spent.amends="0"><no>4</no><heading guid="_0c9cd8f5-ddde-4e95-876c-5c08da91e8f7" id="sec.4-he">Main purpose of Act</heading><block><txt break.before="1">The main purpose of this Act is to establish the Director of Child Protection Litigation to apply for child protection orders and conduct child protection proceedings.</txt></block></clause><clause affected.by.uncommenced="0" guid="_fa0e924d-c786-4695-b853-ff868f467736" id="sec.5" provision.type="other" spent.amends="0"><no>5</no><heading guid="_d3a142bf-cc78-4af1-bc08-0df157cafe36" id="sec.5-he">Paramount principle</heading><block><txt break.before="1">The main principle for administering this Act is that the safety, wellbeing and best interests of a child, both through childhood and for the rest of his or her life, are paramount.</txt></block><note guid="_0d7413b9-37db-470a-bc7c-539c1fbd4633" id="sec.5-note" type="example"><heading guid="_a7cc2b24-afe2-4808-9ea9-57665b3687f6" id="sec.5-note-he">Example—</heading><block><txt break.before="1">If the director is making a decision under this Act about a child protection proceeding where there is conflict between the child’s safety, wellbeing and best interests, and the interests of adults involved in the proceeding, the conflict must be resolved in favour of the child’s safety, wellbeing and best interests.</txt></block></note></clause><clause affected.by.uncommenced="0" guid="_3acef28d-c087-49b6-abe3-37673975ca5f" id="sec.6" provision.type="other" spent.amends="0"><no>6</no><heading guid="_fbfa9ba3-88c4-4736-b692-53bdb9278f63" id="sec.6-he">Other general principles</heading><subclause affected.by.uncommenced="0" guid="_29129c16-af70-4203-88ce-3a39acee4110" id="sec.6-ssec.1" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act is to be administered having regard to the following principles—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_deabfddb-081d-4e5f-833d-d7f2b01c31fa" id="sec.6-ssec.1-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">collaboration between the director and chief executive (child safety) best achieves fair, timely and consistent outcomes for the protection of children;</txt></block></li><li guid="_9333c97d-500d-499d-89da-bf4a87bf6ace" id="sec.6-ssec.1-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">in protecting a child, the director should only take the action that is warranted in the circumstances, including, for example, by applying for the least intrusive child protection order;</txt></block></li><li guid="_25973142-5765-4073-b641-c830358c1c13" id="sec.6-ssec.1-para1.c" provision.type="other"><no>(c)</no><block><txt break.before="0">the director should consider whether sufficient, relevant and appropriate evidence is available in deciding whether to make an application for a child protection order;</txt></block></li><li guid="_9a82355d-e69d-45b9-97ed-041d3d21331e" id="sec.6-ssec.1-para1.d" provision.type="other"><no>(d)</no><block><txt break.before="0">each principle stated in the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref>, section 5B for ensuring the safety, wellbeing and best interests of a child, to the extent the principle is capable of being applied to a person performing a function or exercising a power under this Act, including, for example—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_c211cd0c-5e52-4bb0-9c64-f546d9fdd48f" id="sec.6-ssec.1-para1.d-para2.i" provision.type="other"><no>(i)</no><block><txt break.before="0">a child has a right to be protected from harm or risk of harm; and</txt></block></li><li guid="_e82fc27e-17c8-432f-af96-f0ad237b9001" id="sec.6-ssec.1-para1.d-para2.ii" provision.type="other"><no>(ii)</no><block><txt break.before="0">a delay in making a decision in relation to a child should be avoided, unless appropriate for the child;</txt></block></li></list></block></li><li guid="_3e91c9dc-800a-4570-b198-298dd9edf7bd" id="sec.6-ssec.1-para1.e" provision.type="other"><no>(e)</no><block><txt break.before="0">each principle stated in the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name>, section 5BA</legref> for achieving permanency for a child, to the extent the principle is capable of being applied to a person performing a function or exercising a power under this Act;</txt></block></li><li guid="_aff4d244-90b5-4b31-96b1-819ea2481279" id="sec.6-ssec.1-para1.f" provision.type="other"><no>(f)</no><block><txt break.before="0">each additional principle applying in relation to an Aboriginal or Torres Strait Islander child stated in the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref>, section 5C.</txt></block></li></list></block></subclause><subclause affected.by.uncommenced="0" guid="_e3dd8cc6-cff3-4fd0-95bb-cd41080a3ca0" id="sec.6-ssec.2" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, each principle relevant to exercising powers and making decisions under the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref>, section 5D(1) applies to the extent the principle is capable of being applied to a person exercising a power or making a decision under this Act.</txt></block></subclause><subclause affected.by.uncommenced="0" guid="_d03a79b0-c3de-4115-9bb3-1f4b8006f39a" id="sec.6-ssec.3" provision.type="other"><no>(3)</no><block><txt break.before="0">In addition, the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref>, section 5E applies in relation to a person giving a child an opportunity to express their views under this Act.</txt></block></subclause><subclause affected.by.uncommenced="0" guid="_969f48bf-7320-419e-aedb-df9cef794ab8" id="sec.6-ssec.4" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition affected.by.uncommenced="0" guid="_3ba18dfa-d4c5-4593-8c24-b749eaa31af3" id="sec.6-ssec.4-def.permanency_"><txt break.before="1"><defterm guid="_6f30e539-cd93-451f-947e-5ef7ba53f43f" id="sec.6-ssec.4-def.permanency" type="definition">permanency</defterm>, for a child, see the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name>, section id="sec.9-he">Functions</heading><subclause affected.by.uncommenced="0" guid="_27519acc-5239-4c21-ae84-5db5b7aa1cf9" id="sec.9-ssec.1" provision.type="other"><no>(1)</no><block><txt break.before="0">The director’s main functions are to do the following under the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref>—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_434a7179-c1d5-4cdc-847a-8c0c31da6581" id="sec.9-ssec.1-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">prepare and apply for child protection orders, and conduct child protection proceedings, under chapter 2, part 4 of that Act;</txt></block></li><li guid="_13702488-4d8d-4182-acb1-3199bcda30f4" id="sec.9-ssec.1-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">prepare and apply for transfers of a child protection order or child protection proceeding to a participating State under chapter 7, part 2 or 4 of that Act;</txt></block></li><li guid="_cab2737a-a0ed-482e-90d1-44872206ce99" id="sec.9-ssec.1-para1.c" provision.type="other"><no>(c)</no><block><txt break.before="0">prepare, institute and conduct appeals against—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_927f4daf-83de-4c7b-b4b1-25b526193bbf" id="sec.9-ssec.1-para1.c-para2.i" provision.type="other"><no>(i)</no><block><txt break.before="0">decisions about applications for child protection orders under chapter 3, part 4 of that Act; and</txt></block></li><li guid="_068b93b6-a2c2-49ff-94de-5ccf78fe5c17" id="sec.9-ssec.1-para1.c-para2.ii" provision.type="other"><no>(ii)</no><block><txt break.before="0">decisions to transfer a child protection order or child protection proceeding to a participating State under chapter 7, part 2 or 4 of that Act.</txt></block></li></list></block></li></list></block></subclause><subclause affected.by.uncommenced="0" guid="_46a90d58-cd1b-40a8-91ec-6f187417b301" id="sec.9-ssec.2" provision.type="other"><no>(2)</no><block><txt break.before="0">In addition, the director has the following functions—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_b0e8114b-5289-40d1-865b-42aadac643e4" id="sec.9-ssec.2-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">providing legal advice to the chief executive (child safety) in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_005f6705-472e-460f-b56b-a96322538293" id="sec.9-ssec.2-para1.a-para2.i" provision.type="other"><no>(i)</no><block><txt break.before="0">the functions of the chief executive (child safety) under the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Adoption Act 2009</name></legref> and the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref>; and</txt></block></li><li guid="_aabe0424-39b8-4a12-8a2f-6c22b05a8e8f" id="sec.9-ssec.2-para1.a-para2.ii" provision.type="other"><no>(ii)</no><block><txt break.before="0">other matters relating to the safety, wellbeing or protection of a child;</txt></block></li></list></block></li><li guid="_da5f71b0-924c-491d-abfb-417cce15e1ad" id="sec.9-ssec.2-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">representing the State in legal proceedings under the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Adoption Act 2009</name></legref> and the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref> or other proceedings relating to the safety, wellbeing or protection of a child other than proceedings mentioned in subsection (1);</txt></block></li><li guid="_f529af16-bf79-49c8-8dd2-df2dd116b1d7" id="sec.9-ssec.2-para1.c" provision.type="other"><no>(c)</no><block><txt break.before="0">for a matter involving the State to which the Convention on the Civil Aspects of International Child Abduction applies under the <legref check="unknown" jurisd="CTH" type="act"><name emphasis="yes">Family Law Act 1975</name> (Cwlth)</legref>, section 111B—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_bc887819-e131-4c0c-8d35-964ed2164606" id="sec.9-ssec.2-para1.c-para2.i" provision.type="other"><no>(i)</no><block><txt break.before="0">providing advice to the State about the matter; and</txt></block></li><li guid="_c81387f6-daed-421d-8207-649a168c07aa" id="sec.9-ssec.2-para1.c-para2.ii" provision.type="other"><no>(ii)</no><block><txt break.before="0">representing the State in proceedings relating to the matter;</txt></block></li></list></block></li><li guid="_79687bbe-5bfd-4ae5-a670-1b2e54a42d1f" id="sec.9-ssec.2-para1.d" provision.type="other"><no>(d)</no><block><txt break.before="0">any other function given to the director by this Act or another Act.</txt></block></li></list></block></subclause></clause><clause affected.by.uncommenced="0" guid="_4d273762-ec02-4233-90de-046660b16893" id="sec.10" provision.type="other" spent.amends="0"><no>10</no><heading guid="_80a2bce3-7799-496e-bbff-5bb668b03e3c" id="sec.10-he">Applying for child protection orders and related orders</heading><subclause affected.by.uncommenced="0" guid="_094c9b07-d5bf-449d-a381-fc1f2be09a33" id="sec.10-ssec.1" provision.type="other"><no>(1)</no><block><txt break.before="0">The director may, on behalf of the State, apply to the Childrens Court for the following—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_19e6edfc-247a-4ac1-953a-a58ae9954af6" id="sec.10-ssec.1-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">a child protection order for a child under the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref>, chapter 2, part 4;</txt></block></li><li guid="_b96893fc-5e1f-4a3c-9015-f3e49a2b1bef" id="sec.10-ssec.1-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">an order transferring a child protection order or child protection proceeding to a participating State under the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref>, section 212 or 225.</txt></block></li></list></block></subclause><subclause affected.by.uncommenced="0" guid="_1b3837ce-c86d-4bce-874e-1a366c3f77db" id="sec.10-ssec.2" provision.type="other"><no>(2)</no><block><txt break.before="0">Subject to section 14, no other person may make an application mentioned in subsection (1).</txt></block></subclause></clause><clause affected.by.uncommenced="0" guid="_7d145a69-b02c-4a92-8bb2-a554dc1ea503" id="sec.11" provision.type="other" id="sec.12" provision.type="other" spent.amends="0"><no>12</no><heading guid="_94573565-7739-4bb4-b18f-e814db42b5e3" id="sec.12-he">Powers</heading><subclause affected.by.uncommenced="0" guid="_31e73e88-858d-4879-ac35-c2fb8abed6b7" id="sec.12-ssec.1" provision.type="other"><no>(1)</no><block><txt break.before="0">The director has the powers given under this Act.</txt></block></subclause><subclause affected.by.uncommenced="0" guid="_a7c9dfb8-b7fb-4916-8af5-cad1064b656e" id="sec.12-ssec.2" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, the director has the power to do all things necessary or convenient to be done in performing the director’s functions.</txt></block></subclause></clause><clause id="sec.13-he">Not under Ministerial control</heading><block><txt break.before="1">In performing the director’s functions and exercising the director’s powers, the director is not under the control or spent.amends="0"><no>14</no><heading guid="_91df454a-1480-4d57-93e1-cee846781497" id="sec.14-he">Delegation</heading><subclause affected.by.uncommenced="0" guid="_76eb0043-b862-4e6f-ade7-002851f61817" id="sec.14-ssec.1" provision.type="other"><no>(1)</no><block><txt break.before="0">The director may delegate the director’s functions and powers under this Act to—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_a194d145-903c-43ca-af90-d73781244353" id="sec.14-ssec.1-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">an appropriately qualified member of the director’s staff; or</txt></block></li><li guid="_aee60855-037a-4499-9244-cacf46c83f00" id="sec.14-ssec.1-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">a lawyer engaged provision.type="other"><no>(c)</no><block><txt break.before="0">for a matter mentioned in section 15(1)(c), a brief of evidence about the child that includes the reasons why the chief executive (child safety) is satisfied— </txt><list number.type="manual" unnumbered.indent="0"><li guid="_0dd5fae6-6f46-41ce-985e-9ddd2b0bdf9f" id="sec.16-ssec.1-para1.c-para2.i" provision.type="other"><no>(i)</no><block><txt break.before="0">the child’s permanent guardian is not complying, in a significant way, with the permanent guardian’s obligations under the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name>, section 79A</legref>; and</txt></block></li><li guid="_f536893e-0a55-4c5b-92e0-2cb56c904036" id="sec.16-ssec.1-para1.c-para2.ii" provision.type="other"><no>(ii)</no><block><txt break.before="0">the order is no longer appropriate and desirable for promoting the child’s safety, wellbeing and best interests;</txt></block></li></list></block></li><li guid="_c5bbab2c-3419-4c65-a065-8a691f52d087" id="sec.16-ssec.1-para1.d" provision.type="other"><no>(d)</no><block><txt break.before="0">supporting documents for the matters mentioned in paragraph (a), (b) or (c) available to the chief executive (child safety), including, for example, affidavits;</txt></block></li><li protection matter referred under section 15, the director may decide to either—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_2f1ff505-4d40-4741-8f25-230b7c4a3619" id="sec.17-ssec.1-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">apply for a child protection order for the child; or</txt></block></li><li guid="_c88315cd-b500-4552-9b7d-74b9bd86cd54" id="sec.17-ssec.1-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">refer the matter back to the chief executive (child safety).</txt></block></li></list></block></subclause><subclause affected.by.uncommenced="0" guid="_24beed9d-95b0-4a75-9b5a-def369a342c4" id="sec.17-ssec.2" provision.type="other"><no>(2)</no><block><txt break.before="0">Before deciding how to deal with the matter under subsection (1), the director may ask the chief executive (child safety) to provide further evidence or information about the matter.</txt></block><note guid="_8cc53e62-c63d-4a78-a97e-60f0d9515f66" id="sec.17-ssec.2-note" type="example"><heading guid="_9214726b-e44f-433a-9701-92de15829cc4" id="sec.17-ssec.2-note-he">Example—</heading><block><txt break.before="1">The director may consider further evidence or other information may be needed to enable the Childrens Court to grant a child protection order. The director may ask the chief executive (child safety) for the evidence or information before deciding whether to apply for the order or refer the matter back to the chief executive (child safety).</txt></block></note></subclause></clause><clause affected.by.uncommenced="0" guid="_0a679fdb-22a5-4a4b-a6bd-09c64cc1f5b8" id="sec.18" provision.type="other" spent.amends="0"><no>18</no><heading guid="_9fdde777-6acf-49ad-b8b4-e74f8188ad4c" id="sec.18-he">When director must consult with chief executive (child safety) and give reasons</heading><subclause affected.by.uncommenced="0" guid="_7379e74f-4e31-4d50-b66f-6bfeb66ae452" id="sec.18-ssec.1" provision.type="other"><no>(1)</no><block><txt break.before="0">The director must consult with the chief executive (child safety) before doing any of the following things in relation to a child protection matter—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_a7c4d9ee-5fab-4339-bea8-63f30fffb93f" id="sec.18-ssec.1-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">referring a child protection matter back to the chief executive (child safety) under section 17(1)(b);</txt></block></li><li guid="_33cc170c-5a06-490d-b78b-e6bbe5ffcbef" id="sec.18-ssec.1-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">applying for a child protection order of a different type, or an order that is otherwise different from, the order mentioned in the brief of evidence given by the chief executive (child safety);</txt></block></li><li guid="_4924d902-7fbc-49f6-ac48-1051618a5722" id="sec.18-ssec.1-para1.c" provision.type="other"><no>(c)</no><block><txt break.before="0">any other thing prescribed for this section in the guidelines made by the director under section 39.</txt></block></li></list></block></subclause><subclause affected.by.uncommenced="0" guid="_4d9bf9c9-f632-4c31-ad7f-9049243639a7" id="sec.18-ssec.2" provision.type="other"><no>(2)</no><block><txt break.before="0">If, after consulting with the chief executive (child safety), the director decides to do a thing mentioned in subsection (1) without the agreement of the chief executive (child safety), the director must give the chief executive (child safety) written reasons for break.before="0">make a record of the information or intentionally disclose the information to anyone, other than under subsection (3); or</txt></block></li><li provision.type="other"><no>(3)</no><block><txt break.before="0">However, a person may make a record of confidential information or disclose it to someone else—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_c2d9c4b0-f2ea-4d93-86ef-15b1b106460b" id="sec.19-ssec.3-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">for this Act; or</txt></block></li><li guid="_97a4df20-1f30-4369-9f9f-8f2c18e08db7" id="sec.19-ssec.3-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">to discharge a function under another law; or</txt></block></li><li guid="_03a97215-1beb-48c0-839f-d7253f3a84eb" id="sec.19-ssec.3-para1.c" provision.type="other"><no>(c)</no><block><txt break.before="0">for a proceeding in a court or QCAT; or</txt></block></li><li guid="_4cf7bdd2-8757-4699-a68a-1264c0317ed4" id="sec.19-ssec.3-para1.d" provision.type="other"><no>(d)</no><block><txt break.before="0">if authorised by a court or QCAT in the of information for research purposes</heading><subclause affected.by.uncommenced="0" guid="_77852d2a-4f63-4bc4-8372-91ccf0339590" id="sec.20-ssec.1" provision.type="other"><no>(1)</no><block><txt break.before="0">For the purpose of allowing a person to carry out research, the director may authorise the person to have access to information relating to the administration of this Act, including information from a member of the director’s staff.</txt></block></subclause><subclause affected.by.uncommenced="0" guid="_ffe4b0c1-7411-4305-a0b1-f604999fa96d" id="sec.20-ssec.2" provision.type="other"><no>(2)</no><block><txt break.before="0">The director may only authorise the person to have access to the information if the director is satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_45780d93-6ea0-454d-a387-5cbb09a90a65" id="sec.20-ssec.2-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">the research is relevant to the director’s functions and powers under this Act; and</txt></block></li><li guid="_c3f5da2e-1511-4965-b379-8f12a61174d9" id="sec.20-ssec.2-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">the information will be collected in a way that could not reasonably be expected to result in the identification of any of the guid="_33eea711-76b8-4295-a920-75896429bd56" id="sec.21-def.receiver" type="definition">receiver</defterm>) who is given confidential information by a person under section 19(3) or given access to information for research purposes under section 20.</txt></block></subclause><subclause affected.by.uncommenced="0" guid="_8535afed-5197-4a2e-b95b-27e5f5088ac5" id="sec.21-ssec.2" id="sec.31-ssec.1-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">at the time of the appointment, the matter has not been finally decided or otherwise dealt information given to the person in his or her professional capacity in relation to the matter before the person’s appointment as director, other than to—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_e073ae33-a532-47a9-a204-1aa19effdaf6" id="sec.31-ssec.3-para1.a-para2.i" provision.type="other"><no>(i)</no><block><txt break.before="0">the person for whom the director was acting in the matter in the practice of the director’s profession; or</txt></block></li><li guid="_e3c404ba-bb1b-41ac-85bd-35a86e5a8dfd" id="sec.31-ssec.3-para1.a-para2.ii" signed notice to the Minister giving at least 1 month’s notice; or</txt></block></li><li guid="_6e03bf8b-866f-42cc-adf4-7561f4a5a34b" id="sec.32-ssec.1-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">is convicted of an indictable offence; or</txt></block></li><li guid="_06269972-ab01-4879-b134-3b33b667bfd5" id="sec.32-ssec.1-para1.c" provision.type="other"><no>(c)</no><block><txt break.before="0">has neglected his or her duties or performed them incompetently.</txt></block></li></list></block></subclause><subclause provision.type="other"><no>(a)</no><block><txt break.before="0">if the appointment is continuous on 1 or more of the person’s previous appointments as acting director and the total period of service employees employed in the department administered by the chief executive (child safety) undertaking work relevant to the director’s functions;</txt></block></li><li section 16;</txt></block></li><li guid="_26e810b2-96f5-4720-a7c0-1bb023cd4989" id="sec.39-ssec.2-para1.b-para2.ii" provision.type="other"><no>(ii)</no><block><txt break.before="0">procedures for dealing with child protection matters, including factors the director must have regard to in deciding whether to apply for child protection orders;</txt></block></li><li guid="_94f7a523-785c-4fa8-911b-c8efcfc84f45" id="sec.39-ssec.2-para1.b-para2.iii" provision.type="other"><no>(iii)</no><block><txt break.before="0">principles and procedures for the conduct of child protection proceedings, including procedures about the roles of the director and chief executive (child safety) during the proceedings;</txt></block></li><li guid="_ee6cc7bf-8618-40b1-ba10-2dcdc52ef2e5" id="sec.39-ssec.2-para1.b-para2.iv" provision.type="other"><no>(iv)</no><block><txt break.before="0">procedures about how the chief executive (child proceeding</defterm> means a proceeding under the <legref check="unknown" jurisd="QLD" type="act"><name emphasis="yes">Child Protection Act 1999</name></legref> for the making, extension, amendment or revocation of a child protection order.</txt></definition><definition affected.by.uncommenced="0" guid="_d4f518c6-6722-47de-9c72-fd2cab19f445" id="sch.1-def.confidentialinformation_"><txt break.before="1"><defterm guid="_92a477cb-e5b4-4a0e-b739-6f17cc741a9d" id="sch.1-def.confidentialinformation" type="definition">confidential information</defterm>—</txt><list number.type="manual" unnumbered.indent="0"><li guid="_69e5c044-3dcd-4fba-837c-bbbc4c81b50c" id="sch.1-def.confidentialinformation-para1.a" provision.type="other"><no>(a)</no><block><txt break.before="0">includes information about a person’s affairs; but</txt></block></li><li guid="_9661eba3-628c-49ba-aa68-63805fc81cc2" id="sch.1-def.confidentialinformation-para1.b" provision.type="other"><no>(b)</no><block><txt break.before="0">does not include statistical or other information that could not reasonably be expected to result in the identification of the person to whom the information relates.</txt></block></li></list></definition><definition affected.by.uncommenced="0" guid="_e30015dc-79a9-455b-9bb8-0718248e9623" id="sch.1-def.director_"><txt
