guid="_b5b54e88-75e9-4030-b714-4ba921af193b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This regulation modifies the <legref target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Manufactured Homes (Residential Parks) Act 2003</name></legref>.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_ca2fa8bf-4f5b-489b-ae38-7970a2f72708" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this regulation, a reference to the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> is a reference to the <legref target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Manufactured Homes (Residential Parks) Act 2003</name></legref>.</txt></block></subclause></clause></part><part id="pt.2" guid="_a1ec55aa-6bf8-4b10-9992-10f946ce2031" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_f1676aa7-f812-4357-9e47-0a3957ca5893">Site rent increases—19 March to 24 May 2020</heading><clause id="sec.5" guid="_d9fa6291-5eea-4538-ab49-47945abb754a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_1282864f-b9a0-4549-90ee-f9e4074e15d3">Dispute negotiation notice may be given by home owner</heading><subclause id="sec.5-ssec.1" guid="_498d816d-10f3-434a-a358-467a166ddaeb" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_42f58eba-8ac0-4d68-96be-5551bb95d0f8" provision.type="other"><no>(a)</no><block><txt break.before="0">the park owner for a residential park gave a home owner for an eligible site a general increase notice for a proposed increase in site rent based on a market review of site rent; and</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_70ca5c63-1570-40cf-912f-e832513f63c2" provision.type="other"><no>(b)</no><block><txt break.before="0">as a result of the notice, during the period beginning on 19 March 2020 and ending on 24 May 2020, the site rent increased; and</txt></block></li><li id="sec.5-ssec.1-para1.c" guid="_4842200d-40bf-407f-9b28-afc2bdd726bd" provision.type="other"><no>(c)</no><block><txt break.before="0">the home owner considers the amount of the increase to be excessive; and</txt></block></li><li id="sec.5-ssec.1-para1.d" guid="_1eaaaab0-aecc-41b9-9a02-7eeb28473f1d" provision.type="other"><no>(d)</no><block><txt break.before="0">the home owner considers that insufficient consultation was carried out with interested entities under <legref refid="sec.69D" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;69D</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> in relation to the increase in site rent for any of the following reasons—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.d-para2.i" guid="_22ed042c-99c0-4bc0-8eb7-1b4f22d063a3" provision.type="other"><no>(i)</no><block><txt break.before="0">social distancing requirements under a public health direction under the <legref target.doc.id="act-2005-048" target.version.series="a0e0f082-c057-4815-b921-264c76837ae7" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Health Act 2005</name></legref>, <legref refid="sec.362B" target.doc.id="act-2005-048" target.version.series="a0e0f082-c057-4815-b921-264c76837ae7" target.guid="_95930ad0-2de5-436b-8067-bf676b6e8cdd" check="valid" jurisd="QLD" type="act">section&#160;362B</legref>;</txt></block></li><li id="sec.5-ssec.1-para1.d-para2.ii" guid="_0e6dae87-191f-47fc-984c-bb0e1247f439" provision.type="other"><no>(ii)</no><block><txt break.before="0">the home owner was unable to participate in the consultation because of the COVID-19 emergency;</txt></block></li><li id="sec.5-ssec.1-para1.d-para2.iii" guid="_b80f9922-ff91-4e38-bbe5-aec14d7bbaaa" provision.type="other"><no>(iii)</no><block><txt break.before="0">the home owner was unable to receive legal advice about the dispute because of the COVID-19 emergency.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.5-ssec.2" guid="_42138f58-31ab-44fc-8d30-d2eec24d134a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.5-ssec.1" target.guid="_498d816d-10f3-434a-a358-467a166ddaeb" check="valid">Subsection&#160;(1)</intref> applies even if the site rent increase was less than the site rent increase proposed in the general increase notice.</txt></block></subclause><subclause id="sec.5-ssec.3" guid="_0416fd92-7983-4c56-82a4-01a62ed5a476" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The home owner may give the park owner a dispute negotiation notice for the dispute.</txt></block></subclause><subclause id="sec.5-ssec.4" guid="_95cf9aea-1f53-496f-8732-49cd2308642a" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The notice must be given by 20 November 2020.</txt></block></subclause></clause><clause id="sec.6" guid="_2f39df1b-fe32-4d2b-b85f-16d214571b76" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_bbef7780-d011-4edd-91a1-b4041b4d0d71">Matters to which tribunal may have regard</heading><block><txt break.before="1">If a dispute negotiation notice is given under <legref refid="sec.5" target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" target.guid="_39a77d10-88f6-4332-831d-03262aca5dbb" check="valid" jurisd="QLD" type="act">section&#160;5</legref>, <legref refid="sec.70" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;70</legref><legref refid="sec.70-ssec.5" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">(5)</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> applies to the dispute as if the following provision were inserted in that subsection—</txt><fragment auto.number.type="manual" format="fromcontext" style="indent"><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-para1.m" guid="_9111208d-72e0-40fe-981b-6cd1347b79f7" provision.type="other"><no>(m)</no><block><txt break.before="0">for a dispute in which a home owner considers that insufficient consultation was carried out with interested entities under <intref refid="sec.69D" check="invalid">section&#160;69D</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-frag-para1.m-para2.i" guid="_6b0c9e6f-b56c-41dc-ae52-60952604d0bc" provision.type="other"><no>(i)</no><block><txt break.before="0">public health directions under the <legref target.doc.id="act-2005-048" target.version.series="a0e0f082-c057-4815-b921-264c76837ae7" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Health Act 2005</name></legref>, <legref refid="sec.362B" target.doc.id="act-2005-048" target.version.series="a0e0f082-c057-4815-b921-264c76837ae7" target.guid="_95930ad0-2de5-436b-8067-bf676b6e8cdd" check="valid" jurisd="QLD" type="act">section&#160;362B</legref>;</txt></block></li><li id="sec.6-frag-para1.m-para2.ii" guid="_a3ead987-6515-441c-8611-3f8e1e8177f8" provision.type="other"><no>(ii)</no><block><txt break.before="0">the consultation that took place under <intref refid="sec.69D" check="invalid">section&#160;69D</intref> in relation to the increase in site rent;</txt></block></li><li id="sec.6-frag-para1.m-para2.iii" guid="_6a877f44-802d-44a8-a215-3de459ecefc9" provision.type="other"><no>(iii)</no><block><txt break.before="0">the extent to which interested entities provided their views on the proposed increase in site rent during the consultation;</txt></block></li><li id="sec.6-frag-para1.m-para2.iv" guid="_cbccea16-54c8-4739-aadf-b315e2a57aaf" provision.type="other"><no>(iv)</no><block><txt break.before="0">the nature of the arrangements for carrying out the consultation;</txt></block></li><li id="sec.6-frag-para1.m-para2.v" guid="_12391805-6379-4595-97d7-395cae5725f3" provision.type="other"><no>(v)</no><block><txt break.before="0">any circumstances that adversely affected the ability of the home owner to take part in the consultation;</txt></block></li><li id="sec.6-frag-para1.m-para2.vi" guid="_2d975570-859b-44d4-b974-1c1adbd19590" provision.type="other"><no>(vi)</no><block><txt break.before="0">whether or not the home owner was able to receive legal advice in relation to the consultation within 28 days of the day the general increase notice was given;</txt></block></li><li id="sec.6-frag-para1.m-para2.vii" guid="_2cb7c829-b655-4740-8235-8c75d416a749" provision.type="other"><no>(vii)</no><block><txt break.before="0">whether or not the home owner was able to meet with other home owners to discuss the proposed increase in site rent.</txt></block></li></list></block></li></list></fragment></block></clause><clause id="sec.7" guid="_8995ec04-235c-43b2-b54d-55bc49dcfd8e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_64986e60-e8d6-4bea-bb9e-29406fb01226">New disputes and earlier disputes</heading><subclause id="sec.7-ssec.1" guid="_eaef8130-9006-4bc0-bd74-81c2dc17597e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_edd50c2a-f224-429d-a1ab-c061a13a2f19" provision.type="other"><no>(a)</no><block><txt break.before="0">a dispute negotiation notice is given by a home owner under <intref refid="sec.5" target.guid="_d9fa6291-5eea-4538-ab49-47945abb754a" check="valid">section&#160;5</intref> in relation to a site rent increase (the <defterm id="sec.7-ssec.1-def.newdispute" guid="_3b1c3cf0-1e7c-4e0c-bab6-c3009607f6d5" type="definition">new dispute</defterm>); and</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_7a3c7b47-86a6-4f5e-a060-75177c0a396f" provision.type="other"><no>(b)</no><block><txt break.before="0">another dispute (the <defterm id="sec.7-ssec.1-def.earlierdispute" guid="_43056ea7-116a-4eba-9814-5cf0ecc078cb" type="definition">earlier dispute</defterm>) about the same site rent increase has been finally dealt with by the tribunal.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_6f76b3ee-8494-4d97-b290-6e767faa81dd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The following provisions of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> do not apply to the new dispute—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.2-para1.a" guid="_9d17dc58-d990-4267-ba2d-21a6e89e7075" provision.type="other"><no>(a)</no><block><txt break.before="0"><legref refid="pt.17" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">part&#160;17</legref>, <intref refid="pt.17-div.1" check="invalid">division&#160;1</intref>, other than <intref refid="sec.107" check="invalid">section&#160;107</intref><intref refid="sec.107-ssec.1" check="invalid">(1)</intref><intref refid="sec.107-ssec.1-para1.a" check="invalid">(a)</intref>;</txt></block></li><li id="sec.7-ssec.2-para1.b" guid="_f7cd2dd1-08ba-4cff-9f63-c035bd305217" provision.type="other"><no>(b)</no><block><txt break.before="0"><legref refid="sec.116" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;116</legref>.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.3" guid="_830ee29d-b5ab-48de-8904-5e130f1d55a4" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The home owner may apply to the tribunal under <legref refid="pt.17" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">part&#160;17</legref>, <legref refid="pt.17-div.2" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">division&#160;2</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> for an order to resolve the new dispute.</txt></block></subclause><subclause id="sec.7-ssec.4" guid="_3e3f63eb-617f-41a7-9926-11574073fbf4" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For <intref refid="sec.7-ssec.1" target.guid="_eaef8130-9006-4bc0-bd74-81c2dc17597e" check="valid">subsection&#160;(1)</intref><intref refid="sec.7-ssec.1-para1.b" target.guid="_7a3c7b47-86a6-4f5e-a060-75177c0a396f" check="valid">(b)</intref>, an earlier dispute has been finally dealt with by the tribunal if the tribunal has made a decision.</txt></block></subclause></clause><clause id="sec.8" guid="_d5dc5dfe-327e-425e-8fb8-11b272c4fcab" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_0989074b-c10a-44d5-97a8-867c43efeae1">New disputes and existing disputes</heading><subclause id="sec.8-ssec.1" guid="_4adcbb51-17c2-4a80-8ebe-e8c7484fd34c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_1961bc73-e19a-4357-9074-12a23d1bebe9" provision.type="other"><no>(a)</no><block><txt break.before="0">a dispute negotiation notice is given by a home owner under <intref refid="sec.5" target.guid="_d9fa6291-5eea-4538-ab49-47945abb754a" check="valid">section&#160;5</intref> in relation to a site rent increase (the <defterm id="sec.8-ssec.1-def.newdispute" guid="_fbd37a05-0e85-4cd5-b45c-8b152397719d" type="definition">new dispute</defterm>); and</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_976cd572-a10f-4ac5-bdf1-0fea0a1a0ac7" provision.type="other"><no>(b)</no><block><txt break.before="0">another dispute to which the home owner is a party (the <defterm id="sec.8-ssec.1-def.existingdispute" guid="_6057dd44-998f-49a1-8b82-16d007a4f469" type="definition">existing dispute</defterm>) about the same site rent increase has not been finally dealt with.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_d5d889ae-250e-4bc6-b136-51befa60c9b3" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.8-ssec.3" target.guid="_f83c7509-daca-4457-b64a-a36c8178e9c9" check="valid">Subsection&#160;(3)</intref> applies if an application has been made under <legref refid="sec.108" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;108</legref><legref refid="sec.108-ssec.1" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">(1)</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> for mediation of the existing dispute and—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.2-para1.a" guid="_6aaf9494-a6ba-430b-b63e-30d614a77192" provision.type="other"><no>(a)</no><block><txt break.before="0">mediation of the dispute has not started; or</txt></block></li><li id="sec.8-ssec.2-para1.b" guid="_fa352620-f3ac-409b-a674-c6b89a0179df" provision.type="other"><no>(b)</no><block><txt break.before="0">mediation of the dispute has started but not ended.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.3" guid="_f83c7509-daca-4457-b64a-a36c8178e9c9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For <intref refid="sec.8-ssec.2" target.guid="_d5d889ae-250e-4bc6-b136-51befa60c9b3" check="valid">subsection&#160;(2)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-para1.a" guid="_16652821-537f-4ac1-a01f-52bf7ae2dbe8" provision.type="other"><no>(a)</no><block><txt break.before="0"><intref refid="pt.17" check="invalid">part&#160;17</intref>, <intref refid="pt.17-div.1" check="invalid">division&#160;1</intref>, <intref refid="pt.17-div.1-sdiv.2" check="invalid">subdivision&#160;2</intref> (other than <intref refid="sec.107" check="invalid">section&#160;107</intref><intref refid="sec.107-ssec.1" check="invalid">(1)</intref><intref refid="sec.107-ssec.1-para1.a" check="invalid">(a)</intref>) of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> does not apply to the new dispute; and</txt></block></li><li id="sec.8-ssec.3-para1.b" guid="_ae51299e-3b91-43cd-8f0f-427e84dc2657" provision.type="other"><no>(b)</no><block><txt break.before="0">the new dispute and the existing dispute must be mediated together by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-para1.b-para2.i" guid="_e5e8052d-3e41-445d-b1df-c884c1a023ee" provision.type="other"><no>(i)</no><block><txt break.before="0">if <intref refid="sec.8-ssec.2" target.guid="_d5d889ae-250e-4bc6-b136-51befa60c9b3" check="valid">subsection&#160;(2)</intref><intref refid="sec.8-ssec.2-para1.a" target.guid="_6aaf9494-a6ba-430b-b63e-30d614a77192" check="valid">(a)</intref> applies—a single mediator appointed for both disputes; or</txt></block></li><li id="sec.8-ssec.3-para1.b-para2.ii" guid="_e13c4c67-d1c2-40ec-a28f-4c3fba0f820c" provision.type="other"><no>(ii)</no><block><txt break.before="0">if <intref refid="sec.8-ssec.2" target.guid="_d5d889ae-250e-4bc6-b136-51befa60c9b3" check="valid">subsection&#160;(2)</intref><intref refid="sec.8-ssec.2-para1.b" target.guid="_fa352620-f3ac-409b-a674-c6b89a0179df" check="valid">(b)</intref> applies—the mediator for the existing dispute.</txt></block></li></list></block></li><li id="sec.8-ssec.3-para1.c" guid="_2afb93da-8362-4a56-9068-7efcf01e8102" provision.type="other"><no>(c)</no><block><txt break.before="0">the home owner must, at the same time as the home owner gives the dispute negotiation notice to the park owner—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-para1.c-para2.i" guid="_48815cd0-b436-4708-8aa9-9744d7caa011" provision.type="other"><no>(i)</no><block><txt break.before="0">notify the mediator in writing of the new dispute; and</txt></block></li><li id="sec.8-ssec.3-para1.c-para2.ii" guid="_651c06c7-876f-4d0c-89e3-e6b82109ef26" provision.type="other"><no>(ii)</no><block><txt break.before="0">give a copy of the dispute negotiation notice to the mediator.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.8-ssec.4" guid="_d1bd098a-423c-436c-b90d-2f022707203c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the tribunal has started but not finished hearing the existing dispute—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.4-para1.a" guid="_19392853-6258-4ab6-9fe6-c1660db3c34e" provision.type="other"><no>(a)</no><block><txt break.before="0"><intref refid="pt.17" check="invalid">part&#160;17</intref>, <intref refid="pt.17-div.1" check="invalid">division&#160;1</intref>, <intref refid="pt.17-div.1-sdiv.2" check="invalid">subdivisions&#160;2</intref> (other than <intref refid="sec.107" check="invalid">section&#160;107</intref><intref refid="sec.107-ssec.1" check="invalid">(1)</intref><intref refid="sec.107-ssec.1-para1.a" check="invalid">(a)</intref>) and 3 of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> do not apply to the dispute; and</txt></block></li><li id="sec.8-ssec.4-para1.b" guid="_c9348e6d-4cd2-419e-b79e-31743b15683a" provision.type="other"><no>(b)</no><block><txt break.before="0">the new dispute and the existing dispute must be heard together by the tribunal; and</txt></block></li><li id="sec.8-ssec.4-para1.c" guid="_1e9bf631-f566-4da6-93aa-bb15d2954cb6" provision.type="other"><no>(c)</no><block><txt break.before="0">the home owner must, at the same time as the home owner gives the dispute negotiation notice to the park owner—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.4-para1.c-para2.i" guid="_febf4189-7699-4f03-880f-fe94ad802268" provision.type="other"><no>(i)</no><block><txt break.before="0">notify the registrar of the tribunal in writing of the new dispute; and</txt></block></li><li id="sec.8-ssec.4-para1.c-para2.ii" guid="_054ad4d9-15e6-4f23-8de0-0c3516b05fda" provision.type="other"><no>(ii)</no><block><txt break.before="0">give a copy of the dispute negotiation notice to the registrar of the affected.by.uncommenced="0"><no>Division 1</no><heading id="pt.3-div.1-he" guid="_b91a3ea2-3e44-46d7-8cbd-af4425df143a">Site rent increase continuation notice given</heading><clause id="sec.9" guid="_4b4c824c-ade7-46e2-bf06-d0ce128f4e83" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_16826924-adaf-4037-bfae-ccd518a72017">Site rent increase continuation notice</heading><subclause id="sec.9-ssec.1" guid="_0ba49b64-2e43-40d9-b5b2-22b73db6b93f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_49f3cdbf-ec25-4f54-9b68-d90c0a27c8b7" provision.type="other"><no>(a)</no><block><txt break.before="0">there was a site rent increase for an eligible site, on the basis of a market review of site rent, during the period beginning on 25 May 2020 and ending on the day before the commencement; and</txt></block></li><li id="sec.9-ssec.1-para1.b" guid="_0657124e-5500-4747-a627-b579aa380d8c" provision.type="other"><no>(b)</no><block><txt break.before="0">the general increase notice for the site rent increase was given on or before 8 June 2020.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_404417aa-c9cd-4c50-a0b5-65752b6da5eb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Within 14 days of the commencement, the park owner may give the home owner of the eligible site a notice (a <defterm id="sec.9-def.siterentincreasecontinuationnotice" guid="_29d2e3cb-6a7e-49a5-b5d2-cb9b90a0e8ad" type="definition">site rent increase continuation notice</defterm>) stating—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_a20be6d4-55a9-4bd7-928e-51b4f0bee6c0" provision.type="other"><no>(a)</no><block><txt break.before="0">that the site rent increase that was in effect before the commencement is continuing; and</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_d75f8170-5a53-47be-ad57-9cf97771412d" provision.type="other"><no>(b)</no><block><txt break.before="0">that the home owner is entitled to a payment by the park owner of an amount that is worked out by multiplying the relevant weeks factor by the weekly amount of the site rent increase; and</txt></block></li><li id="sec.9-ssec.2-para1.c" guid="_15c6ef68-5a08-40e6-a282-3e6749cec1b2" provision.type="other"><no>(c)</no><block><txt break.before="0">the amount that is worked out under <intref refid="sec.9-ssec.2-para1.b" target.guid="_d75f8170-5a53-47be-ad57-9cf97771412d" check="valid">paragraph&#160;(b)</intref>; and</txt></block></li><li id="sec.9-ssec.2-para1.d" guid="_3206ae29-9d60-4e8e-89b3-48c513e58fe9" provision.type="other"><no>(d)</no><block><txt break.before="0">that the home owner may dispute the site rent increase by giving a dispute negotiation notice to the park owner within 56 days of the day the site rent increase continuation notice is given.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_b378731b-cf36-498f-a325-d3929120d778" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the park owner gives a notice under <intref refid="sec.9-ssec.2" target.guid="_404417aa-c9cd-4c50-a0b5-65752b6da5eb" check="valid">subsection&#160;(2)</intref>, the park owner must, by 6 November 2020, pay the home owner an amount that is worked out by multiplying the relevant weeks factor by the weekly amount of the site rent increase.</txt><penalty id="sec.9-ssec.3-pen" guid="_4a5dbba2-4fa4-4a03-87f4-4aa6bb99b30c"><block><txt break.before="1">Maximum penalty—20 penalty units.</txt></block></penalty><note id="sec.9-ssec.3-note" guid="_296f4e48-16d4-494a-b1a3-6694d5c88b2c" type="example"><heading id="sec.9-ssec.3-note-he" guid="_702736cf-a849-4a47-a512-9fc3e8d846ed">Example—</heading><block><txt break.before="1">The weekly amount of the site rent increase for an eligible site is $10. The site rent increase started on 1 July 2020. The number of days in the refund period is 184. The relevant weeks factor is 184 divided by 7 and rounded down, namely 26. The park owner must pay the home owner for the eligible site $10 multiplied by the relevant weeks factor of 26, namely $260.</txt></block></note></block></subclause><subclause id="sec.9-ssec.4" guid="_3212ef8e-1624-4237-83ee-f71ccb4eb7e5" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.9-ssec.4-def.refundperiod_" guid="_6762587e-97ce-4414-8a2d-3f9056bb19f2" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.4-def.refundperiod" guid="_362678db-9957-4bf7-a633-501250480ba5" type="definition">refund period</defterm> means the period from the day the site rent increased to 31 December 2020, both days inclusive.</txt></definition><definition id="sec.9-ssec.4-def.relevantweeksfactor_" guid="_bde32caf-c6d0-4986-bcdd-d29c964a06ee" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.4-def.relevantweeksfactor" guid="_390ed11f-4fa3-49c1-8603-d6cd09ccff96" type="definition">relevant weeks factor</defterm> means the number of days in the refund period, divided by 7, and rounded down to the nearest whole number.</txt></definition></deflist></block></subclause></clause><clause id="sec.10" guid="_6351a72b-f262-4d23-b0ed-e247611ecf64" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_1ef92b9d-2fe7-4b82-84b8-687d612ffab7">Dispute negotiation notice may be given by home owner</heading><subclause id="sec.10-ssec.1" guid="_cfe096cc-69f2-4bd4-8b73-9bc0602ac44a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_42120e02-f86e-4dbf-8138-e887614337b0" provision.type="other"><no>(a)</no><block><txt break.before="0">a site rent increase continuation notice is given under <intref refid="sec.9" target.guid="_4b4c824c-ade7-46e2-bf06-d0ce128f4e83" check="valid">section&#160;9</intref>; and</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_4072916a-fed5-4ebb-92df-886d61568bf2" provision.type="other"><no>(b)</no><block><txt break.before="0">the home owner of the eligible site considers the amount of the site rent increase to be excessive; and</txt></block></li><li id="sec.10-ssec.1-para1.c" guid="_d86ee81f-16c5-47ba-b9d7-3d2e28f979f4" provision.type="other"><no>(c)</no><block><txt break.before="0">the home owner considers that insufficient consultation was carried out with interested entities under <legref refid="sec.69D" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;69D</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> in relation to the increase in site rent for any of the following reasons—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.c-para2.i" guid="_0c105fdc-66c6-421f-b198-3679119289b7" provision.type="other"><no>(i)</no><block><txt break.before="0">social distancing requirements under a public health direction under the <legref target.doc.id="act-2005-048" target.version.series="a0e0f082-c057-4815-b921-264c76837ae7" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Health Act 2005</name></legref>, <legref refid="sec.362B" target.doc.id="act-2005-048" target.version.series="a0e0f082-c057-4815-b921-264c76837ae7" target.guid="_95930ad0-2de5-436b-8067-bf676b6e8cdd" check="valid" jurisd="QLD" type="act">section&#160;362B</legref>;</txt></block></li><li id="sec.10-ssec.1-para1.c-para2.ii" guid="_3455c903-c037-4208-bff9-828fc3f51e9d" provision.type="other"><no>(ii)</no><block><txt break.before="0">the home owner was unable to participate in the consultation because of the COVID-19 emergency;</txt></block></li><li id="sec.10-ssec.1-para1.c-para2.iii" guid="_aa60ad09-49bc-485d-a07e-ebf0e3ffab59" provision.type="other"><no>(iii)</no><block><txt break.before="0">the home owner was unable to receive legal advice about the dispute because of the COVID-19 emergency.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.10-ssec.2" guid="_4398d768-110e-4cfc-aa72-e5c89dd40042" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.10-ssec.1" target.guid="_cfe096cc-69f2-4bd4-8b73-9bc0602ac44a" check="valid">Subsection&#160;(1)</intref> applies even if the site rent increase was less than the site rent increase proposed in the general increase notice.</txt></block></subclause><subclause id="sec.10-ssec.3" guid="_a45b1eca-3013-46b7-86d7-039534d6148d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The home owner may give the park owner a dispute negotiation notice for the dispute.</txt></block></subclause><subclause id="sec.10-ssec.4" guid="_855dfeab-80e8-4b27-b37b-b4e15758ceb9" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The notice must be given within 56 days of the day the site rent increase continuation notice is given.</txt></block></subclause></clause><clause id="sec.11" to which tribunal may have regard</heading><block><txt break.before="1">If a dispute negotiation notice is given under <legref refid="sec.10" target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" target.guid="_95f3d0d6-616f-4bc0-9703-14c1193c4cb3" check="valid" jurisd="QLD" type="act">section&#160;10</legref>, <legref refid="sec.70" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;70</legref><legref refid="sec.70-ssec.5" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">(5)</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> applies to the dispute as if the following provision were inserted in that subsection—</txt><fragment auto.number.type="manual" format="fromcontext" style="indent"><list number.type="manual" unnumbered.indent="0"><li id="sec.11-frag-para1.m" guid="_dc6f0e1a-93ac-4772-89e2-11779cae1095" provision.type="other"><no>(m)</no><block><txt break.before="0">for a dispute in which a home owner considers that insufficient consultation was carried out with interested entities under <intref refid="sec.69D" check="invalid">section&#160;69D</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-frag-para1.m-para2.i" guid="_e81cb461-3a66-4f8c-81de-9bc20f5808b3" provision.type="other"><no>(i)</no><block><txt break.before="0">public health directions under the <legref target.doc.id="act-2005-048" target.version.series="a0e0f082-c057-4815-b921-264c76837ae7" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Health Act 2005</name></legref>, <legref refid="sec.362B" target.doc.id="act-2005-048" target.version.series="a0e0f082-c057-4815-b921-264c76837ae7" target.guid="_95930ad0-2de5-436b-8067-bf676b6e8cdd" check="valid" jurisd="QLD" type="act">section&#160;362B</legref>;</txt></block></li><li id="sec.11-frag-para1.m-para2.ii" guid="_d8a29108-13d0-4481-b7ce-a8a213100ea6" provision.type="other"><no>(ii)</no><block><txt break.before="0">the consultation that took place under <intref refid="sec.69D" check="invalid">section&#160;69D</intref> in relation to the increase in site rent;</txt></block></li><li id="sec.11-frag-para1.m-para2.iii" guid="_14733980-e1ab-479f-8231-a60f9c969711" provision.type="other"><no>(iii)</no><block><txt break.before="0">the extent to which interested entities provided their views on the proposed increase in site rent during the consultation;</txt></block></li><li id="sec.11-frag-para1.m-para2.iv" guid="_31fb9af7-aebd-410d-879f-f0508a146198" provision.type="other"><no>(iv)</no><block><txt break.before="0">the nature of the arrangements for carrying out the consultation;</txt></block></li><li id="sec.11-frag-para1.m-para2.v" guid="_0f257d08-3c1e-4c21-a4f2-4162de0b54e3" provision.type="other"><no>(v)</no><block><txt break.before="0">any circumstances that adversely affected the ability of the home owner to take part in the consultation;</txt></block></li><li id="sec.11-frag-para1.m-para2.vi" guid="_88e3a1ff-97cc-4b76-8fc9-d01215e4e80b" provision.type="other"><no>(vi)</no><block><txt break.before="0">whether or not the home owner was able to receive legal advice in relation to the consultation within 28 days of the day the general increase notice was given;</txt></block></li><li id="sec.11-frag-para1.m-para2.vii" guid="_09fbc94e-7b8e-4c48-9129-8ccbcba8eb6a" provision.type="other"><no>(vii)</no><block><txt break.before="0">whether or not the home owner was able to meet with other home owners to discuss the proposed increase in site rent.</txt></block></li></list></block></li></list></fragment></block></clause><clause id="sec.12" guid="_a71f2e12-768a-4c92-ab00-04fdb1954702" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_50f34e20-445c-4165-95e7-d561deadbe38">New disputes and earlier disputes</heading><subclause id="sec.12-ssec.1" guid="_c4504a5e-bbf7-44f9-bff2-9082ebc85682" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.a" guid="_06448b32-de78-42d1-8f17-7b131b80ee1d" provision.type="other"><no>(a)</no><block><txt break.before="0">a dispute negotiation notice is given by a home owner under <intref refid="sec.10" target.guid="_6351a72b-f262-4d23-b0ed-e247611ecf64" check="valid">section&#160;10</intref> in relation to a site rent increase (the <defterm id="sec.12-ssec.1-def.newdispute" guid="_db93b727-eb36-416d-a922-cfe31c18e896" type="definition">new dispute</defterm>); and</txt></block></li><li id="sec.12-ssec.1-para1.b" guid="_c4e9ae38-00dd-4b31-ab96-9aaa6199c2ec" provision.type="other"><no>(b)</no><block><txt break.before="0">another dispute (the <defterm id="sec.12-ssec.1-def.earlierdispute" guid="_4e14470f-6baf-46de-bd62-16ec692450cb" type="definition">earlier dispute</defterm>) about the same site rent increase has been finally dealt with by the tribunal.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.2" guid="_caf63b81-c9d3-4436-9f0e-54e3e7af2e6a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The following provisions of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> do not apply to the new dispute—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a" guid="_5ac262d0-6d3a-453f-aa83-6c10602a790c" provision.type="other"><no>(a)</no><block><txt break.before="0"><legref refid="pt.17" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" guid="_41998390-ae36-47ea-823b-424cb136f16c" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_c25b9633-dddb-453f-810b-26d9ab86aab7">New disputes and existing disputes</heading><subclause id="sec.13-ssec.1" guid="_3dc6442c-1733-4764-a5cc-8baa109a226a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-para1.a" guid="_1f34103a-faaa-4c9e-8c3e-32c3d891eedd" provision.type="other"><no>(a)</no><block><txt break.before="0">a dispute negotiation notice is given by a home owner under <intref refid="sec.10" target.guid="_6351a72b-f262-4d23-b0ed-e247611ecf64" check="valid">section&#160;10</intref> in relation to a site rent increase (the <defterm id="sec.13-ssec.1-def.newdispute" guid="_0bb5c883-efec-4ce8-b501-9fd7bfb76aea" type="definition">new dispute</defterm>); and</txt></block></li><li id="sec.13-ssec.1-para1.b" guid="_9d5a3686-6878-4e58-bf5b-aebd98b11cbf" provision.type="other"><no>(b)</no><block><txt break.before="0">another dispute to which the home owner is a party (the <defterm id="sec.13-ssec.1-def.existingdispute" guid="_4a3e8d10-ebe3-4d7d-85b3-2276aa1dff3b" type="definition">existing dispute</defterm>) about the same site rent increase has not been finally dealt with.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.2" guid="_317496a1-e16b-4323-89d7-c6bb3fffbae9" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.13-ssec.3" target.guid="_ad301cbe-4e7a-4916-8a4d-2a977def1b73" check="valid">Subsection&#160;(3)</intref> applies if an application has been made under <legref refid="sec.108" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;108</legref><legref refid="sec.108-ssec.1" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">(1)</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" id="sec.13-ssec.2-para1.b" guid="_ef987725-d1e7-4cc9-bd84-8ce25ad2e889" provision.type="other"><no>(b)</no><block><txt break.before="0">mediation of the dispute has started but not ended.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.3" guid="_ad301cbe-4e7a-4916-8a4d-2a977def1b73" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For <intref refid="sec.13-ssec.2" target.guid="_317496a1-e16b-4323-89d7-c6bb3fffbae9" check="valid">subsection&#160;(2)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.3-para1.a" guid="_4f167182-c04f-4b4a-96fc-f1d56c32440b" provision.type="other"><no>(a)</no><block><txt break.before="0"><intref refid="pt.17" check="invalid">part&#160;17</intref>, <intref refid="pt.17-div.1" check="invalid">division&#160;1</intref>, <intref refid="pt.17-div.1-sdiv.2" check="invalid">subdivision&#160;2</intref> (other than <intref refid="sec.107" check="invalid">section&#160;107</intref><intref refid="sec.107-ssec.1" check="invalid">(1)</intref><intref refid="sec.107-ssec.1-para1.a" check="invalid">(a)</intref>) of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> does not apply to the new dispute; and</txt></block></li><li id="sec.13-ssec.3-para1.b" guid="_4073bad3-8a03-4e64-a294-7fd20df9dd34" provision.type="other"><no>(b)</no><block><txt break.before="0">the new dispute and the existing dispute must be mediated together by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.3-para1.b-para2.i" guid="_6d588968-a0ef-4465-84b0-e7f127cb8ae4" provision.type="other"><no>(i)</no><block><txt break.before="0">if <intref refid="sec.13-ssec.2" target.guid="_317496a1-e16b-4323-89d7-c6bb3fffbae9" check="valid">subsection&#160;(2)</intref><intref refid="sec.13-ssec.2-para1.a" target.guid="_6da20cb5-2ac5-4a20-8c39-5399144ae4b8" check="valid">(a)</intref> applies—a single mediator appointed for both disputes; or</txt></block></li><li id="sec.13-ssec.3-para1.b-para2.ii" guid="_4df70b49-2f75-4572-a143-a7ab924c3f7c" provision.type="other"><no>(ii)</no><block><txt break.before="0">if <intref refid="sec.13-ssec.2" target.guid="_317496a1-e16b-4323-89d7-c6bb3fffbae9" check="valid">subsection&#160;(2)</intref><intref refid="sec.13-ssec.2-para1.b" target.guid="_ef987725-d1e7-4cc9-bd84-8ce25ad2e889" check="valid">(b)</intref> applies—the mediator for the existing dispute.</txt></block></li></list></block></li><li id="sec.13-ssec.3-para1.c" guid="_35bd8bf2-f27b-43b7-a301-57b17e9764ee" provision.type="other"><no>(c)</no><block><txt break.before="0">the home owner must, at the same time as the home owner gives the dispute negotiation notice to the park owner—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.3-para1.c-para2.i" guid="_2fcacaaf-b925-4103-832b-b00fdbe38b1d" provision.type="other"><no>(i)</no><block><txt break.before="0">notify the mediator in writing of the new dispute; and</txt></block></li><li id="sec.13-ssec.3-para1.c-para2.ii" guid="_839732d6-17eb-4d3c-bb6d-a75ce0016bfa" provision.type="other"><no>(ii)</no><block><txt break.before="0">give a copy of the dispute negotiation notice to the mediator.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.13-ssec.4" guid="_b799189d-ba27-43c5-9eb7-0d8dbb7f14fd" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the tribunal has started but not finished hearing the existing dispute—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.4-para1.a" guid="_6c5cd2ca-bdbc-4359-bb63-e0656ece6046" provision.type="other"><no>(a)</no><block><txt break.before="0"><intref refid="pt.17" check="invalid">part&#160;17</intref>, <intref refid="pt.17-div.1" check="invalid">division&#160;1</intref>, <intref refid="pt.17-div.1-sdiv.2" check="invalid">subdivisions&#160;2</intref> (other than <intref refid="sec.107" check="invalid">section&#160;107</intref><intref refid="sec.107-ssec.1" check="invalid">(1)</intref><intref refid="sec.107-ssec.1-para1.a" check="invalid">(a)</intref>) and 3 of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> do not apply to the dispute; and</txt></block></li><li id="sec.13-ssec.4-para1.b" guid="_8ea8500a-0654-4f0a-8c20-a3af1c653c86" provision.type="other"><no>(b)</no><block><txt break.before="0">the new dispute and the existing dispute must be heard together by the tribunal; and</txt></block></li><li id="sec.13-ssec.4-para1.c" guid="_f57f0e05-dd62-42f6-8e50-81017a54b955" provision.type="other"><no>(c)</no><block><txt break.before="0">the home owner must, at the same time as the home owner gives the dispute negotiation notice to the park owner—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.4-para1.c-para2.i" guid="_0525f4c5-dddd-4eea-a06b-8bffc8f66b74" provision.type="other"><no>(i)</no><block><txt break.before="0">notify the registrar of the tribunal in writing of the new dispute; and</txt></block></li><li id="sec.13-ssec.4-para1.c-para2.ii" guid="_099522c3-0d02-4103-ba0f-a5f0d1d1e542" provision.type="other"><no>(ii)</no><block><txt break.before="0">give a copy of the dispute guid="_4d097be2-e2a9-4862-b309-a273927b6870" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_5d0082ff-e963-4d08-902e-cb709e0b9832">Site rent increase stops having effect</heading><subclause id="sec.14-ssec.1" guid="_5413b149-68b5-455a-a4f7-ba86f6a4cb6a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-ssec.1-para1.a" guid="_8472df0a-5d10-49ef-884a-6a1955691db2" provision.type="other"><no>(a)</no><block><txt break.before="0">there was a site rent increase for an eligible site (the <defterm id="sec.14-ssec.1-def.originalsiterentincrease" guid="_af5dc7f1-7187-4fb4-ac1c-a2a806a4d31b" type="definition">original site rent increase</defterm>), on the basis of a market review of site rent, during the period beginning on 25 May 2020 and ending on the day before the commencement; and</txt></block></li><li id="sec.14-ssec.1-para1.b" guid="_13601329-dda0-4de9-b66a-b96a7b3a7c99" provision.type="other"><no>(b)</no><block><txt break.before="0">no site rent increase continuation notice is given under <intref refid="sec.9" target.guid="_4b4c824c-ade7-46e2-bf06-d0ce128f4e83" check="valid">section&#160;9</intref> by the park owner to the home owner of the eligible site within 14 days of the commencement.</txt></block></li></list></block></subclause><subclause id="sec.14-ssec.2" guid="_26b100ea-589d-4ced-893e-57ee38190bc6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">On the day that is 14 days after the commencement (the <defterm id="sec.14-def.startday" guid="_7efdb928-5c2a-4ea3-8c5f-f9b63b535604" type="definition">start day</defterm>) the site rent increase stops having effect.</txt></block></subclause><subclause id="sec.14-ssec.3" guid="_d66e3e10-b705-415f-9360-814e96ccf97a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For the period starting on the start day and ending on the next general increase day for the eligible site, the site rent is increased on the basis of an increase in the CPI number.</txt></block></subclause><subclause id="sec.14-ssec.4" guid="_bdcb94ca-ad5f-44a5-9651-1d719b9f0619" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the site agreement for the eligible site provides terms for an increase of site rent based on an increase in the CPI number, the increase in site rent under <intref refid="sec.14-ssec.3" target.guid="_d66e3e10-b705-415f-9360-814e96ccf97a" check="valid">subsection&#160;(3)</intref> must be in accordance with those terms.</txt></block></subclause><subclause id="sec.14-ssec.5" guid="_f6714ba4-701e-419b-8a01-2fb24cb836e6" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the site agreement for the eligible site does not provide terms for an increase of site rent based on an increase in the CPI number, the increase in site rent under <intref refid="sec.14-ssec.3" target.guid="_d66e3e10-b705-415f-9360-814e96ccf97a" check="valid">subsection&#160;(3)</intref> must be based on the annual CPI change published by the Australian Bureau of Statistics for the quarter that ended immediately before the day of the original site rent increase.</txt><note id="sec.14-ssec.5-note" guid="_ef1cea01-4a1d-480e-84d2-64dc2f636dbd" type="example"><heading id="sec.14-ssec.5-note-he" guid="_60042af9-6237-4876-94cc-2c1a892bdc17">Examples—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.14-ssec.5-note-para1.1" guid="_613876e3-bcc3-4110-8277-fd6421e273fe" provision.type="other"><no>1</no><block><txt break.before="0">If the site rent increased on the basis of a market review on 27 May 2020, the site rent increase on the basis of an increase in the CPI number will be based on the annual CPI change published for March 2019 to March 2020.</txt></block></li><li id="sec.14-ssec.5-note-para1.2" guid="_87f22de3-fee0-4722-86b7-961bbbf50ff0" provision.type="other"><no>2</no><block><txt break.before="0">If the site rent increased on the basis of a market review on 1 July 2020, the site rent increase on the basis of an increase in the CPI number will be based on the annual CPI change published for June 2019 to June 2020.</txt></block></li></list></block></note></block></subclause><subclause id="sec.14-ssec.6" guid="_f53de70c-2efa-49a9-95a1-09ef1a2c32ba" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">If, under <intref refid="sec.14-ssec.5" target.guid="_f6714ba4-701e-419b-8a01-2fb24cb836e6" check="valid">subsection&#160;(5)</intref>, the annual CPI change published for a quarter by the Australian Bureau of Statistics is a negative number, the park owner is not required to decrease site rent.</txt></block></subclause><subclause id="sec.14-ssec.7" guid="_1f000c80-f396-431e-b296-01177bd09f42" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">Despite any statement to the contrary in the site agreement for the eligible site, the park owner may increase the site rent on the next general increase day by an amount worked out on the basis of a market review of site rent.</txt></block></subclause><subclause id="sec.14-ssec.8" guid="_af8c7a7c-a3d1-4569-b6b1-b865879e111e" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">By 6 November 2020, the park owner must refund to the home owner the amount that is the difference between the increased amount and the CPI amount.</txt></block><penalty id="sec.14-ssec.8-pen" guid="_3949cd2d-7e78-47af-9d6c-e11af1c59464"><block><txt break.before="1">Maximum penalty—20 penalty units.</txt></block></penalty></subclause><subclause id="sec.14-ssec.9" guid="_9c55e828-c2cb-49a0-a925-67f206cdb61a" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0">Within 14 days of the start day, the park owner must give the home owner a notice stating that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14-ssec.9-para1.a" guid="_476d872a-4ca9-4b3e-8490-ae033e5553fb" provision.type="other"><no>(a)</no><block><txt break.before="0">the site rent increase that was in effect before the commencement has stopped having effect; and</txt></block></li><li id="sec.14-ssec.9-para1.b" guid="_b2c64fcf-1199-4963-b850-2e663cd6d308" provision.type="other"><no>(b)</no><block><txt break.before="0">the site rent increase has been replaced by an increase on the basis of an increase in the CPI number; and</txt></block></li><li id="sec.14-ssec.9-para1.c" guid="_cd379288-6e2c-4c6e-be1d-501794c47a33" provision.type="other"><no>(c)</no><block><txt break.before="0">the home owner is entitled to a refund from the park owner, by 6 November 2020, of the amount that is the difference between the increased amount and the CPI amount; and</txt></block></li><li id="sec.14-ssec.9-para1.d" guid="_5200b66d-9700-4a96-9ba4-5695794a3b32" provision.type="other"><no>(d)</no><block><txt break.before="0">the park owner may undertake a market review for which the general increase day will be at least 1 year from the day the site rent last increased on the basis of a market review.</txt></block></li></list><penalty id="sec.14-ssec.9-pen" guid="_ce5aac0d-9234-4f2d-ba1a-5b11cbe484e7"><block><txt break.before="1">Maximum penalty—20 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.14-ssec.10" guid="_0ac2c317-1c75-443e-b288-a51cfd26c362" affected.by.uncommenced="0" provision.type="other"><no>(10)</no><block><txt break.before="0">To remove any doubt, it is declared that <legref refid="sec.69D" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">sections&#160;69D</legref> to&#160;<legref refid="sec.70" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">70</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> apply to the next general increase day.</txt></block></subclause><subclause id="sec.14-ssec.11" guid="_0a650944-d446-40f4-b018-095f33632019" affected.by.uncommenced="0" provision.type="other"><no>(11)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.14-ssec.11-def.CPIamount_" guid="_e4f45913-d93e-4fd6-b76e-a4de967e3375" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.14-ssec.11-def.CPIamount" guid="_659cbe73-6254-470e-810e-1cd5c6305f81" type="definition">CPI amount</defterm> means the amount of site rent that would have been payable under the site agreement if the site rent increase had been based on an increase in the CPI number for the period starting on the day of the original site rent increase and ending on the start day.</txt></definition><definition id="sec.14-ssec.11-def.increasedamount_" guid="_d9823bd7-0fcf-4970-ac4d-233a897a4a63" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.14-ssec.11-def.increasedamount" guid="_7db3a45b-0945-4ecc-a075-e656f3ef1f40" type="definition">increased amount</defterm> means the amount paid for site rent by the home owner for the period starting on the day of the original site rent increase and ending on the start day.</txt></definition></deflist></block></subclause></clause><clause id="sec.15" guid="_5c2236a2-437b-43c9-9ef1-0e5154ddb12e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_3491f132-4395-45e9-8376-97ea4d398bb2">Proceedings are ended</heading><subclause id="sec.15-ssec.1" guid="_6867e7e6-5359-42a8-824b-00ad3aa8cfb6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.1-para1.a" guid="_654a6163-eaa7-4530-916b-9b731daba617" provision.type="other"><no>(a)</no><block><txt break.before="0">a site rent increase for an eligible site stops having effect under <intref refid="sec.14" target.guid="_4d097be2-e2a9-4862-b309-a273927b6870" check="valid">section&#160;14</intref><intref refid="sec.14-ssec.2" target.guid="_26b100ea-589d-4ced-893e-57ee38190bc6" check="valid">(2)</intref>; and</txt></block></li><li id="sec.15-ssec.1-para1.b" guid="_7511d142-1c7b-44ca-923a-05321f10d878" provision.type="other"><no>(b)</no><block><txt break.before="0">a dispute negotiation notice in relation to the site rent increase was given by the home owner of the eligible site.</txt></block></li></list></block></subclause><subclause id="sec.15-ssec.2" guid="_d4b1fb95-afd3-4c48-8d4e-db8b50d6b6a0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">On the commencement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.2-para1.a" guid="_d8bcb4a8-0e8a-4258-9f12-200eb8036674" provision.type="other"><no>(a)</no><block><txt break.before="0">if the parties to the dispute are negotiating a resolution of the dispute under <legref refid="pt.17" target.doc.id="act-2020-013" target.version.series="" check="invalid" jurisd="QLD" type="act">part&#160;17</legref>, <legref refid="pt.17-div.1" target.doc.id="act-2020-013" target.version.series="" check="invalid" jurisd="QLD" type="act">division&#160;1</legref>, <legref refid="pt.17-div.1-sdiv.2" target.doc.id="act-2020-013" target.version.series="" check="invalid" jurisd="QLD" type="act">subdivision&#160;2</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref>—the negotiation is ended; and</txt></block></li><li id="sec.15-ssec.2-para1.b" guid="_84d9a435-79f7-4cc2-9f96-46865f9eb895" provision.type="other"><no>(b)</no><block><txt break.before="0">if the dispute has been referred for mediation under <legref refid="pt.17" target.doc.id="act-2020-013" target.version.series="" check="invalid" jurisd="QLD" type="act">part&#160;17</legref>, <legref refid="pt.17-div.1" target.doc.id="act-2020-013" target.version.series="" check="invalid" jurisd="QLD" type="act">division&#160;1</legref>, <legref refid="pt.17-div.1-sdiv.3" target.doc.id="act-2020-013" target.version.series="" check="invalid" jurisd="QLD" type="act">subdivision&#160;3</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref>—the mediation is ended; and</txt></block></li><li id="sec.15-ssec.2-para1.c" guid="_313b186d-7873-4248-bced-eff0c4521d0a" provision.type="other"><no>(c)</no><block><txt break.before="0">if the dispute is the subject of a proceeding before the tribunal under <legref refid="pt.17" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">part&#160;17</legref>, <legref refid="pt.17-div.2" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">division&#160;2</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" commencement</heading><clause id="sec.16" guid="_f1b0ccb5-5d50-48d0-9305-bf473adc6b22" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_f49b749a-5677-4234-a99d-86a7bb2f73f4">No site rent increase permitted on basis of market review</heading><subclause id="sec.16-ssec.1" guid="_0dabfbbc-291e-4ad5-8c7b-942632654d0a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The site rent for an eligible site may not increase on the basis of a market review of site rent during the period beginning on the commencement and ending on 31 December 2020.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_6263de33-c297-457d-9bea-c4c4767e26bc" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">This section applies even if either of the following steps have been taken for a proposed increase of the site rent for an eligible site—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.2-para1.a" guid="_4cd9535d-c15b-437d-ba53-d3966fc3677a" provision.type="other"><no>(a)</no><block><txt break.before="0">the park owner or a registered valuer consulted with interested entities under <legref refid="sec.69D" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;69D</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> in relation to a proposed increase;</txt></block></li><li id="sec.16-ssec.2-para1.b" guid="_5da8baaf-8344-4aa0-b371-0150c45d1367" provision.type="other"><no>(b)</no><block><txt break.before="0">a general increase notice was given under <legref refid="sec.69E" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">section&#160;69E</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> to the home owner of the eligible site.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.3" guid="_2ba15671-2efe-4b2c-afdd-fd518fb35099" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Despite any statement to the contrary in the site agreement for an eligible site—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-ssec.3-para1.a" guid="_1f1515a1-be85-4571-9dd2-197ab4c00693" provision.type="other"><no>(a)</no><block><txt break.before="0">the park owner may increase the site rent on the next general increase day; and</txt></block></li><li id="sec.16-ssec.3-para1.b" guid="_015be6e5-08b7-4404-a292-b8af5919646d" provision.type="other"><no>(b)</no><block><txt break.before="0">the next general increase day for the eligible site must be at least 1 year from the day the site rent increase would have taken effect but for <intref refid="sec.16-ssec.1" target.guid="_0dabfbbc-291e-4ad5-8c7b-942632654d0a" check="valid">subsection&#160;(1)</intref>; and</txt></block></li><li id="sec.16-ssec.3-para1.c" guid="_ff228136-17e8-45b0-8c4b-792a292814ab" provision.type="other"><no>(c)</no><block><txt break.before="0">the basis for working out the rent increase for the next general increase day may be a market review of site rent.</txt></block></li></list></block></subclause><subclause id="sec.16-ssec.4" guid="_6950e641-bf13-421f-adf5-65a58af1543a" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">To remove any doubt, it is declared that <legref refid="sec.69D" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">sections&#160;69D</legref> to&#160;<legref refid="sec.70" target.doc.id="act-2020-013" check="invalid" jurisd="QLD" type="act">70</legref> of the <legref target.doc.id="act-2020-013" target.version.series="4c7d5743-5188-49bf-8dc0-d711130a1cd1" check="valid" jurisd="QLD" type="act">Act</legref> apply to the next general increase day.</txt></block></subclause></clause><clause id="sec.17" guid="_aa020a79-2e66-4d84-a2c8-f70610e0c052" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>17</no><heading id="sec.17-he" guid="_5fb1739b-91bf-4994-95cc-bfb3e2e41d45">Increase of site rent on basis of increase in CPI number</heading><subclause id="sec.17-ssec.1" guid="_8c1f583c-f5dc-4aba-bf12-8d13f32edfc5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, under <intref refid="sec.16" target.guid="_f1b0ccb5-5d50-48d0-9305-bf473adc6b22" check="valid">section&#160;16</intref><intref refid="sec.16-ssec.1" target.guid="_0dabfbbc-291e-4ad5-8c7b-942632654d0a" check="valid">(1)</intref>, site rent for an eligible site may not increase on the basis of a market review during the period beginning on the commencement and ending on 31 December 2020.</txt></block></subclause><subclause id="sec.17-ssec.2" guid="_150eb4c3-0b19-4ef9-94a4-f09350221d58" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The site rent may instead increase on the basis of an increase in the CPI number if the park owner gives the home owner of the eligible site a notice stating that the site rent is to increase on that basis.</txt></block></subclause><subclause id="sec.17-ssec.3" guid="_5f1981b9-c1dd-40d0-bea5-1ed945f36f9b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The notice must state—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.3-para1.a" guid="_aa7717a9-9095-497c-af1b-7bce2f64cf7f" provision.type="other"><no>(a)</no><block><txt break.before="0">that the site rent is increasing on the basis of an increase in the CPI number under this regulation; and</txt></block></li><li id="sec.17-ssec.3-para1.b" guid="_d8af8767-e58c-4c7c-9fdf-0c3937f52fd5" provision.type="other"><no>(b)</no><block><txt break.before="0">the amount of the site rent increase; and</txt></block></li><li id="sec.17-ssec.3-para1.c" guid="_9cd404e8-70a1-4b2c-b922-e94ef5369389" provision.type="other"><no>(c)</no><block><txt break.before="0">the day the site rent increase starts; and</txt></block></li><li id="sec.17-ssec.3-para1.d" guid="_86014720-a0e0-4a1c-9615-de51898f30ba" provision.type="other"><no>(d)</no><block><txt break.before="0">	that the park owner may undertake a market review for which the general increase day will be at least 1 year from the day the site rent would have increased if this regulation had not been made.</txt></block></li></list></block></subclause><subclause id="sec.17-ssec.4" guid="_f0050782-62be-43ab-8782-0ccb6d733026" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The increase of site rent under <intref refid="sec.17-ssec.2" target.guid="_150eb4c3-0b19-4ef9-94a4-f09350221d58" check="valid">subsection&#160;(2)</intref> must be based on the annual CPI change published by the Australian Bureau of Statistics for the quarter that ended immediately before the day that is 14 days before the day the notice is given.</txt><note id="sec.17-ssec.4-note" guid="_4e951974-def1-48a0-9557-c6623337f796" type="example"><heading id="sec.17-ssec.4-note-he" guid="_a70d2638-41be-4b56-8715-372f3cb3b675">Examples—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.4-note-para1.1" guid="_c9953e08-3b85-45d8-8316-2e97705a79c7" provision.type="other"><no>1</no><block><txt break.before="0">The notice is given under <intref refid="sec.17-ssec.2" target.guid="_150eb4c3-0b19-4ef9-94a4-f09350221d58" check="valid">subsection&#160;(2)</intref> on 1 October 2020. Fourteen days before 1 October is 17 September. The site rent increase on the basis of an increase in the CPI number will be based on the annual CPI change published for June 2019 to June 2020.</txt></block></li><li id="sec.17-ssec.4-note-para1.2" guid="_be94e142-ced7-4e46-8b95-8ecee4989035" provision.type="other"><no>2</no><block><txt break.before="0">The notice is given under <intref refid="sec.17-ssec.2" target.guid="_150eb4c3-0b19-4ef9-94a4-f09350221d58" check="valid">subsection&#160;(2)</intref> on 15 December 2020. Fourteen days before 15 December is 1 December. The site rent increase on the basis of an increase in the CPI number will be based on the annual CPI change published for September 2019 to September 2020.</txt></block></li></list></block></note></block></subclause><subclause id="sec.17-ssec.5" guid="_9c68198f-946f-494d-85b4-26ea664f6cad" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If, under <intref refid="sec.17-ssec.4" target.guid="_f0050782-62be-43ab-8782-0ccb6d733026" check="valid">subsection&#160;(4)</intref>, the annual CPI change published for a quarter by the Australian Bureau of Statistics is a negative number, the park owner is not required to decrease site rent.</txt></block></subclause><subclause id="sec.17-ssec.6" guid="_2ee48256-9e6f-4a00-bdb5-99cdbacc40cf" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">The increase of site rent under <intref refid="sec.17-ssec.2" target.guid="_150eb4c3-0b19-4ef9-94a4-f09350221d58" check="valid">subsection&#160;(2)</intref> may start on or after the general increase day (the <defterm id="sec.17-def.relevantday" guid="_b9982dcf-c655-473d-9f04-5c9d4a5194bb" type="definition">relevant day</defterm>) for the eligible site on which the site rent would have increased but for <intref refid="sec.10" target.guid="_6351a72b-f262-4d23-b0ed-e247611ecf64" check="valid">section&#160;10</intref><intref refid="sec.10-ssec.1" target.guid="_cfe096cc-69f2-4bd4-8b73-9bc0602ac44a"
