<act title="Domicile Act 1981" year.assent="1981" no="51" type="act" amending="none" print.type="act.reprint" first.valid.date="2021-07-01T00:00:00+10:00" in.force="allinforce" assent.date="1981-06-12T00:00:00+10:00" id="act-1981-051" version.desc.id="b8462410-267c-455b-a533-afb290837f70" version.series.id="3881824c-4f58-4629-81a4-3847ce53bcf0" publication.date="2021-07-01"><coverdata id="cd" guid="_9d375365-2fca-4c77-a708-a1416e43aab2"/><wrapper><front id="frnt" guid="_b6ea3fd2-3112-4ad8-99e8-4050711074d2"><shorttitle id="frnt-st" guid="_14e65c2b-79e4-4b13-b4bf-7ba178446381">Domicile Act 1981</shorttitle><longtitle id="frnt-lt" guid="_6b1d0b54-876c-4aaf-8adc-bce53a4ff3ab"><block><txt break.before="1">An Act to abolish the dependent domicile of married women and otherwise to reform the law relating to domicile</txt></block></longtitle></front><body numbering.style="manual"><clause id="sec.1" guid="_d95451a6-48e5-4c3b-ad8a-c105611093fc" provision.type="shorttitle" affected.by.uncommenced="0" spent.amends="0"><no>1</no><heading id="sec.1-he" guid="_1011dbd4-0c4e-4e22-b96b-cf74c8815b45">Short title</heading><block><txt break.before="1">This Act may be cited as the <legref target.doc.id="act-1981-051" target.version.series="3881824c-4f58-4629-81a4-3847ce53bcf0" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Domicile Act 1981</name></legref>.</txt></block></clause><clause id="sec.2" guid="_e3600c40-f6eb-42cf-8047-f1e09ed48361" provision.type="commence" affected.by.uncommenced="0" spent.amends="0"><no>2</no><heading id="sec.2-he" guid="_a6cf01fc-76dd-4ec1-a70a-834d1363cff2">Commencement</heading><subclause id="sec.2-ssec.1" guid="_cae753c8-2638-421e-8267-a629a8554586" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0"><intref refid="sec.1" target.guid="_d95451a6-48e5-4c3b-ad8a-c105611093fc" check="valid">Section&#160;1</intref> and this section shall commence on the day on which it is assented to for and on behalf of Her Majesty.</txt></block></subclause><subclause id="sec.2-ssec.2" guid="_4ec3baf5-dc12-4e5a-b0c8-b4d831948be1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Except as provided in <intref refid="sec.2-ssec.1" target.guid="_cae753c8-2638-421e-8267-a629a8554586" check="valid">subsection&#160;(1)</intref>, this Act shall commence on a day to be appointed by proclamation.</txt></block></subclause></clause><clause id="sec.3" guid="_31158742-84a0-4149-b891-2ffe73f81363" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_4181ae3e-71fe-4881-9ff5-807fa79f7957">Interpretation</heading><block><txt break.before="1">In this Act—</txt><deflist><definition id="sec.3-def.CommonwealthofAustralia_" guid="_7a4c6ab5-77f4-4c8d-b2fc-b3cb55632e6b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.CommonwealthofAustralia" guid="_efa928fc-eca2-49d4-a9d9-e3548a04ae7f" type="definition">Commonwealth of Australia</defterm> means the territory comprising the States and the Australian Capital Territory, the Jervis Bay Territory and the Northern Territory of Australia.</txt></definition><definition id="sec.3-def.country_" guid="_e2f284df-b630-464a-a2db-3907ea9388c8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.country" guid="_f08af18a-66ab-4b45-95e6-879204f4b067" type="definition">country</defterm> includes any state, province or other territory—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-def.country-para1.a" guid="_514e9903-2a0c-4178-a1ae-1f12b8892aaf" provision.type="other"><no>(a)</no><block><txt break.before="0">that is 1 of 2 or more territories that together form a country; and</txt></block></li><li id="sec.3-def.country-para1.b" guid="_ef2394cb-6d25-4086-9579-1a670bea8b7b" provision.type="other"><no>(b)</no><block><txt break.before="0">domicile in which can be material for any purpose of the laws of Queensland.</txt></block></li></list></definition><definition id="sec.3-def.union_" guid="_d348b68a-61ae-40d3-8449-6d108d381d3f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-def.union" guid="_1c082206-07e6-4de0-bb6b-b71d2e3d8459" type="definition">union</defterm> means any country that is a union or federation or other aggregation of 2 or more countries and includes the Commonwealth of Australia.</txt></definition></deflist></block></clause><clause id="sec.4" guid="_cc1c0e06-5d00-42a9-8672-eeb55e9279a2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_7d605a30-387f-42b8-8d00-c6b0134fc601">Operation of Act</heading><subclause id="sec.4-ssec.1" guid="_57ed9df7-8cba-4e18-bfcd-1b577dcaec00" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The domicile of a person at a time before the commencement of this section shall be determined as if this Act had not been enacted.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_1ba6459f-0bfd-476e-9c78-5a7491cfdde6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The domicile of a person at a time after the commencement of this section shall be determined as if this Act had always been in force.</txt></block></subclause><subclause id="sec.4-ssec.3" guid="_bcd6b9b3-9f4f-46aa-844b-f50377a42338" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Nothing in this Act affects the jurisdiction of any court in any proceedings commenced before the commencement of this section.</txt></block></subclause><subclause id="sec.4-ssec.4" guid="_9238ddec-53f3-44b5-8413-f75d52113582" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">This Act has effect to the exclusion of the application of the laws of any other country relating to any matter dealt with by this Act.</txt></block></subclause></clause><clause id="sec.5" guid="_a9cf703a-6dad-4bd9-b91e-94dac7984c62" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_0b5acea2-b98e-4eea-a8d1-35d51bd7a0bf">Abolition of rule of dependent domicile of married woman</heading><block><txt break.before="1">The rule of law whereby a married woman has at all times the domicile of her husband is abolished.</txt></block></clause><clause id="sec.6" guid="_afe9b461-d0df-4378-9b5d-198546cbad85" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_df19d1b1-f0e8-494f-979e-fce15e49813f">Abolition of rule of revival of domicile of origin</heading><block><txt break.before="1">The rule of law whereby the domicile of origin revives upon the abandonment of a domicile of choice without the acquisition of a new domicile of choice is abolished and the domicile a person has at any time continues until the person acquires a different domicile.</txt></block></clause><clause id="sec.7" guid="_120bce73-9f66-48ca-a9c1-efb6b23884c5" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_59eb308c-9553-455a-96a8-a972e5a44e51">Capacity to have independent domicile</heading><subclause id="sec.7-ssec.1" guid="_4b9fad64-1c64-482f-a183-616208ef0c7c" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person is capable of having an independent domicile if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_ee8f3b16-05aa-47db-b11c-3f420210a0b9" provision.type="other"><no>(a)</no><block><txt break.before="0">the person has attained the age of 18 years; or</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_2f68b9be-7835-44db-b504-498aa78eb665" provision.type="other"><no>(b)</no><block><txt break.before="0">the person is, or has at any time been, married;</txt></block></li></list></block><block><txt break.before="1">and not otherwise.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_df3459b2-9e8a-47eb-9830-26b9079e4073" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0"><intref refid="sec.7-ssec.1" target.guid="_4b9fad64-1c64-482f-a183-616208ef0c7c" check="valid">Subsection&#160;(1)</intref> does not apply to a person who, under the rules of law relating to domicile, is incapable of acquiring a domicile by reason of mental incapacity.</txt></block></subclause></clause><clause id="sec.8" guid="_eec64d54-6674-43e8-8265-ae24921c2af7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_835b7728-a1c6-49a2-bbe7-1430d611f59a">Domicile of certain children</heading><subclause id="sec.8-ssec.1" guid="_9ba5cada-c23d-4ce3-a582-2e4fcf64af86" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">In this section—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_9bbdeb95-e329-4cc8-9818-2a1408ba2a12" provision.type="other"><no>(a)</no><block><txt break.before="0"><defterm id="sec.8-ssec.1-def.child" guid="_c039902b-db76-4d32-b5d3-59ba5ecb2973" type="definition">child</defterm> means a person under the age of 18 years who is not, and has not at any time been, married; and</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_ec5c3401-9102-474c-8050-ee024fa65ca5" provision.type="other"><no>(b)</no><block><txt break.before="0">references to the parents of a child include references to parents who are not married to each other.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_100f21c0-a3b0-4ec7-a0c5-a14e752bc35e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Where, at any time, a child has a principal home with 1 of the child’s parents but the parents are living separately and apart or the child does not have another living parent, the domicile of the child at that time is the domicile that that parent has at that time and thereafter the child has the domicile that that parent has from time to time or, if that parent has died, the domicile that that parent had at the time of death.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_8100cf96-77cd-498d-b62f-c8ca7021c5ae" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Where a child is adopted, the child’s domicile—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-para1.a" guid="_fd2979a9-1154-4cd6-8b4c-2fae0b8054ab" provision.type="other"><no>(a)</no><block><txt break.before="0">if, upon adoption, the child has 2 parents—is, at the time of the adoption and thereafter, the domicile the child would have if the child were a child born in wedlock to those parents; and</txt></block></li><li id="sec.8-ssec.3-para1.b" guid="_48001096-0263-451b-8077-015f82514e95" provision.type="other"><no>(b)</no><block><txt break.before="0">if, upon adoption, the child has 1 parent only—is, at the time of the adoption, the domicile of that parent and thereafter is the domicile that that parent has from time to time or, if that parent has died, the domicile that that parent had at the time of death.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.4" guid="_6c169216-6820-4215-893e-a20e27e617b9" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0"><intref refid="sec.8-ssec.5" target.guid="_b5f605ca-6af7-4f76-97cb-9bad025fbd71" check="valid">Subsection&#160;(5)</intref> applies if a child’s parentage has been transferred by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.4-para1.a" guid="_0111b921-a6b8-4958-bdcc-1e8971e9a570" provision.type="other"><no>(a)</no><block><txt break.before="0">a parentage order under the <legref target.doc.id="act-2010-002" target.version.series="75d3a436-9e15-4c85-9f70-103253bb5030" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Surrogacy Act 2010</name></legref>; or</txt></block></li><li id="sec.8-ssec.4-para1.b" guid="_c0516884-5ac5-430a-a4cf-dc282294b068" provision.type="other"><no>(b)</no><block><txt break.before="0">an order of another Australian jurisdiction (also a <defterm id="sec.8-ssec.4-def.parentageorder" guid="_a3f7b5b7-edd6-4230-a394-8c7de28beafa" type="definition">parentage order</defterm>) that corresponds to a parentage order made under the <legref target.doc.id="act-2010-002" target.version.series="75d3a436-9e15-4c85-9f70-103253bb5030" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Surrogacy Act 2010</name></legref>; or</txt></block></li><li id="sec.8-ssec.4-para1.c" guid="_ea5aec84-7220-46ff-a518-61b1da882a11" provision.type="other"><no>(c)</no><block><txt break.before="0">a cultural recognition order (also a <defterm id="sec.8-ssec.4-def.parentageorder-oc.2" guid="_bb3ca9b2-56b9-4e0b-83cb-8de039db20b3" type="definition">parentage order</defterm>) made under the <legref target.doc.id="act-2020-033" target.version.series="971aed15-fe07-47c5-9b58-76d6eec8469e" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Meriba Omasker Kaziw Kazipa (Torres Strait Islander Traditional Child Rearing Practice) Act 2020</name></legref>.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.5" guid="_b5f605ca-6af7-4f76-97cb-9bad025fbd71" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">From the time the parentage order is made, the child’s domicile is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.5-para1.a" guid="_c6071b20-4cfe-44d2-855f-627a44034278" provision.type="other"><no>(a)</no><block><txt break.before="0">if, on the making of the parentage order, the child has 2 parents—the domicile the child would have if the child were a child born in wedlock to those parents; and</txt></block></li><li id="sec.8-ssec.5-para1.b" guid="_29e06d06-d82c-4737-8e57-7322ce42401e" provision.type="other"><no>(b)</no><block><txt break.before="0">if, on the making of the parentage order, the child has 1 parent only—the domicile of that parent or, if that parent has died, the domicile that parent had at the time of death.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.6" guid="_de2eb10d-a4ab-4b26-aac1-eb47625ea1cf" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A child ceases to have, by virtue of <intref refid="sec.8-ssec.2" target.guid="_100f21c0-a3b0-4ec7-a0c5-a14e752bc35e" check="valid">subsection&#160;(2)</intref>, the domicile or last domicile of 1 of the child’s parents if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.6-para1.a" guid="_9b04f775-4fa8-4e34-add2-b45069daeaa5" provision.type="other"><no>(a)</no><block><txt break.before="0">the child commences to have a principal home with the other parent; or</txt></block></li><li id="sec.8-ssec.6-para1.b" guid="_04135473-1a03-413a-a066-c59967b6844d" provision.type="other"><no>(b)</no><block><txt break.before="0">the child’s parents resume or commence living together.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.7" guid="_77d07440-1393-45a9-9325-4dda8a7f561d" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">Where a child has a domicile by virtue of <intref refid="sec.8-ssec.2" target.guid="_100f21c0-a3b0-4ec7-a0c5-a14e752bc35e" check="valid">subsection&#160;(2)</intref>, <intref refid="sec.8-ssec.3" target.guid="_8100cf96-77cd-498d-b62f-c8ca7021c5ae" check="valid">(3)</intref> or <intref refid="sec.8-ssec.5" target.guid="_b5f605ca-6af7-4f76-97cb-9bad025fbd71" check="valid">(5)</intref> immediately before ceasing to be a child, he or she retains that domicile until acquiring a domicile of choice.</txt></block></subclause><subclause id="sec.8-ssec.8" guid="_4356f4bf-9a85-4c96-90b1-e088772cd80c" affected.by.uncommenced="0" provision.type="other"><no>(8)</no><block><txt break.before="0">Where the adoption of a child is rescinded, the domicile of the child shall thereafter be determined in accordance with any provisions with respect to that domicile that are included in the order rescinding the adoption and, so far as no such provision is applicable, as if the adoption had not taken place.</txt></block></subclause><subclause id="sec.8-ssec.9" guid="_18c62806-2f09-4144-9fb2-d93e3a98ab7e" affected.by.uncommenced="0" provision.type="other"><no>(9)</no><block><txt break.before="0"><intref refid="sec.8-ssec.10" target.guid="_d47eec88-7149-4d24-b4ad-76995a664e2c" check="valid">Subsection&#160;(10)</intref> applies if a parentage order for a child is discharged by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.9-para1.a" guid="_c8c6d52c-55a2-492a-9bb4-44be134b267f" provision.type="other"><no>(a)</no><block><txt break.before="0">a discharge order under the <legref target.doc.id="act-2010-002" target.version.series="75d3a436-9e15-4c85-9f70-103253bb5030" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Surrogacy Act 2010</name></legref>; or</txt></block></li><li id="sec.8-ssec.9-para1.b" guid="_16cdf5dd-31a8-4ea8-ae83-92b9f4385cf0" provision.type="other"><no>(b)</no><block><txt break.before="0">an order of another Australian jurisdiction (also a <defterm id="sec.8-ssec.9-def.dischargeorder" guid="_8192910e-6be0-49ba-9805-7ca14994df64" type="definition">discharge order</defterm>) that corresponds to a discharge order made under the <legref target.doc.id="act-2010-002" target.version.series="75d3a436-9e15-4c85-9f70-103253bb5030" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Surrogacy Act 2010</name></legref>; or</txt></block></li><li id="sec.8-ssec.9-para1.c" guid="_fb637e67-36bf-45eb-bfd3-8705e72f60b1" provision.type="other"><no>(c)</no><block><txt break.before="0">a discharge order (also a <defterm id="sec.8-ssec.9-def.dischargeorder-oc.2" guid="_05d674e7-35dc-4a23-a1f9-5e4f267f1006" type="definition">discharge order</defterm>) made under the <legref target.doc.id="act-2020-033" target.version.series="971aed15-fe07-47c5-9b58-76d6eec8469e" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Meriba Omasker Kaziw Kazipa (Torres Strait Islander Traditional Child Rearing Practice) Act 2020</name></legref>.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.10" guid="_d47eec88-7149-4d24-b4ad-76995a664e2c" affected.by.uncommenced="0" provision.type="other"><no>(10)</no><block><txt break.before="0">The child’s domicile is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.10-para1.a" guid="_44d387ce-aacd-444e-9eeb-73122febcfa9" provision.type="other"><no>(a)</no><block><txt break.before="0">the domicile stated in, or dealt with under, the discharge order; or</txt></block></li><li id="sec.8-ssec.10-para1.b" guid="_a5cba171-127f-49df-bb85-3b9e95567515" provision.type="other"><no>(b)</no><block><txt break.before="0">if there is no provision in the discharge order dealing with the child’s domicile—the domicile the child would have if the transfer of parentage under the parentage order had not taken place.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.11" guid="_45e6644d-6755-48a4-8c59-ba52a9ef33fa" affected.by.uncommenced="0" provision.type="other"><no>(11)</no><block><txt break.before="0">Despite the <legref target.doc.id="act-2020-033" target.version.series="971aed15-fe07-47c5-9b58-76d6eec8469e" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Meriba Omasker Kaziw Kazipa (Torres Strait Islander Traditional Child Rearing Practice) Act 2020</name></legref>, <legref refid="sec.106" target.doc.id="act-2020-033" target.version.series="971aed15-fe07-47c5-9b58-76d6eec8469e" target.guid="_c779984d-f08c-4d1b-9beb-7720a45ecb6e" check="valid" jurisd="QLD" type="act">section&#160;106</legref>, a reference in this section to a child who is adopted is taken not to include a reference to a child who is the subject of a cultural recognition order made under that Act. </txt></block></subclause><historynote><txt break.before="1"><b>s&#160;8</b> amd <legref target.doc.id="act-2010-002" target.version.series="75d3a436-9e15-4c85-9f70-103253bb5030" valid.date="as.made" check="valid" jurisd="QLD" type="act">2010 No.&#160;2</legref> <legref refid="sec.93" target.doc.id="act-2010-002" valid.date="as.made" check="invalid" jurisd="QLD" type="act">s&#160;93</legref>;
