guid="_cd7f1c4c-6949-47bf-bf6b-afbbe790b569" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The purpose of these rules is to facilitate the just and expeditious resolution of the real issues in proceedings at a minimum of expense.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_3ab3184a-5df1-4a61-9bb8-707fc600a9cf" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Accordingly, these rules are to be applied by the court with the objective of avoiding undue delay, expense provision.type="other"><no>(3)</no><block><txt break.before="0">In a proceeding in the court, a party impliedly undertakes to the court and to the other parties to proceed in an expeditious id="sec.5-he" guid="_05fd651c-9743-4d75-854c-5b2fd2189e54">Compliance with rules or an order of the court</heading><block><txt break.before="1">The court may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.a" guid="_3f9fdd29-b844-4afe-8021-bf9fe42e4671" provision.type="other"><no>(a)</no><block><txt break.before="0">waive compliance with a provision of these rules if the court considers compliance would be likely to cause injustice, unreasonable expense or inconvenience or otherwise considers waiving compliance appropriate; or</txt></block></li><li id="sec.5-para1.b" guid="_d9fdb000-c6d7-4da4-8903-55abdad2e474" provision.type="other"><no>(b)</no><block><txt break.before="0">excuse noncompliance with a provision of these rules; or</txt></block></li><li id="sec.5-para1.c" guid="_0cdb8b13-82b1-465d-a3f6-84b75f9f8573" provision.type="other"><no>(c)</no><block><txt break.before="0">impose appropriate sanctions if a party does not comply with these rules or an order of the court.</txt><note id="sec.5-para1.c-note" guid="_c8188709-7a87-4def-9d8e-885ccebba590" type="example"><heading id="sec.5-para1.c-note-he" guid="_35f965d0-9610-4353-9902-31d6e31230ea">Examples for paragraph (c)—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.c-note-para2.1" guid="_08d7791a-dcd6-4465-8a8a-2be7a33c0438" provision.type="other"><no>1</no><block><txt break.before="0">The court may impose a sanction as to costs if, in breach of an implied undertaking under service</heading><subclause id="sec.10-ssec.1" guid="_59a60b79-7f5e-4578-96cc-8f91963112db" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An applicant or appellant (the <defterm id="sec.10-def.person" guid="_284c3ea6-1701-448b-9894-531f876bea55" type="definition">person</defterm>) intending to act personally must ensure the following details are stated on the originating process before it is filed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_8632dfc1-a426-4bb0-a9ec-ac000e192480" provision.type="other"><no>(a)</no><block><txt break.before="0">the person’s residential or business address;</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_f56b0d54-8dc7-49f9-9f7a-1dfeccb136ce" provision.type="other"><no>(b)</no><block><txt break.before="0">if the address given under paragraph (a) is not the person’s address for service or is not a Queensland address—an address for service in Queensland including, for example, an address approved by the court as the address for service;</txt></block></li><li id="sec.10-ssec.1-para1.c" guid="_eaf1f2f8-7319-4e48-a663-b59d511cc689" provision.type="other"><no>(c)</no><block><txt break.before="0">the person’s telephone number, if any;</txt></block></li><li id="sec.10-ssec.1-para1.d" guid="_b73dfb24-5fe9-4b45-a631-9174f68d5c4a" provision.type="other"><no>(d)</no><block><txt break.before="0">if the person does not have a telephone number, a way of contacting the person by telephone;</txt></block></li><li id="sec.10-ssec.1-para1.e" guid="_e5cb600d-b8c8-43cb-84e5-ce1a7be4ecbd" provision.type="other"><no>(e)</no><block><txt break.before="0">the person’s fax number, if any.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.2" guid="_6e069c6b-6d35-486d-b206-9df6a22aca42" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A lawyer or agent acting for an applicant or appellant (the <defterm id="sec.10-def.person-oc.2" guid="_907c04fa-3090-4130-9539-fda8a894a891" type="definition">person</defterm>) must ensure the following details are stated on the originating process before it is filed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.a" guid="_79c436b2-1c3d-41c5-bf3d-6fa409af4de0" provision.type="other"><no>(a)</no><block><txt break.before="0">the person’s residential or business address;</txt></block></li><li id="sec.10-ssec.2-para1.b" guid="_bf2bf9a5-3c6a-4b5b-8bfe-d7389a9ca61c" provision.type="other"><no>(b)</no><block><txt break.before="0">the name of the lawyer or agent and, if the lawyer or agent practises in a firm, the name of the firm;</txt></block></li><li id="sec.10-ssec.2-para1.c" guid="_4fbd0d05-87b2-4a07-92f7-f9592941d6ac" provision.type="other"><no>(c)</no><block><txt break.before="0">the address of the lawyer’s or agent’s place of business;</txt></block></li><li id="sec.10-ssec.2-para1.d" guid="_de52e7e2-da36-4406-884a-e3e4b3f69eea" provision.type="other"><no>(d)</no><block><txt break.before="0">if the address given under paragraph (c) is not the person’s address for service or is not a Queensland address—an address for service in Queensland including, for example, an address approved by the court as the address for service;</txt></block></li><li id="sec.10-ssec.2-para1.e" guid="_8d75f4e3-0916-4b35-84ca-fc97d9057b07" provision.type="other"><no>(e)</no><block><txt break.before="0">the lawyer’s or agent’s telephone number;</txt></block></li><li id="sec.10-ssec.2-para1.f" guid="_90c15829-1561-4a03-89fa-6b56498c0916" provision.type="other"><no>(f)</no><block><txt break.before="0">the lawyer’s or agent’s fax number, if any;</txt></block></li><li id="sec.10-ssec.2-para1.g" guid="_7d83b6bc-78d0-4d47-a243-15c63818e182" provision.type="other"><no>(g)</no><block><txt break.before="0">the lawyer’s or agent’s email address, if any.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.3" guid="_ddd1d242-bd92-40c8-b197-7f20d7080a17" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the lawyer or agent, or the lawyer’s or agent’s firm, is a member of an approved document exchange, the lawyer or agent may include the address of the document exchange with the details required under subrule (2).</txt></block></subclause><subclause id="sec.10-ssec.4" guid="_933a81ef-a4d1-40fc-8de9-c6d09b712650" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The <defterm id="sec.10-def.addressforservice" guid="_9af3a601-9447-45ae-93d2-ab757e6a5dfd" type="definition">address for service</defterm> of the person is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.4-para1.a" guid="_2b18f395-a650-46f3-82ed-7d41cdcddc59" provision.type="other"><no>(a)</no><block><txt break.before="0">for a person acting personally—an address in Queensland stated for subrule (1)(a) or (b); and</txt></block></li><li id="sec.10-ssec.4-para1.b" guid="_bb1e8f42-6fb7-44e1-9ae2-b60d024e73df" provision.type="other"><no>(b)</no><block><txt break.before="0">for a person for whom a lawyer or agent acts—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.4-para1.b-para2.i" guid="_9ec6da76-bf45-4693-b2b5-c98036344017" provision.type="other"><no>(i)</no><block><txt break.before="0">if an address is stated for subrule (2)(d)—that address; or</txt></block></li><li id="sec.10-ssec.4-para1.b-para2.ii" guid="_5b6fe1b2-1841-43a7-8bba-622b7e39f8db" provision.type="other"><no>(ii)</no><block><txt break.before="0">otherwise—the address stated for subrule (2)(c).</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.10-ssec.5" guid="_03dde7c3-eb73-49c0-bdf4-da037ba2f053" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this rule—</txt><deflist><definition target.doc.id="sl-1999-0111" target.version.series="a4c6031c-5851-4957-a8e9-46b6b54892a3" check="valid"><name emphasis="yes">Uniform Civil Procedure Rules 1999</name></legref>, rule 102.</txt></definition></deflist></block></subclause></clause><clause id="sec.11" guid="_86690a47-61ab-4469-b2a7-4d474bf5aebc" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_a9f1d225-90b7-4153-95a8-82562c38ede9">Originating process must be signed</heading><block><txt break.before="1">The applicant or appellant, or the applicant’s or appellant’s lawyer or agent, must sign the originating process.</txt></block></clause><clause id="sec.12" guid="_ae9fafb7-6164-4b13-9d7f-a80718069d87" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_c12cf12b-18b5-479b-abd2-902be7a349a8">Originating application must be given to other parties</heading><block><txt break.before="1">Unless the court otherwise orders under rule 18, the applicant must give a copy of the originating application to each other party to the provision.type="other"><no>(xiii)</no><block><txt break.before="0">limiting the time to be taken in examining, cross-examining or re-examining a witness;</txt></block></li><li id="sec.19-ssec.5-para1.c-para2.xiv" guid="_48a39122-5869-43c5-bc45-5359982c878b" provision.type="other"><no>(xiv)</no><block><txt break.before="0">requiring an opening address or submission to be guid="_60504b85-9716-4ba3-b379-b7eda075d9c2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If a party to a proceeding (the <defterm id="sec.26-para1.b" guid="_1ce98ecd-3e6f-4553-bdc7-806eeb4da2b9" provision.type="other"><no>(b)</no><block><txt break.before="0">notice of the contents of any order or direction about the meeting, including the time by which the meeting must be held; and</txt></block></li><li id="sec.26-para1.c" guid="_ed1c3139-02b5-456f-8130-08f907a58c54" provision.type="other"><no>(c)</no><block><txt break.before="0">reasonable notice of the issue in dispute in the proceeding to the extent it is relevant to the expert’s expertise; and</txt></block></li><li id="sec.26-para1.d" guid="_d7c0c544-71fd-4b1b-8f21-e9f8cd763d27" provision.type="other"><no>(d)</no><block><txt break.before="0">enough information and opportunity for the expert to adequately investigate the facts in break.before="0">written notice that the expert has a duty to assist the court and the duty overrides any obligation the expert may have to the party or any person who is liable for the expert’s fee following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-ssec.3-para1.a" guid="_bdc0336a-1a7d-471e-825c-45ed3d890b19" provision.type="other"><no>(a)</no><block><txt break.before="0">participate in a mediation involving the parties;</txt></block></li><li id="sec.27-ssec.3-para1.b" guid="_6fad4e01-e4ff-4111-9b6a-91cb91d6e5cf" provision.type="other"><no>(b)</no><block><txt break.before="0">at any time before the joint report is finished, give 1 or more of the parties a notice—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-ssec.3-para1.b-para2.i" guid="_ad6c8e9a-164c-40f1-b0e0-591ac0202b15" provision.type="other"><no>(i)</no><block><txt break.before="0">asking the recipient to respond to a request for information or other inquiry which may assist the proper and timely conduct or conclusion of the meeting or preparation of the joint report; or</txt></block></li><li id="sec.27-ssec.3-para1.b-para2.ii" guid="_ce199c23-bab7-4d01-966a-c377e88c7f3e" provision.type="other"><no>(ii)</no><block><txt break.before="0">informing the recipient of any matter affecting the proper and timely conduct or conclusion of the meeting or preparation of the joint report.</txt><note id="sec.27-ssec.3-para1.b-para2.ii-note" guid="_89c147a4-6fbd-4f22-a6ee-4dc19eccbfcb" type="example"><heading id="sec.27-ssec.3-para1.b-para2.ii-note-he" guid="_a2ce5f02-28e8-42d1-8efa-c207a768e8cf">Example for subparagraph (ii)—</heading><block><txt break.before="1">informing parties of a delay in gathering data for use in the joint report</txt></block></note></block></li></list></block></li></list></block></subclause><subclause id="sec.27-ssec.4" provision.type="other"><no>(5)</no><block><txt break.before="0">The recipient may respond to the notice only if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-ssec.5-para1.a" guid="_b04a6f2e-675a-469a-817a-24f184aa90de" provision.type="other"><no>(a)</no><block><txt break.before="0">the response is made in a document not more than 10 business days after the notice is
