workers’—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-sdiv.3-sec.55F-ssec.1-para1.a-para2.i" guid="_8e3be834-df87-4b57-ac2f-a4c271cf0f60" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">age; or</txt></block></li><li id="sec.10-frag-sdiv.3-sec.55F-ssec.1-para1.a-para2.ii" guid="_231be5ca-19b0-4962-80f6-d612db553182" (a)—</heading><block><txt break.before="1">At a particular workplace, a younger worker’s sex may be a relevant matter if the majority of other workers are all of a different sex and are a similar age to each other.</txt></block></note></block></li><li id="sec.10-frag-sdiv.3-sec.55F-ssec.1-para1.b" guid="_52cbaf50-a712-4970-a90f-49e831b5c3a9" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">matters relating to characteristics of the workplace or work environment, such as—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-sdiv.3-sec.55F-ssec.1-para1.b-para2.i" guid="_b8b3e151-6188-451c-ba13-5df7d461df1c" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a work environment that may give rise to a workplace culture, or system of work, in which unacceptable or inappropriate behaviour is, or may be, permitted; and</txt></block></li><li id="sec.10-frag-sdiv.3-sec.55F-ssec.1-para1.b-para2.ii" guid="_6ebbfc64-03ff-497a-882f-0c32dd584db7" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a lack of diversity in the workplace generally or in particular decision-making positions; and</txt></block></li><li id="sec.10-frag-sdiv.3-sec.55F-ssec.1-para1.b-para2.iii" guid="_8a6982fc-5abd-4d2e-af0e-ea96e0dbfab3" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">other matters about the workplace or work environment that may affect a person’s behaviour in relation to a worker.</txt><note id="sec.10-frag-sdiv.3-sec.55F-ssec.1-para1.b-para2.iii-note" guid="_f78730d8-5dd9-4be1-9580-1f5ba3eedc27" type="example"><heading affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">A workplace being a hotel may be a relevant matter if patrons at the hotel may be affected by drugs or alcohol.</txt></block></li><li identified risk to the health or safety of workers, or other persons, from either of the following at work—</txt><list number.type="manual" unnumbered.indent="0"><li break.before="0">sex or gender-based harassment.</txt></block></li></list><penalty id="sec.12-frag-sec.55H-ssec.1-pen" guid="_0a89f0bf-29e2-490e-a330-4517a89a57c3"><block><txt break.before="1">Maximum penalty—60 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.12-frag-sec.55H-ssec.2" guid="_e428437c-b844-45b5-8074-8c845f7e6ccb" affected.by.uncommenced="0" break.before="0">identify the control measures implemented, or to be implemented, to manage each identified risk; and</txt></block></li><li id="sec.12-frag-sec.55H-ssec.2-para1.d" guid="_42ec1daf-73fe-4669-86ac-d565cd49504a" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">identify the matters considered by the person conducting the business or undertaking in determining the control measures mentioned in paragraph (c), including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-frag-sec.55H-ssec.2-para1.d-para2.i" guid="_c0caf50f-cd77-4ea7-9842-1ddc48afc628" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the relevant guid="_b5f6f008-1863-48fc-8c4a-a16fa7637014" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">set out the procedure for dealing with reports of sexual harassment or sex or gender-based harassment at work, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-frag-sec.55H-ssec.2-para1.f-para2.i" guid="_651d8a67-2e99-45d3-89de-d8301c890ab9" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">how a person may make a report; and</txt></block></li><li id="sec.12-frag-sec.55H-ssec.2-para1.f-para2.ii" guid="_29019ad9-8f55-48b5-8b29-2b6fa2140753" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">how the report will be investigated; and</txt></block></li><li id="sec.12-frag-sec.55H-ssec.2-para1.f-para2.iii" guid="_2f2a071d-aafe-452e-a005-e5fa726ff714" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">that the person who made the report may be represented by a representative; and</txt></block></li><li id="sec.12-frag-sec.55H-ssec.2-para1.f-para2.iv" guid="_8ea68c30-65ec-4a21-aa95-8b62b300350a" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">how the person who made the report and other parties will be informed of the results of the investigation; and</txt></block></li><li id="sec.12-frag-sec.55H-ssec.2-para1.f-para2.v" guid="_7baa21a4-41cf-49de-ad41-09eddf907e4f" provision.type="other" affected.by.uncommenced="0"><no>(v)</no><block><txt break.before="0">that the person who made the report may also use the issue resolution procedures and the dispute resolution process in part 5, divisions 5 and 7A of the Act; and</txt></block></li></list></block></li><li id="sec.12-frag-sec.55H-ssec.2-para1.g" guid="_51805504-3903-4b8d-a999-2e3566430a35" provision.type="other" affected.by.uncommenced="0"><no>(g)</no><block><txt break.before="0">be set out and expressed in a way that is readily accessible id="sec.12-frag-sec.55H-ssec.4-para1.b" guid="_8235ce59-a6fe-46db-9ff7-9ffdb5effa27" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">review the plan—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-frag-sec.55H-ssec.4-para1.b-para2.i" guid="_80ba8a1e-3895-4644-b2f9-2e39ac543dc4" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if a report of sexual harassment or sex or gender-based harassment at work is made—as soon as practicable after the report is made; or</txt></block></li><li id="sec.12-frag-sec.55H-ssec.4-para1.b-para2.ii" guid="_db93f726-0755-48a3-a7d4-11b2fdb774e0" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if a health and safety committee for the workplace or a worker’s health and safety representative requests a review of the plan—as soon as practicable after the request is made; type="definition">representative</defterm>, in relation to a person other than a worker, means someone else who the person authorises to represent them.</txt><note id="sec.12-frag-sec.55H-ssec.5-def.representative-note" guid="_597d0d5a-64ca-45e3-ba66-d56bbf2a6f27" type="example"><heading id="sec.12-frag-sec.55H-ssec.5-def.representative-note-he"
