assist primary producers carrying on primary production enterprises in particular areas to obtain eligible professional advice to improve the resilience to flooding and high rainfall of the primary production enterprises.</txt></block></clause><clause id="sec.3-sec.2" guid="_3c6167c3-3684-4770-b176-7eef91e50184" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.3-sec.2-he" guid="_afa86898-bc07-4ff5-82a9-f820176b3284">Purpose of assistance</heading><block><txt break.before="1">The purpose of assistance under the scheme is to provide grants of financial assistance to primary producers carrying on primary production enterprises in particular areas to offset all or part of the cost of obtaining eligible professional advice.</txt></block></clause><clause id="sec.3-sec.3" guid="_0347b550-b264-448f-8ef9-70265ea595d4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-sec.3-he" guid="_595c3620-753c-4be9-bf20-ec0d5bb2b381">Definitions for schedule</heading><block><txt break.before="1">In this schedule—</txt><deflist><definition id="sec.3-sec.3-def.applicant_" guid="_1a91f154-c4d7-4325-be9c-255d69fa9560" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.applicant" guid="_82c8bb7d-b697-4ed3-a45d-8078ab1f1064" type="definition">applicant</defterm> means an entity applying for financial assistance under the scheme.</txt></definition><definition id="sec.3-sec.3-def.defineddisasterarea_" guid="_2ca643c6-8e74-4a62-a009-60093afcf21a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.defineddisasterarea" guid="_65325d89-ab9b-4eaf-a81a-3bd1b0a946df" type="definition">defined disaster area</defterm> see section 4.</txt></definition><definition id="sec.3-sec.3-def.eligibleprofessionaladvice_" a primary production enterprise, see section 6.</txt></definition><definition id="sec.3-sec.3-def.primaryproducer_" guid="_b0c37916-df40-412d-99c4-54a737f76890" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.primaryproducer" guid="_da4530a3-e89c-488a-b260-f5d26ac13e75" type="definition">primary producer</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.primaryproducer-para1.a" guid="_d11e8d80-0b01-4544-a75a-4a1c178664d2" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a sole trader who spends the majority of their labour on, and derives the majority of their income from, a primary production enterprise; or</txt></block></li><li id="sec.3-sec.3-def.primaryproducer-para1.b" guid="_2559e18f-f000-41d0-9c67-45e2a204af87" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a partnership, company or trust that carries on a primary production enterprise, for which the partners, shareholders or beneficiaries spend the majority of their labour on, and derive the majority of their income from, the primary production enterprise.</txt></block></li></list></definition><definition id="sec.3-sec.3-def.primaryproductionenterprise_" guid="_4fd32437-cfe2-4b61-97a4-b94833128335" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.primaryproductionenterprise" guid="_e783c4a0-fcde-4b49-b066-6046099bc18d" type="definition">primary production enterprise</defterm> means a business—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.primaryproductionenterprise-para1.a" guid="_fa649d26-04b6-4b42-ac89-9472b87ca542" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">that involves primary production, including, for example, agricultural, apicultural, aquacultural, commercial wild-catch fishing, forestry, grazing and horticultural industries; and</txt></block></li><li id="sec.3-sec.3-def.primaryproductionenterprise-para1.b" guid="_3ecff350-ac05-4081-84ce-8c6965934436" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for which an entity holds an Australian Business Number.</txt></block></li></list></definition><definition id="sec.3-sec.3-def.scheme_" guid="_2c69aaa8-b212-41df-b188-2ab765a57907" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.scheme" guid="_fb4d0d63-b6dc-4f05-a73e-7d747dad6e60" type="definition">scheme</defterm> means the scheme set out in this schedule.</txt></definition><definition id="sec.3-sec.3-def.suitablyqualifiedprofessionaladviser_" guid="_c3d940c4-f14a-442c-870d-93c5e620e3e4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.3-def.suitablyqualifiedprofessionaladviser" guid="_2bb73775-2c8b-43ee-bc35-1f02156d273e" type="definition">suitably qualified professional adviser</defterm> means a person who—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.suitablyqualifiedprofessionaladviser-para1.a" guid="_e755d0f9-faf4-4c78-a0f5-1bda51133a8b" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">is an owner or employee of a business—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.3-def.suitablyqualifiedprofessionaladviser-para1.a-para2.i" guid="_38fb4dfd-b20f-4bb0-bbd4-d5de7d18a01a" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">that provides professional advice or services of a type relevant to improving the resilience to flooding and high rainfall of primary production enterprises; and</txt></block></li><li id="sec.3-sec.3-def.suitablyqualifiedprofessionaladviser-para1.a-para2.ii" guid="_ffd12f04-a2d4-48f7-97af-a0f8c0af8d15" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">for which an entity holds an Australian Business Number; and</txt></block></li></list></block></li><li id="sec.3-sec.3-def.suitablyqualifiedprofessionaladviser-para1.b" guid="_e9a4db82-ec45-40af-8c20-9b5762ae9c52" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">has the relevant qualifications and experience to provide the break.before="1">accountant, agronomist, farm irrigation consultant, financial planner, geographic information system technician, soil scientist</txt></block></note></block></li></list></definition></deflist></block></clause><clause id="sec.3-sec.4" guid="_36d8a5fb-a94e-4845-aed0-66993d0009cb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.3-sec.4-he" guid="_fa7270ed-3224-47dc-8ea8-bb50c5877949">Meaning of <defterm id="sec-sec.4-def.defineddisasterarea" guid="_3df1a141-3aab-48cd-8851-f46bea16480e" type="mention">defined disaster area</defterm></heading><subclause id="sec.3-sec.4-ssec.1" guid="_c89892c2-6654-4f5a-8288-70a207ac0ac0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A <defterm id="sec.3-sec.4-def.defineddisasterarea-oc.2" guid="_12c929a0-b7a4-4050-a452-c97435ab6be1" type="definition">defined disaster area</defterm> is a local government area identified in a disaster activation document as—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.4-ssec.1-para1.a" guid="_b90020d5-3562-4f57-9cb2-40459680f324" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a DRFA Activated Area; and</txt></block></li><li id="sec.3-sec.4-ssec.1-para1.b" guid="_4868fd43-d27e-4379-8e33-df382f846849" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">an area eligible for DRFA assistance measure ‘Disaster Assistance (Primary Producers) Loans’.</txt></block></li></list></block></subclause><subclause id="sec.3-sec.4-ssec.2" break.before="0"><defterm id="sec.3-sec.5-def.Eligibleprofessionaladvice" guid="_f3764073-750f-4dd9-b688-37cfb9dd059d" type="definition">Eligible professional advice</defterm>, for a primary production enterprise, is advice or a service provided by a suitably qualified professional adviser about improving the resilience to flooding and high rainfall of the primary production enterprise.</txt><note id="sec.3-sec.5-ssec.1-note" guid="_94617244-06cd-4bfe-976f-943377ec7249" type="example"><heading id="sec.3-sec.5-ssec.1-note-he" guid="_6f491f50-3d0c-4b10-98bd-228341bea9ca">Examples of advice or a service—</heading><block><txt break.before="1">accountancy advice, agronomic advice, financial planning, flood mapping, geotechnical surveying, soil mapping and assessment</txt></block></note></block></subclause><subclause id="sec.3-sec.5-ssec.2" guid="_6576c80f-9f43-4c17-a56b-bdd6defea5ac" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, <defterm id="sec.3-sec.5-def.eligibleprofessionaladvice-oc.2" guid="_9d521204-cb8b-4efb-8918-f5f121a13109" type="definition">eligible professional advice</defterm> does not include a service provided in relation to implementing actions detailed in a flood management plan that an applicant may take to manage risks to a primary production enterprise.</txt></block></subclause></clause><clause id="sec.3-sec.6" guid="_c016212c-e430-4783-8871-1f760e7aa019" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.3-sec.6-he" guid="_b3268f5d-5f4f-44a0-8d52-04777ad99475">Meaning of <defterm guid="_08a3d042-3c52-4207-b143-b143e6ccc9f0" type="mention">flood management plan</defterm></heading><block><txt break.before="1">A <defterm id="sec.3-def.floodmanagementplan" guid="_4147d0ab-dbc9-4b24-9b01-d93e69ff30a2" type="definition">flood management plan</defterm>, for a primary production enterprise, is a plan that the authority is satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.6-para1.a" guid="_2eaea615-6d21-41fc-bc76-2445559dc243" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">has been prepared in accordance with eligible professional advice for the primary production enterprise; and</txt></block></li><li id="sec.3-sec.6-para1.b" guid="_94b84afc-b2e9-4c1c-bbfc-7bd09698a6c2" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">addresses risks to the primary production enterprise from flooding and high rainfall; and</txt></block></li><li id="sec.3-sec.6-para1.c" guid="_e8628e85-6388-4f49-8fd9-0fbb06f3c6ed" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">details the actions the applicant may take to manage the risks to the primary production enterprise to improve the resilience of the primary production enterprise.</txt></block></li></list></block></clause></part><part guid="_07354442-8d03-426a-96d8-cdabe0a04a63">General provisions for scheme</heading><clause id="sec.3-sec.7" guid="_8307254d-d49c-4ef8-b55a-a33d0d2971c7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.3-sec.7-he" guid="_3d4c2225-a0fc-4744-b55a-1f7d3fa77cd6">Nature and maximum amount of assistance</heading><subclause id="sec.3-sec.7-ssec.1" guid="_9bff19a6-08b3-4e1e-88e6-fd6bec3fe95d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The nature of the assistance available to an applicant under the scheme is a grant of financial assistance to offset all or part of the cost to the applicant of obtaining eligible professional advice for a primary production enterprise.</txt></block></subclause><subclause id="sec.3-sec.7-ssec.2" guid="_5892c71b-da5b-4860-9924-30faad99b92d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The amount of assistance available under the scheme is the cost to the applicant of obtaining the eligible professional advice for the primary production enterprise (exclusive of GST) up to a maximum of $7,500.</txt></block></subclause><subclause id="sec.3-sec.7-ssec.3" guid="_1b259877-c248-469b-a85a-b9760710ff4c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">An applicant may make more than 1 application for assistance under the scheme.</txt></block></subclause><subclause id="sec.3-sec.7-ssec.4" guid="_aee2a416-2e09-485e-ab12-530d191d1312" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, the maximum amount of assistance available under the scheme to an applicant is the amount of assistance mentioned in subsection (2).</txt></block></subclause></clause><clause id="sec.3-sec.8" guid="_34f11009-52af-4233-b942-d6e85bf3654b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.3-sec.8-he" guid="_9f0b02dc-72c8-44e3-9d5b-0e2acab1cd2e">Eligibility criteria</heading><subclause id="sec.3-sec.8-ssec.1" guid="_e9efa33b-9175-4bde-929b-1a2c73415574" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An applicant is eligible to receive assistance under the scheme if the authority is satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.8-ssec.1-para1.a" guid="_03da686e-f8c9-4420-b92b-a67a90c04ab8" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the applicant is a primary producer carrying on a primary production enterprise in a defined disaster area; and</txt></block></li><li id="sec.3-sec.8-ssec.1-para1.b" guid="_4d01e796-4047-4a98-b4c4-1f1196698460" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the applicant obtained eligible professional advice for the primary production enterprise on or after 18 May 2022; and</txt></block></li><li id="sec.3-sec.8-ssec.1-para1.c" guid="_6d5a9454-ec5c-4d7a-a7f4-c29042c059a6" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the suitably qualified professional adviser who provided the eligible professional advice is not an employee of, or engaged as a contractor by, an entity owned wholly or partly by the applicant; and</txt></block></li><li id="sec.3-sec.8-ssec.1-para1.d" guid="_9fcc95de-f616-4895-8209-c696ad8d6172" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the applicant has paid for the eligible professional advice; and</txt></block></li><li id="sec.3-sec.8-ssec.1-para1.e" guid="_bbf3293a-ca85-422a-a06d-474fb9208efb" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">a flood management plan has been prepared for the primary production enterprise; and</txt></block></li><li id="sec.3-sec.8-ssec.1-para1.f" guid="_c012803c-6648-4076-aea4-5d822e93b940" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">an industry recovery and resilience officer has confirmed in writing that the officer considers the eligible professional advice for the primary production enterprise and the flood management plan will improve the resilience to flooding and high rainfall of the primary production enterprise.</txt></block></li></list></block></subclause><subclause id="sec.3-sec.8-ssec.2" guid="_ce443693-388c-4ae4-af52-83898bfc0d53" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, the applicant is not eligible for assistance under the scheme if the applicant has received other assistance from the State or the Commonwealth to offset all or part of the cost to the applicant of obtaining the eligible professional advice for the primary production enterprise.</txt></block></subclause><subclause id="sec.3-sec.8-ssec.3" guid="_76dd6bba-77fe-47d4-beb2-fa6965e4c567" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-sec.8-ssec.3-def.BurnettMaryRegionalGroup_" guid="_241d3720-b391-42cf-af30-62c2379e6704" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.8-ssec.3-def.BurnettMaryRegionalGroup" guid="_92333cc7-b69b-4e7b-8ab9-ebe5ab5c2ac1" type="definition">Burnett Mary Regional Group</defterm> means Burnett Mary Regional Group for Natural Resource Management Ltd ACN 144 005 229.</txt></definition><definition id="sec.3-sec.8-ssec.3-def.industryrecoveryandresilienceofficer_" guid="_b25b9125-9b6d-4a82-88f5-ce365bdd8723" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.8-ssec.3-def.industryrecoveryandresilienceofficer" guid="_af4857ae-75a6-423e-a05c-5e7fb2a3e140" type="definition">industry recovery and resilience officer</defterm> means a person who is employed or otherwise engaged by the Queensland Farmers’ Federation or the Burnett Mary Regional Group as an industry recovery and resilience officer.</txt></definition><definition id="sec.3-sec.8-ssec.3-def.QueenslandFarmersFederation_" guid="_024232a6-d237-44ba-b18e-916d4b6e7d23" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.8-ssec.3-def.QueenslandFarmersFederation" guid="_692bedb0-e0df-4ff2-a4f5-1ead5e220a7b" type="definition">Queensland Farmers’ Federation</defterm> means Queensland Farmers’ Federation Ltd ACN 055 764 488.</txt></definition></deflist></block></subclause></clause><clause id="sec.3-sec.9" guid="_75fde307-dd4c-442f-89b1-cb1b11d55b7c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.3-sec.9-he" guid="_3df5c29d-85c1-4ce6-b1f4-d55d48b444b6">Operation of scheme</heading><subclause id="sec.3-sec.9-ssec.1" guid="_39357711-8f04-4042-aa44-a643b5299d1d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The scheme opens on the day stated on the authority’s website as the day on or after which an application for assistance under the scheme may be made.</txt></block></subclause><subclause id="sec.3-sec.9-ssec.2" guid="_0cff4216-75f3-45f1-bde8-74a615f66e31" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The scheme closes on the earlier of the following days—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.9-ssec.2-para1.a" guid="_885caaad-a75a-404f-9762-80e447ee42ef" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the day on which the authority’s assistance funds for the scheme become insufficient to pay further assistance under the scheme;</txt></block></li><li id="sec.3-sec.9-ssec.2-para1.b" guid="_50e7aee8-9edc-4c1e-8ac3-c2214e3e6f78" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">31 March 2024 (the <defterm id="sec.3-sec.9-ssec.2-def.closingday" guid="_790eb87c-ec35-4395-8c36-665a560f0f9f" type="definition">closing day</defterm>).</txt></block></li></list></block></subclause><subclause id="sec.3-sec.9-ssec.3" guid="_adcb62b7-3a82-45d9-b484-e59e0531b320" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, the Minister may, by notice published on the authority’s website (an <defterm id="sec.3-sec.9-def.extensionnotice" guid="_f5c22ac8-19bd-4791-952c-71716c7bce11" type="definition">extension notice</defterm>), extend the closing day, once only, to a stated day that is not later than 24 December 2024.</txt></block></subclause><subclause id="sec.3-sec.9-ssec.4" guid="_769251cf-fbe0-4376-9ce2-0668acbfdbf6" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The Minister may publish an extension notice only if the Minister is satisfied applicants need more time in which to apply for assistance under the scheme.</txt></block></subclause><subclause id="sec.3-sec.9-ssec.5" guid="_659663ba-01d0-449b-ad87-64b2ee967ec2" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The Minister must table a copy of the extension notice in the Legislative Assembly within 14 days after the day the extension notice is published.</txt></block></subclause></clause><clause id="sec.3-sec.10" guid="_b9339e69-d24d-4313-8588-2d578edcb639" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.3-sec.10-he" guid="_a22cb695-f8f2-44af-ac91-db1ee5cb26a0">Requirements for applications</heading><subclause id="sec.3-sec.10-ssec.1" guid="_292d27be-ba23-4a83-af19-20676aebe545" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An application for assistance under the scheme must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.10-ssec.1-para1.a" guid="_5f1609c4-fef3-4d7b-807f-21359f2c7f2e" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">be made in the form approved by the authority; and</txt></block></li><li id="sec.3-sec.10-ssec.1-para1.b" guid="_3fe14645-39d8-4b47-828b-44dba29e3fdd" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">be accompanied by the following documents—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.10-ssec.1-para1.b-para2.i" guid="_f6edd9ee-21bc-484c-bfdd-be0e0c04ec2a" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a copy of a flood management plan for the primary production enterprise;</txt></block></li><li id="sec.3-sec.10-ssec.1-para1.b-para2.ii" guid="_708ba404-da55-4408-883c-daa3a653546e" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a copy of the confirmation mentioned in section 8(1)(f);</txt></block></li><li id="sec.3-sec.10-ssec.1-para1.b-para2.iii" guid="_4c6bb56b-8828-4787-b8b2-c56d524d1c1a" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">a copy of the tax invoice for the eligible professional advice for the primary production enterprise to which the application for assistance under the scheme relates;</txt></block></li><li id="sec.3-sec.10-ssec.1-para1.b-para2.iv" guid="_442be842-cc7e-4dbf-b896-bafffd46456f" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">an official receipt showing the applicant has paid the tax invoice;</txt></block></li><li id="sec.3-sec.10-ssec.1-para1.b-para2.v" guid="_2b28f424-1c30-4c92-a92e-efdfd1c8630a" provision.type="other" affected.by.uncommenced="0"><no>(v)</no><block><txt break.before="0">any other documents stated in the form; and</txt></block></li></list></block></li><li id="sec.3-sec.10-ssec.1-para1.c" guid="_6541005a-acce-4ec2-82bc-e791067fbfc9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">be received by the authority while the scheme is open under section 9.</txt></block></li></list></block></subclause><subclause id="sec.3-sec.10-ssec.2" guid="_a70c0dc1-408c-4363-8530-77bd790459d3" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the authority asks the applicant to provide further information to decide the application, the applicant must provide the information.</txt></block></subclause><subclause id="sec.3-sec.10-ssec.3" guid="_70214364-0b41-4c02-8834-aab1c44a538a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-sec.10-ssec.3-def.officialreceipt_" guid="_dc4e55d1-01be-431b-be13-eb3846e3ff8e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-sec.10-ssec.3-def.officialreceipt" guid="_c8f1061b-f029-4673-a428-452fc5b14d9d" type="definition">official receipt</defterm> means a receipt that includes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-sec.10-ssec.3-def.officialreceipt-para1.a" guid="_2f7c3591-e61f-4cce-abbb-9ff9efdca671" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the name and address of the entity that issued the receipt; and</txt></block></li><li id="sec.3-sec.10-ssec.3-def.officialreceipt-para1.b" guid="_2236c668-6aac-4a19-95a2-843a92a421db" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the entity’s Australian Business Number; and</txt></block></li><li id="sec.3-sec.10-ssec.3-def.officialreceipt-para1.c" guid="_0596b3d1-555b-412d-9429-244002ce96ca" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">a description of each item to which the receipt relates; and</txt></block></li><li id="sec.3-sec.10-ssec.3-def.officialreceipt-para1.d" guid="_703ef64c-84de-4341-835e-ca8f9b664b6c" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the date the amount to which the receipt relates was paid.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.3-sec.11" guid="_9fa54672-2d10-4e94-b60a-f3cc3081e279" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.3-sec.11-he" guid="_c6de1612-1547-4488-8f6f-5143ed4fe225">Deciding applications</heading><subclause id="sec.3-sec.11-ssec.1" guid="_f1a19617-c548-43c1-8ac1-5d4f3e21b443" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The authority must consider each application for assistance under the scheme that complies with section 10(1) and decide to approve, or refuse to approve, the application.</txt></block></subclause><subclause id="sec.3-sec.11-ssec.2" guid="_c750fdc7-3b41-44e5-b43d-2e429946074f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The authority must consider applications in the order they are received by the authority.</txt></block></subclause><subclause id="sec.3-sec.11-ssec.3" guid="_2eeabd19-acf1-402a-a954-9d161a7f02b2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The authority must refuse to approve an application if the authority’s assistance funds for the scheme are not sufficient to pay for the assistance.</txt></block></subclause><subclause id="sec.3-sec.11-ssec.4" guid="_99264b11-c733-4406-8692-21c2867c72c2" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the authority refuses to approve an application, the authority must give the applicant written notice of the
