or</txt></block></li><li id="sec.3-frag-sec.8A-ssec.2-para1.b" guid="_977539f8-00c0-4a66-b549-506cc3ef810b" provision.type="other"><no>(b)</no><block><txt break.before="0">in a way that is unlawful discrimination on the basis of an attribute; or</txt></block></li><li id="sec.3-frag-sec.8A-ssec.2-para1.c" guid="_cdda5a91-43de-46e7-8dbf-5cfbac9e663d" provision.type="other"><no>(c)</no><block><txt break.before="0">with the intention of offending, humiliating or intimidating another person.</txt></block></li></list></block></subclause></clause></fragment></block></clause><clause id="sec.4" guid="_4d635304-670b-43a5-82dd-f21ff85068fb" affected.by.uncommenced="0" spent.amends="0" provision.type="amend"><no>4</no><heading id="sec.4-he" guid="_9520f29e-1a65-4fd8-b8f6-ca61fdb176e9">Amendment of <legref target.doc.id="act-1991-085" refid="sec.10" target.guid="_6aaa0f5a-aee2-4e81-a8b7-c9b448c917b9" type="act" target.version.series="5b69e295-f76d-4b2c-9633-9e7012e8acdf" check="valid" jurisd="QLD">s&#160;10</legref> (Meaning of <defterm guid="_37680d8d-09ad-4ece-b021-ebe9e12e912c" type="mention">direct discrimination</defterm>)</heading><block><txt break.before="1"><legref target.doc.id="act-1991-085" refid="sec.10" target.guid="_6aaa0f5a-aee2-4e81-a8b7-c9b448c917b9" type="act" target.version.series="5b69e295-f76d-4b2c-9633-9e7012e8acdf" check="valid" jurisd="QLD">Section&#160;10</legref>—</txt><txt break.before="1"><i>insert—</i></txt><fragment format="fromcontext" auto.number.type="manual" style="indent"><subclause id="sec.4-frag-ssec.1A" guid="_59e97288-6b2f-4a1b-9965-7ac7b3bdb8e5" affected.by.uncommenced="0" provision.type="other"><no>(1A)</no><block><txt break.before="0"><defterm id="sec.4-frag-def.Directdiscrimination" guid="_e5a4ced5-f948-44f4-8d33-9a3b8ed42eaa" type="definition">Direct discrimination</defterm> on the basis of the use of gender-specific language happens if a person treats, or proposes to treat, a person who uses the language less favourably than another person, who does not use the language, is or would be treated in circumstances that are the same or not materially different.</txt><note id="sec.4-frag-ssec.1A-note" guid="_36a3599d-efa1-4912-aa9b-e72ec6d60e75" type="example"><heading id="sec.4-frag-ssec.1A-note-he" guid="_90954ae1-9007-4a8b-af64-8dab478bc69d">Examples—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-ssec.1A-note-para1.1" guid="_751a7f1d-1d8a-4910-a3b4-83107121db0b" provision.type="other"><no>1</no><block><txt break.before="0">H is C’s teacher. C submits a piece of assessment to H. In the assessment, C regularly uses the words ‘he’, ‘she’, ‘him’ and ‘her’. H, when marking the assessment, deducts marks for use of the gender-specific language.</txt></block></li><li id="sec.4-frag-ssec.1A-note-para1.2" guid="_db99e6ed-7fa5-4bbe-a375-c2a8c97204ed" provision.type="other"><no>2</no><block><txt break.before="0">R is D’s manager. R hears D addressing a group of customers as ‘guys’. R asks D to undertake sensitivity training and notes the matter on D’s employment record.</txt></block></li></list></block></note></block></subclause><subclause id="sec.4-frag-ssec.6" guid="_3a907da7-031b-4042-8616-3c3d02724db4" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">If there are 2 or more reasons why a person treats, or proposes to treat, another person who uses gender-specific language less favourably, the person treats the other person less favourably on the basis of the use of gender-specific language if the use of the language is a substantial reason for the treatment.</txt></block></subclause></fragment></block></clause><clause id="sec.5" guid="_8015389c-554d-437a-b913-6b291fdeb872" affected.by.uncommenced="0" type="definition">Indirect discrimination</defterm> on the basis of the use of gender-specific language happens if a person directly or indirectly imposes, or proposes to impose, a term or standard, whether written or unwritten, that a person will not comply with if the person uses the language.</txt><note id="sec.5-frag-ssec.1A-note" guid="_95d02e62-f927-4914-ab81-7abbcd32b76b" type="example"><heading id="sec.5-frag-ssec.1A-note-he" guid="_9e47fdaf-ca06-4385-9526-9409bd76187a">Example—</heading><block><txt break.before="1">An employer gives a memo to employees requesting employees stop using the words ‘husband’ and ‘wife’.</txt></block></note></block></subclause></fragment></block></clause><clause id="sec.6" guid="_bb0425d8-ade9-4cea-a107-e588b8d3e71f" id="sec.6-frag-div.5-sec.124B-he" guid="_4c51aca5-5721-405a-a16f-1e4378754d3a">Provision of facilities or services that do not accommodate particular persons</heading><subclause id="sec.6-frag-div.5-sec.124B-ssec.1" guid="_d3497175-7f68-4f00-a1d8-b8273b179402" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if an entity (the <defterm id="sec.6-frag-div.5-sec.124B-def.provider" guid="_2c8921a2-38af-4a10-89b4-92df07f1636f" type="definition">provider</defterm>) provides facilities or services that do not specifically accommodate persons who are not, or do not identify as, male or female.</txt></block></subclause><subclause id="sec.6-frag-div.5-sec.124B-ssec.2" guid="_150a3c89-d639-4b0e-99b5-d31b3f30173e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person must not treat, or propose to treat, the provider less favourably than the person treats, or would treat, a relevant entity in circumstances that are the same or not materially different.</txt></block><note id="sec.6-frag-div.5-sec.124B-ssec.2-note" guid="_6b29e0b5-f137-4cb3-b166-9fea0aeb3ab8" type="example"><heading id="sec.6-frag-div.5-sec.124B-ssec.2-note-he" guid="_b63e98cf-a5ca-4d7c-a9b1-0686d3525cf4">Examples of less favourable treatment—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-div.5-sec.124B-ssec.2-note-para1.1" guid="_4076bda0-b791-4c3f-b9ec-1da722132383" provision.type="other"><no>1</no><block><txt break.before="0">An advocacy group runs a targeted advertising campaign against particular businesses that do not provide bathrooms specifically for persons who are not, or do not identify as, male or female.</txt></block></li><li id="sec.6-frag-div.5-sec.124B-ssec.2-note-para1.2" guid="_ffd8c92d-55df-4464-80bb-06473dd8fc79" provision.type="other"><no>2</no><block><txt break.before="0">During a tender process for a contract, a business’s bid is unsuccessful because the business does not provide bathrooms specifically for persons who are not, or do not identify as, male or female.</txt></block></li></list></block></note></subclause><subclause id="sec.6-frag-div.5-sec.124B-ssec.3" guid="_7982dce7-e1ab-48df-9f97-774f6a9ce8e0" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6-frag-div.5-sec.124B-ssec.3-def.relevantentity_" guid="_d19813d5-1e26-4333-b0d4-720aeb8d34fc" affected.by.uncommenced="0"><txt break.before="1"><defterm that specifically accommodate persons who are not, or do not identify as, male or female.</txt></definition></deflist></block></subclause></clause></division></fragment></block></clause><clause
