(a)a GOC Act entity mentioned in schedule 1 is declared to be a port authority; and

(b)a port stated opposite the GOC Act entity mentioned in schedule 1 is prescribed to be the port the entity is to manage.

6Limits of Port of Brisbane(1)For section 267AA(3) of the Act, the limits of the Port of Brisbane are defined in schedule 2, part 1, subject to subsections (2) and (3).(2)The limits described in schedule 2, part 1 do not include the area of any land above the high-water mark.(3)If the high-water mark intersects at the entrance of a waterway, the limits run in a straight line across that entrance.7Limits of other particular ports(1)For section 274(a) of the Act, the limits of each port mentioned in schedule 1 are defined in schedule 2, part 2, subject to subsections (2) to (4).(2)The limits of a port described in schedule 2, part 2 do not include the area of any land above the high-water mark.(3)For a port mentioned in schedule 2, part 2, division 1, the limits of the port include the waters of navigable creeks or rivers flowing directly or indirectly into waters that—

(a)are within the limits described in that division for the port; and

(b)are either—

(i)waters, including tidal waters, of the sea; or

(ii)waters connecting with any waters mentioned in subparagraph (i).

(4)The limits of a port mentioned in schedule 2, part 2, division 2—

(a)do not include waters of creeks or rivers that—

(i)are within the limits described in that division for the port; and

(ii)are upstream of the mouths of the creeks or rivers; but

(b)do include the following rivers—

(i)for the Port of Burketown—the Albert River;

(ii)for the Port of Karumba—the Norman River;

(iii)for the Port of Skardon River—the Skardon River;

(iv)for the Port of Weipa—the Mission River, Embley River or Hey River.
