and</txt></block></li><li id="sec.4-ssec.2-para1.b" guid="_804e8d82-31aa-4d54-a442-756ba522ec00" provision.type="other"><no>(b)</no><block><txt break.before="1">in exercising the powers of the tribunal under chapter 12, part 3 of the Act, combine all of the orders into a single forensic order (mental health).</txt></block></li></list></block></subclause><subclause id="sec.4-ssec.3" guid="_1dea46f7-4d99-4a48-8c01-34ad2b1700cd" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">This section does not limit section 839 or 851 of the Act or the powers of the tribunal under chapter 12, part 3 of the Act.</txt></block></subclause></clause><clause id="sec.5" guid="_9db6dc3f-c1bb-4a59-a345-378ac88cc7fe" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_8ed374f0-83e0-48e1-a5aa-8ae2fae61ab0">Person subject to multiple forensic orders (disability)</heading><subclause id="sec.5-ssec.1" guid="_0b8c6325-7b28-41c9-a869-46ef7a872ed5" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">This section applies if, immediately before the commencement of the Act, a person is subject to 2 or more forensic orders (disability) of the type mentioned in section 837(2) of the Act. </txt></block></subclause><subclause id="sec.5-ssec.2" guid="_19db30bb-7a37-497e-ba96-f99511703035" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">When the first review, under chapter 12 of the Act, of 1 of the orders is heard by the tribunal, the tribunal must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_20a5e88b-dccc-48ef-83b6-3f4fcf927156" provision.type="other"><no>(a)</no><block><txt break.before="1">conduct the review as a periodic review, under chapter 12 of the Act, of all of the orders as if they were a single forensic order (disability); and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_ed311276-2d06-4371-a4c6-e24e274728dc" provision.type="other"><no>(b)</no><block><txt break.before="1">in exercising the powers of the tribunal under chapter 12, part 3 of the Act, combine all of the orders into a single forensic order (disability). </txt></block></li></list></block></subclause><subclause id="sec.5-ssec.3" guid="_aa0605a0-385b-471b-b196-b0686b17e1b6" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="1">This section does not limit section 839 or 851 of the Act or the powers of the tribunal under chapter 12, part 3 of the Act.</txt></block></subclause></clause><clause id="sec.6" guid="_7fb7dbc3-9ed4-4d44-882b-e401a316f118" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_f7e14c2a-6093-4c4c-8d44-75453d42b5ce">Continuation of interstate agreements</heading><subclause id="sec.6-ssec.1" guid="_54e24220-6e19-4955-8cd4-79cbb9d54e90" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="1">An interstate agreement in force immediately before the commencement of the Act continues in force for—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_6083f69a-cf54-4048-a1c4-7555b295dbd8" provision.type="other"><no>(a)</no><block><txt break.before="1">the purpose of a corresponding law; and</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_f368548a-1a1e-42a7-a70f-2b8e54b6f056" provision.type="other"><no>(b)</no><block><txt break.before="1">the period the agreement would have been in force if the repealed Act had not been repealed.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_0acbcc20-abe7-4f7f-b913-28338ef0bab1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="1">In this section—</txt><definition id="sec.6-ssec.2-def.correspondinglaw_" guid="_ffe6873b-31b7-4e3e-85d2-48c82cebfe7a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-ssec.2-def.correspondinglaw" guid="_ffab3f74-faa2-448c-bd27-e0d6b5e4a96f" type="definition">corresponding law</defterm> means each of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-def.correspondinglaw-para1" guid="_f062665e-4166-464d-879b-352185d437ef" provision.type="other"><no>•</no><block><txt break.before="1"><legref jurisd="ACT" type="act" check="unknown"><name emphasis="yes">Mental Health Act 2015</name> (ACT)</legref></txt></block></li><li id="sec.6-ssec.2-def.correspondinglaw-para1-oc.2" guid="_e4ed964c-1666-41e6-9153-df0049a55aa1" provision.type="other"><no>•</no><block><txt break.before="1"><legref jurisd="NSW" type="act" check="unknown"><name emphasis="yes">Mental Health Act 2007</name> (NSW)</legref></txt></block></li><li id="sec.6-ssec.2-def.correspondinglaw-para1-oc.3" guid="_ff9710d1-5a63-4560-b28c-c041c8777b3f" provision.type="other"><no>•</no><block><txt break.before="1"><legref jurisd="VIC" type="act" check="unknown"><name emphasis="yes">Mental Health Act 2014</name> (Vic)</legref>.</txt></block></li></list></definition><definition id="sec.6-ssec.2-def.interstateagreement_" guid="_c95eb676-88fd-424b-b7fc-922baf02f30c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-ssec.2-def.interstateagreement" guid="_9e931db2-ccb2-4374-a009-1663519e1827" type="definition">interstate agreement</defterm> means an interstate agreement entered into under the repealed <legref jurisd="QLD" type="act" check="unknown"><name emphasis="yes">Mental Health Act 2000</name></legref>, section 176.</txt></definition></block></subclause></clause></body></wrapper></subordleg>
