jurisd="QLD" type="act" check="invalid"><name emphasis="yes">Criminal Law (Historical Homosexual Convictions Expungement) Act 2017</name></legref>.</txt></block></clause><clause id="sec.2" guid="_2f1aa2cd-148d-47a5-9912-27f5c05f5842" affected.by.uncommenced="0" spent.amends="0" provision.type="commence"><no>2</no><heading id="sec.2-he" guid="_6acdce20-0dc8-4b0e-96af-41df96aec8c8">Commencement</heading><block><txt break.before="1">This Act commences on a day to be fixed by proclamation.</txt></block></clause><clause id="sec.3" guid="_65c91360-5608-47fc-a6cb-41b89dcba493" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_61ac1bd3-26f3-4b54-90f1-6c3f74ff875f">Purpose</heading><subclause id="sec.3-ssec.1" guid="_45e6e195-6c60-4db2-9e66-4aa859f8815d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act establishes a scheme for the expungement, on application, of convictions and charges for particular offences involving homosexual activity.</txt></block></subclause><subclause id="sec.3-ssec.2" guid="_69292d7f-4a16-403e-8e3e-179bdbfe33ed" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The scheme only applies to convictions or charges that happened before 19 January 1991.</txt></block></subclause><subclause id="sec.3-ssec.3" guid="_1f421ea1-c06c-4fd6-b23f-4ecd169c160e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">To the extent provided in this Act, if a person’s conviction or charge for an offence is expunged, the person is to be treated in law as if the person had not been convicted of, or charged with, the offence.</txt></block></subclause></clause><clause id="sec.4" guid="_119fcfef-095f-443f-bce7-e8462f3cc4a4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_1e9ab304-d666-4f5d-a74f-c48291b76514">Act binds all persons</heading><subclause id="sec.4-ssec.1" guid="_5cc5dfb0-c253-4aa0-89e7-5ffd58d98ab4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act binds all persons, including the State and, as far as the legislative power of the Parliament permits, the Commonwealth and the other States.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_4ed338e3-b399-43d2-ba10-4cb511541fda" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.4-ssec.1" check="valid" target.guid="_5cc5dfb0-c253-4aa0-89e7-5ffd58d98ab4">Subsection&#160;(1)</intref> does not make the State, the Commonwealth or another State liable to be prosecuted for an offence.</txt></block></subclause></clause><clause id="sec.5" guid="_f0d97a3a-a7e0-466f-b19b-45c3d4c861bf" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_fc30592e-4c98-4bc1-88a0-7e964195bf36">Act does not affect lawful acts or entitle person to compensation</heading><subclause id="sec.5-ssec.1" guid="_315e39ef-5cea-4a65-81bd-1b699b75809b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">No provision of this Act affects anything lawfully done before a conviction or charge is expunged.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_42b7fa76-0f3b-4446-9d2c-42a460319316" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person who has a conviction or charge expunged under this Act is not entitled to compensation of any kind because the conviction or charge becomes an expunged conviction or expunged charge.</txt></block></subclause></clause></division><division id="pt.1-div.2" guid="_f1d078e4-f6a3-4b49-b70b-5c7f7b148b2a" target.guid="_d04fd282-4042-42dc-9529-8cf7089ad793">schedule&#160;1</intref> defines particular words used in this Act.</txt></block></clause><clause id="sec.7" guid="_42b216bd-35bb-419b-a1d2-d884363ada06" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_fbf4441c-f8c2-447e-b242-673736d0cd95">Meaning of <defterm guid="_a1769e7c-5bcf-4e18-ae8f-353deb53836b" type="mention">eligible person</defterm></heading><block><txt break.before="1">An <defterm id="def.eligibleperson" guid="_b9e5a857-e1ac-4026-90f5-6bf5cf83860e" type="definition">eligible person</defterm> is a person who was convicted of, or charged with, an eligible offence before 19 January 1991.</txt></block></clause><clause id="sec.8" guid="_4ed5830f-6e98-4abf-9aaa-5d2a91d77d65" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_baa2f124-3e10-4d95-90c4-74f8671cb6a3">Meaning of <defterm guid="_7805e2ca-6e02-4f04-98cb-f76352ee413a" type="mention">eligible offence</defterm></heading><subclause id="sec.8-ssec.1" guid="_a4a7e91e-51a2-4eb7-a4a5-0f0514b41448" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An <defterm id="sec.8-def.eligibleoffence-oc.2" guid="_e3c0a098-ad00-4c5c-b60b-41f3d462f160" type="definition">eligible offence</defterm> is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_02acdea1-5290-430c-bb0f-3bcfb7deaf9e" provision.type="other"><no>(a)</no><block><txt break.before="0">a Criminal Code male homosexual offence; or</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_31bb2461-7c53-4be0-bfb8-381eb9a6177f" provision.type="other"><no>(b)</no><block><txt break.before="0">a public morality offence; or</txt></block></li><li id="sec.8-ssec.1-para1.c" guid="_70f035d3-ccec-47e4-9649-81d47ae3f4f8" provision.type="other"><no>(c)</no><block><txt break.before="0">another offence prescribed by regulation.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_f64aa989-58f9-4457-aa96-8311e85d21a6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A regulation under <intref refid="sec.8-ssec.1" check="valid" target.guid="_a4a7e91e-51a2-4eb7-a4a5-0f0514b41448">subsection&#160;(1)</intref>(c) may only prescribe an offence to the extent the offence happened, or allegedly happened, before 19 January 1991.</txt></block></subclause></clause><clause id="sec.9" guid="_1c51579f-4900-430e-b1e0-080f1f1a8a77" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_b1341174-f51f-400a-8e14-616a550dc08d">Meaning of <defterm id="sec.9-def.CriminalCodemalehomosexualoffence" guid="_25a01d23-83e3-42bc-89e9-af9c0af1de03" type="definition">Criminal Code male homosexual offence</defterm></heading><block><txt break.before="1">A <defterm id="def.CriminalCodemalehomosexualoffence" guid="_846d2fa3-8bc9-40a5-a04a-6b48eb883178" type="definition">Criminal Code male homosexual offence</defterm> is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-para1.a" guid="_7b68ee55-e651-4da6-bb53-f19a2b61e4d2" provision.type="other"><no>(a)</no><block><txt break.before="0">an offence against any of the following provisions of the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1899-009" target.version.series="19dc3aee-7313-4ba8-a7f6-7abf0c19b425"><name emphasis="no">Criminal Code</name></legref> as in force before 19 January 1991—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-para1.a-para2.i" guid="_c1b4dede-e96d-4fff-a650-60707ad2f544" provision.type="other"><no>(i)</no><block><txt break.before="0"><intref refid="sec.208" check="invalid">section&#160;208</intref>(1) or (3) other than to the extent the offence involved heterosexual activity;</txt></block></li><li id="sec.9-para1.a-para2.ii" guid="_e32c1577-6bcf-4a15-b675-64182b8e311f" provision.type="other"><no>(ii)</no><block><txt break.before="0"><intref refid="sec.209" check="invalid">section&#160;209</intref> to the extent the offence involved an attempt to commit an offence mentioned in subparagraph (i);</txt></block></li><li id="sec.9-para1.a-para2.iii" guid="_44c5172a-342c-427b-be43-9c1458f47462" provision.type="other"><no>(iii)</no><block><txt break.before="0"><intref refid="sec.211" check="invalid">section&#160;211</intref>; or</txt></block></li></list></block></li><li id="sec.9-para1.b" guid="_d35d0983-1c57-49c1-91a4-35240414dee7" provision.type="other"><no>(b)</no><block><txt break.before="0">an offence of attempting to commit an offence mentioned in paragraph (a); or</txt></block></li><li id="sec.9-para1.c" guid="_52daa489-3ee7-4625-9bc4-42fc61fb669d" provision.type="other"><no>(c)</no><block><txt break.before="0">an offence of conspiring to commit an offence mentioned in paragraph (a); or</txt></block></li><li id="sec.9-para1.d" guid="_b1734298-76eb-4683-8a03-5bda6bb69f9c" provision.type="other"><no>(d)</no><block><txt break.before="0">an offence of counselling or procuring a person to commit an offence mentioned in paragraph (a).</txt></block></li></list></block></clause><clause id="sec.10" guid="_308c53f3-695d-4688-b942-13c028bc6b12" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_fef59b4e-7556-4fc9-a52b-234c15a672c3">Meaning of <defterm id="sec.10-def.publicmoralityoffence" guid="_b82f9753-fe97-4c0d-a38c-0d3276952514" type="definition">public morality offence</defterm></heading><block><txt break.before="1">A <defterm id="def.publicmoralityoffence" guid="_e9750bef-5bef-4d06-b46d-4aeac19987d3" type="definition">public morality offence</defterm> is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a" guid="_ec0ba00c-c468-47ab-b35c-233ea2a6f7fa" provision.type="other"><no>(a)</no><block><txt break.before="0">an offence against either of the following provisions as in force before 19 January 1991—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a-para2.i" guid="_5daa9b5b-e303-4eab-893a-c470426cda63" provision.type="other"><no>(i)</no><block><txt break.before="0">an offence against the repealed <legref jurisd="QLD" type="act" target.doc.id="act-1931-027" target.version.series="4b445a57-9e54-4ef3-b245-11ae9b6eb3f2" check="valid"><name emphasis="yes">Vagrants, Gaming and Other Offences Act 1931</name></legref>, <legref jurisd="QLD" type="act" refid="sec.5" target.doc.id="act-1931-027" target.version.series="4b445a57-9e54-4ef3-b245-11ae9b6eb3f2" check="invalid">section&#160;5</legref><legref jurisd="QLD" type="act" refid="sec.5-ssec.1" target.doc.id="act-1931-027" target.version.series="4b445a57-9e54-4ef3-b245-11ae9b6eb3f2" check="invalid">(1)</legref><legref jurisd="QLD" type="act" refid="sec.5-ssec.1-para1.b" target.doc.id="act-1931-027" target.version.series="4b445a57-9e54-4ef3-b245-11ae9b6eb3f2" check="invalid">(b)</legref> or 7(e);</txt></block></li><li id="sec.10-para1.a-para2.ii" guid="_3be187c4-a416-44fb-9a87-1a318bdac2fe" provision.type="other"><no>(ii)</no><block><txt break.before="0">an offence against the <legref jurisd="QLD" type="act" target.doc.id="act-1899-009" or</txt></block></li></list></block></li><li id="sec.10-para1.b" guid="_29adaa31-c8f7-468d-b871-b6db78ea1a9e" provision.type="other"><no>(b)</no><block><txt break.before="0">an offence of attempting to commit an offence mentioned in paragraph (a)(ii); or</txt></block></li><li id="sec.10-para1.c" guid="_562216f2-afd9-42d6-a308-a111857bd1ca" provision.type="other"><no>(c)</no><block><txt guid="_3c224395-1eb5-48bf-b8f4-8c2e66861d01">Application for conviction or charge to be expunged</heading><clause id="sec.11" guid="_d71b0280-f8ac-47b8-97d0-4be4655e0b13" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_32f2a574-cbea-4669-bf25-e66d5f00c312">Who may apply</heading><subclause id="sec.11-ssec.1" guid="_b3584521-4807-4bcc-8c9f-760ddd96a997" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An eligible person may apply to the chief executive for a conviction or charge of the eligible person for an eligible offence to be expunged.</txt></block></subclause><subclause id="sec.11-ssec.2" guid="_a7dcb54c-ad90-4ed8-9b3f-4ca822c55859" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the eligible person is an adult with impaired capacity, the application may be made by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.a" guid="_15f3e1b3-6c98-4a44-8879-7d4ba4a97e9a" provision.type="other"><no>(a)</no><block><txt break.before="0">if the eligible person has a guardian—the guardian; or</txt><note id="sec.11-ssec.2-para1.a-note" guid="_3b7fdf7f-5592-4933-b917-18a3cf06f65f" type="example"><heading id="sec.11-ssec.2-para1.a-note-he" guid="_3b56b740-a82b-4ec9-8b49-88016a46e7cc">Note—</heading><block><txt break.before="1">See the <legref jurisd="QLD" type="act" target.doc.id="act-2000-008" target.version.series="2be00591-d24b-4d27-adb7-2d5071432589" check="valid"><name emphasis="yes">Guardianship and Administration Act 2000</name></legref>, <legref jurisd="QLD" type="act" refid="sec.12" target.doc.id="act-2000-008" target.version.series="2be00591-d24b-4d27-adb7-2d5071432589" check="valid" target.guid="_87c0dec2-1bfd-45c2-b30b-2b651a0a4fdf">sections&#160;12</legref> and 33.</txt></block></note></block></li><li id="sec.11-ssec.2-para1.b" guid="_a49a0e79-371f-4cd6-a311-e092c69b6611" provision.type="other"><no>(b)</no><block><txt break.before="0">if the eligible person does not have a guardian but has appointed an attorney under an enduring power of attorney—the attorney; or</txt></block></li><li id="sec.11-ssec.2-para1.c" guid="_6cb2a1c9-4e01-44cd-808e-6d7a5bc99362" provision.type="other"><no>(c)</no><block><txt break.before="0">if the eligible person does not have a guardian and has not appointed an attorney under an enduring power of attorney—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.c-para2.i" guid="_bb8d6144-fd07-4e2e-ab16-971810adcf5a" provision.type="other"><no>(i)</no><block><txt break.before="0">a member of the eligible person’s support network; or</txt></block></li><li id="sec.11-ssec.2-para1.c-para2.ii" guid="_4c7bc512-4c88-4c10-8310-ea77a4781f24" provision.type="other"><no>(ii)</no><block><txt break.before="0">another person approved by the chief executive.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.11-ssec.3" guid="_201f279c-00a4-435f-a89f-78053301eae9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the eligible person died after 19 January 1991, the application may be made by the first of the following who is available—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.3-para1.a" guid="_35d22493-322b-46d1-8b20-bb6be0024be0" provision.type="other"><no>(a)</no><block><txt break.before="0">the personal representative of the eligible person;</txt></block></li><li id="sec.11-ssec.3-para1.b" guid="_b14cffe2-a059-4492-9659-29016cfc6e97" provision.type="other"><no>(b)</no><block><txt break.before="0">a person who was the eligible person’s spouse on the day the eligible person died;</txt></block></li><li id="sec.11-ssec.3-para1.c" guid="_62254a10-d758-4db2-abc2-5af0b38a9a12" provision.type="other"><no>(c)</no><block><txt break.before="0">a parent of the eligible person;</txt></block></li><li id="sec.11-ssec.3-para1.d" guid="_3ef7984c-9aa6-4201-b10e-b11cd5bda505" provision.type="other"><no>(d)</no><block><txt break.before="0">an adult child of the eligible person;</txt></block></li><li id="sec.11-ssec.3-para1.e" guid="_db0fde99-1692-4009-a845-f22c3754f0ff" provision.type="other"><no>(e)</no><block><txt break.before="0">an adult sibling of the eligible person;</txt></block></li><li id="sec.11-ssec.3-para1.f" guid="_5600b4ce-79d6-4f32-b8fd-03264f8a0e05" provision.type="other"><no>(f)</no><block><txt break.before="0">an adult who was in a close personal relationship with the eligible person immediately before the eligible person died.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.4" guid="_ca877aa7-1f41-4b54-9435-b6273c6c6de7" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.11-ssec.4-def.adultchild_" guid="_76a38f71-dd68-4eba-95de-3d365ca05ac7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.4-def.adultchild" guid="_a59bf8d8-fd55-4838-8786-e7bc8a6204b9" type="definition">adult child</defterm>, of an eligible person, means a child of the person who is 18 years or more.</txt></definition><definition id="sec.11-ssec.4-def.adultsibling_" guid="_5274a945-8b25-45bb-8c97-82ab00bd1ad7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.4-def.adultsibling" guid="_63bdc7c4-9c5d-4a05-82ec-0fcdfe8f3b64" type="definition">adult sibling</defterm>, of an eligible person, means a sibling of the person who is 18 years or more.</txt></definition><definition id="sec.11-ssec.4-def.enduringpowerofattorney_" guid="_4f6a5fc6-0b74-4482-9435-49d5125cac34" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.4-def.enduringpowerofattorney" guid="_07405bc7-bfe4-4e61-881d-9d27ced42906" type="definition">enduring power of attorney</defterm> means an enduring power of attorney under the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-1998-022" id="sec.12-ssec.1" guid="_4dd24ccf-a497-4f0d-8856-88a1f58748fe" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The application must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.a" guid="_f7e9b21f-f096-4d81-a11b-bb2f27fc892d" provision.type="other"><no>(a)</no><block><txt break.before="0">be in the approved form; and</txt></block></li><li id="sec.12-ssec.1-para1.b" guid="_ef71a74c-53f5-4f4e-9623-81686a0cf012" provision.type="other"><no>(b)</no><block><txt break.before="0">state the following information about each eligible offence to which the application relates to the extent the information is available to the applicant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.b-para2.i" guid="_1d22e34e-053f-4edf-a504-71857b1163fc" provision.type="other"><no>(i)</no><block><txt break.before="0">the date of the conviction or charge;</txt></block></li><li id="sec.12-ssec.1-para1.b-para2.ii" guid="_d3c7dd19-fccd-4794-82d9-ad293053c0bd" provision.type="other"><no>(ii)</no><block><txt break.before="0">the place and court (if any) where the eligible person was convicted or charged;</txt></block></li><li id="sec.12-ssec.1-para1.b-para2.iii" guid="_89658150-f972-4f3b-b579-7bbf3025464d" provision.type="other"><no>(iii)</no><block><txt break.before="0">the particulars of the offence;</txt><note id="sec.12-ssec.1-para1.b-para2.iii-note" guid="_09ccbcc4-c8ef-46f9-be55-2987ce24c100" type="example"><heading id="sec.12-ssec.1-para1.b-para2.iii-note-he" guid="_b943b4de-0e4e-4c94-b37d-10b77952f691">Examples of the particulars of an offence—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.b-para2.iii-note-para3" guid="_62b5e9d7-1e18-4cdf-a1f5-fc33031d0d7f" provision.type="other"><no>•</no><block><txt break.before="0">the nature of the offence</txt></block></li><li id="sec.12-ssec.1-para1.b-para2.iii-note-para3-oc.2" guid="_a45e9ba9-cde0-4a8b-8eef-0ab7decc75e3" provision.type="other"><no>•</no><block><txt break.before="0">the act or omission constituting the offence</txt></block></li><li id="sec.12-ssec.1-para1.b-para2.iii-note-para3-oc.3" guid="_347df59a-7eec-4c2f-adc2-1d09a06023ff" provision.type="other"><no>•</no><block><txt break.before="0">the place where the offence was committed or allegedly committed</txt></block></li><li id="sec.12-ssec.1-para1.b-para2.iii-note-para3-oc.4" guid="_8bc8eb11-1ea8-432b-8a05-4cc59e756883" provision.type="other"><no>•</no><block><txt break.before="0">the provision of the <legref jurisd="QLD" type="act" target.doc.id="act-2017-037" target.version.series="82179192-0010-47d7-9deb-4ebee635481f" check="invalid">Act</legref> that was contravened or allegedly contravened</txt></block></li></list></block></note></block></li><li id="sec.12-ssec.1-para1.b-para2.iv" guid="_40b0acf8-44a1-4cb2-b088-7af2e1b2c84a" provision.type="other"><no>(iv)</no><block><txt break.before="0">if the eligible person was convicted of the eligible offence—whether the eligible person was convicted on a plea of guilty;</txt></block></li><li id="sec.12-ssec.1-para1.b-para2.v" guid="_78d17062-28cd-4005-abf5-b66d0af29e4a" provision.type="other"><no>(v)</no><block><txt break.before="0">the details of any sentence imposed; and</txt></block></li></list></block></li><li id="sec.12-ssec.1-para1.c" guid="_e1ce3a2f-25ff-49aa-bce5-e3fdf5a66044" provision.type="other"><no>(c)</no><block><txt break.before="0">include the applicant’s consent to the making of inquiries of, and the exchange of information with, each criminal record holder for the purpose of deciding whether to expunge a conviction or charge the subject of the application.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.2" guid="_6c895173-a827-47b6-b8ff-527bd873c41c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The application must be accompanied by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a" guid="_80269bf6-a305-4ad7-807c-944de7ff4005" provision.type="other"><no>(a)</no><block><txt break.before="0">evidence of identity for the applicant; and</txt></block></li><li id="sec.12-ssec.2-para1.b" guid="_82350f1a-5d42-43e8-8224-cce9cbb49e4e" provision.type="other"><no>(b)</no><block><txt break.before="0">if the eligible person has died—a death certificate for the eligible person; and</txt></block></li><li id="sec.12-ssec.2-para1.c" guid="_24fb610d-f37a-47bf-9895-743c7c31f0ed" provision.type="other"><no>(c)</no><block><txt break.before="0">any other document prescribed by regulation.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.3" guid="_3236702c-7d5a-4e04-9545-875358065268" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The application may be accompanied by any other information or document the applicant reasonably considers may help the chief executive in deciding whether to expunge a conviction or charge the subject of the application.</txt></block><note id="sec.12-ssec.3-note" guid="_bc6feb74-9551-4caa-84b0-316d5bd0ff68" type="example"><heading id="sec.12-ssec.3-note-he" guid="_3f9d7b3e-8a39-4527-a848-fc61d15a0142">Examples of other information or a document—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.3-note-para1" guid="_252ca3a0-e14d-4b14-b923-75aa61dc4104" provision.type="other"><no>•</no><block><txt break.before="0">a statement by the applicant addressing the criteria the chief executive must consider in deciding whether to expunge the conviction or charge</txt></block></li><li id="sec.12-ssec.3-note-para1-oc.2" guid="_5e86e840-a0d4-4705-a5a6-fba0734b46cf" provision.type="other"><no>•</no><block><txt break.before="0">written evidence of a person involved in the act or omission constituting the eligible offence about the eligible provision.type="other"><no>(4)</no><block><txt break.before="0">The application may relate to more than 1 conviction or charge of the eligible person for an eligible offence.</txt></block></subclause><subclause id="sec.12-ssec.5" guid="_54df6cd3-1358-490f-a7c3-dd79720171eb" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.12-ssec.5-def.deathcertificate_" guid="_fb02d22a-315e-4140-9b59-adb70c4395e6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.12-ssec.5-def.deathcertificate" guid="_0202d46f-517a-44a5-a6bb-81180eb5f219" type="definition">death certificate</defterm>, for an eligible person, means a certificate of the eligible person’s death issued under the <legref jurisd="QLD" type="act" check="valid" target.doc.id="act-2003-031" target.version.series="b2507b9b-0801-43b1-9e4d-cd7b72c8ad26"><name emphasis="yes">Births, Deaths and Marriages Registration Act 2003</name></legref> or a law of another jurisdiction that corresponds to that Act.</txt></definition><definition id="sec.12-ssec.5-def.evidenceofidentity_" guid="_f03fefa9-2a46-4d30-aefe-b4f7f5c68a84" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.12-ssec.5-def.evidenceofidentity" guid="_32fa6d0e-1f5e-45ee-9df2-b35f31b6640b" type="definition">evidence of identity</defterm> means the evidence of identity prescribed by regulation.</txt></definition></deflist></block></subclause></clause><clause id="sec.13" guid="_82aa7ca2-4b0a-4589-808b-2a2f08951a69" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_fe64bb19-13da-4b7c-bf52-0bccf5de012e">Withdrawing all or part of application</heading><block><txt break.before="1">The applicant may, by notice given to the chief executive, withdraw—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-para1.a" guid="_ea854dda-583e-4acd-a2a7-87d8853cca50" provision.type="other"><no>(a)</no><block><txt break.before="0">all of the application at any time before the applicant receives a notice under <intref refid="sec.22" check="valid" target.guid="_cbc37135-c060-48e7-9275-ddefd9c2ce22">section&#160;22</intref> in relation to any conviction or charge the subject of the application; or</txt></block></li><li id="sec.13-para1.b" guid="_0a115652-e019-4573-a435-86a0c099da50" provision.type="other"><no>(b)</no><block><txt break.before="0">part of the application relating to a particular conviction or charge at any time before the applicant receives a notice under <intref refid="sec.22" check="valid" target.guid="_cbc37135-c060-48e7-9275-ddefd9c2ce22">section&#160;22</intref> in relation to the particular conviction or charge.</txt></block></li></list></block></clause><clause id="sec.14" guid="_319916f5-add1-46bc-8b1c-478b5b45ca31" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_878b676e-bee7-440e-bc24-80c486dfad2a">Chief executive may request further information or document from applicant</heading><subclause id="sec.14-ssec.1" guid="_6043ee2a-b08f-4971-80b6-23e767e62d98" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive may, by notice given to the applicant, ask the applicant for further information or a document the chief executive reasonably requires to decide whether to expunge a conviction or charge the subject of the application.</txt></block></subclause><subclause id="sec.14-ssec.2" guid="_20dcef2c-18c2-4020-b425-cb07e5f8e2a4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the chief executive makes a request under <intref refid="sec.14-ssec.1" check="valid" target.guid="_6043ee2a-b08f-4971-80b6-23e767e62d98">subsection&#160;(1)</intref>, the chief executive may give the applicant any information or a document about the conviction or charge in the chief executive’s possession or control.</txt></block></subclause><subclause id="sec.14-ssec.3" guid="_c1979424-ac61-4233-9047-ccc073ad8b99" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sec.14-ssec.2" check="valid" target.guid="_20dcef2c-18c2-4020-b425-cb07e5f8e2a4">Subsection&#160;(2)</intref> does not apply to the extent the information or document contains confidential information about a person other than the applicant or eligible person.</txt></block></subclause><subclause id="sec.14-ssec.4" guid="_3aa6c29e-59e3-4e8e-b674-4d65881821ba" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the chief executive makes a request under <intref refid="sec.14-ssec.1" check="valid" target.guid="_6043ee2a-b08f-4971-80b6-23e767e62d98">subsection&#160;(1)</intref>, the chief executive may make a decision under <intref refid="sec.17" check="valid" target.guid="_e8225992-c8c7-4c5c-80ff-5b96fb2818ee">section&#160;17</intref> to expunge or refuse to expunge the conviction or charge regardless of whether the applicant gives the further information or document requested.</txt></block></subclause><subclause id="sec.14-ssec.5" guid="_8d3b7ea3-1420-41fb-a9ee-c4e8a0998dc3" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The chief executive may, by notice given to the applicant, ask the applicant to verify by statutory declaration any information or document the applicant gives, or has given, the chief executive.</txt></block></subclause></clause><clause id="sec.15" guid="_d34cc58c-1905-4b74-97bf-fa220450870e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_1e3b673b-4412-4d87-bc8e-28a333f5facd">Chief executive may request information from criminal record holder</heading><subclause id="sec.15-ssec.1" guid="_f8f8f65f-845b-482b-a4cd-162489016479" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the chief executive has the applicant’s consent to make inquiries of, and exchange information with, a criminal record holder.</txt></block></subclause><subclause id="sec.15-ssec.2" guid="_2a41ca50-6af1-4d62-950c-8f5c7ffbe5d6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may ask the criminal record holder for a public record containing information about a conviction or charge the subject of the application.</txt></block></subclause><subclause id="sec.15-ssec.3" guid="_9c755e0d-bc7e-42c3-8726-150aa4a28d79" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The criminal record holder must comply with the request if the criminal record holder holds the other than the applicant, or an entity other than a criminal record holder, may have information or a document the chief executive reasonably requires to decide whether to expunge a conviction or charge the subject of the application.</txt></block></subclause><subclause id="sec.16-ssec.2" guid="_bf452eee-78f5-4e52-a8c2-b57ae545a64b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may, by notice given to the person or entity, ask the person or entity for the information or document.</txt></block></subclause><subclause id="sec.16-ssec.3" guid="_ddf36d2f-d71a-41ad-b98c-90cf0a000f0a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the information or document is not publicly available, the chief executive may only make a request under <intref refid="sec.16-ssec.2" check="valid" target.guid="_bf452eee-78f5-4e52-a8c2-b57ae545a64b">subsection&#160;(2)</intref> with the applicant’s written consent.</txt></block></subclause><subclause id="sec.16-ssec.4" guid="_fe4f89c5-0ea3-4c76-afa4-98fa22f19c37" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The chief executive may, by notice given to the person or application</heading><subclause id="sec.17-ssec.1" guid="_bf2e7212-d17a-4354-9a8e-0dec9268f884" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive must consider the application and decide to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.17-ssec.1-para1.a" guid="_50f5b552-91f1-4c7c-9b93-cfa510ae0ad5" provision.type="other"><no>(a)</no><block><txt break.before="0">expunge a conviction or charge the subject of the application; or</txt></block></li><li id="sec.17-ssec.1-para1.b" guid="_883ef0ae-514a-4037-b5ef-4d99f28b6929" provision.type="other"><no>(b)</no><block><txt break.before="0">refuse to expunge a conviction or charge the subject of the application.</txt></block></li></list></block></subclause><subclause id="sec.17-ssec.2" guid="_3e087c5e-fdac-4a48-a651-075d03874c13" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In acting under <intref refid="sec.17-ssec.1" check="valid" target.guid="_bf2e7212-d17a-4354-9a8e-0dec9268f884">subsection&#160;(1)</intref>, the chief executive must not hold an oral hearing.</txt></block></subclause></clause><clause id="sec.18" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a conviction or charge the subject of the application is for a Criminal Code male homosexual offence.</txt></block></subclause><subclause id="sec.18-ssec.2" guid="_4d13e1a9-fbfa-485b-9c85-36b28230f0c0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may decide to expunge the conviction or charge for the offence only if the chief executive is satisfied, on the balance of probabilities, that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a" guid="_e32c328f-a292-4730-ad62-75a17eb7caca" provision.type="other"><no>(a)</no><block><txt break.before="0">the other person who engaged, or allegedly engaged, in the act or omission constituting the offence—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.a-para2.i" guid="_df16ffdc-6d9c-4390-a667-11e800716ea7" provision.type="other"><no>(i)</no><block><txt break.before="0">consented to the act or omission; and</txt></block></li><li id="sec.18-ssec.2-para1.a-para2.ii" guid="_1b60f6ec-fde0-447f-90b2-f6a736659365" provision.type="other"><no>(ii)</no><block><txt break.before="0">was 18 years or more at the time the offence was committed or alleged to have been committed; and</txt></block></li></list></block></li><li id="sec.18-ssec.2-para1.b" guid="_9ec36cd5-dfd8-41d3-9d55-11e5234e3a6b" provision.type="other"><no>(b)</no><block><txt break.before="0">the act or omission constituting the offence—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.b-para2.i" guid="_ca89f176-7cf1-4a41-8fe6-4dff606a4742" provision.type="other"><no>(i)</no><block><txt break.before="0">would not constitute an offence under the law of Queensland if it were done by the eligible person at the time the application was made; or</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.ii" guid="_415c08fd-5b6b-4c14-8e8d-7eb972781651" provision.type="other"><no>(ii)</no><block><txt break.before="0">meets the criteria in <intref refid="sec.18-ssec.2A" check="valid" target.guid="_00f5dc1e-bab5-4ad4-a7e9-b7d31e32d560">subsection&#160;(2A)</intref>.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.18-ssec.2A" guid="_00f5dc1e-bab5-4ad4-a7e9-b7d31e32d560" affected.by.uncommenced="0" provision.type="other"><no>(2A)</no><block><txt break.before="0">For <intref refid="sec.18-ssec.2" check="valid" target.guid="_4d13e1a9-fbfa-485b-9c85-36b28230f0c0">subsection&#160;(2)</intref>(b)(ii), the criteria are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2A-para1.a" id="sec.18-ssec.2A-para1.a-para2.i" guid="_be681bd3-aac9-4b68-bd4f-a231c874cff6" provision.type="other"><no>(i)</no><block><txt break.before="0">was done, or allegedly done, in a public place; and</txt></block></li><li id="sec.18-ssec.2A-para1.a-para2.ii" guid="_cd7be64c-11d2-4ae8-9940-6c96b4f1340d" provision.type="other"><no>(ii)</no><block><txt break.before="0">would not constitute an offence under the law of Queensland if it were done at the time the application was made, other than in a public place; and</txt></block></li></list></block></li><li id="sec.18-ssec.2A-para1.b" in a public toilet</txt></block></note></block></li></list></block></subclause><subclause id="sec.18-ssec.3" guid="_ba800a55-02cd-4f44-bfa1-4f6cf846e931" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In considering the criteria mentioned in <intref refid="sec.18-ssec.2" check="valid" target.guid="_4d13e1a9-fbfa-485b-9c85-36b28230f0c0">subsection&#160;(2)</intref> or (2A), the chief executive must have regard to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.3-para1.a" guid="_6647396d-d488-4c6d-a01b-438985692026" provision.type="other"><no>(a)</no><block><txt break.before="0">any public record containing information about the conviction or affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sec.19-he" guid="_2ffa8042-1680-4aab-8c3f-0ea188a9085d">Criteria for public morality offence</heading><subclause id="sec.19-ssec.1" guid="_556d5718-d6f4-408f-be65-30250f5a679b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a conviction or charge the subject of the application is for a public morality offence.</txt></block></subclause><subclause id="sec.19-ssec.2" guid="_775a361b-9f2f-49ff-a3d0-169a65d86e08" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may decide to expunge the conviction or charge for the offence only if the chief executive is satisfied, on the balance of probabilities, that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.2-para1.a" guid="_6106692f-da90-420d-91ae-fdc59217ff30" provision.type="other"><no>(a)</no><block><txt break.before="0">the offence involved homosexual activity; and</txt></block></li><li id="sec.19-ssec.2-para1.b" guid="_a9209644-fcf7-4519-899a-3863d48190d2" provision.type="other"><no>(b)</no><block><txt break.before="0">the act or omission constituting the offence—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.2-para1.b-para2.i" guid="_5c0fed27-bed2-4d48-be42-094bb2273495" provision.type="other"><no>(i)</no><block><txt break.before="0">would not constitute an offence under the law of Queensland if it were done by the eligible person at the time the application was made; or</txt></block></li><li id="sec.19-ssec.2-para1.b-para2.ii" guid="_3c85d5ec-6c89-413a-9d4f-db637a0cab28" provision.type="other"><no>(ii)</no><block><txt break.before="0">meets the criteria in <intref refid="sec.19-ssec.2A" check="valid" target.guid="_163aeb0f-e52f-4440-baf3-a9f314c72431">subsection&#160;(2A)</intref>.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.19-ssec.2A" id="sec.19-ssec.2A-para1.a-para2.i" guid="_bf7799c9-e857-4db1-901e-cd5b152ce372" provision.type="other"><no>(i)</no><block><txt break.before="0">was done, or allegedly done, in a public place; and</txt></block></li><li id="sec.19-ssec.2A-para1.a-para2.ii" guid="_7847de02-311f-4e5f-a46a-ce99d0745243" provision.type="other"><no>(ii)</no><block><txt break.before="0">would not constitute an offence under the law of Queensland if it were done at the time the application was made, other than in a public place; and</txt></block></li></list></block></li><li id="sec.19-ssec.2A-para1.b" guid="_41eb98d6-4ceb-4305-8b3a-08f06c3b0771" provision.type="other"><no>(b)</no><block><txt break.before="0">a person, other than a person engaging in the act or omission, would not have been able to guid="_97a142f5-1c58-42a1-9ebd-654b61b1ecfa">Criteria for other eligible offences</heading><subclause id="sec.20-ssec.1" guid="_12603637-0550-4ef7-a392-62bc0623804f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a conviction or charge the subject of the application is for an eligible offence other than a Criminal Code male homosexual offence or a public morality offence.</txt></block></subclause><subclause id="sec.20-ssec.2" guid="_f4299bf0-6f3b-478b-9d32-5ff5ca1daa89" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive may decide to expunge the conviction or charge for the offence only if the chief executive is satisfied, on the balance of probabilities—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.2-para1.a" guid="_46a33241-530a-41f9-855f-3a0a1d8ad5f5" provision.type="other"><no>(a)</no><block><txt break.before="0">that the offence involved homosexual activity; and</txt></block></li><li id="sec.20-ssec.2-para1.b" guid="_35aeba77-a207-4f5d-8a90-39bdae186891" provision.type="other"><no>(b)</no><block><txt break.before="0">of the criteria prescribed by regulation for the offence.</txt></block></li></list></block></subclause></clause><clause id="sec.21" guid="_e1479669-67ed-4b37-890b-8561d49381cd" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_61072306-45e2-4f79-9285-83b0e3846e29">Proposed refusal to expunge conviction or charge</heading><subclause id="sec.21-ssec.1" guid="_096e5165-735d-4341-b698-4b6ff0791049" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the chief executive proposes to refuse to expunge a conviction or charge the subject of the application, the chief executive must give the applicant a notice—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.1-para1.a" guid="_e01910f3-3ab6-4b38-983e-bc2703af60bc" provision.type="other"><no>(a)</no><block><txt break.before="0">stating the chief executive proposes to refuse to expunge the conviction or charge (the <defterm id="sec.21-ssec.1-def.proposedrefusal" guid="_4e0dbeeb-f052-4294-bd10-5ce7e0df5ca4" type="definition">proposed refusal</defterm>); and</txt></block></li><li id="sec.21-ssec.1-para1.b" guid="_70cdc0c6-7ba0-4e67-b8df-b71b47dd08c6" provision.type="other"><no>(b)</no><block><txt break.before="0">informing the applicant of the reasons for the proposed refusal; and</txt></block></li><li id="sec.21-ssec.1-para1.c" guid="_30207592-3256-476a-9f73-698aaa45dddd" provision.type="other"><no>(c)</no><block><txt break.before="0">inviting the applicant to make a submission to the chief executive, within a stated period, in relation to the proposed refusal.</txt></block></li></list></block></subclause><subclause id="sec.21-ssec.2" guid="_2d5ce69f-9904-4007-89b2-1c0f87e3005a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, the chief executive must give the applicant any information or document—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.2-para1.a" guid="_612a85e5-98b1-4599-a34d-a659f1fb953d" provision.type="other"><no>(a)</no><block><txt break.before="0">obtained by the chief executive from a person or entity other than the applicant; and</txt></block></li><li id="sec.21-ssec.2-para1.b" guid="_410ea3b7-8641-41da-8596-1b83603ddba3" provision.type="other"><no>(b)</no><block><txt break.before="0">in the chief executive’s possession or control; and</txt></block></li><li id="sec.21-ssec.2-para1.c" guid="_9243080f-ed59-4463-9546-a1160c2b0073" provision.type="other"><no>(c)</no><block><txt break.before="0">relied on by the chief executive to support the proposed refusal.</txt></block></li></list></block></subclause><subclause id="sec.21-ssec.3" guid="_1d5050e0-71c7-4b87-bc0c-3060b77d003a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sec.21-ssec.2" check="valid" target.guid="_2d5ce69f-9904-4007-89b2-1c0f87e3005a">Subsection&#160;(2)</intref> does not apply to the extent the information or document contains confidential information about a person other than the applicant or eligible person.</txt></block></subclause><subclause id="sec.21-ssec.4" guid="_e3194e3f-ffc7-4335-bcf2-69173f5b5398" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The applicant may make a written submission about the proposed refusal to the chief executive in the period mentioned in <intref refid="sec.21-ssec.1" check="valid" target.guid="_096e5165-735d-4341-b698-4b6ff0791049">subsection&#160;(1)</intref>(c) (an <defterm id="sec.21-def.acceptedsubmission" guid="_b30db756-f0fb-4698-af63-081f43028eb3" type="definition">accepted submission</defterm>).</txt></block></subclause><subclause id="sec.21-ssec.5" guid="_20fe587e-9270-43ec-8218-27b78033ed07" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">After the period mentioned in <intref refid="sec.21-ssec.1" check="valid" target.guid="_096e5165-735d-4341-b698-4b6ff0791049">subsection&#160;(1)</intref>(c) has ended, the chief executive must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.5-para1.a" guid="_0e6d47b2-4e62-44a9-95bf-0d95abe493b7" provision.type="other"><no>(a)</no><block><txt break.before="0">if the applicant has made an accepted submission—consider the submission; and</txt></block></li><li id="sec.21-ssec.5-para1.b" guid="_9078ae09-e791-4584-9a35-9c940b5c63cc" provision.type="other"><no>(b)</no><block><txt break.before="0">whether or not the applicant has made an accepted submission—decide to expunge or refuse to expunge the conviction or charge.</txt></block></li></list></block></subclause></clause><clause id="sec.22" guid="_cbc37135-c060-48e7-9275-ddefd9c2ce22" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>22</no><heading id="sec.22-he" guid="_0c68dc6d-4e95-430b-9b90-e4d91bac313d">Notice of decision</heading><subclause id="sec.22-ssec.1" guid="_477fac16-c57a-4a2a-b5f0-1f65e8ee9cbb" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the chief executive decides to expunge a conviction or charge the subject of the application, the chief executive must give notice of the decision to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.1-para1.a" guid="_78d71e02-8a58-429b-b1ed-71518b6a9b2c" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant; and</txt></block></li><li id="sec.22-ssec.1-para1.b" guid="_790d5983-e3e6-41d2-8e9d-4d4717834117" provision.type="other"><no>(b)</no><block><txt break.before="0">each criminal record holder.</txt></block></li></list></block></subclause><subclause id="sec.22-ssec.2" guid="_1e57e8f8-4256-4bd3-a9ad-bbf0aa6b67de" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The decision takes effect on the day the notice is given to the applicant.</txt></block></subclause><subclause id="sec.22-ssec.3" guid="_372966f0-3715-4d0e-8d98-e51432bc05f9" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the chief executive decides to refuse to expunge a conviction or charge the subject of the application, the chief executive must give the applicant a QCAT information notice for the decision.</txt></block></subclause></clause><clause id="sec.23" guid="_ee121ecd-a00b-4c1d-b3a2-5a0c2fbfa18e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>23</no><heading id="sec.23-he" guid="_848893a1-1874-4170-bb9c-b3ed82619510">Subsequent expungement application</heading><subclause id="sec.23-ssec.1" guid="_deef4804-2688-451d-8083-e52cd07e3baf" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the chief executive decides to refuse to expunge a conviction or charge the subject of an expungement application (an <defterm id="sec.23-def.originalapplication" guid="_c75d85b3-9b51-4250-b288-5da153e59a36" type="definition">original application</defterm>).</txt></block></subclause><subclause id="sec.23-ssec.2" guid="_ee30cd06-5cbd-49aa-9199-a6f885884e31" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person may make a later expungement application in relation to the conviction or charge only if the chief executive is satisfied evidence relevant to the original application that was not available, or could not with reasonable diligence have been available, to the applicant before the chief executive decided to refuse to expunge the conviction or charge has become available.</txt></block></subclause></clause></part><part guid="_36794875-6112-44cf-ac3e-ebfc6f45e330">General</heading><clause id="sec.24" guid="_6a203e04-ee38-4a1e-ab0f-44ffb814c1c8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>24</no><heading id="sec.24-he" guid="_8c566041-39bb-4ba5-92b5-eaf657091623">Effect of expunged convictions and charges</heading><subclause id="sec.24-ssec.1" guid="_354b1679-faa0-4606-8b93-1156c062125d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A reference in an Act, other than this Act, to a conviction or charge does not include an expunged conviction or expunged charge.</txt></block></subclause><subclause id="sec.24-ssec.2" guid="_eb232b52-db53-476b-804b-a3563b8fa4ce" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting <intref refid="sec.24-ssec.1" check="valid" target.guid="_354b1679-faa0-4606-8b93-1156c062125d">subsection&#160;(1)</intref>, if a conviction or charge of a person for an offence is an expunged conviction or expunged charge—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.2-para1.a" guid="_3d53c33d-39f5-41a1-ac64-4cfaa5540f0e" provision.type="other"><no>(a)</no><block><txt break.before="0">it is lawful for the person to claim, on oath or otherwise, including in a proceeding before any court or tribunal, that the person was not convicted of, or charged with, the offence; and</txt></block></li><li id="sec.24-ssec.2-para1.b" guid="_c56345a1-d3ce-4b52-aa00-32b3c3dd281c" provision.type="other"><no>(b)</no><block><txt break.before="0">evidence is not admissible in a proceeding before any court or tribunal to prove the person was convicted of, or charged with, the offence; and</txt></block></li><li id="sec.24-ssec.2-para1.c" guid="_a6620d42-1856-4f79-a9c5-b24ae91b08dc" provision.type="other"><no>(c)</no><block><txt break.before="0">a question about the person’s criminal history is taken not to refer to the conviction or charge; and</txt></block></li><li id="sec.24-ssec.2-para1.d" guid="_6283d9b4-f08b-43e9-b83c-7b85222fe36d" provision.type="other"><no>(d)</no><block><txt break.before="0">the person is not required to disclose information about the conviction or charge to anyone; and</txt></block></li><li id="sec.24-ssec.2-para1.e" guid="_08a715cf-6fb5-4c6b-b01b-8a82cb612850" provision.type="other"><no>(e)</no><block><txt break.before="0">for the purpose of any Act, agreement or arrangement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.2-para1.e-para2.i" guid="_0dc9aa28-73b1-4cdf-ad5b-778338a27831" provision.type="other"><no>(i)</no><block><txt break.before="0">the conviction or charge is not part of the person’s criminal history; and</txt></block></li><li id="sec.24-ssec.2-para1.e-para2.ii" guid="_a633c770-e70c-4daa-973c-ec95338d0f61" provision.type="other"><no>(ii)</no><block><txt break.before="0">a reference to the person’s character, however expressed, does not require or allow anyone to take the conviction or charge into account; and</txt></block></li></list></block></li><li id="sec.24-ssec.2-para1.f" guid="_4c288671-162b-4ade-8db8-44db941e85a0" provision.type="other"><no>(f)</no><block><txt break.before="0">the conviction or charge, or non-disclosure of the conviction or charge, is not a proper ground for—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.24-ssec.2-para1.f-para2.i" guid="_5f808114-6053-4e16-b56d-0ab0186ab1b1" provision.type="other"><no>(i)</no><block><txt break.before="0">refusing to appoint the person to any office, profession or employment; or</txt></block></li><li id="sec.24-ssec.2-para1.f-para2.ii" guid="_ead25f1a-386a-409f-b65b-5013f2ef356a" provision.type="other"><no>(ii)</no><block><txt break.before="0">excluding or dismissing the person from any office, profession or employment; or</txt></block></li><li id="sec.24-ssec.2-para1.f-para2.iii" guid="_d306cdd5-7094-4b56-b041-af5925ae631c" provision.type="other"><no>(iii)</no><block><txt break.before="0">otherwise prejudicing the person in any way in any office, profession or employment; and</txt></block></li></list></block></li><li id="sec.24-ssec.2-para1.g" guid="_b2c2f20c-3234-43e1-a435-4fae0e0c08e1" provision.type="other"><no>(g)</no><block><txt break.before="0">if, before the conviction or charge was expunged, an application by the person under an Act for an authority was refused wholly because of the conviction or charge, the person may reapply for the authority without waiting any minimum period.</txt></block></li></list></block></subclause><subclause id="sec.24-ssec.3" guid="_e9563093-ff0c-4097-91ba-2a5978baf989" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A reference in <intref refid="sec.24-ssec.2" check="valid" target.guid="_eb232b52-db53-476b-804b-a3563b8fa4ce">subsection&#160;(2)</intref> to the happening of, or information about, a conviction or charge of a person for an offence includes the happening of, provision.type="other"><no>(b)</no><block><txt break.before="0">a prosecution of the person for the offence; or</txt></block></li><li id="sec.24-ssec.3-para1.c" guid="_55303242-9bbf-48b1-91fe-9e1e2e6f5488" provision.type="other"><no>(c)</no><block><txt break.before="0">the sentencing of the person for the offence; or</txt></block></li><li charges</heading><subclause id="sec.26-ssec.1" guid="_46226cc6-18df-4288-8aca-d57703bc2372" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a person who—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.1-para1.a" guid="_18223286-fb67-4a63-8259-86cb3a203e95" guid="_b95039f8-f288-467a-a2d7-febbd9eb7d3b">Chief executive may decide to revive expunged conviction or charge</heading><block><txt break.before="1">The chief executive may decide that an expunged conviction or expunged charge is no longer an expunged conviction or expunged charge if the chief executive is satisfied the conviction or charge became an expunged conviction or expunged charge because of false or misleading information.</txt></block></clause><clause id="sec.32" guid="_b24ed90e-a679-4b48-80ae-593b71b27191" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>(b)</no><block><txt break.before="0">informing the applicant of the reasons for the proposed decision; and</txt></block></li><li id="sec.32-ssec.1-para1.c" guid="_e0b66e5e-cd99-4033-bf08-57acf1eb04f1" provision.type="other"><no>(c)</no><block><txt break.before="0">inviting the applicant to make a submission to the chief executive, within a stated period, considering any accepted submission, the chief executive is still satisfied the expunged conviction or expunged charge became an expunged conviction or expunged charge because of false or misleading
