or</txt></block></li><li id="sec.3-frag-sec.448B-ssec.2-para1.b" guid="_ae3b083a-d7ac-4049-a8f9-b6ecff4992d7" provision.type="other"><no>(b)</no><block><txt break.before="0">the exhibit being required for the court’s use.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-sec.448B-ssec.3" guid="_30316d6e-ebff-43bc-8cb7-36f8f66b8d54" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Also, a party to a proceeding may apply to the court for an order permitting the applicant to do 1 or more of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-sec.448B-ssec.3-para1.a" guid="_1f9261ac-0878-44ae-81fd-c6925345252f" provision.type="other"><no>(a)</no><block><txt break.before="0">inspect an exhibit; </txt></block></li><li id="sec.3-frag-sec.448B-ssec.3-para1.b" guid="_574efa4f-d9a9-4857-a34a-6b0e02a2fcb9" provision.type="other"><no>(b)</no><block><txt break.before="0">obtain a copy of an exhibit that is a document;</txt></block></li><li id="sec.3-frag-sec.448B-ssec.3-para1.c" guid="_ce535b8e-d96f-4e28-bea5-b876e1dc07ee" provision.type="other"><no>(c)</no><block><txt break.before="0">take a photograph of an exhibit that is not a document.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-sec.448B-ssec.4" guid="_293be4a2-7f06-45e2-8aeb-3a199222e9d5" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The court may, on the application, make the orders and give the directions it considers appropriate in relation to the exhibit.</txt></block></subclause></clause><clause id="sec.3-frag-sec.448C" guid="_9dda6994-434b-470a-9d78-a66a62c63ec9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>448C </no><heading id="sec.3-frag-sec.448C-he" guid="_5d97d429-e296-4a94-ae26-b6bde10c291b">Access to exhibits by non-parties</heading><subclause id="sec.3-frag-sec.448C-ssec.1" guid="_1e54548c-4d65-4466-bc2b-6864116b083f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person who is not a party to a proceeding may apply to the court for an order permitting the applicant to do 1 or more of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-sec.448C-ssec.1-para1.a" guid="_bebe7b70-6796-4772-b92c-365a5cb5c75b" provision.type="other"><no>(a)</no><block><txt break.before="0">inspect an exhibit;</txt></block></li><li id="sec.3-frag-sec.448C-ssec.1-para1.b" guid="_5dacbdcd-8f99-40f2-a095-5e2effa9c350" provision.type="other"><no>(b)</no><block><txt break.before="0">obtain a copy of an exhibit that is a document;</txt></block></li><li id="sec.3-frag-sec.448C-ssec.1-para1.c" guid="_f7289051-9080-4e17-a0d2-0d576822f365" provision.type="other"><no>(c)</no><block><txt break.before="0">take a photograph of an exhibit that is not a document.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-sec.448C-ssec.2" guid="_c4c5a6e6-660b-41e7-9161-53c0f094a8b8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The application must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-sec.448C-ssec.2-para1.a" guid="_986dcd17-edc9-48fb-a103-577a1b0f0144" provision.type="other"><no>(a)</no><block><txt break.before="0">identify the exhibit the subject of the application; and</txt></block></li><li id="sec.3-frag-sec.448C-ssec.2-para1.b" guid="_020e7c63-91bc-4057-b73b-e894ac307be4" provision.type="other"><no>(b)</no><block><txt break.before="0">be filed in the proceeding in which the exhibit was tendered; and</txt></block></li><li id="sec.3-frag-sec.448C-ssec.2-para1.c" guid="_d8a98afa-1d10-431b-b51e-65c5947b237d" provision.type="other"><no>(c)</no><block><txt break.before="0">be supported by an affidavit stating—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-sec.448C-ssec.2-para1.c-para2.i" guid="_377c53b8-bcf0-4462-9402-6c19014eb9c2" provision.type="other"><no>(i)</no><block><txt break.before="0">the reason why the order is sought; and</txt></block></li><li id="sec.3-frag-sec.448C-ssec.2-para1.c-para2.ii" guid="_3c5f36ff-63a9-4857-a95c-ad544adb3768" provision.type="other"><no>(ii)</no><block><txt break.before="0">the use the applicant intends to make of the exhibit, including whether the applicant intends to publish, or otherwise communicate, the exhibit or its subject matter.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.3-frag-sec.448C-ssec.3" guid="_f404a718-8cd2-443f-aa36-d9a5efb56fd4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Also, unless the court orders otherwise, the application and the supporting affidavit must be served on—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-sec.448C-ssec.3-para1.a" guid="_e943a2fe-399b-4e83-962e-4ab7b26fb021" provision.type="other"><no>(a)</no><block><txt break.before="0">each party to the proceeding in which the exhibit was tendered; and</txt></block></li><li id="sec.3-frag-sec.448C-ssec.3-para1.b" guid="_08384c07-513d-4220-8e3b-ff2888073d27" provision.type="other"><no>(b)</no><block><txt break.before="0">any other person the applicant has reasonable grounds to believe would be directly affected by the order sought.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-sec.448C-ssec.4" guid="_66064f20-5503-4615-9de6-282b5f2cae46" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The court may, on the application, make the orders and give the directions it considers appropriate in relation to the exhibit, including, for example, an order imposing a condition restricting the nature and extent of any publication or other use of the exhibit or its subject matter.</txt></block></subclause><subclause id="sec.3-frag-sec.448C-ssec.5" guid="_d56f179f-f429-4a2b-b8ec-55fce072adef" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In deciding whether to make an order under subrule (4), the court may have regard to the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-frag-sec.448C-ssec.5-para1.a" guid="_6a1c146c-895f-435e-aad9-ff376783ca65" provision.type="other"><no>(a)</no><block><txt break.before="0">whether inspection of the exhibit may help the applicant provide a fair and accurate report of the proceeding;</txt></block></li><li id="sec.3-frag-sec.448C-ssec.5-para1.b" guid="_a5c7426d-e23e-454f-bac1-7132ce1ecec4" provision.type="other"><no>(b)</no><block><txt break.before="0">whether access to the exhibit enables the business of the court to be seen to be conducted in open court;</txt></block></li><li id="sec.3-frag-sec.448C-ssec.5-para1.c" guid="_f5b89e3d-1607-42bd-ae3a-3ed9d524e882" provision.type="other"><no>(c)</no><block><txt break.before="0">whether access to the exhibit is otherwise in, or contrary to, the public interest or the interests of justice.</txt></block></li></list></block></subclause><subclause id="sec.3-frag-sec.448C-ssec.6" guid="_bc828567-a3a6-4b9b-9cfc-da2ec3f1cde2" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">Unless the court orders otherwise, an order made under this rule permitting the exhibit to be inspected, copied or photographed is stayed until any prescribed fee for that purpose is paid.</txt></block></subclause></clause></fragment></block></clause></body></wrapper></subordleg>
