guid="_49f79386-e511-4871-a4cd-95e9875b0f22" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to premises if a residential tenancy agreement for the premises has previously been entered into, whether or not the lessor is the same person as the lessor for the previous residential tenancy agreement.</txt></block></subclause><subclause id="sec.8-frag-sec.57A-ssec.2" guid="_cb08c377-3a94-418a-9b23-157962cf7da4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The lessor or lessor’s agent must not— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.57A-ssec.2-para1.a" guid="_e718f441-37d2-4627-aa75-75e5bd5c9164" provision.type="other"><no>(a)</no><block><txt break.before="0">advertise or otherwise offer a residential tenancy for the premises for an amount of rent greater than the indexed rent amount; or</txt></block></li><li id="sec.8-frag-sec.57A-ssec.2-para1.b" guid="_08e90827-9820-4e1a-a3e7-dffce76a3ade" provision.type="other"><no>(b)</no><block><txt break.before="0">enter into a residential tenancy agreement for the premises that includes an amount of rent greater than the indexed rent amount.</txt></block></li></list><penalty id="sec.8-frag-sec.57A-ssec.2-pen" guid="_c193fb44-e600-4fee-ae6f-8121ac12f8a0"><block><txt break.before="1">Maximum penalty—100 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.8-frag-sec.57A-ssec.3" guid="_d7a8dddd-c24d-478b-b7b2-6abab96301ed" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, subsection (2) does not apply in any of the following circumstances—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.57A-ssec.3-para1.a" guid="_029888ff-f091-4fc0-b702-298ff501d846" provision.type="other"><no>(a)</no><block><txt break.before="0">if additional services, facilities or goods are to be provided to a prospective tenant for the tenancy;</txt></block></li><li id="sec.8-frag-sec.57A-ssec.3-para1.b" guid="_430226fd-d1f6-481c-8dd7-2736845a0446" provision.type="other"><no>(b)</no><block><txt break.before="0">if the amenity or standard of the premises has increased substantially since the last rent increase;</txt></block></li><li id="sec.8-frag-sec.57A-ssec.3-para1.c" guid="_5e40f5d6-c863-43b1-bf09-f6f65651afd4" provision.type="other"><no>(c)</no><block><txt break.before="0">if the amount of rates payable for a year for the premises has increased by more than 20% since the last rent increase.</txt></block></li></list></block></subclause><subclause id="sec.8-frag-sec.57A-ssec.4" guid="_8a5eb2c5-b04b-40fd-a629-f998f9ac2d90" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The <defterm id="sec.8-frag-sec.57A-def.indexedrentamount" guid="_ef187d48-b41f-4e3c-87b9-248d3a5d66db" type="definition">indexed rent amount</defterm> is the amount worked out using the formula—</txt><formulablock id="sec.8-frag-sec.57A-ssec.4-eq" guid="_e35e5ab0-78fd-4ef3-bfd5-200e50682f5f" formula.align="center"><formula><eqn file.name="_e35e5ab0-78fd-4ef3-bfd5-200e50682f5f.gif" height="0.563in" width="4.833in" dpi="144"/></formula></formulablock><txt break.before="1">where—</txt><deflist><definition id="sec.8-frag-sec.57A-ssec.4-def.A_" guid="_90095526-fb4c-4a2a-9770-e17524f0318b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-frag-sec.57A-ssec.4-def.A" guid="_8679a1d8-b0a4-4e47-8731-d8a5c954ff25" type="definition">A</defterm> is the indexed rent amount.</txt></definition><definition id="sec.8-frag-sec.57A-ssec.4-def.R_" guid="_42b0ec78-7262-4b6d-99a3-3ad877bc903a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-frag-sec.57A-ssec.4-def.R" guid="_1a78d8f6-8307-474e-8645-6c57f4c0bb13" type="definition">R</defterm> is the amount of the rent for the most recent residential tenancy agreement for the premises.</txt></definition><definition id="sec.8-frag-sec.57A-ssec.4-def.B_" guid="_197d11d3-dda2-4b4a-b042-69a2a183e928" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-frag-sec.57A-ssec.4-def.B" guid="_90e69399-c03e-4d3a-a3c8-75d86e85b3fb" type="definition">B</defterm> is the latest CPI published for a quarter before the lessor advertises or otherwise offers a residential tenancy for the premises.</txt></definition><definition id="sec.8-frag-sec.57A-ssec.4-def.C_" guid="_250aa856-c37e-4ad6-adad-9c1841772ea0" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-frag-sec.57A-ssec.4-def.C" guid="_cd649fcc-52f3-4542-830f-16701f202b21" type="definition">C</defterm> is the CPI published for the corresponding quarter in the year in which the rent was last increased.</txt></definition></deflist></block></subclause><subclause id="sec.8-frag-sec.57A-ssec.5" guid="_bce86b07-3173-44cf-8041-a299364922fa" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.8-frag-sec.57A-ssec.5-def.CPI_" guid="_3a562f36-4a74-49d1-9ba4-38e2401c7963" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-frag-sec.57A-ssec.5-def.CPI" guid="_c64bffa5-e8a1-42fc-8dc2-d5de31ebeadb" type="definition">CPI</defterm>, for a quarter, means the all groups consumer price index for Brisbane published by the Australian Statistician for that quarter.</txt></definition><definition id="sec.8-frag-sec.57A-ssec.5-def.quarter_" guid="_6463a9d8-facf-4005-a28d-1627f7bdedec" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-frag-sec.57A-ssec.5-def.quarter" guid="_5906bb50-1245-4741-ad94-cdfb2c86f8a8" type="definition">quarter</defterm> means any of the following periods in a year—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.57A-ssec.5-def.quarter-para1.a" guid="_c8580eef-1f90-4422-b0f6-ecadbf54073e" provision.type="other"><no>(a)</no><block><txt break.before="0">1 January to 31 March; </txt></block></li><li provision.type="other"><no>(c)</no><block><txt break.before="0">if evidence of identity other than the prospective tenant’s passport is available—details about, or a copy of, the prospective tenant’s passport;</txt></block></li><li id="sec.8-frag-sec.57B-ssec.1-para1.d" guid="_e65030d3-81b3-48f9-a284-5b2bb69c7c6c" provision.type="other"><no>(d)</no><block><txt break.before="0">a statement from the residential tenancy agreement for premises, the lessor or lessor’s agent must give a prospective tenant for the tenancy all of the following information—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.57C-ssec.1-para1.a" guid="_ce9fba85-8beb-4aab-bccf-96df674aaa82" provision.type="other"><no>(a)</no><block><txt break.before="0">if the lessor has engaged an agent to sell the premises or prepared a contract of sale—that there is a proposal to sell the premises;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.b" guid="_624cf714-02aa-4f92-a9b0-75d9261bd2de" provision.type="other"><no>(b)</no><block><txt break.before="0">if a mortgagee has commenced a proceeding to enforce a mortgage over the premises—that a mortgagee is taking action for possession of the premises;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.c" guid="_501a3fe8-a335-45ae-ac1d-9eccec8ea584" provision.type="other"><no>(c)</no><block><txt break.before="0">if the lessor is not the owner of the premises—that the lessor has a right to let the premises;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.d" guid="_578928ae-34e3-4729-8893-4cf1fe7ed734" provision.type="other"><no>(d)</no><block><txt break.before="0">if the premises are supplied with electricity from an embedded electricity network—the following details—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.57C-ssec.1-para1.d-para2.i" guid="_2bad0be4-6b53-4904-95f6-3442731f7713" provision.type="other"><no>(i)</no><block><txt break.before="0">the ABN and trading name of the operator of the network;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.d-para2.ii" guid="_933d0e29-536a-4a2b-a1d6-6721f78bc400" provision.type="other"><no>(ii)</no><block><txt break.before="0">the contact details, including a phone number and website address, of the operator of the network;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.d-para2.iii" guid="_83ca565b-8b54-4da6-9568-d38692fbe83d" provision.type="other"><no>(iii)</no><block><txt break.before="0">the electricity tariffs and all associated fees and charges that may apply to the customer in relation to the sale of electricity, or where that information can be accessed;</txt></block></li></list></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.e" guid="_29f2404e-e6c4-4d09-b2cd-0057f09cf9e2" provision.type="other"><no>(e)</no><block><txt break.before="0">whether the lessor has received a notice to remedy breach for mould or damp in relation to the premises within the last 3 years;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.f" guid="_e53078d3-62a9-4cc2-8ff1-3a5ad2321a9d" provision.type="other"><no>(f)</no><block><txt break.before="0">whether the lessor knows about any of the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-frag-sec.57C-ssec.1-para1.f-para2.i" guid="_09c12c66-ab0f-4045-9c1e-83c6ed7002cf" provision.type="other"><no>(i)</no><block><txt break.before="0">the contamination of the premises because the premises have been used for trafficking or producing a dangerous drug, within the meaning of the <legref target.doc.id="act-1986-036" target.version.series="ef7fd278-ec04-4d14-bfea-5199da381778" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Drugs Misuse Act 1986</name></legref>, within the last 5 years;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.f-para2.ii" guid="_e3f6fdde-b064-4fc9-bb7c-ba1a3cf5220d" provision.type="other"><no>(ii)</no><block><txt break.before="0">the presence of asbestos at the premises;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.f-para2.iii" guid="_d527066a-80c8-407b-93e3-55dd8d4bf920" provision.type="other"><no>(iii)</no><block><txt break.before="0">that the premises are the subject of a notice, report or order about a building defect or safety concern;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.f-para2.iv" guid="_f7f888f7-e300-49e4-bd33-58e058e3c6da" provision.type="other"><no>(iv)</no><block><txt break.before="0">an application under the <legref target.doc.id="act-2016-025" target.version.series="d4a7e9d3-f73d-48a3-9459-9be0b66a1c15" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Planning Act 2016</name></legref> in relation to the premises;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.f-para2.v" guid="_14624b2d-b121-4a06-861b-4e4ee2fe0d81" provision.type="other"><no>(v)</no><block><txt break.before="0">a current building work dispute in relation to the premises;</txt></block></li><li id="sec.8-frag-sec.57C-ssec.1-para1.f-para2.vi" guid="_6fc8344e-3e2e-4543-b0e5-d57ef2a391f9" provision.type="other"><no>(vi)</no><block><txt break.before="0">a dispute within the meaning of the <legref target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Body Corporate and Community Management Act 1997</name></legref>, section 227 in relation to the premises.</txt></block></li></list></block></li></list><penalty id="sec.8-frag-sec.57C-ssec.1-pen" guid="_627f2b97-4243-4951-9b54-215ff9d208fd"><block><txt break.before="1">Maximum penalty—60 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.8-frag-sec.57C-ssec.2" guid="_5479c5ca-447e-4800-a35e-b926727fe27b" affected.by.uncommenced="0" provision.type="other"><no>(b)</no><block><txt break.before="0">connects to a distribution or transmission system in the national grid through a parent connection point.</txt></block></li></list></definition></deflist></block></subclause></clause></fragment></block></clause><clause id="sec.9" guid="_765fe081-4144-4bc7-9408-c74e8fa6657f" provision.type="amend" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to rental premises if a rooming accommodation agreement for the premises has previously been entered into, whether or not the provider is the same person as the provider for the previous rooming accommodation agreement.</txt></block></subclause><subclause id="sec.9-frag-sec.79A-ssec.2" break.before="0">advertise or otherwise offer accommodation for the rental premises for an amount of rent greater than the indexed rent amount; or</txt></block></li><li id="sec.9-frag-sec.79A-ssec.2-para1.b" guid="_b13758a0-8327-49b0-8716-e401bcad7d26" provision.type="other"><no>(b)</no><block><txt break.before="0">enter into a rooming accommodation agreement for the rental premises that includes an amount of rent greater than the indexed rent amount.</txt></block></li></list><penalty id="sec.9-frag-sec.79A-ssec.2-pen" guid="_169d3bd5-60a8-4207-abdf-ba0376f1e000"><block><txt break.before="1">Maximum penalty—100 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.9-frag-sec.79A-ssec.3" provision.type="other"><no>(c)</no><block><txt break.before="0">if the amount of rates payable for a year for the rental premises has increased by more than 20% since the last rent increase.</txt></block></li></list></block></subclause><subclause id="sec.9-frag-sec.79A-ssec.4" guid="_f1a031e7-b092-4c2a-936b-dfd4fa931dfd" affected.by.uncommenced="0" id="sec.9-frag-sec.79A-ssec.4-def.C_" guid="_254d6e80-a29c-4f23-928c-084b523f5419" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-frag-sec.79A-ssec.4-def.C" guid="_e375455f-e4ce-4674-b3b0-dd974b23a625" type="definition">C</defterm> is the CPI published for the corresponding quarter in the year in which the rent was last increased.</txt></definition></deflist></block></subclause><subclause id="sec.9-frag-sec.79A-ssec.5" guid="_f1e86432-4f79-4f9b-8de9-c67c7bbbf023" affected.by.uncommenced="0" provision.type="other"><no>(c)</no><block><txt break.before="0">if the amount of rates payable for a year for the premises has increased by more than 20% since the last rent increase—the increase in the amount of rates payable;</txt></block></li><li id="sec.12-frag-sec.92A-ssec.2-para1.d" guid="_410f92b7-b50f-4c81-9af2-b09132d47ac1" provision.type="other"><no>(d)</no><block><txt break.before="0">the proposed increased rent compared to the current rent;</txt></block></li><li id="sec.12-frag-sec.92A-ssec.2-para1.e" guid="_6bbdc0f4-d5d7-4daa-a035-efa504261c01" provision.type="other"><no>(e)</no><block><txt break.before="0">the state of repair of the premises;</txt></block></li><li id="sec.12-frag-sec.92A-ssec.2-para1.f" guid="_7c7590a5-3ae3-4730-8ef6-12facbe5f7e7" provision.type="other"><no>(f)</no><block><txt break.before="0">the term of the tenancy.</txt></block></li></list></block></subclause><subclause provision.type="other"><no>(b)</no><block><txt break.before="0">for increased rent that is greater than the indexed rent amount—</txt><list number.type="manual" unnumbered.indent="0"><li amenity or standard of the rental premises has increased substantially since the last rent increase;</txt></block></li><li id="sec.15-frag-sec.105B-ssec.2-para1.c" guid="_3ee35249-d4f8-48dd-946b-57eb2d8f47ee" provision.type="other"><no>(c)</no><block><txt break.before="0">if the amount of rates payable for a year for the rental premises has increased by more than 20% since the last rent increase—the increase in the amount of rates payable;</txt></block></li><li id="sec.15-frag-sec.105B-ssec.2-para1.d" guid="_51dd7a52-a7e5-4d21-ac5a-c9cb20f26706" provision.type="other"><no>(d)</no><block><txt break.before="0">the proposed increased rent compared to the current rent;</txt></block></li><li id="sec.15-frag-sec.105B-ssec.2-para1.e" guid="_cec54a79-d1ba-464c-9b21-fade138e857b" provision.type="other"><no>(e)</no><block><txt break.before="0">the state of repair of the rental premises;</txt></block></li><li id="sec.15-frag-sec.105B-ssec.2-para1.f" guid="_a19da5af-39cf-4f6d-85a5-11ec6047545b" provision.type="other"><no>(f)</no><block><txt break.before="0">the period of the rooming accommodation agreement.</txt></block></li></list></block></subclause><subclause id="sec.15-frag-sec.105B-ssec.3" guid="_4bd2b0f8-61cb-4162-bac0-b8bd53994d74" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The rent payable under the agreement increases to the extent stated in the order and from the day stated in the break.before="0">A warrant of possession must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.38-frag-div.5A-sec.389B-ssec.1-para1.a" guid="_165411c3-644c-4cc9-ac2e-e2e2ee95024c" provision.type="other"><no>(a)</no><block><txt break.before="0">authorise a police officer, or a stated authorised person, to enter the rental premises and give possession of the premises to the person in whose favour the termination order was made; and</txt></block></li><li id="sec.38-frag-div.5A-sec.389B-ssec.1-para1.b" guid="_e7a2ee07-6b72-4560-8ac9-b969ddccfac3" provision.type="other"><no>(b)</no><block><txt break.before="0">authorise the person to whom the warrant is directed to exercise the powers under the warrant with necessary and reasonable help and force; and</txt></block></li><li id="sec.38-frag-div.5A-sec.389B-ssec.1-para1.c" guid="_242927f8-0e82-490c-952a-dc0889685725" provision.type="other"><no>(c)</no><block><txt break.before="0">state the hours of the day when entry may be made; and</txt></block></li><li id="sec.38-frag-div.5A-sec.389B-ssec.1-para1.d" guid="_d3f80832-64fd-41e9-9aad-28ab07005623" provision.type="other"><no>(d)</no><block><txt break.before="0">state the day the warrant ends.</txt></block></li></list></block></subclause><subclause id="sec.38-frag-div.5A-sec.389B-ssec.2" guid="_445d315e-7932-428c-a245-37daf48fd39d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The registrar must give written notice of the issue of a warrant of possession to the former resident as soon as practicable after the warrant is issued.</txt></block></subclause><subclause id="sec.38-frag-div.5A-sec.389B-ssec.3" located</txt></block></li><li id="sec.38-frag-div.5A-sec.389B-ssec.4-para1.b-note-para2-oc.2" guid="_97dbf82c-41ce-4ad0-97b9-de6d3b00ebf5" provision.type="other"><no>•</no><block><txt break.before="0">the remoteness of the rental premises</txt></block></li></list></block></note></li></list></block></subclause><subclause id="sec.38-frag-div.5A-sec.389B-ssec.5" guid="_4e70b35b-c4f8-41fb-b443-02d50ac9a0a5" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">However, the day on which the warrant takes effect must not be
