encourage the installation of approved battery systems at residential premises.</txt></block></clause><clause id="sec.3-sec.2" guid="_84e170e4-99cd-410d-b0bc-71ffd657b9f4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.3-sec.2-he" guid="_7c51d848-d6f1-4096-ba6a-8f8f2f12490c">Purpose of assistance</heading><block><txt break.before="1">The purpose of assistance under the scheme is to give individual owners of residential premises a rebate to offset the cost of having an approved battery system suitably installed at the premises. </txt></block></clause><clause id="sec.3-sec.3" guid="_86a64ac9-6853-4050-afda-587e1232e15e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-sec.3-he" guid="_c3ea77d4-e5af-4d95-882c-86f03ad52fe9">Definitions for schedule</heading><block><txt break.before="1">In this schedule—</txt><deflist><definition id="sec.3-sec.3-def.applicant_" guid="_ea3924c3-dbdd-4ee6-b2ed-c0ff0f666741" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.applicant" guid="_b0352304-33f4-4ef0-b44a-a4b1919ea106" type="definition">applicant</defterm>, in relation to assistance under the scheme or conditional approval for assistance under the scheme, means a person applying for the assistance or conditional approval.</txt></definition><definition id="sec.3-sec.3-def.approvedbatterysystem_" guid="_e7c4ea72-c27a-41bb-92ae-88d4ca5d236f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.approvedbatterysystem" guid="_f21eb419-7e70-48cc-a400-d6bf92277170" type="definition">approved battery system</defterm> means a battery energy storage system that is included in the list of systems approved, for the purposes of the scheme, on the electricity department’s website.</txt></definition><definition id="sec.3-sec.3-def.approvedinstaller_" guid="_54f4c405-80d9-4cb2-91df-c55cfef97b2e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.approvedinstaller" guid="_69ce129f-f96e-4d76-81a6-ae52f8bd5d55" type="definition">approved installer</defterm> means an installer of approved battery systems at residential premises who is included in the list of installers approved, for the purposes of the scheme, on the electricity department’s website.</txt></definition><definition id="sec.3-sec.3-def.BuildingCodeofAustralia_" guid="_755dcab4-21df-4578-b317-5b077497e68c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.BuildingCodeofAustralia" guid="_57a7df8a-c418-4553-8e71-e6beba362d6a" type="definition">Building Code of Australia</defterm> see the <legref target.doc.id="act-1975-011" target.version.series="d9daab5f-059e-488d-ba00-96f36d4a1fe5" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Act 1975</name></legref>, section 12.</txt></definition><definition id="sec.3-sec.3-def.class1abuilding_" guid="_eb3dae5d-4e27-496e-9a04-dff29ab3222d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.class1abuilding" guid="_92647974-ff12-499b-a542-27ccdc47e0fd" type="definition">class 1a building</defterm>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.class1abuilding-para1.a" guid="_ae291b1e-1839-4022-b7fc-47d6feba1bc3" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">means a class 1a building under the Building Code of Australia; and</txt></block></li><li id="sec.3-sec.3-def.class1abuilding-para1.b" guid="_aa5aac57-a539-452d-b351-f98613494d78" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">includes a granny flat.</txt></block></li></list></definition><definition id="sec.3-sec.3-def.conditionalapprovalapplication_" guid="_e71c0583-02a0-4f17-a604-39bccfe498cc" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.conditionalapprovalapplication" guid="_bf982465-f0e4-47aa-9d91-7435e2db0f2c" type="definition">conditional approval application</defterm> means an application under section 8 for conditional approval for assistance under the scheme.</txt></definition><definition id="sec.3-sec.3-def.electricitydepartmentswebsite_" guid="_7d9e30ab-b40c-457e-9677-20a9ce3f6797" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.electricitydepartmentswebsite" guid="_6d0114ef-6348-4753-87b7-bf576e06d815" type="definition">electricity department’s website</defterm> means the website of the department administering the <legref target.doc.id="act-1994-064" target.version.series="9906752b-4e97-4fa7-8f1e-9e2cbb7fb2b6" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Electricity Act 1994</name></legref>.</txt></definition><definition id="sec.3-sec.3-def.grannyflat_" guid="_f8498a09-cc8e-422f-ae25-f0d42d9672a3" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.grannyflat" guid="_9f9567e7-1603-4bc8-aac2-bd191df2a4e0" type="definition">granny flat</defterm> means a small building on a lot that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.grannyflat-para1.a" guid="_29d1e67b-8fed-4221-a313-310201c00815" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">is capable of providing self-contained accommodation; and</txt></block></li><li id="sec.3-sec.3-def.grannyflat-para1.b" guid="_f9f7a7fe-d3ce-4ced-a1bf-13e141bea019" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">is not—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.grannyflat-para1.b-para2.i" guid="_3a05b9bc-ca58-41e1-8a71-331196f66ac0" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a house, or other main building used for residential purposes, on the lot; or</txt></block></li><li id="sec.3-sec.3-def.grannyflat-para1.b-para2.ii" guid="_e231be02-3770-4436-a352-79f7917cf10f" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a manufactured home.</txt></block></li></list></block></li></list></definition><definition id="sec.3-sec.3-def.house_" guid="_e65f53d8-4398-4353-a6bd-1db01e5d6233" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.house" guid="_5a7fa1fa-da04-4028-9a80-e6caafdabb6b" type="definition">house</defterm> means residential premises on a lot, if the premises are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.house-para1.a" guid="_eaf03dc6-f076-4ee1-b97f-61cd8266dfc0" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a single detached dwelling; and</txt></block></li><li id="sec.3-sec.3-def.house-para1.b" guid="_014f74d8-898b-48c7-91fe-e54707fe8e0f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the main building on the lot used for residential purposes. </txt></block></li></list></definition><definition id="sec.3-sec.3-def.incomeearner_" guid="_5a5b2bf7-8ebc-4981-9078-38cf826daef6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.incomeearner" guid="_d6b7f3a6-1b9e-4819-bb5f-0bc7fa412e1b" type="definition">income earner</defterm>, for an application for assistance under the scheme, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.incomeearner-para1.a" guid="_a0df1fcb-bbc9-4a9e-9bf4-33d2a467d49e" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the applicant has a spouse who is an individual owner of the residential premises to which the application relates—whomever of the applicant or the spouse had the higher taxable income for the most recently ended financial year; or</txt></block></li><li id="sec.3-sec.3-def.incomeearner-para1.b" guid="_ee6acf46-a297-4bb3-8bf9-82e65faa29a1" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">otherwise—the applicant.</txt></block></li></list></definition><definition id="sec.3-sec.3-def.individualowner_" guid="_a9f5d2d9-7c62-4b03-81bc-172f3d706743" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.individualowner" guid="_2096e00f-57d8-4474-86de-eade6738a017" type="definition">individual owner</defterm>, of residential premises, means an individual who is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.individualowner-para1.a" guid="_2a047b36-b510-4389-a44b-4e1bbe16d1a3" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for a house—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.individualowner-para1.a-para2.i" guid="_ba09d5af-5e36-46ca-b853-83366cf5f1aa" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the registered owner of the lot on which the house is located; or</txt></block></li><li id="sec.3-sec.3-def.individualowner-para1.a-para2.ii" guid="_6ee18bc8-b1f3-4fba-ad98-f226d089f32d" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if there is a home ownership lease over the lot on which the house is located under the <legref target.doc.id="act-1991-032" target.version.series="9408f57c-9b40-4ed4-817e-ee06cee2b54e" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Aboriginal Land Act 1991</name></legref> or the <legref target.doc.id="act-1991-033" target.version.series="dbdd7c1d-f4f4-4804-a544-27228a06ed09" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Torres Strait Islander Land Act 1991</name></legref>—the lessee under the lease; or</txt></block></li></list></block></li><li id="sec.3-sec.3-def.individualowner-para1.b" guid="_b7d18de8-ea81-4a75-bb47-5b886bd6aadc" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for a granny flat—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.individualowner-para1.b-para2.i" guid="_766eecc2-c65a-4d0e-8d1a-75eb76cb1e33" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the registered owner of the lot on which the flat is located; or</txt></block></li><li id="sec.3-sec.3-def.individualowner-para1.b-para2.ii" guid="_09c584ea-7090-4876-b924-43bc5533e1a6" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the person who, under any arrangement, resides at the flat and has responsibility for making significant repairs or modifications to the flat; or</txt></block></li></list></block></li><li id="sec.3-sec.3-def.individualowner-para1.c" guid="_300e9700-cbdd-4d0d-8d66-56b5e450b66a" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">for residential premises, other than a house or granny flat, on a lot that is included in a community titles scheme under the <legref target.doc.id="act-1997-028" target.version.series="64bf56de-be45-4387-8ada-9b4f75f32515" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Body Corporate and Community Management Act 1997</name></legref> or on a building units plan or group titles plan registered under the <legref target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Units and Group Titles Act 1980</name></legref>—the registered owner of the lot; or</txt></block></li><li id="sec.3-sec.3-def.individualowner-para1.d" guid="_6668c2e9-fa63-4729-9574-1809643b4963" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">for other residential premises—the person the authority is satisfied owns the premises on the basis of an arrangement or document evidencing that the person is the owner or is treated as the owner by the entity that owns the land on which the premises are located.</txt></block></li></list></definition><definition id="sec.3-sec.3-def.lot_" guid="_3c4b342b-2a64-4fe2-abd6-ecd2e585973b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.lot" guid="_39303c2a-19ec-4303-9215-61803871a36b" type="definition">lot</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.lot-para1.a" guid="_23f07449-9d68-41eb-9c31-4e36a201bba1" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a lot on a building units plan or group titles plan registered under the <legref target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Units and Group Titles Act 1980</name></legref>; or</txt></block></li><li id="sec.3-sec.3-def.lot-para1.b" guid="_d5eb9a10-00d3-4666-9eb9-c2ea7c313fbb" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a lot under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref>.</txt></block></li></list></definition><definition id="sec.3-sec.3-def.manufacturedhome_" guid="_caa6de13-0a89-4812-a476-28e2696922db" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.manufacturedhome" guid="_99b265a9-84f1-498e-96d2-a6d0047af5eb" type="definition">manufactured home</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.manufacturedhome-para1.a" guid="_d8051c85-e864-4640-80e6-a07d5a5e0c56" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a manufactured home under the <legref target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Manufactured Homes (Residential Parks) Act 2003</name></legref>, section 10; or</txt></block></li><li id="sec.3-sec.3-def.manufacturedhome-para1.b" guid="_f5d7232d-b985-49da-b76a-2ea7496ba0d8" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a caravan that has been modified so that it may not be moved from its position using the means ordinarily used to transport the caravan.</txt></block></li></list></definition><definition id="sec.3-sec.3-def.noticeofassessment_" guid="_d0f1a4bd-96de-4ae8-8634-7b1a8ec7517a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.noticeofassessment" guid="_66e4f723-b229-4087-96f0-9c8d85300ede" type="definition">notice of assessment</defterm> means a notice of assessment issued under the <legref jurisd="CTH" target.doc.id="act-1997-038" target.version.series="C2004A05138" check="valid" type="act"><name emphasis="yes">Income Tax Assessment Act 1997</name> (Cwlth)</legref>.</txt></definition><definition id="sec.3-sec.3-def.registeredowner_" guid="_09970b24-5b9c-4e1a-8742-1be62979288b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.registeredowner" guid="_899c543c-aeef-4bfb-931c-b0310195910a" type="definition">registered owner</defterm>, of a lot, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.registeredowner-para1.a" guid="_8d52a256-6988-445c-8d64-69b33b6d9cde" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for a lot on a building units plan or group titles plan registered under the <legref target.doc.id="act-1980-042" target.version.series="db1baf67-e0e9-4aaa-88d6-6b0407d404c3" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Building Units and Group Titles Act 1980</name></legref>—the proprietor of the lot under that Act; or</txt></block></li><li id="sec.3-sec.3-def.registeredowner-para1.b" guid="_f7b757ce-2d9c-4161-9c6d-022a012d9cdc" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for another lot—the registered owner of the lot under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref>.</txt></block></li></list></definition><definition id="sec.3-sec.3-def.residentialpremises_" guid="_8abd9634-408b-47f9-8811-e7fef0b9e5d7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.residentialpremises" guid="_cdae0772-d5a6-4f95-81bc-ee1f4e376b14" type="definition">residential premises</defterm> means a class 1a building in Queensland.</txt></definition><definition id="sec.3-sec.3-def.scheme_" guid="_2ee1b97c-92e9-463d-b12e-c0d0a1c0c1d5" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.scheme" guid="_a0d772c0-809f-4167-af92-2e2198f9e2c0" type="definition">scheme</defterm> means the scheme set out in this schedule.</txt></definition><definition id="sec.3-sec.3-def.suitablyinstalled_" guid="_1c6ab4e3-d952-4456-8b4a-94313b6df837" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.suitablyinstalled" guid="_ca1d647c-88b9-463e-bbc1-17110dd086cd" type="definition">suitably installed</defterm>, in relation to an approved battery system at residential premises, see section 4.</txt></definition><definition id="sec.3-sec.3-def.taxableincome_" guid="_b6fb60df-111b-46f3-a6a0-7840b89d59c0" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.taxableincome" guid="_6ea11171-1c65-4afb-9aeb-bc61e6935053" type="definition">taxable income</defterm>, of an individual, means the individual’s taxable income within the meaning affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An approved battery system is <defterm id="sec.3-sec.4-def.suitablyinstalled-oc.2" guid="_ac096859-f5f3-437b-86d6-04647cd196ba" type="definition">suitably installed</defterm> at residential premises if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.4-ssec.1-para1.a" guid="_0df31545-1df9-4cfc-b7ec-b844e66e6caf" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the system is installed, and connected to a suitable solar PV system that is installed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.4-ssec.1-para1.a-para2.i" guid="_f67ece65-7c66-49f7-ae93-25a29cdd135f" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">at the premises; or</txt></block></li><li id="sec.3-sec.4-ssec.1-para1.a-para2.ii" guid="_45eb0c63-4db8-4971-954d-f1f4c8388f7b" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">on the lot or other land on which the premises are located; and</txt></block></li></list></block></li><li id="sec.3-sec.4-ssec.1-para1.b" guid="_e5306a64-c0f0-416a-b062-7ca04198a018" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the person who carried out the installation and connection is an approved installer; and</txt></block></li><li id="sec.3-sec.4-ssec.1-para1.c" guid="_1f58e472-f94b-4742-99e4-125f4907f104" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the connection allows the approved battery system and suitable solar PV system to operate together.</txt></block></li></list></block></subclause><subclause id="sec.3-sec.4-ssec.2" guid="_8723e459-aaa9-485f-bd7d-d7fc8a0d4f74" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-sec.4-ssec.2-def.suitablesolarPVsystem_" guid="_d8859b3e-4773-4767-a949-f5b8b13abd0b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.4-ssec.2-def.suitablesolarPVsystem" guid="_69a706da-7d4d-4d35-a8f1-7b476a784186" type="definition">suitable solar PV system</defterm> means a solar photovoltaic system with a system capacity of 5kW or more.</txt></definition></deflist></block></subclause></clause></part><part id="sec.3-frag-sch.55-pt.2" guid="_047524ac-547f-490a-8a2c-d2046bb8e062" numbering.style="all" affected.by.uncommenced="0"><no>Part 2</no><heading id="sec.3-frag-sch.55-pt.2-he" guid="_e70b57da-544d-4355-b126-4028397324dd">General provisions for scheme</heading><clause id="sec.3-sec.5" guid="_3e587dbc-64ba-4e7e-bf25-5ad2fe6981fa" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.3-sec.5-he" guid="_d0442099-fa65-47d6-bb8b-774f60f6ba62">Nature and amount of assistance</heading><subclause id="sec.3-sec.5-ssec.1" guid="_5393a5b9-d379-49ba-a10b-101b4908642c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The nature of the assistance available under the scheme is a rebate to offset the cost of having an approved battery system suitably installed at residential premises owned by the applicant.</txt></block></subclause><subclause id="sec.3-sec.5-ssec.2" guid="_fa051a79-3256-4d5a-951b-b520b7c7ead5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The amount of the assistance is the total of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.5-ssec.2-para1.a" guid="_8c2b869f-d294-4604-b1bb-1288d7eea959" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the lesser of the following amounts—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.5-ssec.2-para1.a-para2.i" guid="_87415473-07ef-4ec5-a4f7-7b313a0e28e3" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the amount mentioned in subsection (3);</txt></block></li><li id="sec.3-sec.5-ssec.2-para1.a-para2.ii" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the amount of any GST payable by the authority in relation to the assistance mentioned in paragraph (a).</txt></block></li></list></block></subclause><subclause id="sec.3-sec.5-ssec.3" guid="_8349e618-143f-43e3-bc58-cd55bd10ba37" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For subsection (2)(a)(i), the amount is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.5-ssec.3-para1.a" guid="_1555d0c3-52b2-4dca-92f8-8bec8e2069cd" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the taxable income of the income earner for the application, for the most recently ended financial year, is $66,667 or less—$4,000; or</txt></block></li><li id="sec.3-sec.5-ssec.3-para1.b" guid="_f91a47bb-efa1-47d9-9f7c-d8a7e44d2b0d" provision.type="other" guid="_9976e41e-974a-4eb0-9192-d46ca3c0713e">Operation of scheme</heading><block><txt break.before="0">The scheme—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.6-para1.a" guid="_5c645fe0-2dc1-40a2-a849-74fd553145fc" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">opens on the day stated on the electricity department’s website as the day the scheme opens; and</txt></block></li><li id="sec.3-sec.6-para1.b" guid="_dec2d15d-3655-46e8-b078-f756a1c04b4e" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">closes on the earlier of the following days—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.6-para1.b-para2.i" guid="_bd3dc875-8905-4c93-a5dc-2fc3b1e39012" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the day stated on the website as the day the scheme closes;</txt></block></li><li id="sec.3-sec.6-para1.b-para2.ii" guid="_f7bf17da-5890-4661-9f65-eb3f7cf4e487" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the day on which the authority’s assistance funds for the scheme become insufficient to pay further assistance under the scheme.</txt></block></li></list></block></li></list></block></clause><clause id="sec.3-sec.7" guid="_98b7094e-46c3-49b6-81a4-57c385b5b4f2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.3-sec.7-he" guid="_fbfe396e-d507-4aa8-b1a4-f949f0c98f29">Eligibility criteria—conditional approval for assistance</heading><block><txt break.before="0">An applicant is eligible for conditional approval for assistance under the scheme in relation to residential premises if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.7-para1.a" guid="_0e5ccbfd-fa9e-42df-ac40-539f8e1c5697" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the applicant is an individual owner of the premises; and</txt></block></li><li id="sec.3-sec.7-para1.b" guid="_26bddc47-7b1e-4204-bf4e-0fd77cdc9b11" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a person has not previously received assistance under the scheme in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.7-para1.b-para2.i" guid="_827b741c-8ad9-4098-973b-407b6f2b932a" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the premises; or</txt></block></li><li id="sec.3-sec.7-para1.b-para2.ii" guid="_5cb838ed-8f77-4597-99dc-a17af0a2ac67" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if the premises are located on a lot—any other residential premises located on the same lot; and</txt></block></li></list></block></li><li id="sec.3-sec.7-para1.c" guid="_3986cf13-e3e7-4364-a502-441ab33ccc4d" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the applicant has obtained a quote for the sale of an approved battery system from—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.7-para1.c-para2.i" guid="_62ea1f7d-e46e-46fe-b83d-89173c2ad439" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">an approved installer; or</txt></block></li><li id="sec.3-sec.7-para1.c-para2.ii" guid="_15d4e2be-841a-497b-ba21-e065259ac50d" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">another retailer of approved battery systems; and</txt></block></li></list></block></li><li id="sec.3-sec.7-para1.d" guid="_3b574890-7e57-42f2-a7a1-0c4acf7794b7" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the applicant’s taxable income or, if the applicant has a spouse, the combined taxable income of the applicant and spouse, for the most recently ended financial year, is $180,000 or less.</txt></block></li></list></block></clause><clause id="sec.3-sec.8" guid="_7480f74b-1709-47a3-8816-663c7ed69abb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.3-sec.8-he" guid="_3f0ea83d-673f-4f70-a34b-28562f3062d5">Conditional approval applications</heading><subclause id="sec.3-sec.8-ssec.1" guid="_c1f4dd69-3f20-41fa-aadf-600562569d3f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An application for conditional approval for assistance under the scheme in relation to residential premises must be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.8-ssec.1-para1.a" guid="_a40f64e8-7ba2-4203-98d3-bb2ea9b62026" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">made in the approved form; and</txt></block></li><li id="sec.3-sec.8-ssec.1-para1.b" guid="_0804e58a-789e-4467-9a06-1f92d7af7b27" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">given to the authority before the applicant applies for the assistance under section 11.</txt></block></li></list></block></subclause><subclause id="sec.3-sec.8-ssec.2" guid="_ed06cbbe-65b3-4d96-b6d0-44808509821d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The application must be accompanied by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.8-ssec.2-para1.a" guid="_fb0d77fa-5778-4db1-a0e3-dd71f78e7a9a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a copy of the quote mentioned in section 7(c) relating to the residential premises; and</txt></block></li><li id="sec.3-sec.8-ssec.2-para1.b" guid="_86302449-4eec-44be-a23f-7c8af9eaf773" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a copy of the notice of assessment for the applicant’s taxable income or, if the applicant has a spouse, the combined taxable income of the applicant and spouse, for the most recently ended financial year; and</txt></block></li><li id="sec.3-sec.8-ssec.2-para1.c" guid="_c96331ab-4480-4b48-8ff3-bddf3e2d49c9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">any other documents stated in the form.</txt></block></li></list></block></subclause><subclause id="sec.3-sec.8-ssec.3" guid="_3af6ccda-f735-4d80-88b8-8364b33887b6" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, if the notice of assessment mentioned in subsection (2)(b) has not been issued when the application is made, the application— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.8-ssec.3-para1.a" guid="_50f19e95-aa7d-4406-88e3-5c716893520f" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">is not required to be accompanied by a copy of the notice; and</txt></block></li><li id="sec.3-sec.8-ssec.3-para1.b" guid="_4a918bd6-2ec0-4343-97bc-1b78074bd6eb" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">must be accompanied by other documentary evidence, to the satisfaction of the authority, of the taxable income or combined taxable income.</txt></block></li></list></block></subclause><subclause id="sec.3-sec.8-ssec.4" guid="_d50df5a3-8262-4626-ad9f-084bfcce2eb4" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the authority asks the applicant to provide further information to decide the application, the applicant must provide the information.</txt></block></subclause></clause><clause id="sec.3-sec.9" guid="_4dff9e6d-945d-4d32-af77-7b88c4198a0d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.3-sec.9-he" guid="_7bc05964-30e0-441f-b876-9233e2a68c9c">Deciding conditional approval applications</heading><subclause id="sec.3-sec.9-ssec.1" guid="_6f6efea2-ffa3-48ff-8739-3268ff69ada2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The authority must consider each conditional approval application and decide to approve, or refuse to approve, the application.</txt></block></subclause><subclause id="sec.3-sec.9-ssec.2" guid="_66f2a079-943e-4f12-8f84-d0bda1642522" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The authority must consider conditional approval applications in the order they are received by the authority.</txt></block></subclause><subclause id="sec.3-sec.9-ssec.3" guid="_b7edb1b9-cb2e-4a43-86d1-b32804eda704" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The authority must, for each conditional approval application, give the applicant written notice of the authority’s decision.</txt></block></subclause></clause><clause id="sec.3-sec.10" guid="_e1586da3-0019-4694-b15b-5785188289ff" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.3-sec.10-he" guid="_897695a4-da94-40cf-90ee-3d0c4df0c2cb">Eligibility criteria—assistance</heading><block><txt break.before="0">An applicant is eligible to receive assistance under the scheme in relation to residential premises if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.10-para1.a" guid="_9b791e58-368e-4586-b388-a12e38f4acaa" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the authority has, under section 9(1), approved a conditional approval application for the assistance by the applicant; and</txt></block></li><li id="sec.3-sec.10-para1.b" guid="_1f5b2be0-93c1-4d30-b62e-500e00e67c0d" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the applicant is an individual owner of the premises; and</txt></block></li><li id="sec.3-sec.10-para1.c" guid="_a8fd19ae-9b1a-40b6-a461-6b758caaaf7a" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the applicant’s taxable income or, if the applicant has a spouse, the combined taxable income of the applicant and spouse, for the most recently ended financial year, is $180,000 or less; and</txt></block></li><li id="sec.3-sec.10-para1.d" guid="_dd46d7ce-c666-4951-9b07-8a7949348368" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the authority is satisfied the approved battery system for which the conditional approval was given has been suitably installed at the premises; and</txt></block></li><li id="sec.3-sec.10-para1.e" guid="_d5618882-fbe7-45a5-ba31-ee79055ef1fa" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">the applicant applies for the assistance under section 11 on or before the day that is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.10-para1.e-para2.i" guid="_2af3c145-9ffc-4341-8a14-796f53092ff6" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">90 days after receiving written notice of the conditional approval under section 9(3); or</txt></block></li><li id="sec.3-sec.10-para1.e-para2.ii" guid="_2b5890fc-5459-4de8-9b56-dafb3610ea30" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a later day, not later than 120 days after receiving the notice, if the authority is satisfied it is not reasonably practicable for the installation to have been carried out, and the application made, until the later day.</txt></block></li></list></block></li></list></block></clause><clause id="sec.3-sec.11" guid="_711c8556-8ea0-41e1-9813-2c5b425633cc" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.3-sec.11-he" guid="_6e15a5a6-9532-498c-a8a0-4750a1c1e9ec">Applications for assistance</heading><subclause id="sec.3-sec.11-ssec.1" guid="_9632b77b-3130-486d-8be0-36eacaed29b8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An application for assistance under the scheme in relation to residential premises must be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.11-ssec.1-para1.a" guid="_1a12209f-ba6e-4c40-a1d2-dc68ec4104bc" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">made in the approved form; and</txt></block></li><li id="sec.3-sec.11-ssec.1-para1.b" guid="_02d9697d-1439-46d5-8da8-45dbe66927ec" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">accompanied by the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.11-ssec.1-para1.b-para2.i" guid="_60d1359b-eefd-4844-921c-8927d61cf43e" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if a financial year has ended since the conditional approval application for the assistance was made—a copy of the notice of assessment for the applicant’s taxable income or, if the applicant has a spouse, the combined taxable income of the applicant and spouse, for the most recently ended financial year;</txt></block></li><li id="sec.3-sec.11-ssec.1-para1.b-para2.ii" guid="_e1e9805a-b2c2-49b5-a7e1-1bf8adf296be" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if section 5(2)(a)(i) applies for working out the amount of assistance applied for—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.11-ssec.1-para1.b-para2.ii-para3.A" guid="_b5eb86a3-ff45-4fcd-b602-5c3b0160cf39" provision.type="other" affected.by.uncommenced="0"><no>(A)</no><block><txt break.before="0">a declaration by the applicant stating the name of the income earner for the application; and</txt></block></li><li id="sec.3-sec.11-ssec.1-para1.b-para2.ii-para3.B" guid="_7926ae33-0520-4bb4-8728-da162c8c8ed1" provision.type="other" affected.by.uncommenced="0"><no>(B)</no><block><txt break.before="0">a copy of the notice of assessment for the taxable income of the income earner for the most recently ended financial year;</txt></block></li></list></block></li><li id="sec.3-sec.11-ssec.1-para1.b-para2.iii" guid="_20cb9915-fc0c-42e4-b7d4-7c766b12a908" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">a copy of the tax invoice for the purchase, and installation at the premises, of the approved battery system for which conditional approval for the assistance was given under section 9;</txt></block></li><li id="sec.3-sec.11-ssec.1-para1.b-para2.iv" guid="_f8c07991-ec20-4bcf-86f7-d28add103e32" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">any other documents stated in the form.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.3-sec.11-ssec.2" guid="_514fb302-82e1-4907-9319-4cfe6cd14e7b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, if the notice of assessment mentioned in subsection (1)(b)(i) or (ii)(B) has not been issued when the application is made, the application— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.11-ssec.2-para1.a" guid="_55a80790-4f27-42e6-a350-2beccebb06e2" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">is not required to be accompanied by a copy of the notice; and</txt></block></li><li id="sec.3-sec.11-ssec.2-para1.b" guid="_90d3307b-c9e8-42d9-b54b-33e8cb13fcc0" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">must be accompanied by other documentary evidence, to the satisfaction of the authority, of the taxable income or combined taxable income.</txt></block></li></list></block></subclause><subclause id="sec.3-sec.11-ssec.3" guid="_c10ec500-dcf6-4884-a743-dc27705d7f57" affected.by.uncommenced="0"
