affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>82A </no><heading id="sec.4-frag-div.1AA-sec.82A-he" guid="_2a470fe0-9c54-4e01-8f61-71a816aa2add">Meaning of <defterm guid="_71c8d16a-1f03-4f5b-a891-e03944f9b330" type="mention">2-year rent freeze period</defterm></heading><block><txt break.before="1">The <defterm id="sec.4-frag-div.1AA-def.2yearrentfreezeperiod" guid="_c17d7191-803c-4c8f-82a7-f2c8b50abade" type="definition">2-year rent freeze period</defterm> is the period of 2 years that starts on the day of commencement.</txt></block></clause><clause id="sec.4-frag-div.1AA-sec.82B" guid="_39969f77-e15d-4273-a72e-c18c57808866" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>82B </no><heading id="sec.4-frag-div.1AA-sec.82B-he" guid="_06807b72-603d-45ba-9197-df06a6eb4c67">Two-year rent freeze</heading><subclause id="sec.4-frag-div.1AA-sec.82B-ssec.1" guid="_c21ee0c4-802d-4519-9113-9eb63e1c3373" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The maximum amount of rent payable (the <defterm id="sec.4-frag-div.1AA-sec.82B-def.maximumrentpayable" guid="_12855e60-937f-49e0-8bb5-603ba69751cc" type="definition">maximum rent payable</defterm>) for a residential tenancy for premises during the 2-year rent freeze period is— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82B-ssec.1-para1.a" guid="_600afd13-13f1-42d4-b6d0-4593311ef80d" provision.type="other"><no>(a)</no><block><txt break.before="0">the amount of rent payable under a residential tenancy agreement for the premises on 1 August 2022; or</txt></block></li><li id="sec.4-frag-div.1AA-sec.82B-ssec.1-para1.b" guid="_21590365-ca4a-4343-b039-130049fd199c" provision.type="other"><no>(b)</no><block><txt break.before="0">if the premises were not let under a residential tenancy agreement on 1 August 2022, the highest of the following amounts—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82B-ssec.1-para1.b-para2.i" guid="_11a86d76-f48e-4434-8c25-0ffa79090dac" provision.type="other"><no>(i)</no><block><txt break.before="0">the amount of rent payable for the premises on the last day the premises were let under a residential tenancy after 1 August 2021;</txt></block></li><li id="sec.4-frag-div.1AA-sec.82B-ssec.1-para1.b-para2.ii" guid="_58170285-4bab-4e69-a7a1-026e393f87a1" provision.type="other"><no>(ii)</no><block><txt break.before="0">the amount of rent stated in an offer of a residential tenancy for the premises by the lessor or lessor’s agent in an advertisement or other public offer published after 1 August 2022;</txt></block></li><li id="sec.4-frag-div.1AA-sec.82B-ssec.1-para1.b-para2.iii" guid="_122dba30-4662-41a8-9e6d-2392b390c190" provision.type="other"><no>(iii)</no><block><txt break.before="0">the amount of rent for the premises worked out under section 82C.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82B-ssec.2" guid="_329fe39f-cccf-41e3-b916-169b576bf410" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">During the 2-year rent freeze period, a lessor or lessor’s agent must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82B-ssec.2-para1.a" guid="_5e38ce10-3b8f-4540-ac28-f0559f15388d" provision.type="other"><no>(a)</no><block><txt break.before="0">require payment of, or take, an amount for rent for a residential tenancy of premises that is more than the maximum rent payable for the tenancy; or</txt></block></li><li id="sec.4-frag-div.1AA-sec.82B-ssec.2-para1.b" guid="_bd850cb9-4dca-4038-b515-9f93e164d584" provision.type="other"><no>(b)</no><block><txt break.before="0">offer a residential tenancy for premises for an amount of rent that is more than the maximum rent payable for the tenancy; or</txt></block></li><li id="sec.4-frag-div.1AA-sec.82B-ssec.2-para1.c" guid="_ac23960a-e0da-4606-9629-a1e0a5961426" provision.type="other"><no>(c)</no><block><txt break.before="0">for residential premises that have been let under a residential tenancy agreement at any time on or after 1 August 2022—give, or offer to give, the right of occupancy for the premises under a short-term letting agreement for an amount of rent that is more than the maximum rent payable for a residential tenancy of the premises.</txt></block></li></list><penalty id="sec.4-frag-div.1AA-sec.82B-ssec.2-pen" guid="_e20001a3-1ca4-44c0-a5f3-b7a54af47e06"><block><txt break.before="1">Maximum penalty—50 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82B-ssec.3" guid="_de4649e8-74c1-4a7e-b609-5f8423507cd0" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.4-frag-div.1AA-sec.82B-ssec.3-def.shorttermlettingagreement_" guid="_97015c15-70b7-44d7-84dd-a765c2942e11" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-frag-div.1AA-sec.82B-ssec.3-def.shorttermlettingagreement" guid="_d4973e31-094f-432b-a965-92de7dc0fed4" type="definition">short-term letting agreement</defterm> means an agreement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82B-ssec.3-def.shorttermlettingagreement-para1.a" guid="_25bab197-effa-450b-9427-46b37d465a21" provision.type="other"><no>(a)</no><block><txt break.before="0">under which the right to occupy residential premises is given on a short-term basis, including, for example, for holiday purposes; and</txt></block></li><li id="sec.4-frag-div.1AA-sec.82B-ssec.3-def.shorttermlettingagreement-para1.b" guid="_a3630789-f876-4e5c-b64c-9d056f773d20" provision.type="other"><no>(b)</no><block><txt break.before="0">that is not a residential tenancy agreement to which this Act applies.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.4-frag-div.1AA-sec.82C" guid="_58a8fa3b-c964-4fd1-95e1-69c4013e47f3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>82C</no><heading id="sec.4-frag-div.1AA-sec.82C-he" guid="_2ac45248-969a-41d9-a0c4-936289a2a886">Maximum amount of rent for premises not let during period 1 August 2021 to 1 August 2022</heading><subclause id="sec.4-frag-div.1AA-sec.82C-ssec.1" guid="_a2146fd6-ba8f-48a8-994b-648ac6840b40" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies in relation to residential premises if the premises were not let under a residential tenancy agreement during the period starting on 1 August 2021 and ending on 1 August 2022, including, for example, because the premises are newly constructed.</txt></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82C-ssec.2" guid="_6136905a-5392-47b0-b75d-1f065887ab33" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For section 82B(1)(b)(iii), the maximum rent payable for a residential tenancy of the premises is the amount of the median rent, for the June quarter in 2022, for comparable residential premises located in an area that has the same postcode as the premises, published on the authority’s website.</txt></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82C-ssec.3" guid="_0fff5d1a-ac38-4d29-bd7d-517f51478732" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In deciding whether residential premises are comparable to other residential premises, the following matters are to be considered—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82C-ssec.3-para1.a" guid="_766361c4-ae82-40d8-89a9-ebb7aad82173" provision.type="other"><no>(a)</no><block><txt break.before="0">the type of the premises;</txt><note id="sec.4-frag-div.1AA-sec.82C-ssec.3-para1.a-note" guid="_ad8da698-2d73-4beb-b20b-f238aa47a324" type="example"><heading id="sec.4-frag-div.1AA-sec.82C-ssec.3-para1.a-note-he" guid="_596cfcd8-bee9-4abd-a816-f45fc1fe8c33">Examples of types of premises—</heading><block><txt break.before="1">house, unit, townhouse</txt></block></note></block></li><li id="sec.4-frag-div.1AA-sec.82C-ssec.3-para1.b" guid="_4b8a04d4-14c6-45fe-9391-dec63916f8ad" provision.type="other"><no>(b)</no><block><txt break.before="0">the number of bedrooms of the premises.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82C-ssec.4" guid="_931deded-153f-432f-9ab5-9ed0b7cb83af" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.4-frag-div.1AA-sec.82C-ssec.4-def.Junequarterin2022_" guid="_b6cfc7f9-76bf-4c02-b07c-7e88d00b2de8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-frag-div.1AA-sec.82C-ssec.4-def.Junequarterin2022" guid="_49c76b40-c2d1-4a91-ab77-a09e2d356163" type="definition">June quarter in 2022</defterm> means the period starting on 1 April 2022 and ending on 30 June 2022.</txt></definition></deflist></block></subclause></clause><clause id="sec.4-frag-div.1AA-sec.82D" guid="_14c2ebce-3c97-40fd-81c7-3212209b702b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>82D </no><heading id="sec.4-frag-div.1AA-sec.82D-he" guid="_11a70514-4ad6-4955-af1c-91b166c0b954">Maximum increase in amount of rent after 2-year rent freeze period</heading><subclause id="sec.4-frag-div.1AA-sec.82D-ssec.1" guid="_bcd506bc-8e00-44a0-be98-d27299b38dde" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies after the 2-year rent freeze period ends.</txt></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82D-ssec.2" guid="_6e97a0a5-f95f-4b55-ac56-d0f7239c3bd4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The maximum amount of rent payable (the <defterm id="sec.4-frag-div.1AA-sec.82D-def.maximumrentpayable" guid="_d08fd5a3-ebf2-4095-91b3-4522dbaf89c1" type="definition">maximum rent payable</defterm>) for a residential tenancy for premises during a 2-year rent period is the amount equivalent to 2% more than—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82D-ssec.2-para1.a" guid="_e78d2867-81ab-4c60-a1c8-0d8d35dc72a1" provision.type="other"><no>(a)</no><block><txt break.before="0">for the 2-year rent period that starts on the day after the last day of the 2-year rent freeze period—the maximum rent payable for a residential tenancy of the premises during the 2-year rent freeze period under section 82B; or</txt></block></li><li id="sec.4-frag-div.1AA-sec.82D-ssec.2-para1.b" guid="_4fd523c9-53d1-4696-94c7-7ff6219dfcf7" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—the maximum amount of rent payable for a residential tenancy of the premises during the previous 2-year rent period.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82D-ssec.3" guid="_a238250d-024e-4ff8-9efe-9a9876bd194e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A lessor or lessor’s agent must not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82D-ssec.3-para1.a" guid="_2e540d0b-18dd-4939-9935-2ad369c9d08e" provision.type="other"><no>(a)</no><block><txt break.before="0">require payment of, or take, an amount for rent for a residential tenancy of premises that is more than the maximum rent payable for the tenancy; or</txt></block></li><li id="sec.4-frag-div.1AA-sec.82D-ssec.3-para1.b" guid="_96c59ba1-bbc4-4ceb-b166-c37e309c072e" provision.type="other"><no>(b)</no><block><txt break.before="0">offer a residential tenancy for premises for an amount of rent that is more than the maximum rent payable for the tenancy.</txt></block></li></list><penalty id="sec.4-frag-div.1AA-sec.82D-ssec.3-pen" guid="_1fd2dda5-3cf2-4431-bc30-6cb86380a8bb"><block><txt break.before="1">Maximum penalty—50 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82D-ssec.4" guid="_31e695a8-a1ef-4637-a812-745b0b394e37" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.4-frag-div.1AA-sec.82D-ssec.4-def.2yearrentperiod_" guid="_f4476b64-14dd-4d51-a1ca-8528b5216925" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-frag-div.1AA-sec.82D-ssec.4-def.2yearrentperiod" guid="_b3584295-0896-42a6-9fc7-f094fd058e67" type="definition">2-year rent period</defterm> means each period of 2 years that starts—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82D-ssec.4-def.2yearrentperiod-para1.a" guid="_02e61fa1-aa8b-4cc8-9010-2a43cfee1ad8" provision.type="other"><no>(a)</no><block><txt break.before="0">on the day after the last day of the 2-year rent freeze period; and</txt></block></li><li id="sec.4-frag-div.1AA-sec.82D-ssec.4-def.2yearrentperiod-para1.b" guid="_13a43f75-4c11-41fc-90fb-9c814295f096" provision.type="other"><no>(b)</no><block><txt break.before="0">on each second anniversary of the day mentioned in paragraph (a).</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.4-frag-div.1AA-sec.82E" guid="_f820f92c-beb3-4da1-b78c-58892aabaf80" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>82E </no><heading id="sec.4-frag-div.1AA-sec.82E-he" guid="_7728acf5-d1e6-4f2e-8311-0c3e0fe6a128">Authority must keep register of rents for residential tenancies</heading><subclause id="sec.4-frag-div.1AA-sec.82E-ssec.1" guid="_43c6d4bd-5418-4e69-9a29-3ba9d4d07aee" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The authority must keep an up-to-date register of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.1AA-sec.82E-ssec.1-para1.a" guid="_219578d7-7c21-4ddf-a753-1c7f82f1a9ec" provision.type="other"><no>(a)</no><block><txt break.before="0">the amount of rent payable under the current residential tenancy for premises; and</txt></block></li><li id="sec.4-frag-div.1AA-sec.82E-ssec.1-para1.b" guid="_4ce3b220-c1bb-42b0-aabb-80128cd81179" provision.type="other"><no>(b)</no><block><txt break.before="0">the maximum rent payable for a residential tenancy of premises.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-div.1AA-sec.82E-ssec.2" guid="_147299df-a86d-4f91-8790-3283680aae5d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The approved form about a rental bond that is required to be given to the authority under section 116(1)(b) or 117(2)(b) must provide for the amount of rent payable under a residential tenancy agreement for the premises to which the rental bond relates to be stated.</txt></block></subclause><subclause affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The authority may give the lessor of the premises a written notice requiring the lessor to notify the authority of the amount of rent payable for the premises under the residential tenancy agreement by the day stated in the notice.</txt></block></subclause><subclause
