Repealed on 20 August 2021 by <legref type="subordleg" target.doc.id="sl-2021-0115" check="invalid" jurisd="QLD">2021 SL&#160;No.&#160;115</legref> <intref refid="sec.3" target.guid="_46ec505f-b11d-4cae-8f55-fa3b30653599" check="valid">s&#160;3</intref>.</txt></block></statusrecord></coverdata><wrapper><front id="frnt" guid="_1ceae870-0d83-4d54-9bf4-8ba636052d7a"><shorttitle id="frnt-st" guid="_85eef0e3-46b8-476d-ba74-46ceb844ede4">Attorney-General Regulation 2010</shorttitle></front><body numbering.style="manual"><clause id="sec.1" guid="_07eb7727-a5ac-499a-9a86-f0b221b17597" provision.type="shorttitle" affected.by.uncommenced="0" spent.amends="0"><no>1</no><heading id="sec.1-he" guid="_3ec84eff-3ca0-4998-a3fc-3dff23dd4a3f">Short title</heading><block><txt break.before="1">This regulation may be cited as the <legref type="subordleg" target.doc.id="sl-2010-0234" target.version.series="70d09ac4-3035-4094-bf85-9715ed9b255d" check="valid" jurisd="QLD"><name emphasis="yes">Attorney-General Regulation 2010</name></legref>.</txt></block></clause><clause id="sec.2" guid="_3a50668c-6060-4ce6-9ba2-71e4e23ae443" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_458fd1ba-377d-4f69-a450-d7a8e1634cdf">Application for a fiat—<legref target.doc.id="act-1999-001" target.version.series="82beafa0-0d70-4730-93a3-0d2faa8b92df" check="valid" jurisd="QLD" type="act">Act</legref>, <legref refid="sec.7" target.doc.id="act-1999-001" target.version.series="82beafa0-0d70-4730-93a3-0d2faa8b92df" target.guid="_0eee0daf-3d7b-4723-9761-b21c87f9e692" check="valid" jurisd="QLD" type="act">s&#160;7</legref><legref refid="sec.7-ssec.1" check="invalid" jurisd="QLD" type="act">(1)</legref><legref refid="sec.7-ssec.1-para1.g" check="invalid" jurisd="QLD" type="act">(g)</legref><legref refid="sec.7-ssec.1-para1.g-para2.ii" check="invalid" jurisd="QLD" type="act">(ii)</legref></heading><subclause id="sec.2-ssec.1" guid="_2a47307a-a29b-4250-b215-5ef2fc191bb7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An application for the Attorney-General to grant a fiat to start a proceeding in the Attorney-General’s name to enforce or protect public rights must contain the following information—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.1-para1.a" guid="_90712b46-fc68-46c8-b25f-eac416d9b0df" provision.type="other"><no>(a)</no><block><txt break.before="0">the applicant’s name, address, phone number and fax number;</txt></block></li><li id="sec.2-ssec.1-para1.b" guid="_62b6b6d9-7a0b-41dc-80d1-bf2394284b0d" provision.type="other"><no>(b)</no><block><txt break.before="0">the reasons why the applicant can not obtain complete relief in the proceeding if the fiat is not granted;</txt></block></li><li id="sec.2-ssec.1-para1.c" guid="_4d57489f-cea9-4228-9aee-8a72b3d25681" provision.type="other"><no>(c)</no><block><txt break.before="0">whether the applicant has pursued other forms of relief, for example, mediation.</txt></block></li></list></block></subclause><subclause id="sec.2-ssec.2" guid="_af6b2ce1-3969-4297-9058-b791fc8b1ff0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The application must be accompanied by the following documents—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.2-para1.a" guid="_01b3fc0f-2efd-4dfe-9db6-59402ccf0bde" provision.type="other"><no>(a)</no><block><txt break.before="0">the proposed originating process;</txt></block></li><li id="sec.2-ssec.2-para1.b" guid="_67d308d6-9fb1-4a24-a666-89b443775b4a" provision.type="other"><no>(b)</no><block><txt break.before="0">a certificate signed by counsel stating that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.2-para1.b-para2.i" guid="_f2cb09aa-3b09-47e1-b5b1-030792e38194" provision.type="other"><no>(i)</no><block><txt break.before="0">the proceeding is appropriate to be started in the Attorney-General’s name; and</txt></block></li><li id="sec.2-ssec.2-para1.b-para2.ii" guid="_7564a0e3-daed-4e93-b120-c9dc167f23ed" provision.type="other"><no>(ii)</no><block><txt break.before="0">the originating process is appropriate for the Attorney-General’s fiat; and</txt></block></li><li id="sec.2-ssec.2-para1.b-para2.iii" guid="_93470142-4c51-4149-bc67-b4741ead332a" provision.type="other"><no>(iii)</no><block><txt break.before="0">the applicant can not obtain complete relief if the fiat is not granted;</txt></block></li></list></block></li><li id="sec.2-ssec.2-para1.c" guid="_9d5a84e4-4078-4723-a578-6bd25cd8dc59" provision.type="other"><no>(c)</no><block><txt break.before="0">an opinion from counsel as to the likelihood of success of the proceeding that details the facts of the case and explains the proceeding;</txt></block></li><li id="sec.2-ssec.2-para1.d" guid="_368ca83b-4bf3-478d-bfcc-fc1f229933c2" provision.type="other"><no>(d)</no><block><txt break.before="0">a certificate signed by the applicant’s solicitor stating that the applicant is an appropriate person to act as relator in the proceeding;</txt></block></li><li id="sec.2-ssec.2-para1.e" guid="_13326a1e-dea9-4219-9cc8-fb3a0e1083f9" provision.type="other"><no>(e)</no><block><txt break.before="0">a document signed by the applicant or the applicant’s solicitors undertaking that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.2-para1.e-para2.i" guid="_3238d65f-5456-4fa1-b18d-e406117a6870" provision.type="other"><no>(i)</no><block><txt break.before="0">the proceeding is at the sole risk and cost of the applicant; and</txt></block></li><li id="sec.2-ssec.2-para1.e-para2.ii" guid="_183fe738-84f9-4539-85ec-ba1048f913b6" provision.type="other"><no>(ii)</no><block><txt break.before="0">the applicant will pay all of the Attorney-General’s costs of the proceeding including any costs payable by the Attorney-General to a party; and</txt></block></li><li id="sec.2-ssec.2-para1.e-para2.iii" guid="_79b17725-6e4c-4f95-b314-a64fa838d171" provision.type="other"><no>(iii)</no><block><txt break.before="0">the applicant indemnifies the Attorney-General for the proceeding; and</txt></block></li><li id="sec.2-ssec.2-para1.e-para2.iv" guid="_7f712c8e-25f5-41e4-8c21-c1937b7f81e1" provision.type="other"><no>(iv)</no><block><txt break.before="0">the applicant will give the Attorney-General copies of all pleadings and other court documents for the proceeding; and</txt></block></li><li id="sec.2-ssec.2-para1.e-para2.v" guid="_47ffa06d-fea9-4bcb-b05a-a4fce15377e9" provision.type="other"><no>(v)</no><block><txt break.before="0">the applicant will only take any of the following steps with the Attorney-General’s approval—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.2-para1.e-para2.v-para3.A" guid="_493c06fe-8b86-4f3a-98a9-9673aad93645" provision.type="other"><no>(A)</no><block><txt break.before="0">amend the originating process for the proceeding;</txt></block></li><li id="sec.2-ssec.2-para1.e-para2.v-para3.B" guid="_268c0d9f-94c8-49a4-a4dc-bee78641cbf5" provision.type="other"><no>(B)</no><block><txt break.before="0">discontinue the proceeding or withdraw part of it;</txt></block></li><li id="sec.2-ssec.2-para1.e-para2.v-para3.C" guid="_cda32cca-1d9e-4348-883e-7cf4ec863bcc" provision.type="other"><no>(C)</no><block><txt break.before="0">withdraw all or part of any answer to a counterclaim;</txt></block></li><li id="sec.2-ssec.2-para1.e-para2.v-para3.D" guid="_3f463dd6-f803-461d-8f38-fd5973adbd16" provision.type="other"><no>(D)</no><block><txt break.before="0">settle all or part of the proceeding.</txt></block></li></list></block></li></list></block></li></list></block></subclause><subclause id="sec.2-ssec.3" guid="_9c85dd2e-43ad-41ca-a757-600e87e5f5da" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a proceeding has already started—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2-ssec.3-para1.a" guid="_0b2ea874-1699-4c71-be56-d058b9d12524" provision.type="other"><no>(a)</no><block><txt break.before="0">this section applies, with necessary changes, to an application in the proceeding; and</txt></block></li><li id="sec.2-ssec.3-para1.b" guid="_cb64d817-a387-486a-ba24-068363b53925" provision.type="other"><no>(b)</no><block><txt break.before="0">the application under this section must state the stage of the proceeding.</txt></block></li></list></block></subclause></clause><clause id="sec.3" guid="_46ec505f-b11d-4cae-8f55-fa3b30653599" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_265cef2c-4d28-4831-b0bd-e9d92ddc000f">Repeal</heading><block><txt break.before="1">The <legref type="subordleg" target.doc.id="sl-2000-0058" target.version.series="50681786-bfe4-4ca3-918d-edfb84dace11" check="valid" jurisd="QLD"><name emphasis="no">Attorney-General Regulation 2000</name></legref>, SL No. 58 is repealed.</txt></block></clause></body></wrapper></subordleg>
