or</txt></block></li><li id="sec.3-para1.b" guid="_9bfb80af-590b-4df6-8080-7d8ea23899d3" provision.type="other"><no>(b)</no><block><txt break.before="0">if the equitable percentage is more than 60% but not more than 74%—equal to the equitable percentage; or</txt></block></li><li id="sec.3-para1.c" guid="_00990495-4be0-4c1a-840d-053442a888c7" provision.type="other"><no>(c)</no><block><txt break.before="0">if the equitable percentage is more than 74% but not more than 100%—75%; or</txt></block></li><li id="sec.3-para1.d" guid="_78d744a4-7366-408c-832c-18b84b1929e6" provision.type="other"><no>(d)</no><block><txt break.before="0">if the equitable percentage is more than 100%—the equitable percentage minus 25%, up to a maximum of 100%.</txt></block></li></list></block></clause><clause id="sec.4" guid="_176a8e62-547e-42b1-b458-85565b9e4e5a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_630e44c5-2cb3-4d92-abd2-b8617b33f196">Calculating <defterm guid="_40ff72ee-35b8-4ebe-9f20-7e1518128f44" type="mention">equitable percentage</defterm></heading><block><txt break.before="1">For section 3, the <defterm id="def.equitablepercentage" guid="_b72ecefa-47b3-4f17-b889-d8a8a23664c8" type="definition">equitable percentage</defterm> is the percentage calculated, to 2 decimal places, using the following formula—</txt><formulablock id="sec.4-eq" guid="_1212e76e-3f63-4e19-8070-4b9a469a24e1" formula.align="center"><formula><eqn file.name="_1212e76e-3f63-4e19-8070-4b9a469a24e1.gif" height="0.412in" width="1.583in" dpi="96"/></formula></formulablock><txt break.before="1">where—</txt><deflist><definition id="sec.4-def.A_" guid="_a81907b1-c109-44e4-8323-21c8a4b8a957" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.A" guid="_f9dc4f5d-8232-45ed-a3d2-406df12d557a" type="definition">A</defterm> means the annual land rental percentage equal to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.A-para1.a" guid="_45a65f8f-a082-4399-b800-dbf51e2ba21b" provision.type="other"><no>(a)</no><block><txt break.before="0">if a percentage is prescribed under a regulation for the <legref jurisd="QLD" type="act" check="unknown"><name emphasis="yes">Housing Act 2003</name></legref>, section 136—the prescribed percentage; or </txt></block></li><li id="sec.4-def.A-para1.b" guid="_361ef6b3-bc4e-4d23-aef7-8aa8c9eb081e" provision.type="other"><no>(b)</no><block><txt break.before="0">otherwise—3%.</txt></block></li></list></definition><definition id="sec.4-def.B_" guid="_82791772-184a-4725-8957-0e3de8af59bc" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.B" guid="_25f8af05-49c5-4f79-8c63-3c318f2822d0" type="definition">B</defterm> means the Treasury indexed bond real yield rate, published from time to time by the Reserve Bank of Australia, for bonds with a maturity date of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.B-para1.a" guid="_e8c960ab-d513-47ad-9ca1-dfdb45510dd3" provision.type="other"><no>(a)</no><block><txt break.before="0">if the declared percentage is declared on or before 30 September 2020—September 2025; or </txt></block></li><li id="sec.4-def.B-para1.b" guid="_4258d04e-15fd-48a8-b6aa-8057ac388ae8" provision.type="other"><no>(b)</no><block><txt break.before="0">if the declared percentage is declared after 30 September 2020—September 2030.</txt></block></li></list></definition><definition id="sec.4-def.EP_" guid="_4514c2d6-d44e-44f4-8f65-dd877f93de40" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.EP" guid="_65f46f03-e749-402c-9256-89365b67f925" type="definition">EP</defterm> means the equitable percentage.</txt><note id="sec.4-def.EP-note" guid="_732cf28d-1297-403c-86b4-9a41bb618e72" type="example"><heading id="sec.4-def.EP-note-he" guid="_9d978be5-f3f0-4e56-8ea9-6691556ba7b8">Example—</heading><block><txt break.before="1">If A is 3% and the Treasury indexed bond real yield rate is 2.5%, the equitable percentage is 120%.</txt></block></note></definition></deflist></block></clause></body></wrapper></subordleg>
