id="sec.2-def.appeal_" guid="_f14f6f77-370d-4a99-b429-df2c3798357d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2-def.appeal" guid="_f56a70e3-a0bc-47c7-a116-5b4ed2f97948" type="definition">appeal</defterm> means an appeal under <legref type="subordleg" refid="sec.43" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;43</legref><legref type="subordleg" refid="sec.43-ssec.1" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(1)</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>.</txt></definition><definition id="sec.2-def.award_" guid="_52c88a59-0747-4b10-a584-f91449aa6683" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2-def.award" guid="_0ce60511-e6af-4ac9-81f9-5e2f06cbedd4" type="definition">award</defterm> means the Parliamentary Service Award—State 2003 published in the Queensland Government Industrial break.before="1"><defterm id="sec.2-def.ministerialdirective" guid="_49b0b19a-c309-4d9a-8599-621a5b19c329" type="definition">ministerial directive</defterm> means a directive made under the <legref target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Service Act 2008</name></legref>, <legref refid="sec.54" target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" target.guid="_5928f102-67e7-46a7-bb8a-6086d5a4c577" check="valid" jurisd="QLD" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_5da95ac1-a6e6-48f3-9ac9-c4436f2644a6">Starting an appeal</heading><subclause id="sec.3-ssec.1" guid="_6a85e872-095e-463c-9ccb-bc2a674bba66" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person who may appeal against a decision may start the appeal only by giving the Speaker a written notice stating—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.a" guid="_35d966e8-ed85-45e2-8be0-9659cabb6d25" provision.type="other"><no>(a)</no><block><txt break.before="0">details identifying the decision appealed against; and</txt></block></li><li id="sec.3-ssec.1-para1.b" guid="_d4fa0fa5-9077-43fb-8c46-db9df78e9085" provision.type="other"><no>(b)</no><block><txt break.before="0">why the person is appealing against the decision.</txt></block></li></list></block></subclause><subclause id="sec.3-ssec.2" guid="_0fb4e4ce-5eef-4a0b-a77c-b10d911bac5c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The notice must be given no later than 5p.m. on the twenty-first day after—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-para1.a" guid="_f1b224e6-3c17-4687-b368-d334070258c3" provision.type="other"><no>(a)</no><block><txt break.before="0">for an appeal against an appointment—notice is given of the appointment in the gazette; or</txt></block></li><li id="sec.3-ssec.2-para1.b" guid="_94cbabcd-5724-44bf-9a2d-7b1d062fa6e8" provision.type="other"><no>(b)</no><block><txt break.before="0">for an appeal against disciplinary action—receipt by the appellant of written advice about the disciplinary action to be taken against the appellant.</txt></block></li></list></block></subclause></clause><clause id="sec.4" guid="_a804d7e4-2efe-4190-84bc-adadd8ab1e68" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_5b07944e-7cbd-4096-8367-142578c0cfa0">Withdrawing an appeal</heading><subclause id="sec.4-ssec.1" guid="_345af513-09d4-40b3-a1c2-ec659dd0f467" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An appellant may withdraw an appeal by written notice given to the Speaker.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_c4bf7e81-9c23-43b7-916b-a1a08418b07c" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The notice may only be given before the Speaker gives the appellant the Speaker’s written decision on the appeal.</txt></block></subclause></clause><clause id="sec.5" guid="_3139ae80-ac89-454e-8824-9ebc7cce91df" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_468de65e-6b7c-489c-89c2-fa4a3e0339e4">Vexatious or frivolous appeal</heading><subclause id="sec.5-ssec.1" guid="_7175aa6c-c09b-48eb-8474-889b83934a87" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Speaker may decide not to proceed with an appeal if the Speaker considers the appeal is vexatious or frivolous.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_b659ed1d-6e24-42a7-a797-3a6ff98cf84b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Before deciding not to proceed with the appeal, the Speaker must give the appellant the opportunity to establish, by written submissions, an arguable case for the appeal.</txt></block></subclause></clause><clause id="sec.6" guid="_fefc1240-c9f6-40c8-bc01-d5efef48235e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_a9e22039-689a-4ac6-b24e-9483112d46f9">Time, date and place for hearing etc.</heading><block><txt break.before="1">The Speaker may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-para1.a" guid="_07c7ee11-d3d6-4c42-b635-96c888513885" provision.type="other"><no>(a)</no><block><txt break.before="0">decide the time, date and place for hearing an appeal; or</txt></block></li><li id="sec.6-para1.b" guid="_2db02833-1002-434a-be76-7f6238d163c7" provision.type="other"><no>(b)</no><block><txt break.before="0">adjourn the hearing of an appeal.</txt></block></li></list></block></clause><clause id="sec.7" guid="_ea86ced9-a1d4-457a-8ba7-5fe786184470" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_f65a7e7d-7d2e-42ba-8f92-9b93fa4cd16c">Officer or employee to comply</heading><block><txt break.before="1">An officer of, or an employee in, the parliamentary service must comply with any reasonable request by the Speaker for the proper conduct of an appeal.</txt></block></clause><clause id="sec.8" guid="_e67248fe-a46f-4ee1-8a7e-9268c1cbb0ff" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_3ac32efc-b69d-4e11-b306-65aaae02716d">Attendance at hearing by officer or employee</heading><subclause id="sec.8-ssec.1" guid="_3f2be558-03ac-4f23-9814-5675d553b5d0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An officer of, or an employee in, the parliamentary service required to attend at the hearing of an appeal is taken to be on official duty while attending for the hearing.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_fa2bf633-d521-4c97-96f1-b58e86462ad1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">This section does not apply to an officer or employee who is suspended from duty under <legref type="subordleg" refid="sec.41" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;41</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>, <legref type="subordleg" refid="sec.43" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">s&#160;43</legref><legref type="subordleg" refid="sec.43-ssec.1" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(1)</legref><legref type="subordleg" refid="sec.43-ssec.1-para1.b" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(b)</legref><legref type="subordleg" refid="sec.43-ssec.1-para1.b-para2.ii" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(ii)</legref></heading><block><txt break.before="1">For <legref type="subordleg" refid="sec.43" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;43</legref><legref type="subordleg" refid="sec.43-ssec.1" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(1)</legref><legref type="subordleg" refid="sec.43-ssec.1-para1.b" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(b)</legref><legref type="subordleg" refid="sec.43-ssec.1-para1.b-para2.ii" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(ii)</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>, each office or class of office mentioned in <intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">schedule&#160;1</intref> is a class of office for which no appeal lies in relation to an appointment to the office.</txt></block></clause><clause id="sec.10" guid="_4aeae096-cad6-4f81-bf58-10d82cbb5519" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_9a733115-155f-4a81-96b4-097eed289980">Requirements for appeal against an appointment—<legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>, <legref type="subordleg" refid="sec.43" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">s&#160;43</legref><legref type="subordleg" refid="sec.43-ssec.2" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(2)</legref><legref type="subordleg" refid="sec.43-ssec.2-para1.b" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(b)</legref></heading><subclause id="sec.10-ssec.1" guid="_c4074d3d-cf2f-443b-b201-030e4262b33b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For an appeal by an officer of the parliamentary service against an appointment to an office, the requirements for the officer for <legref type="subordleg" refid="sec.43" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;43</legref><legref type="subordleg" refid="sec.43-ssec.2" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(2)</legref><legref type="subordleg" refid="sec.43-ssec.2-para1.b" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(b)</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref> are as follows—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_29014cd3-d40f-4e47-9d61-0987eed0ae5f" provision.type="other"><no>(a)</no><block><txt break.before="0">the officer applied for the office, whether or not the vacancy in the office was advertised;</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_4639e751-d8f1-410a-b385-a581ee97e9e4" provision.type="other"><no>(b)</no><block><txt break.before="0">for an advertised vacancy for an office—the officer’s application was received on or before the closing date for receipt of applications for the office;</txt></block></li><li id="sec.10-ssec.1-para1.c" guid="_4ce963b9-034e-4975-a0b6-2fe382006030" provision.type="other"><no>(c)</no><block><txt break.before="0">at the date on which the appointment to the office was made—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.c-para2.i" guid="_52da16bd-8633-406c-baca-256b52625771" provision.type="other"><no>(i)</no><block><txt break.before="0">the officer was an officer of the parliamentary service; and</txt></block></li><li id="sec.10-ssec.1-para1.c-para2.ii" guid="_b3bb681f-dac4-47bd-a013-69078a447a1b" provision.type="other"><no>(ii)</no><block><txt break.before="0">the maximum salary for the office applied for was more than the maximum salary for the office held by the officer.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.10-ssec.2" guid="_6f45c20a-b865-4811-bd36-6570c4780b2e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An appeal lapses if the appellant stops being an officer of the parliamentary service.</txt></block></subclause></clause><clause id="sec.11" guid="_e0c8d0c2-fc6c-4eb1-a427-0747e79bbccc" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_2c6898bd-2cf1-4dc1-951c-a9303d29a692">Right of address by Clerk, appellant and appointee</heading><block><txt break.before="1">On an appeal against an appointment to an office, the Clerk or an officer for the Clerk, the appellant and the appointee may address the Speaker about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-para1.a" guid="_9b96773c-154a-4eb7-a74c-0f656b010daf" provision.type="other"><no>(a)</no><block><txt break.before="0">the claims of the appointee and the appellant to appointment to the office, having regard to their qualifications and competence; and</txt></block></li><li id="sec.11-para1.b" guid="_5d1df52f-9e1d-4692-9aff-9d440fdfe02d" provision.type="other"><no>(b)</no><block><txt break.before="0">the appropriateness of any procedures used for the selection of the appointee.</txt></block></li></list></block></clause><clause id="sec.12" guid="_d20f8aff-6fd0-42be-b214-8e6d64353fbc" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_76f245d9-db8c-4734-99e9-70477909e51a">Clerk to notify decision on appeal against appointment</heading><block><txt break.before="1">For an appeal against an appointment to an office, the Clerk must notify the appellant and appointee of the Speaker’s decision on the appeal as soon as practicable after the decision is made.</txt></block></clause><clause id="sec.13" guid="_46c98bbb-3450-414e-90c1-937286240d30" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_6effab20-1f1e-4590-b8a2-d37eb5d3eabf">Successful appeal</heading><subclause id="sec.13-ssec.1" guid="_3f64dd40-5314-453a-b466-66f7111472e6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if an appellant is appointed to an office as a result of a decision on an appeal.</txt></block></subclause><subclause id="sec.13-ssec.2" guid="_66d1640e-c1e9-4c89-9958-70453fcf23e0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The appellant is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.a" guid="_9cc37165-0dac-48aa-af57-d2954c0a6de3" provision.type="other"><no>(a)</no><block><txt break.before="0">entitled to be paid salary at the rate for the office on and after the date of the appellant’s appointment, despite any delay in the appellant taking up duty in the office; and</txt></block></li><li id="sec.13-ssec.2-para1.b" guid="_7e2cc5be-568d-49d5-b6b9-073a138931e2" provision.type="other"><no>(b)</no><block><txt break.before="0">eligible to receive any applicable salary increment on the anniversary of the appointment of the officer originally appointed to the office.</txt></block></li></list></block></subclause><subclause id="sec.13-ssec.3" guid="_d8bfaa3a-fc2c-4c1b-9954-0b9901a7aee2" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The officer originally appointed to the office is to return to the office and classification from which the officer was appointed.</txt></block></subclause><subclause id="sec.13-ssec.4" guid="_2931172b-1fbd-4b38-8d2b-e1b286f22aae" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, if the office from which the officer originally appointed was appointed is no longer vacant, the officer is to be retained at a salary level not less than the salary level for that office.</txt></block></subclause><subclause id="sec.13-ssec.5" guid="_d763a078-c5c5-4f51-895d-351bc5607905" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The revocation of the appointment of the officer originally appointed to the office must be gazetted.</txt></block></subclause></clause><clause id="sec.14" guid="_82d9a221-d78d-4387-91fd-ef67d24b1984" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_436e42e4-62dc-4c27-8758-c80b9619aa78">Disciplinary action to be deferred until after appeal</heading><subclause id="sec.14-ssec.1" guid="_26db6841-99ae-44de-a2a2-dcd0b8c76969" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the Clerk makes an order under <legref type="subordleg" refid="sec.40" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;40</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref> that a person be disciplined, no action may be provision.type="other"><no>(5)</no><block><txt break.before="0">The Clerk must keep a record of the number, type and classification level of direct appointments made under this section in each provision.type="other"><no>(1)</no><block><txt break.before="0">Subject to <intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">subsections&#160;(3)</intref> to <intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">(5)</intref>, an application to fill a vacancy (the <defterm id="sec.18-def.originalvacancy" guid="_abd0281a-9df7-4769-a2de-1b6aafe17845" type="definition">original vacancy</defterm>) in an office the role for which the Speaker considers is less than equivalent to a senior officer role under the <legref target.doc.id="act-2008-038" target.version.series="fb2a64ab-e90e-42c2-83db-24a42b4ba0d3" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Public Service Act 2008</name></legref> may be used by the Speaker, during the period stated in <intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">subsection&#160;(4)</intref><intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">(a)</intref><intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">(ii)</intref>, to consider the applicant for appointment to a relevant office.</txt></block></subclause><subclause id="sec.18-ssec.2" guid="_5a16a102-b218-44a1-8824-77cea37af296" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A <defterm id="sec.18-def.relevantoffice" guid="_840bc601-f460-415c-aa98-e57d0eee43cc" type="definition">relevant office</defterm> is an office, in which there is a vacancy after the original vacancy, that has the same title, classification level and role description as the office the original vacancy is in.</txt></block></subclause><subclause id="sec.18-ssec.3" guid="_26dc135e-82ba-48df-8e6e-f5ea2b47eaec" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, the respective role descriptions of the office mentioned in <intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">subsection&#160;(1)</intref> and the relevant office may vary—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.3-para1.a" guid="_76ce855d-3792-46c3-a12e-7a274a2b6b9d" provision.type="other"><no>(a)</no><block><txt break.before="0">about the location of employment, if each advertisement by the Speaker for the original vacancy included a statement under <intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">subsection&#160;(4)</intref><intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">(b)</intref><intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">(i)</intref>; or</txt></block></li><li id="sec.18-ssec.3-para1.b" guid="_7590e281-e62f-464e-aaae-191e0a48dafb" provision.type="other"><no>(b)</no><block><txt break.before="0">about whether employment is on a part-time or full-time basis, if each advertisement by the Speaker for the original vacancy included a statement under <intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">subsection&#160;(4)</intref><intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">(b)</intref><intref refid="sch.3-para1.13" target.guid="_8ba18f12-68ca-4738-844f-2fa5862a2d73" check="valid">(ii)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.4" guid="_8ba4a82b-3630-439d-9490-943290d27388" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">When the original vacancy is advertised by id="sec.18-ssec.4-para1.b-para2.ii" guid="_9109e45d-b9f6-4681-8350-0ba21d7d6df5" provision.type="other"><no>(ii)</no><block><txt break.before="0">the role for a relevant office could, however, vary
