guid="_a90a0d0b-fe54-4635-bd78-a53f3c8e3577">Preamble</heading><block align="left"><txt break.before="1">Parliament’s reasons for enacting this Act are—</txt></block><block><list number.type="manual" unnumbered.indent="0"><li id="frnt-preamble-para1.1" guid="_f0ffe18d-b348-423a-a197-7da28319482d" provision.type="other" affected.by.uncommenced="0"><no>1</no><block><txt break.before="0">The Commonwealth and the States have agreed to a cooperative scheme to apply the criminal law of the States extraterritorially in the areas adjacent to the coast of Australia.</txt></block></li><li id="frnt-preamble-para1.2" guid="_9c84364d-f536-4b09-b29f-0ff94bc497e3" provision.type="other" affected.by.uncommenced="0"><no>2</no><block><txt break.before="0">Under the scheme, the criminal law of each State is to apply in the area adjacent to the State—</txt><list number.type="manual" unnumbered.indent="0"><li id="frnt-preamble-para1.2-para2.a" guid="_4b8a0d0b-d6da-48d5-b77a-a33835d9e8bc" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for a distance of 12 nautical miles from the baseline for the State—by force of the law of the State; and</txt></block></li><li id="frnt-preamble-para1.2-para2.b" guid="_bab10921-fefe-45b1-b994-f90e9ae073ae" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">beyond 12 nautical miles up to a distance of 200 nautical miles from the baseline for the State or the outer limit of the continental shelf (whichever is the greater distance)—by force of the law of the Commonwealth.</txt></block></li></list></block></li><li id="frnt-preamble-para1.3" guid="_b212d816-e378-4828-81ce-044a82984a28" provision.type="other" affected.by.uncommenced="0"><no>3</no><block><txt break.before="0">Responsibility for administering criminal justice in the area covered by the scheme will be divided between the Commonwealth and the States under the scheme and an intergovernmental agreement.</txt></block></li><li id="frnt-preamble-para1.4" guid="_03aefebd-b41d-4b7b-bbd4-9f5e89a814d8" provision.type="other" affected.by.uncommenced="0"><no>4</no><block><txt break.before="0">The purpose of this Act is to give legal force to the scheme (so far as it depends on the legislative power of the State) and to provide for consequential vesting of judicial and other powers.</txt></block></li></list></block></preamble></front><body numbering.style="manual"><clause id="sec.1" title</heading><block><txt break.before="1">This Act may be cited as the <legref jurisd="QLD" type="act" target.doc.id="act-2001-019" target.version.series="c09bdc37-3889-453b-96e9-d9ebd19a5278" check="valid"><name emphasis="yes">Crimes at Sea Act 2001</name></legref>.</txt></block></clause><clause id="sec.2" guid="_d082c242-6fcd-4cde-b81d-0055ad28f8ac" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_0b257d97-ffe1-43a8-9494-0317abb11c21">Commencement</heading><block><txt break.before="1">This Act commences on a day to be fixed by proclamation.</txt></block></clause><clause id="sec.3" guid="_1f5ef92d-38a2-4690-a4dc-f5ee0fbef4b1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_6c65049b-465c-47fe-8c87-625cd1f412b5">Definitions</heading><block><txt break.before="1">In this Act—</txt><deflist><definition id="sec.3-def.cooperativescheme_" guid="_e96a8be9-6bd5-4e40-abf8-d2e20a2baa5f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.cooperativescheme" guid="_26a97549-e16a-486f-9054-3b846ccb1439" type="definition">cooperative scheme</defterm> means the legislative and administrative scheme for applying and enforcing criminal law in the areas adjacent to the coast of Australia set out in the schedule.</txt></definition><definition id="sec.3-def.intergovernmentalagreement_" guid="_e015016e-38de-4e59-bf07-6730825a82c9" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.intergovernmentalagreement" guid="_9a5cd141-9d6d-4b20-b79a-6c4a862baa36" type="definition">intergovernmental agreement</defterm> means the agreement entered into under clause 5 of the schedule.</txt></definition></deflist></block></clause><clause id="sec.4" guid="_cfe9e0df-4913-44a4-a2be-f097f66eafc9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_8d44cd3b-f6a6-47be-8a37-80df96069335">Ratification of cooperative scheme</heading><block><txt break.before="1">To the extent that it lies within the legislative competence of the State to give the cooperative scheme the force of law, it has the force of law.</txt></block></clause><clause id="sec.5" guid="_78a99b6c-23cc-4851-8e70-b77d5c9cc0c3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_f5a8a950-8fe1-40e0-b136-ec4289da3cca">Classification of offences</heading><block><txt break.before="1">Offences (other than offences arising under the law of the State) are classified for the purposes of the cooperative scheme as follows—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.a" guid="_c5c52cdf-39ce-449b-bd74-14a229d79685" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the maximum penalty for the offence is a fine or imprisonment for not more than 2 years, the offence is classified as a summary offence;</txt></block></li><li id="sec.5-para1.b" guid="_5be8fdd6-59aa-4897-aefa-30d169f3f3b7" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the maximum penalty for the offence is (or includes) imprisonment for more than 2 years but not more than 5 years, the offence is classified as a misdemeanour;</txt></block></li><li id="sec.5-para1.c" guid="_23a4731a-ac01-4d5a-af54-472acbc003ef" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">if the maximum penalty for the offence is (or includes) imprisonment for more than 5 years or for an indeterminate term, the offence is classified as a crime.</txt></block></li></list></block></clause><clause id="sec.6" guid="_81760cf2-ab11-422c-ae4a-408e07d69af8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_bedc8811-c54a-492e-9b92-6c2dc8484fb0">Publication of intergovernmental agreement</heading><block><txt break.before="1">The Minister must have the intergovernmental agreement, and any amendment to the intergovernmental agreement, published in the Gazette.</txt></block></clause><clause id="sec.7" guid="_1cd87ded-000b-4452-b500-93f902bdf3ba" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_40a1003b-e5b8-414f-a3a9-12259b1b5cee">No effect on <legref jurisd="CTH" type="act" target.doc.id="act-1991-139" target.version.series="C2004A04214" check="valid"><name emphasis="no">Crimes (Aviation) Act 1991</name> (Cwlth)</legref></heading><block><txt break.before="1">This Act and the cooperative scheme do not apply to an act or omission to which the <legref jurisd="CTH" type="act" target.doc.id="act-1991-139" target.version.series="C2004A04214" check="valid"><name emphasis="yes">Crimes (Aviation) Act 1991</name> (Cwlth)</legref>, <legref jurisd="CTH" type="act" refid="sec.15" check="invalid">section&#160;15</legref>, applies.</txt></block></clause><clause id="sec.8" guid="_bb8c8c54-1d0c-4122-92f7-e6162982f72e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_3a43b6ed-4a22-47e8-ae5c-a9b40fb3930f">Regulation-making power</heading><subclause id="sec.8-ssec.1" guid="_4b172bbd-39b9-4826-aff8-e5c02602505a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Governor in Council may make regulations under this Act.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_2d0af61c-9606-46df-936f-a1c80180e092" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, this section does not authorise the making of section&#160;14A, the Criminal Code, section&#160;14A continues to apply, in relation to acts and omissions that took place before the commencement of section&#160;9, as if the Criminal Code, id="sch-sec.1-ssec.1-def.indictableoffence" guid="_083b37a5-76d9-44dc-8349-ec34d71ba169" type="definition">indictable offence</defterm> means an offence for which a charge may be laid by indictment or an equivalent process (whether that is the only, or an optional, way to lay a charge of the offence).</txt></definition><definition id="sch-sec.1-ssec.1-def.inneradjacentarea_" guid="_e6b154c8-4c1b-4738-8ae5-cf8b4518afbb" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.inneradjacentarea" guid="_05f36c1e-aef1-487e-92d0-cae1c1226936" type="definition">inner adjacent area</defterm> for a State means the parts of the adjacent area for the State that are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.1-ssec.1-def.inneradjacentarea-para1.a" guid="_8cd74a2d-b70a-48ab-9c00-6bf611f2cd9f" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">on the landward side of the baseline for the State; and</txt></block></li><li id="sch-sec.1-ssec.1-def.inneradjacentarea-para1.b" guid="_1c8b1656-8ca7-4d68-b899-8f1c847ab49f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">on the seaward side, but within 12 nautical miles from, the baseline for the State.</txt></block></li></list></definition><definition id="sch-sec.1-ssec.1-def.intergovernmentalagreement_" guid="_316feaba-1817-44dc-a598-ad01f9d65bac" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.intergovernmentalagreement" guid="_7515092a-d13e-46d4-87d7-1a263f3222b4" type="definition">intergovernmental agreement</defterm> means the agreement entered into under clause 5 of this schedule.</txt></definition><definition id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence_" guid="_1ef13059-83fc-42f8-b8ff-2437b110f9cc" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence" guid="_736301b5-4cd5-4293-ab6d-12ce3d78131d" type="definition">law of criminal investigation, procedure and evidence</defterm> means law (including unwritten law) about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence-para1.a" guid="_c86c0a18-f90f-4336-a41e-aead934684dc" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the investigation of offences (including coronial inquiry); or</txt></block></li><li id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence-para1.b" guid="_a044e682-ec73-4d2d-ac8e-cbc8bd31801b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">immunity from prosecution and undertakings about the use of evidence; or</txt></block></li><li id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence-para1.c" guid="_03fdc436-1c3a-425e-9f61-9b2730a6d370" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the arrest and custody of offenders or suspected offenders; or</txt></block></li><li id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence-para1.d" guid="_83c54a26-d838-4838-8c49-c68f3499695a" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">bail; or</txt></block></li><li id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence-para1.e" guid="_23c22f1d-807f-4022-8bcd-6255eb17a851" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">the laying of charges; or</txt></block></li><li id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence-para1.f" guid="_49c1bcd6-237f-4e7a-a4f2-808c5f3b0fd3" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">the capacity to plead to a charge, or to stand trial on a charge; or</txt></block></li><li id="sch-sec.1-ssec.1-def.lawofcriminalinvestigationprocedureandevidence-para1.g" guid="_3853d517-4932-4080-a0ea-9cf070fb71b6" provision.type="other" affected.by.uncommenced="0"><no>(g)</no><block><txt break.before="0">the classification of offences as indictable or summary offences (and sub-classification within those classes); break.before="1"><defterm id="sch-sec.1-ssec.1-def.maritimeoffence" guid="_a47040d1-055d-4550-9c95-bfc2d2597702" type="definition">maritime offence</defterm> means an offence against a law that applies in the adjacent area for a State under this scheme.</txt></definition><definition id="sch-sec.1-ssec.1-def.offence_" guid="_f5d79e6c-454a-4c99-aaa3-78ef08421ddb" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.offence" guid="_2a0efa7c-fc8f-42cb-83ee-adb18d622535" type="definition">offence</defterm> means an indictable or summary offence.</txt></definition><definition id="sch-sec.1-ssec.1-def.outeradjacentarea_" guid="_7e385bf0-d8a8-4184-8afc-ccf77083818e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.outeradjacentarea" guid="_6848fee6-121f-4a17-8cb8-6629d113353e" type="definition">outer adjacent area</defterm> for a State means the part of the adjacent area for the State that is outside the inner adjacent area for the State.</txt></definition><definition id="sch-sec.1-ssec.1-def.participatingStateMinister_" guid="_e8768887-5097-428c-b06b-5870631779bd" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.participatingStateMinister" guid="_43a2ffde-4389-4ff9-8281-07659bb25332" type="definition">participating State Minister</defterm> means a Minister responsible for administering a State Act that gives effect to this scheme.</txt></definition><definition id="sch-sec.1-ssec.1-def.ship_" guid="_a9c96b89-fa23-4ba8-91ee-985df4064f4f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.ship" guid="_a5c6467b-5da2-48ee-a513-dd7536059ad8" type="definition">ship</defterm> means a vessel or boat of any description and includes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.1-ssec.1-def.ship-para1.a" guid="_fd2374e6-3e8f-4e1a-96d0-79224c504d1c" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a floating structure; and</txt></block></li><li id="sch-sec.1-ssec.1-def.ship-para1.b" guid="_7d74fa9d-9ba4-46c0-ab26-5a34966e4b6f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a hovercraft or other similar craft.</txt></block></li></list></definition><definition id="sch-sec.1-ssec.1-def.State_" guid="_684e5a9d-c6f6-4653-a58f-c24b9890f286" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.State" guid="_10f0788a-5a44-49bf-ae86-2873d4b2a8cc" type="definition">State</defterm> includes the Northern Territory.</txt></definition><definition id="sch-sec.1-ssec.1-def.substantivecriminallaw_" guid="_e3e2383f-71f7-4db3-ae30-adf5b0898a21" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch-sec.1-ssec.1-def.substantivecriminallaw" guid="_275f32cb-cb2f-4583-90d1-6d9b34112cc0" type="definition">substantive criminal law</defterm> means law (including unwritten law)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.1-ssec.1-def.substantivecriminallaw-para1.a" guid="_8614989f-92cb-4dd6-ace1-092fe3e830bc" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">creating offences or imposing criminal liability for offences; or</txt></block></li><li id="sch-sec.1-ssec.1-def.substantivecriminallaw-para1.b" guid="_47908d05-87f4-4952-848f-0224d5582d97" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">dealing with capacity to incur criminal liability; or</txt></block></li><li id="sch-sec.1-ssec.1-def.substantivecriminallaw-para1.c" guid="_efbb14ba-dc4f-4d9a-bb73-9041107552fd" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">providing a defence or for reduction of the degree of criminal liability; or</txt></block></li><li vehicle at a speed exceeding a prescribed limit on a road could not apply in an adjacent area because of the inherent localising elements of the offence. or</txt></block></li></list></block></li><li id="sch-sec.3-ssec.1-def.Statejudicialproceeding-para1.b" guid="_6aba5fc4-7b2d-48b9-8ae8-70e18ce574eb" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a judicial proceeding about an investigation, procedure or act by an authority of a State in relation to a maritime offence.</txt></block></li></list></definition></deflist></block></subclause><subclause id="sch-sec.3-ssec.2" guid="_9da6cf22-4a05-40fe-9656-4289709ce424" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The laws of criminal investigation, procedure and evidence of the Commonwealth and the States apply to maritime offences as follows—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.3-ssec.2-para1.a" guid="_22c2ce0c-6314-4bf4-a258-5e6346bbd0e0" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the law of the Commonwealth applies to investigations, procedures and acts (other than judicial proceedings) by authorities of the Commonwealth; and</txt></block></li><li id="sch-sec.3-ssec.2-para1.b" guid="_fe60e202-b316-406f-9179-d9e3726981a5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the law of a State applies to investigations, procedures and acts (other than judicial proceedings) by authorities of the State operating within the area of administrative responsibility for the relevant State; and</txt></block></li><li id="sch-sec.3-ssec.2-para1.c" guid="_e96c92ee-5f3e-4b10-846f-ae63717b8a51" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">in a Commonwealth judicial proceeding the law of the Commonwealth applies and in a State judicial proceeding, the law of the State in which the proceeding was commenced applies (subject to the Constitution) irrespective of whether—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch-sec.3-ssec.2-para1.c-para2.i" guid="_1dd08e2a-c193-4425-8add-f9fa0192ef67" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the maritime offence arises under the law of the State in which the proceeding was commenced or another State; id="sch-sec.14-ssec.4-para1.a-para2.i" guid="_fde43407-816f-46c5-b456-3bffc46cf073" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">is within the outer limits of the continental shelf; and</txt></block></li><li id="sch-sec.14-ssec.4-para1.a-para2.ii" guid="_754fe4f6-a0ee-474d-a8dd-a3d55ad9c3e8" provision.type="other"
