break.before="1">In this regulation, if the context permits, a reference to a cadastral survey includes a reference to a survey commonly called an identification survey in the surveying guid="_2bbc3058-97a5-4c1e-b2c5-43fbc5ee96b8">Principles to be applied in carrying out surveys</heading><division id="pt.2-div.1" guid="_2d6bbac6-0d77-4565-bf7d-3e06fb4b9bde" affected.by.uncommenced="0"><no>Division 1</no><heading id="pt.2-div.1-he" guid="_145e2680-e175-4968-b0ea-d23aa0ec3063">All surveys</heading><clause id="sec.5" guid="_c964a1cf-c83c-4d7d-ac57-fde897df6484" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_86fb52b9-ecdb-4526-8481-98bd4618d36f">Importance of State survey and mapping infrastructure</heading><block><txt break.before="1">The State survey and mapping infrastructure is of value to the community because it contributes to the State’s economic, environmental and social development.</txt></block></clause><clause id="sec.6" guid="_26623878-0d3f-4caf-a2ff-8ba712c68cd5" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_e770a474-a7f3-40d8-8a17-780a9acdd41d">How survey contributes to State survey and mapping infrastructure</heading><block><txt break.before="1">A survey contributes to the State survey and mapping infrastructure by, for example, ensuring each of the following for the survey—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-para1.a" guid="_0383b9d5-a549-47cc-933a-4c214a7851cc" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">survey observations achieve an acceptable level of survey quality;</txt></block></li><li id="sec.6-para1.b" guid="_48a99f6f-3220-48bc-90e0-57b08d854c6c" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">survey marks placed, or survey marks used as reference points for the survey, provide permanent physical evidence of the survey;</txt></block></li><li id="sec.6-para1.c" guid="_06b3e2aa-bf25-4741-9ff5-f4a6f48fc197" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the physical integrity of the survey marks used are appropriate for the survey’s intended purpose;</txt></block></li><li id="sec.6-para1.d" guid="_f995abb8-aa10-440f-84cf-e9e3fc920b54" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">survey observations made and survey marks placed comply with the relevant survey standard;</txt></block></li><li id="sec.6-para1.e" guid="_6a6d42f7-cc64-44a6-9a65-04c0414cc378" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">survey records for the survey include a clear description of the survey marks placed;</txt></block></li><li id="sec.6-para1.f" guid="_a0eb699e-8476-4c40-9951-9f7979b2c20c" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">if a survey mark from another survey has been incorrectly placed or disturbed, details of the mark are recorded in an appropriate document;</txt><note id="sec.6-para1.f-note" guid="_07ecef33-2d95-4c6c-9aaf-aa388ca70f01" type="example"><heading id="sec.6-para1.f-note-he" guid="_1edacdd4-fc53-471e-8744-0b91882f922f">Examples of an appropriate document—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.6-para1.f-note-para2" guid="_e08f0475-dd30-4312-a4fd-e13f41e56d9c" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">a State dataset</txt></block></li><li id="sec.6-para1.f-note-para2-oc.2" guid="_84fc5ef7-5262-4454-a984-41beaca45f84" provision.type="other" break.before="0">the surveyor for the survey accepts responsibility for the survey quality of the survey.</txt></block></li></list></block></clause><clause id="sec.7" survey is of value for survey and mapping infrastructure purpose</heading><subclause id="sec.7-ssec.1" guid="_f4ad9e4a-d067-4a31-a33c-8870bd340e4a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A survey is of value for a survey and mapping infrastructure purpose if, for example, the survey—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_be19ac20-884d-452f-b2ba-d861c62c2709" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">produces information in a form that can be recorded in a State dataset; or</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_0e234438-c137-46a5-b83c-a4de9b28cd73" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">places permanent survey marks; or</txt></block></li><li id="sec.7-ssec.1-para1.c" guid="_740afcf0-b386-4abb-b23f-8e32f165a9e7" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">makes measurements between permanent survey marks; or</txt></block></li><li id="sec.7-ssec.1-para1.d" guid="_86e9160f-2646-45f4-8e36-920154e556f8" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">makes measurements that establish the relationship between the geodetic reference framework and a subsidiary framework.</txt><note id="sec.7-ssec.1-para1.d-note" guid="_cf0b85e6-5d03-4add-a3e7-8f4d636a2367" type="example"><heading id="sec.7-ssec.1-para1.d-note-he" guid="_cfd6ed60-1dd4-4ea6-9c0f-1a48f560e47a">Example of a subsidiary framework—</heading><block><txt break.before="1">cadastral boundary provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a surveyor in deciding, under <legref refid="sec.55" target.doc.id="act-2003-071" target.version.series="4dd89572-99e7-4bc2-97d8-4565681c9a58" target.guid="_2650237c-26c1-48ab-afa6-41f679baf98e" check="valid" jurisd="QLD" type="act">section&#160;55</legref><legref refid="sec.55-ssec.1" target.doc.id="act-2003-071" target.version.series="4dd89572-99e7-4bc2-97d8-4565681c9a58" target.guid="_9ca4523d-a0ce-4aad-b21f-9feb2de16507" check="valid" jurisd="QLD" id="sec.8-ssec.1" guid="_a755fa6c-a390-45bf-8971-376eda8ef666" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A survey must be carried out in a way that achieves the survey’s intended purpose.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_b11a4055-9a6f-4ee3-b418-0e68731ab221" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The survey’s intended purpose may be achieved by, for example—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.2-para1.a" guid="_68994ad5-b642-4cb3-9628-14381c6853e9" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">depicting on the plan of survey the spatial location, and the extent of, the features surveyed; and</txt></block></li><li id="sec.8-ssec.2-para1.b" guid="_5f43b874-52a2-492f-bec1-45347cdb74fb" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">establishing appropriate survey marks for the survey by, for example—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.2-para1.b-para2.i" guid="_2af6daa6-8c42-46f7-9dbf-88e0a7a8cdb2" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">placing survey marks that comply with the relevant survey standard; or</txt></block></li><li id="sec.8-ssec.2-para1.b-para2.ii" guid="_2f1a89d5-570a-4039-9dfe-e52e6a53d583" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">using existing survey marks as reference points; and</txt></block></li></list></block></li><li id="sec.8-ssec.2-para1.c" guid="_bc47b890-f40e-424b-96a5-ab66bf0341df" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">achieving a level of survey quality appropriate for the survey’s intended purpose; and</txt></block></li><li id="sec.8-ssec.2-para1.d" guid="_f6ecc5c5-948f-40cf-9b0a-a3c75f5ec302" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">identifying, describing and depicting, as appropriate, natural features that are tidal boundaries or non-tidal boundaries of guid="_218eaba6-ddba-4d21-9b77-f44eab0f33e8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A survey must be capable of being integrated with other surveys.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_dfe1de72-0afd-442b-84ca-5411b156e70e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The integration may be achieved by, for example, ensuring appropriate connections are made between the survey and the following when carrying out the survey—</txt><list following for the survey—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-para1.a" guid="_e87734f0-7179-4643-9140-49098c1add1f" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">survey observations achieve an acceptable level of survey quality;</txt></block></li><li id="sec.11-para1.b" guid="_ec94c377-c31d-426a-a4f5-20cd606df79f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">survey marks placed, or survey marks used as reference points for the survey, provide permanent physical evidence of the survey;</txt></block></li><li id="sec.11-para1.c" guid="_37e49465-3705-4993-b78d-4aa2cfbc797c" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the physical integrity of the survey marks used are appropriate for the survey’s intended purpose;</txt></block></li><li affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a State dataset; or</txt></block></li><li id="sec.11-para1.g-para2.ii" guid="_1e2368d8-d0a8-4083-8784-a3099cdb8fa0" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the land registry;</txt></block></li></list></block></li><li id="sec.11-para1.h" guid="_b0d4b991-f698-4e05-b040-2b103f0db17a" provision.type="other" affected.by.uncommenced="0"><no>(h)</no><block><txt break.before="0">the cadastral surveyor for the survey—</txt><list break.before="0">accepts responsibility for the survey quality of the survey; and</txt></block></li><li id="sec.11-para1.h-para2.ii" guid="_d72f291e-a604-4603-8cc6-ed6a2334c4f7" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">keeps the survey records for the survey in a form suitable as a record of the survey.</txt></block></li></list></block></li></list></block></clause><clause id="sec.12" guid="_613c0a8f-3202-4e4e-bd43-2dc07462186a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_7df51665-ff8a-4fa0-aafc-0b2e36bdeb7b">Boundary locations</heading><subclause id="sec.12-ssec.1" guid="_9799c03f-dbe4-43b7-aeae-78cf97425733" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The plan of survey for a cadastral survey must, for a parcel of land surveyed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.a" guid="_9ca09a17-54af-437b-ae46-7c5078109a87" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">describe and show the location of each existing boundary of the land; and</txt></block></li><li id="sec.12-ssec.1-para1.b" guid="_cec03108-0b22-42c9-8549-a9730f37aadc" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the survey is carried out for registering an interest in the land—describe and show each boundary of the land the subject of the interest.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.2" guid="_d33bee71-c170-414e-99fc-88fc4d54d81f" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A boundary of land is shown on the plan by recording—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a" guid="_c6f2d872-0e49-4367-9ae2-0a8812d483a9" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">all of the following things used as reference points for the survey—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a-para2.i" guid="_e55be55e-4c81-449e-a71c-6bd75318a921" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">permanent improvements on the land;</txt></block></li><li id="sec.12-ssec.2-para1.a-para2.ii" guid="_58b8f112-436d-4041-a6f3-7fb358ebe7ac" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">existing survey marks;</txt></block></li><li id="sec.12-ssec.2-para1.a-para2.iii" guid="_6ea73475-fe29-47f5-9680-83d95d9c7cf7" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">survey marks placed in carrying out the survey; and</txt></block></li></list></block></li><li id="sec.12-ssec.2-para1.b" guid="_7e11516b-0d58-44c0-a980-ba6834fe808a" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the length and direction of the boundary.</txt></block></li></list></block></subclause><subclause id="sec.12-ssec.3" guid="_33e31b8c-7d02-4a32-9739-fbe4f4aafe97" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A boundary of land must be marked on the land in a way that a person on the land can identify the boundary.</txt></block></subclause><subclause id="sec.12-ssec.4" guid="_246b6b0a-2b38-4614-b8f4-406b28a96b6b" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">However, <intref refid="sec.12-ssec.3" target.guid="_33e31b8c-7d02-4a32-9739-fbe4f4aafe97" check="valid">subsection&#160;(3)</intref> does not apply if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.4-para1.a" guid="_4f37a4ee-e998-4257-b335-f4b4f71efc09" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the client of the surveyor marking the boundary gives the surveyor written notice that the client does not require the boundary to be marked as required by <intref refid="sec.12-ssec.3" target.guid="_33e31b8c-7d02-4a32-9739-fbe4f4aafe97" check="valid">subsection&#160;(3)</intref>; and</txt></block></li><li id="sec.12-ssec.4-para1.b" guid="_12559574-8bbf-4121-a8f5-7dac03fa430f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the surveyor complies with the relevant survey standard when marking the boundary of land; and</txt></block></li><li id="sec.12-ssec.4-para1.c" guid="_2a490218-ab15-41d8-b50c-70d9278330a2" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the reference points used for the survey include a recognised permanent survey mark.</txt></block></li></list></block></subclause></clause><clause id="sec.13" guid="_8189c612-ea5b-475f-811d-6485378bb0dc" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_2d0d33ab-ae30-40e0-8eb9-5f33db9996cb">Taking account of parties’ rights and obligations</heading><subclause id="sec.13-ssec.1" guid="_0179c3f8-2abd-4f9c-a27a-911acf1bf540" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A cadastral surveyor carrying out a cadastral survey must, in identifying or marking a boundary of land, take account of the rights and obligations of each party affected by the boundary.</txt><note id="sec.13-ssec.1-note" guid="_6948dd93-80e0-4b34-aeef-bc2fd3dbeb7c" type="example"><heading id="sec.13-ssec.1-note-he" guid="_847e5dd0-a187-4804-9c63-cdc2bf656139">Examples of a party affected by the boundary—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.1-note-para1" guid="_54c46c0d-7b3b-4feb-a441-cdc0eeb83062" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">an owner of land sharing the boundary</txt></block></li><li id="sec.13-ssec.1-note-para1-oc.2" guid="_1b662a28-76ab-4c5d-a507-010b73700ad4" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">an owner of land near the boundary if the owner’s understanding of the position of the boundaries of the owner’s land may change as a result of reinstating the boundary</txt></block></li><li id="sec.13-ssec.1-note-para1-oc.3" guid="_1d8803ea-767f-42cf-9e58-95ba7670aac6" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">an owner of land benefited by an easement if the owner’s understanding of the position of the boundaries of the easement may change as a result of reinstating the boundary</txt></block></li></list></block></note></block></subclause><subclause id="sec.13-ssec.2" guid="_6ce58a60-5da3-4497-b0f3-e72be49224c8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The affected parties rights and obligations may be taken account of by, for example, ensuring each of the following for the cadastral survey—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.a" guid="_b4462d60-1c0b-40b9-9043-eb4cd53d22a8" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">cadastral boundaries are reinstated in accordance with the hierarchy of reinstatement evidence;</txt></block></li><li id="sec.13-ssec.2-para1.b" guid="_b07e0ff7-56c9-479b-9422-4e1b741f4c66" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">cadastral boundaries are defined by abuttals with no gaps between, or overlaps of, the boundaries;</txt></block></li><li id="sec.13-ssec.2-para1.c" guid="_67c1df33-b1c7-4528-ab35-67deec39f361" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">any natural feature forming a boundary of land is clearly described on the plan of survey for the cadastral survey and the feature’s position is shown on the plan; </txt></block></li><li id="sec.13-ssec.2-para1.d" guid="_e085588f-e6f8-470b-af52-e71e9d65faa0" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">if there is an apparent irregularity in information recorded for an existing survey mark, the irregularity is recorded in—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.13-ssec.2-para1.d-para2.i" guid="_0c9cfda6-3b2b-4246-9633-7c3d39f59754" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a State dataset; or</txt></block></li><li id="sec.13-ssec.2-para1.d-para2.ii" guid="_59316ffb-5fc2-427c-be56-c3d82616d621" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the land registry;</txt></block></li></list><note guid="_d4881bcc-5465-44c4-b31b-e9ae1bd8e84e">Preparing plans without carrying out cadastral survey</heading><subclause id="sec.18-ssec.1" guid="_e17e1ca6-e149-49ed-9372-fe4d7029e755" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A cadastral surveyor may prepare a plan of survey for a cadastral survey without carrying out the survey if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.1-para1.a" guid="_ad94fa01-9f15-45d2-afca-4d6fdca1ce9c" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the plan is prepared from information sourced from an existing survey, whether or not made for cadastral purposes; and</txt></block></li><li id="sec.18-ssec.1-para1.b" guid="_df5bcda4-453d-417c-a2ad-bed33c1a6f95" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the area and dimensions of the land are sufficiently accurate for the plan’s intended purpose.</txt><note id="sec.18-ssec.1-para1.b-note" guid="_7929356c-713a-4ca3-838a-6ffa850c08cf" type="example"><heading id="sec.18-ssec.1-para1.b-note-he" guid="_c711dd8a-8d51-4a77-b8f1-8ec52c79a417">Example of intended purpose—</heading><block><txt break.before="1">to register an interest in land</txt></block></note></block></li></list></block></subclause><subclause id="sec.18-ssec.2" guid="_355a87f9-84da-4fa8-89d7-6e78070dca79" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If a cadastral surveyor prepares a plan under <intref refid="sec.18-ssec.1" target.guid="_e17e1ca6-e149-49ed-9372-fe4d7029e755" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the plan must be in the approved form and signed by the surveyor; and</txt></block></li><li id="sec.18-ssec.2-para1.b" guid="_221b57b0-49ef-4312-8703-4bfcae5545bd" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the surveyor must certify that the plan was prepared in affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a cadastral surveyor carries out, or is responsible for carrying out, a cadastral of the position of the existing boundary on the land is identified by locating the positions, and finding the descriptions, of existing survey marks and permanent improvements on the land that have a watercourse is typically located in the most elevated parts of the watercourse catchment, often near the catchment’s watershed. The valley floor is typically quite narrow, characterised by gorges and in some places is only as wide as the watercourse itself. The valley floor is typically quite steep, characterised by waterfalls and cascades. The general direction and location of the reach is dictated by the valley margins that appear as significant geomorphic features.</txt></block><block><txt break.before="1">The watercourse is typically narrow and deep with a V-shaped profile carved into the bedrock. The location of the watercourse within the narrow valley floor is generally dictated by the valley margins. The flow in the watercourse has high velocity and high energy, resulting in high erosive power. High flow events are confined within the watercourse by the adjoining valley margins. Past flow levels are often evidenced by scour marks on the valley margin or the deposition of lighter material, including, for example, sands and twigs, carried by the flow. The bed and banks of the watercourse typically consist of bedrock and very coarse material, including boulders, cobbles and gravel. The movement and deposition of material happens primarily in periods of high flow. Flow tends to respond directly to rainfall events and during dry periods there is little or no base flow. Vegetation within or along the watercourse is often sparse or immature due to the regular scouring caused by high flow energy or by the absence of deep soil profiles.</txt></block><block><txt break.before="1">Where the watercourse is wider, it could have a narrow bench adjacent to one bank or the other. These benches are typically made of finer materials, commonly cobbles and gravel. These benches tend to be short in length and disconnected, and alternate from one side of the watercourse to the other as the flow rebounds from one valley margin to the other. The middle valley reach is at a higher elevation than the lower valley reach but is not as high as the upper valley reach. The valley floor is typically of moderate width, and is characterised by narrow floodplains between valley margins of fringing hills, terraces and low ridges. The valley floor has a moderate grade, characterised by a meandering watercourse and occasional cascades. The valley floor is typically comprised of ancient sediments deposited by the watercourse in earlier geological periods, and can be interrupted by occasional bedrock ridges or bars that are exposed in the watercourse.</txt></block><block><txt break.before="1">The watercourse carries flow from several tributaries and so is typically deeper and wider than in the upper valley reach. The location of the watercourse within the valley floor is generally dictated by its meander pattern and is occasionally bounded by the valley margin. The flow in the watercourse has less energy and is not as fast as in the upper valley reach. However, it has enough energy to transport sediment eroded in the upper valley reach down to the lower valley reach. Much of the sediment being transported is temporarily stored in the watercourse (typically as in-stream benches and islands) or on adjacent floodplains before being further eroded and transported downstream in subsequent high flow events.</txt></block><block><txt break.before="1">A number of benches are typical in the watercourse, created by the mixture of flow size and frequency. The lower, narrower channel of the watercourse is shaped by the more frequent, smaller flows and the wider, deeper channel of the watercourse is shaped by less frequent large flows. High flow events commonly erupt from the watercourse onto the adjacent floodplain. The bed and banks of the watercourse typically consist of medium sized material, such as cobbles, gravel and sand. Subject always to long-term weather cycles, almost perennial base flows occur because of the slow drainage of upper sections of the middle valley reach and groundwater inflows from alluvial floodplain aquifers along the watercourse. The valley floor is quite broad, characterised by extensive floodplains between distant valley margins of fringing hills and low ridges. The valley floor has a low gradient, characterised by a strongly meandering watercourse with ox-bows and occasional anabranches. The valley floor is typically comprised of ancient sediments deposited by the watercourse in earlier geological periods.</txt></block><block><txt break.before="1">The watercourse gradient is quite low, resulting in slow moving flow. However, the watercourse is now carrying water from all upstream reaches and so dissipates this kinetic energy by meandering across the valley floor, eroding and depositing sediment along the way. This results in a comparatively wide, shallow channel, often with large sediment accumulations such as in-stream benches and islands. Sediment that makes up the channel of the watercourse and adjoining floodplains tends to be fine, commonly gravel, sand and silt, with low resistance to erosion. Large flows result in floods that spread across the floodplains, depositing fine sediment. Perennial base flows occur because of the slow drainage of upper sections of the lower valley reach and groundwater inflows from alluvial floodplain aquifers along the watercourse. affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">used in the reinstatement of cadastral boundaries.</txt></block></li></list></definition><definition type="act">section&#160;16</legref> of the <legref target.doc.id="act-2003-071" target.version.series="4dd89572-99e7-4bc2-97d8-4565681c9a58" check="valid" jurisd="QLD" type="act">Act</legref>—the chief executive; or</txt></block></li><li id="sch.2-def.relevantperson-para1.b" guid="_122ee073-6fd2-4c43-9589-7036cc554142" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for a plan of survey for a cadastral survey, a copy of which is to be registered, lodged for registration, or deposited, in the land registry under a registration Act—the registering entity for the plan of survey.</txt></block></li></list></definition><definition id="sch.2-def.registeringentity_" guid="_f256eee2-2bdc-441d-98ef-bdae713d6d9c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.2-def.registeringentity" guid="_f3a57449-e989-438c-aa80-9e0aba12ba1d" type="definition">registering entity</defterm>, for a plan of survey, means the person responsible for registering the plan under a registration Act.</txt></definition><definition id="sch.2-def.registrationAct_" guid="_aaaac89a-c4b8-4496-8fa7-1386dc0de0e6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.2-def.registrationAct" guid="_7d114a59-f1af-426d-b33f-5546e32b4ed0" type="definition">registration Act</defterm> means the <legref target.doc.id="act-1994-081" target.version.series="65816ffc-330d-4ddd-87b5-e82241fc305f" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Act 1994</name></legref> or the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref>.</txt></definition><definition id="sch.2-def.surveyrecords_" guid="_29d7a676-2c25-4df7-b1b1-7eae3b6ff71b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.2-def.surveyrecords" guid="_3d8746d5-29b6-42c2-9689-3d7a1a725117" type="definition">survey records</defterm>, for a survey, means the documents necessary to adequately record every aspect of affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a measurement or an analysis made for, or in relation to, the survey;</txt></block></li><li id="sch.2-def.surveyrecords-para1.b" guid="_a4bf46aa-a089-4b5c-8e47-993d0f5ab9ff" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">information about—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.2-def.surveyrecords-para1.b-para2.i" guid="_f7f48d8e-a4d0-4046-8a40-3f7831847352" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">survey marks placed in carrying out the survey; or</txt></block></li><li id="sch.2-def.surveyrecords-para1.b-para2.ii" guid="_078c60c3-468b-4c2b-86e7-966fe546b205" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">survey marks used as reference points in carrying out the survey;</txt></block></li></list></block></li><li id="sch.2-def.surveyrecords-para1.c" guid="_5931e5ca-2fbb-410f-916c-cbc86842781e" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the plan of survey;</txt></block></li><li id="sch.2-def.surveyrecords-para1.d" guid="_1bbe8aea-b328-41a9-87bd-7b598e1f2402" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">any document supplied for demonstrating consistency with the public interest under <legref refid="pt.7" target.doc.id="act-2003-071" target.version.series="4dd89572-99e7-4bc2-97d8-4565681c9a58" target.guid="_c4bd0800-94b8-4cca-80ef-1083a3270a69" check="valid" jurisd="QLD" type="act">part&#160;7</legref> of the <legref target.doc.id="act-2003-071" target.version.series="4dd89572-99e7-4bc2-97d8-4565681c9a58" check="valid" jurisd="QLD"
