jurisd="QLD"><name emphasis="no">Uniform Civil Procedure Rules&#160;1999</name></legref></heading><subclause id="sec.3-ssec.1" guid="_cf668b80-7a8c-4c8d-b782-b83efb7593fd" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If these rules, an order or a direction do not provide for a matter in relation to a proceeding in the court and the uniform rules provide for the matter, the uniform rules apply in relation to the matter with necessary changes.</txt></block></subclause><subclause id="sec.3-ssec.2" guid="_c4565347-29ba-401c-8d91-caa9af030280" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For <intref refid="sec.3-ssec.1" target.guid="_cf668b80-7a8c-4c8d-b782-b83efb7593fd" id="sec.3-ssec.2-para1.b" guid="_e873da54-e377-43af-9778-4a061229a583" provision.type="other"><no>(b)</no><block><txt break.before="0">a notice of appeal under these rules is to be treated as if it break.before="0">a document that starts a recommendatory proceeding under these rules is to be treated as if it were an application for a statutory order of review under the uniform provision.type="other"><no>(4)</no><block><txt break.before="0">For the uniform rules, <intref refid="ch.22" check="invalid">chapter&#160;22</intref>, <intref refid="ch.22-pt.3" check="invalid">part&#160;3</intref>, a reference to a solicitor is taken to be a reference to a solicitor or agent.</txt></block></subclause></clause><clause id="sec.4" guid="_8953dc82-defd-40b2-ab47-829295041a75" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_14a6f4c7-2bb3-4d53-8f1d-96696c70043e">Main purposes of rules</heading><block><txt break.before="0">The main purposes of these rules are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-para1.a" guid="_ce987dfe-b2a2-43a7-8a42-c053dbbd57e0" provision.type="other"><no>(a)</no><block><txt break.before="0">to ensure that when the court performs a function under an Act, including applying these rules, the court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-para1.a-para2.i" guid="_2af71c8e-1cf7-4d65-8215-0a69ce1ae9ab" provision.type="other"><no>(i)</no><block><txt break.before="0">facilitates the just and quick resolution of the issues in a proceeding; and</txt></block></li><li id="sec.4-para1.a-para2.ii" guid="_2ed7f675-faf2-43b9-ac51-20e55a1c9851" provision.type="other"><no>(ii)</no><block><txt break.before="0">avoids undue delay, expense and technicality in a proceeding; and</txt></block></li></list></block></li><li id="sec.4-para1.b" guid="_2bd71c40-15fe-4eb0-8460-a37b0ca7c4af" provision.type="other"><no>(b)</no><block><txt break.before="0">to ensure that a party to a proceeding undertakes to the court and to each other party to the proceeding to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-para1.b-para2.i" guid="_e8b41b3f-b7b9-43ec-9780-f100ca3fded1" provision.type="other"><no>(i)</no><block><txt break.before="0">participate in the proceeding in an expeditious way; and </txt></block></li><li id="sec.4-para1.b-para2.ii" guid="_fe6720da-c1ef-4375-b38b-a62c820ebf64" provision.type="other"><no>(ii)</no><block><txt break.before="0">comply with these rules and any order or direction made by the court in relation to the proceeding.</txt></block></li></list></block></li></list></block></clause><clause id="sec.5" guid="_2f9b2439-4c02-4234-ac20-7761f7091263" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_16a2012e-cdb4-4c42-ad66-d3359fad7a22">Definitions</heading><block><txt break.before="1">The dictionary in <intref refid="sch.1" target.guid="_771dbd81-cefb-4dff-84cb-2db291e5257d" check="valid">schedule&#160;1</intref> defines particular words used in these rules.</txt></block></clause></part><part id="pt.2" guid="_ac60677a-5063-4e03-9e12-aa2db4d575d8" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_34c30e92-b59b-4663-b2c8-46da61b84939">Starting proceedings</heading><clause id="sec.6" guid="_91d34cef-d67a-41c8-9b59-200fbee27926" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_30e7803b-739e-44af-8b46-3ac3706b1832">Starting proceeding</heading><block><txt break.before="0">A proceeding in the court is started by filing an originating process in the registry.</txt></block></clause><clause id="sec.7" guid="_43947711-c6b3-4e18-9d99-2c865c4ed01d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_194ff64d-a5ee-40f9-a20f-cd01ebb148b3">Originating process</heading><subclause id="sec.7-ssec.1" guid="_2f2acd3c-5296-4d47-9afe-eb8b3fa9ddd7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An originating process for a proceeding must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_2a555f66-f458-4174-96b7-78690dc62071" provision.type="other"><no>(a)</no><block><txt break.before="0">be in the approved form; and </txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_0ad2e566-11bd-4b97-862d-7218f54bacdc" provision.type="other"><no>(b)</no><block><txt break.before="0">state—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.b-para2.i" guid="_a0c04d3e-1a6d-44ca-9b8c-308ffa196ecb" provision.type="other"><no>(i)</no><block><txt break.before="0">the name of the respondent; and</txt></block></li><li id="sec.7-ssec.1-para1.b-para2.ii" guid="_ea1a3d2f-83d2-4716-95d7-c62e5b6452d5" provision.type="other"><no>(ii)</no><block><txt break.before="0">the relevant entity’s address for service; and</txt></block></li></list></block></li><li id="sec.7-ssec.1-para1.c" guid="_12c62629-a864-4f05-afcd-2001b24298f3" provision.type="other"><no>(c)</no><block><txt break.before="0">be signed by the relevant entity; and</txt></block></li><li id="sec.7-ssec.1-para1.d" guid="_1b63ea04-eee1-494b-8866-417fd3bcb257" provision.type="other"><no>(d)</no><block><txt break.before="0">comply with any requirements of the <legref type="subordleg" check="invalid" jurisd="QLD">Act</legref> giving jurisdiction for the proceeding to the court.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_10f3bd2a-4968-4d9d-a9ad-e09abe91552e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If at any time after filing the originating process the relevant entity’s address for service changes, the entity must file and serve a notice of the change of address in the approved form on each other party to the proceeding.</txt></block></subclause><subclause id="sec.7-ssec.3" guid="_6a8d93aa-e788-4a95-96ee-0e3073677496" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this rule—</txt><deflist><definition id="sec.7-ssec.3-def.addressforservice_" guid="_b4ddcdd0-7cbd-4ffc-b858-201242a6b43c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.3-def.addressforservice" guid="_466e253a-16d2-4502-b156-43cb965f4714" type="definition">address for service</defterm>, of a relevant entity, means the relevant entity’s residential or business address.</txt></definition><definition id="sec.7-ssec.3-def.relevantentity_" guid="_c2287b0d-84f2-4be3-a876-3005da707fec" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.3-def.relevantentity" guid="_2dd806b7-288e-4088-b86c-7beef53fc07e" type="definition">relevant entity</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.3-def.relevantentity-para1.a" guid="_76c5559e-0620-459e-819b-cbe070ac3968" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant or appellant who files the originating process; or</txt></block></li><li id="sec.7-ssec.3-def.relevantentity-para1.b" guid="_84eeb295-3cbb-4f1a-a9cd-421dcacf5126" provision.type="other"><no>(b)</no><block><txt break.before="0">if the applicant or appellant is represented by a lawyer or agent—the lawyer or agent who files the originating directions</heading><clause id="sec.9" guid="_80153078-97cf-4630-b6dc-a10f7696a75c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_61b11ca1-1c5d-44d2-8a64-c716f34610c0">Directions hearing</heading><block><txt break.before="0">At any time after an originating process is filed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-para1.a" guid="_d549ed8a-164a-4529-a7dd-9768c4fca86e" provision.type="other"><no>(a)</no><block><txt break.before="0">any party may apply to the court for a hearing (a <defterm id="sec.9-def.directionshearing" guid="_8c31d58d-24c3-4079-84c6-bdfe9cef27b7" type="definition">directions hearing</defterm>) about an order or directions about the proceeding; or</txt></block></li><li id="sec.9-para1.b" guid="_3c15a1eb-35ba-40e5-a43e-2eb74ee0230a" provision.type="other"><no>(b)</no><block><txt break.before="0">the court may order the parties to attend a directions hearing.</txt></block></li></list></block></clause><clause id="sec.10" guid="_9173ad3e-55b2-48c6-befc-6c1bcd5d7522" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_3c3042f4-d35e-4ae4-a293-b795d0e86e4d">Compliance with rules, orders and directions</heading><subclause id="sec.10-ssec.1" guid="_c51791d3-52e6-4b52-98c4-eb3a588ec923" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This rule applies if a party to a proceeding does not comply with a rule or an order or a direction made by the court.</txt></block></subclause><subclause id="sec.10-ssec.2" guid="_53aeafe9-ec94-48aa-b42b-95d446cc5df6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The court may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.a" guid="_2174b4c0-bcfb-4ca0-8467-e9537e3e9f04" provision.type="other"><no>(a)</no><block><txt break.before="0">waive compliance with the rule, order or direction, or excuse non-compliance with the rule, order or direction, if the court considers compliance would be likely to cause injustice, unreasonable expense or inconvenience; or</txt></block></li><li id="sec.10-ssec.2-para1.b" guid="_88b0ec13-7e26-4e33-b08b-4943b8fa6e0d" provision.type="other"><no>(b)</no><block><txt break.before="0">extend time for compliance with the rule, order or direction; or</txt></block></li><li id="sec.10-ssec.2-para1.c" guid="_ee53a99e-97e0-4840-b366-0c80b459cf77" provision.type="other"><no>(c)</no><block><txt break.before="0">give directions; or</txt></block></li><li id="sec.10-ssec.2-para1.d" guid="_bcd4ae67-bc9a-43bd-acac-a79a29fb17b5" provision.type="other"><no>(d)</no><block><txt break.before="0">make another order.</txt></block></li></list></block></subclause></clause><clause id="sec.11" guid="_8ac777f1-45eb-46d8-b6eb-d900d5c85893" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_3876f0bc-9854-4cd3-83ed-0d8c4b379bd6">Restriction orders</heading><subclause id="sec.11-ssec.1" guid="_b5edc369-528a-4a71-ae07-49ec2f33a198" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A party to a proceeding may apply to the court in writing for an order (a <defterm id="sec.11-def.restrictionorder" guid="_9919fdf3-cbcb-4953-b296-fb5cd817c529" type="definition">restriction order</defterm>) restricting access to a document, or part of a document, in the proceeding.</txt></block></subclause><subclause id="sec.11-ssec.2" guid="_ed3df6ad-8b87-4de8-8479-0e69b8790a77" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An application made under <intref refid="sec.11-ssec.1" target.guid="_b5edc369-528a-4a71-ae07-49ec2f33a198" check="valid">subrule&#160;(1)</intref> must state the following information—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.a" guid="_28653ebd-694f-436a-858a-18b947a972a9" provision.type="other"><no>(a)</no><block><txt break.before="0">the document, or the part of a document, that the party wants to be subject to the restriction order; </txt></block></li><li id="sec.11-ssec.2-para1.b" guid="_984709fb-03c5-489b-9df2-1bd0c985be9e" provision.type="other"><no>(b)</no><block><txt break.before="0">the proposed terms of the order; </txt></block></li><li id="sec.11-ssec.2-para1.c" guid="_6c36fd81-3aab-4ae4-82eb-881bfbfb8a4c" provision.type="other"><no>(c)</no><block><txt break.before="0">why the party is applying for the order; </txt></block></li><li id="sec.11-ssec.2-para1.d" guid="_53d16d68-2c91-4a03-86a0-8183d7472d56" provision.type="other"><no>(d)</no><block><txt break.before="0">why it is in the interests of justice for the court to make the order;</txt></block></li><li id="sec.11-ssec.2-para1.e" guid="_41ef2f56-d5c1-4066-a3a2-71114e91d384" provision.type="other"><no>(e)</no><block><txt guid="_8e053543-09ea-4368-905a-56bb28ca1b97">Expert</heading><block><txt break.before="1">An expert may be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-para1.a" guid="_60aca069-c302-4c4f-afa7-8f451c7b6843" provision.type="other"><no>(a)</no><block><txt break.before="0">engaged to give evidence by 1 or more parties to a proceeding; or</txt></block></li><li id="sec.18-para1.b" guid="_64bd47ed-a368-4145-88d5-f0b85d9ea516" provision.type="other"><no>(b)</no><block><txt break.before="0">after hearing from the parties to a proceeding—nominated by the court to give evidence in the proceeding.</txt></block></li></list></block></clause><clause id="sec.19" guid="_748031e5-0b66-4fd2-b0dd-2ffab4bde2cd" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sec.19-he" guid="_57572eea-e7c3-45fd-9a4f-af16e07dd18c">Directions generally</heading><subclause id="sec.19-ssec.1" guid="_ec852633-930b-4c1a-a2fc-21c6cdb89c9a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The court may, at any time, give the directions it considers appropriate about the use of expert evidence in a proceeding.</txt></block></subclause><subclause id="sec.19-ssec.2" guid="_b9564161-dd10-4e68-9ed8-8f8b0a234d4b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting <intref refid="sec.19-ssec.1" target.guid="_ec852633-930b-4c1a-a2fc-21c6cdb89c9a" check="valid">subrule&#160;(1)</intref>, <intref refid="sec.1" target.guid="_1e3aa84e-7edc-419a-bd95-b9d46c45f5a8" check="valid">1</intref> or more of the following directions may be given under this rule—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.2-para1.a" guid="_4915a54d-870e-4ff1-82d4-fbcc7fceba9f" provision.type="other"><no>(a)</no><block><txt break.before="0">a direction that reports be served within a particular period;</txt></block></li><li id="sec.19-ssec.2-para1.b" guid="_a18bbf78-9627-4202-9a06-bf98336df00b" provision.type="other"><no>(b)</no><block><txt break.before="0">a direction that expert evidence on a particular issue may not be adduced, or may be adduced only with the leave of the court;</txt></block></li><li id="sec.19-ssec.2-para1.c" guid="_810d72c2-06e7-40eb-802a-ec27b5ab759c" provision.type="other"><no>(c)</no><block><txt break.before="0">a direction that expert evidence may be adduced on particular issues only;</txt></block></li><li id="sec.19-ssec.2-para1.d" guid="_05d83419-8971-469c-9557-890bdcaa31fc" provision.type="other"><no>(d)</no><block><txt break.before="0">a direction limiting the number of experts who may be called to give evidence on a particular issue or for a particular area of expertise;</txt></block></li><li id="sec.19-ssec.2-para1.e" guid="_ac4a1296-2683-42e9-8c84-9e2f2b38a3d8" provision.type="other"><no>(e)</no><block><txt break.before="0">a direction requiring experts in relation to the same issue to confer before preparing their reports in relation to the issue;</txt></block></li><li id="sec.19-ssec.2-para1.f" guid="_379a029d-084b-48db-b008-35d68061edad" provision.type="other"><no>(f)</no><block><txt break.before="0">a direction requiring an expert who has prepared more than 1 report for a proceeding to prepare a single report that reflects the expert’s evidence-in-chief in the proceeding;</txt></block></li><li id="sec.19-ssec.2-para1.g" guid="_6ed4c934-57dd-4d75-879f-66cfe0f690a2" provision.type="other"><no>(g)</no><block><txt break.before="0">a direction for an expert engaged jointly by the parties or nominated by the court, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.2-para1.g-para2.i" guid="_c6bbce00-4d36-432d-982b-14edc13c51e4" provision.type="other"><no>(i)</no><block><txt break.before="0">for an expert not yet engaged or nominated—how the expert will be engaged or nominated; and</txt></block></li><li id="sec.19-ssec.2-para1.g-para2.ii" guid="_7f803191-363b-4754-8da5-bd67cc922c47" provision.type="other"><no>(ii)</no><block><txt break.before="0">how the expert will be instructed; and</txt></block></li><li id="sec.19-ssec.2-para1.g-para2.iii" guid="_20be8731-1643-4791-94d2-5234ec58f312" provision.type="other"><no>(iii)</no><block><txt break.before="0">who has the liability for the expert’s fees and expenses; and</txt></block></li><li id="sec.19-ssec.2-para1.g-para2.iv" guid="_b22d0019-cbe4-4081-8f62-3ef822a36667" provision.type="other"><no>(iv)</no><block><txt break.before="0">how the expert may seek information or instructions from the parties or the court;</txt></block></li></list></block></li><li id="sec.19-ssec.2-para1.h" guid="_ec9500fb-04cd-47c0-920d-36262cd5aebd" provision.type="other"><no>(h)</no><block><txt break.before="0">a direction about how and when expert evidence is to be adduced in the proceeding;</txt></block></li><li id="sec.19-ssec.2-para1.i" guid="_bfa802e1-b6f2-445e-96a4-958ad146ba5f" provision.type="other"><no>(i)</no><block><txt break.before="0">any other direction that may assist an expert in the performance of the expert’s functions.</txt></block></li></list></block></subclause><subclause id="sec.19-ssec.3" guid="_9e49a3b0-7a29-483a-9526-77b84837c87b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">This rule does not limit any other power of the court to make orders or give directions.</txt></block></subclause></clause><clause id="sec.20" guid="_9c11e4cb-f6a3-448b-a986-6532f9921fb1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.20-he" guid="_5536bef4-8897-466a-9df5-a5f2479b5be3">Duty of expert</heading><subclause id="sec.20-ssec.1" guid="_18b73bb0-7e57-40b6-a90e-5c1d85e6f5e3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An expert who gives evidence in a proceeding has a duty to assist the court in relation to any matter arising in the proceeding that is within the expertise of the expert.</txt></block></subclause><subclause id="sec.20-ssec.2" guid="_74843b0a-35b7-408c-a7c7-b7a650baaf9d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The expert’s duty to assist the court overrides any obligation the expert may have to any party to the proceeding, any person who engaged the expert to give evidence or any person who is liable for the expert’s fees or expenses.</txt></block></subclause><subclause id="sec.20-ssec.3" guid="_5abed9f0-7aab-4dd4-a3d9-202196c6f4ff" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The expert must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.3-para1.a" guid="_266e0496-138e-4497-9a05-36f36954b50f" provision.type="other"><no>(a)</no><block><txt break.before="0">be independent and impartial; and</txt></block></li><li id="sec.20-ssec.3-para1.b" guid="_874b2a50-c3f2-4421-b371-dfb7276ee899" provision.type="other"><no>(b)</no><block><txt break.before="0">observe the limits of the expert’s expertise; and</txt></block></li><li id="sec.20-ssec.3-para1.c" guid="_cbe36637-757f-4c43-bc89-4c396b447c77" provision.type="other"><no>(c)</no><block><txt break.before="0">comply with these rules and any directions given by the court; and</txt></block></li><li id="sec.20-ssec.3-para1.d" guid="_47bf21cb-f610-47a7-8aa0-b435d79fc671" provision.type="other"><no>(d)</no><block><txt break.before="0">comply, to the extent applicable, with the code of conduct for experts set out in the uniform rules, <intref refid="sch.1C" check="invalid">schedule&#160;1C</intref>.</txt></block></li></list></block></subclause><subclause guid="_8c400edc-9494-4c48-a3f2-3a9e613bfd28">Obligation of party who calls expert</heading><subclause id="sec.21-ssec.1" guid="_e6577ce7-d775-4006-9c01-8ed62a3ca5ce" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A party who calls an expert to give evidence in a proceeding must, before the expert gives evidence, give the expert—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.1-para1.a" guid="_c0a44a2d-0b9f-4f9b-8ae9-16e85afeab72" provision.type="other"><no>(a)</no><block><txt break.before="0">a copy of these rules and any directions made by the court about the giving of expert evidence; and</txt></block></li><li id="sec.21-ssec.1-para1.b" guid="_1c46ad7b-db54-4941-969b-e9576c66d0ce" provision.type="other"><no>(b)</no><block><txt break.before="0">any other information or material necessary to enable the expert to comply with <intref refid="sec.20" target.guid="_9c11e4cb-f6a3-448b-a986-6532f9921fb1" check="valid">rule&#160;20</intref>.</txt></block></li></list></block></subclause><subclause id="sec.21-ssec.2" an expert— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-para1.a" guid="_e462290c-e4a6-4a41-a3a2-aab289075659" provision.type="other"><no>(a)</no><block><txt break.before="0">prepare a report and provide the report to the court; or</txt></block></li><li id="sec.22-para1.b" guid="_ddf35a6a-46db-4324-88ba-38124167c80d" provision.type="other"><no>(b)</no><block><txt break.before="0">participate in a meeting of experts with 1 or more other experts.</txt></block></li></list></block></clause><clause id="sec.23" guid="_0c333a0b-877a-4054-8155-15a13b898e93" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>23</no><heading id="sec.23-he" guid="_30a30470-05c4-4e59-9297-02cd1ee90827">Briefing experts</heading><subclause id="sec.23-ssec.1" guid="_0fecf6a2-37b9-4b85-8281-5a79d6fc7510" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the court directs a meeting of experts, the parties must prepare and deliver to the experts a consolidated brief of instructions that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.1-para1.a" guid="_0a7fab93-5e45-43b5-894a-df740aef794b" provision.type="other"><no>(a)</no><block><txt break.before="0">identifies any issue that any party considers the experts need to address; and</txt></block></li><li id="sec.23-ssec.1-para1.b" guid="_d07a4a21-3259-437a-9149-84470c3fdca1" provision.type="other"><no>(b)</no><block><txt break.before="0">includes any information or documents that any party considers relevant to that issue.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.2" guid="_be2d35d1-721f-495a-99fa-5ba27ef855d1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Including information or a document in a consolidated brief of instructions is without prejudice to each party’s right to object at the hearing to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.2-para1.a" guid="_beb48d4d-9367-47d5-8cba-a0950f95c42e" provision.type="other"><no>(a)</no><block><txt the experts must give the joint report prepared by the experts in the meeting of experts to the parties—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-para1.a" guid="_da57956b-9193-48ca-b401-86fec9d4d516" provision.type="other"><no>(a)</no><block><txt break.before="0">if the court has given a direction about the period within which the report is to be given—as directed by the court; or</txt></block></li><li id="sec.24-para1.b" guid="_ea3cd079-2501-4323-a193-92b680b4929a" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—as id="sec.25-ssec.1" guid="_87f3882f-ee21-4e56-9a36-64a74d2683d4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">Evidence of anything done or said, or an admission made, at a meeting of experts in a proceeding is admissible in the following only if all parties to the proceeding agree—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-ssec.1-para1.a" guid="_19b97b96-75ff-4342-8f6e-fb791502c33b" provision.type="other"><no>(a)</no><block><txt break.before="0">the hearing of the proceeding;</txt></block></li><li id="sec.25-ssec.1-para1.b" guid="_bd042ee6-815c-405d-8164-5c7a7c4c2d93" provision.type="other"><no>(b)</no><block><txt break.before="0">the hearing of another proceeding in the court; guid="_3ab74184-d536-4786-ac08-dd43d8101ce2">Permitted communications between experts and parties</heading><subclause id="sec.26-ssec.1" guid="_e350f2b7-f6b8-4ab9-9236-1974f614df10" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the court directs a meeting of experts, any of the experts may, in writing—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.1-para1.a" guid="_4a6d10e5-00e9-4a18-934d-1446a6b0662c" provision.type="other"><no>(a)</no><block><txt break.before="0">ask the parties for information that may assist the proper and timely conduct or conclusion of the meeting of experts or preparation of the joint report; or</txt></block></li><li id="sec.26-ssec.1-para1.b" guid="_d57ba841-bde2-4f61-83f6-f7b70f2f9681" provision.type="other"><no>(b)</no><block><txt break.before="0">inform the parties of any matter adversely affecting the proper and timely conduct or conclusion of the meeting of experts or preparation of the joint report.</txt></block></li></list></block></subclause><subclause id="sec.26-ssec.2" guid="_b938f135-e181-446e-b553-fd25fc21b237" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A communication mentioned in <intref refid="sec.26-ssec.1" target.guid="_e350f2b7-f6b8-4ab9-9236-1974f614df10" check="valid">subrule&#160;(1)</intref> must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.2-para1.a" guid="_f71142d2-7739-4c5e-b231-2a3057d8218e" provision.type="other"><no>(a)</no><block><txt break.before="0">be made jointly to all of the parties; and</txt></block></li><li id="sec.26-ssec.2-para1.b" guid="_39612b3b-7962-4600-8e88-57bb6fc7b1aa" provision.type="other"><no>(b)</no><block><txt break.before="0">state—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.2-para1.b-para2.i" guid="_3b5ca078-0f81-4c05-8431-d4cbcfa81899" provision.type="other"><no>(i)</no><block><txt break.before="0">whether or not all of the experts agree on the terms of the communication; and</txt></block></li><li id="sec.26-ssec.2-para1.b-para2.ii" guid="_b528de8a-d0c2-4eee-8139-2e9deb2b51db" provision.type="other"><no>(ii)</no><block><txt break.before="0">if all of the experts do not agree on the terms of the communication—the matters on which the experts disagree.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.26-ssec.3" guid="_f572833e-d81a-4be3-a4cb-1853d0567e36" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Any response by a party to a communication mentioned in <intref refid="sec.26-ssec.1" target.guid="_e350f2b7-f6b8-4ab9-9236-1974f614df10" check="valid">subrule&#160;(1)</intref> must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.3-para1.a" guid="_f35aac33-2e9e-4ddf-997f-fdd785ec4edc" provision.type="other"><no>(a)</no><block><txt break.before="0">be in writing; and</txt></block></li><li a meeting of experts; and</txt></block></li><li id="sec.27-ssec.1-para1.c-para2.iii" guid="_2efe6529-3575-4fde-9572-3bffe09bb53c" provision.type="other"><no>(iii)</no><block><txt break.before="0">facilitating the preparation of a joint report for the proceeding; and</txt></block></li></list></block></li><li id="sec.27-ssec.1-para1.d" guid="_f443d253-7b70-4460-9816-5aaf333a4540" provision.type="other"><no>(d)</no><block><txt break.before="0">assist the parties in case provision.type="other"><no>(1)</no><block><txt break.before="0">A respondent in a proceeding, other than a recommendatory proceeding, may apply to the court for an order dismissing the proceeding for want of prosecution if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.31-ssec.1-para1.a" guid="_8a3c3459-a315-451b-9fd7-c48ab3cfb51a" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant or appellant is required under these rules to take a step in the proceeding, or is required to comply with an order of the court, within a stated time; and</txt></block></li><li id="sec.31-ssec.1-para1.b" guid="_cd22dd9a-071c-42a9-ad5b-a041c4077af4" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant or appellant does not
