owner of the lot is responsible for maintaining, in good order and condition, utility infrastructure, including utility infrastructure situated on common property to the extent the utility infrastructure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.i" guid="_583aa9c5-a8cc-47ef-b361-d2b47b7eccc6" provision.type="other"><no>(i)</no><block><txt break.before="0">relates only to supplying utility services to the owner’s lot; and</txt></block></li><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.ii" guid="_6e73bd31-60b2-41c3-91bf-e4fe8e53719e" provision.type="other"><no>(ii)</no><block><txt break.before="0">is 1 of the following types—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.ii-para3.A" guid="_7c7517d3-a4a8-40c1-87db-7f0f14178b31" provision.type="other"><no>(A)</no><block><txt break.before="0">hot-water systems;</txt></block></li><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.ii-para3.B" guid="_a30dcf83-749a-4963-907a-ead5374d8212" provision.type="other"><no>(B)</no><block><txt break.before="0">washing machines;</txt></block></li><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.ii-para3.C" guid="_822b845d-b0e6-4b24-ab2a-04acbdc84e1b" provision.type="other"><no>(C)</no><block><txt break.before="0">clothes dryers;</txt></block></li><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.ii-para3.D" guid="_1377b923-4f09-458a-bddb-109bbb8e6c80" provision.type="other"><no>(D)</no><block><txt break.before="0">solar panels;</txt></block></li><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.ii-para3.E" guid="_b4ee7268-7f25-49fc-888e-2a0cc7d76296" provision.type="other"><no>(E)</no><block><txt break.before="0">air-conditioning systems;</txt></block></li><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.ii-para3.F" guid="_e40f162f-eee5-441a-bb30-d64c648c35d8" provision.type="other"><no>(F)</no><block><txt break.before="0">television antennae;</txt></block></li><li id="sec.5-ssec.5-frag-ssec.3-para1.a-para2.ii-para3.G" guid="_bb7039d6-d306-4a7f-b49b-fdeebb36d3b4" provision.type="other"><no>(G)</no><block><txt break.before="0">another device providing a utility service to a lot; and</txt></block></li></list></block></li></list><note id="sec.5-ssec.5-frag-ssec.3-para1.a-note" guid="_c8ebcd45-0938-444f-b41f-8408105089d5" type="example"><heading id="sec.5-ssec.5-frag-ssec.3-para1.a-note-he" guid="_d6d904a3-8bc4-4b76-9df1-5e3ebb548117">Examples for paragraph (a)—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.5-frag-ssec.3-para1.a-note-para2.1" guid="_df104ccd-17c5-47f4-8fb1-b380e126694c" provision.type="other"><no>1</no><block><txt break.before="0">An air-conditioning plant is installed on the common property, but relates only to supplying utility services to a particular lot. The owner of the lot is responsible for maintaining the air-conditioning equipment.</txt></block></li><li id="sec.5-ssec.5-frag-ssec.3-para1.a-note-para2.2" guid="_7059cca3-5580-4fdf-a6cf-04a8a1e2e1ce" provision.type="other"><no>2</no><block><txt break.before="0">A hot-water system is installed on the common property, but supplies water only to a particular lot. The owner of the lot is responsible for maintaining the hot-water system and the associated pipes and wiring.</txt></block></li></list></block></note></block></li><li the tray of a shower that services the lot, whether or not the tray forms part of the lot.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.5-frag-ssec.4" guid="_5147934b-baa5-4a85-86fb-5b3cf3206e43" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">To avoid any doubt, it is declared that, despite an obligation the body corporate may have under subsection (2), the body corporate may recover the prescribed costs, as a debt, from a person, whether or not the person is the owner of the lot, whose actions cause or contribute to the damage or deterioration of the part of the lot.</txt></block></subclause></fragment></block></subclause><subclause id="sec.5-ssec.6" guid="_a4d4af3f-f4f2-4bc2-b6d3-67b82c7f1ca6" break.before="0">A body corporate must, on or before the second anniversary of the scheme’s establishment, consider engaging an appropriately qualified person to prepare a defect assessment report for property, other than a body corporate asset, the body corporate must insure, for full replacement value, under sections 48(1), 49(2) and 50(2).</txt></block></clause><clause id="sec.6-frag-sec.31B" guid="_04f5c0b7-6f99-44d9-bc41-edcd9562acf4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>31B</no><heading id="sec.6-frag-sec.31B-he" guid="_249c0150-0bea-42be-b07a-73ad4fd7fcb6">Body corporate may establish voluntary defect assessment plan</heading><subclause id="sec.6-frag-sec.31B-ssec.1" guid="_c7c45d44-1cfb-45b9-93a4-ee18f8b3a55c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-sec.31B-ssec.1-para1.a" guid="_23c97c42-e379-45fe-9669-5913bfe9c354" provision.type="other"><no>(a)</no><block><txt break.before="0">a body corporate has, under section 31A, considered the preparation of a defect assessment report; and</txt></block></li><li id="sec.6-frag-sec.31B-ssec.1-para1.b" guid="_bd89a59a-00d2-4742-b2e7-8fb23c5ff27c" provision.type="other"><no>(b)</no><block><txt break.before="0">lots included in the scheme were created under a standard format plan of subdivision; and</txt></block></li><li id="sec.6-frag-sec.31B-ssec.1-para1.c" guid="_e47573f6-6798-45b9-9ac5-7c1198b7ce23" provision.type="other"><no>(c)</no><block><txt break.before="0">on 1 or more of the lots mentioned in paragraph&#160;(b), there is a building (a <defterm id="sec.6-frag-sec.31B-ssec.1-def.standalonebuilding" guid="_740333f0-bc40-4fc7-b28a-02462b15d314" type="definition">stand-alone building</defterm>) having no common wall with a building on another lot.</txt></block></li></list></block></subclause><subclause id="sec.6-frag-sec.31B-ssec.2" guid="_28be84eb-64ea-4095-bd6a-33233e03e64d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The body corporate may establish a plan (a <defterm id="sec.6-frag-sec.31B-def.voluntarydefectassessmentplan" guid="_e760a293-381b-485b-ba7f-e017e5eae096" type="definition">voluntary defect assessment plan</defterm>) under which it arranges for a defect assessment report to be prepared for stand-alone buildings for the owners of the lots on which they are located.</txt></block></subclause><subclause id="sec.6-frag-sec.31B-ssec.3" guid="_71869ff5-d523-4b9c-8163-31c33b68ba21" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Participation in the voluntary defect assessment plan is optional, and the owner of a lot who wants to take part in the plan must comply with all reasonable requirements made by the body corporate establishing the plan.</txt></block></subclause><subclause id="sec.6-frag-sec.31B-ssec.4" guid="_567391c3-3e2a-48fe-a68b-7f21eba1c65c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The owner of a lot who takes part in the voluntary defect assessment plan is liable to pay a contribution that is a proportionate amount of the total cost of the plan relative to the defect assessment report undertaken on the owner’s lot.</txt></block></subclause></clause></fragment></block></clause><clause id="sec.7" guid="_b22d422f-9de9-4c77-a73b-959fb3604f1e" provision.type="amend" affected.by.uncommenced="0"
