and</txt></block></li><li id="sec.4-frag-sec.19AA-ssec.2-para1.b" guid="_3278ff48-2e7f-4f6c-ac3a-540a5556dd27" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">each person entitled to make the application for review under the DFVP Act, section 100Z(1), other than the applicant; and</txt></block></li><li id="sec.4-frag-sec.19AA-ssec.2-para1.c" guid="_92226a33-8a52-4616-9d96-0fd52fc190dd" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">each named person in the police protection direction who is not a child.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-sec.19AA-ssec.3" guid="_e796689b-a254-4eca-8811-06d2668f39e5" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a named person in the police protection direction is a child, the DFVP court may order that a copy of the application for leave be given to the child if it considers that it is necessary and appropriate.</txt></block></subclause><subclause id="sec.4-frag-sec.19AA-ssec.4" guid="_1f67a8d4-767b-4051-8dd4-6ecb90b8b255" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In making an order under subrule (3), the DFVP court must have regard to the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.19AA-ssec.4-para1.a" guid="_bf53175d-a7a2-411e-8c2f-8e6ca972db10" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the age of the child;</txt></block></li><li id="sec.4-frag-sec.19AA-ssec.4-para1.b" guid="_ca89484f-3fce-465a-bf90-8dfaf1c6635a" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the ability of the child to understand the application for leave;</txt></block></li><li id="sec.4-frag-sec.19AA-ssec.4-para1.c" guid="_e51adaad-b37d-48ff-9f4e-7daf39fd57c9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">whether the court has dispensed with the requirement to give a copy of the application for leave to a parent of the child under the DFVP Act, section 188(3);</txt></block></li><li id="sec.4-frag-sec.19AA-ssec.4-para1.d" guid="_5c580688-d851-4d8c-9996-953e26842f23" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">whether giving a copy of the application for leave to the child is in the best interests of the child;</txt></block></li><li id="sec.4-frag-sec.19AA-ssec.4-para1.e" guid="_30e93232-a2b0-4116-8603-402eecbd88ad" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">whether the child is already aware of the application for leave or the circumstances giving rise to the application for leave.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-sec.19AA-ssec.5" guid="_fe462243-b7f1-4da3-8ba2-484baeb957fa" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In complying with an order made under subrule (3), the clerk of the DFVP court must give a copy of the application for leave to the child in accordance with the DFVP Act, section 188.</txt></block></subclause><subclause id="sec.4-frag-sec.19AA-ssec.6" guid="_439c4953-307f-4058-b0f0-03b12047eff0" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this rule—</txt><deflist><definition id="sec.4-frag-sec.19AA-ssec.6-def.applicationforreview_" guid="_28731b43-626f-4ca1-9a55-f2a219fc1b95" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-frag-sec.19AA-ssec.6-def.applicationforreview" guid="_76f20634-ffc9-445f-aeec-96e6c37acc3b" type="definition">application for review</defterm> means an application made under the DFVP Act, section 100Z.</txt></definition></deflist></block></subclause></clause><clause id="sec.4-frag-sec.19AB" guid="_1c56295f-a567-4376-998e-84b4c99fa44e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19A<b>B </b></no><heading id="sec.4-frag-sec.19AB-he" guid="_ef698d08-5c15-4f33-8a6d-b097f50042e3">Giving notice of application to reopen proceedings</heading><subclause id="sec.4-frag-sec.19AB-ssec.1" guid="_43f07d68-3bf8-431c-8e15-4f5e847fab7d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This rule applies if— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.19AB-ssec.1-para1.a" guid="_e2e09aaa-a229-41e4-b06e-090bba1db55a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a person makes an application to reopen a proceeding; or</txt></block></li><li id="sec.4-frag-sec.19AB-ssec.1-para1.b" guid="_8692dd30-6449-4a8c-9ac4-73889088175f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a person applies for leave of the court to make an application to reopen a proceeding because the DFVP Act, s 157A(4) applies to the person for that application.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-sec.19AB-ssec.2" guid="_a13420cb-ebec-461b-9533-ac0acd8f70a6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">As soon as reasonably practicable after the application to reopen a proceeding or for leave is filed, the clerk of the DFVP court must give a copy of the application to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.19AB-ssec.2-para1.a" guid="_56453a6a-082a-430d-bf0b-3ec4a744b744" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the police commissioner; and</txt></block></li><li id="sec.4-frag-sec.19AB-ssec.2-para1.b" guid="_ff5effc3-d013-40da-a4bf-3ddb3d812712" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">each person who was a party to the proceeding the subject of the application, other than the applicant; and</txt></block></li><li id="sec.4-frag-sec.19AB-ssec.2-para1.c" guid="_7e7f7e86-9923-4bde-acfb-7cc9c75c18c0" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">each named person in the protection order the subject of the proceeding who is not a child.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-sec.19AB-ssec.3" guid="_d527aaa1-f451-4f41-b78b-54ae100b0534" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a named person in the protection order the subject of the proceeding is a child, the DFVP court may order that a copy of the application be given to the child if it considers that it is necessary and appropriate.</txt></block></subclause><subclause id="sec.4-frag-sec.19AB-ssec.4" guid="_676161df-ebaa-4109-a96c-c3fb58d594e3" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In making an order under subrule (3), the DFVP court must have regard to the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-sec.19AB-ssec.4-para1.a" guid="_b8a8741d-5e47-4137-a4f6-ca6ff4281bc4" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the age of the child;</txt></block></li><li id="sec.4-frag-sec.19AB-ssec.4-para1.b" guid="_98bbd5e9-a94f-4935-b9e8-bf5efc627479" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the ability of the child to understand the application;</txt></block></li><li id="sec.4-frag-sec.19AB-ssec.4-para1.c" guid="_867c25d8-20a8-49af-9c82-4318c59ea4f2" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">whether the court has dispensed with the requirement to give a copy of the application to a parent of the child under the DFVP Act, section 188(3);</txt></block></li><li id="sec.4-frag-sec.19AB-ssec.4-para1.d" guid="_f46c6682-36f3-47c7-b7ad-0362c7e84ecf" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">whether giving a copy of the application to the child is in the best interests of the child;</txt></block></li><li id="sec.4-frag-sec.19AB-ssec.4-para1.e" guid="_576cc1e6-b15e-4992-9df2-a5722b57f2e6" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">whether the child is already aware of the application or the circumstances giving rise to the application.</txt></block></li></list></block></subclause><subclause id="sec.4-frag-sec.19AB-ssec.5" guid="_5c75fa1d-6ea1-40e0-8ae8-0c40f310a3a4" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In complying with an order made under subrule (3), the clerk of the DFVP court must give a copy of the application to the child in accordance with the DFVP Act, section 188.</txt></block></subclause><subclause id="sec.4-frag-sec.19AB-ssec.6" guid="_b22929bd-c920-4e9f-9dba-a6f10357689c" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this rule—</txt><deflist><definition id="sec.4-frag-sec.19AB-ssec.6-def.applicationtoreopenaproceeding_" guid="_48ed3b52-5c0a-4cad-90e4-38cf742e2870" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-frag-sec.19AB-ssec.6-def.applicationtoreopenaproceeding" guid="_77ee349d-ef46-4f2b-ac29-052c29ca47b2" type="definition">application to reopen a proceeding</defterm> means an application made under the DFVP Act, section 157A.</txt></definition></deflist></block></subclause></clause></fragment></block></clause></body></wrapper></subordleg>
