guid="_c2868523-7eea-4177-847e-bcefa310c633" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>275ZI </no><heading id="sec.3-frag-pt.4D-sec.275ZI-he" guid="_12b24526-5dd7-46ab-b8ef-ff046088eee4">Definitions for part</heading><block><txt break.before="1">In this part—</txt><deflist><definition id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling_" guid="_cae15b87-a736-42f7-acdc-2ad3e0912b38" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling" guid="_7f5a9d94-e00a-4c4c-8268-bcbb5030d803" type="definition">dwelling</defterm> means a building, or part of a building, that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling-para1.a" guid="_58b29663-a2cc-43b6-afdd-913412437cd1" provision.type="other"><no>(a)</no><block><txt break.before="0">is used, or is capable of being used, as a self-contained residence; and</txt></block></li><li id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling-para1.b" guid="_234dc5a4-b67a-4e92-8736-f4b16d52f51c" provision.type="other"><no>(b)</no><block><txt break.before="0">contains—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling-para1.b-para2.i" guid="_063db5d2-f547-4572-afb1-7ecb7d0903e1" provision.type="other"><no>(i)</no><block><txt break.before="0">food preparation facilities; and</txt></block></li><li id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling-para1.b-para2.ii" guid="_a41763af-f32d-4817-a76f-149afae2cecb" provision.type="other"><no>(ii)</no><block><txt break.before="0">a bath or shower; and</txt></block></li><li id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling-para1.b-para2.iii" guid="_1fcbc043-0928-45a5-8ebf-d10b6d5e9ac6" provision.type="other"><no>(iii)</no><block><txt break.before="0">a toilet; and</txt></block></li><li id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling-para1.b-para2.iv" guid="_7a6a74eb-0e9c-48b8-9cc3-eeffe849ec19" provision.type="other"><no>(iv)</no><block><txt break.before="0">a wash basin; and</txt></block></li><li id="sec.3-frag-pt.4D-sec.275ZI-def.dwelling-para1.b-para2.v" guid="_48320d80-6d21-46b4-8b77-3bafadc06b62" provision.type="other"><no>(v)</no><block><txt break.before="0">facilities for washing clothes.</txt></block></li></list></block></li></list></definition><definition id="sec.3-frag-pt.4D-sec.275ZI-def.publichousing_" guid="_63338aad-cfa8-4a54-a8b0-f2bd6d6a238f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.4D-sec.275ZI-def.publichousing" guid="_e2bad6f2-6e45-40ee-ba02-66b2d6a5462f" type="definition">public housing</defterm> see the <legref target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Housing Act 2003</name></legref>, section 8(4).</txt></definition></deflist></block></clause><clause id="sec.3-frag-pt.4D-sec.275ZJ" guid="_bb99415d-7332-4d68-9fbf-fe07a09974a1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>275ZJ </no><heading id="sec.3-frag-pt.4D-sec.275ZJ-he" guid="_5eb1609b-a115-4e9f-a11b-ee8e70c0f041">Implementing inclusionary zoning strategy</heading><subclause id="sec.3-frag-pt.4D-sec.275ZJ-ssec.1" guid="_47b96932-098f-4955-8722-3e4abf42f0df" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Minister must, within 2 months after the relevant date, introduce a Bill in the Legislative Assembly that achieves the objectives mentioned in sections 275ZK and 275ZL.</txt></block></subclause><subclause id="sec.3-frag-pt.4D-sec.275ZJ-ssec.2" guid="_e090aa09-209d-4de6-9bbe-051e0a56622b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-frag-pt.4D-sec.275ZJ-ssec.2-def.relevantdate_" guid="_4aec3ed9-39ea-4ee9-ae4d-15e52b71228e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.4D-sec.275ZJ-ssec.2-def.relevantdate" guid="_d6413ce3-dbc4-42a4-a324-aac483256a6c" type="definition">relevant date</defterm> means the date of assent of the <legref check="invalid" jurisd="QLD" type="act"><name emphasis="yes">Planning (Inclusionary Zoning Strategy) Amendment Act 2023</name></legref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.3-frag-pt.4D-sec.275ZK" guid="_99f7e671-ec23-4458-af87-7b81fe45a916" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>275ZK </no><heading id="sec.3-frag-pt.4D-sec.275ZK-he" guid="_17cd79ff-ed52-4cd4-943a-c58e928e878d">Objectives for residential construction projects</heading><subclause id="sec.3-frag-pt.4D-sec.275ZK-ssec.1" guid="_6dd712ff-792e-447c-876f-e5d443684d24" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For all residential construction projects completed on or after 1 July 2024, at least 25% of the dwellings (rounded up to the nearest whole number) constructed for the project are to be reserved for transfer to the State for the purpose of providing public housing.</txt></block></subclause><subclause id="sec.3-frag-pt.4D-sec.275ZK-ssec.2" guid="_483431a7-f5f4-440b-a526-e78ad1483f97" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Each reserved dwelling is, as far as practicable, to be finished to the same standard, and have the same features, as the other dwellings constructed for the residential construction project.</txt></block></subclause><subclause id="sec.3-frag-pt.4D-sec.275ZK-ssec.3" guid="_2d21199f-73bb-4258-bf61-34b16d5b47b6" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Each reserved dwelling is, as far as practicable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.4D-sec.275ZK-ssec.3-para1.a" guid="_6e185f2e-0816-47b4-a7e3-cdc72719de75" provision.type="other"><no>(a)</no><block><txt break.before="0">if the reserved dwelling is a class 1(a) building under the Building Code—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-pt.4D-sec.275ZK-ssec.3-para1.a-para2.i" guid="_ccf87181-9cf5-4bd9-ab15-7fb2a5ba59e7" provision.type="other"><no>(i)</no><block><txt break.before="0">to have a total floor area equal to, or greater than, the average total floor area of all class 1(a) buildings constructed for the residential construction project; and</txt></block></li><li id="sec.3-frag-pt.4D-sec.275ZK-ssec.3-para1.a-para2.ii" guid="_56624dbb-353e-47a7-981e-3acafd449ec2" provision.type="other"><no>(ii)</no><block><txt break.before="0">to be constructed on a lot that has an area equal to, or greater than, the average area of all lots on which other class 1(a) buildings are constructed for the residential construction project; or</txt></block></li></list></block></li><li id="sec.3-frag-pt.4D-sec.275ZK-ssec.3-para1.b" guid="_1c8164d8-6e67-4dc1-8340-bc281dded9a1" provision.type="other"><no>(b)</no><block><txt break.before="0">if the dwelling is part of a class 2 building under the Building Code—to have a total floor area equal to, or greater than, the average total floor area of all dwellings constructed in class 2 buildings for the residential construction project.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-pt.4D-sec.275ZK-ssec.4" guid="_5aeaec7a-5b4a-4384-90ce-94b5de72ce3d" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Each reserved dwelling not already owned by the State is to be transferred to the State, for no consideration, as soon as practicable after the dwelling is able to be lawfully transferred.</txt></block></subclause><subclause id="sec.3-frag-pt.4D-sec.275ZK-ssec.5" guid="_9d1a10d2-3f27-4362-91a1-52811bbf0fa6" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Each reserved dwelling is to be used only for the purpose of providing public housing.</txt></block></subclause><subclause id="sec.3-frag-pt.4D-sec.275ZK-ssec.6" guid="_8c2ddc59-857f-417a-9bbd-f6fd7a3a1a92" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-frag-pt.4D-sec.275ZK-ssec.6-def.reserveddwelling_" guid="_7bec1280-4623-4387-a332-60d104d0d2d6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.4D-sec.275ZK-ssec.6-def.reserveddwelling" guid="_60538870-6364-4c1a-b6ed-af7a67b4440e" type="definition">reserved dwelling</defterm> means a dwelling reserved for transfer to the State, under subsection (1), for the purpose of providing public housing.</txt></definition><definition id="sec.3-frag-pt.4D-sec.275ZK-ssec.6-def.residentialconstructionproject_" guid="_13382d86-d148-4d0f-b7e2-2e807ca69d82" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.4D-sec.275ZK-ssec.6-def.residentialconstructionproject" guid="_8a3b1e23-0819-4ce8-9b06-6b513f01daee" type="definition">residential construction project</defterm> means development, carried out by an entity other than the State, related to the construction of 10 or more dwellings.</txt></definition><definition id="sec.3-frag-pt.4D-sec.275ZK-ssec.6-def.totalfloorarea_" guid="_72f04b4d-7b1c-4584-a439-1e5e87584439" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-frag-pt.4D-sec.275ZK-ssec.6-def.totalfloorarea" guid="_2c710c80-5210-4464-a5a1-6d50c3321252" type="definition">total floor area</defterm>, of a dwelling, means the combined internal and external floor areas of the dwelling.</txt></definition></deflist></block></subclause></clause><clause id="sec.3-frag-pt.4D-sec.275ZL" guid="_7cb4a427-924b-45f1-8abf-8975393aaec6" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>275ZL </no><heading id="sec.3-frag-pt.4D-sec.275ZL-he" guid="_6791c21c-67c0-4b89-9f33-d2ebaf29a5e9">Objectives for residential subdivision projects</heading><subclause id="sec.3-frag-pt.4D-sec.275ZL-ssec.1" guid="_c14fd30c-df5a-468e-b8ab-49761e97cd73" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For all residential subdivision projects completed on or after 1 July 2024, at least 25% of the lots (rounded up to the nearest whole number) created for the project are to be reserved for transfer to the State for the purpose of providing public housing.</txt></block></subclause><subclause id="sec.3-frag-pt.4D-sec.275ZL-ssec.2" guid="_a350f24f-0856-4997-93ed-5235be2df6d8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Each reserved lot is, as far as practicable, to have an area equal to, or greater than, the average area of all lots created for the residential subdivision project.</txt></block></subclause><subclause id="sec.3-frag-pt.4D-sec.275ZL-ssec.3" guid="_1e61927a-35d8-417d-954c-4fc11d0fd7ed" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Each reserved lot not already owned by the State is to be transferred to the State, for no consideration, as soon as practicable after the lot is able to be lawfully transferred.</txt></block></subclause><subclause project</defterm> means development, carried out by an entity other than the State, related to the subdivision of 1 lot into 10 or more lots on which dwellings can lawfully be
