in the optimal and complete transfer of the meaning of the other language into English and of English into the other language; and</txt></block></li><li id="sec.6-frag-pt.2-sec.54AB-def.accurately-para1.b" guid="_b0e245cd-3011-4651-8b65-d4ecbe03a205" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">preserving the content and intent of the other language or English (as the case may be) without omission or distortion, including matters the interpreter may consider inappropriate or offensive.</txt></block></li></list></definition><definition id="sec.6-frag-pt.2-sec.54AB-def.codeofconduct_" guid="_08c1ed5b-ae30-471b-9a93-5f37ffceaf77" affected.by.uncommenced="0"><txt interpreters set out in schedule 5A.</txt></definition><definition id="sec.6-frag-pt.2-sec.54AB-def.interpret_" guid="_d37e83fb-3f78-488e-814b-b9c1cf59a69c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.54AB-def.interpret" guid="_c1fd8a32-a361-48ce-b5c8-a254420449b2" type="definition">interpret</defterm> means to carry out the process by which spoken or signed language is conveyed from one language (known as the source language) to another language (known as the target language) orally.</txt></definition><definition id="sec.6-frag-pt.2-sec.54AB-def.otherlanguage_" guid="_5f7ed7d4-2006-4b95-b91a-d2e6617aa2b1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.54AB-def.otherlanguage" guid="_e1abc04e-1e7e-4adc-9c53-67593116f3ae" type="definition">other language</defterm> means a spoken or signed language other than English.</txt></definition><definition id="sec.6-frag-pt.2-sec.54AB-def.recognisedagency_" guid="_31b069f8-0d2f-4234-9b57-419532f83ab0" affected.by.uncommenced="0"><txt break.before="1"><defterm break.before="0">another entity approved by the Chief Justice to be a recognised agency for the purposes of this part.</txt></block></li></list></definition><definition id="sec.6-frag-pt.2-sec.54AB-def.sighttranslate_" guid="_30c0fd65-3a20-4ad4-8b6d-64c134f4191c" affected.by.uncommenced="0"><txt break.before="1"><defterm affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-pt.2-sec.54AB-def.translate" guid="_9c2a214c-b5b9-4f9e-91e1-dfff8d74f4e3" type="definition">translate</defterm> means to carry out the process by which written language is conveyed from one language (known as the source language) to another language (known as the target language) in written form.</txt></definition></deflist></block></clause><clause id="sec.6-frag-pt.2-sec.54AC" guid="_8c13ed1b-fc23-4f31-9e84-ca52dbfa5fb0" affected.by.uncommenced="0" spent.amends="0" break.before="1">Subject to this part, proceedings are to be conducted in English.</txt></block></clause><clause id="sec.6-frag-pt.2-sec.54AD" guid="_c36a3275-74a1-4a09-8893-ff619032ac95" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">understand and participate in the proceeding; or</txt></block></li><li id="sec.6-frag-pt.2-sec.54AD-ssec.1-para1.b" guid="_0c5b67bf-0f64-4794-a260-4f3b14c9e59f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">understand, and make adequate reply to, questions that may be put to the accused person in the proceeding.</txt></block></li></list></block></subclause><subclause id="sec.6-frag-pt.2-sec.54AD-ssec.2" provision.type="other"><no>(3)</no><block><txt break.before="0">If an interpreter is provided under subrule (2), the court is responsible for engaging and bearing the costs of the interpreter.</txt></block></subclause></clause><clause id="sec.6-frag-pt.2-sec.54AE" guid="_a319e980-2bbf-4ae7-994c-a4ffc89aa025" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>54AE </no><heading id="sec.6-frag-pt.2-sec.54AE-he" guid="_fe704e42-0ae5-4bad-895e-5e8619867cb8">When interpreter is required by witness</heading><subclause id="sec.6-frag-pt.2-sec.54AE-ssec.1" guid="_1d84c587-addb-4b60-b0b4-3b95d0c6f5ce" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This rule applies if the court is satisfied that a witness in a proceeding can not understand and speak the English language sufficiently to enable the witness to understand, and make adequate reply to, questions that may be put to the witness in the proceeding.</txt></block></subclause><subclause id="sec.6-frag-pt.2-sec.54AE-ssec.2" guid="_7e329ac6-1e66-41dc-9be5-b2f066e4d2f0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The witness may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.54AE-ssec.2-para1.a" guid="_b1d8d878-6ff8-4508-999c-66fb40524c23" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">give spoken evidence or signed evidence in the other language that is interpreted into English by an interpreter in accordance with this part; or</txt></block></li><li id="sec.6-frag-pt.2-sec.54AE-ssec.2-para1.b" guid="_174e516c-d776-45d5-9a65-276975032efe" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">give evidence by an affidavit or statement in English that has been sight translated to the witness by an interpreter in accordance with rule 54AJ.</txt></block></li></list></block></subclause><subclause id="sec.6-frag-pt.2-sec.54AE-ssec.3" guid="_8c8b944b-4a5b-4ac6-9770-134b7caa4632" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Unless the court orders otherwise, the party calling the witness is responsible for engaging, and bearing the costs of, an interpreter who meets the standards and requirements imposed by this part.</txt><note id="sec.6-frag-pt.2-sec.54AE-ssec.3-note" guid="_eb9bc881-563a-4df4-b7ce-4ab7c5159003" type="example"><heading id="sec.6-frag-pt.2-sec.54AE-ssec.3-note-he" guid="_49541e58-75f5-4701-b079-7d0d9443c7b2">Note—</heading><block><txt break.before="1">See the <legref target.doc.id="act-1977-047" target.version.series="ed56f5a4-9bf3-4ec8-8df7-1efa3cee16a1" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Evidence Act 1977</name></legref>, section 131A in relation to the court’s power to order the State to provide an interpreter in a criminal proceeding.</txt></block></note></block></subclause></clause><clause id="sec.6-frag-pt.2-sec.54AF" guid="_b25820e9-b688-45df-8d9c-70547e8d1a97" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>54AF </no><heading id="sec.6-frag-pt.2-sec.54AF-he" guid="_779beb98-f84a-48f8-86b5-af04fbf3a76b">Who may act as interpreter generally</heading><subclause id="sec.6-frag-pt.2-sec.54AF-ssec.1" guid="_1b336b1c-722a-4e67-8889-98853be5a895" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person must not act as an interpreter in a proceeding unless the person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.54AF-ssec.1-para1.a" guid="_0f27d79e-4989-4026-93bf-5cccb81167c9" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">is currently certified, registered or recognised as an interpreter for the other language by a recognised agency, or otherwise satisfies the court that the person is qualified to act as an interpreter for the other language; and</txt></block></li><li id="sec.6-frag-pt.2-sec.54AF-ssec.1-para1.b" guid="_1cb5ab41-2151-4151-8942-170aacf86404" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">has read and agreed to comply with the code of conduct; and</txt></block></li><li id="sec.6-frag-pt.2-sec.54AF-ssec.1-para1.c" guid="_ed9004be-dcf3-4d75-b451-79b9c8deb61c" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">takes an oath, or makes an affirmation, to interpret accurately to the best of the person’s ability.</txt></block></li></list></block></subclause><subclause id="sec.6-frag-pt.2-sec.54AF-ssec.2" guid="_e1c4f461-7b8b-48cb-b442-4f0bf32877bc" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a party to the proceeding or a member of a party’s family; or</txt></block></li><li id="sec.6-frag-pt.2-sec.54AF-ssec.2-para1.b-para2.ii" guid="_14953bcb-5af9-4dd5-b256-d9ba370fb132" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a witness or potential witness in the proceeding; or</txt></block></li></list></block></li><li id="sec.6-frag-pt.2-sec.54AF-ssec.2-para1.c" guid="_121b5f19-95b1-4c75-ad0a-8da94f73e8cf" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">has or may have a financial or other interest of any kind in the outcome of the proceeding, other than an entitlement to a reasonable fee for the services provided by the interpreter in the course of their engagement; or</txt></block></li><li id="sec.6-frag-pt.2-sec.54AF-ssec.2-para1.d" guid="_aa8322d7-84ec-4588-9ead-1484ca8af572" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">is or may be unable to fulfil their duty of accuracy or impartiality under the code of conduct for any reason, including, for example—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.54AF-ssec.2-para1.d-para2.i" guid="_13afe2e9-c81b-4a79-972e-f2935ee80905" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">personal or religious beliefs; and</txt></block></li><li id="sec.6-frag-pt.2-sec.54AF-ssec.2-para1.d-para2.ii" guid="_b89ec16d-d808-4eb0-9e4e-15a48b19f736" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">cultural or other circumstances.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.6-frag-pt.2-sec.54AF-ssec.3" guid="_ac19aa59-b0e0-4d55-a0dc-e77d4667d6f2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a person acting as an interpreter in a proceeding becomes aware during a hearing of the proceeding that a matter mentioned in subrule (2) applies in relation to the person, the person must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.54AF-ssec.3-para1.a" guid="_d13a9216-2704-4498-92ef-3070c50256a2" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">cease to act as an interpreter in the proceeding; provision.type="other"><no>(1)</no><block><txt break.before="0">This rule applies if a person is prohibited from acting, or continuing to act, as an interpreter under rule 54AF(1), (2) or (3).</txt></block></subclause><subclause id="sec.6-frag-pt.2-sec.54AG-ssec.2" guid="_5eb09cb4-423c-4a61-bf80-9f8874a7aa19" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The court may grant leave for the person to act, or continue to act, as an interpreter if it is in the interests of justice and, to the extent practicable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.54AG-ssec.2-para1.a" guid="_7b5f50bd-a6ef-4e72-8823-1a5ce144fe23" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the court is satisfied that, because of the person’s specialised knowledge based on the person’s training, study or experience, the person is able to interpret and, if necessary, sight translate accurately to the level the court considers satisfactory in all the circumstances from the other language into English and from English into the other language; and</txt></block></li><li id="sec.6-frag-pt.2-sec.54AG-ssec.2-para1.b" guid="_8d7aba32-93aa-45fe-9a63-34f0968e02fe" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the person takes an oath, or makes an affirmation, to interpret accurately to the best of the person’s ability; and</txt></block></li><li id="sec.6-frag-pt.2-sec.54AG-ssec.2-para1.c" guid="_b7938435-54d9-41b1-8552-5c9a6ed4f82a" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the court is satisfied that the person understands and accepts that, in acting as an interpreter, the person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.54AG-ssec.2-para1.c-para2.i" guid="_062eaf67-2048-4049-8ec2-0861eecada2f" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">is not an agent, assistant or advocate of the witness or the accused person for whom the person is to act as an interpreter, or of the party who has engaged the interpreter; and</txt></block></li><li id="sec.6-frag-pt.2-sec.54AG-ssec.2-para1.c-para2.ii" guid="_e19910b5-0336-43ba-8fb8-33200385340e" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">owes a paramount duty to the court to be accurate to the best of the person’s ability and impartial; and</txt></block></li></list></block></li><li id="sec.6-frag-pt.2-sec.54AG-ssec.2-para1.d" guid="_b5e0e219-8204-4393-99d6-250b050c9c34" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the court directs that the evidence and interpretation be sound recorded for spoken languages or video recorded for signed languages; and</txt></block></li><li id="sec.6-frag-pt.2-sec.54AG-ssec.2-para1.e" guid="_9d305d3e-6af9-4de1-9de5-6f35c4e06b4e" provision.type="other"><no>(1)</no><block><txt break.before="0">An interpreter owes a paramount duty to the court to be accurate to the best of the interpreter’s ability and impartial.</txt></block></subclause><subclause id="sec.6-frag-pt.2-sec.54AH-ssec.2" guid="_ab005a96-08e6-4ce7-b9f5-0e94643332a7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The duty to the court under subrule (1) overrides any duty the interpreter may have to a party to the proceeding (regardless of whether break.before="0">subject to subrule (4), sight translate, whether before or during the course of a witness’s evidence, documents shown to the affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">sight translating the document would be too onerous or difficult because of the length or complexity of the provision.type="other"><no>(5)</no><block><txt break.before="0">Unless the court orders otherwise, an interpreter may not assist a party or a party’s legal representatives in their conduct of a proceeding (including a hearing) other than by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-pt.2-sec.54AH-ssec.5-para1.a" guid="_ff1e25af-bb28-4fd7-ac82-316b5539c80d" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the number of interpreters required in the proceeding and whether relay interpreting should be used;</txt></block></li><li id="sec.6-frag-pt.2-sec.54AL-ssec.1-para1.c" guid="_8d791b9b-2ce3-4585-aee4-95b1d1c29ff4" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">establishing the expertise of an interpreter;</txt></block></li><li id="sec.6-frag-pt.2-sec.54AL-ssec.1-para1.d" guid="_2ab93dd0-1e1f-4a0c-a62c-ae4653f8feea" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the steps to be taken to obtain an interpreter who is certified, registered or recognised by a recognised agency or is otherwise qualified to act as an interpreter;</txt></block></li><li id="sec.6-frag-pt.2-sec.54AL-ssec.1-para1.e" guid="_f09140af-a537-448c-849a-a89212a53def" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">the steps to be taken before an order under rule 54AG is made;</txt></block></li><li id="sec.6-frag-pt.2-sec.54AL-ssec.1-para1.f" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the party, legal representative or other person who has engaged the interpreter; or</txt></block></li><li id="sec.7-sec.6-ssec.3-para1.b" guid="_71f73da9-418c-41ad-9b14-70337b75ff78" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">any witness or potential provision.type="other"><no>(2)</no><block><txt break.before="0">Also, a person must not act as an interpreter in a proceeding if the person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.6-sec.429VF-ssec.2-para1.a" guid="_f2c63c01-0fbe-461f-9022-a48061bca262" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">is or may become a party to, or witness in, the proceeding (other than as an interpreter); or</txt></block></li><li id="sec.10-frag-pt.6-sec.429VF-ssec.2-para1.b" guid="_9078b92d-1631-4828-a320-24f162a23586" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">is related to, or has a close personal relationship with—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.6-sec.429VF-ssec.2-para1.b-para2.i" guid="_a14b06fe-e889-4bcb-bec5-9bf1b703e5f5" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a party to the proceeding or a member of a party’s family; or</txt></block></li><li id="sec.10-frag-pt.6-sec.429VF-ssec.2-para1.b-para2.ii" guid="_324fa483-e119-4c24-a46c-40dcdf791c55" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a witness or potential witness in the proceeding; or</txt></block></li></list></block></li><li id="sec.10-frag-pt.6-sec.429VF-ssec.2-para1.c" guid="_b5cc790d-b2f5-4d07-8a9f-5a20cde6680a" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">has or may have a financial or other interest of any kind in the outcome of the proceeding, other than an entitlement to a reasonable fee for the services provided by the interpreter in the course of their engagement; or</txt></block></li><li id="sec.10-frag-pt.6-sec.429VF-ssec.2-para1.d" guid="_cf8bc826-db76-4e72-974b-582c2f8f9d2f" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">is or may be unable to fulfil their duty of accuracy or impartiality under the code of conduct for any reason, including, for example—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.6-sec.429VF-ssec.2-para1.d-para2.i" guid="_9d8cea27-0b21-4bd2-9ace-01847b9f5fc7" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">personal or religious beliefs; and</txt></block></li><li id="sec.10-frag-pt.6-sec.429VF-ssec.2-para1.d-para2.ii" guid="_0b5a8448-2b8c-49f5-8cee-06010209b7ca" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">cultural or other circumstances.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.10-frag-pt.6-sec.429VF-ssec.3" guid="_43e01ebe-228f-418c-be5d-eed38d4662a5" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a person acting as an interpreter in a proceeding becomes aware during a hearing of the proceeding that a matter mentioned in subrule (2) applies in relation to the person, the person must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.6-sec.429VF-ssec.3-para1.a" guid="_f2e71156-ff57-499b-acd9-e362ace807d4" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">cease to act as id="sec.10-frag-pt.6-sec.429VG-ssec.1" guid="_e33cad78-70ec-4e1f-8e95-626120b4b7f7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This rule applies if a person is prohibited from acting, or continuing to act, as an interpreter under rule 429VF(1), (2) or (3).</txt></block></subclause><subclause id="sec.10-frag-pt.6-sec.429VG-ssec.2" guid="_17e327ce-110a-4edf-9c1f-073116858f88" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The court may grant leave for the person to act, or continue to act, as an interpreter if it is in the interests of justice and, to the extent practicable—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.6-sec.429VG-ssec.2-para1.a" guid="_bc73f10d-e137-42ac-ba4d-27e1f710a838" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the court is satisfied that, because of the person’s specialised knowledge based on the person’s training, study or experience, the person is able to interpret and, if necessary, sight translate accurately to the level the court considers satisfactory in all the circumstances from the other language into English and from English into the other language; and</txt></block></li><li id="sec.10-frag-pt.6-sec.429VG-ssec.2-para1.b" guid="_826ad238-edc1-41bd-90f6-0d33f781897a" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the person takes an oath, or makes an affirmation, to interpret accurately to the best of the person’s ability; and</txt></block></li><li id="sec.10-frag-pt.6-sec.429VG-ssec.2-para1.c" guid="_7ab3bce2-164e-4e85-bac7-456385cad448" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the court is satisfied that the person understands and accepts that, in acting as an interpreter, the person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.6-sec.429VG-ssec.2-para1.c-para2.i" guid="_85f60402-190d-46e7-ac5e-66668043f971" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">is not an agent, assistant or advocate of the witness for whom the person is to act as an interpreter, or of the party who has engaged the interpreter; and</txt></block></li><li id="sec.10-frag-pt.6-sec.429VG-ssec.2-para1.c-para2.ii" guid="_7ee0d37c-2acd-4d3e-b4b4-9afb76315ddd" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">owes a paramount duty to the court to be accurate to the best of the person’s ability and impartial; and</txt></block></li></list></block></li><li id="sec.10-frag-pt.6-sec.429VG-ssec.2-para1.d" guid="_801f1259-29bc-461a-b9de-e757b70104fd" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the court directs that the evidence and interpretation be sound recorded for spoken languages or video recorded for signed languages; and</txt></block></li><li id="sec.10-frag-pt.6-sec.429VG-ssec.2-para1.e" guid="_25e593da-85d2-4f4c-8df5-03a1f658187f" provision.type="other" guid="_467c46cd-0c5b-41c8-b5bb-606a66a85117">Duties of interpreter</heading><subclause id="sec.10-frag-pt.6-sec.429VH-ssec.1" guid="_730771ac-a575-4ccb-b593-c455acd9e817" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An interpreter owes a paramount duty to the court to be accurate to the best of the interpreter’s ability and impartial.</txt></block></subclause><subclause id="sec.10-frag-pt.6-sec.429VH-ssec.2" guid="_0ca845f7-33f1-4a3a-baf0-c05b045578c4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The duty to the court under subrule (1) overrides any duty the interpreter may have to a party to the proceeding (regardless of whether the party engaged the interpreter).</txt></block></subclause><subclause id="sec.10-frag-pt.6-sec.429VH-ssec.3" guid="_037d19da-7d46-411d-acdc-eab1d0101696" affected.by.uncommenced="0" considers that the interpreter is not competent to do so; or</txt></block></li><li id="sec.10-frag-pt.6-sec.429VH-ssec.4-para1.b" guid="_f833f201-9d1d-4010-b0f9-21bf3fad2052" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">sight translating the document would be too onerous or difficult because of the length or complexity of the text.</txt></block></li></list></block></subclause><subclause id="sec.10-frag-pt.6-sec.429VH-ssec.5" guid="_7174a298-7f46-4bef-ad2e-cc59554430bd" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Unless the court orders otherwise, an interpreter may not assist a party or a party’s legal representatives in their conduct of a proceeding (including a hearing) other than by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-frag-pt.6-sec.429VH-ssec.5-para1.a" guid="_5d2b4ab2-c196-4785-832a-408382c38390" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">establishing the expertise of an interpreter;</txt></block></li><li id="sec.10-frag-pt.6-sec.429VL-ssec.1-para1.d" guid="_1da5f923-bcbc-4ee8-be63-e15dcdbe6798" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the steps to be taken to obtain an interpreter who is certified, registered or recognised by a recognised agency or is otherwise qualified to act as an interpreter;</txt></block></li><li id="sec.10-frag-pt.6-sec.429VL-ssec.1-para1.e" guid="_bc3e3005-9063-4ee7-8adb-f9cb78747679" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">the steps to be taken before an order under rule 429VG is guid="_7024970a-0884-4361-a879-1e4aeaa08204" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the party who has engaged, or is paying, the interpreter; and</txt></block></li><li id="sec.12-sec.6-ssec.1-para1.c" guid="_891d7486-fe77-4851-a1ee-8cc40ea76ecb" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">any other party to, or person involved in, the proceeding.</txt></block></li></list></block></subclause><subclause id="sec.12-sec.6-ssec.2" guid="_fbb32607-e426-436f-93e6-47440a629d98" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Unless the court orders otherwise, an interpreter must not accept an engagement to act as an interpreter in provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">is or may become a party to, or witness in, the proceeding; or</txt></block></li><li id="sec.12-sec.6-ssec.2-para1.b" guid="_393062a9-e06a-478e-853c-7c42a901dac7" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">is related to, or has a close personal relationship with—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-sec.6-ssec.2-para1.b-para2.i" guid="_21dacfed-3276-420b-b8fe-f52ed27020af" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a party to the proceeding or a member of a party’s family; or</txt></block></li><li id="sec.12-sec.6-ssec.2-para1.b-para2.ii" guid="_8e58fbaf-4f8d-41fb-880a-facfd41a1da8" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a witness or potential witness in the proceeding; or</txt></block></li></list></block></li><li id="sec.12-sec.6-ssec.2-para1.c" guid="_f4a3208c-f4ff-4b9e-88f4-871c521d8564" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">has or may have a financial or other interest of any kind whatsoever in the outcome of the proceeding, other than an entitlement to a reasonable fee for the services provided by the interpreter in the course of their engagement; or</txt></block></li><li id="sec.12-sec.6-ssec.2-para1.d" guid="_7ced9a94-892d-4a8b-af18-48bf63f9bcef" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">is or may be unable to fulfil their duty of accuracy or impartiality for any reason including, for example—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-sec.6-ssec.2-para1.d-para2.i" guid="_4aaadae1-8d0c-4c75-862d-051c73ba6af7" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">personal or religious beliefs; and</txt></block></li><li id="sec.12-sec.6-ssec.2-para1.d-para2.ii" guid="_b428960d-572d-427b-a5c7-1ace4389216c" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">cultural or other perform in the languages for which they are qualified by reason of their training, qualifications or experience.</txt></block></subclause><subclause id="sec.12-sec.7-ssec.2" id="sec.12-sec.7-ssec.2-para1.b" guid="_f6d7f160-6b8e-4098-b499-9b07a137c337" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">work to resolve the situation by either withdrawing from the proceeding or following another strategy acceptable to the court.</txt></block></li></list></block></subclause></clause><clause id="sec.12-sec.8"
