or</txt></block></li><li id="sec.4-frag-div.11-sec.55A-para1.a-para2.ii" guid="_0e6c5c62-d1af-4778-935b-0f5c246e5c91" provision.type="other"><no>(ii)</no><block><txt break.before="0">a work environment; or</txt></block></li><li id="sec.4-frag-div.11-sec.55A-para1.a-para2.iii" guid="_a933604e-11a6-4008-9a09-30e7b2938302" provision.type="other"><no>(iii)</no><block><txt break.before="0">plant at a workplace; or</txt></block></li><li id="sec.4-frag-div.11-sec.55A-para1.a-para2.iv" guid="_c6792f77-60c2-46ac-9396-26fa7bcbee6d" provision.type="other"><no>(iv)</no><block><txt break.before="0">workplace interactions or behaviours; and</txt></block></li></list></block></li><li id="sec.4-frag-div.11-sec.55A-para1.b" guid="_5218187e-089e-4a6e-97fc-72d3e345fdfc" provision.type="other"><no>(b)</no><block><txt break.before="0">may cause psychological harm, whether or not the hazard may also cause physical harm.</txt></block></li></list></block></clause><clause id="sec.4-frag-div.11-sec.55B" guid="_2e4d57cc-c833-4776-a455-69dbf20613e3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>55B</no><heading id="sec.4-frag-div.11-sec.55B-he" guid="_32fed5b5-f3c3-4737-9e04-71e346d78a5e">Meaning of <defterm id="sec.4-frag-div.11-sec.55B-def.psychosocialrisk" guid="_8f0465af-167f-4852-8b75-eacfa9be083e" type="definition">psychosocial risk</defterm></heading><block><txt break.before="1">A <defterm id="sec.4-frag-div.11-def.psychosocialrisk" guid="_2a6089cc-87eb-4a40-b354-85f6b0b0ee4c" type="definition">psychosocial risk</defterm> is a risk to the health or safety of a worker or other person from a psychosocial hazard.</txt></block></clause><clause id="sec.4-frag-div.11-sec.55C" guid="_77aec184-416c-479b-8a04-bbbf77c3fad9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>55C </no><heading id="sec.4-frag-div.11-sec.55C-he" guid="_f61fa53a-e033-4510-87bc-924c90b7566b">Duty to manage psychosocial risks</heading><block><txt break.before="0">A person conducting a business or undertaking must manage psychosocial risks under part 3.1.</txt><note id="sec.4-frag-div.11-sec.55C-note" guid="_4311a3dd-bf6e-4356-9e34-b11456d18580" type="example"><heading id="sec.4-frag-div.11-sec.55C-note-he" guid="_e800e7b5-9714-4e1d-be32-fd5512c113f6">Notes—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.11-sec.55C-note-para1.1" guid="_35e7dede-52f8-4f1e-a598-dfc99a1ca8e0" provision.type="other"><no>1</no><block><txt break.before="0">WHS Act—section 19 (see section 9).</txt></block></li><li id="sec.4-frag-div.11-sec.55C-note-para1.2" guid="_323440b0-cc63-443a-b588-d7bfedab1a44" provision.type="other"><no>2</no><block><txt break.before="0">For general risk management requirements, see part 3.1. </txt></block></li></list></block></note></block></clause><clause id="sec.4-frag-div.11-sec.55D" guid="_d993c4f1-aad9-458c-a1de-33981ff8d736" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>55D</no><heading id="sec.4-frag-div.11-sec.55D-he" guid="_a1e65866-ab55-4643-98e3-bab5a1de57eb">Determining control measures for psychosocial risks</heading><subclause id="sec.4-frag-div.11-sec.55D-ssec.1" guid="_915309c2-7648-49c9-a564-2fc396d4a937" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a person conducting a business or undertaking who implements control measures to manage psychosocial risks under part 3.1.</txt></block></subclause><subclause id="sec.4-frag-div.11-sec.55D-ssec.2" guid="_99fc6cec-241a-4baf-9be5-f9a9e91f708e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In determining the control measures to implement, the person conducting the business or undertaking must have regard to all relevant matters, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.a" guid="_f4577192-4812-4aef-bd91-e3885467d2c4" provision.type="other"><no>(a)</no><block><txt break.before="0">the duration, frequency or severity of the exposure of workers and other persons to psychosocial hazards; and</txt></block></li><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.b" guid="_a891281a-87be-419c-98b9-e6ae6d5daaa7" provision.type="other"><no>(b)</no><block><txt break.before="0">how the psychosocial hazards may interact or combine; and</txt></block></li><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.c" guid="_96fdfd02-f6d2-4cc5-a9cf-6f3903a12e52" provision.type="other"><no>(c)</no><block><txt break.before="0">the design of work, including job demands and tasks; and</txt></block></li><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.d" guid="_70a8345d-fe9a-48cf-8377-7d0b07e86ff6" provision.type="other"><no>(d)</no><block><txt break.before="0">the systems of work, including how work is managed, organised and supported; and</txt></block></li><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.e" guid="_98106ecc-1d76-405d-997d-f0023a89744b" provision.type="other"><no>(e)</no><block><txt break.before="0">the design and layout, and environmental conditions, of the workplace, including the provision of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.e-para2.i" guid="_b6a36356-5f68-44bf-b55e-0968adc67a4e" provision.type="other"><no>(i)</no><block><txt break.before="0">safe means of entering and exiting the workplace; and</txt></block></li><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.e-para2.ii" guid="_7d5de68b-8a36-4603-9a3a-278399a98b55" provision.type="other"><no>(ii)</no><block><txt break.before="0">facilities for the welfare of workers; and</txt></block></li></list></block></li><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.f" guid="_7a69c934-c100-4a90-b5db-d4f64c266d81" provision.type="other"><no>(f)</no><block><txt break.before="0">the design and layout, and environmental conditions, of workers’ accommodation; and</txt></block></li><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.g" guid="_3b095426-1e1e-4f9c-a0d0-592b224470a1" provision.type="other"><no>(g)</no><block><txt break.before="0">the plant, substances and structures at the workplace; and</txt></block></li><li id="sec.4-frag-div.11-sec.55D-ssec.2-para1.h" guid="_334549d0-4bf4-4c85-a973-0cf912e0ddea" provision.type="other"><no>(h)</no><block><txt break.before="0">workplace interactions or behaviours;
