affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The purpose of this regulation is to provide for the waiver and deferral of rent and the deferral of check="valid">schedule&#160;1</intref> defines particular words used in this regulation.</txt></block></subclause><subclause id="sec.3-ssec.2" guid="_00915cd3-2c10-48d7-b8af-e26ff19ff237" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subject to <intref refid="sec.3-ssec.1" target.guid="_8abfb1b8-ceea-4b7f-9912-98b0f34ce06d" guid="_c278ae22-d226-47ee-9a1d-5769e6cc18a3" type="definition">eligible tenure</defterm> see <intref refid="sec.5" target.guid="_573b8d6c-3b80-4a3c-9ff1-862ca179761b" check="valid">section&#160;5</intref>.</txt></definition><definition id="sec.4-def.relevantrentalperiod_" guid="_94dbaf0e-2adb-460b-8229-8613730ef4d3" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.relevantrentalperiod" guid="_020c3765-b3ff-49fc-82ce-4f96d110fbcd" type="definition">relevant rental period</defterm> means—</txt><list number.type="manual" tenure that is in force—the current rental period for the tenure; or</txt></block></li><li id="sec.4-def.relevantrentalperiod-para1.b" guid="_1285a0fe-edd3-4605-8413-ea2a0c9a486b" provision.type="other"><no>(b)</no><block><txt break.before="0">for an eligible tenure that is not in force—the last rental period for the tenure.</txt></block></li></list></definition><definition id="sec.4-def.usualamount" guid="_fa0fc3f4-9061-4889-982b-9d57e0de1748" type="definition">usual amount</defterm>, of rent for a period, means the amount of rent that, but for the waiver under this part, would have been, or would be, payable for the period.</txt></definition><definition id="sec.4-def.waivedamount_" guid="_3bbdb56f-e1a7-4260-ac66-4f1728840d79" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.waivedamount" guid="_b6fda574-73a6-4470-83c8-b3869a7d615a" type="definition">waived amount</defterm>, of rent for an eligible tenure, means the partial amount of the rent for the tenure worked out under <intref refid="sec.8" target.guid="_d49ee05b-123d-42e6-9a48-caf9b207d8da" check="valid">section&#160;8</intref> or <intref refid="sec.9" target.guid="_ea0ebb79-fb28-45d7-8317-00fb0bbadc7f" check="valid">9</intref>.</txt></definition><definition id="sec.4-def.waiverperiod_" guid="_81285b72-599b-42a0-a37b-a58492b4bd6d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.4-def.waiverperiod" guid="_26f1e37b-16d1-4d19-9b0e-8948d1e49453" type="definition">waiver period</defterm>, for an eligible tenure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.waiverperiod-para1.a" guid="_56b5e5f5-2b76-40c0-9d0d-8aacc70da583" provision.type="other"><no>(a)</no><block><txt break.before="0">means the period that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-def.waiverperiod-para1.a-para2.i" guid="_8e841060-c365-4cd2-aaa2-14759483fb42" provision.type="other"><no>(i)</no><block><txt break.before="0">started on 1 April 2020; and</txt></block></li><li id="sec.4-def.waiverperiod-para1.a-para2.ii" guid="_d0a0bff0-a876-4bcf-9e91-be186a1edfb6" provision.type="other"><no>(ii)</no><block><txt break.before="0">ends on 30 September 2020; but</txt></block></li></list></block></li><li id="sec.4-def.waiverperiod-para1.b" guid="_c5de0e4e-61f8-444c-9a75-665b6100cba2" provision.type="other"><no>(b)</no><block><txt break.before="0">does not include a period for which the tenure was not, provision.type="other"><no>5</no><heading id="sec.5-he" guid="_5fdd2608-23f6-4940-97b5-e908c30a4927">What is an <defterm id="sec.5-def.eligibletenure" guid="_9efff4c8-26b2-484c-9e33-4edd66a5d5f0" type="definition">eligible tenure</defterm></heading><subclause id="sec.5-ssec.1" guid="_7057f386-1a57-4095-a8d7-6b06455b0037" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An <defterm id="sec.5-def.eligibletenure-oc.2" guid="_1307196b-de4a-471b-9867-691ef42ddcb6" type="definition">eligible tenure</defterm> is a tenure, other than a tenure held by a government leasing entity, of any of the following rental categories—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.1-para1.a" guid="_facc62a9-a6f2-4a3b-a8d0-8e20c405f6ad" provision.type="other"><no>(a)</no><block><txt break.before="0">category 11.1 or 11.2;</txt></block></li><li id="sec.5-ssec.1-para1.b" guid="_9490274c-d5a8-4190-9cd1-25b255917e86" provision.type="other"><no>(b)</no><block><txt break.before="0">category 13;</txt></block></li><li id="sec.5-ssec.1-para1.c" id="sec.6-he" guid="_0ef5ec2a-f482-430c-b369-584cf34e6c4a">What is the <defterm id="sec.6-def.thresholdamount" guid="_6f9af24f-a2b7-47ea-a32f-449db1e63dba" type="definition">threshold amount</defterm></heading><block><txt break.before="0">The <defterm id="def.thresholdamount" guid="_0a162d0b-931e-4ddf-8a11-21575506395d" type="definition">threshold amount</defterm> for working out the waived amount of the rent for an eligible tenure, other than a category 15.1, 15.2, 15.3, 15.4 or 15.5 tenure, is the amount worked out using the following formula—</txt><txt break.before="1"><b>TA = (MR x 4)/3</b></txt><txt break.before="1">where—</txt><deflist><definition id="sec.6-def.TA_" guid="_65a02775-412c-41ba-af13-1ab6c0044c75" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-def.TA" guid="_a28cd893-672e-4d8c-80d8-b9994ed9608f" type="definition">TA</defterm> is the threshold amount.</txt></definition><definition id="sec.6-def.MR_" guid="_9d3e693b-adb6-45fc-abd0-5e279871bd64" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.6-def.MR" guid="_358f0a61-c7f2-4fc6-9bee-3a1db8672ee4" type="definition">MR</defterm> is the usual amount of the minimum rent for the tenure for the relevant rental period.</txt></definition></deflist></block></clause><clause id="sec.7" guid="_251ef2f1-28f8-472f-9c4b-ba89fa6a6b56" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_ce10b5e9-2003-4447-b566-762fe5322a46">Waiver of payment of waived amount of rent</heading><subclause id="sec.7-ssec" guid="_dab5f058-595e-4562-a322-6e201711b058" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="0">Payment of the waived amount of rent for an eligible tenure— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec-para1.a" guid="_8f79384c-5848-4c17-b9c9-5570dde709de" provision.type="other"><no>(a)</no><block><txt break.before="0">is waived under this part for the waiver period; and</txt></block></li><li id="sec.7-ssec-para1.b" guid="_e4ea5afa-7d36-414e-a3cf-7c1b5d8562d1" provision.type="other"><no>(b)</no><block><txt break.before="0">is taken to have been waived from the start of the waiver period.</txt></block></li></list><note id="sec.7-ssec-note" guid="_923b8539-9a8a-40fd-8560-fa3fdeb6621a" type="example"><heading id="sec.7-ssec-note-he" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_a81b09c1-e9d9-449e-ac82-eb323d52f827">Waived amount of rent—eligible tenure with higher annual rent</heading><subclause id="sec.8-ssec.1" guid="_7813732a-4ade-4651-9edd-f81d4a2e0981" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies in relation to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.1-para1.a" guid="_a8c4cc0e-34b8-41b2-8b26-77231a1bb11d" provision.type="other"><no>(a)</no><block><txt break.before="0">an eligible tenure that is a category 15.1, 15.2, 15.3, 15.4 or 15.5 tenure; or</txt></block></li><li id="sec.8-ssec.1-para1.b" guid="_eff10387-417b-44b6-90c3-b67d8de89e3e" provision.type="other"><no>(b)</no><block><txt break.before="0">another eligible tenure, if the usual amount of the rent for the tenure for the relevant rental period is equal to or more than the threshold amount.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.2" guid="_0e2ebe82-5006-4b52-92b6-506084f797ad" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The amount of the rent for the eligible tenure that is waived for each relevant sub-period of the waiver period is the amount worked out using the following formula—</txt><txt break.before="1"><b>W = AR/FYD x QD</b></txt><txt break.before="1">where—</txt><deflist><definition id="sec.8-ssec.2-def.W_" guid="_d66644ce-9b68-4a82-8a77-6fe7847ebe43" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-ssec.2-def.W" guid="_804a0fb0-2b84-4b4d-a09a-497a2f32fcf2" type="definition">W</defterm> is the amount of the rent waived for the relevant sub-period.</txt></definition><definition id="sec.8-ssec.2-def.AR_" guid="_7b152bc5-327b-456d-9caa-2d3a40ba9b33" break.before="1"><defterm id="sec.8-ssec.2-def.FYD" guid="_8f56b14f-b93e-4db2-90d6-53b766373388" type="definition">FYD</defterm> is the number of days in the financial year including the relevant sub-period.</txt></definition><definition id="sec.8-ssec.2-def.QD_" guid="_c803f633-dec6-42ba-9b6e-96f3770c54a4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-ssec.2-def.QD" guid="_d21da0c9-7a04-4be7-869b-9bc62e0f3a53" type="definition">QD</defterm> is the number of days in the relevant sub-period.</txt></definition></deflist></block></subclause><subclause id="sec.8-ssec.3" guid="_5fd42571-5f31-4eb9-b42f-aa7ba4297f7e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.8-ssec.3-def.relevantsubperiod_" guid="_c4e73627-0ca5-4211-8e4b-1158437aa8bf" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.8-ssec.3-def.relevantsubperiod" guid="_312779df-d8ef-459f-8f0c-1f561e7fc6f2" type="definition">relevant sub-period</defterm>, of a waiver period, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-def.relevantsubperiod-para1.a" guid="_2e85716b-b9cb-437c-b5a5-bc248a04f178" provision.type="other"><no>(a)</no><block><txt break.before="0">to the extent the waiver period consists of, or includes, a whole quarterly sub-period—the quarterly sub-period; or</txt></block></li><li id="sec.8-ssec.3-def.relevantsubperiod-para1.b" guid="_a64eecd7-106f-4941-aa20-214e6052176c" provision.type="other"><no>(b)</no><block><txt break.before="0">to the extent the waiver period includes part of a quarterly sub-period to which <intref refid="sec.8-ssec.3-def.relevantsubperiod-para1.a" target.guid="_2e85716b-b9cb-437c-b5a5-bc248a04f178" check="valid">paragraph&#160;(a)</intref> does not apply—the part of the quarterly sub-period.</txt></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.9" guid="_ea0ebb79-fb28-45d7-8317-00fb0bbadc7f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_8e666bb9-ebd9-4c85-accb-c76d6389b750">Waived amount of rent—other eligible tenures</heading><subclause id="sec.9-ssec.1" guid="_7e4f083b-6cf9-42ca-88e0-b777550487d9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies in relation to an eligible tenure, other than a tenure mentioned in <intref refid="sec.8" target.guid="_d49ee05b-123d-42e6-9a48-caf9b207d8da" check="valid">section&#160;8</intref><intref refid="sec.8-ssec.1" target.guid="_7813732a-4ade-4651-9edd-f81d4a2e0981" check="valid">(1)</intref>, if the usual amount of the rent for the relevant rental period is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_53a40a6e-f9d1-40c7-b2c4-39a24148a534" provision.type="other"><no>(a)</no><block><txt break.before="0">equal to or more than the usual amount break.before="0">less than the threshold amount.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_74dd9d6c-1c38-47c0-b89e-a11a24ba4218" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The amount of the rent for the eligible tenure that is waived for each full rental period, or part rental period, within the waiver period is the amount worked out using the following formula—</txt><txt break.before="1"><b>W = AR - MR</b></txt><txt break.before="1">where—</txt><deflist><definition id="sec.9-ssec.2-def.W_" type="definition">AR</defterm> is the usual amount of the rent for the tenure for the financial year consisting of the full rental period or including the part rental period.</txt></definition><definition id="sec.9-ssec.2-def.MR_" guid="_1b2bfe42-6b01-4691-bcf8-f79f6462bb4b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.2-def.MR" guid="_822f125c-4494-416c-9964-6f3664d8916f" type="definition">MR</defterm> is the usual amount of the minimum rent for the tenure for the financial year consisting of the full rental period or including the part rental period.</txt></definition></deflist></block></subclause><subclause id="sec.9-ssec.3" guid="_938eb860-62d4-4328-aa90-c35eb2957f33" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.9-ssec.3-def.fullrentalperiod_" guid="_9cfd9b4e-670d-4d8d-a88a-8e2e260c2a3d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.3-def.fullrentalperiod" guid="_17ffec3d-a5de-417d-8746-25289d3acb7f" type="definition">full rental period</defterm> means a rental period that is a financial year.</txt></definition><definition id="sec.9-ssec.3-def.partrentalperiod_" guid="_f369eed5-8a41-435b-a8ed-aae3d87791f8" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.3-def.partrentalperiod" guid="_2247c66a-08ef-4361-9629-88e4c8b63171" type="definition">part rental period</defterm> means a rental period other than a full rental period.</txt></definition></deflist></block></subclause></clause></part><part id="pt.3" guid="_b7312b38-95d5-4792-9b36-d04102c7cc9c" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_a5a536f6-f21b-46aa-8eb7-ddc5d3ff60b7">Waiver or deferral of rent or instalments by Minister</heading><clause id="sec.10" guid="_b42480e1-441c-46ee-a675-ab9fdd44cfc7" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_ba9a8f0b-916a-4c76-b122-95fbffecb0b7">Notice of waiver or deferral of rent or instalments</heading><subclause id="sec.10-ssec.1" guid="_e3a4129e-a3bd-478c-83c8-7bc06df36e10" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Minister may, by notice published on the department’s website (a <defterm id="sec.10-def.waiverordeferralnotice" guid="_d9b4af80-8a85-4775-bf2d-7a1819ba9ca4" type="definition">waiver or deferral notice</defterm>), waive the payment of rent, or defer the payment of rent or instalments, for a tenure under this part if the Minister considers it is appropriate to do so in response to the COVID-19 emergency.</txt><note id="sec.10-ssec.1-note" guid="_082af639-ac6c-4afe-88de-658476b035a3" type="example"><heading id="sec.10-ssec.1-note-he" guid="_f24e3a33-092c-4dd4-b1e7-b3fd8875cc21">Note—</heading><block><txt break.before="1">See, however, <intref refid="sec.15" target.guid="_75e99046-d6ab-4604-9eda-1120ddb0f9e2" check="valid">sections&#160;15</intref> and <intref refid="sec.16" target.guid="_d4845cff-6944-4917-9792-7e830f7897c1" check="valid">16</intref>.</txt></block></note></block></subclause><subclause id="sec.10-ssec.2" guid="_162e22e6-96fb-429d-ac79-35f2b1278925" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The waiver or deferral notice must state—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.a" guid="_1affeea7-79e0-49f6-b962-3a3f05986e55" provision.type="other"><no>(a)</no><block><txt break.before="0">each tenure to which the notice applies; and</txt></block></li><li id="sec.10-ssec.2-para1.b" guid="_a9eb34ef-b99e-4faa-8d2a-a8ecab396050" provision.type="other"><no>(b)</no><block><txt break.before="0">the rental category of each tenure to which the notice applies; and</txt></block></li><li id="sec.10-ssec.2-para1.c" guid="_539e3afe-813c-44be-9f47-b6f5192f8d92" provision.type="other"><no>(c)</no><block><txt break.before="0">for the waiver of rent—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.c-para2.i" guid="_8f50087b-38cc-4265-8cb9-8d9972291093" provision.type="other"><no>(i)</no><block><txt break.before="0">whether payment of all or only part of the rent is waived; and</txt></block></li><li id="sec.10-ssec.2-para1.c-para2.ii" guid="_ec374100-e2b9-40f4-b9ed-20f2ee419512" provision.type="other"><no>(ii)</no><block><txt break.before="0">the amount or proportion of the rent that is waived (the <defterm id="sec.10-ssec.2-para1.c-def.waivedamount" guid="_ed236a3b-d3c9-44e0-951b-f22cc2242a17" type="definition">waived amount</defterm>); and</txt></block></li><li id="sec.10-ssec.2-para1.c-para2.iii" guid="_860da4ec-0545-41b6-a51e-455ba06e8de7" provision.type="other"><no>(iii)</no><block><txt break.before="0">the period for which the waiver applies, or is taken to have applied (the <defterm id="sec.10-ssec.2-para1.c-def.waiverperiod" guid="_7205dcec-1660-446f-a678-f409f8794729" type="definition">waiver period</defterm>), including when the period starts, or started, and ends; and</txt></block></li></list></block></li><li id="sec.10-ssec.2-para1.d" guid="_533bd760-8a76-4258-9813-3f73ee6851dd" provision.type="other"><no>(d)</no><block><txt break.before="0">for the deferral of rent or instalments—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.2-para1.d-para2.i" guid="_741febad-6f28-4e3d-bdae-829f698ff043" provision.type="other"><no>(i)</no><block><txt break.before="0">whether payment of all or only part of the rent or instalments is deferred; and</txt></block></li><li id="sec.10-ssec.2-para1.d-para2.ii" guid="_a24dc35a-7fa3-4784-91ab-0c168f94e6a0" provision.type="other"><no>(ii)</no><block><txt break.before="0">if payment of only part of the rent or instalments is deferred—the amount or proportion of the rent or instalments that is deferred; and</txt></block></li><li id="sec.10-ssec.2-para1.d-para2.iii" guid="_b57aac99-800b-4af0-8da2-4952d21c28de" provision.type="other"><no>(iii)</no><block><txt break.before="0">the period for which the deferral applies (the <defterm id="sec.10-ssec.2-para1.d-def.deferralperiod" guid="_3231d15c-1dcf-4f23-8133-6d873ec868b1" type="definition">deferral period</defterm>), including when the period starts and ends; id="sec.10-ssec.3-para1.a" guid="_a9391e12-a7d1-49ed-b7ac-aec127bb604c" provision.type="other"><no>(a)</no><block><txt break.before="0">was in force for a period consisting of, or including part of, the waiver period preceding the publication day; but</txt></block></li><li id="sec.10-ssec.3-para1.b" guid="_299eb70d-46f5-4bea-bd17-0503d16b050f" provision.type="other"><no>(b)</no><block><txt break.before="0">is not in force on the publication day of the waiver or deferral notice under which payment of the rent for the tenure is provision.type="other"><no>11</no><heading id="sec.11-he" guid="_32f95eab-3ba7-4946-b4d0-065c44433083">Period of waiver or deferral</heading><subclause id="sec.11-ssec.1" guid="_a3b5ce3c-c94e-45f5-a0cd-32f2a3982fa9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a waiver period or deferral period stated for the waiver or deferral of the payment of rent or instalments for a tenure under a waiver or deferral notice.</txt></block></subclause><subclause id="sec.11-ssec.2" guid="_686ee29e-a086-4a7c-ab3a-9871289e8485" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The waiver period for the tenure may be taken to have started on a stated day before the publication day of the waiver or deferral notice but not earlier than the commencement.</txt></block></subclause><subclause id="sec.11-ssec.3" guid="_247ef00c-315d-417c-b3d3-e3e9e70245fe" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the waiver period for the tenure is taken to have started before the publication day of the waiver or deferral notice, the waiver is taken to have applied from the day the waiver period starts.</txt></block></subclause><subclause id="sec.11-ssec.4" guid="_a565f8bb-b441-4630-8d7f-f8920847974c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The waiver period or deferral period for the tenure must end on or before the later of the following days—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.4-para1.a" guid="_1e865916-5529-4d3b-b6ce-693117820659" provision.type="other"><no>(a)</no><block><txt break.before="0">the day this regulation expires under <intref refid="sec.18" target.guid="_b7faeb10-be8a-4806-9619-7ee9d1672432" check="valid">section&#160;18</intref>;</txt></block></li><li id="sec.11-ssec.4-para1.b" guid="_23d4eb26-3d1c-4869-a496-d762a3984225" provision.type="other"><no>(b)</no><block><txt guid="_836869d7-5424-4641-b275-04f16c3d33d9" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Minister may amend a waiver or deferral notice (the <defterm id="sec.12-def.oldnotice" guid="_905c28ce-1526-42de-b8b5-0cb28bd5c726" type="definition">old notice</defterm>) by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.a" guid="_34e598fd-e707-4721-87d4-448ed2fd7ec8" provision.type="other"><no>(a)</no><block><txt break.before="0">preparing another waiver or deferral notice (an <defterm id="sec.12-ssec.1-def.amendednotice" guid="_766374c7-78a2-4dcb-8595-157236ef56fa" type="definition">amended notice</defterm>) that replaces the old notice; and</txt></block></li><li provision.type="other"><no>(2)</no><block><txt break.before="0">The Minister must refund or credit to the holder of the tenure the residual amount for the payment rent under <intref refid="pt.2" target.guid="_8710fdac-4027-4c1d-979b-99b0c0cea1f2" check="valid">part&#160;2</intref>—the commencement; or</txt></block></li><li
