this division—</txt><deflist><definition id="sec.5-frag-sec.43-def.relevantemployee_" guid="_84fa914b-a792-4bd2-a0de-83d510558111" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-sec.43-def.relevantemployee" guid="_2b5d8cd0-07d6-433d-9ed2-ef3f805f6c4c" type="definition">relevant employee</defterm> see section 45(1).</txt></definition><definition id="sec.5-frag-sec.43-def.relevantService_" guid="_17c35aa2-5c6a-47a4-b48c-e4fcfd716bb1" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-frag-sec.43-def.relevantService" guid="_6cc1b434-2500-44b2-b970-9d445a092685" type="definition">relevant Service</defterm> means a Service that was prescribed under section 20(4) of the Act immediately before the commencement.</txt></definition></deflist></block></clause><clause id="sec.5-frag-sec.44" guid="_a94c2bc3-b341-4a78-b170-d3fa68179d31" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>44</no><heading id="sec.5-frag-sec.44-he" guid="_6f1ac860-13b0-4ffd-8ecf-3a83b7516487">Purpose of division</heading><block><txt break.before="1">This division makes provision about matters that are necessary or convenient to facilitate the transition of a relevant Service from a prescribed Service to a Service that is no longer prescribed under section 20(4) of the Act.</txt><note id="sec.5-frag-sec.44-note" guid="_c9044951-78ae-408f-9b6a-545222d8851a" type="example"><heading id="sec.5-frag-sec.44-note-he" guid="_b4b0536e-ba2c-4a73-a326-109285b34e4c">Note—</heading><block><txt break.before="1">See also section 282(7) and (8) of the Act.</txt></block></note></block></clause><clause id="sec.5-frag-sec.45" guid="_8184b0fa-42bf-48a5-8b34-6b5ea8795898" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>45</no><heading id="sec.5-frag-sec.45-he" guid="_5384d6d9-14ea-4847-bc18-ad95f333c4f7">Particular health service employees to be employed by chief executive</heading><subclause id="sec.5-frag-sec.45-ssec.1" guid="_c9357285-fa69-45ab-b4bc-8ad27eca51e2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a health service employee, other than a health executive or senior health service employee, who was employed by the relevant Service immediately before the commencement (a <defterm id="sec.5-frag-sec.45-def.relevantemployee" guid="_4903d21e-bd03-44fe-a4ab-9b62a68ac311" type="definition">relevant employee</defterm>).</txt></block></subclause><subclause id="sec.5-frag-sec.45-ssec.2" guid="_eaa01239-8de3-4c57-bc8e-79e496a06c63" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">From the commencement, the relevant employee is taken to be employed by the chief executive, in the department, on the same terms, conditions and entitlements as those applying to the employee’s employment by the relevant Service immediately before the commencement.</txt></block></subclause><subclause id="sec.5-frag-sec.45-ssec.3" guid="_c3420efb-80af-4e24-a6de-049a88635659" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Without limiting subsection (2), the following matters apply in relation to the change to the relevant employee’s employment mentioned in that subsection—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-sec.45-ssec.3-para1.a" guid="_dc7beda8-8d25-47e2-afda-6e1aab4c15a5" provision.type="other"><no>(a)</no><block><txt break.before="0">the employee retains, and is entitled to, all rights, benefits and entitlements that have accrued to the employee because of the employee’s employment as a health service employee by the relevant Service;</txt></block></li><li id="sec.5-frag-sec.45-ssec.3-para1.b" guid="_c6e8767a-27a3-46c0-936e-351365552da7" provision.type="other"><no>(b)</no><block><txt break.before="0">the employee’s accruing rights, including to superannuation or recreation, sick, long service or other leave, are not affected;</txt></block></li><li id="sec.5-frag-sec.45-ssec.3-para1.c" guid="_873a40a1-53d3-42b6-bc65-911e724977e3" provision.type="other"><no>(c)</no><block><txt break.before="0">the employee’s continuity of service is not interrupted, except that the employee is not entitled to claim the benefit of a right or entitlement more than once in relation to the same period of service;</txt></block></li><li id="sec.5-frag-sec.45-ssec.3-para1.d" guid="_0c339431-b444-4ebb-aa6e-1a90b2911d81" provision.type="other"><no>(d)</no><block><txt break.before="0">the change to the employee’s employment does not constitute a termination of employment or a retrenchment or redundancy;</txt></block></li><li id="sec.5-frag-sec.45-ssec.3-para1.e" guid="_009ba9d0-eb95-45b3-bb08-35a93bca0451" provision.type="other"><no>(e)</no><block><txt break.before="0">the employee is not entitled to a payment or other benefit because the employee is no longer employed by the relevant Service.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-sec.45-ssec.4" guid="_0dc627d8-9f9f-4581-9f64-2de31934587a" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Subject to this section, the chief executive may issue a direction to the relevant employee to facilitate the transition of the employee’s employment from the relevant Service to the chief executive.</txt><note id="sec.5-frag-sec.45-ssec.4-note" guid="_a1c20266-ca2f-43f7-8077-7eb9b39a56da" type="example"><heading id="sec.5-frag-sec.45-ssec.4-note-he" guid="_9b2d6147-b8c9-483b-bb1e-dc4dfc8372f8">Note—</heading><block><txt break.before="1">See also the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3"><name emphasis="yes">Public Service Act 2008</name></legref>, section 187(1)(d).</txt></block></note></block></subclause><subclause id="sec.5-frag-sec.45-ssec.5" guid="_a88e7f27-1aff-4c5c-844e-c5d85912baec" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the relevant employee was, immediately before the commencement, employed by the relevant Service under a contract, the employee is taken to be employed by the chief executive, in the department, under the contract.</txt></block></subclause></clause><clause id="sec.5-frag-sec.46" guid="_a621f417-59f1-4f80-90c5-13189261a7d1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>46</no><heading id="sec.5-frag-sec.46-he" guid="_97a253ec-f1db-4a39-ba09-1cc8be9bd376">Appointment to perform functions or do other things not affected by becoming employees in the department</heading><subclause id="sec.5-frag-sec.46-ssec.1" guid="_8beb84a9-4864-4660-b7e5-7ee8f682ef75" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, before the commencement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-sec.46-ssec.1-para1.a" guid="_30760a81-a9de-4915-befe-39826b964e08" provision.type="other"><no>(a)</no><block><txt break.before="0">a relevant employee was appointed to perform a function or to do anything under the Act; and</txt></block></li><li id="sec.5-frag-sec.46-ssec.1-para1.b" guid="_f1d2594b-8c7c-4f6f-83ce-a550183f99a0" provision.type="other"><no>(b)</no><block><txt break.before="0">the function or thing has not been completed.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-sec.46-ssec.2" guid="_c665f05b-8e5a-4438-9930-13f05811d709" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The appointment is not affected by the change to the relevant employee’s employment under section 45(2).</txt></block></subclause><subclause id="sec.5-frag-sec.46-ssec.3" guid="_e13ca972-e8d3-4787-bd68-ff3328eae25b" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The relevant employee may complete the function or thing on or after the commencement.</txt><note id="sec.5-frag-sec.46-ssec.3-note" guid="_c13ceb0e-66ea-41c1-9dc9-7b4efdc795e1" type="example"><heading id="sec.5-frag-sec.46-ssec.3-note-he" guid="_9d6e3bb9-31a3-42c6-9029-0dc80309f3d9">Example—</heading><block><txt break.before="1">A relevant employee’s appointment as a clinical reviewer, or as a member of an RCA team, is not affected by the relevant employee becoming an employee of the chief executive in the department under section 45(2) and the relevant employee may complete the matter for which the relevant employee was appointed.</txt></block></note></block></subclause></clause><clause id="sec.5-frag-sec.47" guid="_3b9d3c3c-e6dc-4d23-99dd-1ec255ce1619" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>47</no><heading id="sec.5-frag-sec.47-he" guid="_33dc40c4-8ffe-4ae8-a06b-a7d9003d9a33">Proceedings and other things not affected by persons becoming employees in the department</heading><subclause id="sec.5-frag-sec.47-ssec.1" guid="_232ee384-224b-40b1-828e-0d0b1d099e9b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if, before the commencement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-sec.47-ssec.1-para1.a" guid="_20368981-983a-4f5f-bb1d-f9f4db062906" provision.type="other"><no>(a)</no><block><txt break.before="0">a proceeding—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-sec.47-ssec.1-para1.a-para2.i" guid="_a1acc7f0-a45d-43b7-bc59-a8c8bc97cf56" provision.type="other"><no>(i)</no><block><txt break.before="0">was taken by or against a relevant employee as an employee of the relevant Service; and</txt></block></li><li id="sec.5-frag-sec.47-ssec.1-para1.a-para2.ii" guid="_a6b8a0c4-76e1-4c55-b112-780c7d41eda3" provision.type="other"><no>(ii)</no><block><txt break.before="0">was not completed; or</txt></block></li></list></block></li><li id="sec.5-frag-sec.47-ssec.1-para1.b" guid="_1f78d999-4bf4-429a-9fb1-7cc0b62e1a0b" provision.type="other"><no>(b)</no><block><txt break.before="0">a thing, other than a proceeding, was done in relation to a relevant employee as an employee of the relevant Service.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-sec.47-ssec.2" guid="_7b68fcb7-7750-4d36-9b91-c38dccee5683" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If subsection (1)(a) applies, from the commencement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-sec.47-ssec.2-para1.a" guid="_b2537e0a-d148-4e9c-8aba-7c0164cadddc" provision.type="other"><no>(a)</no><block><txt break.before="0">the chief executive is taken to be a party for the proceeding instead of the relevant Service; and</txt><note id="sec.5-frag-sec.47-ssec.2-para1.a-note" guid="_6acec919-9879-4eaf-8369-0e50b278b637" type="example"><heading id="sec.5-frag-sec.47-ssec.2-para1.a-note-he" guid="_4b8f51a3-98cd-45a6-bfe8-a722d358e7d3">Note—</heading><block><txt break.before="1">See also section 46 of the Act for the power of the chief executive to delegate the chief executive’s functions under the Act.</txt></block></note></block></li><li id="sec.5-frag-sec.47-ssec.2-para1.b" guid="_45b540bf-4864-48cb-b793-e1f7973e13fd" provision.type="other"><no>(b)</no><block><txt break.before="0">the proceeding may be continued and completed by or against the chief executive instead of the relevant Service.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-sec.47-ssec.3" guid="_88d00c43-304a-4a90-ba05-4f7ec5160da5" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If subsection (1)(b) applies, the thing done in relation to the relevant employee is not affected by the change to the relevant employee’s employment under section 45(2).</txt><note id="sec.5-frag-sec.47-ssec.3-note" guid="_3cc55113-3529-4b05-b0c3-b814fbe4dc24" type="example"><heading id="sec.5-frag-sec.47-ssec.3-note-he" guid="_65a7307c-5ed9-4fe2-95b0-38b276e684b5">Examples for subsection (3)—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-sec.47-ssec.3-note-para1.1" guid="_2942f6cb-2efb-43b7-8a16-453bc739ea47" provision.type="other"><no>1</no><block><txt break.before="0">A recruitment and selection process involving a relevant employee started before the commencement may continue from the commencement.</txt></block></li><li id="sec.5-frag-sec.47-ssec.3-note-para1.2" guid="_451fafe9-2a15-49a7-89e6-bfd96e7d2257" provision.type="other"><no>2</no><block><txt break.before="0">The approval of the annual leave for a relevant employee before the commencement is effective from the commencement.</txt></block></li></list></block></note></block></subclause></clause><clause id="sec.5-frag-sec.48" guid="_9ba717b2-107a-4a91-9dc2-d826e48c9d7c" affected.by.uncommenced="0" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3"><name emphasis="yes">Public Service Act 2008</name></legref>, s 149 to particular relevant employees</heading><subclause id="sec.5-frag-sec.48-ssec.1" guid="_170b2274-dff6-4c2f-8e7c-48e71dec4b55" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-frag-sec.48-ssec.1-para1.a" guid="_c6ca4a53-f34e-4b0e-937b-684f2b1a8d72" provision.type="other"><no>(a)</no><block><txt break.before="0">a relevant employee was continuously employed as a temporary employee by the relevant Service for a period; and</txt></block></li><li id="sec.5-frag-sec.48-ssec.1-para1.b" guid="_4f13ee65-753f-4c72-ac5a-82f3aa5d947f" provision.type="other"><no>(b)</no><block><txt break.before="0">the period had not ended immediately before the commencement.</txt></block></li></list></block></subclause><subclause id="sec.5-frag-sec.48-ssec.2" guid="_9da1f5f3-2557-4d9d-96ac-c4bf7e3a3552" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting section 45(2) or (3), the relevant employee is, for the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3"><name emphasis="yes">Public Service Act 2008</name></legref>, section 149, taken to have been continuously employed as a temporary employee by the chief executive, in the department, for the period mentioned in subsection (1).</txt></block></subclause><subclause id="sec.5-frag-sec.48-ssec.3" guid="_13fc7406-8aab-4ace-9972-f1cb314869f2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-frag-sec.48-ssec.3-def.continuouslyemployedasatemporaryemployee_" guid="_adcd8272-0073-4a28-861f-7038b69bd80a" affected.by.uncommenced="0"><txt break.before="1"><defterm provision.type="other"><no>(a)</no><block><txt break.before="0">a relevant employee was employed by the relevant Service as a casual employee on a regular and systematic basis for a period;
