provision.type="other"><no>•</no><block><txt break.before="1">the numbers of some provisions that are not enacted in this jurisdiction have not been used in the numbering of this spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_5b7f93e3-2e1b-4415-95f8-e37246f6ad5a">Tort of defamation</heading><subclause id="sec.6-ssec.1" guid="_abcec70f-408a-4e85-888a-ad56b0105297" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">This Act relates to the tort of defamation at general law.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_d4ebbea3-6c1c-4f26-9697-433313108cb9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">This Act does not affect the operation of the general law in relation to the tort of defamation except to the extent that this Act provides otherwise (whether expressly or by necessary implication).</txt></block></subclause><subclause id="sec.6-ssec.3" guid="_5099875a-1734-4fa1-b6b7-66375860453b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt guid="_e582182a-c25e-4f9a-99e1-c839f46d2151">Causes of action for defamation</heading><clause id="sec.8" guid="_c680f7d1-bbec-4418-b659-b73651e81bf2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_e5b75a45-f329-44e4-8914-f4b1b1cd654a">Single cause of action for multiple defamatory imputations in same matter</heading><block><txt break.before="1">A person has a single cause of action for defamation in relation to the publication of defamatory matter about the person even if more than 1 defamatory imputation about the person is carried by the matter.</txt></block></clause><clause id="sec.9" guid="_93c469d7-c700-4cf6-8267-ad8039e38cb5" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_7565bfe0-12f9-4fae-91ff-cef4c94a1af6">Certain corporations do not have cause of action for defamation</heading><subclause id="sec.9-ssec.1" guid="_ae9e9d23-9fdd-4caf-a75c-698b4c844bd7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">A corporation has no cause of action for defamation in relation to the publication of defamatory matter about the corporation unless it was an excluded corporation at the time of the publication.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_d858a851-1692-4a70-9a81-a57e7ea1da9f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">A corporation is an excluded corporation if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_cf444d23-0432-44d7-9084-1a339a4e59dd" provision.type="other"><no>(a)</no><block><txt break.before="1">the objects for which it is formed do not include obtaining financial gain for its members or corporators; or</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_ef007cc3-8c3f-47f9-be77-e872b35bf69f" provision.type="other"><no>(b)</no><block><txt break.before="1">it employs fewer than 10 persons and is not related to another corporation;</txt></block></li></list></block><block><txt break.before="1">and the corporation is not a public body.</txt></block></subclause><subclause id="sec.9-ssec.3" guid="_764a86ca-a8e2-4b84-a8d0-32b921b4988c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">In counting employees for the purposes of <intref refid="sec.9-ssec.2" target.guid="_d858a851-1692-4a70-9a81-a57e7ea1da9f" check="valid">subsection&#160;(2)</intref><intref refid="sec.9-ssec.2-para1.b" target.guid="_ef007cc3-8c3f-47f9-be77-e872b35bf69f" check="valid">(b)</intref>, part-time employees are to be taken into account as an appropriate fraction of a full-time equivalent.</txt></block></subclause><subclause id="sec.9-ssec.4" guid="_3c92c2aa-03bd-4fb4-87a5-084de8987aea" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">In determining whether a corporation is related to another corporation for the purposes of <intref refid="sec.9-ssec.2" target.guid="_d858a851-1692-4a70-9a81-a57e7ea1da9f" check="valid">subsection&#160;(2)</intref><intref refid="sec.9-ssec.2-para1.b" target.guid="_ef007cc3-8c3f-47f9-be77-e872b35bf69f" check="valid">(b)</intref>, the Corporations Act, <intref check="invalid">section&#160;50</intref> applies as if references to bodies corporate in that section were references to corporations within the meaning of this section.</txt></block></subclause><subclause id="sec.9-ssec.5" guid="_4569f7f4-92f9-4d06-bff8-5ff6335269ca" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="1"><intref refid="sec.9-ssec.1" target.guid="_ae9e9d23-9fdd-4caf-a75c-698b4c844bd7" check="valid">Subsection&#160;(1)</intref> does not affect any cause of action for defamation that an individual associated with a corporation has in relation to the publication of defamatory matter about the individual even if the publication of the same matter also defames the corporation.</txt></block></subclause><subclause id="sec.9-ssec.6" guid="_3e17a08a-645a-45f2-90df-0069dc1edde8" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="1">In this section—</txt><deflist><definition id="sec.9-ssec.6-def.corporation_" guid="_d061bc56-086c-44da-a964-2dc3a0b74849" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.6-def.corporation" guid="_16de1005-fd5a-487c-afd3-e70e695d53eb" type="definition">corporation </defterm>includes any body corporate or corporation constituted by or under a law of any country (including by exercise of a prerogative right), whether or not a public body.</txt></definition><definition id="sec.9-ssec.6-def.publicbody_" guid="_94429fb1-438a-42ab-b30f-b8ed96d92169" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.6-def.publicbody" guid="_870c22a6-5976-4b28-846f-2775719c231d" type="definition">public body </defterm>means a local government body or other governmental or public authority constituted by or under a law of any country.</txt></definition></deflist></block></subclause></clause><clause id="sec.10" guid="_675d387a-ba0a-48b0-b9b0-d809ca9b92ec" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_d256047e-f603-4935-8e49-7c07735b1cf5">No cause of action for defamation of, or against, deceased persons</heading><block><txt break.before="1">A person (including a personal representative of a deceased person) can not assert, continue or enforce a cause of action for defamation in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a" guid="_361305d9-f693-491e-b06d-89c32be38e22" provision.type="other"><no>(a)</no><block><txt break.before="1">the publication of defamatory matter about a deceased person (whether published before or after his or her death); or</txt></block></li><li id="sec.10-para1.b" guid="_7376ad46-18bd-4105-bcf2-c5657cb992d8" provision.type="other"><no>(b)</no><block><txt break.before="1">the publication of defamatory matter by a person who has died since publishing the matter.</txt></block></li></list></block></clause></division><division id="pt.2-div.3" guid="_218ad291-4345-4acf-9b70-7651bf8fe168" affected.by.uncommenced="0"><no>Division 3</no><heading id="pt.2-div.3-he" guid="_12fd9152-92ad-41c4-b45d-9201d7f0db0f">Choice of law</heading><clause id="sec.11" guid="_bc519ce9-f04c-4f6b-9d7c-f5ffcb9e299c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_b918c35f-25f2-4999-8938-ec38de53ff22">Choice of law for defamation proceedings</heading><subclause id="sec.11-ssec.1" guid="_b4f38c97-674c-40dc-924f-8730dedccd94" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">If a matter is published wholly within a particular Australian jurisdictional area, the substantive law that is applicable in that area must be applied in this jurisdiction to determine any cause of action for defamation based on the publication.</txt></block></subclause><subclause id="sec.11-ssec.2" guid="_fe5c3e8a-3ea4-4c46-9496-db516a9f682a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">If there is a multiple publication of matter in more than 1 Australian jurisdictional area, the substantive law applicable in the Australian jurisdictional area with which the harm occasioned by the publication as a whole has its closest connection must be applied in this jurisdiction to determine each cause of action for defamation based on the publication.</txt></block></subclause><subclause id="sec.11-ssec.3" guid="_774d478a-a34c-4f66-891c-23ec8bc9ea48" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">In determining the Australian jurisdictional area with which the harm occasioned by a publication of matter has its closest connection, a court may take into account—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.3-para1.a" guid="_5edee8c7-0397-4349-8010-061350ebf041" provision.type="other"><no>(a)</no><block><txt break.before="1">the place at the time of publication where the plaintiff was ordinarily resident or, in the case of a corporation that may assert a cause of action for defamation, the place where the corporation had its principal place of business at that time; and</txt></block></li><li id="sec.11-ssec.3-para1.b" guid="_0e49c14e-726d-41c1-9812-35a063c72e7f" provision.type="other"><no>(b)</no><block><txt break.before="1">the extent of publication in each relevant Australian jurisdictional area; and</txt></block></li><li id="sec.11-ssec.3-para1.c" guid="_7d34531b-2e07-44ca-83f1-56c290ddf02b" provision.type="other"><no>(c)</no><block><txt break.before="1">the extent of harm sustained by the plaintiff in each relevant Australian jurisdictional area; and</txt></block></li><li id="sec.11-ssec.3-para1.d" guid="_e41d9d9b-ca81-4b1c-9158-846a069d886f" provision.type="other"><no>(d)</no><block><txt break.before="1">any other matter that the court considers relevant.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.4" guid="_3ba0c6b6-4c42-4ae3-8b53-9ca1f2f2a46f" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">For the purposes of this section, the <defterm id="sec.11-def.substantivelaw" guid="_4f39116f-1f02-41ef-935a-7721257f04a6" type="definition">substantive law </defterm>applicable in an Australian jurisdictional area does not include any law prescribing rules for choice of law that differ from the rules prescribed by this section.</txt></block></subclause><subclause id="sec.11-ssec.5" guid="_b11fd703-999a-417c-8105-0db04a921052" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="1">In this section—</txt><deflist><definition id="sec.11-ssec.5-def.Australianjurisdictionalarea_" guid="_fb683210-5e4d-4252-ae37-180a87eeb7aa" affected.by.uncommenced="0"><txt break.before="1">the geographical area of Australia that lies within the territorial limits of a particular State (including its coastal waters), but not including any territory, place or other area referred to in paragraph (c); or</txt></block></li><li id="sec.11-ssec.5-def.Australianjurisdictionalarea-para1.b" guid="_bac7a3b4-94ed-4b23-bdfc-204c0389dbea" provision.type="other"><no>(b)</no><block><txt break.before="1">the geographical area of Australia that lies within the territorial limits of a particular Territory (including its coastal waters), but not including any territory, place or other area referred to in paragraph (c); or</txt></block></li><li id="sec.11-ssec.5-def.Australianjurisdictionalarea-para1.c" guid="_9a284fce-57f8-4cc2-b9f5-07444b24a65b" provision.type="other"><no>(c)</no><block><txt break.before="1">any territory, place or other geographical area of Australia over which the Commonwealth has legislative competence but over which no State or Territory has legislative competence.</txt></block></li></list></definition><definition id="sec.11-ssec.5-def.geographicalareaofAustralia_" guid="_99a03af7-9cea-4069-9726-a03e50c4a19e" provision.type="other"><no>(a)</no><block><txt break.before="1">the territorial sea of Australia; and</txt></block></li><li id="sec.11-ssec.5-def.geographicalareaofAustralia-para1.b" guid="_4f1dee3f-0b6b-4cc3-96a9-d2aa493c2282" provision.type="other"><no>(b)</no><block><txt break.before="1">the external Territories of the Commonwealth.</txt></block></li></list></definition><definition id="sec.11-ssec.5-def.multiplepublication_" guid="_5562faf5-ce76-4dfa-aea0-347f5ef5d71a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.5-def.multiplepublication" guid="_e2ed7664-c832-4eb7-9f33-4fb46cd8adfa" type="definition">multiple publication </defterm>means publication by a particular person of the same, or substantially the same, matter in substantially the same form to 2 or more persons.</txt></definition></deflist></block></subclause></clause></division></part><part id="pt.3" guid="_b58758b3-348d-41af-a0f8-7965be7a4a33" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_2ca60ad9-bbb1-43a6-a04a-804dcbaf67b0">Resolution of civil disputes without litigation</heading><division id="pt.3-div.1" guid="_5a62e1df-2377-4b9a-b121-e0b509146151" affected.by.uncommenced="0"><no>Division 1</no><heading id="pt.3-div.1-he" guid="_9c6f3daf-e959-42a5-a721-819757d83d19">Offers to make amends</heading><clause id="sec.12" guid="_3d2ff010-b6a5-4894-8eec-11ad5e400072" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_4f9d203b-203f-4193-92be-22822f0d1b55">Application of division</heading><subclause id="sec.12-ssec.1" guid="_3f94380d-f5b4-4162-9f72-0f19caf8c8a3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">This division applies if a person (the <defterm id="sec.12-def.publisher" guid="_6d09005e-67fa-494b-872e-b21696940d39" type="definition">publisher</defterm>) publishes matter (the <defterm id="sec.12-def.matterinquestion" guid="_c1dd6366-79eb-4763-a258-7770f43e4762" type="definition">matter in question</defterm>) that is, or may be, defamatory of another person (the <defterm id="sec.12-def.aggrievedperson" guid="_3aee7e67-23ea-4d92-a0e9-8043cd691d4f" type="definition">aggrieved person</defterm>).</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_e42093f9-6c5f-44ff-a717-b90035337df7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">The provisions of this division may be used instead of the provisions of any rules of court or any other law in relation to payment into court or offers of compromise.</txt></block></subclause><subclause id="sec.12-ssec.3" guid="_4d5189ac-6e2c-42ce-a789-976b709f8294" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">Nothing in this division prevents a publisher or aggrieved person from making or accepting a settlement offer in relation to the publication of the matter in question otherwise than in accordance with the provisions of this division.</txt></block></subclause></clause><clause id="sec.13" guid="_98f11186-a1ed-4002-abb2-934899eb58f9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_4ab88356-66ad-4611-9bcc-8dc1c6a315ed">Publisher may make offer to make amends</heading><subclause id="sec.13-ssec.1" guid="_16f64999-f1b9-4045-9bff-788e331957d8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">The publisher may make an offer to make amends to the aggrieved person.</txt></block></subclause><subclause id="sec.13-ssec.2" guid="_60dcf1ed-cc47-4fea-b157-8a00c0c5f3ef" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">The offer may be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.a" guid="_0a0d6da2-0e4e-4580-9ee1-e5739b132e53" provision.type="other"><no>(a)</no><block><txt break.before="1">in relation to the matter in question generally; or</txt></block></li><li id="sec.13-ssec.2-para1.b" guid="_cdb995d0-5d43-48fe-9343-8d6a3da0586a" provision.type="other"><no>(b)</no><block><txt break.before="1">limited to any particular defamatory imputations that the publisher accepts that the matter in question carries.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.3" guid="_5fb1e040-0f9a-48ef-8637-4eb60ffd5f3e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">If 2 or more persons published the matter in question, an offer to make amends by 1 or more of them does not affect the liability of the other or others.</txt></block></subclause><subclause id="sec.13-ssec.4" guid="_f3165811-1e87-4503-a4da-1d9f5c5b3f50" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">An offer to make amends is taken to have been made without prejudice, unless the offer provides otherwise.</txt></block></subclause></clause><clause id="sec.14" guid="_e21163d4-fcb7-4839-bf34-bac7ba8e644c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_11eea720-d2e8-480d-b4de-51de47660346">When offer to make amends may be made</heading><subclause id="sec.14-ssec.1" guid="_08798aff-3d4a-48d0-9e5e-01fdf13a7aaa" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">An offer to make amends can not be made if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-ssec.1-para1.a" guid="_4e03920f-c668-4fa0-be9b-c0330ed360d4" provision.type="other"><no>(a)</no><block><txt break.before="1">28 days have elapsed since the publisher was given a concerns notice by the aggrieved person; or</txt></block></li><li id="sec.14-ssec.1-para1.b" guid="_a5eb3572-f558-4d54-a7d1-4dc74e5e8b47" provision.type="other"><no>(b)</no><block><txt break.before="1">a defence has been served in an action brought by the aggrieved person against the publisher in relation to the matter in question.</txt></block></li></list></block></subclause><subclause id="sec.14-ssec.2" guid="_e5d0c2b4-8e4c-4758-835d-ffda23b9d8ea" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">A notice is a <defterm id="sec.14-def.concernsnotice" guid="_c70691c9-790a-4227-8387-0fc2bd49ec1e" type="definition">concerns notice </defterm>for the purposes of this section if the notice—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-ssec.2-para1.a" guid="_c82c9b75-0e99-425b-8ffd-0354dd00b946" provision.type="other"><no>(a)</no><block><txt break.before="1">is in writing; and</txt></block></li><li id="sec.14-ssec.2-para1.b" guid="_f998729d-f620-4561-9fff-e55d4dff09b7" provision.type="other"><no>(b)</no><block><txt break.before="1">informs the publisher of the defamatory imputations that the aggrieved person considers are or may be carried about the aggrieved person by the matter in question (the <defterm id="sec.14-ssec.2-def.imputationsofconcern" guid="_4133e0af-110f-4b5c-9776-c7310aa7316d" type="definition">imputations of concern</defterm>).</txt></block></li></list></block></subclause><subclause id="sec.14-ssec.3" guid="_ff15d845-14f5-4551-bd7e-407cb6e995ff" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">If an aggrieved person gives the publisher a concerns notice, but fails to particularise the imputations of concern adequately, the publisher may give the aggrieved person a written notice (a <defterm id="sec.14-def.furtherparticularsnotice" guid="_a35df601-c2e4-48f1-8107-e7e386b77d82" type="definition">further particulars notice</defterm>) requesting the aggrieved person to provide reasonable further particulars about the imputations of concern as specified in the further particulars notice.</txt></block></subclause><subclause id="sec.14-ssec.4" guid="_a24b5b1f-60e6-498d-a526-b68fa9d4bd90" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">An aggrieved person to whom a further particulars notice is given must provide the reasonable further particulars specified in the notice within 14 days (or any further period agreed by the publisher and aggrieved person) after being given the notice.</txt></block></subclause><subclause id="sec.14-ssec.5" guid="_e42c9002-1ebf-4539-b9b4-8c3de853d3f2" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="1">An aggrieved person who fails to provide the reasonable further particulars specified in a further particulars notice within the applicable period is taken not to have given the publisher a concerns notice for the purposes of this section.</txt></block></subclause></clause><clause id="sec.15" guid="_bf2e8d66-74ed-4c74-8644-83e0177b20c8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_f78863fa-a7d2-4447-94fe-fa301dff3cfe">Content of offer to make amends</heading><subclause id="sec.15-ssec.1" guid="_3f5d8032-119a-4250-9836-f346b4ca7562" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">An offer to make amends—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.1-para1.a" guid="_0c1434cd-ae39-434c-8b75-60083159a477" provision.type="other"><no>(a)</no><block><txt break.before="1">must be in writing; and</txt></block></li><li id="sec.15-ssec.1-para1.b" guid="_8fc4ef66-95a3-492a-91ed-f23934096a53" provision.type="other"><no>(b)</no><block><txt break.before="1">must be readily identifiable as an offer to make amends under this division; and</txt></block></li><li id="sec.15-ssec.1-para1.c" guid="_e92e68cf-41b3-4c5f-aeaf-9f340e55b40f" provision.type="other"><no>(c)</no><block><txt break.before="1">if the offer is limited to any particular defamatory imputations—must state that the offer is so limited and particularise the imputations to which the offer is limited; and</txt></block></li><li id="sec.15-ssec.1-para1.d" guid="_6febcb94-2695-4c25-a757-2461f527a39b" provision.type="other"><no>(d)</no><block><txt break.before="1">must include an offer to publish, or join in publishing, a reasonable correction of the matter in question or, if the offer is limited to any particular defamatory imputations, the imputations to which the offer is limited; and</txt></block></li><li id="sec.15-ssec.1-para1.e" guid="_3c3f0450-1c15-41cc-9fff-b7910a9fa697" provision.type="other"><no>(e)</no><block><txt break.before="1">if material containing the matter has been given to someone else by the publisher or with the publisher’s knowledge—must include an offer to take, or join in taking, reasonable steps to tell the other person that the matter is or may be defamatory of the aggrieved person; and</txt></block></li><li id="sec.15-ssec.1-para1.f" guid="_1ab0b762-6a64-4c1c-b1f5-8540f25fd467" provision.type="other"><no>(f)</no><block><txt break.before="1">must include an offer to pay the expenses reasonably incurred by the aggrieved person before the offer was made and the expenses reasonably incurred by the aggrieved person in considering the offer; and</txt></block></li><li id="sec.15-ssec.1-para1.g" guid="_a606ed80-47aa-4417-bb19-9f0e1debf127" provision.type="other"><no>(g)</no><block><txt break.before="1">may include any other kind of offer, or particulars of any other action taken by the publisher, to redress the harm sustained by the aggrieved person because of the matter in question, including (but not limited to)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.1-para1.g-para2.i" guid="_bd885ab4-380b-4adc-95de-55f11c25477a" provision.type="other"><no>(i)</no><block><txt break.before="1">an offer to publish, or join in publishing, an apology in relation to the matter in question or, if the offer is limited to any particular defamatory imputations, the imputations to which the offer is limited; or</txt></block></li><li id="sec.15-ssec.1-para1.g-para2.ii" guid="_72b598af-f91b-4ed4-a24b-d1d643d42340" provision.type="other"><no>(ii)</no><block><txt break.before="1">an offer to pay compensation for any economic or non-economic loss of the aggrieved person; or</txt></block></li><li id="sec.15-ssec.1-para1.g-para2.iii" guid="_375ccbdb-2f86-43b9-9f28-e10a739b1452" provision.type="other"><no>(iii)</no><block><txt break.before="1">the particulars of any correction or apology made, or action taken, before the date of the offer.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.15-ssec.2" guid="_07f584c9-bb81-4f6e-b7c8-1c539b885814" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">Without limiting <intref refid="sec.15-ssec.1" target.guid="_3f5d8032-119a-4250-9836-f346b4ca7562" check="valid">subsection&#160;(1)</intref><intref refid="sec.15-ssec.1-para1.g" target.guid="_a606ed80-47aa-4417-bb19-9f0e1debf127" check="valid">(g)</intref><intref refid="sec.15-ssec.1-para1.g-para2.ii" target.guid="_72b598af-f91b-4ed4-a24b-d1d643d42340" check="valid">(ii)</intref>, an offer to pay compensation may comprise or include any 1 or more of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.2-para1.a" guid="_57312e82-0d39-4e08-b90d-242b0f225412" provision.type="other"><no>(a)</no><block><txt break.before="1">an offer to pay a stated amount;</txt></block></li><li id="sec.15-ssec.2-para1.b" guid="_97e33767-86a4-46cb-abbd-fb948b7027b9" provision.type="other"><no>(b)</no><block><txt break.before="1">an offer to pay an amount to be agreed between the publisher and the aggrieved person;</txt></block></li><li id="sec.15-ssec.2-para1.c" guid="_b17c3c7d-ded9-46c5-8ca6-d41cd2bd590f" provision.type="other"><no>(c)</no><block><txt break.before="1">an offer to pay an amount determined by an arbitrator appointed, or agreed on, by the publisher and the aggrieved person;</txt></block></li><li id="sec.15-ssec.2-para1.d" guid="_ec097f4f-d8f7-4e89-82fe-8d4a4e1cb668" provision.type="other"><no>(d)</no><block><txt break.before="1">an offer to pay an amount determined by a court.</txt></block></li></list></block></subclause><subclause id="sec.15-ssec.3" guid="_2f0a28a1-6214-4926-b17e-6e08e050e26e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">If an offer to make amends is accepted, a court may, on the application of the aggrieved person or publisher, determine—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.3-para1.a" guid="_9553e8f2-11d6-4871-8637-715881a1a981" provision.type="other"><no>(a)</no><block><txt break.before="1">if the offer provides for a court to determine the amount of compensation payable under the offer—the amount of compensation to be paid under the offer; and</txt></block></li><li id="sec.15-ssec.3-para1.b" guid="_e2d26a2d-b18e-46ff-9c8a-4f882c654d96" provision.type="other"><no>(b)</no><block><txt break.before="1">any other question that arises about what must be done to carry out the terms of the offer.</txt></block></li></list></block></subclause><subclause id="sec.15-ssec.4" guid="_21055fdc-18d5-4196-b609-0dd0944e42f0" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">The powers conferred on a court by <intref refid="sec.15-ssec.3" target.guid="_2f0a28a1-6214-4926-b17e-6e08e050e26e" check="valid">subsection&#160;(3)</intref> are exercisable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.4-para1.a" guid="_b29c221a-6d5a-4fb0-ab34-044c018b792c" provision.type="other"><no>(a)</no><block><txt break.before="1">if the aggrieved person has brought proceedings against the publisher in any court for defamation in relation to the matter in question, by that court in those proceedings; and</txt></block></li><li id="sec.15-ssec.4-para1.b" guid="_b6c7c46d-8bb8-40f7-a76c-9fc7dc69b17d" provision.type="other"><no>(b)</no><block><txt break.before="1">except as provided in paragraph (a), by the Supreme Court.</txt></block></li></list></block></subclause></clause><clause id="sec.16" guid="_3e1df107-99d3-4186-93c8-7c5c9f4f9aca" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_82cb99d8-64f2-49c5-afe8-0e4703cd3833">Withdrawal of offer to make amends</heading><subclause id="sec.16-ssec.1" guid="_5e5b290a-8fd6-4c0a-9c9f-8f86c9713b7b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">An offer to make amends may be withdrawn before it is accepted by notice in writing given to the aggrieved person.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_df1523e2-e3c7-44df-85a0-1b0c5041a026" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">A publisher who has withdrawn an offer to make amends may make a renewed offer.</txt></block></subclause><subclause id="sec.16-ssec.3" guid="_9175e093-8583-4369-bb84-23af909e1089" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">A renewed offer may (but need not) be in the same terms as the withdrawn offer.</txt></block></subclause><subclause id="sec.16-ssec.4" guid="_23e168f2-998f-43ff-9a1e-bdede00bdc18" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">A renewed offer is to be treated as a new offer (including for the purposes of <intref refid="sec.14" target.guid="_e21163d4-fcb7-4839-bf34-bac7ba8e644c" check="valid">section&#160;14</intref>).</txt></block></subclause><subclause id="sec.16-ssec.5" guid="_e89cceec-80cc-4cc8-b5b3-d077d573d5f7" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="1">However, the time limit specified in <intref refid="sec.14" target.guid="_e21163d4-fcb7-4839-bf34-bac7ba8e644c" check="valid">section&#160;14</intref> for the making of offers to make amends does not prevent the making of a renewed offer that is not in the same terms as the withdrawn offer if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.5-para1.a" guid="_777fcd96-5c1c-4ed3-b093-1bb52f3be1ea" provision.type="other"><no>(a)</no><block><txt break.before="1">the renewed offer represents a genuine attempt by the publisher to address matters of concern raised by the aggrieved person about the withdrawn offer; and</txt></block></li><li id="sec.16-ssec.5-para1.b" guid="_db231b9e-9dae-49c5-8db3-31012ea98142" provision.type="other"><no>(b)</no><block><txt break.before="1">the renewed offer is made within 14 days after the withdrawal of the withdrawn offer or any other period agreed by the publisher and the aggrieved person.</txt></block></li></list></block></subclause></clause><clause id="sec.17" guid="_2c6171e4-8ed7-41f0-b244-4211f7dc368e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>17</no><heading id="sec.17-he" guid="_bee4c18c-1a5b-4053-9884-23d20466e56f">Effect of acceptance of offer to make amends</heading><subclause id="sec.17-ssec.1" guid="_5ec92d9a-96b1-49ca-8005-98f5a296208a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">If the publisher carries out the terms of an offer to make amends (including payment of any compensation under the offer) that is accepted, the aggrieved person can not assert, continue or enforce an action for defamation against the publisher in relation to the matter in question even if the offer was limited to any particular defamatory imputations.</txt></block></subclause><subclause id="sec.17-ssec.2" guid="_5fab0dcd-380d-4f4c-a7f0-a61aa5374a44" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">A court may (but need not)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.2-para1.a" guid="_6464999c-57d6-44d7-9608-f3f251185af0" provision.type="other"><no>(a)</no><block><txt break.before="1">order the publisher to pay the aggrieved person the expenses reasonably incurred by the aggrieved person as a result of accepting the offer; and</txt></block></li><li id="sec.17-ssec.2-para1.b" guid="_9ca34413-1d03-4aba-b409-44878327fc38" provision.type="other"><no>(b)</no><block><txt break.before="1">order any costs incurred by the aggrieved person that form part of those expenses to be assessed on an indemnity basis.</txt></block></li></list></block></subclause><subclause id="sec.17-ssec.3" guid="_c14bbcc0-b303-4039-9391-b5bd31bd4e11" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">The powers conferred on a court by <intref refid="sec.17-ssec.2" target.guid="_5fab0dcd-380d-4f4c-a7f0-a61aa5374a44" check="valid">subsection&#160;(2)</intref> are exercisable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.3-para1.a" guid="_8a19158d-1fa8-4769-96ea-ebc2ed77bf35" provision.type="other"><no>(a)</no><block><txt break.before="1">if the aggrieved person has brought proceedings against the publisher in any court for defamation in relation to the matter in question, by that court in those proceedings; and</txt></block></li><li id="sec.17-ssec.3-para1.b" guid="_48a3686a-551e-4fb2-bf5f-5259a760a9de" provision.type="other"><no>(b)</no><block><txt break.before="1">except as provided in paragraph (a), by the Supreme id="sec.18-ssec.1" guid="_c003725b-563d-4719-9c15-7c97b3a3ad79" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">If an offer to make amends is made in relation to the matter in question but is not accepted, it is a defence to an action for defamation against the publisher in relation to the matter if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.1-para1.a" guid="_c21974b1-396f-4124-b18f-a90d09f6c229" provision.type="other"><no>(a)</no><block><txt break.before="1">the publisher made the offer as soon as practicable after becoming aware that the matter is or may be defamatory; and</txt></block></li><li id="sec.18-ssec.1-para1.b" guid="_2ad4d374-ba2b-4123-8c02-11c9c0b546f3" provision.type="other"><no>(b)</no><block><txt break.before="1">at any time before the trial the publisher was ready and willing, on acceptance of the offer by the aggrieved person, to carry out the terms of the offer; and</txt></block></li><li id="sec.18-ssec.1-para1.c" guid="_7a6124e2-cfbc-4315-8055-ba03f7a785ce" provision.type="other"><no>(c)</no><block><txt break.before="1">in all the circumstances the offer was reasonable.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.2" guid="_c6188839-5d17-44e3-9b55-b147f8896324" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">In determining whether an offer to make amends is reasonable, a court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a" guid="_7dddcb7e-d8bc-48d4-8e3d-b3400dcee5eb" provision.type="other"><no>(a)</no><block><txt break.before="1">must have regard to any correction or apology published before any trial arising out of the matter in question, including the extent to which the correction or apology is brought to the attention of the audience of the matter in question taking into account—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a-para2.i" guid="_25e40f09-a864-4d26-b65f-3a17499d8796" provision.type="other"><no>(i)</no><block><txt break.before="1">the prominence given to the correction or apology as published in comparison to the prominence given to the matter in question as published; and</txt></block></li><li id="sec.18-ssec.2-para1.a-para2.ii" guid="_5de0e964-2465-4cbf-8696-4e8b74cf54b9" provision.type="other"><no>(ii)</no><block><txt break.before="1">the period that elapses between publication of the matter in question and publication of the correction or apology; and</txt></block></li></list></block></li><li id="sec.18-ssec.2-para1.b" guid="_3b3f659e-82f4-4142-b886-6d02aa6c9105" provision.type="other"><no>(b)</no><block><txt break.before="1">may have regard to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.b-para2.i" guid="_13a5ad26-137d-4875-b42d-c63b7a729b85" provision.type="other"><no>(i)</no><block><txt break.before="1">whether the aggrieved person refused to accept an offer that was limited to any particular defamatory imputations because the aggrieved person did not agree with the publisher about the imputations that the matter in question carried; and</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.ii" guid="_d4b536e2-adc6-4660-a0a1-8095c8d09704" provision.type="other"><no>(ii)</no><block><txt break.before="1">any other matter that the court considers relevant.</txt></block></li></list></block></li></list></block></subclause></clause><clause id="sec.19" guid="_a0cba85f-7502-497b-996d-dcee19ed04db" affected.by.uncommenced="0" spent.amends="0" guid="_ede08d54-b6c7-4ebe-ab7e-a2b4ce823018">Roles of judicial officers and juries in defamation proceedings</heading><subclause id="sec.22-ssec.1" guid="_7fcbd3a5-b55a-445a-bf7a-3ca75ebe8853" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">This section applies to defamation proceedings that are tried by jury.</txt></block></subclause><subclause id="sec.22-ssec.2" guid="_00251b31-a3cf-4922-b9ae-1429ef3fc7c3" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">The jury is to determine whether the defendant has published defamatory matter about the plaintiff and, if so, whether any defence raised by the defendant has been established.</txt></block></subclause><subclause id="sec.22-ssec.3" guid="_d234d383-74d1-48c1-a396-7623b5ca9f03" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">If the jury finds that the defendant has published defamatory matter about the plaintiff and that no defence has been established, the judicial officer and not the jury is to determine the amount of damages (if any) that should be awarded to the plaintiff and all unresolved issues of fact and law relating to the determination of that amount.</txt></block></subclause><subclause id="sec.22-ssec.4" guid="_1389b8e7-ad88-426f-83d7-a99cc7479b86" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">If the proceedings relate to more than 1 cause of action for defamation, the jury must give a single verdict in relation to all causes of action on which the plaintiff relies unless the judicial officer orders otherwise.</txt></block></subclause><subclause id="sec.22-ssec.5" provision.type="other"><no>(a)</no><block><txt break.before="1">the matter carried, in addition to the defamatory imputations of which the plaintiff complains, 1 or more other imputations (<defterm id="sec.26-def.contextualimputations" guid="_d3e03a38-6726-413d-9528-89f4cee86230" type="definition">contextual imputations</defterm>) that are substantially true; and</txt></block></li><li id="sec.26-para1.b" guid="_84199f12-2c80-446b-b5e8-59b4806aa98b" provision.type="other"><no>(b)</no><block><txt break.before="1">the defamatory imputations do not further harm the reputation of the id="sec.27-ssec.1" guid="_65f4f855-a7f7-4a48-899a-4c18f4ce6459" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">It is a defence to the publication of defamatory matter if the defendant proves that it was published on an occasion of absolute privilege.</txt></block></subclause><subclause id="sec.27-ssec.2" guid="_ea8c52c2-16c9-4fc1-a2ab-02836df1538b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">Without limiting <intref refid="sec.27-ssec.1" target.guid="_65f4f855-a7f7-4a48-899a-4c18f4ce6459" check="valid">subsection&#160;(1)</intref>, matter is published on an occasion of absolute privilege if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-ssec.2-para1.a" guid="_7217b0fa-3f50-412f-868c-ee78badde8c7" provision.type="other"><no>(a)</no><block><txt break.before="1">the matter is published in the course of the proceedings of a parliamentary body, including (but not limited to)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-ssec.2-para1.a-para2.i" guid="_eb1143e1-8654-487e-a7de-6f4f9ededc61" provision.type="other"><no>(i)</no><block><txt break.before="1">the publication of a document by order, or under the authority, of the body; and</txt></block></li><li id="sec.27-ssec.2-para1.a-para2.ii" guid="_6eb47598-0367-41db-897a-5f6c962c0156" provision.type="other"><no>(ii)</no><block><txt break.before="1">the publication of the debates and proceedings of the body by or under the authority of the body or any law; and</txt></block></li><li id="sec.27-ssec.2-para1.a-para2.iii" guid="_95b3badf-fa87-4ff9-bd2a-d2c6819efcd6" guid="_ef61cbb3-9482-4b1f-9e9e-47262c8752fc" provision.type="other"><no>(iv)</no><block><txt break.before="1">the publication of matter while presenting or submitting a document to the body; or</txt></block></li></list></block></li><li id="sec.27-ssec.2-para1.b" guid="_6cfcff92-a00c-4505-8d74-607673d606b0" provision.type="other"><no>(b)</no><block><txt break.before="1">the matter is published in the course of the proceedings of an Australian court or Australian tribunal, including (but not limited to)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-ssec.2-para1.b-para2.i" guid="_34cf1edd-dcc2-42a8-bf5d-dbab77c30586" provision.type="other"><no>(i)</no><block><txt break.before="1">the publication of matter in any document filed or lodged with, or otherwise submitted to, the court or tribunal (including any originating process); and</txt></block></li><li id="sec.27-ssec.2-para1.b-para2.ii" guid="_55e59d7b-eed0-47e7-ac12-9fd0d602553b" provision.type="other"><no>(ii)</no><block><txt break.before="1">the publication of matter while giving evidence before the court or tribunal; provision.type="other"><no>(c)</no><block><txt break.before="1">the matter is published on an occasion that, if published in another Australian jurisdiction, would be an occasion of absolute privilege in that jurisdiction under a provision of a law of the jurisdiction corresponding to this section; or</txt></block></li><li id="sec.27-ssec.2-para1.d" guid="_dadfa2a8-f03c-406e-8c63-0f3cb8f26770" provision.type="other"><no>(d)</no><block><txt break.before="1">the matter is published by a person or body in any circumstances specified in <intref or</txt></block></li><li id="sec.28-ssec.1-para1.b" guid="_971bac96-3927-451e-b443-8a5cb8ac5c86" provision.type="other"><no>(b)</no><block><txt break.before="1">a fair summary of, or a fair extract from, a public document.</txt></block></li></list></block></subclause><subclause id="sec.28-ssec.2" guid="_90fe3b35-ba96-4a94-8b6f-98fd6990a760" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">For the purposes of <intref refid="sec.28-ssec.1" target.guid="_c44fed23-4e1b-4b6e-a70a-0989a0af9444" check="valid">subsection&#160;(1)</intref>, if a report or other document under the law of a country would be a public document except for non-compliance with a provision of that law about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec.2-para1.a" guid="_274d8a64-6f54-46bf-bcf2-5d1a670c86a5" provision.type="other"><no>(a)</no><block><txt break.before="1">the formal requirements for the content or layout of the report or document; or</txt></block></li><li id="sec.28-ssec.2-para1.b" guid="_9bd4082c-8a25-4178-bd21-002b20b021b3" provision.type="other"><no>(b)</no><block><txt break.before="1">the time within which the report or document is prepared, or presented, submitted, tabled or laid to or before a person or body;</txt></block></li></list></block><block><txt break.before="1">the report or document is a public document despite that non-compliance.</txt></block></subclause><subclause id="sec.28-ssec.3" guid="_243b9716-4182-4fa4-a38c-15194f386c81" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">A defence established under <intref refid="sec.28-ssec.1" target.guid="_c44fed23-4e1b-4b6e-a70a-0989a0af9444" check="valid">subsection&#160;(1)</intref> is defeated if, and only if, the plaintiff proves that the defamatory matter was not published honestly for the information of the public or the advancement of education.</txt></block></subclause><subclause id="sec.28-ssec.4" guid="_b05685ca-1418-4de3-bc7e-e9353ede44f0" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">In this section—</txt><deflist><definition id="sec.28-ssec.4-def.publicdocument_" guid="_67fe548e-0664-427a-ae2d-d69ab446e0d1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.28-ssec.4-def.publicdocument" guid="_1dbf3604-edd0-42c0-ae12-dd16f96b2eba" type="definition">public document </defterm>means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec.4-def.publicdocument-para1.a" guid="_063d273f-282b-4053-ba11-318768f4de81" provision.type="other"><no>(a)</no><block><txt break.before="1">any report or paper published by a parliamentary body, or a record of votes, debates or other proceedings relating to a parliamentary body published by or under the authority of the body or any law; or</txt></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.b" guid="_fed9cd7f-a944-4d62-8aaf-82fc93f2b8e1" provision.type="other"><no>(b)</no><block><txt break.before="1">any judgment, order or other determination of a court or arbitral tribunal of any country in civil proceedings, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec.4-def.publicdocument-para1.b-para2.i" guid="_82318b83-8c6d-4830-a5a4-721a9ae022b4" provision.type="other"><no>(i)</no><block><txt break.before="1">any record of the court or tribunal relating to the judgment, order or determination or to its enforcement or satisfaction; and</txt></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.b-para2.ii" guid="_077a5a39-886d-44cf-b14a-a53710fc839e" provision.type="other"><no>(ii)</no><block><txt break.before="1">any report of the court or tribunal about its judgment, order or determination and the reasons for its judgment, order or determination; or</txt></block></li></list></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.c" guid="_bfbc5a3f-981d-48c9-9303-d73bdafaa96e" provision.type="other"><no>(c)</no><block><txt break.before="1">any report or other document that under the law of any country—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec.4-def.publicdocument-para1.c-para2.i" guid="_8847bb7a-f438-40c4-9f52-ab83abbf9a41" provision.type="other"><no>(i)</no><block><txt break.before="1">is authorised to be published; or</txt></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.c-para2.ii" guid="_7f08e8eb-9479-4160-aa5b-98a16ac9c0c7" provision.type="other"><no>(ii)</no><block><txt break.before="1">is required to be presented or submitted to, tabled in, or laid before, a parliamentary body; or</txt></block></li></list></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.d" guid="_59c0d550-bb85-4bc8-85d1-85d2dfccb2fa" provision.type="other"><no>(d)</no><block><txt break.before="1">any document issued by the government (including a local government) of a country, or by an officer, employee or agency of the government, for the information of the public; or</txt></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.e" guid="_07d4d008-31f0-48c2-9e56-1e427261d056" provision.type="other"><no>(e)</no><block><txt break.before="1">any record or other document open to inspection by the public that is kept—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec.4-def.publicdocument-para1.e-para2.i" guid="_3e561033-98ec-4913-b0cb-dde827c07f31" provision.type="other"><no>(i)</no><block><txt break.before="1">by an Australian jurisdiction; or</txt></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.e-para2.ii" guid="_55a6315f-e20a-4268-995b-1b86528e9980" provision.type="other"><no>(ii)</no><block><txt break.before="1">by a statutory authority of an Australian jurisdiction; or</txt></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.e-para2.iii" guid="_d3f9a351-a9e0-4620-881a-290bd5bb28f1" provision.type="other"><no>(iii)</no><block><txt break.before="1">by an Australian court; or</txt></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.e-para2.iv" guid="_8f5fbbcb-6bbe-4211-85ad-43b3cc6dfa03" provision.type="other"><no>(iv)</no><block><txt break.before="1">under legislation of an Australian jurisdiction; or</txt></block></li></list></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.f" guid="_fcf6e906-31c7-4663-8fe5-a900d63915c1" provision.type="other"><no>(f)</no><block><txt break.before="1">any other document issued, kept or published by a person, body or organisation of another Australian jurisdiction that is treated in that jurisdiction as a public document under a provision of a law of the jurisdiction corresponding to this section; or</txt></block></li><li id="sec.28-ssec.4-def.publicdocument-para1.g" guid="_0a0b5d63-0594-4abe-b2f3-c5c47c8eea38" provision.type="other"><no>(g)</no><block><txt break.before="1">any document of a kind specified in <intref check="invalid">schedule&#160;2</intref>.</txt></block></li></list><note id="sec.28-ssec.4-def.publicdocument-note" guid="_e7a44022-987d-4730-b5dc-134f3f9cc923" type="example"><heading id="sec.28-ssec.4-def.publicdocument-note-he" guid="_66db30e1-a7bd-48b9-8642-17d412df1000">Note—</heading><block><txt break.before="1">This Act does not contain a <intref check="invalid">schedule&#160;2</intref>. See note to <intref refid="sec.3" target.guid="_32859bda-db04-4ca1-9cec-228a07b47ae9" check="valid">section&#160;3</intref><intref refid="sec.3-para1.a" target.guid="_48a14086-00f4-4386-ace1-5018e4b7a992" check="valid">(a)</intref>.</txt></block></note></definition></deflist></block></subclause></clause><clause id="sec.29" guid="_4a6b3731-662b-4b6d-9396-5883c39d066d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>29</no><heading id="sec.29-he" guid="_018bbf60-55c3-4ef0-ad44-c16b1fd17686">Defences of fair report of proceedings of public concern</heading><subclause id="sec.29-ssec.1" guid="_c0293a24-68a3-4979-8a65-d71a0c4c7fe6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">It is a defence to the publication of defamatory matter if the defendant proves that the matter was, or was contained in, a fair report of any proceedings of public concern.</txt></block></subclause><subclause id="sec.29-ssec.2" guid="_ca2ba3a9-875c-40f1-8dfe-d358b94a2f7d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">It is a defence to the publication of defamatory matter if the defendant proves that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.2-para1.a" guid="_8f1a2095-fd3a-4974-bef1-c3a4235b602d" provision.type="other"><no>(a)</no><block><txt break.before="1">the matter was, or was contained in, an earlier published report of proceedings of public concern; and</txt></block></li><li id="sec.29-ssec.2-para1.b" guid="_be7139df-d589-49a6-928b-47b076a8d2fe" provision.type="other"><no>(b)</no><block><txt break.before="1">the matter was, or was contained in, a fair copy of, a fair summary of, or a fair extract from, the earlier published report; and</txt></block></li><li id="sec.29-ssec.2-para1.c" guid="_f1597d4d-09b6-4ea7-8196-44a900fb0d6a" provision.type="other"><no>(c)</no><block><txt break.before="1">the defendant had no knowledge that would reasonably make the defendant aware that the earlier published report was not fair.</txt></block></li></list></block></subclause><subclause id="sec.29-ssec.3" guid="_e201b623-495f-4324-9598-e8ee2c88fd04" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">A defence established under <intref refid="sec.29-ssec.1" target.guid="_c0293a24-68a3-4979-8a65-d71a0c4c7fe6" check="valid">subsection&#160;(1)</intref> or <intref refid="sec.29-ssec.2" target.guid="_ca2ba3a9-875c-40f1-8dfe-d358b94a2f7d" check="valid">(2)</intref> is defeated if, and only if, the plaintiff proves that the defamatory matter was not published honestly for the information of the public or the advancement of education.</txt></block></subclause><subclause id="sec.29-ssec.4" guid="_59913bf5-353e-4dcc-8e17-36a1ac7e822c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">In this section—</txt><deflist><definition id="sec.29-ssec.4-def.proceedingsofpublicconcern_" guid="_4e3ee79e-f12c-47e1-b7ad-a79db752da98" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.29-ssec.4-def.proceedingsofpublicconcern" guid="_0ab4dc30-a481-47c9-ab0d-eb87fffa8d62" type="definition">proceedings of public concern </defterm>means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.a" guid="_307c7d9d-5e39-4eaa-b8cf-844d2e9d5de0" provision.type="other"><no>(a)</no><block><txt break.before="1">any proceedings in public of a parliamentary body; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.b" guid="_6143566e-d322-48af-bab6-c2531767b8e2" provision.type="other"><no>(b)</no><block><txt break.before="1">any proceedings in public of an international organisation of any countries or of the governments of any countries; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.c" guid="_7d367c3c-ba31-4a51-8b80-52f823911d58" provision.type="other"><no>(c)</no><block><txt break.before="1">any proceedings in public of an international conference at which the governments of any countries are represented; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.d" guid="_8e526f35-4460-43b0-9881-06caa9e52881" provision.type="other"><no>(d)</no><block><txt break.before="1">any proceedings in public of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.d-para2.i" guid="_14cbd4ed-e4c7-4c6d-bf5a-4b3ad44046ac" provision.type="other"><no>(i)</no><block><txt break.before="1">the International Court of Justice, or any other judicial or arbitral tribunal, for the decision of any matter in dispute between nations; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.d-para2.ii" guid="_c3e36526-8650-4c18-a5bd-d4803d707562" provision.type="other"><no>(ii)</no><block><txt break.before="1">any other international judicial or arbitral tribunal; or</txt></block></li></list></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.e" guid="_af781ccf-1233-4848-8c3a-775242819d0e" provision.type="other"><no>(e)</no><block><txt break.before="1">any proceedings in public of a court or arbitral tribunal of any country; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.f" guid="_2b082f80-9707-4cf9-bff1-f554210fa5fc" provision.type="other"><no>(f)</no><block><txt break.before="1">any proceedings in public of an inquiry held under the law of any country or under the authority of the government of any country; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.g" guid="_e1011185-3198-4cfe-8212-4091292c1042" provision.type="other"><no>(g)</no><block><txt break.before="1">any proceedings in public of a local government body of any Australian jurisdiction; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.h" guid="_aeab9250-0705-41ff-947a-aa40c27e1f6a" provision.type="other"><no>(h)</no><block><txt break.before="1">proceedings of a learned society, or of a committee or governing body of the society, under its relevant objects, but only to the extent that the proceedings relate to a decision or adjudication made in Australia about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.h-para2.i" guid="_015594e8-1090-4b49-9cb5-b62f07543b6a" provision.type="other"><no>(i)</no><block><txt break.before="1">a member or members of the society; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.h-para2.ii" guid="_9d5348b3-6f33-496a-8802-26b90c42ce09" provision.type="other"><no>(ii)</no><block><txt break.before="1">a person subject by contract or otherwise by law to control by the society; or</txt></block></li></list></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.i" guid="_58143050-5f4e-4ce7-8546-609059546cb0" provision.type="other"><no>(i)</no><block><txt break.before="1">proceedings of a sport or recreation association, or of a committee or governing body of the association, under its relevant objects, but only to the extent that the proceedings relate to a decision or adjudication made in Australia about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.i-para2.i" guid="_f107c8c5-f5c1-4c3b-8599-e9851cd7565a" provision.type="other"><no>(i)</no><block><txt break.before="1">a member or members of the association; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.i-para2.ii" guid="_8f4a6a39-a30a-482a-9cf4-c78f8b79b222" provision.type="other"><no>(ii)</no><block><txt break.before="1">a person subject by contract or otherwise by law to control by the association; or</txt></block></li></list></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.j" guid="_f930f0ed-25c3-412d-b5fe-b7c1fa16392a" provision.type="other"><no>(j)</no><block><txt break.before="1">proceedings of a trade association, or of a committee or governing body of the association, under its relevant objects, but only to the extent that the proceedings relate to a decision or adjudication made in Australia about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.j-para2.i" guid="_3ce6ad73-b842-45b1-81ea-97b33cfb7a70" provision.type="other"><no>(i)</no><block><txt break.before="1">a member or members of the association; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.j-para2.ii" guid="_502e0bb5-a2f4-4ed1-a9d5-104a4db43385" provision.type="other"><no>(ii)</no><block><txt break.before="1">a person subject by contract or otherwise by law to control by the association; or</txt></block></li></list></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.k" guid="_6b98ee05-f203-42eb-9dad-f3c79df31032" provision.type="other"><no>(k)</no><block><txt break.before="1">any proceedings of a public meeting (with or without restriction on the people attending) of shareholders of a public company under the Corporations Act held anywhere in Australia; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.l" guid="_00874f25-3d56-4f5d-824d-6e90c76ac52d" provision.type="other"><no>(l)</no><block><txt break.before="1">any proceedings of a public meeting (with or without restriction on the people attending) held anywhere in Australia if the proceedings relate to a matter of public interest, including the advocacy or candidature of a person for public office; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.m" guid="_bc9ab060-5b7d-465d-81c9-22853874c1f0" provision.type="other"><no>(m)</no><block><txt break.before="1">any proceedings of an ombudsman of any country if the proceedings relate to a report of the ombudsman; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.n" guid="_70acd569-71fb-49ca-96b7-4d8f7cfd1cc1" provision.type="other"><no>(n)</no><block><txt break.before="1">any proceedings in public of a law reform body of any country; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.o" guid="_d2877dfd-15c0-4cce-b8ec-94da5b469663" provision.type="other"><no>(o)</no><block><txt break.before="1">any other proceedings conducted by, or proceedings of, a person, body or organisation of another Australian jurisdiction that are treated in that jurisdiction as proceedings of public concern under a provision of a law of the jurisdiction corresponding to this section; or</txt></block></li><li id="sec.29-ssec.4-def.proceedingsofpublicconcern-para1.p" guid="_1c744d54-8015-4618-9971-d80e95bc0013" provision.type="other"><no>(p)</no><block><txt break.before="1">any proceedings of a kind specified in <intref check="invalid">schedule&#160;3</intref>.</txt></block></li></list><note id="sec.29-ssec.4-def.proceedingsofpublicconcern-note" guid="_d27faa33-5cd2-46c7-b2d9-934dae1ba71a" type="example"><heading id="sec.29-ssec.4-def.proceedingsofpublicconcern-note-he" guid="_dd0d3501-0839-49ff-a4d7-43a3181a0387">Note—</heading><block><txt break.before="1">This Act does not contain a <intref check="invalid">schedule&#160;3</intref>. id="sec.29-ssec.5-def.lawreformbody_" guid="_5ab4c442-9782-4345-994c-4f4108ec64b9" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.29-ssec.5-def.lawreformbody" guid="_0b76287d-62da-4c5c-9e91-852af84c0f50" type="definition">law reform body </defterm>of a country means a body (however described and whether or not permanent or full-time) established by law to conduct inquiries into, and to make recommendations on, reforming the laws of that country.</txt></definition><definition id="sec.29-ssec.5-def.learnedsociety_" guid="_811efec8-08b1-4c3c-a80b-25e7d2681c30" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.29-ssec.5-def.learnedsociety" guid="_0d4b8916-2ec3-4811-abe9-aa4bc019f945" type="definition">learned society </defterm>means a body, wherever formed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.5-def.learnedsociety-para1.a" guid="_6e944dc7-08f5-45f4-92c7-f785c5acb3bf" provision.type="other"><no>(a)</no><block><txt break.before="1">the objects of which include the advancement of any art, science or religion or the advancement of learning in any field; and</txt></block></li><li id="sec.29-ssec.5-def.learnedsociety-para1.b" guid="_01c26772-ddfb-4131-b66b-d4bcf67156a7" provision.type="other"><no>(b)</no><block><txt break.before="1">authorised by its constitution—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.5-def.learnedsociety-para1.b-para2.i" guid="_cc59dad7-3e96-4972-b07b-713d6028ffe4" provision.type="other"><no>(i)</no><block><txt break.before="1">to exercise control over, or adjudicate on, matters connected with those objects; and</txt></block></li><li id="sec.29-ssec.5-def.learnedsociety-para1.b-para2.ii" guid="_6861f516-7464-4e47-ad39-6dc231c03c67" provision.type="other"><no>(ii)</no><block><txt break.before="1">to make findings or decisions having effect, by law or custom, in any part of Australia.</txt></block></li></list></block></li></list></definition><definition id="sec.29-ssec.5-def.ombudsman_" guid="_0a17a814-79d2-4f12-b76e-59e5aad8fbd9" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.29-ssec.5-def.ombudsman" guid="_4a04fdb0-abc9-4b68-990e-6c8ba1c03324" type="definition">ombudsman </defterm>of a country means a person (however described and whether or not permanent or full-time) authorised by law to investigate complaints about the actions or other conduct of any public officials or public bodies of that country.</txt></definition><definition id="sec.29-ssec.5-def.relevantobjects_" guid="_3500fc80-16d6-4239-861c-fbd908207882" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.29-ssec.5-def.relevantobjects" guid="_ec539cca-de50-42f2-ac55-e8def0e937e1" type="definition">relevant objects </defterm>of a learned society, sport or recreation association or trade association means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.5-def.relevantobjects-para1.a" guid="_3dfdcbd0-0516-4b32-9b38-c0d91500e796" provision.type="other"><no>(a)</no><block><txt break.before="1">in relation to a learned society—objects of the kind referred to in paragraph (a) of the definition <i>learned society</i> in this subsection; or</txt></block></li><li id="sec.29-ssec.5-def.relevantobjects-para1.b" guid="_00d44874-7583-423b-8593-d94afacddb89" provision.type="other"><no>(b)</no><block><txt break.before="1">in relation to a sport or recreation association—objects of the kind referred to in paragraph (a) of the definition <i>sport or recreation association</i> in this subsection; or</txt></block></li><li id="sec.29-ssec.5-def.relevantobjects-para1.c" guid="_bcea2233-e2c1-4853-a189-79fef267ed3a" provision.type="other"><no>(c)</no><block><txt break.before="1">in relation to a trade association—objects of the kind referred to in paragraph (a) of the definition <i>trade association</i> in this subsection.</txt></block></li></list></definition><definition id="sec.29-ssec.5-def.sportorrecreationassociation_" guid="_fd39d953-3caa-4171-a01d-0023a44564ff" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.29-ssec.5-def.sportorrecreationassociation" guid="_d4c10045-e2f1-4506-b37e-74efb177872a" type="definition">sport or recreation association </defterm>means a body, wherever formed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.5-def.sportorrecreationassociation-para1.a" guid="_19fb3c0c-e0ea-4b50-963d-407b520f59c2" provision.type="other"><no>(a)</no><block><txt break.before="1">the objects of which include the promotion of any game, sport, or pastime to the playing of which or exercise of which the public is admitted as spectators or otherwise and the promotion or protection of the interests of people connected with the game, sport, or pastime; and</txt></block></li><li id="sec.29-ssec.5-def.sportorrecreationassociation-para1.b" guid="_b81c22b4-fab8-4b1e-840b-4d90036a710b" provision.type="other"><no>(b)</no><block><txt break.before="1">authorised by its constitution—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.5-def.sportorrecreationassociation-para1.b-para2.i" guid="_7268cffa-1fc7-45ee-abd3-50787ca2189e" provision.type="other"><no>(i)</no><block><txt break.before="1">to exercise control over, or adjudicate on, matters connected with the game, sport, or pastime; and</txt></block></li><li id="sec.29-ssec.5-def.sportorrecreationassociation-para1.b-para2.ii" guid="_f606838d-87d6-4287-9e3f-f9d34bdbdf8b" provision.type="other"><no>(ii)</no><block><txt break.before="1">to make findings or decisions having effect, by law or custom, in any part of Australia.</txt></block></li></list></block></li></list></definition><definition id="sec.29-ssec.5-def.tradeassociation_" guid="_304ca24d-8172-47ad-bb16-bc6193d97f05" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.29-ssec.5-def.tradeassociation" guid="_550e132e-b961-4e70-9cbc-a3522de84edc" type="definition">trade association </defterm>means a body, wherever formed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.5-def.tradeassociation-para1.a" guid="_b7139652-da35-4816-91b4-153665a46532" provision.type="other"><no>(a)</no><block><txt break.before="1">the objects of which include the promotion of any calling, that is to say, a trade, business, industry or profession, and the promotion or protection of the interests of people engaged in any calling; and</txt></block></li><li id="sec.29-ssec.5-def.tradeassociation-para1.b" guid="_3d208af7-38d6-4a6f-9abd-7c254095673e" provision.type="other"><no>(b)</no><block><txt break.before="1">authorised by its constitution—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.5-def.tradeassociation-para1.b-para2.i" guid="_a3c3502e-1cca-4b9e-b1bc-94bd7dc96d86" provision.type="other"><no>(i)</no><block><txt break.before="1">to exercise control over, or adjudicate on, matters connected with a calling or the conduct of people engaged in the calling; and</txt></block></li><li id="sec.29-ssec.5-def.tradeassociation-para1.b-para2.ii" guid="_c97eaa7a-8d85-4ed1-9193-2032b2432a4a" provision.type="other"><no>(ii)</no><block><txt break.before="1">to make findings or decisions having effect, by law or custom, in any part of Australia.</txt></block></li></list></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.30" guid="_48a65d0c-3249-49df-ac98-a62cc0dc94b2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>30</no><heading id="sec.30-he" guid="_3e2cc1fe-c51d-4e8a-a12d-cb85f56923ee">Defence of qualified privilege for provision of certain information</heading><subclause id="sec.30-ssec.1" guid="_22e5a459-225e-4082-a09d-5f051888c47a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">There is a defence of qualified privilege for the publication of defamatory matter to a person (the <defterm id="sec.30-def.recipient" guid="_37902c10-a6a7-4f6d-a4e6-5d1911524adb" type="definition">recipient</defterm>) if the defendant proves that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.30-ssec.1-para1.a" guid="_1e3ef2c7-cae1-4adf-b91a-4ad7e1f22441" provision.type="other"><no>(a)</no><block><txt break.before="1">the recipient has an interest or apparent interest in having information on some subject; and</txt></block></li><li id="sec.30-ssec.1-para1.b" guid="_d9dfe3d9-0579-4180-ad9a-7432ce5fb4a8" provision.type="other"><no>(b)</no><block><txt break.before="1">the matter is published to the recipient in the course of giving to the recipient information on that subject; and</txt></block></li><li id="sec.30-ssec.1-para1.c" guid="_d7ffeb43-6fcc-4c4e-8f39-6d3c8f93e39f" provision.type="other"><no>(c)</no><block><txt break.before="1">the conduct of the defendant in publishing that matter is reasonable in the circumstances.</txt></block></li></list></block></subclause><subclause id="sec.30-ssec.2" guid="_145906c0-57de-4669-b821-f110c7d94823" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">For the purposes of <intref refid="sec.30-ssec.1" target.guid="_22e5a459-225e-4082-a09d-5f051888c47a" check="valid">subsection&#160;(1)</intref>, a recipient has an apparent interest in having information on some subject if, and only if, at the time of the publication in question, the defendant believes on reasonable grounds that the recipient has that interest.</txt></block></subclause><subclause id="sec.30-ssec.3" guid="_d16f94d5-c242-4b12-8ce7-eb876d2d1296" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">In determining for the purposes of <intref refid="sec.30-ssec.1" target.guid="_22e5a459-225e-4082-a09d-5f051888c47a" check="valid">subsection&#160;(1)</intref> whether the conduct of the defendant in publishing matter about a person is reasonable in the circumstances, a court may take into account—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.30-ssec.3-para1.a" guid="_a862001e-fbe5-485e-89b3-51419f705f1e" provision.type="other"><no>(a)</no><block><txt break.before="1">the extent to which the matter published is of public interest; and</txt></block></li><li id="sec.30-ssec.3-para1.b" guid="_5a1ef6a8-3c5d-47dd-99c3-f02ed18b0e27" provision.type="other"><no>(b)</no><block><txt break.before="1">the extent to which the matter published relates to the performance of the public functions or activities of the person; and</txt></block></li><li id="sec.30-ssec.3-para1.c" guid="_26c233da-122d-440d-9733-c78f5fdd2d9e" provision.type="other"><no>(c)</no><block><txt break.before="1">the seriousness of any defamatory imputation carried by the matter published; and</txt></block></li><li id="sec.30-ssec.3-para1.d" guid="_b3330876-1220-4880-a933-cb27d669ff64" provision.type="other"><no>(d)</no><block><txt break.before="1">the extent to which the matter published distinguishes between suspicions, allegations and proven facts; and</txt></block></li><li id="sec.30-ssec.3-para1.e" guid="_e542d301-5a84-457c-afae-a35c06bf44b8" provision.type="other"><no>(e)</no><block><txt break.before="1">whether it was in the public interest in the circumstances for the matter published to be published expeditiously; and</txt></block></li><li id="sec.30-ssec.3-para1.f" guid="_7337b74e-8d04-4a29-8877-38dd9d989cc8" provision.type="other"><no>(f)</no><block><txt break.before="1">the nature of the business environment in which the defendant operates; and</txt></block></li><li id="sec.30-ssec.3-para1.g" guid="_1dd5fcc6-904a-4874-893b-1f2f6823ff89" provision.type="other"><no>(g)</no><block><txt break.before="1">the sources of the information in the matter published and the integrity of those sources; and</txt></block></li><li id="sec.30-ssec.3-para1.h" guid="_05cf8079-241e-4ab7-b490-7e2b1103c9da" provision.type="other"><no>(h)</no><block><txt break.before="1">whether the matter published contained the substance of the person’s side of the story and, if not, whether a reasonable attempt was made by the defendant to obtain and publish a response from the person; and</txt></block></li><li id="sec.30-ssec.3-para1.i" guid="_40ad79ec-6b42-4625-b45f-6f158ed28245" provision.type="other"><no>(i)</no><block><txt break.before="1">any other steps taken to verify the information in the matter published; and</txt></block></li><li id="sec.30-ssec.3-para1.j" guid="_a19318c4-8d5c-4030-affc-9cf537d056d8" provision.type="other"><no>(j)</no><block><txt break.before="1">any other circumstances that the court considers relevant.</txt></block></li></list></block></subclause><subclause id="sec.30-ssec.4" guid="_ae9113c9-88aa-4591-ad23-c09ce42f6c99" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">For the avoidance of doubt, a defence of qualified privilege under <intref refid="sec.30-ssec.1" target.guid="_22e5a459-225e-4082-a09d-5f051888c47a" check="valid">subsection&#160;(1)</intref> is defeated if the plaintiff proves that the publication of the defamatory matter was actuated by malice.</txt></block></subclause><subclause id="sec.30-ssec.5" guid="_89732270-5f22-46dd-adf7-e20dea3dfb78" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="1">However, a defence of qualified privilege under <intref refid="sec.30-ssec.1" target.guid="_22e5a459-225e-4082-a09d-5f051888c47a" check="valid">subsection&#160;(1)</intref> is not defeated merely because the defamatory matter was published for reward.</txt></block></subclause></clause><clause id="sec.31" guid="_c9cc058c-f87c-4d2e-a442-68a9e8cc67c4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>31</no><heading id="sec.31-he" guid="_84e052e0-9d6a-4665-80bc-0ca07003d90a">Defences of honest opinion</heading><subclause id="sec.31-ssec.1" guid="_4e54e1ba-4c44-40ca-908a-cacbab33aac0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">It is a defence to the publication of defamatory matter if the defendant proves that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.1-para1.a" guid="_e63e049e-0452-43e4-b5c6-71760bce62b6" provision.type="other"><no>(a)</no><block><txt break.before="1">the matter was an expression of opinion of the defendant rather than a statement of fact; and</txt></block></li><li id="sec.31-ssec.1-para1.b" guid="_9bc908b7-f16c-4fba-9798-d8a71168688f" provision.type="other"><no>(b)</no><block><txt break.before="1">the opinion related to a matter of public interest; and</txt></block></li><li id="sec.31-ssec.1-para1.c" guid="_415cb82a-9d6b-437e-8637-99575659498e" provision.type="other"><no>(c)</no><block><txt break.before="1">the opinion is based on proper material.</txt></block></li></list></block></subclause><subclause id="sec.31-ssec.2" guid="_823d95b9-4bcd-4996-8092-7e9a5fc96ba0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">It is a defence to the publication of defamatory matter if the defendant proves that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.2-para1.a" guid="_d1b55715-b695-4646-9225-4fa8a637a5b6" provision.type="other"><no>(a)</no><block><txt break.before="1">the matter was an expression of opinion of an employee or agent of the defendant rather than a statement of fact; and</txt></block></li><li id="sec.31-ssec.2-para1.b" guid="_efcbcfb9-2a73-410e-98bd-6ec70ca8b11a" provision.type="other"><no>(b)</no><block><txt break.before="1">the opinion related to a matter of public interest; and</txt></block></li><li id="sec.31-ssec.2-para1.c" guid="_e70b25a1-0244-4cd4-8b88-cb1579d6f734" provision.type="other"><no>(c)</no><block><txt break.before="1">the opinion is based on proper material.</txt></block></li></list></block></subclause><subclause id="sec.31-ssec.3" guid="_9804dc87-5d91-4a85-86c6-1924ac3181c8" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">It is a defence to the publication of defamatory matter if the defendant proves that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.3-para1.a" guid="_9e66ddbd-0c57-4bdf-b0bb-bc3680dd9ead" provision.type="other"><no>(a)</no><block><txt break.before="1">the matter was an expression of opinion of a person (the <defterm id="sec.31-ssec.3-def.commentator" guid="_13793edf-f8b4-4d29-b625-b523883a178a" type="definition">commentator</defterm>), other than the defendant or an employee or agent of the defendant, rather than a statement of fact; and</txt></block></li><li id="sec.31-ssec.3-para1.b" guid="_9a9e3d98-b3ab-4b92-9bd3-b52f489d0433" provision.type="other"><no>(b)</no><block><txt break.before="1">the opinion related to a matter of public interest; and</txt></block></li><li id="sec.31-ssec.3-para1.c" guid="_836d21cc-2a56-4c8d-b946-28b5b6b04219" provision.type="other"><no>(c)</no><block><txt break.before="1">the opinion is based on proper material.</txt></block></li></list></block></subclause><subclause id="sec.31-ssec.4" guid="_740fa3ac-b9d3-45b9-bf99-97d9a1af4879" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">A defence established under this section is defeated if, and only if, the plaintiff proves that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.4-para1.a" guid="_660c5bb4-213b-47c8-9506-301058d9c721" provision.type="other"><no>(a)</no><block><txt break.before="1">in the case of a defence under <intref refid="sec.31-ssec.1" target.guid="_4e54e1ba-4c44-40ca-908a-cacbab33aac0" check="valid">subsection&#160;(1)</intref>—the opinion was not honestly held by the defendant at the time the defamatory matter was published; or</txt></block></li><li id="sec.31-ssec.4-para1.b" guid="_1bdf3847-deb1-4da0-89b7-a027febdf512" provision.type="other"><no>(b)</no><block><txt break.before="1">in the case of a defence under <intref refid="sec.31-ssec.2" target.guid="_823d95b9-4bcd-4996-8092-7e9a5fc96ba0" check="valid">subsection&#160;(2)</intref>—the defendant did not believe that the opinion was honestly held by the employee or agent at the time the defamatory matter was published; or</txt></block></li><li id="sec.31-ssec.4-para1.c" guid="_828015c2-c002-4bc5-ba52-f4133ce1c8d5" provision.type="other"><no>(c)</no><block><txt break.before="1">in the case of a defence under <intref refid="sec.31-ssec.3" target.guid="_9804dc87-5d91-4a85-86c6-1924ac3181c8" check="valid">subsection&#160;(3)</intref>—the defendant had reasonable grounds to believe that the opinion was not honestly held by the commentator at the time the defamatory matter was published.</txt></block></li></list></block></subclause><subclause id="sec.31-ssec.5" guid="_8378ccbd-6e18-4e78-ad2b-3369e155af93" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="1">For the purposes of this section, an opinion is based on <defterm id="sec.31-def.propermaterial" guid="_74b7990c-f8b3-4acf-9e1c-7ac0140fcf82" type="definition">proper material </defterm>if it is based on material that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.5-para1.a" guid="_3e272353-92a4-4182-a422-25f85a4c9222" provision.type="other"><no>(a)</no><block><txt break.before="1">is substantially true; or</txt></block></li><li id="sec.31-ssec.5-para1.b" guid="_8f84a70e-7c5c-4168-a763-b5b8749d08ea" provision.type="other"><no>(b)</no><block><txt break.before="1">was published on an occasion of absolute or qualified privilege (whether under this Act or at general law); or</txt></block></li><li id="sec.31-ssec.5-para1.c" guid="_d11bc745-0c14-46e8-9ead-ffcba3025913" provision.type="other"><no>(c)</no><block><txt break.before="1">was published on an occasion that attracted the protection of a defence under this section or <intref refid="sec.28" target.guid="_51cf46b6-f13a-4066-972d-bff8f59b97f9" check="valid">section&#160;28</intref> or <intref refid="sec.29" target.guid="_4a6b3731-662b-4b6d-9396-5883c39d066d" check="valid">29</intref>.</txt></block></li></list></block></subclause><subclause id="sec.31-ssec.6" guid="_75532cbb-2081-4dab-abc5-a08f2f6a96e0" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="1">An opinion does not cease to be based on proper material only because some of the material on which it is based is not proper material if the opinion might reasonably be based on such of the material as is proper material.</txt></block></subclause></clause><clause id="sec.32" guid="_eceebec4-37ca-4529-8410-045f2a488547" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>32</no><heading id="sec.32-he" guid="_7755a779-dc20-4adc-bf94-9454bf6c1a80">Defence of innocent dissemination</heading><subclause id="sec.32-ssec.1" guid="_e2441035-6b2b-41e2-be5e-028481dc0cd5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">It is a defence to the publication of defamatory matter if the defendant proves that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.1-para1.a" guid="_298d0897-f31c-44a1-a2d0-58ad2e473128" provision.type="other"><no>(a)</no><block><txt break.before="1">the defendant published the matter merely in the capacity, or as an employee or agent, of a subordinate distributor; and</txt></block></li><li id="sec.32-ssec.1-para1.b" guid="_c0455f38-4e14-4207-b005-e70ffa1284d3" provision.type="other"><no>(b)</no><block><txt break.before="1">the defendant neither knew, nor ought reasonably to have known, that the matter was defamatory; and</txt></block></li><li id="sec.32-ssec.1-para1.c" guid="_d25cb73f-b022-4c12-b7c6-d1f74422959c" provision.type="other"><no>(c)</no><block><txt break.before="1">the defendant’s lack of knowledge was not due to any negligence on the part of the defendant.</txt></block></li></list></block></subclause><subclause id="sec.32-ssec.2" guid="_275907d5-31cd-48ac-82c6-4c6ffc66f409" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">For the purposes of <intref refid="sec.32-ssec.1" target.guid="_e2441035-6b2b-41e2-be5e-028481dc0cd5" check="valid">subsection&#160;(1)</intref>, a person is a <defterm id="sec.32-def.subordinatedistributor" guid="_26156a72-e667-4073-8875-91d3171dcdc9" type="definition">subordinate distributor </defterm>of defamatory matter if the person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.2-para1.a" guid="_7ff49fe2-28e1-4567-a78f-ce3a8c83521b" provision.type="other"><no>(a)</no><block><txt break.before="1">was not the first or primary distributor of the matter; and</txt></block></li><li id="sec.32-ssec.2-para1.b" guid="_3c803cfb-1304-4522-978d-7df29382f977" provision.type="other"><no>(b)</no><block><txt break.before="1">was not the author or originator of the matter; and</txt></block></li><li id="sec.32-ssec.2-para1.c" guid="_06b38987-de9e-4475-b3fc-0357554341ef" provision.type="other"><no>(c)</no><block><txt break.before="1">did not have any capacity to exercise editorial control over the content of the matter (or over the publication of the matter) before it was first published.</txt></block></li></list></block></subclause><subclause id="sec.32-ssec.3" guid="_8d36d312-a1c8-48c3-b541-f621210281a2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">Without limiting <intref refid="sec.32-ssec.2" target.guid="_275907d5-31cd-48ac-82c6-4c6ffc66f409" check="valid">subsection&#160;(2)</intref><intref refid="sec.32-ssec.2-para1.a" target.guid="_7ff49fe2-28e1-4567-a78f-ce3a8c83521b" check="valid">(a)</intref>, a person is not the first or primary distributor of matter merely because the person was involved in the publication of the matter in the capacity of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.3-para1.a" guid="_96925058-064f-4cf7-b59a-b9fe56056417" provision.type="other"><no>(a)</no><block><txt break.before="1">a bookseller, newsagent or news-vendor; or</txt></block></li><li id="sec.32-ssec.3-para1.b" guid="_a929d605-d494-4a3a-9d2c-359f3457a723" provision.type="other"><no>(b)</no><block><txt break.before="1">a librarian; or</txt></block></li><li id="sec.32-ssec.3-para1.c" guid="_8422c131-1edd-4ea1-b3b1-9f22d76088b6" provision.type="other"><no>(c)</no><block><txt break.before="1">a wholesaler or retailer of the matter; or</txt></block></li><li id="sec.32-ssec.3-para1.d" guid="_59b4d52d-660d-4678-ad7e-c4e24410bda0" provision.type="other"><no>(d)</no><block><txt break.before="1">a provider of postal or similar services by means of which the matter is published; or</txt></block></li><li id="sec.32-ssec.3-para1.e" guid="_29ae212a-00a2-4a77-a935-df4646c049cc" provision.type="other"><no>(e)</no><block><txt break.before="1">a broadcaster of a live program (whether on television, radio or otherwise) containing the matter in circumstances in which the broadcaster has no effective control over the person who makes the statements that comprise the matter; or</txt></block></li><li id="sec.32-ssec.3-para1.f" guid="_0f5ed7d3-422f-440b-9320-1e302a11a7b7" provision.type="other"><no>(f)</no><block><txt break.before="1">a provider of services consisting of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.3-para1.f-para2.i" guid="_bcbb71ed-97ea-4043-addf-478ec2693fdf" provision.type="other"><no>(i)</no><block><txt break.before="1">the processing, copying, distributing or selling of any electronic medium in or on which the matter is recorded; or</txt></block></li><li id="sec.32-ssec.3-para1.f-para2.ii" guid="_6e21dce1-f823-4dda-af1d-28e3af341a7d" provision.type="other"><no>(ii)</no><block><txt break.before="1">the operation of, or the provision of, any equipment, system or service, by means of which the matter is retrieved, copied, distributed or made available in electronic form; or</txt></block></li></list></block></li><li id="sec.32-ssec.3-para1.g" guid="_dba3b3ba-6331-410c-a184-8f841e2587d6" provision.type="other"><no>(g)</no><block><txt break.before="1">an operator of, or a provider of access to, a communications system by means of which the matter is transmitted, or made available, by another person over whom the operator or provider has no effective control; or</txt></block></li><li id="sec.32-ssec.3-para1.h" guid="_31f2e798-270d-4dd2-8211-a2af0bfb98b5" provision.type="other"><no>(h)</no><block><txt break.before="1">a person who, on the instructions or at the direction of another person, prints or produces, reprints or reproduces or distributes the matter for or on behalf of that other person.</txt></block></li></list></block></subclause></clause><clause id="sec.33" guid="_9a25115c-1be1-40ad-85cf-241f6e82d073" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>33</no><heading id="sec.33-he" guid="_b205a50b-b194-4c63-be41-966affc521f4">Defence of triviality</heading><block><txt break.before="1">It is a defence to the publication of defamatory matter if the defendant proves that the circumstances of publication were such that the plaintiff was unlikely to sustain any harm.</txt></block></clause></division><division id="pt.4-div.3" guid="_85b45fb3-a57b-4597-b6b2-b05fbed98ae1" affected.by.uncommenced="0"><no>Division 3</no><heading provision.type="other"><no>34</no><heading id="sec.34-he" guid="_76d5541b-8053-4f01-8e99-b50c4b87104a">Damages to bear rational relationship to harm</heading><block><txt break.before="1">In determining the amount of damages to be awarded in any defamation proceedings, the court is to ensure that there is an appropriate and rational relationship between the harm sustained by the plaintiff and the amount of damages awarded.</txt></block></clause><clause id="sec.35" guid="_97dc44ea-0a45-4d60-8dc6-8c5460a191b2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>35</no><heading id="sec.35-he" guid="_897f7881-edd4-430f-8961-ffce537af64e">Damages for non-economic loss limited</heading><subclause id="sec.35-ssec.1" guid="_32d65837-6c64-4e3b-938e-6887e09a333d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">Unless the court orders otherwise under <intref refid="sec.35-ssec.2" target.guid="_3eea8128-ee52-4d3c-9427-aa810abb4de8" check="valid">subsection&#160;(2)</intref>, the maximum amount of damages for non-economic loss that may be awarded in defamation proceedings is $250000 or any other amount adjusted in accordance with this section from time to time (the <defterm id="sec.35-def.maximumdamagesamount" guid="_8370fb56-4b25-4080-90bd-75fb9ec068e2" type="definition">maximum damages amount</defterm>) that is applicable at the time damages are awarded.</txt></block></subclause><subclause id="sec.35-ssec.2" guid="_3eea8128-ee52-4d3c-9427-aa810abb4de8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">A court may order a defendant in defamation proceedings to pay damages for non-economic loss that exceed the maximum damages amount applicable at the time the order is made if, and only if, the court is satisfied that the circumstances of the publication of the defamatory matter to which the proceedings relate are such as to warrant an award of aggravated damages.</txt></block></subclause><subclause id="sec.35-ssec.3" guid="_7819ba54-e45f-4954-8dc5-ae8160fca146" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">The Minister is, on or before 1 July 2006 and on or before 1 July in each succeeding year, to declare, by order published in the gazette, the amount that is to apply, as from the date specified in the order, for the purposes of <intref refid="sec.35-ssec.1" target.guid="_32d65837-6c64-4e3b-938e-6887e09a333d" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.35-ssec.4" guid="_09dcde31-d6bb-4553-9f83-2665a7784b3e" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="1">The amount declared is to be the amount applicable under <intref refid="sec.35-ssec.1" target.guid="_32d65837-6c64-4e3b-938e-6887e09a333d" check="valid">subsection&#160;(1)</intref> (or that amount as last adjusted under this section) adjusted by the percentage change in the amount estimated by the Australian Statistician of the average weekly total earnings of full-time adults in Australia over the 4 quarters preceding the date of the declaration for which those estimates are, at that date, available.</txt></block></subclause><subclause id="sec.35-ssec.5" guid="_de0c3d7b-00a5-4c61-b123-a75cca5e115a" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="1">An amount declared for the time being under this section applies to the exclusion of the amount of $250000 or an amount previously adjusted under this section.</txt></block></subclause><subclause id="sec.35-ssec.6" guid="_860fbace-8196-4e88-965d-212411c62cbd" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="1">If the Australian Statistician fails or ceases to estimate the amount referred to in <intref refid="sec.35-ssec.4" target.guid="_09dcde31-d6bb-4553-9f83-2665a7784b3e" check="valid">subsection&#160;(4)</intref>, the amount declared is to be determined under a regulation.</txt></block></subclause><subclause id="sec.35-ssec.7" guid="_646e114d-e620-4e9a-99f2-e69c2086e022" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="1">In adjusting an amount to be declared for the purposes of <intref refid="sec.35-ssec.1" target.guid="_32d65837-6c64-4e3b-938e-6887e09a333d" check="valid">subsection&#160;(1)</intref>, the amount determined in accordance with <intref refid="sec.35-ssec.4" target.guid="_09dcde31-d6bb-4553-9f83-2665a7784b3e" check="valid">subsection&#160;(4)</intref> is to be rounded to the nearest $500.</txt></block></subclause><subclause id="sec.35-ssec.8" guid="_3f3d4e99-deaf-4cce-a974-6577d98de017" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="1">A declaration made or published in the gazette after 1 July in a year and specifying a date that is before the date it is made or published as the date from which the amount declared by the order is to apply has effect as from that specified defamation, the court is to disregard the malice or other state of mind of the defendant at the time of the publication of the defamatory matter to which the proceedings relate or at any other time except to the extent that the malice or other state of mind affects the harm sustained by the plaintiff.</txt></block></clause><clause id="sec.37" guid="_c22c23d4-fc67-41cc-a13e-4cf389beb3c9" in mitigation of damages</heading><subclause id="sec.38-ssec.1" guid="_0e3da959-93b5-4ad2-b9e2-0577e628673d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">Evidence is admissible on behalf of the defendant, in mitigation of damages for the publication of defamatory matter, that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.38-ssec.1-para1.a" guid="_f1eda0aa-37ee-4fdd-bb16-6bb7c10325a0" provision.type="other"><no>(a)</no><block><txt break.before="1">the defendant has made an apology to the plaintiff about the publication of the defamatory matter; or</txt></block></li><li id="sec.38-ssec.1-para1.b" guid="_582d4e70-5911-4cc8-9522-f2bafff6e78d" provision.type="other"><no>(b)</no><block><txt break.before="1">the defendant has published a correction of the defamatory matter; or</txt></block></li><li id="sec.38-ssec.1-para1.c" guid="_08b201d9-f5f7-4dd3-b408-3f0293f85664" provision.type="other"><no>(c)</no><block><txt break.before="1">the plaintiff has already recovered damages for defamation in relation to any other publication of matter having the same meaning or effect as the defamatory matter; or</txt></block></li><li id="sec.38-ssec.1-para1.d" guid="_8fe60d8d-acec-4bf0-9c2e-c7d0096cfa0a" provision.type="other"><no>(d)</no><block><txt break.before="1">the plaintiff has brought proceedings for damages for defamation in relation to any other publication of matter having the same meaning or effect as the defamatory matter; or</txt></block></li><li id="sec.38-ssec.1-para1.e" guid="_9578c317-2f4b-4407-b758-bd78675cb8bd" provision.type="other"><no>(e)</no><block><txt break.before="1">the plaintiff has received or agreed to receive compensation for defamation in relation to any other publication of matter having the same meaning or effect as the defamatory matter.</txt></block></li></list></block></subclause><subclause id="sec.38-ssec.2" guid="_31ae50ba-d998-4d61-8278-28ae258c24ff" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">Nothing in <intref refid="sec.38-ssec.1" target.guid="_0e3da959-93b5-4ad2-b9e2-0577e628673d" check="valid">subsection&#160;(1)</intref> operates to limit the matters that can be taken into account by a court in mitigation of proceedings finds for the plaintiff as to more than 1 cause of action, the judicial officer may assess damages in a single sum.</txt></block></clause></division><division id="pt.4-div.4" in defamation proceedings</heading><subclause id="sec.40-ssec.1" guid="_60381975-c46b-4c16-ab48-563ae6e79cbd" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">In awarding costs in defamation proceedings, the court may have regard to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.40-ssec.1-para1.a" guid="_85bf427a-aff3-4248-901a-724e0dbde149" provision.type="other"><no>(a)</no><block><txt break.before="1">the way in which the parties to the proceedings conducted their cases (including any misuse of a party’s superior financial position to hinder the early resolution of the proceedings); and</txt></block></li><li id="sec.40-ssec.1-para1.b" guid="_f1b0ba68-edfc-4161-afdb-a643ffb117c5" provision.type="other"><no>(b)</no><block><txt break.before="1">any other matters that the court considers relevant.</txt></block></li></list></block></subclause><subclause id="sec.40-ssec.2" guid="_330abe49-6d6a-4d17-9c57-46dc6e3220b8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">Without limiting <intref refid="sec.40-ssec.1" target.guid="_60381975-c46b-4c16-ab48-563ae6e79cbd" check="valid">subsection&#160;(1)</intref>, a court must (unless the interests of justice require otherwise)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.40-ssec.2-para1.a" guid="_8c9874ba-628d-4ea9-86d7-b32bd1f7d8dd" provision.type="other"><no>(a)</no><block><txt break.before="1">if defamation proceedings are successfully brought by a plaintiff and costs in the proceedings are to be awarded to the plaintiff—order costs of and incidental to the proceedings to be assessed on an indemnity basis if the court is satisfied that the defendant unreasonably failed to make a settlement offer or agree to a settlement offer proposed by the plaintiff; or</txt></block></li><li id="sec.40-ssec.2-para1.b" guid="_4213bbd4-4623-4887-889e-1a697b679ea5" provision.type="other"><no>(b)</no><block><txt break.before="1">if defamation proceedings are unsuccessfully brought by a plaintiff and costs in the proceedings are to be awarded to the defendant—order costs of and incidental to the proceedings to be assessed on an indemnity basis if the court is satisfied that the plaintiff unreasonably failed to accept a settlement offer made by the defendant.</txt></block></li></list></block></subclause><subclause id="sec.40-ssec.3" guid="_4859c2fd-3e72-4959-80c4-fe813c4bef9d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">In this section—</txt><deflist><definition id="sec.40-ssec.3-def.settlementoffer_" guid="_97987d6c-bbbb-482e-b89f-d1814a5f0965" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.40-ssec.3-def.settlementoffer" guid="_d1744857-c94b-440b-b211-b5b748484399" type="definition">settlement offer </defterm>means any offer to settle the proceedings made before the proceedings are determined, and includes an offer to make amends (whether made before or after the proceedings are commenced), that was a reasonable offer at the time it was made.</txt></definition></deflist></block></subclause></clause></division></part><part id="pt.5" guid="_0cdb0b6a-380f-43f3-8a37-11b7aa5b33e0" otherwise produced by means adapted for the production of numerous copies and there is in the document a statement to the effect that the document is printed, produced, published or distributed by or Australian court is conclusive evidence that the person committed the offence; and</txt></block></li><li id="sec.42-ssec.1-para1.b" guid="_de4ed733-a0f6-4461-a53c-66a58a8a2c24" provision.type="other"><no>(b)</no><block><txt break.before="1">proof that the person was convicted of the offence by a court of any country (other than an Australian court) or a court martial of any country is evidence that the person committed the offence.</txt></block></li></list></block></subclause><subclause id="sec.42-ssec.2" guid="_ffd48d3e-e80a-45e0-8b0f-552074855b08" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">For the purposes of this section, the contents of a document that is evidence of conviction of an offence, and the contents of an information, complaint, indictment, charge sheet or similar document on which a person is convicted of an offence, are admissible in evidence to identify the facts on which the a plaintiff; and</txt></block></li><li id="sec.49-ssec.2-para1.b" guid="_19a68597-5d67-48f2-b452-d3f03187bb21" provision.type="other"><no>(b)</no><block><txt break.before="1">each cause of action in the proceedings accrues because of the publication of the same, or substantially the same, matter on separate occasions (whether by the same defendant or another defendant); and</txt></block></li><li
