guid="_8def6718-eda5-4434-98e3-0b52f9823282">Objective of scheme</heading><block><txt break.before="1">The objective of the scheme is to assist sole traders, partnerships, proprietary companies and trusts, that are carrying on primary production enterprises that have been significantly financially affected by drought, with carry-on finance.</txt></block></clause><clause id="sec.5-sec.2" guid="_c400f36f-62aa-49cc-b789-f3ef9ade44b4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.5-sec.2-he" guid="_dfe6b213-52b4-4049-8a40-f45c5106282c">Purpose of assistance</heading><subclause id="sec.5-sec.2-ssec.1" guid="_7af2197e-ef3e-4a72-aefc-92348dc791c0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The purpose of assistance under the scheme is to provide concessional loans to sole traders, partnerships, proprietary companies and trusts carrying on primary production enterprises to assist the entities to meet working capital expenses.</txt></block></subclause><subclause id="sec.5-sec.2-ssec.2" guid="_33e6db01-76a0-4b85-bb49-a207a3805f47" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For subsection (1), working capital expenses include, for example, the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.2-ssec.2-para1.a" guid="_593eb70a-3d1b-42ec-b53f-1806d42b16ed" provision.type="other"><no>(a)</no><block><txt break.before="0">paying employee wages;</txt></block></li><li id="sec.5-sec.2-ssec.2-para1.b" guid="_8cc8ee3f-8d53-4134-9794-e6db2b3a8b5b" provision.type="other"><no>(b)</no><block><txt break.before="0">paying creditors;</txt></block></li><li id="sec.5-sec.2-ssec.2-para1.c" guid="_7c92f4f7-7f7f-498e-ba31-097cbc9e8097" provision.type="other"><no>(c)</no><block><txt break.before="0">paying rent and rates; </txt></block></li><li id="sec.5-sec.2-ssec.2-para1.d" guid="_12a5d793-f0d9-4e5f-9844-db5dc33c376e" provision.type="other"><no>(d)</no><block><txt break.before="0">buying goods, including fuel, for carrying on the business.</txt></block></li></list></block></subclause><subclause id="sec.5-sec.2-ssec.3" guid="_c69af669-93ce-4263-beb3-843ba8002b43" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, for subsection (1), the following are not working capital expenses—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.2-ssec.3-para1.a" guid="_bdb08ce0-3e07-4ab8-85eb-ac6cad9661bc" provision.type="other"><no>(a)</no><block><txt break.before="0">refinancing existing business loans or equipment finance;</txt></block></li><li id="sec.5-sec.2-ssec.3-para1.b" guid="_3c02bc96-527a-47e2-b544-e6df25580190" provision.type="other"><no>(b)</no><block><txt break.before="0">buying new equipment or other assets. </txt></block></li></list></block></subclause></clause><clause id="sec.5-sec.3" guid="_3c71651b-5d21-48fb-abb7-3e00ec692a3e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.5-sec.3-he" guid="_fecbf5c0-385b-46d2-a9ea-8800bd1a54bc">Definitions for schedule</heading><block><txt break.before="1">In this schedule—</txt><deflist><definition id="sec.5-sec.3-def.primaryproducer_" guid="_dc9a3d5b-467d-4cd7-a98d-ca6af1e2d119" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.primaryproducer" guid="_6ac92b60-1456-4870-b0fc-d52f37c27891" type="definition">primary producer</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.primaryproducer-para1.a" guid="_f3462ee0-3b65-401a-be5d-915c1436d5b9" provision.type="other"><no>(a)</no><block><txt break.before="0">a sole trader who spends the majority of the person’s labour on, and derives the majority of the person’s income from, a primary production enterprise; or</txt></block></li><li id="sec.5-sec.3-def.primaryproducer-para1.b" guid="_01ab75fb-47e4-45c1-969a-a346f727b24c" provision.type="other"><no>(b)</no><block><txt break.before="0">in relation to a partnership, proprietary company or trust that carries on a primary production enterprise, any partner in the partnership, shareholder in the company or beneficiary of the trust who spends the majority of their labour on, and derives the majority of their income from, the primary production enterprise.</txt></block></li></list></definition><definition id="sec.5-sec.3-def.primaryproductionenterprise_" guid="_7e787559-b576-4909-9dce-8002e1cff67e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.primaryproductionenterprise" guid="_ef6882b3-04c3-437d-bcb6-027c3597a1dc" type="definition">primary production enterprise</defterm> means a business—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.3-def.primaryproductionenterprise-para1.a" guid="_71789efe-d4b0-4c1c-97b0-265193857c31" provision.type="other"><no>(a)</no><block><txt break.before="0">that involves primary production, including the agricultural, apicultural, aquacultural, forestry, grazing and horticultural industries; and</txt></block></li><li id="sec.5-sec.3-def.primaryproductionenterprise-para1.b" guid="_d4fcfe8c-995a-4012-b0cf-34d57da30660" provision.type="other"><no>(b)</no><block><txt break.before="0">for which an entity holds an Australian Business Number.</txt></block></li></list></definition><definition id="sec.5-sec.3-def.resilienceplan_" guid="_7222c45a-2208-41a0-9792-8d6235145bc8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.resilienceplan" guid="_52f38a43-b881-42a8-bd40-381b43573b5f" type="definition">resilience plan</defterm>, for a primary production enterprise, see section 4.</txt></definition><definition id="sec.5-sec.3-def.scheme_" guid="_bb478de2-815b-4c5e-876d-e07eb17ddfb6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.3-def.scheme" guid="_c33be4f9-13ab-4a24-9a2f-dc00a7397684" type="definition">scheme</defterm> means the scheme set out in this schedule.</txt></definition></deflist></block></clause><clause id="sec.5-sec.4" guid="_40088057-1cf4-42f5-a7fa-a42f611545fd" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.5-sec.4-he" guid="_bbaa1bef-cdbd-4662-b297-de58408a4632">Meaning of <defterm id="sec.5-sec.4-def.resilienceplan" guid="_7542df9a-1e9b-40f1-a58d-5ee395f4aaf7" type="definition">resilience plan</defterm></heading><block><txt break.before="1">A <defterm id="sec.5-def.resilienceplan" guid="_a27279bc-31ca-45f0-9115-d4630494e4f8" type="definition">resilience plan</defterm>, for a primary production enterprise, is a plan that the authority is satisfied— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.4-para1.a" guid="_b7255c77-3099-4f48-b784-0650846207a9" provision.type="other"><no>(a)</no><block><txt break.before="0">addresses risks relevant to the primary production enterprise, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.4-para1.a-para2.i" guid="_156bcf7a-344f-4bd6-8f42-d0b35d5b39bb" provision.type="other"><no>(i)</no><block><txt break.before="0">viability risks; and</txt></block></li><li id="sec.5-sec.4-para1.a-para2.ii" guid="_167e707c-70fb-4f69-a23f-7622a77952b0" provision.type="other"><no>(ii)</no><block><txt break.before="0">productivity risks; and</txt></block></li><li id="sec.5-sec.4-para1.a-para2.iii" guid="_cbe01306-bb32-4a8b-9390-21b2ecafb5ff" provision.type="other"><no>(iii)</no><block><txt break.before="0">business and climate risks, such as drought; and</txt></block></li></list></block></li><li id="sec.5-sec.4-para1.b" guid="_40ce6785-6c7e-4c0d-bcc6-daf3622d4843" provision.type="other"><no>(b)</no><block><txt break.before="0">details the actions the applicant may take to manage the risks relevant to the primary production enterprise to improve the resilience of the primary production enterprise; and</txt></block></li><li id="sec.5-sec.4-para1.c" guid="_8866defa-e249-4286-ad30-d3797da6f24e" provision.type="other"><no>(c)</no><block><txt break.before="0">complies with the guidelines for resilience plans under the scheme that are issued by the authority. </txt></block></li></list><note id="sec.5-sec.4-note" guid="_a0418505-4a3f-4045-b596-e42ddb511d04" type="example"><heading id="sec.5-sec.4-note-he" guid="_af05bfa5-e0af-440e-8e27-7ccde1cbd996">Note—</heading><block><txt break.before="1">A copy of the guidelines for resilience plans under the scheme may be obtained from the authority.</txt></block></note></block></clause></part><part id="sec.5-frag-sch.4-pt.2" guid="_66631e10-0adf-4a91-988e-bb9ca9a9a2ef" numbering.style="all" affected.by.uncommenced="0"><no>Part 2</no><heading id="sec.5-frag-sch.4-pt.2-he" guid="_9e60ea99-b498-4b8f-bd72-9de115df053b">General provisions of scheme</heading><clause id="sec.5-sec.5" guid="_50a5282c-84b5-4d3b-8cce-dfe09bac81bb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-sec.5-he" guid="_2c320a71-fc26-4231-891a-ccefc67727da">Nature of assistance</heading><block><txt break.before="1">The nature of the assistance that may be given to an applicant under the scheme is a loan at a concessional rate of interest to be used to pay for a purpose mentioned in section 2.</txt></block></clause><clause id="sec.5-sec.6" guid="_56295bdd-1564-4c78-800e-a41a0054dcfb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.5-sec.6-he" guid="_fbfb4a3b-4b41-4157-b69a-22eac92750f2">Maximum loan amount</heading><subclause id="sec.5-sec.6-ssec.1" guid="_bc6ab753-994f-4ca7-b9a7-89aa8d3f5f1d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The maximum amount of a loan, or total outstanding loan balance, under the scheme is $250,000.</txt></block></subclause><subclause id="sec.5-sec.6-ssec.2" guid="_00487ec2-6c18-4c33-9eb5-96e838f2ed66" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, if the applicant applies for assistance under the scheme and the scheme set out in schedule 5, the maximum amount of the loans an applicant may receive under both schemes is a combined total of $250,000.</txt></block></subclause></clause><clause id="sec.5-sec.7" guid="_11ccaf4a-2b6f-4fe4-a8a7-6e475ba946e2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.5-sec.7-he" guid="_02e8014e-9c53-4b2d-8c15-7358a8dcb041">Eligibility criteria</heading><subclause id="sec.5-sec.7-ssec.1" guid="_69b81da3-9673-440a-a329-ae9cb054d31f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">To be eligible to receive assistance under the scheme the applicant must demonstrate to the authority that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.1-para1.a" guid="_397f6929-139b-402c-b9af-c1f96ef1becf" provision.type="other"><no>(a)</no><block><txt break.before="0">the assistance is for a primary production enterprise carried on by a sole trader, partnership, proprietary company or trust; and</txt></block></li><li id="sec.5-sec.7-ssec.1-para1.b" guid="_e3a76ac6-6abe-452a-855f-9d361c93dfc7" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant is the sole trader, partnership, proprietary company or trust that is carrying on the primary production enterprise; and</txt></block></li><li id="sec.5-sec.7-ssec.1-para1.c" guid="_ce573898-9f48-4bb2-88ce-cf9dd9a12fe7" provision.type="other"><no>(c)</no><block><txt break.before="0">an interested person for the primary production enterprise is a primary producer; and</txt></block></li><li id="sec.5-sec.7-ssec.1-para1.d" guid="_5f5dbf4e-f7a2-4041-a3b6-0c61a5b32026" provision.type="other"><no>(d)</no><block><txt break.before="0">the applicant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.1-para1.d-para2.i" guid="_ee86811f-45a7-454d-a67a-69808bebef23" provision.type="other"><no>(i)</no><block><txt break.before="0">has taken reasonable precautions to minimise the effect of drought on the primary production enterprise; and </txt><note id="sec.5-sec.7-ssec.1-para1.d-para2.i-note" guid="_0e458cd3-2816-40e1-8d6f-ae2d14530af9" type="example"><heading id="sec.5-sec.7-ssec.1-para1.d-para2.i-note-he" guid="_e5b8bbb0-79a2-4cf4-9279-81c32d34ef8b">Example of reasonable precautions—</heading><block><txt break.before="1">maintaining stock at levels commensurate with seasonal conditions</txt></block></note></block></li><li id="sec.5-sec.7-ssec.1-para1.d-para2.ii" guid="_f6f2199b-d71d-498c-af5a-71314c20cec0" provision.type="other"><no>(ii)</no><block><txt break.before="0">intends to use any of the primary production enterprise’s surplus liquid reserves or normal credit sources up to normal credit limits, in conjunction with the loan, to continue operations; and</txt></block></li><li id="sec.5-sec.7-ssec.1-para1.d-para2.iii" guid="_29333865-01c2-4fca-ad9c-c9e526f8c83f" provision.type="other"><no>(iii)</no><block><txt break.before="0">can service the loan; and</txt></block></li></list></block></li><li id="sec.5-sec.7-ssec.1-para1.e" guid="_389df29e-5997-4fa7-a8f0-1165cac55d85" provision.type="other"><no>(e)</no><block><txt break.before="0">the primary production enterprise—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.1-para1.e-para2.i" guid="_6942e897-6d9b-46c8-9afd-6eef13c4268a" provision.type="other"><no>(i)</no><block><txt break.before="0">has been carried on for at least 12 months before the day the application for assistance is made; and </txt></block></li><li id="sec.5-sec.7-ssec.1-para1.e-para2.ii" guid="_59f0fab5-9ef0-4278-b9ad-a91b0630a9ba" provision.type="other"><no>(ii)</no><block><txt break.before="0">demonstrates prospects for commercial viability; and</txt></block></li><li id="sec.5-sec.7-ssec.1-para1.e-para2.iii" guid="_31e6845d-50dd-48af-b80b-dcd3ce3b8504" provision.type="other"><no>(iii)</no><block><txt break.before="0">requires financial assistance because the primary production enterprise has been significantly financially affected by drought.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-sec.7-ssec.2" guid="_231e5a5a-3613-4983-bf42-e82e1602b782" give to the authority, a resilience plan for the primary production enterprise.</txt></block></subclause><subclause id="sec.5-sec.7-ssec.3" guid="_5a41ab4a-fffe-44ec-bce7-f04d797226ca" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, an applicant is not eligible to receive assistance under the scheme if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.3-para1.a" guid="_8fad14a8-c709-42a7-a45e-0f3aeb51fee3" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant has received assistance under the scheme and the loan has not been discharged; or</txt></block></li><li id="sec.5-sec.7-ssec.3-para1.b" guid="_dcb5f6ab-76a7-43f0-a734-82a7506d9c95" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant has received assistance under the scheme in the 5 years before the day the application for assistance is made; or</txt></block></li><li id="sec.5-sec.7-ssec.3-para1.c" guid="_5fdab153-4570-4951-a6bf-7f327339655b" provision.type="other"><no>(c)</no><block><txt break.before="0">the applicant or an interested person for the primary production enterprise—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.3-para1.c-para2.i" guid="_f02a464c-cc5b-47ed-bd96-481cbfd06886" provision.type="other"><no>(i)</no><block><txt break.before="0">has given to the department, in support of an application for DRAS funding, an invoice issued in the 6 months before the day the application for assistance is made; and</txt></block></li><li id="sec.5-sec.7-ssec.3-para1.c-para2.ii" guid="_e17cc653-30e7-441b-ba95-977012654fe1" provision.type="other"><no>(ii)</no><block><txt break.before="0">has received DRAS funding for the invoice.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-sec.7-ssec.4" guid="_005b56d7-6520-43c9-bd35-63ca2e60682d" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-sec.7-ssec.4-def.DRASfunding_" guid="_946a32a5-433e-4803-99cf-30e10185280f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.7-ssec.4-def.DRASfunding" guid="_c841dd5f-89b5-4766-a161-0b87fa064e49" type="definition">DRAS funding</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.4-def.DRASfunding-para1.a" guid="_f9027d22-417e-4995-836f-5380cd6206c6" provision.type="other"><no>(a)</no><block><txt break.before="0">a freight subsidy under the program known as the Drought Relief Assistance Scheme administered by the department; or</txt></block></li><li id="sec.5-sec.7-ssec.4-def.DRASfunding-para1.b" guid="_e7f251cd-3aa8-4719-ac95-723501c4796d" provision.type="other"><no>(b)</no><block><txt break.before="0">a rebate known as the Emergency Water Infrastructure Rebate under the program known as the Drought Relief Assistance Scheme administered by the department.</txt></block></li></list></definition><definition id="sec.5-sec.7-ssec.4-def.interestedperson_" guid="_3971a37b-69fc-45fd-8d9c-7c1de3159a12" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.7-ssec.4-def.interestedperson" guid="_11fcf189-2106-4c9e-86b0-77305144b259" type="definition">interested person</defterm>, for a primary production enterprise, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-ssec.4-def.interestedperson-para1.a" guid="_501a59b4-f2d6-4815-b615-275be5589e85" provision.type="other"><no>(a)</no><block><txt break.before="0">if the primary production enterprise is carried on by a sole trader—the sole trader; or</txt></block></li><li id="sec.5-sec.7-ssec.4-def.interestedperson-para1.b" guid="_0358cd34-ea29-4fc0-8af2-d8ec8682c809" provision.type="other"><no>(b)</no><block><txt break.before="0">if the primary production enterprise is carried on by a partnership, proprietary company or trust—a partner in the partnership, a shareholder in the company or a beneficiary of the trust. </txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.5-sec.8" guid="_54d0f002-a4f4-4365-ab93-62ec9c3eee98" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.5-sec.8-he" guid="_691f52d2-218a-4245-ab66-d357d13b02e1">Interest rates</heading><subclause id="sec.5-sec.8-ssec.1" guid="_c5069d44-485d-4165-8fe1-abb843f7e207" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The interest charged on a loan given under the scheme must be calculated at a concessional interest rate decided by the authority.</txt></block></subclause><subclause id="sec.5-sec.8-ssec.2" guid="_d21f7078-1edf-4695-ba11-8683372e2cb1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The authority may include a condition varying the interest rate during the term of the id="sec.5-sec.9-he" guid="_71665f94-e225-421e-a645-29831ad5e4e2">Security</heading><block><txt break.before="1">A loan under the scheme must be secured to the satisfaction of the authority.</txt></block></clause><clause id="sec.5-sec.10" guid="_6a1b5b9d-c2d5-4e6d-83d2-ed1c8745b0ee" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.5-sec.10-he" guid="_36b8eb12-0a41-4372-a97e-6deb2857c677">Terms of repayment</heading><subclause id="sec.5-sec.10-ssec.1" guid="_e146a54e-cfc0-4df8-b611-097c7a56f2ec" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The term of a loan under the scheme is the term decided by the authority up to a maximum of 10 years.</txt></block></subclause><subclause id="sec.5-sec.10-ssec.2" guid="_8d0978cb-2f46-450f-8b2e-a487fafe9e31" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">During the first 2 years of the loan term, the applicant must make the interest repayments decided by the authority.</txt></block></subclause><subclause id="sec.5-sec.10-ssec.3" applicant must make the principal and interest repayments decided by the authority.</txt></block></subclause></clause><clause id="sec.5-sec.11" guid="_bc3551ab-6fa0-4bb7-86f1-c9491b31e956" id="sec.5-sec.11-ssec.1" guid="_9f3b0d8a-472f-4e46-bdc7-0d7dad03e7ea" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The payment of assistance under the provision.type="other"><no>(1)</no><block><txt break.before="0">An application for assistance under the scheme must—</txt><list number.type="manual" unnumbered.indent="0"><li provision.type="other"><no>(2)</no><block><txt break.before="0">If the authority asks the applicant to provide further information to support the application, the applicant must provide the guid="_f6e81b65-f846-4192-a716-35daf60ac313" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The authority must consider, and decide to approve or refuse to affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The purpose of assistance under the scheme is to provide interest-free loans to sole traders, partnerships, proprietary companies and trusts that are carrying on primary production enterprises to assist the entities to meet working capital expenses.</txt></block></subclause><subclause plan</defterm></heading><block><txt break.before="1">A <defterm id="sec.5-sec.4-def.resilienceplan-oc.2" guid="_9c99cdaa-352c-4d0d-b0de-91dc4b3b56f6" type="definition">resilience plan</defterm>, for a primary production enterprise, is a plan that the authority is satisfied— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.4-oc.2-para1.a" guid="_c440ff01-3495-453c-80a7-06752e638175" provision.type="other"><no>(a)</no><block><txt break.before="0">addresses risks relevant to the primary production enterprise, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.4-oc.2-para1.a-para2.i" guid="_59930e37-6d9a-485f-a9fa-bdb883b3d3f8" provision.type="other"><no>(i)</no><block><txt break.before="0">viability risks; and</txt></block></li><li id="sec.5-sec.4-oc.2-para1.a-para2.ii" guid="_ee5378e5-578f-41b7-8944-81a5a7516acc" provision.type="other"><no>(ii)</no><block><txt for assistance under the scheme and the scheme set out in schedule 4, the maximum amount of the loans an applicant may receive under both schemes is a combined total of guid="_0e03bb8e-0cca-46e2-ae6f-086106cf372d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">To be eligible to receive assistance under the scheme the applicant must demonstrate to the authority that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-oc.2-ssec.1-para1.a" guid="_d5214680-9230-4d40-8143-56bb69c71f12" provision.type="other"><no>(a)</no><block><txt break.before="0">the assistance is for a primary production enterprise carried on by a sole trader, partnership, proprietary company or trust; and</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.1-para1.b" guid="_46592cb5-9a54-4dc2-bd1c-49cd11f0da8a" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant is the sole trader, partnership, proprietary company or trust that is carrying on the primary production enterprise; and</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.1-para1.c" guid="_84d307c4-7042-4de5-a53b-08970a7050b2" provision.type="other"><no>(c)</no><block><txt break.before="0">an interested person for the primary production enterprise is a primary producer; and</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.1-para1.d" guid="_ef44274c-50ff-4e59-8c9f-e8080a9e4a7d" provision.type="other"><no>(d)</no><block><txt break.before="0">the applicant— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-oc.2-ssec.1-para1.d-para2.i" guid="_645e9c57-ab6d-4c38-91ea-8a6ffce55b8f" provision.type="other"><no>(i)</no><block><txt break.before="0">has taken reasonable precautions to minimise the effect of drought on the primary production enterprise; and </txt><note id="sec.5-sec.7-oc.2-ssec.1-para1.d-para2.i-note" guid="_ac8cf7d5-3dce-4c5d-82f7-9981586fd433" type="example"><heading id="sec.5-sec.7-oc.2-ssec.1-para1.d-para2.i-note-he" guid="_4f777751-5c9f-4846-a440-98161fa6b6b0">Example of reasonable precautions—</heading><block><txt break.before="1">maintaining stock at levels commensurate with seasonal conditions</txt></block></note></block></li><li id="sec.5-sec.7-oc.2-ssec.1-para1.d-para2.ii" guid="_4681d939-c00a-465d-8f3d-939b74836b59" provision.type="other"><no>(ii)</no><block><txt break.before="0">intends to use any of the primary production enterprise’s surplus liquid reserves or normal credit sources up to normal credit limits, in conjunction with the loan, to continue operations; and</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.1-para1.d-para2.iii" guid="_20207625-cf62-4beb-9148-44320f64cc83" provision.type="other"><no>(iii)</no><block><txt break.before="0">can service the loan; and</txt></block></li></list></block></li><li id="sec.5-sec.7-oc.2-ssec.1-para1.e" guid="_1d67a865-8644-40eb-8c91-002b6be05955" provision.type="other"><no>(e)</no><block><txt break.before="0">the primary production enterprise— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-oc.2-ssec.1-para1.e-para2.i" guid="_62ee6b27-a4d8-4551-8c24-9031d26f3db2" provision.type="other"><no>(i)</no><block><txt break.before="0">has been carried on for at least 12 months before the day the application for assistance is made; and </txt></block></li><li id="sec.5-sec.7-oc.2-ssec.1-para1.e-para2.ii" guid="_dee2ce01-19ba-4e41-88c8-2bc8826d33ee" provision.type="other"><no>(ii)</no><block><txt break.before="0">demonstrates prospects for commercial viability; and</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.1-para1.e-para2.iii" guid="_3e8c762f-d24f-4c7c-93aa-7487fe9bc77f" provision.type="other"><no>(iii)</no><block><txt break.before="0">requires financial assistance because the primary production enterprise has been significantly financially affected by drought.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-sec.7-oc.2-ssec.2" guid="_5dacf7d0-9a41-4fec-a910-2d6725336fc8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, an applicant must give to the authority, or demonstrate to the authority that the applicant intends to give to the authority, a resilience plan for the primary production enterprise.</txt></block></subclause><subclause id="sec.5-sec.7-oc.2-ssec.3" guid="_63cb981b-fafb-415b-b9d7-555e85bd9731" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, an applicant is not eligible to receive assistance under the scheme if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-oc.2-ssec.3-para1.a" guid="_d46eef77-8c9b-403b-a45c-f558a1614b52" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant has received assistance under the scheme and the loan has not been discharged; or</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.3-para1.b" guid="_ac4d4861-4f87-4752-961b-5025864c8138" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant has received assistance under the scheme in the 5 years before the day the application for assistance is made; or</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.3-para1.c" guid="_0502fb7b-b155-42e8-9912-0ea1efa4304a" provision.type="other"><no>(c)</no><block><txt break.before="0">the applicant or an interested person for the primary production enterprise—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-oc.2-ssec.3-para1.c-para2.i" guid="_818b719b-a1f5-416a-8903-79fa04d261c1" provision.type="other"><no>(i)</no><block><txt break.before="0">has given to the department, in support of an application for DRAS funding, an invoice issued in the 6 months before the day the application for assistance is made; and</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.3-para1.c-para2.ii" guid="_97ea6180-7174-41f9-8de6-e2824482c184" provision.type="other"><no>(ii)</no><block><txt break.before="0">has received DRAS funding for the invoice.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-sec.7-oc.2-ssec.4" guid="_b2b3755f-92ec-4141-b5be-d2513f38c307" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-sec.7-oc.2-ssec.4-def.DRASfunding_" guid="_05a6303e-209f-4a8a-8f62-c2c9c9edad89" provision.type="other"><no>(a)</no><block><txt break.before="0">a freight subsidy under the program known as the Drought Relief Assistance Scheme administered by the department; or</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.4-def.DRASfunding-para1.b" guid="_8b59f8b1-4215-4ede-b1c5-81966fca8f6f" provision.type="other"><no>(b)</no><block><txt break.before="0">a rebate known as the Emergency Water Infrastructure Rebate under the program known as the Drought Relief Assistance Scheme administered by the department.</txt></block></li></list></definition><definition id="sec.5-sec.7-oc.2-ssec.4-def.interestedperson_" guid="_066b563f-f591-45f8-a780-0be61648d48f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-sec.7-oc.2-ssec.4-def.interestedperson" guid="_919dea4d-f456-4dc6-a4d5-93d1ff2121c4" type="definition">interested person</defterm>, for a primary production enterprise, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-sec.7-oc.2-ssec.4-def.interestedperson-para1.a" guid="_18eec53f-620f-42a1-bb8e-07b11ab0a212" provision.type="other"><no>(a)</no><block><txt break.before="0">if the primary production enterprise is carried on by a sole trader—the sole trader; or</txt></block></li><li id="sec.5-sec.7-oc.2-ssec.4-def.interestedperson-para1.b" guid="_a056fc33-95e7-42b0-b8a6-560b085cf11e" provision.type="other"><no>(b)</no><block><txt break.before="0">if the primary production enterprise is carried on by a partnership, proprietary company or trust—a partner in the partnership, a shareholder in the company or a beneficiary of the trust. </txt></block></li></list></definition></deflist></block></subclause></clause><clause guid="_373a594e-d402-4c39-a871-d39cf146b50a">Security</heading><block><txt break.before="1">A loan under the scheme must be secured to the satisfaction of the authority.</txt></block></clause><clause id="sec.5-sec.9-oc.2" guid="_ac54b8be-a1fd-4197-8556-c75219d28001" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.5-sec.9-oc.2-he" provision.type="other"><no>(1)</no><block><txt break.before="0">The term of a loan under the scheme is the term decided by the authority up to a maximum of 7 years.</txt></block></subclause><subclause affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the authority asks the applicant to provide further information to support the application, the applicant </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.3-def.primaryproducer-para1.a-para2.i" guid="_4d7c2553-3aaa-449a-99ab-a6607f16c122" provision.type="other"><no>(i)</no><block><txt break.before="0">spends the majority of the person’s labour on a primary production enterprise; and</txt></block></li><li id="sec.7-sec.3-def.primaryproducer-para1.a-para2.ii" guid="_733e9971-8f79-484e-a9ed-61f042daa2bf" provision.type="other"><no>(ii)</no><block><txt break.before="0">either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.3-def.primaryproducer-para1.a-para2.ii-para3.A" guid="_65f08440-447a-47de-a7ff-f8e30e0903b5" provision.type="other"><no>(A)</no><block><txt break.before="0">derives the majority of the person’s income from the primary production enterprise; or</txt></block></li><li id="sec.7-sec.3-def.primaryproducer-para1.a-para2.ii-para3.B" guid="_1860a064-b561-44de-bccf-55301b5558d0" provision.type="other"><no>(B)</no><block><txt break.before="0">in the opinion of the authority, based on the demonstrated production potential of the primary production enterprise, will eventually derive the majority of the person’s income from the primary production enterprise; or</txt></block></li></list></block></li></list></block></li><li id="sec.7-sec.3-def.primaryproducer-para1.b" guid="_4040e856-e771-4847-bbb9-c413927bb425" provision.type="other"><no>(b)</no><block><txt break.before="0">a partnership, proprietary company or trust that carries on a primary production enterprise for which the partners, shareholders or beneficiaries—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.3-def.primaryproducer-para1.b-para2.i" guid="_7b16958b-24a6-4b4e-95bc-3d443cea995c" provision.type="other"><no>(i)</no><block><txt break.before="0">spend the majority of their labour on a primary production enterprise; and</txt></block></li><li id="sec.7-sec.3-def.primaryproducer-para1.b-para2.ii" guid="_c743c75b-c914-4ab9-89e8-d296905c0ed0" provision.type="other"><no>(ii)</no><block><txt break.before="0">either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.3-def.primaryproducer-para1.b-para2.ii-para3.A" guid="_46d0526a-8bf7-434b-a5cf-39b48ed7413a" provision.type="other"><no>(A)</no><block><txt break.before="0">derive the majority of their income from the primary production enterprise; or relevant to the primary production enterprise, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.6-para1.a-para2.i" guid="_abaacee0-7646-4277-8852-d128efb48ff7" provision.type="other"><no>(i)</no><block><txt break.before="0">viability risks; and</txt></block></li><li id="sec.7-sec.6-para1.a-para2.ii" guid="_7330f3c1-b239-43bd-8c91-58626fb772d5" provision.type="other"><no>(ii)</no><block><txt break.before="0">productivity risks; and</txt></block></li><li id="sec.7-sec.6-para1.a-para2.iii" guid="_bee10d47-5c81-4c77-86b3-b0342e0d1d3b" provision.type="other"><no>(iii)</no><block><txt break.before="0">business and climate risks, such as drought; and</txt></block></li></list></block></li><li id="sec.7-sec.6-para1.b" provision.type="other"><no>(c)</no><block><txt break.before="0">complies with the guidelines for resilience plans under the scheme that are issued by the authority. </txt></block></li></list><note if the authority is satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.9-ssec.1-para1.a" guid="_f5a6bbaa-198a-4705-8031-694577ca4774" provision.type="other"><no>(a)</no><block><txt break.before="0">the assistance is for a primary production enterprise carried on by a sole trader, partnership, proprietary company or trust; and</txt></block></li><li id="sec.7-sec.9-ssec.1-para1.b" guid="_a375c752-70cc-4c6e-af9c-cef60d856914" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant is the sole trader, partnership, proprietary company or trust that is carrying on the primary production enterprise; and</txt></block></li><li id="sec.7-sec.9-ssec.1-para1.c" guid="_4530c752-a068-47b4-b05b-7f6f26c42897" provision.type="other"><no>(c)</no><block><txt break.before="0">an interested person for the primary production enterprise is a primary producer; and</txt></block></li><li id="sec.7-sec.9-ssec.1-para1.d" guid="_1f32d7ae-b8b9-46f2-aaeb-8c9805d446c0" provision.type="other"><no>(d)</no><block><txt break.before="0">the applicant has given a resilience plan to the authority for the applicant’s primary production enterprise; and</txt></block></li><li id="sec.7-sec.9-ssec.1-para1.e" guid="_2833250f-3c2d-4ec8-8d88-e43d60f0c73a" provision.type="other"><no>(e)</no><block><txt break.before="0">the applicant has identified in the resilience plan an eligible project or eligible recovery activity to be completed with the assistance provided under the scheme; and</txt></block></li><li id="sec.7-sec.9-ssec.1-para1.f" guid="_32f27a8e-fe98-41b7-9f87-10397eab5cb2" provision.type="other"><no>(f)</no><block><txt break.before="0">the applicant can service the loan; and</txt></block></li><li id="sec.7-sec.9-ssec.1-para1.g" guid="_e40e4a53-3b85-4395-862f-322bc9996074" provision.type="other"><no>(g)</no><block><txt break.before="0">the applicant’s primary production enterprise is commercially viable or demonstrates sound prospects for commercial viability.</txt></block></li></list></block></subclause><subclause id="sec.7-sec.9-ssec.2" guid="_07bdb4f2-962a-4094-bb58-e3046218b285" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, the applicant is not eligible to receive assistance under the scheme if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.9-ssec.2-para1.a" guid="_ef8e0815-8e9e-45cd-8ef2-5e5aab1626db" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant or an interested person for the primary production enterprise has given to the department, in support of an application for DRAS funding, an invoice issued in the 6 months before the day the application for assistance is made; and</txt></block></li><li id="sec.7-sec.9-ssec.2-para1.b" guid="_07739405-0ba8-4b2c-8b64-bffadd689645" provision.type="other"><no>(b)</no><block><txt break.before="0">the applicant or the interested person received DRAS funding for the invoice.</txt></block></li></list></block></subclause><subclause id="sec.7-sec.9-ssec.3" guid="_7bca53cb-3709-4557-aa59-7e7da831fa26" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.7-sec.9-ssec.3-def.DRASfunding_" guid="_8c1bef84-a714-4000-91eb-56216b9ce4b7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-sec.9-ssec.3-def.DRASfunding" guid="_73223cb6-657e-4d7f-88ef-4dd1fdfc823f" type="definition">DRAS funding</defterm> means— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.9-ssec.3-def.DRASfunding-para1.a" guid="_a34a5bc6-92b5-453e-bbce-2537e3f41388" provision.type="other"><no>(a)</no><block><txt break.before="0">a freight subsidy under the program known as the Drought Relief Assistance Scheme administered by the department; or</txt></block></li><li id="sec.7-sec.9-ssec.3-def.DRASfunding-para1.b" guid="_30c952cc-1bb0-449c-a88f-aeb08e56936f" provision.type="other"><no>(b)</no><block><txt break.before="0">a rebate known as the Emergency Water Infrastructure Rebate under the program known as the Drought Relief Assistance Scheme administered by the department.</txt></block></li></list></definition><definition id="sec.7-sec.9-ssec.3-def.interestedperson_" guid="_5d87e438-9117-4f42-8375-dc53d4e7c5c1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-sec.9-ssec.3-def.interestedperson" application for assistance under the scheme must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-sec.14-ssec.1-para1.a" guid="_1872e187-3461-432d-a214-1c3e268275e7" provision.type="other"><no>(a)</no><block><txt break.before="0">be made on the authority’s application form; and</txt></block></li><li id="sec.7-sec.14-ssec.1-para1.b" guid="_f33da053-4f46-4321-94b9-7e6944b6feef" provision.type="other"><no>(b)</no><block><txt break.before="0">be accompanied by the documents stated on the application form; and</txt></block></li><li id="sec.7-sec.14-ssec.1-para1.c" guid="_e367cd6c-f875-47f6-a065-4a09d70cb9cb" provision.type="other"><no>(c)</no><block><txt break.before="0">be given to the authority.</txt></block></li></list></block></subclause><subclause id="sec.7-sec.14-ssec.2" guid="_d1966626-405b-4dbf-aec7-68f45ede8831" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the authority asks the applicant to provide further information to support the application, the applicant must provide the
