guid="_9a926cb5-1161-4be0-92b6-c5205723a5d7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.CommonwealthCreditinstrument" guid="_33e5b8f9-91f4-4bef-a183-d1620013cff3" type="definition">Commonwealth Credit instrument</defterm> means any instrument (whether or not of a legislative character) that is made or issued under the National Credit legislation.</txt></definition><definition id="sec.3-def.expressamendment_" guid="_5cf32676-0205-4d93-bcc8-2e7cde33bf40" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.expressamendment" guid="_1f0baa2c-b1c0-4812-81a7-e10cb867f7b6" type="definition">express amendment</defterm> of the National Credit legislation means the direct amendment of the text of the National Credit legislation (whether by the insertion, omission, repeal, substitution or relocation of words or matter) by another Commonwealth Act or by an instrument under a Commonwealth Act, but does not include the enactment by a Commonwealth Act of a provision that has or will have substantive effect otherwise than as part of the text of the National Credit legislation.</txt></definition><definition id="sec.3-def.NationalCreditlegislation_" guid="_43fc4e06-abee-4fa1-afbc-39dbd2b4a417" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.NationalCreditlegislation" guid="_d14c10b8-a828-43b8-9a42-64b0d247fb69" type="definition">National Credit legislation</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-def.NationalCreditlegislation-para1.a" guid="_1b53b482-0c58-41e4-ab07-c23cc02e098d" provision.type="other"><no>(a)</no><block><txt break.before="0">the <legref jurisd="CTH" type="act" target.doc.id="act-2009-134" target.version.series="C2009A00134" check="valid"><name emphasis="yes">National Consumer Credit Protection Act 2009</name> (Cwlth)</legref>; and</txt></block></li><li id="sec.3-def.NationalCreditlegislation-para1.b" guid="_31151e0a-61c3-4347-a568-0c5e44dc6f3e" provision.type="other"><no>(b)</no><block><txt break.before="0">the <legref jurisd="CTH" type="act" target.doc.id="act-2009-135" target.version.series="C2009A00135" check="valid"><name emphasis="yes">National Consumer Credit Protection (Transitional and Consequential Provisions) Act 2009</name> (Cwlth)</legref>;</txt></block></li></list><txt break.before="1">as in force from time to time.</txt></definition><definition id="sec.3-def.referredcreditmatter_" guid="_050753cd-a721-4f6a-84e4-d96dc2cdbe66" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.referredcreditmatter" guid="_733ad165-b8b3-40c7-b929-aec19ffd62bc" type="definition">referred credit matter</defterm> means a matter relating to either of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-def.referredcreditmatter-para1.a" guid="_b2211628-18bb-4a18-9aac-7306f18bf778" provision.type="other"><no>(a)</no><block><txt break.before="0">credit, being credit the provision of which would be covered by the expression ‘provision of credit to which this Code applies’ in the relevant version of the National Credit Code;</txt></block></li><li id="sec.3-def.referredcreditmatter-para1.b" guid="_bcd16b82-ff74-4651-91cd-d71b5fc10bcc" provision.type="other"><no>(b)</no><block><txt break.before="0">consumer leases, being consumer leases each of which would be covered by the expression ‘consumer lease to which <legref jurisd="QLD" type="act" check="invalid">Part&#160;11</legref> applies’ in the relevant version of the National Credit Code.</txt></block></li></list></definition><definition id="sec.3-def.relevantversionoftheNationalCreditCode_" guid="_f1417a54-476f-4a5a-8a00-0d46e5bc6009" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.relevantversionoftheNationalCreditCode" guid="_b6391634-a40b-4e9a-9275-a69a0d80ab94" type="definition">relevant version of the National Credit Code</defterm> jurisd="CTH" type="act" target.doc.id="act-2010-009" target.version.series="C2010A00009" check="valid"><name emphasis="yes">National Consumer Credit Protection Amendment Act 2010</name> legislation</heading><subclause id="sec.4-ssec.1" guid="_71f2348b-fc1b-4ded-81e9-389c93c49a3a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The relevant version of the National Credit legislation is adopted within the meaning of <intref refid="sec.51" check="invalid">section&#160;51</intref><intref refid="sec.51-para1.xxxvii" check="invalid">(xxxvii)</intref> of the Commonwealth Constitution.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_d5ce1fc7-8c5e-4f43-8f4f-7762cd4818ff" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The adoption has effect for a period—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.2-para1.a" target.guid="_81c78f19-35b3-43f1-a668-e3ada0a91888" check="valid">section&#160;5</intref> as the day on which the adoption is to terminate;</txt></block></li></list></block><block><txt break.before="1">but no longer.</txt></block></subclause></clause><clause id="sec.5" guid="_81c78f19-35b3-43f1-a668-e3ada0a91888" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_f455e4d9-2746-44bc-b161-686018ba9d6c">Termination of adoption</heading><subclause id="sec.5-ssec.1" guid="_c2f96ed3-7931-46c8-b4c4-1f90c3a71676" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Governor may, at any time, by proclamation published in the gazette, fix a day as the day on which the adoption terminates.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_c2c1004d-0dc4-46df-951a-a0e943dc7bdb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Governor may, by proclamation published in the gazette, revoke a proclamation published under <intref refid="sec.5-ssec.1" target.guid="_c2f96ed3-7931-46c8-b4c4-1f90c3a71676" check="valid">subsection&#160;(1)</intref>, in which case the revoked proclamation is taken (for the purposes of <intref refid="sec.4" target.guid="_4171160b-d949-461e-a2b0-135167c23bd6" check="valid">section&#160;4</intref>) never to have been published.</txt></block></subclause><subclause id="sec.5-ssec.3" guid="_2b2ff658-c583-47fd-9fec-44b723135f7f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A revoking proclamation has effect only if published before the day fixed under <intref refid="sec.5-ssec.1" target.guid="_c2f96ed3-7931-46c8-b4c4-1f90c3a71676" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.5-ssec.4" provision.type="other"><no>(1)</no><block><txt break.before="0">Subject to <intref refid="sec.7" target.guid="_105f04b2-2fce-4ed7-b084-e658ee601472" check="valid">section&#160;7</intref>, any referred credit matter is referred to the Parliament of the Commonwealth, but only to the extent of the making of laws with respect to such a matter by making express amendments of the National Credit legislation.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_5b63f0ee-0b79-4550-8c50-a4b4167faf6e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt forfeiture.</txt></definition><definition id="sec.7-ssec.2-def.Statelaw_" guid="_194b85b3-be61-4d3a-876f-68d528d8f8f1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.2-def.Statelaw" guid="_f6b8aa24-26b8-447b-a3f4-8c95fd15ce13" type="definition">State law</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-def.Statelaw-para1.a" guid="_328ece38-7b30-4c02-bce0-a940f8dbb7ed" provision.type="other"><no>(a)</no><block><txt break.before="0">any Act of the State or any instrument made under such an Act, whenever enacted or made and as in force from time to time; or</txt></block></li><li id="sec.7-ssec.2-def.Statelaw-para1.b" guid="_b3168aa2-b803-4c68-ad23-765a6b00d028" provision.type="other"><no>(b)</no><block><txt break.before="0">the general law, being the principles and rules of common law and equity to the extent they have effect in the State from time to time.</txt></block></li></list></definition><definition id="sec.7-ssec.2-def.Statestatutoryright_" guid="_aa053f38-b84e-4579-af60-bcc3471c5f5e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.2-def.Statestatutoryright" guid="_87b38697-2589-4d80-a2fe-58be0f6210f0" type="definition">State statutory right</defterm> means a right, entitlement or authority granted by or under any Act of the State or any instrument made under such an Act, whenever enacted or made and as in force from time to time, other than a right, entitlement or authority relating to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-def.Statestatutoryright-para1.a" guid="_967f14e2-e8e5-4238-a630-cef1291851ac" provision.type="other"><no>(a)</no><block><txt break.before="0">credit covered by <intref refid="sec.7-ssec.2-def.Statestatutoryright-para1.a" target.guid="_967f14e2-e8e5-4238-a630-cef1291851ac" check="valid">paragraph&#160;(a)</intref> of the definition of <defterm guid="_a880937f-ade1-4c74-ad03-6074935036ec" type="mention">referred credit matter</defterm> in <intref refid="sec.3" target.guid="_ece92c36-49c1-4aa5-a4d8-696b7f9eae2c" check="valid">section&#160;3</intref>; or</txt></block></li><li id="sec.7-ssec.2-def.Statestatutoryright-para1.b" guid="_8d009a27-01d8-4c77-b32c-d30142db11e8" provision.type="other"><no>(b)</no><block><txt break.before="0">a consumer lease covered by <intref refid="sec.7-ssec.2-def.Statestatutoryright-para1.b" target.guid="_8d009a27-01d8-4c77-b32c-d30142db11e8" check="valid">paragraph&#160;(b)</intref> of that definition.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.8" guid="_c264c312-b29f-432c-beee-4b89db70b520" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_4766b783-bc47-4ead-9abc-1756ce22d1ad">Termination of reference</heading><subclause id="sec.8-ssec.1" guid="_126f72d7-859a-4211-8622-3a5a5982d519" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Governor may, at any time, by proclamation published in the gazette, fix a day as the day on which the amendment reference terminates.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_3d24405b-2833-4468-a864-62039ed027e7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The Governor may, by proclamation published in the gazette, revoke a proclamation published under <intref refid="sec.8-ssec.1" target.guid="_126f72d7-859a-4211-8622-3a5a5982d519" check="valid">subsection&#160;(1)</intref>, in which case the revoked proclamation is taken (for the purposes of <intref refid="sec.6" target.guid="_294f712e-7410-403b-bd02-deeb4c4595f0" check="valid">section&#160;6</intref>) never to have been published.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_0ae2c9db-7931-4403-bf07-adbb5aaebbee" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A revoking proclamation has effect only if published before the day fixed under <intref refid="sec.8-ssec.1" id="sec.9-he" guid="_21b80b2c-4748-42f3-a0c7-a235020d721e">Amendment of Commonwealth law</heading><block><txt break.before="1">For the avoidance of doubt, it is the intention of the Parliament of the State that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-para1.a" guid="_a8685ae2-5465-4c7e-9a50-b36a676b5b2e" provision.type="other"><no>(a)</no><block><txt break.before="0">the National Credit legislation may be expressly amended, or have its operation otherwise affected, at any time after the commencement of this Act by provisions of Commonwealth Acts the operation of which is based on any legislative powers that the Parliament of the Commonwealth has on account of a reference of any matters, or the adoption of the relevant version of the National Credit legislation, under <legref jurisd="QLD" type="act" refid="sec.51" check="invalid">section&#160;51</legref> (xxxvii) of the Commonwealth Constitution; and</txt></block></li><li id="sec.9-para1.b" guid="_2525d12a-3cb1-4cf4-b1c5-049f16a808ba" provision.type="other"><no>(b)</no><block><txt break.before="0">the National Credit legislation may be expressly amended, or have its operation otherwise affected, at any time after the commencement of this Act by provisions of Commonwealth Acts the operation of which is based on legislative powers that the Parliament of the Commonwealth has apart from a reference of any matters, or the adoption of the relevant version of the National Credit legislation, under <legref jurisd="QLD" type="act" refid="sec.51" check="invalid">section&#160;51</legref><legref jurisd="QLD" type="act" refid="sec.51-para1.xxxvii" check="invalid">(xxxvii)</legref> of the Commonwealth Constitution; and</txt></block></li><li id="sec.9-para1.c" guid="_1294619f-5ec4-4f32-be69-2bdb8414dd9a" provision.type="other"><no>(c)</no><block><txt break.before="0">the National Credit legislation may have its operation affected, otherwise than by express amendment, at any time by provisions of Commonwealth Credit instruments.</txt></block></li></list></block></clause><clause id="sec.10" guid="_bd81ca8a-b4ee-489f-8d02-fd643f125cc8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_6e2f0d91-edc5-4f9f-b010-35aa97ce0697">Effect of termination of amendment reference before termination of adoption of Commonwealth Acts</heading><subclause id="sec.10-ssec.1" guid="_38424fd1-f694-484c-b490-d9196f1e2cc2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the amendment reference is terminated but the adoption of the relevant version of the National Credit legislation is not terminated, the termination of the amendment reference does not affect—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_5186edfa-89ce-4bc3-888e-b74d79325f1d" provision.type="other"><no>(a)</no><block><txt break.before="0">laws that were made under the amendment reference (but not repealed) before that termination (whether or not they have come into operation before that termination); or</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_55ed1b75-aaf0-4a76-b6c7-1118175b2acd" provision.type="other"><no>(b)</no><block><txt break.before="0">the continued operation in this State of the National Credit legislation as in operation immediately before that termination or as subsequently amended or affected by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.b-para2.i" guid="_37ae6a9d-799d-474c-8d95-1df6135b8658" provision.type="other"><no>(i)</no><block><txt break.before="0">laws referred to in <intref refid="sec.10-ssec.1-para1.a" target.guid="_5186edfa-89ce-4bc3-888e-b74d79325f1d" check="valid">paragraph&#160;(a)</intref> that come into operation after that termination; or</txt></block></li><li id="sec.10-ssec.1-para1.b-para2.ii" guid="_0cbe1b15-fdbe-4fed-8ff2-377eea558a5e" provision.type="other"><no>(ii)</no><block><txt break.before="0">provisions referred to in <intref refid="sec.9" target.guid="_3a00b946-3c60-4bef-b98e-58b357baf0a1" check="valid">section&#160;9</intref><intref refid="sec.9-para1.b" target.guid="_2525d12a-3cb1-4cf4-b1c5-049f16a808ba" check="valid">(b)</intref> or <intref refid="sec.9-para1.c" target.guid="_1294619f-5ec4-4f32-be69-2bdb8414dd9a" check="valid">(c)</intref>.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.10-ssec.2" guid="_c94610df-e4b7-477b-9edb-200ceb4a91c7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Accordingly, the amendment reference continues to have effect for the purposes of <intref refid="sec.10-ssec.1" target.guid="_38424fd1-f694-484c-b490-d9196f1e2cc2" check="valid">subsection&#160;(1)</intref> unless the adoption is terminated.</txt></block></subclause><subclause id="sec.10-ssec.3" guid="_f90aa5b7-9b44-4faf-b7b0-4cfc6a19a685" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sec.10-ssec.1" target.guid="_38424fd1-f694-484c-b490-d9196f1e2cc2" check="valid">Subsection&#160;(1)</intref> does not apply to or in relation to an amendment of the National Credit legislation that is excluded from the operation of this section by the proclamation that terminates the amendment reference.</txt></block></subclause><subclause id="sec.10-ssec.4" guid="_fbd0a9ae-e17e-415d-81a2-aedda3c62992" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For the purposes of <intref refid="sec.10-ssec.1" provision.type="other"><no>(d)</no><block><txt break.before="0">consumer surveys;</txt></block></li><li id="sec.19-ssec.1-para1.e" guid="_b686dcd6-81f8-4ced-a174-3267c4db9d92" provision.type="other"><no>(e)</no><block><txt break.before="0">other consumer-related initiatives;</txt></block></li><li id="sec.19-ssec.1-para1.f" guid="_a456ad83-53b3-429d-bfce-c3fd68ea24af" provision.type="other"><no>(f)</no><block><txt break.before="0">legal fees incurred by the chief executive, or costs awarded by a court against the chief executive, in a proceeding under the repealed Act;</txt></block></li><li id="sec.19-ssec.1-para1.g" guid="_0ad7e0f6-2344-4176-b35f-fe8d617c52dc" provision.type="other"><no>(g)</no><block><txt break.before="0">legal fees incurred by the registrar, or costs awarded by a court against the registrar, in a proceeding under the repealed <legref jurisd="QLD" type="act" target.doc.id="act-1987-052" id="sec.25-ssec.1" guid="_c4f6c6c4-d146-4de8-b5c4-4f86d8c38a32" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies for the purpose of the monitoring, enforcement and administration generally of the repealed <legref jurisd="QLD" type="act" target.doc.id="act-1994-051" target.version.series="ae419a07-c3fe-499d-8a72-5d2e4fb45074" check="valid"><name emphasis="yes">Consumer Credit (Queensland) Act 1994</name></legref> (the <defterm id="sec.25-def.repealedAct" guid="_1ef15e4e-a624-4dc1-a3f0-30e7d56e6f5c" type="definition">repealed Act</defterm>), including the repealed Act as continued in effect for any purpose.</txt></block></subclause><subclause id="sec.25-ssec.2" guid="_3aa8ae75-3870-4067-a6f3-ba2a6b3e4af9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The repealed Act, parts&#160;7 and 9, and anything done under those parts, continues to apply as if the parts had not been repealed.</txt></block></subclause><subclause id="sec.25-ssec.3" guid="_f64a4d53-1139-4c8c-9df2-ba496e2f3b27" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">To remove any doubt, it is declared that a person holding an appointment as an inspector under section&#160;33(3) is authorised to writing by the Minister, may enter into an agreement or arrangement with ASIC for the performance of functions or the exercise of powers by ASIC as an agent of the State, even if those functions or powers are or may be conferred on another person or body by or under a law of the State.</txt></block></subclause><subclause id="sec.29-ssec.2" guid="_d44e1a22-dc74-4a8a-82d3-fbdb0f0b330d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An agreement or arrangement of a kind mentioned in subsection&#160;(1) has effect by force of this section
