associated documents—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5A-ssec.1-para1.a" guid="_da9f243e-044d-4059-b2ad-d4bbb0156d8e" provision.type="other"><no>(a)</no><block><txt break.before="0">for a period of at least 5 years from the relevant day to which the data relates; and</txt></block></li><li id="sec.5A-ssec.1-para1.b" guid="_9d6cd14a-4f6a-46db-b739-a19c0b45b77a" provision.type="other"><no>(b)</no><block><txt break.before="0">in a way that ensures the integrity and security of the data and documents.</txt></block></li></list></block></subclause><subclause student’s absence is considered to be for a reason beyond the control of the person mentioned in <intref refid="sec.14D" check="valid" target.guid="_253e1a9c-e193-4295-99ce-d1c8205f2c65">section&#160;14D</intref>(3)(b)(i) or (ii) or 14E(3)(b)(i) or (ii).</txt></block></li></list></block></subclause><subclause id="sec.5A-ssec.3" provision.type="other"><no>(2)</no><block><txt break.before="0">The statement must be consistent with the Melbourne Declaration on Educational Goals for Young Australians.</txt><note provision.type="other"><no>(1)</no><block><txt break.before="0">A school must have a written educational program that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_79cb0ad1-2c53-4e56-97d9-24aa477170e3" provision.type="other"><no>(a)</no><block><txt break.before="0">has regard to the ages, abilities, aptitudes and development of the school’s students; and</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_048fa267-2329-4b33-9be5-cce57073bfda" provision.type="other"><no>(b)</no><block><txt break.before="0">promotes delivering distance education</heading><subclause id="sec.9-ssec.1" guid="_3ecdb59f-c4bb-49d9-a9c6-31c0b4fe63f1" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A distance education school must have a written standard of service, appropriate to the school’s distance education students achieving learning standards under the school’s educational program.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_5c7ff22b-2865-4fa4-bed5-5d4199ea9b60" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt guid="_54c06b03-f64a-400b-8750-c09210c84222" provision.type="other"><no>(b)</no><block><txt break.before="0">the communication procedures to be followed by the students and their teachers and tutors; and</txt></block></li><li id="sec.9-ssec.2-para1.c" guid="_bb2519d5-7d87-4971-965e-41e6c3dc2cc2" provision.type="other"><no>(c)</no><block><txt break.before="0">the regular tracking and assessment of work submitted by the students to the teachers; and</txt></block></li><li id="sec.9-ssec.2-para1.d" guid="_d91e0fb9-9026-4070-a6de-a5e0e80a806b" provision.type="other"><no>(d)</no><block><txt break.before="0">the regular monitoring of the students’ achievement of the learning standards.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_076ecbc1-1dfe-4e63-ac79-620e071b474d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The school’s governing body must be able to demonstrate how the school is meeting the standard of service.</txt></block></subclause><subclause id="sec.9-ssec.4" guid="_91244a92-302e-4c3a-9bac-3e7a48f0fdde" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.9-ssec.4-def.distanceeducationschool_" guid="_f8f14b3f-6f4b-4902-a660-d9ca17170fad" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.4-def.distanceeducationschool" guid="_235965a7-931c-421a-b0ec-7abe3abfd7d4" type="definition">distance education school</defterm> means a school that utilises the distance education mode of delivery of education.</txt></definition></deflist></block></subclause></clause><clause id="sec.9AA" guid="_0a21b134-e93f-41ac-9e52-c2fdc568ea5a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9AA</no><heading id="sec.9AA-he" guid="_89b4a28e-f36e-4c40-9b85-adbe39862dab">Special assistance schools</heading><subclause id="sec.9AA-ssec.1" guid="_e8012e76-9f19-44d7-affd-a5e2201ed52a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A special assistance school’s written educational program must promote continuous engagement by the school’s relevant students in primary or secondary education.</txt><note id="sec.9AA-ssec.1-note" guid="_e7ec6f8a-d449-4801-88cd-15d747554af7" type="example"><heading id="sec.9AA-ssec.1-note-he" guid="_9f15b693-f393-4069-b182-6acf2499a3c1" provision.type="other"><no>(i)</no><block><txt break.before="0">attendance by the relevant students at an accredited special assistance site for the school; and</txt></block></li><li id="sec.9AA-ssec.3-para1.b-para2.ii" guid="_4e39eae3-e9e1-4a21-9da9-69c203541ede" provision.type="other"><no>(ii)</no><block><txt break.before="0">the relevant students’ achievement of the learning standards; and</txt></block></li><li id="sec.9AA-ssec.3-para1.b-para2.iii" guid="_22950d92-033d-4e20-8f12-0830d00fde02" provision.type="other"><no>(iii)</no><block><txt break.before="0">the relevant students’ participation in the educational program; and</txt></block></li></list></block></li><li provision.type="other"><no>(2)</no><block><txt break.before="0">Also, the school must have written processes about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.a" guid="_066843f5-7678-4244-a66f-19bbb3368f71" provision.type="other"><no>(a)</no><block><txt break.before="0">how the school will respond to harm, or allegations of harm, to students under 18 years old; and</txt></block></li><li id="sec.10-ssec.2-para1.b" guid="_eb911366-8cae-4e32-92f7-e46657b74360" provision.type="other"><no>(b)</no><block><txt break.before="0">the appropriate conduct of the school’s staff and students.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.3" guid="_4eb4c4b7-7a38-450b-897a-21e524513e6d" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Without limiting <intref refid="sec.14C-ssec.2-para1.h" target.guid="_96d92ded-73d8-4399-bf17-84023ae2a447" check="valid">subsection&#160;(2)</intref>, the processes must include—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.3-para1.a" guid="_4fd87288-fbb3-4596-bf53-caeb0c4613bd" provision.type="other"><no>(a)</no><block><txt break.before="0">a process for the reporting by a student to a stated staff member of behaviour of another staff member that the student considers is inappropriate; and</txt></block></li><li id="sec.10-ssec.3-para1.b" guid="_6888963f-d0b3-4815-b7c4-62191fde8d71" provision.type="other"><no>(b)</no><block><txt break.before="0">a process for how the information reported to the stated staff member must be dealt with by the stated staff member.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.4" guid="_bec10edf-2744-48bf-aa58-1df5230cebde" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">For the process mentioned in <intref refid="sec.14C-ssec.2-para1.h" target.guid="_96d92ded-73d8-4399-bf17-84023ae2a447" check="valid">subsection&#160;(3)</intref><intref refid="sec.14C-ssec.2-para1.h" target.guid="_96d92ded-73d8-4399-bf17-84023ae2a447" check="valid">(a)</intref>, there must be stated at least 2 staff 2006</name></legref>, <legref jurisd="QLD" type="act" refid="sec.366" target.doc.id="act-2006-039" target.version.series="1e1a0ed5-f492-44f9-ba49-f9194ef5fefb" check="valid"><name emphasis="yes">Education (General Provisions) Act 2006</name></legref>, <legref jurisd="QLD" type="act" refid="sec.366A" target.doc.id="act-2006-039" target.version.series="1e1a0ed5-f492-44f9-ba49-f9194ef5fefb" check="invalid">section&#160;366A</legref>;</txt></block></li></list></block></li><li id="sec.10-ssec.5-para1.b" guid="_bd2ed32b-9895-4105-9402-76c2f418cdef" provision.type="other"><no>(b)</no><block><txt break.before="0">a process for reporting a reportable suspicion under the <legref jurisd="QLD" type="act" target.doc.id="act-1999-010" target.version.series="e9e391a7-2547-48ef-b641-3ee305aad163" check="valid"><name emphasis="yes">Child Protection Act 1999</name></legref>, <legref jurisd="QLD" type="act" guid="_cc0c480e-5db5-424c-8e33-b242a565469b" provision.type="other"><no>(a)</no><block><txt break.before="0">staff, students and parents are made aware of the processes; and</txt></block></li><li id="sec.10-ssec.6-para1.b" guid="_31739f6c-59d7-4dce-bccc-a3d95c3ea34e" provision.type="other"><no>(b)</no><block><txt break.before="0">staff are trained in implementing the processes; and</txt></block></li><li id="sec.10-ssec.6-para1.c" guid="_bacc7887-962c-482a-b043-c29e09c989aa" provision.type="other"><no>(c)</no><block><txt break.before="0">the school is implementing the processes; and</txt></block></li><li id="sec.10-ssec.6-para1.d" guid="_50804735-1952-4a5f-8fba-8c48033b892f" provision.type="other"><no>(d)</no><block><txt break.before="0">the processes are readily accessible by staff, students and parents.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.7" guid="_b2bc9ecb-52b8-4781-ba26-24fc3d4a6102" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The school must have a written complaints procedure to address allegations of non-compliance with the processes.</txt></block></subclause><subclause id="sec.10-ssec.7A" guid="_0bb35be8-526a-4d2b-8316-96b1a1383a1a" affected.by.uncommenced="0" provision.type="other"><no>(7A)</no><block><txt provision.type="other"><no>(2)</no><block><txt break.before="0">A full-time student is taken to have attended a school during the relevant period if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.14D-ssec.2-para1.a" guid="_4513c389-b0f6-4d98-96c6-4b1fe5acd5f8" provision.type="other"><no>(a)</no><block><txt break.before="0">the student is enrolled at the
