id="frnt-preamble" guid="_f370f447-a7c7-4911-8263-a3f924375b9e"><block><txt break.before="1">WHEREAS inconvenience and expense have occasionally been caused to litigants by jurisdictional limitations in federal, State and Territory courts, and whereas it is desirable—</txt><list number.type="manual" unnumbered.indent="0"><li id="frnt-preamble-para1.a" guid="_1e361c03-ef67-4c0d-b9ca-e6ca9cf4fa35" provision.type="other"><no>(a)</no><block><txt break.before="0">to establish a system of cross-vesting of jurisdiction between those courts, without detracting from the existing jurisdiction of any court; and</txt></block></li><li id="frnt-preamble-para1.b" guid="_53622e0f-a6ba-4b61-b8ac-8eae524051e4" provision.type="other"><no>(b)</no><block><txt break.before="0">to structure the system in such a way as to ensure as far as practicable that proceedings concerning matters which, apart from this Act and any law of the Commonwealth or another State relating to cross-vesting of jurisdiction, would be entirely or substantially within the jurisdiction (other than any accrued jurisdiction) of the Federal Court or the Family Court or the jurisdiction of a Supreme Court of a State or Territory are instituted and determined in that court, whilst providing for the determination by one court of federal and State matters in appropriate cases; and</txt></block></li><li id="frnt-preamble-para1.c" guid="_e7a90d29-b384-40a1-9aae-1dac350ffc8c" provision.type="other"><no>(c)</no><block><txt break.before="0">if a proceeding is instituted in a court that is not the appropriate court, to provide a system under which the proceeding will be transferred to the appropriate court.</txt></block></li></list></block></preamble></front><body numbering.style="manual"><clause id="sec.1" title</heading><block><txt break.before="1">This Act may be cited as the <legref jurisd="QLD" type="act" target.doc.id="act-1987-088" target.version.series="d6b3e778-bc66-4e2a-8a9a-86622fb7fd58" check="valid"><name emphasis="yes">Jurisdiction of Courts (Cross-vesting) Act 1987</name></legref>.</txt></block></clause><clause id="sec.2" guid="_74a10a67-b46d-4c69-a146-e3ae6b233953" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_9caaa309-ad02-491c-a2f0-bd4c908d737f">Commencement</heading><subclause id="sec.2-ssec.1" guid="_74d8a5a0-522d-4215-af31-6b40538ee870" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0"><intref refid="sec.1" target.guid="_4586f30d-deeb-49bd-80d1-e39e3efb3e8b" check="valid">Section&#160;1</intref> and this section shall commence on the date on which this Act is assented to for and on behalf of Her Majesty.</txt></block></subclause><subclause id="sec.2-ssec.2" guid="_56ebd03e-4c8e-44e4-9de6-584373350d83" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Except as provided by <intref refid="sec.2-ssec.1" target.guid="_74d8a5a0-522d-4215-af31-6b40538ee870" check="valid">subsection&#160;(1)</intref>, this Act shall commence on a day provision.type="other"><no>3</no><heading id="sec.3-he" guid="_4260cf2c-5c59-4b89-b359-ef99c6757e21">Interpretation</heading><subclause id="sec.3-ssec.1" guid="_2ab1f605-5a5c-49eb-80b4-f4ae2d2064a4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">In this Act—</txt><deflist><definition id="sec.3-ssec.1-def.FamilyCourt_" guid="_042403ef-7754-461a-8b4d-03cb448ab60b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.FamilyCourt" guid="_ef3c4b91-5368-41b4-bb1d-2b1b49536d81" type="definition">Family Court</defterm> means the Family Court of Australia.</txt></definition><definition id="sec.3-ssec.1-def.FederalCourt_" guid="_4da0e242-6540-4103-a0c5-0fcd2511328a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.FederalCourt" guid="_2996322f-16df-4b1b-a1b0-1820d5304ef9" type="definition">Federal Court</defterm> means the Federal Court of Australia.</txt></definition><definition id="sec.3-ssec.1-def.FullCourt_" guid="_b84c4bc4-6c2f-41dd-a922-140e3a18dac1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.FullCourt" guid="_7c15b958-0e36-4eb6-b579-bd9d235eb05b" type="definition">Full Court</defterm>, in relation to a Supreme Court of a State, includes any court of the State to which appeals lie from a single Judge of that Supreme Court.</txt></definition><definition id="sec.3-ssec.1-def.judgment_" guid="_a16a716d-350b-4d77-9e43-44c3b3f01fd7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.judgment" guid="_b342c489-9689-44b8-a7e4-5ee4a2a095d7" type="definition">judgment</defterm> means a judgment, decree or order, whether final or interlocutory.</txt></definition><definition id="sec.3-ssec.1-def.party_" guid="_3bec5846-507d-4854-b1fc-a8efa79a5c7c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.party" guid="_faf08ada-e1ae-4a4e-831d-9dc8a81b8aa9" type="definition">party</defterm>, in relation to a proceeding, includes a person who intervenes in the proceeding.</txt></definition><definition id="sec.3-ssec.1-def.proceeding_" guid="_676f1578-e6d5-4879-b71e-1d7f145ff30e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.proceeding" guid="_ebaea915-4209-403c-a59d-049660e6aae8" type="definition">proceeding</defterm> does not include a criminal proceeding.</txt></definition><definition id="sec.3-ssec.1-def.specialfederalmatter_" guid="_dd794fbd-ce41-434c-91d9-b63ca1294248" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.specialfederalmatter" guid="_fd2910d1-371f-45c1-a4b8-3b5a7eebd221" type="definition">special federal matter</defterm> has the same meaning as in the <legref jurisd="CTH" target.doc.id="act-1987-088" target.version.series="d6b3e778-bc66-4e2a-8a9a-86622fb7fd58" check="valid" type="act"><name emphasis="yes">Jurisdiction of Courts (Cross-vesting) Act 1987</name> (Cwlth)</legref>.</txt></definition><definition id="sec.3-ssec.1-def.State_" guid="_48a2e82b-07ef-4e3c-874b-c023282f57e8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.State" guid="_c9aa43c5-513b-4b6c-a369-67794287c2f8" type="definition">State</defterm> includes the Northern Territory and the Australian Capital Territory.</txt><historynote><txt break.before="1">def <defterm guid="_3705a52e-b674-419e-86bb-8a49e3c4aca7" type="mention">State</defterm> sub <legref jurisd="QLD" type="act" target.doc.id="act-1993-041" target.version.series="e31cd71a-68ae-4c19-a4f2-74761b0fa383" valid.date="as.made" check="valid">1993 No.&#160;41</legref> <legref jurisd="QLD" type="act" refid="sec.4" target.doc.id="act-1993-041" valid.date="as.made" check="invalid">s&#160;4</legref><legref jurisd="QLD" type="act" refid="sec.4-ssec.1" target.doc.id="act-1993-041" valid.date="as.made" check="invalid">(1)</legref>–<legref jurisd="QLD" type="act" refid="sec.4-ssec.2" target.doc.id="act-1993-041" valid.date="as.made" check="invalid">(2)</legref></txt></historynote></definition><definition id="sec.3-ssec.1-def.StateFamilyCourt_" guid="_c1ffcc2c-0ec9-4499-b136-fa7989951a92" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.StateFamilyCourt" 1975</name> (Cwlth)</legref> applies by virtue of a proclamation made under <legref jurisd="CTH" refid="sec.41" check="invalid" type="act">section&#160;41</legref><legref jurisd="CTH" refid="sec.41-ssec.2" check="invalid" type="act">(2)</legref> of that Act.</txt></definition><definition id="sec.3-ssec.1-def.Statematter_" guid="_cd704d2a-6c57-4c9e-9b33-3af9706e79e5" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.Statematter" guid="_586b7b63-aa3b-40e0-87d0-ef2fa229c5ac" type="definition">State matter</defterm> means a break.before="0">If—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_6a737b73-c55f-46f6-8e0a-88deeb80dc99" provision.type="other"><no>(a)</no><block><txt break.before="0">a proceeding (the <defterm id="sec.5-ssec.1-def.relevantproceeding" guid="_7191233b-23fb-4afa-ae2d-1f506a3736b7" type="definition">relevant proceeding</defterm>) is pending in the Supreme Court; and</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_3cfa3ad1-3c6b-45c0-add4-61bf782f5b2e" provision.type="other"><no>(b)</no><block><txt break.before="0">it appears to the Supreme Court that, having regard to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.b-para2.i" guid="_7b70c8a8-9255-4a59-a8c9-64f5d4450663" provision.type="other"><no>(i)</no><block><txt break.before="0">whether, in the opinion of the Supreme Court, apart from any law of the Commonwealth or another State relating to cross-vesting of jurisdiction and apart from any accrued jurisdiction of the Federal Court or the Family Court, the relevant proceeding or a substantial part of the relevant proceeding would have been incapable of being instituted in the Supreme Court and capable of being instituted in the Federal Court or the Family Court; and</txt></block></li><li id="sec.5-ssec.1-para1.b-para2.ii" guid="_14e6b123-db4f-436e-bf0b-3b2eeb1cd855" provision.type="other"><no>(ii)</no><block><txt break.before="0">the extent to which, in the opinion of the Supreme Court, the matters for determination in the relevant proceeding are matters arising under or involving questions as to the application, interpretation or validity of a law of the Commonwealth and not within the jurisdiction of the Supreme Court apart from this Act and any law of the Commonwealth or another State relating to cross-vesting of jurisdiction; and</txt></block></li><li id="sec.5-ssec.1-para1.b-para2.iii" guid="_847845f0-8d1f-4d2c-99dc-58c23c727e77" provision.type="other"><no>(iii)</no><block><txt break.before="0">the interests of justice;</txt></block></li></list></block><block><txt break.before="1">it is more appropriate that the relevant proceeding be determined by the Federal Court or the Family Court, as the case may be;</txt></block></li></list></block><block><txt break.before="1">the Supreme Court must transfer the relevant proceeding to the Federal Court or the Family Court, as the case may be.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_99dec039-06d3-4744-a46d-90f3e377b70b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Where—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_daa040d4-eea6-4636-93ce-63cf48ad6cb4" provision.type="other"><no>(a)</no><block><txt break.before="0">a proceeding (the <defterm id="sec.5-ssec.2-def.relevantproceeding" guid="_e443d2f0-346c-4de9-969c-011f41d0fd32" type="definition">relevant proceeding</defterm>) is pending in the Supreme Court (the <defterm id="sec.5-ssec.2-def.firstcourt" guid="_2ebf9b1b-2e86-4a33-9bc4-ba8d277705e3" type="definition">first court</defterm>); and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_4ee50bc1-15fc-4676-8924-50eb419b5eb5" provision.type="other"><no>(b)</no><block><txt break.before="0">it appears to the first court that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.b-para2.i" guid="_081e9d2f-a6ee-4ff0-9669-48c59a68488b" provision.type="other"><no>(i)</no><block><txt break.before="0">the relevant proceeding arises out of, or is related to, another proceeding pending in the Supreme Court of another State or of a Territory and it is more appropriate that the relevant proceeding be determined by that other Supreme Court; or</txt></block></li><li id="sec.5-ssec.2-para1.b-para2.ii" guid="_d16218fe-601d-4d65-b410-657b25f29668" provision.type="other"><no>(ii)</no><block><txt break.before="0">having regard to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.b-para2.ii-para3.A" guid="_57a9e8fd-d267-4b49-9668-ffabadf2bb5c" provision.type="other"><no>(A)</no><block><txt break.before="0">whether, in the opinion of the first court, apart from this Act and any law of the Commonwealth or another State relating to cross-vesting of jurisdiction, the relevant proceeding or a substantial part of the relevant proceeding would have been incapable of being instituted in the first court and capable of being instituted in the Supreme Court of another State or Territory; and</txt></block></li><li id="sec.5-ssec.2-para1.b-para2.ii-para3.B" guid="_12be2929-a715-4709-8d38-ba5f28851933" provision.type="other"><no>(B)</no><block><txt break.before="0">the extent to which, in the opinion of the first court, the matters for determination in the relevant proceeding are matters arising under or involving questions as to the application, interpretation or validity of a law of the State or Territory referred to in sub-subparagraph (A) and not within the jurisdiction of the first court apart from this Act and any law of the Commonwealth or another State relating to cross-vesting of jurisdiction; and</txt></block></li><li id="sec.5-ssec.2-para1.b-para2.ii-para3.C" guid="_b2dca5b7-bc71-4f5d-8e1a-73e9746cb69c" provision.type="other"><no>(C)</no><block><txt break.before="0">the interests of justice;</txt></block></li></list></block><block><txt break.before="1">it is more appropriate that the relevant proceeding be determined by that other Supreme Court; or</txt></block></li><li id="sec.5-ssec.2-para1.b-para2.iii" guid="_d47a543e-dc5a-455e-bb77-757abba6145a" provision.type="other"><no>(iii)</no><block><txt break.before="0">it is otherwise in the interests of justice that the relevant proceeding be determined by the Supreme Court of another State or of a Territory;</txt></block></li></list></block></li></list></block><block><txt break.before="1">the first court shall transfer the relevant proceeding to that other Supreme Court.</txt></block></subclause><subclause id="sec.5-ssec.3" guid="_e937e5d5-0513-4b05-ab09-c1886ca6e0ec" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Where—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a" guid="_52fa948a-4615-44f5-ace7-95d1f292bcce" provision.type="other"><no>(a)</no><block><txt break.before="0">a proceeding (the <defterm id="sec.5-ssec.3-def.relevantproceeding" guid="_db73fa5b-6d25-4eca-ba4a-faeea2abaa98" type="definition">relevant proceeding</defterm>) is pending in the Supreme Court of another State or of a Territory (the <defterm id="sec.5-ssec.3-def.firstcourt" guid="_ce8a322d-f93c-4544-a4b7-9cde4127be47" type="definition">first court</defterm>); and</txt></block></li><li id="sec.5-ssec.3-para1.b" guid="_4f828125-083f-429b-9b54-7b93ced0f9c1" provision.type="other"><no>(b)</no><block><txt break.before="0">it appears to the first court that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.b-para2.i" guid="_d8c637f4-f915-4427-9f93-3e100491394c" provision.type="other"><no>(i)</no><block><txt break.before="0">the relevant proceeding arises out of, or is related to, another proceeding pending in the Supreme Court of Queensland and it is more appropriate that the relevant proceeding be determined by the Supreme Court of Queensland; or</txt></block></li><li id="sec.5-ssec.3-para1.b-para2.ii" guid="_0185a285-6a3e-48ee-864b-852a6a8531d8" provision.type="other"><no>(ii)</no><block><txt break.before="0">having regard to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.b-para2.ii-para3.A" guid="_30f3ef4e-22d0-4777-90ba-5ca266b76e42" provision.type="other"><no>(A)</no><block><txt break.before="0">whether, in the opinion of the first court, apart from this Act and any law of the Commonwealth or another State relating to cross-vesting of jurisdiction, the relevant proceeding or a substantial part of the relevant proceeding would have been incapable of being instituted in the first court and capable of being instituted in the Supreme Court of Queensland; and</txt></block></li><li id="sec.5-ssec.3-para1.b-para2.ii-para3.B" guid="_be599662-5b2e-4274-981e-46ab16c9cdc5" provision.type="other"><no>(B)</no><block><txt break.before="0">the extent to which, in the opinion of the first court, the matters for determination in the relevant proceeding are matters arising under or involving questions as to the application, interpretation or validity of a law of the State and not within the jurisdiction of the first court apart from this Act and any law of the Commonwealth or another State relating to cross-vesting of jurisdiction; and</txt></block></li><li id="sec.5-ssec.3-para1.b-para2.ii-para3.C" guid="_1ef6ffa0-2462-425a-9a16-dc418374ce1c" provision.type="other"><no>(C)</no><block><txt break.before="0">the interests of justice;</txt></block></li></list></block><block><txt break.before="1">it is more appropriate that the relevant proceeding be determined by the Supreme Court of Queensland; or</txt></block></li><li id="sec.5-ssec.3-para1.b-para2.iii" guid="_073acece-9de0-436f-ba2e-47d99c173828" provision.type="other"><no>(iii)</no><block><txt break.before="0">it is otherwise in the interests of justice that the relevant proceeding be determined by the Supreme Court of Queensland;</txt></block></li></list></block></li></list></block><block><txt break.before="1">the first court shall transfer the relevant proceeding to the Supreme Court of Queensland.</txt></block></subclause><subclause id="sec.5-ssec.4" guid="_0449964b-09c1-446e-a871-9a02a53d807b" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Where—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.4-para1.a" guid="_018ffce4-1cdb-4c1f-9d5a-a1a99e97601d" provision.type="other"><no>(a)</no><block><txt break.before="0">a proceeding (the <defterm id="sec.5-ssec.4-def.relevantproceeding" guid="_1870548b-4819-4d94-a39d-bfc89af3eb23" type="definition">relevant proceeding</defterm>) is pending in the Federal Court or the Family Court (the <defterm id="sec.5-ssec.4-def.firstcourt" guid="_a12bb038-f1ea-484c-b9a1-bb139fec8ff4" type="definition">first court</defterm>); and</txt></block></li><li id="sec.5-ssec.4-para1.b" guid="_d73ce241-04a9-4fb9-bf14-3e64f10579ba" provision.type="other"><no>(b)</no><block><txt break.before="0">it appears to the first court that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.4-para1.b-para2.i" guid="_4d2a39d0-314c-475a-8fc6-bbbc8be3b0af" provision.type="other"><no>(i)</no><block><txt break.before="0">the relevant proceeding arises out of, or is related to, another proceeding pending in the Supreme Court and it is more appropriate that the relevant proceeding be determined by the Supreme Court; or</txt></block></li><li id="sec.5-ssec.4-para1.b-para2.ii" guid="_626d7744-ef9c-4e16-aeee-be1362a1bd32" provision.type="other"><no>(ii)</no><block><txt break.before="0">having regard to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.4-para1.b-para2.ii-para3.A" guid="_0187e2c9-b5d1-4cca-9989-f3bb1d2b24b1" provision.type="other"><no>(A)</no><block><txt break.before="0">whether, in the opinion of the first court, the relevant proceeding or a substantial part of it would have been incapable of being instituted in that court, apart from any law of the Commonwealth or another State relating to cross-vesting of jurisdiction; and</txt></block></li><li id="sec.5-ssec.4-para1.b-para2.ii-para3.B" guid="_82a9ba1e-74b2-4341-b699-0625b70d8e9d" provision.type="other"><no>(B)</no><block><txt break.before="0">whether, in the opinion of the first court, the relevant proceeding or a substantial part of it would have been capable of being instituted in the Supreme Court, apart from any law of the Commonwealth or another State relating to cross-vesting of jurisdiction; and</txt></block></li><li id="sec.5-ssec.4-para1.b-para2.ii-para3.C" guid="_743a7280-c4bb-4617-95b3-7292c1405050" provision.type="other"><no>(C)</no><block><txt break.before="0">the extent to which, in the opinion of the first court, the matters for determination in the relevant proceeding are matters arising under or involving questions as to the application, interpretation or validity of a law of the State and not within the jurisdiction of the first court apart from any law of the Commonwealth or another State relating to cross-vesting of jurisdiction; and</txt></block></li><li id="sec.5-ssec.4-para1.b-para2.ii-para3.D" guid="_39157a08-4b71-4092-8849-ce25021f303a" provision.type="other"><no>(D)</no><block><txt break.before="0">the interests of justice;</txt></block></li></list></block><block><txt break.before="1">it is more appropriate that the relevant proceeding be determined by the Supreme Court; or</txt></block></li><li id="sec.5-ssec.4-para1.b-para2.iii" guid="_8f8d22a5-7a22-42f9-b00f-a9ccc8f622a6" provision.type="other"><no>(iii)</no><block><txt break.before="0">it is otherwise in the interests of justice that the relevant proceeding be determined by the Supreme Court;</txt></block></li></list></block></li></list></block><block><txt break.before="1">the first court shall transfer the relevant proceeding to the Supreme Court.</txt></block></subclause><subclause id="sec.5-ssec.6" guid="_a6f76659-e8e1-4fc3-8264-a89b18d74223" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">Where—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.6-para1.a" guid="_af9964bc-261c-4b8f-952e-3a1d196e16a6" provision.type="other"><no>(a)</no><block><txt break.before="0">a court (the <defterm id="sec.5-ssec.6-def.firstcourt" guid="_ea4fad04-bfea-4d89-8e83-6f65c0e07982" type="definition">first court</defterm>) transfers a proceeding to another court under a law or laws relating to cross-vesting of jurisdiction; and</txt></block></li><li id="sec.5-ssec.6-para1.b" guid="_2db8f842-3ce7-42a2-8039-6d06d6c5c629" provision.type="other"><no>(b)</no><block><txt break.before="0">it appears to the first court that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.6-para1.b-para2.i" guid="_763f60c4-5600-41f1-aa7c-5c02c498f679" provision.type="other"><no>(i)</no><block><txt break.before="0">there is another proceeding pending in the first court that arises out of, or is related to, the first mentioned proceeding; and</txt></block></li><li id="sec.5-ssec.6-para1.b-para2.ii" guid="_a2f2e8fe-7c65-4122-a756-92364cfcea12" provision.type="other"><no>(ii)</no><block><txt break.before="0">it is in the interests of justice that the other proceeding be determined by the other court;</txt></block></li></list></block><block><txt break.before="1">the first court shall transfer the other proceeding to the other court.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.7" guid="_922d189e-ee2f-4e97-8732-00cba38fc33f" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">A court may transfer a proceeding under this section on the application of a party to the proceeding, of its own motion or on the application of the Attorney-General of the Commonwealth or of a State or Territory.</txt></block></subclause><subclause id="sec.5-ssec.8" guid="_016f6bc5-5941-404d-a493-eb23b13c7f82" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">A person who is entitled to practise as a barrister or a solicitor, or as both a barrister and a solicitor, in a court has, if a proceeding (the <defterm id="sec.5-def.transferredproceeding" guid="_0af47df7-e0a5-4f32-b226-1c2bf4351094" type="definition">transferred proceeding</defterm>) in that court is transferred to another court under a law or laws relating to cross-vesting of jurisdiction, the same entitlement to practise in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.8-para1.a" guid="_d1e75a4a-16fa-4489-8833-a81b19f187c9" provision.type="other"><no>(a)</no><block><txt break.before="0">the transferred proceedings; and</txt></block></li><li id="sec.5-ssec.8-para1.b" guid="_4efc103b-0bb1-4653-843e-948b1ff0e491" provision.type="other"><no>(b)</no><block><txt break.before="0">any other proceeding out of which the transferred proceeding arises or to which the transferred proceeding is related, being another proceeding that is to be determined together with the transferred proceeding;</txt></block></li></list></block><block><txt break.before="1">in the other court that the person would have if the other court were a federal court exercising federal jurisdiction.</txt></block></subclause><subclause id="sec.5-ssec.9" guid="_a6586367-c85a-48a3-9f6e-d4de49062570" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">Nothing in this section confers on a court jurisdiction that the court would not otherwise have.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;5</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-2001-027" valid.date="as.made" check="invalid">s&#160;40</legref></txt></historynote></clause><clause id="sec.6" guid="_ad135e82-9716-4ff4-a96b-9660b7390111" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_ce148af1-9a74-4ce4-b7e3-dfbed311c26e">Special federal matters</heading><subclause id="sec.6-ssec.1" guid="_76b9a516-e272-4e1d-a877-f59022df15f5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_53764b56-e0f6-4f70-b2d2-29bc92164684" provision.type="other"><no>(a)</no><block><txt break.before="0">a matter for determination in a proceeding that is pending in the Supreme Court is a special federal matter; and</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_9f29ce31-778e-4a31-80ac-5eae7249791b" provision.type="other"><no>(b)</no><block><txt break.before="0">the court does not make an order under <intref refid="sec.6-ssec.3" target.guid="_4d2ea953-370a-4379-8818-f44c504008c6" check="valid">subsection&#160;(3)</intref> in respect of the matter;</txt></block></li></list></block><block><txt break.before="1">the court must transfer the proceeding in accordance with this section to the Federal Court or a court mentioned in <intref refid="sec.6-ssec.2" target.guid="_10bba150-31a7-4d5d-876c-3db16cff4951" check="valid">subsection&#160;(2)</intref><intref refid="sec.6-ssec.2-para1.b" target.guid="_29551561-35f0-4faa-8d34-dd723219d46d" check="valid">(b)</intref>.</txt></block></subclause><subclause id="sec.6-ssec.1A" guid="_1aaee1d1-d340-4e1f-8160-3b8443d37192" affected.by.uncommenced="0" provision.type="other"><no>(1A)</no><block><txt break.before="0">However, the court must only transfer so much of the proceeding as is, in the opinion of the court, within the jurisdiction (including the accrued jurisdiction) of the Federal Court, or the court mentioned in <intref refid="sec.6-ssec.2" target.guid="_10bba150-31a7-4d5d-876c-3db16cff4951" check="valid">subsection&#160;(2)</intref><intref refid="sec.6-ssec.2-para1.b" target.guid="_29551561-35f0-4faa-8d34-dd723219d46d" check="valid">(b)</intref>, as the case may be.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_10bba150-31a7-4d5d-876c-3db16cff4951" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the court orders that a proceeding or part of a proceeding be transferred, the proceeding or part of the proceeding must be transferred—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a" guid="_b1643d68-8fae-4ebd-a77b-fa0fb1aa1987" provision.type="other"><no>(a)</no><block><txt break.before="0">if the matter for determination in the proceeding is a matter mentioned in <intref refid="sec.6-ssec.2-para1.a" target.guid="_b1643d68-8fae-4ebd-a77b-fa0fb1aa1987" check="valid">paragraph&#160;(a)</intref>, <intref refid="sec.6-ssec.2-para1.b" target.guid="_29551561-35f0-4faa-8d34-dd723219d46d" check="valid">(b)</intref>, <intref refid="sec.6-ssec.2-para1.c" check="invalid">(c)</intref>, <intref refid="sec.6-ssec.2-para1.d" check="invalid">(d)</intref> or <intref refid="sec.6-ssec.2-para1.e" check="invalid">(e)</intref> of the definition of <defterm guid="_f56acc45-ff9a-4ddc-8298-06497b9583e6" type="mention">special federal matter</defterm> in <intref refid="sec.3" target.guid="_8a76dcad-9561-4014-8448-7a0f781ce6f5" check="valid">section&#160;3</intref><intref refid="sec.3-ssec.1" target.guid="_2ab1f605-5a5c-49eb-80b4-f4ae2d2064a4" check="valid">(1)</intref> of the <legref jurisd="CTH" target.doc.id="act-1987-088" target.version.series="d6b3e778-bc66-4e2a-8a9a-86622fb7fd58" check="valid" type="act"><name emphasis="yes">Jurisdiction of Courts (Cross-vesting) Act 1987</name> (Cwlth)</legref>—to the Federal Court; or</txt></block></li><li id="sec.6-ssec.2-para1.b" guid="_29551561-35f0-4faa-8d34-dd723219d46d" provision.type="other"><no>(b)</no><block><txt break.before="0">if the matter for determination in the proceeding is a matter mentioned in <intref refid="sec.6-ssec.2-para1.ab" check="invalid">paragraph&#160;(ab)</intref> of that definition—to whichever of the Family Court, the Family Court of Western Australia or the Supreme Court of the Northern Territory, in the opinion of the court, is appropriate in the circumstances.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.3" guid="_4d2ea953-370a-4379-8818-f44c504008c6" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Supreme Court may order that the proceeding be determined by that court if it is satisfied that there are special reasons for doing so in the particular circumstances of the proceeding other than reasons relevant to the convenience of the parties.</txt></block></subclause><subclause id="sec.6-ssec.4" guid="_715f06d9-e9f0-4879-b96d-9652ed137d88" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Before making an order under <intref refid="sec.6-ssec.3" target.guid="_4d2ea953-370a-4379-8818-f44c504008c6" check="valid">subsection&#160;(3)</intref>, the court must be satisfied that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.4-para1.a" guid="_433115cc-951c-402e-a1fb-80558657b761" provision.type="other"><no>(a)</no><block><txt break.before="0">a written notice specifying the nature of the special federal matter has been given to the Attorney-General of the Commonwealth and the Attorney-General of the State; and</txt></block></li><li id="sec.6-ssec.4-para1.b" guid="_7a41b2af-a609-4a9f-9681-c5539b4ec1f0" provision.type="other"><no>(b)</no><block><txt break.before="0">a reasonable time has elapsed since the giving of the notice for the Attorneys-General to consider whether submissions to the court should be made in relation to the proceeding.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.5" guid="_8d246776-2ebb-4dc1-ad37-a798c43f0c60" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">For the purposes of <intref refid="sec.6-ssec.4" target.guid="_715f06d9-e9f0-4879-b96d-9652ed137d88" check="valid">subsection&#160;(4)</intref>, the court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.5-para1.a" guid="_cca0a306-d7c2-4ad2-b2b3-aaa74870e9f0" provision.type="other"><no>(a)</no><block><txt break.before="0">may adjourn the proceeding for such time as the court thinks necessary and may make such order as to costs in relation to an adjournment as it thinks fit; and</txt></block></li><li id="sec.6-ssec.5-para1.b" guid="_f4b50ef4-da54-43fc-ab45-fa3cb0b489cc" provision.type="other"><no>(b)</no><block><txt break.before="0">may direct a party to the proceeding to give a notice in accordance with that subsection.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.6" guid="_b66b2818-aad0-426d-978c-c7046e0e612c" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In considering whether there are special reasons for the purposes of <intref refid="sec.6-ssec.3" target.guid="_4d2ea953-370a-4379-8818-f44c504008c6" check="valid">subsection&#160;(3)</intref>, the court must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.6-para1.a" guid="_46071b20-89bd-46be-9028-f0326d5ef9a4" provision.type="other"><no>(a)</no><block><txt break.before="0">have regard to the general rule that special federal matters should be heard by the Federal Court or a court mentioned in <intref refid="sec.6-ssec.2" target.guid="_10bba150-31a7-4d5d-876c-3db16cff4951" check="valid">subsection&#160;(2)</intref><intref refid="sec.6-ssec.2-para1.b" target.guid="_29551561-35f0-4faa-8d34-dd723219d46d" check="valid">(b)</intref>, whichever is appropriate in the particular case; and</txt></block></li><li id="sec.6-ssec.6-para1.b" guid="_f0093e15-8649-448d-bdff-df3804e2bab5" provision.type="other"><no>(b)</no><block><txt break.before="0">take into account any submission made in relation to the proceeding by an Attorney-General mentioned in <intref refid="sec.6-ssec.4" target.guid="_715f06d9-e9f0-4879-b96d-9652ed137d88" check="valid">subsection&#160;(4)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.7" guid="_3a332df8-d013-44ed-b0f2-f4456f1e92c5" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">Nothing in this section prevents the court granting urgent relief of an interlocutory nature if it is in the interests of justice to do so.</txt></block></subclause><subclause id="sec.6-ssec.8" guid="_4653a1c7-4741-493d-a324-cfa120e86d96" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">If, through inadvertence, the Supreme Court determines a proceeding of the kind mentioned in <intref refid="sec.6-ssec.1" target.guid="_76b9a516-e272-4e1d-a877-f59022df15f5" check="valid">subsection&#160;(1)</intref> without—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.8-para1.a" guid="_912da807-6119-4fc2-876e-afc67282cc62" provision.type="other"><no>(a)</no><block><txt break.before="0">the court making an order under <intref refid="sec.6-ssec.3" target.guid="_4d2ea953-370a-4379-8818-f44c504008c6" check="valid">subsection&#160;(3)</intref> that the proceeding be determined by that court; or</txt></block></li><li id="sec.6-ssec.8-para1.b" guid="_7314bf89-eac4-4a97-9e7d-c08e22942435" provision.type="other"><no>(b)</no><block><txt break.before="0">a notice mentioned in <intref refid="sec.6-ssec.4" guid="_5df83ddb-da13-4d51-b748-c83578565d35" type="mention">enactment</defterm> in <intref refid="sec.3" target.guid="_8a76dcad-9561-4014-8448-7a0f781ce6f5" check="valid">section&#160;3</intref><intref refid="sec.3-ssec.1" target.guid="_2ab1f605-5a5c-49eb-80b4-f4ae2d2064a4" check="valid">(1)</intref> of the <legref jurisd="CTH" first.</txt></block></li></list></block></subclause><subclause id="sec.6A-ssec.2" guid="_e90b6baf-d59b-4e4e-bbdc-01cead1f52c5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6A-ssec.2-para1.a" guid="_cd20dca2-db5e-478c-b75e-f3778abe6c8d" provision.type="other"><no>(a)</no><block><txt break.before="0">the federal matter proceeding is pending in the Federal Court or the Family Court; and</txt></block></li><li id="sec.6A-ssec.2-para1.b" guid="_ac4b95c0-6b15-49c2-ac09-77702e4af957" provision.type="other"><no>(b)</no><block><txt break.before="0">having regard to the interests of justice, including the desirability of related proceedings being heard in the same jurisdiction, the Federal Court or the Family Court considers it appropriate to transfer the proceeding to the Supreme Court;</txt></block></li></list></block><block><txt break.before="1">the Federal Court or the Family Court may transfer the proceeding to the Supreme Court, and <intref refid="sec.5" target.guid="_d62080ee-9c3c-45d4-bd26-efa38c2daf90" check="valid">section&#160;5</intref><intref refid="sec.5-ssec.4" target.guid="_0449964b-09c1-446e-a871-9a02a53d807b" check="valid">(4)</intref> guid="_4895dbb6-de74-45c4-97d1-0e100e6ace25" provision.type="other"><no>(b)</no><block><txt break.before="0">the State matter proceeding is pending in any court of this State;</txt></block></li></list></block><block><txt break.before="1">neither <intref refid="sec.5" target.guid="_d62080ee-9c3c-45d4-bd26-efa38c2daf90" check="valid">section&#160;5</intref><intref refid="sec.5-ssec.1" target.guid="_733a0661-9090-4921-974c-7d4b1a9ec62e" check="valid">(1)</intref> nor <intref refid="sec.6" target.guid="_ad135e82-9716-4ff4-a96b-9660b7390111" check="valid">section&#160;6</intref> applies to require the Supreme Court to transfer the federal matter proceeding to the Federal Court or the Family Court, but the Supreme Court may do so if it considers that to be appropriate, having regard to the interests of justice, including the desirability of related proceedings being heard in the same jurisdiction.</txt></block></subclause><subclause id="sec.6A-ssec.4" guid="_f4bedcb9-f94b-418c-93f8-d0eb961b7fae" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Nothing in this section confers on a court jurisdiction that the court would not otherwise have.</txt></block></subclause><subclause id="sec.6A-ssec.5" guid="_90e01caf-ba2f-45c8-9542-b788a592a680" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The fact that references in this section to the interests of justice include the desirability of related proceedings being heard in the same jurisdiction does not of itself mean that references to the interests of justice elsewhere in this Act do not include that matter.</txt></block></subclause><subclause id="sec.6A-ssec.6" guid="_2c716960-6cff-4ff3-88ae-30e39d3bb95e" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6A-ssec.6-def.Commonwealthauthority_" guid="_ac8c5283-b202-48b6-bec8-0bc288a42d8b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6A-ssec.6-def.Commonwealthauthority" guid="_26fd05b7-ce84-4732-908f-1a801f9a236e" type="definition">Commonwealth authority</defterm> means an authority or other body (whether incorporated or not) that is established or continued in existence by or under an Act of the Commonwealth.</txt></definition><definition id="sec.6A-ssec.6-def.officeroftheCommonwealth_" guid="_7d4a3731-ebc1-4ff9-98a6-8a038bf4f842" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6A-ssec.6-def.officeroftheCommonwealth" guid="_a35193d5-cef6-486e-997e-41b4a67bf081" type="definition">officer of the Commonwealth</defterm> has the same meaning as in <intref refid="sec.75" check="invalid">section&#160;75</intref><intref refid="sec.75-para1.v" check="invalid">(v)</intref> of the Constitution of the Judge of the Federal Court or the Family Court to the Full Court of the Supreme Court.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_4992e5a9-3e6f-424d-9724-ec5f9402b5bb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An appeal shall not be instituted from the Federal Court or the Family Court to the other of those courts.</txt></block></subclause><subclause id="sec.7-ssec.3" guid="_3800cd6d-5cd4-4331-bf73-cdc3caf830f5" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Where it appears that the only matters for determination in a proceeding by way of an appeal from a decision of a single Judge of the Supreme Court are matters other than matters arising under an Act specified in the Schedule to the <legref jurisd="CTH" target.doc.id="act-1987-088" target.version.series="d6b3e778-bc66-4e2a-8a9a-86622fb7fd58" check="valid" type="act"><name emphasis="yes">Jurisdiction of Courts (Cross-vesting) Act 1987</name> (Cwlth)</legref>, that proceeding shall be instituted only in, and shall be determined only by, the Full Court of the Supreme Court.</txt></block></subclause><subclause id="sec.7-ssec.4" guid="_3759e17d-6593-4ae6-8dda-45b1815d14b2" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Subject to <intref refid="sec.7-ssec.6" target.guid="_3a8bea21-41f8-4056-91fc-d2e1e08571ca" check="valid">subsections&#160;(6)</intref> and <intref refid="sec.7-ssec.7" target.guid="_98f7d342-883a-44fa-8ab5-4c2292292e9f" check="valid">(7)</intref>, where it appears that a matter for determination in a proceeding by way of an appeal from a decision of a single Judge of the Supreme Court (not being a proceeding to which <intref refid="sec.7-ssec.5" target.guid="_0ae5d980-c44e-404e-abbe-604005a88f78" check="valid">subsection&#160;(5)</intref> applies) is a matter arising under an Act specified in the Schedule referred to in <intref refid="sec.7-ssec.3" target.guid="_3800cd6d-5cd4-4331-bf73-cdc3caf830f5" check="valid">subsection&#160;(3)</intref>, that proceeding shall be instituted only in, and shall be determined only by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.4-para1.a" guid="_3483596b-35de-4eb9-bbd0-ac64473f9b60" provision.type="other"><no>(a)</no><block><txt break.before="0">the Full Court of the Federal Court or of the Family Court, as the case requires; or</txt></block></li><li id="sec.7-ssec.4-para1.b" guid="_7d7895ed-687a-4bc0-ade5-5d37ab0a3d5a" provision.type="other"><no>(b)</no><block><txt break.before="0">with special leave of the High Court, the High Court.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.5" guid="_0ae5d980-c44e-404e-abbe-604005a88f78" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A proceeding by way of an appeal from a decision of a Judge of a State Family Court, being a proceeding involving the determination of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.5-para1.a" guid="_15bdbbcc-3254-4bd6-85f1-dc87721c5fc3" provision.type="other"><no>(a)</no><block><txt break.before="0">a matter arising under an Act specified in the Schedule referred to in <intref refid="sec.7-ssec.3" target.guid="_3800cd6d-5cd4-4331-bf73-cdc3caf830f5" check="valid">subsection&#160;(3)</intref>; and</txt></block></li><li id="sec.7-ssec.5-para1.b" guid="_650cb17c-14ed-48c2-82b7-03500a93a95f" provision.type="other"><no>(b)</no><block><txt break.before="0">another matter;</txt></block></li></list></block><block><txt break.before="1">may be dealt with as if no matter for determination in the proceeding were a matter arising under an Act specified in that Schedule.</txt></block></subclause><subclause id="sec.7-ssec.6" guid="_3a8bea21-41f8-4056-91fc-d2e1e08571ca" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">Where—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.6-para1.a" guid="_666590b9-ab60-44c5-bc3b-8d135f626f2a" provision.type="other"><no>(a)</no><block><txt break.before="0">the Full Court of the Supreme Court commences to hear a proceeding by way of an appeal; and</txt></block></li><li id="sec.7-ssec.6-para1.b" guid="_1f371bf0-ebd3-4dcb-a152-eeb5c9b9a4cf" provision.type="other"><no>(b)</no><block><txt break.before="0">before the Court determines the proceeding, it appears to the Court that the proceeding is a proceeding to which <intref refid="sec.7-ssec.4" target.guid="_3759e17d-6593-4ae6-8dda-45b1815d14b2" check="valid">subsection&#160;(4)</intref> applies;</txt></block></li></list></block><block><txt break.before="1">the Court shall, unless the interests of justice require that the Court proceed to determine the proceeding, transfer the proceeding to the Full Court of the Federal Court or of the Family Court, as the case requires.</txt></block></subclause><subclause id="sec.7-ssec.7" guid="_98f7d342-883a-44fa-8ab5-4c2292292e9f" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">Where the Full Court of the Supreme Court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.7-para1.a" guid="_4dd64806-a414-4489-aaa2-8a984fab92ce" provision.type="other"><no>(a)</no><block><txt break.before="0">determines a proceeding to which <intref refid="sec.7-ssec.4" target.guid="_3759e17d-6593-4ae6-8dda-45b1815d14b2" check="valid">subsection&#160;(4)</intref> applies as mentioned in <intref refid="sec.7-ssec.6" target.guid="_3a8bea21-41f8-4056-91fc-d2e1e08571ca" check="valid">subsection&#160;(6)</intref>; or</txt></block></li><li id="sec.7-ssec.7-para1.b" guid="_4135672e-432d-4e1d-90c9-3fb9a66f6536" provision.type="other"><no>(b)</no><block><txt break.before="0">through inadvertence, determines a proceeding to which <intref refid="sec.7-ssec.4" target.guid="_3759e17d-6593-4ae6-8dda-45b1815d14b2" check="valid">subsection&#160;(4)</intref> applies;</txt></block></li></list></block><block><txt break.before="1">nothing in this section invalidates the decision of that Court.</txt></block></subclause></clause><clause id="sec.8" guid="_1e493924-6203-4264-b759-30115dcd29ce" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_0a27b1cc-f38e-4a9c-99be-a7e18ff5a3d6">Orders by Supreme Court</heading><subclause id="sec.8-ssec.1" guid="_ea6400a3-4022-4940-b847-6794e53fd213" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Where—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_ae53083c-d7af-4540-ba6c-f49a307364e0" provision.type="other"><no>(a)</no><block><txt break.before="0">a proceeding (the <defterm id="sec.8-ssec.1-def.relevantproceeding" guid="_bf7223cc-b0bf-4724-8cc5-4208186878fc" type="definition">relevant proceeding</defterm>) is pending in—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a-para2.i" guid="_73841c69-01c0-4d9f-8bb7-d6b93b7c2d1c" provision.type="other"><no>(i)</no><block><txt break.before="0">a court, other than the Supreme Court, of the State; or</txt></block></li><li id="sec.8-ssec.1-para1.a-para2.ii" guid="_572036fd-7834-4115-9b9e-3bbdfcc4407c" provision.type="other"><no>(ii)</no><block><txt break.before="0">a tribunal established by or under an Act; and</txt></block></li></list></block></li><li id="sec.8-ssec.1-para1.b" guid="_6fbb1e2a-d088-4b06-b484-9c8fa9de746c" provision.type="other"><no>(b)</no><block><txt break.before="0">it appears to the Supreme Court that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.b-para2.i" guid="_88a8760b-0be6-4495-9c3a-46eac069c6c2" provision.type="other"><no>(i)</no><block><txt break.before="0">the relevant proceeding arises out of, or is related to, another proceeding pending in the Federal Court, the Family Court or the Supreme Court of another State or of a Territory and, if an order is made under this subsection in relation to the relevant proceeding, there would be grounds on which that other proceeding could be transferred to the Supreme Court; or</txt></block></li><li id="sec.8-ssec.1-para1.b-para2.ii" guid="_df67213d-3249-4dec-a871-940e6670dc95" provision.type="other"><no>(ii)</no><block><txt break.before="0">an order should be made under this subsection in relation to the relevant proceeding so that consideration can be given to whether the relevant proceeding should be transferred to another court;</txt></block></li></list></block></li></list></block><block><txt break.before="1">the Supreme Court may, on the application of a party to the relevant proceeding or of its own motion, make an order removing the relevant proceeding to the Supreme Court.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_383d6d68-c04a-4707-bb63-6dc9919b9b86" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Where an order is made under <intref refid="sec.8-ssec.1" target.guid="_ea6400a3-4022-4940-b847-6794e53fd213" check="valid">subsection&#160;(1)</intref> in relation to a proceeding, this Act applies in relation to the proceeding as if it were a proceeding pending in the Supreme Court.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_57d38eeb-5251-41df-8949-7be72b7c546e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Where a proceeding is removed to the Supreme Court in accordance with an order made under <intref refid="sec.8-ssec.1" target.guid="_ea6400a3-4022-4940-b847-6794e53fd213" check="valid">subsection&#160;(1)</intref>, the Supreme Court may, if the Supreme Court considers it appropriate to do so, remit the proceeding to break.before="1">The Supreme Court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-para1.a" guid="_44064ebf-0508-4df6-89d3-ac68f685c624" provision.type="other"><no>(a)</no><block><txt break.before="0">may exercise jurisdiction (whether original or appellate) conferred on that court by a provision of this Act or of a law of the Commonwealth or a State relating to cross-vesting of jurisdiction; and</txt></block></li><li id="sec.9-para1.b" guid="_262e5c29-121b-4264-97fc-6bfcb03ed4c8" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Where a proceeding is transferred or removed to a court (the <defterm id="sec.11-def.transfereecourt" guid="_0a7f9d43-d667-4b06-97b8-0048d557a0fd" type="definition">transferee court</defterm>) from another court (the <defterm id="sec.11-def.transferorcourt" guid="_42cf2d82-c64f-4967-b733-845165e3175d" type="definition">transferor court</defterm>), the transferee court shall deal with the proceeding as if, subject to any order of the transferee court, the steps that had been taken for the purposes of the proceeding in the transferor court (including the making of an order), or similar steps, had been taken in the transferee court.</txt></block></subclause><historynote><txt as to costs</heading><block><txt break.before="1">Where a proceeding is transferred or removed to a court, that court may make an order as to costs that relate to the conduct of the proceeding before the transfer or removal if those costs have not already been dealt with by another court.</txt></block></clause><clause id="sec.13" guid="_bb89534c-4517-4b3c-908e-5b416718b28c" guid="_b39a6226-cb85-469f-9ea9-9e985e3026e4" provision.type="other"><no>(b)</no><block><txt break.before="0">as to which rules of evidence and procedure are to be applied pursuant to <intref refid="sec.11" target.guid="_cdd5aab7-0dd5-4c06-a705-e6b8be9308f8" check="valid">section&#160;11</intref><intref refid="sec.11-ssec.1" target.guid="_70569db7-7071-436d-9023-801eb0c6a5e6" check="valid">(1)</intref>.</txt></block></li></list></block></clause><clause id="sec.14" guid="_9be722a1-3181-4f95-8d9c-78a5a28585b2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_4542bd18-70d1-4241-95ff-e66253bd2637">Enforcement and effect of judgments</heading><subclause id="sec.14-ssec.1" guid="_d2d771e0-6dd7-4896-8c97-264fb54e1226" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A judgment of the Supreme Court that is given, in whole or in part, in the exercise of jurisdiction conferred by a law or laws relating to cross-vesting of jurisdiction is enforceable in the State as if the judgment had been given entirely in the exercise of the jurisdiction of the Supreme Court apart from any such law.</txt></block></subclause><subclause id="sec.14-ssec.2" guid="_f96d027e-a9a2-4a79-a642-04b14aa6e07f" affected.by.uncommenced="0" provision.type="other"><no>(a)</no><block><txt break.before="0">a provision of a law of the State (not being a law relating to the enforcement of judgments) refers to a thing done by the Supreme Court; and</txt></block></li><li id="sec.14-ssec.2-para1.b" guid="_c9be46c8-65cd-4799-8334-6119f4978f86" provision.type="other"><no>(b)</no><block><txt break.before="0">that thing is done by another court in exercise of jurisdiction conferred by this Act;</txt></block></li></list></block><block><txt break.before="1">the reference in that provision to the Supreme Court shall be read as a reference target.guid="_1e50e4a1-be9c-4e24-bb02-888fc42be027" check="valid">subsection&#160;(2)</intref>, the Governor may, if a proclamation has not been made under <intref refid="sec.16-ssec.4" target.guid="_326a6bd2-c4bf-489c-9488-92b20733d1e9" check="valid">subsection&#160;(4)</intref>, by proclamation declare that the operation of this Act is suspended from a day (being a day not earlier than 3 years after the commencement of this Act) specified in the proclamation and, where such a proclamation is made, this Act ceases to be in force from that day until a proclamation is made under <intref refid="sec.16-ssec.3" target.guid="_56d5856b-023e-469b-a247-b4cdb9d02ef2" check="valid">subsection&#160;(3)</intref> revoking the first mentioned proclamation.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_1e50e4a1-be9c-4e24-bb02-888fc42be027" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt effect from a particular day unless the Governor is satisfied that the Attorney-General has given notice of his or her intention to seek the making of such a proclamation to the Commonwealth and to each other State (other than a State in relation to which a proclamation under <intref refid="sec.16-ssec.5" target.guid="_c5e1f2b4-90ad-4e3a-b2c9-eb9a989fe72b" check="valid">subsection&#160;(5)</intref> has been made) not less than 6 months before that day.</txt></block></subclause><subclause id="sec.16-ssec.3" guid="_56d5856b-023e-469b-a247-b4cdb9d02ef2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Where the Governor has made a proclamation under <intref refid="sec.16-ssec.1" target.guid="_c39384e6-711a-449a-8a0f-ef38b437703d" check="valid">subsection&#160;(1)</intref>, the Governor may, by proclamation, revoke the first mentioned proclamation.</txt></block></subclause><subclause id="sec.16-ssec.4" guid="_326a6bd2-c4bf-489c-9488-92b20733d1e9" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Where the Governor is satisfied that the <legref jurisd="QLD" type="act" target.doc.id="act-1987-088" target.version.series="d6b3e778-bc66-4e2a-8a9a-86622fb7fd58" check="valid">Act</legref>s of the Commonwealth and other States relating to cross-vesting of jurisdiction are not effective to invest the Supreme Court of Queensland with, or confer on that Court, jurisdiction of the Federal Court, the Family Court or a Supreme Court of another State or of a Territory, the Governor may, by proclamation, declare that this Act shall, on a day specified in the proclamation, cease to be in force and, where such a proclamation is made, this Act ceases to be in force on that day.</txt></block></subclause><subclause id="sec.16-ssec.5" guid="_c5e1f2b4-90ad-4e3a-b2c9-eb9a989fe72b" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Where the Governor is satisfied that an Act of the Commonwealth or another State relating to cross-vesting of jurisdiction has been repealed, rendered inoperative, suspended or altered in a substantial manner, the Governor may, by proclamation, declare that this Act shall, on a day specified in the proclamation, cease to be in force in relation to the Commonwealth or a Territory or in relation to that State and, where such a proclamation is made, this Act ceases to be in force in relation to the Commonwealth or a Territory or that State on that day.</txt></block></subclause><subclause id="sec.16-ssec.6" guid="_5ac88bf4-4552-439d-93c3-916f064079d0" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">Where—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.6-para1.a" guid="_5f768287-d9ac-4a11-8555-af06ea52782d" provision.type="other"><no>(a)</no><block><txt break.before="0">the Governor has made a proclamation under <intref refid="sec.16-ssec.5" target.guid="_c5e1f2b4-90ad-4e3a-b2c9-eb9a989fe72b" check="valid">subsection&#160;(5)</intref> in relation to the Commonwealth or a Territory or a State; and</txt></block></li><li id="sec.16-ssec.6-para1.b" guid="_e85fa950-e19d-40f8-baaa-bffd81dce9aa" provision.type="other"><no>(b)</no><block><txt break.before="0">the Governor is satisfied that there is in force an Act of the Commonwealth or that State relating to cross-vesting of jurisdiction, being an Act in terms substantially corresponding to the terms of this Act;</txt></block></li></list></block><block><txt break.before="1">the Governor may, by proclamation, declare that this Act again applies in relation to the Commonwealth or the Territory or that State from a day specified in the proclamation, and where such a proclamation is made, this Act applies in relation to the Commonwealth or Territory or that State on and after that day.</txt></block></subclause><subclause id="sec.16-ssec.7"
