86</heading><block><txt break.before="0">For section 86(4)(c) of the Act, the total amount of work performed by an individual at 1 or more publicly owned coal-fired power stations prescribed is the contractors—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.5-ssec.1-para1.b-para2.i" guid="_81490809-35df-4c12-842a-54ac4e31a5e4" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">personalised support service costs; and</txt></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.1-para1.b-para2.ii" guid="_ad545efb-2f03-45a1-8ccc-455683342e86" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">skills support costs (co-funded); and</txt></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.1-para1.b-para2.iii" guid="_8e1bb5a9-6e3b-4d5d-a027-b9400c7dbd09" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">relocation support costs (co-funded);</txt></block></li></list></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.1-para1.c" guid="_03fd476f-d4e7-4a56-8a4a-64f665942b1e" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">retention payments and incentives mentioned in section 89(b) of the Act;</txt></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.1-para1.d" guid="_7475c027-7e0e-40e8-9075-1213b214beb6" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the costs mentioned in section 89(c) of the Act.</txt></block></li></list></block></subclause><subclause id="sec.6-frag-pt.2-sec.5-ssec.2" guid="_3ace1885-1a8d-420b-a5a1-bbf75be60ae6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, a category of costs mentioned in subsection (1) does not include costs to the extent an amount is payable to a worker under an employment agreement, policy or other entitlement.</txt></block></subclause><subclause id="sec.6-frag-pt.2-sec.5-ssec.3" guid="_6690c70f-be5f-48b5-858a-2714b5615471" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For section 90(5)(b) of the Act, a payment from the fund may be paid—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.5-ssec.3-para1.a" guid="_8528389e-b4ef-4d96-b7b3-06b0d41bedf5" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for a category of costs mentioned in subsection (1)(a) or (b)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.5-ssec.3-para1.a-para2.i" guid="_7f5a75f4-0762-4e0e-a747-e2279738ad92" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">to a public sector entity under the <legref target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Sector Act 2022</name></legref>, section 8; or</txt></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.3-para1.a-para2.ii" guid="_832d809c-a1cc-486c-b0fa-d2d374164cd7" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">to a publicly owned energy business under section 122 of the Act; or</txt></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.3-para1.a-para2.iii" guid="_a6c56f81-4eee-4dac-80a4-9ea0ff6f51fd" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">to an affected energy worker mentioned in the subsection; or</txt></block></li></list></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.3-para1.b" guid="_84027bea-08c0-46db-8f3c-1b1b3b550a02" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for a category of costs mentioned in subsection (1)(c)—to the entity that operates the publicly owned coal-fired power station.</txt></block></li></list></block></subclause><subclause id="sec.6-frag-pt.2-sec.5-ssec.4" guid="_b89cf21a-1fba-4259-a9c0-2412f42d4c9b" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.affectedenergycontractor_" guid="_794a20bb-f852-4a5c-ba34-cf9788fd7791" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.affectedenergycontractor" guid="_8e18094e-95db-4409-a73b-60c35f0fd69f" type="definition">affected energy contractor</defterm> see section 86(4) of the Act.</txt></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.affectedenergyGOCworker_" guid="_32a24bc7-0098-4b1a-9d2f-f620d2b5ce39" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.affectedenergyGOCworker" guid="_545376d9-5fda-481d-b66f-d1cbbd8094d7" type="definition">affected energy GOC worker</defterm> see section 86(2) of the Act.</txt></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.personalisedsupportservicecosts_" guid="_05b58719-21f7-46b8-957d-f5abff3c2f04" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.personalisedsupportservicecosts" guid="_1483f663-a0a5-47ea-b31c-ccd70be0050e" type="definition">personalised support service costs</defterm> means the reasonable costs of providing support in relation to an affected energy worker having regard to the worker’s individual circumstances, including, for example, mental health support, financial and career planning, mentoring or job-seeking support.</txt></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.prescribedenergyworker_" guid="_cd7d2561-8d7f-4471-9126-2ac6ac80b633" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.prescribedenergyworker" guid="_8f36f627-3f3b-4d42-8ff8-df792b3047cf" type="definition">prescribed energy worker</defterm> see section 86(3) of the Act.</txt></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.prescribedfacility_" guid="_a3c5be77-381c-4722-bfc8-58a3b1b0fc82" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.prescribedfacility" guid="_f0f97575-8f85-4c2a-917c-def7316a0d73" type="definition">prescribed facility</defterm> see section 86(5) of the Act.</txt></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.relevantprescribedenergyworker_" guid="_cc7734e6-fe27-41b3-9cc7-4e0914c5fd72" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.relevantprescribedenergyworker" guid="_afcc6678-531c-42cc-9cfd-c3f4c4e0e14c" type="definition">relevant prescribed energy worker</defterm> means an individual who is a prescribed energy worker, if— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.5-ssec.4-def.relevantprescribedenergyworker-para1.a" guid="_e128d6c0-2a89-452e-b6fa-7725e7db4d70" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the total amount of work performed by the individual at 1 or more prescribed facilities meets or exceeds—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.5-ssec.4-def.relevantprescribedenergyworker-para1.a-para2.i" guid="_751ff2ad-d79c-4333-837f-ed32ee75f8bf" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">80% of the total work performed by the individual during a continuous 36 month period ending on the application day for the individual; or</txt></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.4-def.relevantprescribedenergyworker-para1.a-para2.ii" guid="_62efc1f0-f3ac-4e02-84a8-40a601176862" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">100% of the total work performed by the individual during a continuous 24 month period ending on the application day for the individual; and</txt></block></li></list></block></li><li id="sec.6-frag-pt.2-sec.5-ssec.4-def.relevantprescribedenergyworker-para1.b" guid="_6403dad8-0fd7-4df5-8ad3-86a9000f53d7" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the individual performs work under a contract entered into directly with the operator of the prescribed facility. </txt></block></li></list></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.relocationsupportcosts_" guid="_72fc386c-82ed-4ac6-b200-0d77e7baa5af" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.relocationsupportcosts" guid="_6bdd5efd-6f17-446d-bfc7-81f572f8758d" type="definition">relocation support costs</defterm> means the reasonable costs of relocating an affected energy worker and the worker’s spouse and dependants.</txt></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.relocationsupportcostscofunded_" guid="_f966a4d9-d7c1-47bb-873c-c1a5bffece5d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.relocationsupportcostscofunded" guid="_16e57e9b-47b9-4601-a158-ea3e8248a470" type="definition">relocation support costs (co-funded)</defterm> means relocation support costs of up to $8,000 in total for each affected energy worker, if the relocation is reasonably necessary for the worker to obtain employment.</txt></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.sectortransitionsupportcosts_" guid="_f61b215c-5ed3-4288-adb9-c1337a172bb6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.sectortransitionsupportcosts" guid="_c18db5b1-b380-4282-83c4-e4a801498435" type="definition">sector transition support costs</defterm> means the reasonable costs for providing financial support or incentives to enable or incentivise an affected energy worker to transition to employment in a sector other than the sector in which the worker is or was performing work as an affected energy worker.</txt></definition><definition id="sec.6-frag-pt.2-sec.5-ssec.4-def.skillssupportcosts_" guid="_38597bca-f6da-4ce1-9ef6-00768aa36e47" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.5-ssec.4-def.skillssupportcosts" guid="_952d7f6e-7b6d-49dc-83b0-d463605bb452" type="definition">skills support costs</defterm> means the reasonable costs for providing the following support to assist an affected energy worker in obtaining employment in the energy industry or another industry—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.5-ssec.4-def.skillssupportcosts-para1.a" guid="_583ebbf3-f7b4-4915-9079-6c9324929107" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">training, including training provided by a registered training organisation under the <legref target.doc.id="act-2011-012" target.version.series="C2011A00012" check="valid" the AER’s treatment of the expenditure is, to the extent practicable, consistent with the AER’s treatment of other amounts of forecast capital expenditure for the revenue proposal for the second provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">include the expenditure in the capital expenditure in the revenue determination for Powerlink for the second period; and</txt></block></li></list></block></li><li id="sec.6-frag-pt.4-div.2-sdiv.2-sec.20-ssec.3-para1.b" guid="_f7461c9b-c03b-492d-83a3-cdec26aa978b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for the forecast operating expenditure included in the application under a requirement made under section 18(4)(c)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.2-sdiv.2-sec.20-ssec.3-para1.b-para2.i" guid="_0e42827f-08d2-4664-b92f-739cde4c9871" provision.type="other" must publish the amounts of the forecast capital expenditure and forecast operating expenditure that are attributable to the priority transmission investment to be accounted for in the revenue break.before="1"><defterm id="sec.6-frag-pt.4-div.2-sdiv.3-sec.32-ssec.4-def.directedPTIexpenditureamount" guid="_2851fd8e-78cb-4746-908d-8b8df5f39ad9" type="definition">directed PTI expenditure amount</defterm> means forecast capital expenditure for the priority transmission investment for the first period stated in Powerlink’s revenue proposal under a requirement made under section 28.</txt></definition></deflist></block></subclause></clause><clause id="sec.6-frag-pt.4-div.2-sdiv.3-sec.33" guid="_807108b1-1bd9-4f4f-8001-3aee556aaf32" affected.by.uncommenced="0" spent.amends="0" regulatory models, to ensure the AER’s treatment of the amounts is, to the extent practicable, consistent with the AER’s treatment of other amounts of forecast capital expenditure for the revenue proposal for that period; or</txt></block></li><li id="sec.6-frag-pt.4-div.3-sec.35-ssec.2-para1.a-para2.ii" guid="_5b071fbf-3e31-4c8c-8a64-d5f4fe5a4e48" provision.type="other" other than the first regulatory year, to include the forecast capital expenditure or part of that expenditure identified in the application to be included in Powerlink’s regulatory asset base for the regulatory year; and</txt></block></li></list></block></li><li id="sec.6-frag-pt.4-div.3-sec.35-ssec.2-para1.b" guid="_57ab152e-279c-4a5f-ad68-76e6e7d94479" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">must adjust the value of Powerlink’s regulatory asset base at the beginning of the first regulatory year in the regulatory control period immediately following the primary period (the <defterm id="sec.6-frag-pt.4-div.3-sec.35-ssec.2-def.secondaryperiod" guid="_4ac56709-0ec3-48af-b059-7cf1272945b6" type="definition">secondary period</defterm>) to include the lesser of the following amounts—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.3-sec.35-ssec.2-para1.b-para2.i" guid="_ac0e266b-3dc6-4a88-9c2b-93ddee22ed93" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the total of the directed forecast capital expenditure mentioned in section 34(2)(a) or part of that expenditure for the priority investment stated in the application to be included in Powerlink’s regulatory asset base for the primary period;</txt></block></li><li id="sec.6-frag-pt.4-div.3-sec.35-ssec.2-para1.b-para2.ii" guid="_e6b4543f-5ccc-49c2-b948-e675955da421" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the total of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.3-sec.35-ssec.2-para1.b-para2.ii-para3.A" guid="_0af05943-cd89-47d8-b359-f9e8b10b17d2" provision.type="other" affected.by.uncommenced="0"><no>(A)</no><block><txt break.before="0">the total amount of actual capital expenditure for the priority transmission investment for any of the regulatory years as at the end of the primary period; and</txt></block></li><li provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the total of the directed forecast capital expenditure mentioned in section 34(2)(a) or part of that expenditure for the priority investment stated in the application to be included in Powerlink’s regulatory asset base for the primary period;</txt></block></li><li id="sec.6-frag-pt.4-div.3-sec.35-ssec.2-para1.c-para2.ii" guid="_bead0b26-1fd2-471f-87a0-5cb39ff3efcd" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the total of the amounts of actual capital expenditure for the priority transmission investment as at the end of the primary period; and</txt></block></li></list></block></li><li id="sec.6-frag-pt.4-div.3-sec.35-ssec.2-para1.d" guid="_803175cb-47a5-4355-85e0-8e1bef5a23c6" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">must not include in the value of Powerlink’s regulatory asset base any other amount in relation to the priority transmission investment that may otherwise be allowed to be included in the value of Powerlink’s type="definition">primary period</defterm>), other than a regulatory control period mentioned in section 35(1).</txt></block></subclause><subclause id="sec.6-frag-pt.4-div.3-sec.36-ssec.2" guid="_4a8024be-2dae-4028-8673-ab4db94e2217" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">there is a significant change in the circumstances on which the optimal infrastructure pathway is based and the change is relevant to the investment; or</txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.1-para1.b-para2.ii" guid="_3d92523e-3e58-41bf-ba02-8d53cfa540ec" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">there is a significant change in the circumstances on which the optimal development path is based and the change is relevant to the investment; or</txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.1-para1.b-para2.iii" guid="_d7239ba9-23c1-418e-9017-ecf3bafb9d2e" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the actual capital expenditure for the investment is higher than the directed forecast capital expenditure stated in the primary PTI allowance direction under section 34(2)(a) and all or part of the additional capital expenditure was incurred efficiently; and</txt></block></li></list></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.1-para1.c" guid="_9d718a06-bcf0-40a4-a094-5430528b9989" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">Powerlink gives the responsible Ministers written notice of the day the priority transmission investment is completed.</txt></block></li></list></block></subclause><subclause id="sec.6-frag-pt.4-div.4-sec.38-ssec.2" guid="_a9f3981d-7a51-4c80-ade3-c55faa6bcd83" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In deciding under subsection (1)(b)(iii) whether additional expenditure was incurred efficiently, the responsible Ministers must seek advice from a suitably qualified person.</txt></block></subclause><subclause id="sec.6-frag-pt.4-div.4-sec.38-ssec.3" guid="_59490664-7f6e-4ff0-906d-835edc98dd62" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If requested by the suitably qualified person, Powerlink must give the person any documents or information the person reasonably requires to give the advice.</txt></block></subclause><subclause id="sec.6-frag-pt.4-div.4-sec.38-ssec.4" guid="_630113f4-586a-4d2e-8298-df61b07ac9e3" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">During the period starting on the day Powerlink gives the responsible Ministers written notice under subsection (1)(c) and ending on the day that is 18 months later, the responsible Ministers may direct Powerlink under this section.</txt></block></subclause><subclause id="sec.6-frag-pt.4-div.4-sec.38-ssec.5" provision.type="other"><no>(6)</no><block><txt break.before="0">A material change PTI direction about a priority transmission investment—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.6-para1.a" guid="_1c932760-5bc3-4004-bca6-835584c702f6" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">must state a description of the investment; and</txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.6-para1.b" guid="_c736349c-050f-4c5e-af43-f7e25add9504" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">must state the date of completion of the investment; and</txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.6-para1.c" guid="_08c4f43c-1b9c-4263-b13d-6289986346e4" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">may direct Powerlink to apply to the AER to do any of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.6-para1.c-para2.i" guid="_64fe2813-2a7d-4be5-86a6-4f66c788c13d" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">to adjust the value of Powerlink’s regulatory asset base for 1 or more regulatory years in 1 or more of Powerlink’s regulatory control periods to include an amount of capital expenditure for the investment stated in the application;</txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.6-para1.c-para2.ii" guid="_f0277312-d45b-49bb-b79f-78baeb9e9c82" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">to bring forward to an earlier regulatory year or defer to a later regulatory year in 1 or more of Powerlink’s regulatory control periods an amount of capital expenditure for the investment that was stated to be included in Powerlink’s regulatory asset base in an application by Powerlink under section 34(2);</txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.6-para1.c-para2.iii" guid="_55ad69d8-533b-4cf6-b783-5ba92cc8d4b4" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">to apply to the AER to attribute a stated value or values of assets comprising the priority transmission investment for inclusion in the value of Powerlink’s regulatory asset base from the beginning of each regulatory year for which expenditure is included under subparagraphs (i) and (ii).</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.6-frag-pt.4-div.4-sec.38-ssec.7" guid="_1ace6a2c-8a8b-4672-8096-3c8d7ad7ef42" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">For subsection (6)(c)(i)—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.7-para1.a" guid="_d13f143c-e478-47a1-917e-75cc0c091f5a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if subsection (1)(b)(iii) applies—the adjustment under subsection (6)(c)(i) must not include an amount of capital expenditure that exceeds the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.7-para1.a-para2.i" guid="_302a424f-0192-4b3c-82ed-2d76a653439c" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the amount of actual capital expenditure that the responsible Ministers are satisfied was incurred efficiently;</txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.7-para1.a-para2.ii" guid="_13b8f25f-1bc5-48e5-a7a4-61ed160ace25" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the amount by which the actual capital expenditure exceeds the directed forecast capital expenditure stated in the primary PTI allowance direction under section 34(2)(a); or</txt></block></li></list></block></li><li id="sec.6-frag-pt.4-div.4-sec.38-ssec.7-para1.b" guid="_4cd46144-c762-4562-b48e-a9bf6908c83b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">otherwise—the amount of capital expenditure cannot be greater than the amount of actual capital expenditure of the priority transmission investment.</txt></block></li></list></block></subclause></clause><clause id="sec.6-frag-pt.4-div.4-sec.39" guid="_3e3b68da-5b01-4eae-b1ef-1d974e3fe197" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>39</no><heading id="sec.6-frag-pt.4-div.4-sec.39-he" guid="_4ccc88b5-e899-41f5-bdad-7814cdf4b02b">Obligations of AER for material change PTI direction</heading><subclause id="sec.6-frag-pt.4-div.4-sec.39-ssec.1" guid="_36b9c2d0-f99f-4bfd-b644-da3fd71343db" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If Powerlink applies to the AER under a direction given under section 38(6)(c)(i), the AER must adjust the value of Powerlink’s regulatory asset base at the beginning of each regulatory year stated in the application to include the amount of capital expenditure for the priority transmission investment stated in the application.</txt></block></subclause><subclause id="sec.6-frag-pt.4-div.4-sec.39-ssec.2" guid="_63f9df57-7a06-4ff1-92d0-60d4f804145e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If Powerlink applies to the AER under a direction given under section 38(6)(c)(ii), the AER must change each regulatory year during which an amount of capital expenditure for the priority transmission investment is to be included in the value of Powerlink’s regulatory asset base in accordance with the application.</txt></block></subclause><subclause id="sec.6-frag-pt.4-div.4-sec.39-ssec.3" guid="_b02759b6-5659-4a61-b552-fc4b6b532357" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Also, if Powerlink applies to the AER under a material change PTI direction, the AER must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.4-sec.39-ssec.3-para1.a" guid="_1860aee9-18f9-4dc8-ba45-a719bb74eddc" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">amend Powerlink’s revenue determination for the regulatory control period during which the direction is given, to reflect the effect of an adjustment made under subsection (1) or (2) on the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.4-div.4-sec.39-ssec.3-para1.a-para2.i" guid="_4cd1d4e4-e05f-4b7a-894b-4fe0ef97f5c1" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">Powerlink’s maximum allowed revenue for the regulatory control period; </txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.39-ssec.3-para1.a-para2.ii" guid="_53c434bd-e9b1-4f79-addd-ef302c12a4ab" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the X factors for the regulatory control period; and</txt></block></li></list></block></li><li id="sec.6-frag-pt.4-div.4-sec.39-ssec.3-para1.b" guid="_d254f7d4-44ec-4268-ab3d-4f86d3265a1c" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">in making a revenue determination for Powerlink for each subsequent regulatory control period stated in the affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">Powerlink’s maximum allowed revenue;</txt></block></li><li id="sec.6-frag-pt.4-div.4-sec.39-ssec.3-para1.b-para2.ii" guid="_2068278f-819d-485b-bb52-47c0c29d7b0d" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the X
