provision.type="other"><no>2</no><heading id="sec.2-he" guid="_eb27e514-2c06-44c2-977c-b92c7744bc4f">Forms</heading><subclause id="sec.2-ssec.1" guid="_3a85c629-ceb0-496d-993c-3a18bcb41ffe" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The forms set forth in the schedule, with such modifications as circumstances in a particular case require, are the forms to be used for the purposes of these rules and shall be used for the purposes for which they are respectively expressed to be applicable.</txt></block></subclause><subclause Tribunal</heading><subclause id="sec.3-ssec.1" guid="_fbc3b0c8-6fb5-40d3-9679-43dabcff5597" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For the purposes of the <legref jurisd="QLD" type="act" target.doc.id="act-1974-002" target.version.series="0aab24e4-fc60-480a-9073-af3aa709ed27" check="valid"><name emphasis="yes">Mental Health Act 1974</name></legref>, <legref jurisd="QLD" type="act" refid="sec.43A" target.doc.id="act-1974-002" target.version.series="0aab24e4-fc60-480a-9073-af3aa709ed27" check="invalid">section&#160;43A</legref>, a notice of appeal from a decision of the Mental Health Tribunal shall—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.a" guid="_ba3237cc-156d-451f-98b5-479e7b3d80c6" provision.type="other"><no>(a)</no><block><txt break.before="0">be in form 1 of the schedule; and</txt></block></li><li id="sec.3-ssec.1-para1.b" guid="_6cfabe1d-f425-45ac-a9e0-a9476758e297" provision.type="other"><no>(b)</no><block><txt break.before="0">set forth accurately and completely the required particulars and grounds of appeal; and</txt></block></li><li id="sec.3-ssec.1-para1.c" guid="_2bc7a167-4248-4495-b7e8-0edb1d35d46c" provision.type="other"><no>(c)</no><block><txt break.before="0">be signed by the appellant, the appellant’s solicitor or another person authorised to act on the appellant’s behalf.</txt></block></li></list></block></subclause><subclause id="sec.3-ssec.2" guid="_0fa3e2f8-9843-4e92-af3a-cd9d8627c988" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The appellant, upon filing the notice of appeal, shall serve on the secretary to the Mental Health Tribunal a copy thereof.</txt></block></subclause></clause><clause id="sec.4" guid="_fd72ebb8-257c-47bf-acf0-fd079ebae846" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_5440c4e0-945d-45bc-9fdf-6077e847f4ff">Hearing of appeal</heading><block><txt break.before="1">An appeal instituted under <intref refid="sec.3" target.guid="_6cd10f85-394c-436f-87b8-a3c01a388cbd" check="valid">section&#160;3</intref> shall be set down for hearing in accordance with order 9 rule 3 of the Criminal Practice Rules 1900.</txt></block></clause><clause id="sec.5" guid="_e546759e-e9bd-4498-b92c-e743c205397d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_1975cf7b-59ab-4c5f-9a53-3e00d3c75977">Secretary to tribunal to furnish material</heading><block><txt break.before="1">Upon receipt by the secretary of a copy of the notice of appeal filed in accordance with <intref refid="sec.3" check="valid" target.guid="_6cd10f85-394c-436f-87b8-a3c01a388cbd">section&#160;3</intref> the secretary to the Mental Health Tribunal shall furnish to the registrar of the Court of Appeal—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.a" guid="_63b467f5-02c4-4e4c-a786-a9ea9bf91d59" provision.type="other"><no>(a)</no><block><txt break.before="0">originals of documents or writings containing evidence given and notes taken and exhibits produced at the proceedings before the tribunal out of which the appeal arose and the decision of the tribunal in those proceedings;</txt></block></li><li id="sec.5-para1.b" guid="_e5bc8915-9e30-4743-ade7-52cf972b89d8" provision.type="other"><no>(b)</no><block><txt break.before="0">sufficient true copies of the material specified in <intref refid="sec.5-para1.a" check="valid" target.guid="_63b467f5-02c4-4e4c-a786-a9ea9bf91d59">paragraph&#160;(a)</intref> certified as such by the secretary to the tribunal;</txt></block></li><li id="sec.5-para1.c" guid="_11562e12-53df-4a8c-897e-847b27b5b324" provision.type="other"><no>(c)</no><block><txt break.before="0">such other documents or writings relevant to the appeal in the possession or under the control of the tribunal as are required (generally or in a particular case) by the registrar and notified by the registrar to the secretary to the tribunal.</txt></block></li></list></block></clause><clause id="sec.6" guid="_9cc97d9e-9f39-473a-abdc-1268dfe537b8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_90b8692f-9d07-4f1b-92ab-77fee7fdf998">Abandonment of appeal</heading><subclause id="sec.6-ssec.1" guid="_29f81310-fe62-4103-b49b-dc5efbf9037a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person appealing against a decision of the Mental Health Tribunal may at any time after the appellant has duly filed the notice of appeal in accordance with <intref refid="sec.3" target.guid="_6cd10f85-394c-436f-87b8-a3c01a388cbd" check="valid">section&#160;3</intref> abandon his or her appeal by giving to the registrar of the Court of Appeal notice of abandonment thereof in form 3 of the schedule and serving a copy of the notice on the secretary to the Mental Health Tribunal.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_bddfd65b-8fe4-4623-af4a-d112887a1d85" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Thereupon it shall be deemed that the appeal has been dismissed by the Court of Appeal.</txt></block></subclause></clause><clause id="sec.7" guid="_eaf8a626-d987-446b-a3ab-ca0605d366e1" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_3cc9ce73-daaf-4e50-96df-816ea687435f">Witnesses</heading><block><txt break.before="1">An order for the attendance of a witness before it in an appeal against a decision of the Mental Health Tribunal may be made by the Court of Appeal on form 2 of the schedule on the application at any time of a person who is a party to such appeal or by the person’s solicitor or a person authorised by the person to act on his or her behalf.</txt></block></clause><clause id="sec.8" guid="_0c703bdf-f857-4bc1-8e06-572fa30b8cb8" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_5304632b-01c3-4ecc-81af-4346d74a3d42">Notification of result of appeal</heading><block><txt break.before="1">Upon the final determination of an appeal to which these rules relate, the registrar of the Court of Appeal shall give notification of the determination in form 4 of the schedule to the appellant or the appellant’s solicitor or other person authorised to act on the appellant’s behalf and to the director of psychiatric services.</txt></block></clause><clause id="sec.9" guid="_616c9cd4-a1fe-478c-87aa-e4e045281e5e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_7e276fc6-2d87-441a-9d5d-ece9ab50257e">Application of Criminal Practice Rules</heading><block><txt break.before="1">Where these rules do not provide or do not sufficiently provide in respect of a matter or in relation to the circumstances of a particular case, such of the rules set forth in the Criminal Practice Rules 1900 as may reasonably be applied in respect of that matter or those circumstances shall with all necessary adaptations apply and extend to an appeal to which these rules relate.</txt></block></clause></body></wrapper><schedules affected.by.uncommenced="0" numbering.style="manual"><schedule id="sch" guid="_19a4fd01-e04b-40a2-860d-e7a2f8b1829f"
