provision.type="other"><no>(i)</no><block><txt break.before="0">no relevant overlay applies to the premises;</txt></block></li><li id="sec.5-ssec.1-frag-para1.c-para2.ii" guid="_c538d409-9a2d-4974-b11e-973ab714077b" provision.type="other"><no>(ii)</no><block><txt break.before="0">only an overlay about bush fire hazards applies to the premises and the premises are less number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.4-para1.a" guid="_b145a124-a850-47f0-ab4c-0431d94736f8" provision.type="other"><no>(a)</no><block><txt break.before="0">the material change of use—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.4-para1.a-para2.i" guid="_d67670d4-d07a-4879-a62e-2193eb80641d" provision.type="other"><no>(i)</no><block><txt break.before="0">does not involve the carrying out of building work; or</txt></block></li><li id="sec.5-ssec.2-frag-ssec.4-para1.a-para2.ii" guid="_e47ddee1-043f-459b-90e3-1ba5aef39248" provision.type="other"><no>(ii)</no><block><txt break.before="0">involves the carrying out of minor building work only; and</txt></block></li></list></block></li><li id="sec.5-ssec.2-frag-ssec.4-para1.b" guid="_3c5ca363-e62b-4fac-a468-ca357fadf443" provision.type="other"><no>(b)</no><block><txt break.before="0">the premises are included in a general residential zone, low density residential zone or low-medium density residential zone under a local categorising instrument; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.4-para1.c" guid="_b9a21e08-0e10-4df9-896b-1906dc303905" provision.type="other"><no>(c)</no><block><txt break.before="0">the material change of use does not create new vehicular access to a State-controlled road; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.4-para1.d" guid="_9762776d-ce9c-41d1-9443-fe2b14649d44" provision.type="other"><no>(d)</no><block><txt break.before="0">the premises— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.4-para1.d-para2.i" guid="_1fb8234f-69e0-486a-a818-2ceecc272279" provision.type="other"><no>(i)</no><block><txt break.before="0">have no more than 5 bedrooms, including any bedroom used as part of a manager’s residence; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.4-para1.d-para2.ii" guid="_d3b99510-80aa-4c25-af9e-b3406310344c" provision.type="other"><no>(ii)</no><block><txt break.before="0">are occupied by no more than 5 persons; and</txt></block></li></list></block></li><li id="sec.5-ssec.2-frag-ssec.4-para1.e" guid="_bf4ae69c-a87a-4a1e-8bb0-432cf9bdcfa1" provision.type="other"><no>(e)</no><block><txt break.before="0">either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.4-para1.e-para2.i" guid="_b8d5b5cc-bad3-45f7-bc8c-bb582a0ebff0" provision.type="other"><no>(i)</no><block><txt break.before="0">no overlay about bush fire hazards, coastal hazards, flood hazards or landslide hazards applies to the premises; or</txt></block></li><li id="sec.5-ssec.2-frag-ssec.4-para1.e-para2.ii" guid="_d3d727c3-6b24-4eed-a41f-c48c883460b0" provision.type="other"><no>(ii)</no><block><txt break.before="0">an overlay about bush fire hazards, coastal hazards, flood hazards or landslide hazards applies to the premises and the application of the overlay does not result in the material change of use being categorised as assessable development.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-ssec.2-frag-ssec.5" guid="_52be9e5a-e277-45f2-a66a-4d550aed5495" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">A material change of use of premises for a class 1 building for rooming accommodation, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.5-para1.a" guid="_035dd4bf-0b04-4f80-a8de-2d7eddce147b" provision.type="other"><no>(a)</no><block><txt break.before="0">the material change of use involves the carrying out of building work other than minor building work; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.b" guid="_f4fa880f-6f16-47c3-9533-e65e8ca9fd71" provision.type="other"><no>(b)</no><block><txt break.before="0">the premises are included in a general residential zone, low density residential zone or low-medium density residential zone under a local categorising instrument; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.c" guid="_fa5a906b-84fa-48ab-b6fa-534a3d9e7607" provision.type="other"><no>(c)</no><block><txt break.before="0">the material change of use does not create new vehicular access to a State-controlled road; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.d" guid="_07c6c595-1bfc-42a2-a4bf-2f4bf3379695" provision.type="other"><no>(d)</no><block><txt break.before="0">the premises—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.5-para1.d-para2.i" guid="_a05b05fc-6672-4483-aee7-4ffdd727546a" provision.type="other"><no>(i)</no><block><txt break.before="0">have no more than 5 bedrooms, including any bedroom used as part of a manager’s residence; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.d-para2.ii" guid="_31b3d1cc-1c4a-4ce1-986e-e2413b3fb411" provision.type="other"><no>(ii)</no><block><txt break.before="0">are occupied by no more than 5 persons; and</txt></block></li></list></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.e" guid="_a101f9c3-ec65-4453-a398-7504fb364e98" provision.type="other"><no>(e)</no><block><txt break.before="0">either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.5-para1.e-para2.i" guid="_2497f0fe-3f86-4954-9ed9-ea6613419dc3" provision.type="other"><no>(i)</no><block><txt break.before="0">no relevant overlay applies to the premises; or</txt></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.e-para2.ii" guid="_a2745637-a14d-41a4-9ea0-55add38f1c63" provision.type="other"><no>(ii)</no><block><txt break.before="0">a relevant overlay applies to the premises and the application of the overlay does not result in the material change of use being categorised as assessable development; and</txt></block></li></list></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.f" guid="_d8beb4b3-fbb4-4227-925f-e0abaaa27501" provision.type="other"><no>(f)</no><block><txt break.before="0">the material change of use does not involve a basement or an underground parking area; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.g" guid="_062f2ab5-3561-42bc-a659-c2860fd446e7" provision.type="other"><no>(g)</no><block><txt break.before="0">the premises are not on a local heritage register under the <legref target.doc.id="act-1992-009" target.version.series="d72eb13a-6f43-48b9-b79e-7f64dfa7f9b2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Queensland Heritage Act 1992</name></legref>; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.5-para1.h" guid="_aeaacc22-91c2-4cdc-b2f5-06caba6d9e96" provision.type="other"><no>(h)</no><block><txt break.before="0">the material change of use provides landscaping between a building that is on the premises and the front boundary of the premises, excluding any driveway or pedestrian access.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2-frag-ssec.6" guid="_574cadf3-d9de-472b-9256-c13c77ebc5bc" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">In this section—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.6-para1.a" guid="_a70b030d-2356-493e-96c7-1a7f2187cfd2" provision.type="other"><no>(a)</no><block><txt break.before="0">a reference to a zone using a particular name is taken to be a reference to the zone of that name stated in schedule 2; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.6-para1.b" guid="_fdc95fe1-0750-44ad-9d64-7a8c1a38d809" provision.type="other"><no>(b)</no><block><txt break.before="0">a reference to an overlay is a reference to the overlay as identified in the local categorising instrument and relevant to assessment of the material change of use.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.2-frag-ssec.7" guid="_435b6741-30e5-4eb5-bcc9-7f02434359c9" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-ssec.2-frag-ssec.7-def.landscaping_" guid="_b85a5e8f-05b7-4414-b52f-8bbb7ab646cd" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.2-frag-ssec.7-def.landscaping" guid="_4d1b6171-d53f-4c3d-a76c-58bff7fd92cb" type="definition">landscaping</defterm> means any combination of trees, grass, plants, garden beds and paving.</txt></definition><definition id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay_" guid="_060d67af-2bea-4c59-aaae-a96e766407d9" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay" guid="_ba88b2da-806d-4a80-b410-586818f88f45" type="definition">relevant overlay</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay-para1.a" guid="_8fd76e69-2664-4f39-8530-79a80bb66f8a" provision.type="other"><no>(a)</no><block><txt break.before="0">an overlay, or part of an overlay, that is about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay-para1.a-para2.i" guid="_d11fa48b-c96b-41f4-8138-be4e32d0aa1f" provision.type="other"><no>(i)</no><block><txt break.before="0">bush fire hazards, coastal hazards, flood hazards or landslide hazards; or</txt></block></li><li id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay-para1.a-para2.ii" guid="_4be59547-33ec-44b1-868d-70061b182bf1" provision.type="other"><no>(ii)</no><block><txt break.before="0">safety hazards arising from historic mining activities, including, for example, mining subsidence and mining contamination; or</txt></block></li></list></block></li><li id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay-para1.b" guid="_7196372f-d7af-401a-9c88-a30cdf992bab" provision.type="other"><no>(b)</no><block><txt break.before="0">an overlay, or part of an overlay, that includes an overlay code and is about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay-para1.b-para2.i" guid="_516f6e32-4033-431b-b21e-fc149eb23252" provision.type="other"><no>(i)</no><block><txt break.before="0">development of a local heritage place; or</txt></block></li><li id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay-para1.b-para2.ii" guid="_760bc555-7d18-44ab-a151-9a2b0c98dd7e" provision.type="other"><no>(ii)</no><block><txt break.before="0">development in a place with traditional building character; or</txt></block></li><li id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay-para1.b-para2.iii" guid="_a52205f3-1d75-4763-a04f-3325facd0b40" provision.type="other"><no>(iii)</no><block><txt break.before="0">the protection of areas of natural, environmental or ecological significance, including the protection of the biodiversity, significant animals and plants, wetlands and waterways of such areas; or</txt></block></li><li id="sec.5-ssec.2-frag-ssec.7-def.relevantoverlay-para1.b-para2.iv" guid="_eba01166-cf1d-47d4-926d-23c5151d38e7" provision.type="other"><no>(iv)</no><block><txt break.before="0">development within an area identified on a map titled ‘ANEF’ on the State Planning Policy Interactive Mapping System.</txt></block></li></list></block></li></list></definition></deflist><note id="sec.5-ssec.2-frag-ssec.7-note" guid="_4c2ef044-f8f0-4e83-a281-88f0250cfb0a" type="example"><heading id="sec.5-ssec.2-frag-ssec.7-note-he" guid="_226fed43-a167-4ddf-9337-d4f86748eae4">Note—</heading><block><txt break.before="1">Section 16(2) of the regulation provides for the expiry of particular provisions of this section.</txt></block></note></block></subclause></fragment></block></subclause></clause></body></wrapper></subordleg>
