affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-div.2-sec.50-def.amendingregulation" guid="_85df728c-52fd-4284-90ae-a482ae44e4ba" type="definition">amending regulation </defterm>means the <legref type="subordleg" valid.date="as.made" check="invalid" jurisd="QLD"><name emphasis="yes">Retail Shop Leases and Other Commercial Leases (COVID-19 Emergency Response) Amendment Regulation 2021</name></legref>.</txt></definition><definition id="sec.6-frag-div.2-sec.50-def.ineligiblelease_" guid="_5eac5066-b700-4d09-8a07-7186639cfada" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-frag-div.2-sec.50-def.ineligiblelease" guid="_d0a9d16c-c37c-4943-98d3-89def627d317" type="definition">ineligible lease</defterm> means a lease of premises that, other than for the commencement of the amending regulation, would have been an affected lease.</txt><note id="sec.6-frag-div.2-sec.50-def.ineligiblelease-note" guid="_9fbae7b2-fe52-4b8d-bfcf-b9627e5edc56" type="example"><heading id="sec.6-frag-div.2-sec.50-def.ineligiblelease-note-he" guid="_9fa00d3e-9bf8-4487-93ce-d8017f924dde">Note—</heading><block><txt break.before="1">On the commencement, an entity was an<sub/> SME entity only if its annual turnover for the previous financial year, or its likely turnover for the current financial year, was less than $50m. See, however, the <legref jurisd="CTH" check="invalid" type="act"><name emphasis="yes">Guarantee of Lending to Small and Medium Enterprises (Coronavirus Economic Response Package) Amendment Rules 2020 </name>(Cwlth)</legref>.</txt></block></note></definition></deflist></block></clause><clause id="sec.6-frag-div.2-sec.51" guid="_fc2ef490-5359-4368-903e-575d99d355ce" provision.type="transitional" affected.by.uncommenced="0" spent.amends="0"><no>51</no><heading id="sec.6-frag-div.2-sec.51-he" guid="_d1f9246a-9c9a-4d02-8207-e1d2d9113c41">Application of s 5 for ineligible leases</heading><subclause id="sec.6-frag-div.2-sec.51-ssec.1" guid="_73b4d579-d2ac-46ea-a53f-e35c667ada5a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section is subject to sections 52 and 53.</txt></block></subclause><subclause id="sec.6-frag-div.2-sec.51-ssec.2" guid="_a6dfe5a6-13dd-40a3-9ff1-a9ad662b0cf5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Section 5(5), definition <defterm guid="_073dca36-d0ca-47d5-a388-7bbc95deda85" type="mention">SME entity</defterm> applies, and is taken to have always applied, for working out whether or not a lease of premises is an affected lease.</txt></block></subclause><subclause id="sec.6-frag-div.2-sec.51-ssec.3" guid="_a3a6c111-7616-4fde-8aea-76e84b209d61" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For subsection (2), the following apply in relation to an ineligible lease—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-div.2-sec.51-ssec.3-para1.a" guid="_e13a18ab-c9f4-41a4-88a3-7167c1738b44" provision.type="other"><no>(a)</no><block><txt break.before="0">if, before the commencement, the lessor had refrained from taking a prescribed action during the extension period under section 12—from the commencement the lessor may take a prescribed action under the lease as if section 12 had never applied for the lease;</txt></block></li><li id="sec.6-frag-div.2-sec.51-ssec.3-para1.b" guid="_c0823be2-2e89-413a-8903-1ed6041ace43" provision.type="other"><no>(b)</no><block><txt break.before="0">if, before the commencement, the lessee had applied to QCAT or a court for an order mentioned in section 12(3)—on the commencement the application lapses;</txt></block></li><li id="sec.6-frag-div.2-sec.51-ssec.3-para1.c" guid="_417d603d-0c14-425f-8296-b7f24ede73d6" provision.type="other"><no>(c)</no><block><txt break.before="0">if, before the commencement, the lessor had refrained from increasing the rent payable or taking a prescribed action under section 13—from the commencement the lessor may, under the lease, increase the rent payable, or take the prescribed action against the lessee, as if section 13 had never applied for the lease;</txt></block></li><li id="sec.6-frag-div.2-sec.51-ssec.3-para1.d" guid="_f9f7aee6-bf80-455d-9960-3cd4830fdd35" provision.type="other"><no>(d)</no><block><txt break.before="0">if, before the commencement, the lessor had made an offer under section 15 and the offer had not been accepted in writing—on the commencement the offer is taken to have been withdrawn;</txt></block></li><li id="sec.6-frag-div.2-sec.51-ssec.3-para1.e" guid="_c932d5c0-084e-4267-ad7a-04d9e06d21bc" provision.type="other"><no>(e)</no><block><txt break.before="0">if, before the commencement, a dispute notice was given to the small business commissioner under section 26 in relation to the lease—on the commencement the notice is taken to have been withdrawn under section 35.</txt></block></li></list></block></subclause></clause><clause id="sec.6-frag-div.2-sec.52" guid="_f0e736ce-a576-4e87-96c2-3b82162e449d" provision.type="transitional" affected.by.uncommenced="0" spent.amends="0"><no>52</no><heading id="sec.6-frag-div.2-sec.52-he" guid="_22a80608-e6ba-456a-9aa4-def94953ecfb">Matters resolved before commencement</heading><subclause id="sec.6-frag-div.2-sec.52-ssec.1" guid="_4738fb8a-d6f2-4b57-ad28-be3c8dcb8da6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies in relation to an ineligible lease if, before the commencement of the amending regulation, a dispute or other matter relating to the ineligible lease had been resolved.</txt></block></subclause><subclause id="sec.6-frag-div.2-sec.52-ssec.2" guid="_869bb96c-f328-4635-9a2d-4b7d62a0c509" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Nothing in the amending regulation affects the matter as resolved.</txt></block></subclause><subclause id="sec.6-frag-div.2-sec.52-ssec.3" guid="_70fef125-da97-479f-b655-1ae8d3cb5cd4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">To remove any doubt, it is declared that nothing in the amending regulation affects the validity of an agreement or order relating to an ineligible lease entered into or made before the commencement of the amending regulation. </txt></block></subclause><subclause id="sec.6-frag-div.2-sec.52-ssec.4" guid="_0a08c680-b7b5-4534-a3c4-e8be2a024624" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For this section, a matter relating to an ineligible lease has been <defterm id="sec.6-frag-div.2-sec.52-def.resolved" guid="_f88ed44d-2868-4edf-a530-ffaa37183c4c" type="definition">resolved</defterm> if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-div.2-sec.52-ssec.4-para1.a" guid="_5dfd7588-6e30-44b2-a333-1cc8684883cc" provision.type="other"><no>(a)</no><block><txt break.before="0">a settlement agreement or other binding agreement has been entered into by the parties to the ineligible lease in relation to the matter; or</txt></block></li><li id="sec.6-frag-div.2-sec.52-ssec.4-para1.b" guid="_8532031d-0a46-4c41-8635-1fb3a9dd6717" provision.type="other"><no>(b)</no><block><txt break.before="0">an order has been made about the matter by a court or tribunal; or</txt></block></li><li id="sec.6-frag-div.2-sec.52-ssec.4-para1.c" guid="_9ca8681d-d243-4c74-bcdc-a8e53ffadb8c" provision.type="other"><no>(c)</no><block><txt break.before="0">a dispute about the matter has been withdrawn.</txt></block></li></list></block></subclause></clause><clause id="sec.6-frag-div.2-sec.53" guid="_5162e103-3d02-4eb5-840a-0aaa588891fb" provision.type="transitional" affected.by.uncommenced="0" spent.amends="0"><no>53</no><heading id="sec.6-frag-div.2-sec.53-he" guid="_6bb51610-f3da-4c91-b00e-4bdd95c785f1">Application of s 20</heading><block><txt break.before="1">Despite the amending regulation, section 20 continues to apply to a party to an ineligible lease in relation to protected information obtained by the party under this regulation before the commencement of the amending
