break.before="0">Without limiting subsection (2), the lessor has a reasonable excuse if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.3-para1.a" guid="_1220864d-c0e4-4128-b8aa-b15253502c24" provision.type="other"><no>(a)</no><block><txt break.before="0">for a notice to leave given to the tenant under repealed section 35—the lessor proves—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.3-para1.a-para2.i" guid="_85b10ba6-a6f3-420d-bae4-400036b7458b" provision.type="other"><no>(i)</no><block><txt break.before="0">the lessor genuinely made the premises available for sale but no offers, acceptable to the lessor, were received; or</txt><note id="sec.5-ssec.2-frag-ssec.3-para1.a-para2.i-note" guid="_c37c82f2-d36d-4941-a38f-712427b87e21" type="example"><heading id="sec.5-ssec.2-frag-ssec.3-para1.a-para2.i-note-he" guid="_48503e00-9b68-44ae-a11d-3c6008f0e345">Example—</heading><block><txt break.before="1">The only offers the lessor received were below the lessor’s expected sale price.</txt></block></note></block></li><li id="sec.5-ssec.2-frag-ssec.3-para1.a-para2.ii" guid="_4941bf08-45ff-49be-baad-e56ae3d719f0" provision.type="other"><no>(ii)</no><block><txt break.before="0">the lessor entered into a contract for the sale of the premises but the contract ended without the sale of the premises; or</txt><note id="sec.5-ssec.2-frag-ssec.3-para1.a-para2.ii-note" guid="_84a6bbc0-027e-4e39-9938-862c43af5f39" type="example"><heading id="sec.5-ssec.2-frag-ssec.3-para1.a-para2.ii-note-he" guid="_fd7b7c1d-802a-497b-9a6f-8c3c527832c5">Example—</heading><block><txt break.before="1">The contract was terminated by the buyer under a term of the contract or a statutory right, including a cooling-off period.</txt></block></note></block></li></list></block></li><li id="sec.5-ssec.2-frag-ssec.3-para1.b" guid="_f2f507fb-491d-416e-b4f4-1de5678eb7bf" provision.type="other"><no>(b)</no><block><txt break.before="0">for a notice to leave given to the tenant under repealed section 37—the lessor proves—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-frag-ssec.3-para1.b-para2.i" guid="_38521430-ea74-4ebb-bdb5-896a53183344" provision.type="other"><no>(i)</no><block><txt break.before="0">the intended occupant’s need to occupy the premises has ended or the intended occupant became unable to occupy the premises; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.3-para1.b-para2.ii" guid="_cf30a1c7-3f13-42aa-bc54-01fadab2df08" provision.type="other"><no>(ii)</no><block><txt break.before="0">the lessor did not offer a residential tenancy for the premises until after the intended occupant’s need ended or the occupant became unable to occupy the premises; and</txt></block></li><li id="sec.5-ssec.2-frag-ssec.3-para1.b-para2.iii" guid="_442519b3-7157-4af3-8f3b-f68e67c6f7eb" provision.type="other"><no>(iii)</no><block><txt break.before="0">the premises remained vacant between the tenant moving out and the offer mentioned in subparagraph (ii) being accepted.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-ssec.2-frag-ssec.4" guid="_0117b5e5-c8c2-41ba-bec1-20acde90e5c1" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-ssec.2-frag-ssec.4-def.intendedoccupant_" guid="_28e2c211-4de3-4c2d-972a-bac8f5968858" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.2-frag-ssec.4-def.intendedoccupant" guid="_dadc6c33-a01c-448b-b254-9fee0d9e7663" type="definition">intended occupant</defterm>, for premises for which a notice to leave was given under repealed section 37, means the lessor or member of the lessor’s immediate family whose need to occupy the premises formed the basis for giving the notice to leave.</txt></definition></deflist></block></subclause></fragment></block></subclause></clause><clause id="sec.6"
