or</txt><note id="sec.3-para1.a-note" guid="_ad38ac22-63d0-4a15-8639-c7bb8be1e2d6" type="editorial"><heading id="sec.3-para1.a-note-he" guid="_bb2b22e9-6b47-433e-8184-5cccb8f19109">Example—</heading><block status="uncommenced"><txt break.before="1">a special term that states that a rental increase is calculated in accordance with the consumer price index, but the rental increase includes an additional charge</txt></block></note></block></li><li id="sec.3-para1.b" guid="_fd70ef8d-dbf9-4d51-bf5c-eb0e133bc4d0" status="uncommenced" provision.type="other"><no>(b)</no><block status="uncommenced"><txt break.before="0">require a home owner to pay other charges but does not fully explain the charges; or</txt></block></li><li id="sec.3-para1.c" guid="_2a7f4550-f840-4981-bb16-3f18ecf62216" status="uncommenced" provision.type="other"><no>(c)</no><block status="uncommenced"><txt break.before="0">require a home owner to gain the consent of the park owner before the home owner complies with a requirement under law; or</txt></block></li><li id="sec.3-para1.d" guid="_4bb2de46-31a3-4800-b7e6-72692bc5f571" status="uncommenced" provision.type="other"><no>(d)</no><block status="uncommenced"><txt break.before="0">state that if the seller assigns the seller’s interest in a site agreement to a buyer, the site agreement between the seller and the park owner does not end until the buyer enters into a site agreement with the park owner; or</txt></block></li><li id="sec.3-para1.e" guid="_6f04e196-3fa6-4349-a692-ad2b41dafe18" status="uncommenced" provision.type="other"><no>(e)</no><block status="uncommenced"><txt break.before="0">require the home owner to give a current building inspection certificate to the park owner; or</txt></block></li><li id="sec.3-para1.f" guid="_6ca434f1-fa5f-4bec-b7c5-c9b5ba829313" status="uncommenced" provision.type="other"><no>(f)</no><block status="uncommenced"><txt break.before="0">restrict or prohibit an alteration to the home that is not visible from the outside of the home; or</txt></block></li><li id="sec.3-para1.g" guid="_da528300-fe0b-4ff3-be01-b10e0ca83178" status="uncommenced" provision.type="other"><no>(g)</no><block status="uncommenced"><txt break.before="0">allow the park owner to consent to the alteration to the exterior of a home or addition to the home in a way that is contrary to <legref jurisd="QLD" type="act" refid="sec.98" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" target.guid="_2b822897-34f4-48ce-8520-23c4896a97ee">section&#160;98</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>; or</txt></block></li><li id="sec.3-para1.h" guid="_f830e6c1-7c23-491f-b9df-414f4c1e371c" status="uncommenced" provision.type="other"><no>(h)</no><block status="uncommenced"><txt break.before="0">require the home owner to indemnify the park owner and the park owner’s employees, contractors or agents for loss that was not caused by the home owner, a guest of a home owner, or a home owner’s contractors or agents; or</txt></block></li><li id="sec.3-para1.i" guid="_5700588b-9bfc-4c6d-9f8e-0759b8cec44a" status="uncommenced" provision.type="other"><no>(i)</no><block status="uncommenced"><txt break.before="0">give the park owner either of the following rights, however described—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.i-para2.i" guid="_3499dc55-444c-4ca7-a48c-0394dc0e5bc6" status="uncommenced" provision.type="other"><no>(i)</no><block status="uncommenced"><txt break.before="0">a right to buy a home before another person may be offered the home; </txt></block></li><li id="sec.3-para1.i-para2.ii" guid="_3d76bb57-3ecb-4fb6-83b7-762aaa9ce278" status="uncommenced" provision.type="other"><no>(ii)</no><block status="uncommenced"><txt break.before="0">a right to make a final offer to buy a home after all other offers have been made to buy the home; or</txt></block></li></list></block></li><li id="sec.3-para1.j" guid="_b4eb4eea-b95a-4ed7-b40b-c91b5e36e264" status="uncommenced" provision.type="other"><no>(j)</no><block status="uncommenced"><txt break.before="0">state site rent will not be reduced if there is a decrease or reduction in the standards, amenity or community facilities or services, including if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.j-para2.i" guid="_75c7f4ae-7540-499f-b20c-366b5e8419cb" status="uncommenced" provision.type="other"><no>(i)</no><block status="uncommenced"><txt break.before="0">there is a decrease in amenity or standard of the residential park’s common areas and communal facilities mentioned in <intref check="invalid">section&#160;72</intref>(1)(a) of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>; or</txt></block></li><li id="sec.3-para1.j-para2.ii" guid="_2e357be2-6b8d-4122-9819-3d39811dcb5f" status="uncommenced" provision.type="other"><no>(ii)</no><block status="uncommenced"><txt break.before="0">a communal facility or services mentioned in <intref check="invalid">section&#160;72</intref>(1)(b) of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref> has been withdrawn; or</txt></block></li><li id="sec.3-para1.j-para2.iii" guid="_3028be2c-b6e0-4bda-a1ce-21a7680d283e" status="uncommenced" provision.type="other"><no>(iii)</no><block status="uncommenced"><txt break.before="0">a communal facility or services mentioned in <intref check="invalid">section&#160;72</intref>(1)(c) of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref> has not been provided; or</txt></block></li></list></block></li><li id="sec.3-para1.k" guid="_a852f016-53ec-46ad-8479-878bd648c72e" status="uncommenced" provision.type="other"><no>(k)</no><block status="uncommenced"><txt break.before="0">state that the park owner does not warrant that the site is suitable for use as the site of a manufactured home; or </txt></block></li><li id="sec.3-para1.l" guid="_1929a527-4345-487a-a4fa-ea125def6a9f" status="uncommenced" provision.type="other"><no>(l)</no><block status="uncommenced"><txt break.before="0">state that the park owner may exclude a person from the residential park without having reasonable grounds for the exclusion; or</txt></block></li><li id="sec.3-para1.m" guid="_5c9f1f35-b969-430d-9340-aa8abcd69d23" status="uncommenced" provision.type="other"><no>(m)</no><block status="uncommenced"><txt break.before="0">appoint, or require the home owner to appoint, the park owner as an attorney for the home owner; or </txt></block></li><li id="sec.3-para1.n" guid="_6ab31c69-72f9-41a3-b498-b9a66d486276" status="uncommenced" provision.type="other"><no>(n)</no><block status="uncommenced"><txt break.before="0">state that the seller is liable for the actions of a buyer after the seller assigns the seller’s interest to the buyer; or</txt></block></li><li id="sec.3-para1.o" guid="_0b909dd0-407a-416b-b0cc-2f4bad142731" status="uncommenced" provision.type="other"><no>(o)</no><block status="uncommenced"><txt break.before="0">state that referring to the site agreement is a sufficient way to explain how an increase in site rent is calculated for the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>; or</txt></block></li><li id="sec.3-para1.p" guid="_2504407d-48cf-4de6-b1b4-d7340d3ceae1" status="uncommenced" provision.type="other"><no>(p)</no><block status="uncommenced"><txt break.before="0">purport to exclude legislation from affecting the site agreement, unless the legislation provides that it may be excluded; or </txt></block></li><li id="sec.3-para1.q" guid="_2d336e2e-84e6-4f53-93a4-7e423fb7cd03" status="uncommenced" provision.type="other"><no>(q)</no><block status="uncommenced"><txt break.before="0">impose a monetary penalty on a home owner if the home owner breaches the site agreement; or</txt></block></li><li id="sec.3-para1.r" guid="_3b23855c-6921-4db7-97f8-795afaa992ab" status="uncommenced" provision.type="other"><no>(r)</no><block status="uncommenced"><txt break.before="0">remove a park owner’s liability for negligence or a breach of a contractual duty of care if the negligence or breach is caused by an act or omission of the park owner or the park owner’s employees, contractors or agents; or</txt></block></li><li id="sec.3-para1.s" guid="_e401439c-d2c0-4ba6-b7e2-1afe0e4f394c" status="uncommenced" provision.type="other"><no>(s)</no><block status="uncommenced"><txt break.before="0">prohibit or prevent the park owner from reducing the site rent for any reason.</txt></block></li></list></block><note guid="_db196bb0-3a89-443b-ad9f-e7a3959a8c4d" type="example" id="sec.3-note"><heading guid="_c6095982-cb42-4f2d-8b8f-92067c3c4a2c" id="sec.3-note-he">Editor’s note—</heading><block><txt break.before="1">This provision had not commenced on or before the reprint date.</txt></block></note></clause><clause id="sec.4" guid="_c889e9c6-b8df-4a16-b5d7-b2925983c867" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_1efb536d-79ca-4814-a6ae-de1429a6e513">Maximum fee under selling authority—<legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>, <intref check="invalid">s&#160;61</intref></heading><block><txt break.before="1">For <legref jurisd="QLD" type="act" refid="sec.61" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid" target.guid="_251ba4cd-5553-4201-875d-d90fd4365b60">section&#160;61</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2003-074" target.version.series="2c5b25e7-a20a-420d-80ba-0f6ee6a447d1" check="valid">Act</legref>, the prescribed amount is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-para1.a" guid="_1c0bd720-3699-4c8c-9023-941f8f2cbb24" provision.type="other"><no>(a)</no><block><txt break.before="0">if the sale price of the manufactured home is not more than $18,000—5% of the sale price;
