id="sec.6-sec.1-def.organiser-para1.a" guid="_4f0cdd40-6100-4158-82d2-d07b2d3d4ea5" provision.type="other"><no>(a)</no><block><txt break.before="0">generally, means the person conducting the rodeo; and</txt></block></li><li id="sec.6-sec.1-def.organiser-para1.b" guid="_ea1dbc5d-fa39-4030-b1ae-fa4608a33b94" provision.type="other"><no>(b)</no><block><txt break.before="0">includes a person purporting to conduct the rodeo.</txt></block></li></list></definition><definition id="sec.6-sec.1-def.personalusesupplier_" guid="_26bbf92d-4b60-4324-9d6d-939ab9b99c3f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.1-def.personalusesupplier" guid="_d7f10d14-b945-4cf5-9da5-fc139fdb6de7" type="definition">personal use supplier</defterm> means a person who supplies a rodeo animal owned by the person for the exclusive use of the person or another person for a rodeo activity.</txt></definition><definition id="sec.6-sec.1-def.poddyriding_" guid="_2c28beb3-c7c9-4ded-a228-c40d92a72ca2" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.1-def.poddyriding" guid="_ff2aa60e-78c4-4999-949e-bf1c9967b6ee" type="definition">poddy riding</defterm> see section 44.</txt></definition><definition id="sec.6-sec.1-def.protectionclown_" guid="_df4d98dc-6b54-4f94-9f3a-7d77a24f113e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.1-def.protectionclown" guid="_a39084ca-78d5-4dc1-a371-27d03e54571e" type="definition">protection clown</defterm> means a person, however called, who, during a rodeo activity, distracts a rodeo animal that has thrown a competitor to try to prevent the animal from injuring the competitor or another person.</txt></definition><definition id="sec.6-sec.1-def.responsibleperson_" guid="_5caf1890-41d1-4acf-b77d-b581e3c5c196" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.1-def.responsibleperson" guid="_6c8338ca-b5cf-4305-8890-8978133ea7b8" type="definition">responsible person</defterm>, for a rodeo animal at a rodeo, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.1-def.responsibleperson-para1.a" guid="_e15daa87-f7f8-4493-b6e0-105f24891317" provision.type="other"><no>(a)</no><block><txt break.before="0">the organiser for the rodeo; or</txt></block></li><li id="sec.6-sec.1-def.responsibleperson-para1.b" guid="_5a33f696-860d-4e4f-b667-ba9438303242" provision.type="other"><no>(b)</no><block><txt break.before="0">a rodeo animal welfare officer for the rodeo; or</txt></block></li><li id="sec.6-sec.1-def.responsibleperson-para1.c" guid="_760e7ae1-006b-43ec-9ef7-655131af76bf" provision.type="other"><no>(c)</no><block><txt break.before="0">another person who is in charge of the subsection (1) at a rodeo; or</txt></block></li><li id="sec.6-sec.3-ssec.2-para1.b" guid="_0975638d-de32-4649-9947-06e5acd7f3fe" provision.type="other"><no>(b)</no><block><txt break.before="0">to train a person or a rodeo animal in carrying on an activity mentioned in subsection (1) at a rodeo school.</txt></block></li></list></block></subclause></clause><clause id="sec.6-sec.4" rodeo.</txt></block></clause></part><part id="sec.6-frag-sch.3B-pt.2" guid="_0f7a72eb-9ddf-40d6-92b4-25c61d3f2b00" affected.by.uncommenced="0"><no>Part 2</no><heading id="sec.6-frag-sch.3B-pt.2-he" guid="_604ff8d7-943a-472e-a841-2ae8e2616352">General responsibilities of persons involved in rodeos</heading><clause id="sec.6-sec.5" guid="_3331d14b-c07f-4d38-8a24-b0332433beb9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.6-sec.5-he" guid="_b282c50d-d1bf-4ff0-8a8a-579b773584b7">Organiser’s responsibilities</heading><subclause id="sec.6-sec.5-ssec.1" guid="_eedee6ed-c4dd-42bf-a97e-e570b10f0816" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The organiser for a rodeo must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.5-ssec.1-para1.a" guid="_ec3fb899-b9ca-420d-bcb7-76515cbceeb5" provision.type="other"><no>(a)</no><block><txt break.before="0">appoint a person (a <defterm id="sec.6-sec.5-ssec.1-def.rodeoanimalwelfareofficer" guid="_3c6cd6df-4b3c-48ff-bd81-8ab6b25f263b" type="definition">rodeo animal welfare officer</defterm>) to be responsible for the welfare of rodeo animals at the rodeo; and</txt></block></li><li id="sec.6-sec.5-ssec.1-para1.b" guid="_add8b436-2f60-47fe-b832-e80ca820b4bb" provision.type="other"><no>(b)</no><block><txt break.before="0">appoint other rodeo officials required for conducting the rodeo; and</txt></block></li><li id="sec.6-sec.5-ssec.1-para1.c" guid="_298e8c7b-95d7-4478-9fa1-cc88388180a3" provision.type="other"><no>(c)</no><block><txt break.before="0">ensure each rodeo official at the rodeo is approved by a designated rodeo association; and</txt></block></li><li id="sec.6-sec.5-ssec.1-para1.d" guid="_d986627f-7f46-4fce-aced-dda196b1bae3" provision.type="other"><no>(d)</no><block><txt break.before="0">engage a veterinary surgeon to treat rodeo animals on the site of the rodeo, or to be available for consultation, while the rodeo is being conducted; and</txt></block></li><li id="sec.6-sec.5-ssec.1-para1.e" guid="_210e3b41-f8fe-4ab2-95ac-85cc305df6ed" provision.type="other"><no>(e)</no><block><txt break.before="0">ensure that each person involved in carrying on a rodeo activity has the experience, knowledge and skills required to carry out the person’s responsibilities under this code of practice. </txt></block></li></list></block></subclause><subclause id="sec.6-sec.5-ssec.2" guid="_e9582dc7-44d0-4af4-bd91-828da7e8ecf9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If a person, other than the organiser for a rodeo, is required under this code of practice to do a thing or omit to do a thing at or for the rodeo, the organiser for the rodeo must take reasonable steps to ensure the person complies with the requirement.</txt><note id="sec.6-sec.5-ssec.2-note" guid="_e8a86c20-9ca9-4107-aabd-78bc68319191" type="example"><heading id="sec.6-sec.5-ssec.2-note-he" guid="_6d78f3be-5ed3-4513-9ae1-6117822d469f">Examples of steps that may be reasonable for subsection (2)—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.5-ssec.2-note-para1" guid="_1b949156-951c-46d2-a670-e9f8fcd05561" provision.type="other"><no>•</no><block><txt break.before="0">giving an oral direction to a person about compliance with a requirement</txt></block></li><li id="sec.6-sec.5-ssec.2-note-para1-oc.2" guid="_c0be86c5-95b8-4506-8441-cc06939c733b" provision.type="other"><no>•</no><block><txt break.before="0">conspicuously displaying a sign about compliance with a requirement</txt></block></li><li id="sec.6-sec.5-ssec.2-note-para1-oc.3" guid="_e9a972ee-11d0-4983-9c19-e867c27e47ff" provision.type="other"><no>•</no><block><txt break.before="0">giving instruction or training to rodeo officials about compliance with requirements applying to them</txt></block></li></list></block></note></block></subclause></clause><clause id="sec.6-sec.6" guid="_ca9f03a5-4eb0-4766-b50f-0e402c1d0e59" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-sec.6-he" guid="_af018342-4f64-4fb7-8acb-9eadc4636cbd">Supplier’s responsibilities</heading><subclause id="sec.6-sec.6-ssec" guid="_a3bfbe67-f132-419c-b3d9-aae416b67f85" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="0">A person who supplies a rodeo animal for use at a rodeo must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.6-ssec-para1.a" guid="_e2bed7c3-39e6-4e51-9615-d69ad2b0ef89" provision.type="other"><no>(a)</no><block><txt break.before="0">ensure that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.6-ssec-para1.a-para2.i" guid="_34e31201-7fd1-4839-af5a-d2dfce4e67a1" provision.type="other"><no>(i)</no><block><txt break.before="0">if the animal is a bovine less than 3 months old—the animal is not prevented from accessing feed or water for more than 2 hours; or</txt></block></li><li id="sec.6-sec.6-ssec-para1.a-para2.ii" guid="_012285e9-da29-4a58-9dcd-de999f9bcd4d" provision.type="other"><no>(ii)</no><block><txt break.before="0">otherwise—the animal is not prevented from accessing water for more than 6 hours; and</txt></block></li></list></block></li><li id="sec.6-sec.6-ssec-para1.b" guid="_8cb5a4dc-a618-4077-99c0-644f416579dd" provision.type="other"><no>(b)</no><block><txt break.before="0">ensure that if the animal becomes lame, sick, distressed or otherwise unsuitable to be used for a rodeo activity, the animal—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.6-ssec-para1.b-para2.i" guid="_3be5c3d9-f706-4a62-9c52-02af3c4ddf80" provision.type="other"><no>(i)</no><block><txt break.before="0">is not used for, or is withdrawn from, the activity; and</txt></block></li><li id="sec.6-sec.6-ssec-para1.b-para2.ii" guid="_c04da0a2-0c8b-4b61-8835-b22e6d461096" provision.type="other"><no>(ii)</no><block><txt break.before="0">receives appropriate care, including, if appropriate, veterinary treatment; and</txt></block></li><li id="sec.6-sec.6-ssec-para1.b-para2.iii" guid="_11e78ebc-2bce-4a32-90a5-bfc23b4a98e7" provision.type="other"><no>(iii)</no><block><txt break.before="0">is killed as required under section 20, if necessary for the animal’s welfare.</txt></block></li></list></block></li></list></block></subclause></clause><clause id="sec.6-sec.7" guid="_89baa6fb-0688-4a80-9767-741725753782" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.6-sec.7-he" guid="_71558247-a7bf-4c54-aa68-90f91193fb66">Rodeo animal welfare officer’s responsibilities</heading><subclause id="sec.6-sec.7-ssec" guid="_d77fb51d-c1f8-4adb-a6f7-2da25a3fda89" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="0">A rodeo animal welfare officer for a rodeo must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.7-ssec-para1.a" guid="_b82a2df9-dc4f-4c45-ae90-92855f06c0ca" provision.type="other"><no>(a)</no><block><txt break.before="0">have the experience, knowledge and skills relating to the welfare of rodeo animals to enable the person to carry out the person’s responsibilities under this code of practice; and</txt></block></li><li id="sec.6-sec.7-ssec-para1.b" guid="_bfaa503b-b486-4841-8df9-b407415ab7c1" provision.type="other"><no>(b)</no><block><txt break.before="0">ensure that each rodeo animal to be used in the rodeo has been supplied by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.7-ssec-para1.b-para2.i" guid="_c2281d5d-4c04-4e1c-9782-5f766578e2ad" provision.type="other"><no>(i)</no><block><txt break.before="0">a stock contractor approved by a designated rodeo association; or </txt></block></li><li id="sec.6-sec.7-ssec-para1.b-para2.ii" guid="_b841676e-549f-4228-aaa8-93f927af589c" provision.type="other"><no>(ii)</no><block><txt break.before="0">a personal use supplier; and</txt></block></li></list></block></li><li id="sec.6-sec.7-ssec-para1.c" guid="_938ccefe-b937-42fc-954f-aa0ad184c02f" provision.type="other"><no>(c)</no><block><txt break.before="0">inspect each arena, chute and yard to be used for conducting the rodeo to check it is safe for rodeo animals and persons to use; and</txt></block></li><li id="sec.6-sec.7-ssec-para1.d" guid="_0512a329-c7d1-44cc-805e-f6a0c13f60b0" provision.type="other"><no>(d)</no><block><txt break.before="0">ensure that any aggressive or injured rodeo animal is managed to minimise the risk of injury to persons or other animals at the rodeo; and</txt></block></li><li id="sec.6-sec.7-ssec-para1.e" guid="_372256b4-5c20-4e4c-b4c7-db1b86bb5c6e" provision.type="other"><no>(e)</no><block><txt break.before="0">ensure that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.7-ssec-para1.e-para2.i" guid="_f36b5667-ab61-4729-b271-21dd61b2641e" provision.type="other"><no>(i)</no><block><txt break.before="0">a rodeo animal that is a bovine less than 3 months old is not prevented from accessing feed or water at the rodeo for more than 2 hours; and</txt></block></li><li id="sec.6-sec.7-ssec-para1.e-para2.ii" guid="_a1cf351d-86d6-44d3-8116-233b123dea9d" provision.type="other"><no>(ii)</no><block><txt break.before="0">another rodeo animal is not prevented from accessing water at the rodeo for more than 6 hours; and</txt></block></li></list></block></li><li id="sec.6-sec.7-ssec-para1.f" guid="_5114160a-45df-450a-a18a-eb5087cdaba6" provision.type="other"><no>(f)</no><block><txt break.before="0">ensure that a rodeo animal that becomes lame, sick, distressed or otherwise unsuitable to be used for a rodeo activity—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.7-ssec-para1.f-para2.i" guid="_0ee834b1-1ca6-48a8-b9e1-a1f3d09d1f45" provision.type="other"><no>(i)</no><block><txt break.before="0">is not used for, or is withdrawn from, the activity; and</txt></block></li><li id="sec.6-sec.7-ssec-para1.f-para2.ii" guid="_0e9b21fc-9d58-46c2-a0af-179c604d9d7b" provision.type="other"><no>(ii)</no><block><txt break.before="0">receives appropriate care, including, if appropriate, veterinary treatment; and</txt></block></li><li id="sec.6-sec.7-ssec-para1.f-para2.iii" guid="_0d33caa6-c571-4f50-90d7-1fa2934aedad" provision.type="other"><no>(iii)</no><block><txt break.before="0">is killed as required under section 20, if necessary for the animal’s welfare.</txt></block></li></list></block></li></list></block></subclause></clause><clause id="sec.6-sec.8" guid="_01b505fe-0ba7-497c-a209-d6e91a829dcf" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.6-sec.8-he" guid="_287035a5-eb71-465c-96e7-1573889a0694">Judge’s responsibilities</heading><subclause id="sec.6-sec.8-ssec" guid="_53d92cc6-27dc-4eda-a14e-9ad4ee6328a4" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="0">A judge for a rodeo activity must ensure a rodeo animal in a chute is safely released from the chute and withdrawn from the activity if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.8-ssec-para1.a" guid="_9755f37b-bd1c-4660-9c5c-fc1d73905e9a" provision.type="other"><no>(a)</no><block><txt break.before="0">the animal lies on the ground; or</txt></block></li><li id="sec.6-sec.8-ssec-para1.b" guid="_d0484844-b805-496c-ac77-a69437ae4256" provision.type="other"><no>(b)</no><block><txt break.before="0">the animal tries to climb out of the chute twice; or</txt></block></li><li id="sec.6-sec.8-ssec-para1.c" guid="_21cf53b9-25bb-4329-b615-fd053f02f5b0" provision.type="other"><no>(c)</no><block><txt break.before="0">the judge reasonably believes it is in the interests of the animal’s welfare to withdraw it from the activity.</txt></block></li></list></block></subclause></clause><clause id="sec.6-sec.9" guid="_5d43e76d-b16c-4f32-ad35-9c2a543a6513" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.6-sec.9-he" guid="_b0c22546-c6da-42f2-b320-b698ae720b73">Protection clown’s responsibilities</heading><subclause id="sec.6-sec.9-ssec.1" guid="_4e0c48f6-2b57-477f-b091-5154d4901b92" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A protection clown may distract a rodeo animal used for a rodeo activity to try to prevent it from injuring a person competing in the activity or another person. </txt></block></subclause><subclause id="sec.6-sec.9-ssec.2" guid="_f5b91928-2b5a-425c-913f-0adbcf6e8d1b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, a protection clown must not provoke a rodeo animal to a greater extent than is necessary for carrying out the protection clown’s responsibility under subsection (1).</txt></block></subclause></clause><clause id="sec.6-sec.10" guid="_5a8a6ad2-a1ab-45ac-80e5-ba93bb092e66" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.6-sec.10-he" guid="_e4bb6676-81ed-417b-b9de-fec00f1219c1">Competitor’s responsibilities</heading><block><txt break.before="1">A person who competes in a rodeo activity at a rodeo must comply with all reasonable directions given to the person by a rodeo official or a veterinary surgeon about carrying on the rodeo activity. </txt></block></clause><clause id="sec.6-sec.11" guid="_7e9e681f-8a23-47d0-97be-37c3d2442357" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.6-sec.11-he" guid="_5024c8af-6c0c-4dfc-8be5-4c7e02d066f1">Veterinary surgeon’s responsibilities</heading><block><txt break.before="1">A veterinary surgeon who is engaged for a rodeo for a purpose mentioned in section 5(1)(d) must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.11-para1.a" guid="_6067d215-fceb-48de-abc0-6bde9d4c42b2" provision.type="other"><no>(a)</no><block><txt break.before="0">if present on the site of the rodeo while the rodeo is being conducted—treat all sick, injured or distressed rodeo animals—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.11-para1.a-para2.i" guid="_fac44630-52a1-489f-89e6-67b771eca42a" provision.type="other"><no>(i)</no><block><txt break.before="0">at the request of the organiser for the rodeo; or </txt></block></li><li id="sec.6-sec.11-para1.a-para2.ii" guid="_2ec50e41-9d5b-4ecc-bc3d-ba2798491623" provision.type="other"><no>(ii)</no><block><txt break.before="0">as the veterinary surgeon otherwise considers appropriate; or</txt></block></li></list></block></li><li id="sec.6-sec.11-para1.b" guid="_536e9f08-5a40-415f-9c52-5cbc75ad8922" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—be available for consultation while rodeo animals are on the site of the rodeo.</txt></block></li></list></block></clause></part><part id="sec.6-frag-sch.3B-pt.3" guid="_579bd297-e4e2-4e54-a74d-dfa00e7e7b4a" affected.by.uncommenced="0"><no>Part 3</no><heading id="sec.6-frag-sch.3B-pt.3-he" guid="_5f006d02-0536-4738-bd4d-f6a694c36941">Facilities for use with rodeo animals</heading><clause id="sec.6-sec.12" guid="_34894100-2c11-4b5b-9e71-dff0c9f9d06b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.6-sec.12-he" guid="_ebf65836-9c4e-46de-b929-c40592b276b3">Design, construction and maintenance of facilities</heading><subclause id="sec.6-sec.12-ssec" guid="_70855eab-bd4d-4ca6-a05c-e0ac18bcf7e5" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="0">The organiser for a rodeo must ensure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.12-ssec-para1.a" guid="_ca7a5873-19ee-49b7-84cc-b7b59ba6e03b" provision.type="other"><no>(a)</no><block><txt break.before="0">each chute, fence, gate and race used at the rodeo—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.12-ssec-para1.a-para2.i" guid="_ef2dc2e3-c4e3-424c-af87-c1d9414b4ed0" provision.type="other"><no>(i)</no><block><txt break.before="0">is structurally sound; and</txt></block></li><li id="sec.6-sec.12-ssec-para1.a-para2.ii" guid="_09d1897f-7b46-4fba-a85b-21998d73ce18" provision.type="other"><no>(ii)</no><block><txt break.before="0">is designed to allow rodeo animals to be handled quietly and efficiently; and</txt></block></li><li id="sec.6-sec.12-ssec-para1.a-para2.iii" guid="_ac032955-5575-4423-bd17-1736d121c4eb" provision.type="other"><no>(iii)</no><block><txt break.before="0">is constructed and maintained to minimise the risk of injury to rodeo animals; and</txt></block></li></list></block></li><li id="sec.6-sec.12-ssec-para1.b" guid="_857a084a-f9fe-4ecf-89e1-4ce4ab6e4c14" provision.type="other"><no>(b)</no><block><txt break.before="0">each chute used at the rodeo is large enough to allow a rodeo animal in the chute to stand freely; and</txt></block></li><li id="sec.6-sec.12-ssec-para1.c" guid="_d3f6fb62-031c-4056-a83c-0104c32298e9" provision.type="other"><no>(c)</no><block><txt break.before="0">each arena, lane and yard used at the rodeo is large enough to minimise the risk of injury being caused to a rodeo animal by contacting the fence bounding the arena, lane or yard; and</txt></block></li><li id="sec.6-sec.12-ssec-para1.d" guid="_7da56bd2-7d2f-4ec3-bb4c-14863c5930f4" provision.type="other"><no>(d)</no><block><txt break.before="0">each yard used at the rodeo is large enough to allow the rodeo animals in the yard to— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.12-ssec-para1.d-para2.i" guid="_ada7b835-0357-42be-99c5-8f5f57c55a13" provision.type="other"><no>(i)</no><block><txt break.before="0">move reasonably freely; and</txt></block></li><li id="sec.6-sec.12-ssec-para1.d-para2.ii" guid="_c6434d69-a9e7-44aa-9cd4-47cd1a27e715" provision.type="other"><no>(ii)</no><block><txt break.before="0">lie down and rise without help.</txt></block></li></list></block></li></list></block></subclause></clause></part><part id="sec.6-frag-sch.3B-pt.4" guid="_ec2847d0-d784-48b5-bb99-4dae149a6d03" affected.by.uncommenced="0"><no>Part 4</no><heading id="sec.6-frag-sch.3B-pt.4-he" guid="_cc10de69-645e-44db-a9e2-5f6ed6fec270">Handling and use of rodeo affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person (the <defterm id="sec.6-sec.14-def.relevantperson" guid="_094755c5-fde3-4aea-b260-0f20b342c4cc" type="definition">relevant person</defterm>) may supply a rodeo animal for use at a rodeo only if the animal is suitable for use under this section.</txt></block></subclause><subclause id="sec.6-sec.14-ssec.2" guid="_53cbedba-ad58-4543-817c-3ef491e20b80" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A responsible person for a rodeo animal at a rodeo (also the <defterm id="sec.6-sec.14-def.relevantperson-oc.2" guid="_7604788b-f91e-4846-bbc3-70707a93a2e3" type="definition">relevant person</defterm>) may allow a rodeo animal to be used at a rodeo only if the animal is suitable for use under this section.</txt></block></subclause><subclause id="sec.6-sec.14-ssec.3" guid="_e017234d-db9e-4a13-b25a-9d23bbe1b0d0" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For subsection (1) or (2), a rodeo animal is suitable for use at a rodeo if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.14-ssec.3-para1.a" guid="_04f6b92f-639d-4f83-b30f-2b9377525e1f" provision.type="other"><no>(a)</no><block><txt break.before="0">the animal is in good health; and</txt></block></li><li id="sec.6-sec.14-ssec.3-para1.b" guid="_1a16b2d7-d06f-4af6-b496-f77ef5305481" provision.type="other"><no>(b)</no><block><txt break.before="0">for a rodeo animal that is a bovine—the animal has a condition score of 2, 3 or 4 under section 66; and</txt></block></li><li id="sec.6-sec.14-ssec.3-para1.c" guid="_7444d1ef-7ecb-494b-8ddd-2d3aaa784f76" provision.type="other"><no>(c)</no><block><txt break.before="0">for a rodeo animal that is a horse—the animal has a condition score of 3 or 4 under section 67.</txt></block></li></list></block></subclause><subclause id="sec.6-sec.14-ssec.4" guid="_e244160f-49d7-4bc0-bf93-9123e14152b7" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, a rodeo animal is not suitable for use at a rodeo if the relevant person knows, or ought reasonably to know, the animal is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.14-ssec.4-para1.a" guid="_84fb8c6a-5ef2-4e94-8784-ee901a9818ef" provision.type="other"><no>(a)</no><block><txt break.before="0">pregnant; or</txt></block></li><li id="sec.6-sec.14-ssec.4-para1.b" guid="_66ffb642-1852-40a4-9aa4-e7ef71ccef3c" provision.type="other"><no>(b)</no><block><txt break.before="0">lactating with dependant or unweaned young; or</txt></block></li><li id="sec.6-sec.14-ssec.4-para1.c" guid="_5b725875-ee45-4516-a73b-a1ddceaed825" provision.type="other"><no>(c)</no><block><txt break.before="0">suffering from a condition that is likely to cause the animal pain.</txt></block></li></list></block></subclause><note id="sec.6-sec.14-note" guid="_de03edbd-e2d2-4cac-bbe4-fad5165ff973" type="example"><heading id="sec.6-sec.14-note-he" guid="_5c17a708-9548-47e7-9a40-62412e3bfab3">Note—</heading><block><txt guid="_463b1502-911c-48ab-9e20-3690a565fd62">Ensuring adequate space for rodeo animal in a yard</heading><subclause id="sec.6-sec.15-ssec" guid="_f05ab6ab-3954-44e4-9653-155c83d81dd4" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="0">A responsible person for a rodeo animal in a yard must ensure the animal has adequate space to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.15-ssec-para1.a" guid="_1816d47b-dc5c-4aeb-9be0-5bea18a8c879" provision.type="other"><no>(a)</no><block><txt break.before="0">move reasonably freely; and</txt></block></li><li id="sec.6-sec.15-ssec-para1.b" guid="_6dab4308-5376-44ca-bfa2-d702560f2751" provision.type="other"><no>(b)</no><block><txt break.before="0">lie down and rise without help.</txt></block></li></list></block></subclause></clause><clause id="sec.6-sec.16" guid="_7384905e-dd8f-40ed-9823-226495000fc7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.6-sec.16-he" guid="_9001346d-782b-410d-96ff-81a782eb6840">Handling a rodeo animal in a chute</heading><subclause id="sec.6-sec.16-ssec" guid="_6531321a-e54f-41f2-b755-44b7cf77756f" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="0">A person must not provoke a rodeo animal in a chute to a greater extent than is necessary to use the animal to carry on the rodeo activity in which the animal is involved.</txt><note id="sec.6-sec.16-ssec-note" guid="_92d98a51-e9d6-4209-9ed7-04d85b4c7d76" spent.amends="0" provision.type="other"><no>17</no><heading id="sec.6-sec.17-he" guid="_3d77d943-1b1a-49fe-903a-2e8518961f93">Pulling or twisting a rodeo animal’s tail</heading><subclause id="sec.6-sec.17-ssec" guid="_d90ef58f-d613-4eb6-8dc8-983f7ca3a36b" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="0">A person must not pull or twist a rodeo animal’s tail unless the pulling or twisting is necessary to prevent the animal from falling or is otherwise in the interests of the animal’s welfare.</txt></block></subclause></clause><clause id="sec.6-sec.18" guid="_6b446f34-60b7-4ae1-b861-a8d8531fbe50" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>18</no><heading id="sec.6-sec.18-he" id="sec.6-sec.19-he" guid="_4c6c16af-af4f-435e-9dc1-6267155111b2">Exposure to fireworks and other noise</heading><subclause id="sec.6-sec.19-ssec.1" guid="_d3346fe2-5b8b-48ee-86b1-6c65c14e21d6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The organiser for a rodeo must take reasonable steps to prevent a rodeo animal from being unduly disturbed by noise at the rodeo.</txt></block></subclause><subclause id="sec.6-sec.19-ssec.2" guid="_98fba267-e057-46e9-95d8-a107ecbafe2f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting subsection (1), the organiser must ensure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.19-ssec.2-para1.a" guid="_d35b092d-f181-471f-8c95-25d8496b4ec7" provision.type="other"><no>(a)</no><block><txt break.before="0">no rodeo animal is in an arena while fireworks are being used in the arena; and</txt></block></li><li id="sec.6-sec.19-ssec.2-para1.b" guid="_66ccc4df-937f-41f9-83e7-d7a9979f9ca6" provision.type="other"><no>(b)</no><block><txt break.before="0">a rodeo animal is kept far enough away from fireworks to prevent the animal from being unduly disturbed by noise from the fireworks.</txt></block></li></list></block></subclause></clause><clause id="sec.6-sec.20" guid="_08a7a131-bbab-43a7-8647-2c43099d6430" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.6-sec.20-he" guid="_7ff187b4-0cf2-4a93-ae35-029fab775e17">Killing rodeo animal</heading><subclause id="sec.6-sec.20-ssec.1" guid="_fd71fcd0-c1c4-4689-8b74-13fdb4e4f0fa" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person may kill a rodeo animal at a rodeo if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.20-ssec.1-para1.a" guid="_92afa2a1-5e8e-4c89-a1bb-5911ffb31da7" provision.type="other"><no>(a)</no><block><txt break.before="0">the person is a veterinary surgeon; or</txt></block></li><li id="sec.6-sec.20-ssec.1-para1.b" guid="_349b30b9-faf2-49bb-bb7f-affcbc021f0e" provision.type="other"><no>(b)</no><block><txt break.before="0">the person is acting under the direct supervision of a veterinary surgeon. </txt></block></li></list></block></subclause><subclause id="sec.6-sec.20-ssec.2" guid="_c195cfc6-fce0-484f-940a-feb0648c1a4e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person, other than a person mentioned in subsection (1), may kill a rodeo animal at a rodeo if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.20-ssec.2-para1.a" guid="_67e8ba2a-eba5-48f4-8877-61affdf6d188" provision.type="other"><no>(a)</no><block><txt break.before="0">it is necessary to kill the animal to prevent it from suffering; and</txt></block></li><li id="sec.6-sec.20-ssec.2-para1.b" guid="_5888a9b8-0c8a-4cad-a293-c87f5af5ef8f" provision.type="other"><no>(b)</no><block><txt break.before="0">it would be inhumane to delay killing the animal until a person could kill it under subsection (1).</txt></block></li></list></block></subclause><subclause id="sec.6-sec.20-ssec.3" guid="_f8010835-c2b2-4347-bea6-637f996e31c5" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person who kills a rodeo animal at a rodeo must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.20-ssec.3-para1.a" guid="_61d13d17-ac7c-4a27-afa9-3e46ecd42b39" provision.type="other"><no>(a)</no><block><txt break.before="0">ensure the animal is killed humanely; and</txt></block></li><li id="sec.6-sec.20-ssec.3-para1.b" guid="_ee336dae-d1ca-49cf-85c9-e524a27934f9" provision.type="other"><no>(b)</no><block><txt break.before="0">confirm the animal is dead by reference to at least 2 of the following indicia—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.20-ssec.3-para1.b-para2.i" guid="_d9735780-c889-4922-a20f-c2f5c13ec196" provision.type="other"><no>(i)</no><block><txt break.before="0">the absence of a heart beat; </txt></block></li><li id="sec.6-sec.20-ssec.3-para1.b-para2.ii" guid="_2de33727-8942-4f10-92b6-ce6e9b99fcc0" provision.type="other"><no>(ii)</no><block><txt break.before="0">the absence of rhythmic breathing; </txt></block></li><li id="sec.6-sec.20-ssec.3-para1.b-para2.iii" guid="_d52e4280-a532-49e8-88b8-1680cd450a17" provision.type="other"><no>(iii)</no><block><txt break.before="0">the absence of a blinking reflex. </txt></block></li></list></block></li></list></block></subclause></clause><clause id="sec.6-sec.21" guid="_71674faa-af58-4e64-bdeb-cd3613a22a5a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.6-sec.21-he" guid="_c031f35b-1898-40ca-9d05-7cbef53d9cba">Rodeo animal incident record</heading><subclause id="sec.6-sec.21-ssec.1" guid="_dae33b43-a42c-4573-8427-089d68534307" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a rodeo animal becomes sick or is injured or killed at a rodeo (each of which is an <defterm id="sec.6-sec.21-def.incident" guid="_a88f5926-1971-465d-9046-f77487ce4efe" type="definition">incident</defterm>).</txt></block></subclause><subclause id="sec.6-sec.21-ssec.2" guid="_0ed4badd-05de-477b-bdd6-1e4cec8febf4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The organiser for the rodeo must ensure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.21-ssec.2-para1.a" guid="_dab1ddd9-1154-477e-9a18-94f724c32cee" provision.type="other"><no>(a)</no><block><txt break.before="0">a written record, complying with subsection (3), is prepared about the incident; and</txt></block></li><li id="sec.6-sec.21-ssec.2-para1.b" guid="_519f635d-fab9-480f-8edc-8d6685cdf16b" provision.type="other"><no>(b)</no><block><txt break.before="0">a record prepared under paragraph (a) is kept for at least 2 years after the rodeo ends.</txt></block></li></list></block></subclause><subclause id="sec.6-sec.21-ssec.3" guid="_8105043f-8089-40b0-878a-4b2b31405e37" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The record must state—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.21-ssec.3-para1.a" guid="_547d70eb-f7f3-4a93-855c-3955d1183299" provision.type="other"><no>(a)</no><block><txt break.before="0">the date and location of the rodeo; and</txt></block></li><li id="sec.6-sec.21-ssec.3-para1.b" guid="_25b77619-6bbd-4557-8913-a2aa89116fd1" provision.type="other"><no>(b)</no><block><txt break.before="0">the name of the organiser; and</txt></block></li><li id="sec.6-sec.21-ssec.3-para1.c" guid="_4ff93a36-578d-4367-a74b-33a6d0dce569" provision.type="other"><no>(c)</no><block><txt break.before="0">a description of the incident, including, if relevant, the number and types of injuries to the rodeo animal; and</txt></block></li><li id="sec.6-sec.21-ssec.3-para1.d" guid="_d855a3e9-7f6b-4491-97eb-527500158215" provision.type="other"><no>(d)</no><block><txt break.before="0">details of the action taken in response to the incident, including any veterinary treatment given to the rodeo animal; and</txt></block></li><li id="sec.6-sec.21-ssec.3-para1.e" guid="_058332e8-eeb2-4f4b-b931-32c546f87882" provision.type="other"><no>(e)</no><block><txt break.before="0">if a veterinary surgeon treated, or was consulted about, the rodeo animal—the name of the veterinary surgeon; and </txt></block></li><li id="sec.6-sec.21-ssec.3-para1.f" guid="_d4282984-36d1-40ff-a9ba-2b10aaf6f92d" provision.type="other"><no>(f)</no><block><txt break.before="0">if the incident happened during, or was otherwise related to, a rodeo activity—the name of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.21-ssec.3-para1.f-para2.i" guid="_c1d9ab9b-d05a-404f-a53c-6ff8e0b7a7ce" provision.type="other"><no>(i)</no><block><txt break.before="0">each person involved in carrying on the rodeo activity; and</txt></block></li><li id="sec.6-sec.21-ssec.3-para1.f-para2.ii" guid="_2e440ab0-df46-458c-a175-323b59713cb6" provision.type="other"><no>(ii)</no><block><txt break.before="0">anyone else who was involved in the incident.</txt></block></li></list></block></li></list></block></subclause></clause></part><part id="sec.6-frag-sch.3B-pt.5" guid="_15704b1d-d05a-4c33-b19f-f9f029aabb17" affected.by.uncommenced="0"><no>Part 5</no><heading id="sec.6-frag-sch.3B-pt.5-he" guid="_b1fd0d4d-8ff5-436b-a305-b93850db041c">Use of equipment on rodeo guid="_4727f320-558b-4991-a0ad-439fd7b7c053">Competency to use equipment on rodeo animal</heading><block><txt break.before="1">The organiser for a rodeo must ensure each person who uses equipment on a rodeo animal at the rodeo—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.23-para1.a" guid="_af1f57ed-62eb-4e76-b6cb-62e13e90b7a5" provision.type="other"><no>(a)</no><block><txt break.before="0">has the experience, knowledge and skills required to use the equipment under this code of practice; or</txt></block></li><li id="sec.6-sec.23-para1.b" guid="_27b53513-c222-4c21-be96-6d0e11b04870" provision.type="other"><no>(b)</no><block><txt break.before="0">uses the equipment under the supervision of a person who has the experience, knowledge and skills mentioned in paragraph (a).</txt></block></li></list></block></clause><clause id="sec.6-sec.24" guid="_f63c01dd-eb0a-4ce5-84b2-2be1eeb6fc87" animal while the animal is in a chute.</txt></block></subclause></clause><clause id="sec.6-sec.25" guid="_f95a6367-47ed-4993-a855-0d094f4cc6f4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>25</no><heading id="sec.6-sec.25-he" guid="_204e2c36-64bf-4f2a-b2c8-fdf12bc8875e">Use of electrical prod on bovine</heading><subclause id="sec.6-sec.25-ssec.1" guid="_3e069f14-cae0-427f-85d5-30532e9dca90" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a person for using an electrical prod on a rodeo animal that is a bovine.</txt><note id="sec.6-sec.25-ssec.1-note" guid="_bad0c22b-dcc8-48c6-ac7a-cab699798e7e" type="example"><heading id="sec.6-sec.25-ssec.1-note-he" guid="_0d8417e0-5de9-43a2-9fc5-a9aa617327da">Note—</heading><block><txt break.before="1">See section 6A of this regulation under which an electrical prod is prescribed for horses for section 18(2)(e) of the Act.</txt></block></note></block></subclause><subclause id="sec.6-sec.25-ssec.2" guid="_70490d4d-fd6a-461b-9962-d8aec0e92e63" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person may use an electrical prod on the bovine only if— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.25-ssec.2-para1.a" guid="_e5489d1b-d116-4fbb-a451-59a66aa69395" provision.type="other"><no>(a)</no><block><txt break.before="0">the person is in charge of the bovine; and</txt></block></li><li id="sec.6-sec.25-ssec.2-para1.b" guid="_39f9f7eb-ae02-4f17-a4a7-55efc41f7e04" provision.type="other"><no>(b)</no><block><txt break.before="0">either—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.25-ssec.2-para1.b-para2.i" guid="_249f2048-d6c9-472b-9b09-26716824baeb" provision.type="other"><no>(i)</no><block><txt break.before="0">the bovine is at least 3 months old; or</txt></block></li><li id="sec.6-sec.25-ssec.2-para1.b-para2.ii" guid="_bd2a942b-1107-40ee-8966-5f18cb6cfec0" provision.type="other"><no>(ii)</no><block><txt break.before="0">it is necessary to use the prod in the interests of the bovine’s welfare; and</txt></block></li></list></block></li><li id="sec.6-sec.25-ssec.2-para1.c" guid="_c3c5ef86-e429-4880-9bb6-4eeabeed862b" provision.type="other"><no>(c)</no><block><txt break.before="0">the person has made reasonable efforts to move the bovine without using an electrical prod and the bovine has not moved; and</txt></block></li><li id="sec.6-sec.25-ssec.2-para1.d" guid="_dfca112a-a059-45fd-814f-7f17298197ff" provision.type="other"><no>(d)</no><block><txt break.before="0">the bovine is able to move away from the prod; and</txt></block></li><li id="sec.6-sec.25-ssec.2-para1.e" guid="_f10de540-4232-48b3-a6ea-2e29f0981c27" provision.type="other"><no>(e)</no><block><txt break.before="0">the person uses the prod as sparingly as possible.</txt></block></li></list></block></subclause><subclause id="sec.6-sec.25-ssec.3" guid="_e51143a8-2b50-4d30-8b36-1c848e5edf6b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, a person must not use an electrical prod on the face, udders, anus or genitals of the bovine.</txt></block></subclause><subclause id="sec.6-sec.25-ssec.4" guid="_91c21fd4-d7d4-47a3-9d6f-22e16f74d773" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Also, a person must not use an electrical prod on the bovine if it is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.25-ssec.4-para1.a" guid="_1f4f612d-5405-41b0-9550-5815f1ca54d6" provision.type="other"><no>(a)</no><block><txt break.before="0">in an arena; or</txt></block></li><li id="sec.6-sec.25-ssec.4-para1.b" guid="_9bdec5bf-3dfa-4807-874d-b0186136e306" provision.type="other"><no>(b)</no><block><txt break.before="0">in a chute, unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.25-ssec.4-para1.b-para2.i" guid="_f76c8457-8ea4-41b6-a336-624ab996516a" provision.type="other"><no>(i)</no><block><txt break.before="0">the use of the prod is necessary for the safety of the bovine or a person riding the bovine; and</txt></block></li><li id="sec.6-sec.25-ssec.4-para1.b-para2.ii" guid="_eeb6fd67-d8fe-4527-a417-b317d27748cf" provision.type="other"><no>(ii)</no><block><txt break.before="0">the prod is used only on the shoulder or hindquarters of the bovine.</txt></block></li></list></block></li></list></block></subclause></clause><clause id="sec.6-sec.26" guid="_18d1bef7-6b43-4567-adfc-b4392d70a70e" affected.by.uncommenced="0" spent.amends="0"
