provision.type="other"><no>(1)</no><block><txt break.before="0">This schedule applies to reconfiguring a lot if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.1-ssec.1-para1.a" guid="_1bedfa6d-487e-44e5-a9a3-27b802a5733d" provision.type="other"><no>(a)</no><block><txt break.before="0">the reconfiguration is the subdivision of the lot into 2 or more lots (each a <defterm id="sec.6-sec.1-ssec.1-def.createdlot" guid="_fe462aea-2de5-45fb-ab11-c7a806a4369f" type="definition">created lot</defterm>); and</txt></block></li><li id="sec.6-sec.1-ssec.1-para1.b" guid="_24db7e35-0323-4805-b0ac-7f7ed89afcc2" provision.type="other"><no>(b)</no><block><txt break.before="0">the lot being reconfigured is wholly or partly in a prescribed zone under a local instrument applying to the lot; and</txt></block></li><li id="sec.6-sec.1-ssec.1-para1.c" guid="_05077e1e-ca73-43f4-bc46-6ac7f24048f1" provision.type="other"><no>(c)</no><block><txt break.before="0">no part of the lot being reconfigured is in either of the following zones under a local instrument applying to the lot—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.1-ssec.1-para1.c-para2.i" guid="_425357da-5b72-4aca-a649-f0553cf4aac1" provision.type="other"><no>(i)</no><block><txt break.before="0">a rural residential zone stated in schedule 2;</txt></block></li><li id="sec.6-sec.1-ssec.1-para1.c-para2.ii" guid="_6e60c1c1-5230-4a89-b43f-4c546cafa653" provision.type="other"><no>(ii)</no><block><txt break.before="0">a zone, other than a zone stated in schedule 2, that is of a substantially similar type to a zone mentioned in subparagraph (i); and</txt></block></li></list></block></li><li id="sec.6-sec.1-ssec.1-para1.d" guid="_77fc2762-1594-47ba-b617-180ad6df2ce7" provision.type="other"><no>(d)</no><block><txt break.before="0">at least 1 created lot is intended mainly for a residential purpose; and</txt></block></li><li id="sec.6-sec.1-ssec.1-para1.e" guid="_2bf417d2-20cd-47de-9f13-1cf6e74df2c1" provision.type="other"><no>(e)</no><block><txt break.before="0">the reconfiguration is associated with the construction or extension of a road.</txt></block></li></list></block></subclause><subclause id="sec.6-sec.1-ssec.2" guid="_a6018205-8519-4baa-9eb9-b7a3e5981884" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.6-sec.1-ssec.2-def.prescribedzone_" guid="_68ed4cf2-2faf-4488-b8c9-9793ea193699" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.1-ssec.2-def.prescribedzone" guid="_c20f2a7b-9fca-489b-98ac-a5f0e9e6c256" type="definition">prescribed zone</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.1-ssec.2-def.prescribedzone-para1.a" guid="_f6d44c38-714f-4236-adf8-61f86bb8227e" provision.type="other"><no>(a)</no><block><txt break.before="0">any of the following zones stated in schedule 2—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.1-ssec.2-def.prescribedzone-para1.a-para2.i" guid="_205869d8-bced-409f-9f5d-6f12db95b2d2" provision.type="other"><no>(i)</no><block><txt break.before="0">general residential zone, low density residential zone, low-medium density residential zone, medium density residential zone, high density residential zone, character residential zone or tourist accommodation zone;</txt></block></li><li id="sec.6-sec.1-ssec.2-def.prescribedzone-para1.a-para2.ii" guid="_5f2317fc-68b8-484d-9b6d-17406b66711d" provision.type="other"><no>(ii)</no><block><txt break.before="0">emerging community zone;</txt></block></li><li id="sec.6-sec.1-ssec.2-def.prescribedzone-para1.a-para2.iii" guid="_77ccde14-1930-4a8f-a8d6-c8fad4508f28" provision.type="other"><no>(iii)</no><block><txt break.before="0">mixed use zone; or</txt></block></li></list></block></li><li id="sec.6-sec.1-ssec.2-def.prescribedzone-para1.b" guid="_842c324c-940d-42a5-8013-1468796b2451" provision.type="other"><no>(b)</no><block><txt break.before="0">a zone, other than a zone stated in schedule 2, that is of a substantially similar type to a zone mentioned in paragraph (a).</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.6-sec.2" guid="_74ce8fba-4fe6-4b2d-a2ba-e4d196aec2a0" toc="no" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.6-sec.2-he" guid="_f018ffdd-d4f3-4433-ac7c-c74c4ea3a4ce">Definitions for schedule</heading><block><txt break.before="1">In this schedule—</txt><deflist><definition id="sec.6-sec.2-def.block_" guid="_f7a177d8-7541-4d48-af38-d1ce9d03ced6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.2-def.block" guid="_90fbbdb1-e6d0-405c-ad6b-e8c40f44004f" type="definition">block</defterm>, in relation to reconfiguring a lot, means an area consisting of 2 or more adjacent created lots for the reconfiguration.</txt></definition><definition id="sec.6-sec.2-def.createdlot_" guid="_2feedf8c-0be4-4c01-8a7e-5c6adf92f661" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.2-def.createdlot" guid="_daf296b3-4385-4039-bb6b-32978394aff1" type="definition">created lot</defterm> see section 1(1)(a).</txt></definition><definition id="sec.6-sec.2-def.localassessmentbenchmark_" guid="_9804816c-7001-4b3a-a368-1c7aa9a9b241" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.2-def.localassessmentbenchmark" guid="_9d6dc2ca-eb0f-41b8-9b99-acb56b156e8d" type="definition">local assessment benchmark</defterm>, for reconfiguring a lot, means an assessment benchmark for the reconfiguration stated in a local categorising instrument applying to the lot.</txt></definition><definition id="sec.6-sec.2-def.newroad_" guid="_3986f426-4101-4415-b3d4-448037dc44f8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.2-def.newroad" guid="_a18223cb-9336-49c7-8f16-ea8b5868516c" type="definition">new road</defterm>, in relation to reconfiguring a lot, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.2-def.newroad-para1.a" guid="_1ee959fc-129e-4e68-b09a-a9d9572e5180" provision.type="other"><no>(a)</no><block><txt break.before="0">a road constructed in association with the reconfiguration; or</txt></block></li><li id="sec.6-sec.2-def.newroad-para1.b" guid="_1d326db9-238b-4b5d-9a10-1a7bc2228d5d" provision.type="other"><no>(b)</no><block><txt break.before="0">the extended part of a road that is extended in association with the reconfiguration.</txt></block></li></list></definition><definition id="sec.6-sec.2-def.road_" guid="_5136169a-fd5b-42a6-bb91-28d6aaf6f31f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-sec.2-def.road" guid="_8dc67b19-56c3-4d0f-9b51-f3c0d8057d1b" type="definition">road</defterm> does not include—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.2-def.road-para1.a" guid="_37623045-ab4e-4611-a521-d1c9c6218304" provision.type="other"><no>(a)</no><block><txt break.before="0">a laneway; or</txt></block></li><li id="sec.6-sec.2-def.road-para1.b" guid="_1e0fe300-e7df-4cba-994a-83b6cb56f67b" provision.type="other"><no>(b)</no><block><txt break.before="0">a pedestrian or bicycle path.</txt></block></li></list></definition></deflist></block></clause></part><part id="sec.6-frag-sch.12A-pt.2" guid="_751966ca-21a2-478d-b72c-161d075dfb23" toc="no" affected.by.uncommenced="0"><no>Part 2</no><heading id="sec.6-frag-sch.12A-pt.2-he" guid="_5d2a0112-3a67-4264-9a89-43370905e1b6">Assessment <b/>benchmarks</heading><clause id="sec.6-sec.3" guid="_53bda273-e6e8-49de-bc87-5c72c1fcfb52" toc="no" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.6-sec.3-he" guid="_6fd87c58-0ac1-4497-ae0b-c8ca8aac123e">Purpose of part</heading><subclause id="sec.6-sec.3-ssec.1" guid="_3a8d978a-c3be-488b-af3c-576ccd27a73c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This part sets out assessment benchmarks for reconfiguring a lot to which this schedule applies.</txt></block></subclause><subclause id="sec.6-sec.3-ssec.2" guid="_3d249271-24d6-4b59-9f25-a60c80530280" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The purpose of this part is to ensure the reconfiguration supports convenient and comfortable walking for transport, recreation, leisure and exercise in the locality of the lot.</txt></block></subclause></clause><clause id="sec.6-sec.4" guid="_9a0d8332-0af3-4a17-8353-5f423fb80f06" toc="no" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.6-sec.4-he" guid="_2211c353-f08b-40f4-8862-943235939509">Connectivity</heading><block><txt break.before="1">The reconfiguration provides connectivity for pedestrians by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.4-para1.a" guid="_ebb45ef7-1d99-48c4-af86-6fc476d69adb" provision.type="other"><no>(a)</no><block><txt break.before="0">ensuring that any roads constructed or extended in association with the reconfiguration are connected in a grid-like pattern that is responsive to topography and other physical constraints; and</txt></block></li><li id="sec.6-sec.4-para1.b" guid="_f33a667c-0b9f-4145-9542-7acc025d99b1" provision.type="other"><no>(b)</no><block><txt break.before="0">ensuring that, to the extent topography and other physical constraints reasonably permit, any roads constructed or extended in association with the reconfiguration, or footpaths provided in relation to the reconfiguration—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.4-para1.b-para2.i" guid="_8a60829d-7257-4e9d-bb0e-4427ab035f8c" provision.type="other"><no>(i)</no><block><txt break.before="0">connect to roads and footpaths in surrounding areas; or</txt></block></li><li id="sec.6-sec.4-para1.b-para2.ii" guid="_97bae6d0-d564-4ad8-bee7-f564412c196c" provision.type="other"><no>(ii)</no><block><txt break.before="0">allow for connection to future roads and footpaths in surrounding areas.</txt></block></li></list></block></li></list></block></clause><clause id="sec.6-sec.5" guid="_e6d4ce76-910a-4c26-846d-87d4ef06a280" toc="no" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.6-sec.5-he" guid="_292666dd-40b9-4efe-be6c-f6e9f9c82d0b">Maximum length of particular blocks</heading><subclause id="sec.6-sec.5-ssec.1" guid="_abc1f021-d71a-4d8c-b44a-3540ceb5908b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The reconfiguration provides for convenient pedestrian movement by ensuring the length of each boundary of a block for the reconfiguration does not exceed the lesser of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.5-ssec.1-para1.a" guid="_4e41bf34-1a2e-4f8c-9797-49c2d0e56671" provision.type="other"><no>(a)</no><block><txt break.before="0">a maximum length for a boundary of a block stated in a local assessment benchmark for the reconfiguration; or</txt></block></li><li id="sec.6-sec.5-ssec.1-para1.b" guid="_676e92b9-c984-4cc3-a706-b50708a60974" provision.type="other"><no>(b)</no><block><txt break.before="0">250m.</txt></block></li></list></block></subclause><subclause id="sec.6-sec.5-ssec.2" guid="_8c97acca-6eee-43e7-9349-6c927358c495" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subsection (1) does not apply in relation to a block for the reconfiguration that the development application for the reconfiguration states will be subdivided as part of a future stage of development.</txt></block></subclause></clause><clause id="sec.6-sec.6" guid="_0d74c5c4-f792-4917-a7ed-ae1fe13e4e35" toc="no" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-sec.6-he" guid="_a56c4033-814f-40ae-a64e-fdf2238c9613">Street trees</heading><block><txt break.before="1">The reconfiguration provides shade for comfortable walking by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.6-para1.a" guid="_5ccfe838-6844-4abe-a946-d43ea665c685" provision.type="other"><no>(a)</no><block><txt break.before="0">if a local assessment benchmark for the reconfiguration requires the planting of more than 1 tree per 15m on each side of a new road—complying with the local assessment benchmark; or</txt></block></li><li id="sec.6-sec.6-para1.b" guid="_fac0d2d9-c26c-4b7c-9abe-48662c5803b3" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—ensuring at least 1 tree is planted per 15m on each side of a new road.</txt></block></li></list></block></clause><clause id="sec.6-sec.7" guid="_fa3970a9-0c6c-4581-9d1d-97178100e7af" toc="no" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.6-sec.7-he" guid="_5d1d8531-3fff-4880-9dce-d1b0aeb761ac">Footpaths</heading><block><txt break.before="1">The reconfiguration provides for convenient and comfortable pedestrian movement by ensuring—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.7-para1.a" guid="_527747a0-9e15-46ed-8516-80c315875b7c" provision.type="other"><no>(a)</no><block><txt break.before="0">for a new road used mainly for providing direct access to a created lot—a footpath is constructed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-sec.7-para1.a-para2.i" guid="_4badd980-9fc6-46d2-a8a1-db347d5e0182" provision.type="other"><no>(i)</no><block><txt break.before="0">if a local assessment benchmark for the reconfiguration requires the construction of a footpath on both sides of the new road—on both sides of the road; or</txt></block></li><li id="sec.6-sec.7-para1.a-para2.ii" guid="_48bbde48-2e6a-4013-a066-4c1763c80c1f" provision.type="other"><no>(ii)</no><block><txt break.before="0">otherwise—on at least 1 side of the new road; or</txt></block></li></list></block></li><li id="sec.6-sec.7-para1.b" guid="_16ed57b8-ec66-4faa-ae89-686c17cf95d3" provision.type="other"><no>(b)</no><block><txt break.before="0">for another new road—a footpath is constructed on both sides of the road.</txt></block></li></list></block></clause><clause id="sec.6-sec.8" guid="_5c9e6a6d-df6b-418c-a60d-f61f288d35c4" toc="no" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.6-sec.8-he" guid="_f86327d5-f61a-47e0-b02d-6692e2396fcf">Parks and other areas of open space</heading><subclause id="sec.6-sec.8-ssec.1" leisure or exercise by ensuring that, to the extent topography and other physical constraints reasonably permit, a part of each block for the reconfiguration is within 400m of a park or another area of open space that is accessible to the public.</txt></block></subclause><subclause id="sec.6-sec.8-ssec.2" guid="_a2720364-94ec-4d84-8985-8feef1e511bc" affected.by.uncommenced="0"
