id="sec.5-he" guid="_4eb8accc-540d-4c32-8aee-97d2ee60b2a8">Main objects of Act</heading><block><txt break.before="1">The main objects of this Act are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.a" guid="_047b004f-1718-4128-9f45-61fdabc6e49e" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">to regulate particular matters in relation to surrogacy arrangements, including by prohibiting commercial surrogacy arrangements and providing, in particular circumstances, for the court-sanctioned transfer of parentage of a child born as a result of a surrogacy arrangement; and</txt></block></li><li id="sec.5-para1.b" guid="_cbb87e8a-3072-4d58-81c4-6884be54e5d5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">in the context of a surrogacy arrangement that may result in the court-sanctioned transfer of parentage of a child born as a result—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-para1.b-para2.i" guid="_072d520c-cf66-4590-b894-93f408208b77" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">to establish procedures to ensure parties to the arrangement understand its nature and implications; and</txt></block></li><li id="sec.5-para1.b-para2.ii" guid="_fe285fd3-52d3-4022-a582-3e65493b5080" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">to safeguard the child’s wellbeing and best interests.</txt></block></li></list></block></li></list></block></clause><clause id="sec.6" guid="_28830f02-bfe3-48b8-9113-422b75702d14" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_72af041a-0604-43ab-9e60-9f3c40dc6bec">Guiding principles</heading><subclause id="sec.6-ssec.1" guid="_828bf259-2d14-474a-a02e-f94da1e4e8a7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act is to be administered according to the principle that the wellbeing and best interests of a child born as a result of a surrogacy arrangement, both through childhood and for the rest of his or her life, are paramount.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_e8e7bae6-c412-417d-916f-694da3de9ce0" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subject to <intref refid="sec.6-ssec.1" target.guid="_828bf259-2d14-474a-a02e-f94da1e4e8a7" check="valid">subsection&#160;(1)</intref>, this Act is to be administered according to the following principles—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a" guid="_fc8f2396-8878-4922-a992-4f77ad463ae5" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a child born as a result of a surrogacy arrangement should be cared for in a way that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a-para2.i" guid="_9c78fb1c-aa17-464c-8b23-2c219ffb3e5e" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">ensures a safe, stable and nurturing family and home life; and</txt></block></li><li id="sec.6-ssec.2-para1.a-para2.ii" guid="_39d84f4c-610a-4d69-b004-ac7b0872fa17" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">promotes openness and honesty about the child’s birth parentage; and</txt></block></li><li id="sec.6-ssec.2-para1.a-para2.iii" guid="_e57a0e47-f666-4872-96b5-8ba0877b2b2b" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">promotes the development of the child’s emotional, mental, physical and social wellbeing;</txt></block></li></list></block></li><li id="sec.6-ssec.2-para1.b" guid="_c6151cfe-ae30-4e21-ab40-6a0763a05900" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the same status, protection and support should be available to a child born as a result of a surrogacy arrangement regardless of—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.b-para2.i" guid="_bf605dd0-e0b9-4f59-9dd8-5daa6f3a532f" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">how the child was conceived under the arrangement; or</txt></block></li><li id="sec.6-ssec.2-para1.b-para2.ii" guid="_9336ff08-fbd6-4d6e-8837-90168ba90672" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">whether there is a genetic relationship between the child and any of the parties to the arrangement; or</txt></block></li><li id="sec.6-ssec.2-para1.b-para2.iii" guid="_73a81a51-3b40-4a8c-9639-45b338b6c8f7" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the relationship status of the persons who become the child’s parents as a result of a transfer of parentage;</txt></block></li></list></block></li><li id="sec.6-ssec.2-para1.c" guid="_5fd71716-1813-4b59-8e3a-0eb06332ecc9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the long-term health and wellbeing of parties to a surrogacy arrangement and their families should be promoted;</txt></block></li><li id="sec.6-ssec.2-para1.d" guid="_faed2c10-b4cf-4802-bf7a-2fdbcf861577" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the autonomy of consenting adults in their private lives should be respected.</txt></block></li></list></block></subclause></clause></part><part id="ch.1-pt.3" guid="_3cb9b8cd-629b-433e-ba9a-30affad0a11c" affected.by.uncommenced="0"><no>Part 3</no><heading id="ch.1-pt.3-he" guid="_f54e5119-301f-400d-acbf-8d3a5eca864f">Key concepts</heading><clause id="sec.7" guid="_2353aff2-3225-42fc-b0b0-a25786877492" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_8acc1fa8-dee0-4d88-85f7-183a3fa875cb">Meaning of <defterm guid="_f13996a3-26b7-4e5b-9cb2-ed5edb3964ce" type="mention">surrogacy arrangement</defterm></heading><subclause id="sec.7-ssec.1" guid="_90c0d804-b831-444b-ab9c-fa3a146ed014" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A <defterm id="sec.7-def.surrogacyarrangement-oc.2" guid="_cae5f5ac-31a1-45fe-ac78-da17caa2b5ac" type="definition">surrogacy arrangement</defterm> means an arrangement, agreement or understanding between a woman and another person or persons under which—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_438df1a1-95ab-4e53-a19f-4a5c866fec40" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the woman agrees to become, or try to become, pregnant with the intention that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a-para2.i" guid="_cde67124-49b9-4aaf-b1fe-770ea7f5be7a" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a child born as a result of the pregnancy is to be treated as the child, not of the woman, but of the other person or persons; and</txt></block></li><li id="sec.7-ssec.1-para1.a-para2.ii" guid="_50238b19-6828-4bda-a18a-a087ed09332a" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the woman will relinquish to the other person or persons custody and guardianship of a child born as a result of the pregnancy; and</txt></block></li></list></block></li><li id="sec.7-ssec.1-para1.b" guid="_f3e3c08d-ee47-479a-91a5-7e24635a72fb" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the other person or persons agree to become permanently responsible for the custody and guardianship of a child born as a result of the pregnancy.</txt></block></li></list><note id="sec.7-ssec.1-note" guid="_487980b5-a52c-40c4-a5db-c26f92eea0ed" type="example"><heading id="sec.7-ssec.1-note-he" guid="_37152118-f94e-4fd1-9ee7-b7a36a0a5577">Note—</heading><block><txt break.before="1"><intref refid="sec.7" target.guid="_2353aff2-3225-42fc-b0b0-a25786877492" check="valid">Section&#160;7</intref><intref refid="sec.7-ssec.1" target.guid="_90c0d804-b831-444b-ab9c-fa3a146ed014" check="valid">(1)</intref> sets out only the minimum requirements for a surrogacy arrangement. There are many additional requirements which must be satisfied to obtain a parentage order under <intref refid="ch.3" target.guid="_de295122-3a68-4348-8a80-071c2f9dfa2d" check="valid">chapter&#160;3</intref>. For example, independent legal advice must be obtained before entering into a surrogacy arrangement if transfer of parentage of the child born as a result of the arrangement is desired—see <intref refid="sec.22" target.guid="_a78fbefe-11aa-4d6b-8e0c-4384e9330852" check="valid">section&#160;22</intref><intref refid="sec.22-ssec.2" target.guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" check="valid">(2)</intref><intref refid="sec.22-ssec.2-para1.e" target.guid="_1ef34ccf-20ef-4ea4-84bd-c6ef7c33e9a7" check="valid">(e)</intref><intref refid="sec.22-ssec.2-para1.e-para2.i" target.guid="_6e9db0dc-e282-4550-96ee-896ddfa6090c" check="valid">(i)</intref>.</txt></block></note></block></subclause><subclause id="sec.7-ssec.2" guid="_c69c01bb-bdf2-4902-83d7-11acaabcc1cf" type="mention">couple</defterm></heading><subclause id="sec.9-ssec.1" guid="_2221f7ae-9841-4b41-8d5f-56a2b57a8699" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An <defterm id="sec.9-def.intendedparent-oc.2" guid="_5fb70b20-f432-40a7-8298-7d4e58e62213" type="definition">intended parent</defterm> is a person who agrees to the matter mentioned of <defterm guid="_ed0418dd-6f3a-4ca2-9830-85036bedcaf2" type="mention">commercial surrogacy arrangement</defterm></heading><block><txt break.before="1">A surrogacy arrangement is a <defterm id="def.commercialsurrogacyarrangement" guid="_ca7c510b-1254-4130-84c0-8f4e27f267d3" type="definition">commercial surrogacy arrangement </defterm>if a person receives a payment, reward or other material benefit or advantage (other than the reimbursement of the birth mother’s surrogacy costs) for the person or another person—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a" guid="_5f4ad970-f06b-494f-b4bb-e751a3138209" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">agreeing to enter into or entering into the surrogacy arrangement; or</txt></block></li><li id="sec.10-para1.b" guid="_cd0e7c76-aa56-42cd-88b3-eb372015a83b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">permanently relinquishing to 1 or more intended parents the custody and guardianship of a child born as a result of the surrogacy arrangement; or</txt></block></li><li id="sec.10-para1.c" guid="_8d2d7fc9-e49f-4845-bd8c-4cd3d6f2c6d0" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">consenting to the making of a parentage order for a child born as a result of the surrogacy arrangement.</txt></block></li></list></block></clause><clause id="sec.11" guid="_f9ec45d2-7882-4a4c-802d-c7d40660a983" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_a5c5869c-99a0-4362-ba36-13c49933f16c">Meaning of <defterm guid="_ab8b9abf-650b-48c9-8b26-db751750b091" type="mention">birth mother’s surrogacy costs</defterm></heading><subclause id="sec.11-ssec.1" guid="_97daac63-17e1-4623-88a6-9d9224a20af6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A <defterm id="sec.11-def.birthmotherssurrogacycosts-oc.2" guid="_be6a6063-2ddb-434d-929e-b2a50f5e2754" type="definition">birth mother’s surrogacy costs</defterm> are the birth mother’s reasonable costs associated with any of the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.1-para1.a" guid="_fb8ec80b-5ebf-408e-ae59-870263705547" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">becoming or trying to become pregnant;</txt></block></li><li id="sec.11-ssec.1-para1.b" guid="_1d36b537-4a1d-438a-ae29-fa7b62d4d051" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a pregnancy or a birth;</txt></block></li><li id="sec.11-ssec.1-para1.c" guid="_5c6c82b4-a231-486c-bd3f-9d9f5dee671f" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the birth mother and the birth mother’s spouse (if any) being a party to a surrogacy arrangement or proceedings in relation to a parentage order.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.2" guid="_f77acd38-148a-47ef-a52c-ba6ea1bb6206" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting <intref refid="sec.11-ssec.1" target.guid="_97daac63-17e1-4623-88a6-9d9224a20af6" check="valid">subsection&#160;(1)</intref>, the following amounts are a birth mother’s surrogacy costs—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.a" guid="_72da90eb-2eb3-48f5-bd98-3448f4bf3234" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a reasonable medical cost for the birth mother associated with any of the matters mentioned in <intref refid="sec.11-ssec.1" target.guid="_97daac63-17e1-4623-88a6-9d9224a20af6" check="valid">subsection&#160;(1)</intref>;</txt><note id="sec.11-ssec.2-para1.a-note" guid="_2ba07e4b-e584-4630-9133-5afc97326e39" type="example"><heading id="sec.11-ssec.2-para1.a-note-he" guid="_16f6cc68-8768-4d8e-a165-52b24a57db95">Example of a reasonable medical cost for <intref refid="sec.11-ssec.2-para1.a" target.guid="_72da90eb-2eb3-48f5-bd98-3448f4bf3234" check="valid">paragraph&#160;(a)</intref>—</heading><block><txt break.before="1">a cost incurred before conception if the birth mother consults a medical practitioner to find out if she is capable of carrying a pregnancy before undergoing a fertilisation procedure</txt></block></note></block></li><li id="sec.11-ssec.2-para1.b" guid="_c4e41b30-26a4-4787-85a7-edc518439451" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a reasonable cost, including a reasonable medical cost, for a child born as a result of the surrogacy arrangement;</txt></block></li><li id="sec.11-ssec.2-para1.c" guid="_2bf5157a-8821-4f23-afbe-281caad77ab3" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">a premium payable for health, disability or life insurance that would not have been obtained by the birth mother if the surrogacy arrangement had not been entered into;</txt></block></li><li id="sec.11-ssec.2-para1.d" guid="_2fc3e5e7-c8ed-4084-8f5d-4dc34c2c98a7" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">a reasonable cost of counselling associated with any of the matters mentioned in <intref refid="sec.11-ssec.1" target.guid="_97daac63-17e1-4623-88a6-9d9224a20af6" check="valid">subsection&#160;(1)</intref>, including—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.d-para2.i" guid="_3ddd62ff-e062-4b5a-9302-f42f1ccb6696" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the cost of counselling obtained by the birth mother or the birth mother’s spouse (if any) before or after entering into the surrogacy arrangement; or</txt></block></li><li id="sec.11-ssec.2-para1.d-para2.ii" guid="_ce47bfdc-6c4c-4e93-a207-864ded4d5797" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the cost relating to the preparation of a surrogacy guidance report under <intref refid="sec.32" target.guid="_f4b60fa5-b821-452b-bfde-0e7e2cafd9c4" check="valid">section&#160;32</intref>;</txt></block></li></list></block></li><li id="sec.11-ssec.2-para1.e" guid="_02fbb081-b6d8-463e-aa34-1944f7424477" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">a reasonable legal cost for the birth mother and the birth mother’s spouse (if any) relating to the surrogacy arrangement and the transfer of parentage;</txt></block></li><li id="sec.11-ssec.2-para1.f" guid="_8d3647ab-7558-48ae-b96f-9af09ac42c63" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">the value of the birth mother’s actual lost earnings because of leave taken—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.f-para2.i" guid="_8395cea0-2c81-40ff-bda3-d8dcabbc9b6b" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">for a period of not more than 2 months during which a birth happened or was expected to happen; or</txt></block></li><li id="sec.11-ssec.2-para1.f-para2.ii" guid="_ae2233c9-5e03-4665-8c1c-cc452e271621" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">for any other period during the pregnancy when the birth mother was unable to work on medical grounds;</txt></block></li></list></block></li><li id="sec.11-ssec.2-para1.g" guid="_129f0185-aa96-450a-8cfa-56200beaeffb" provision.type="other" affected.by.uncommenced="0"><no>(g)</no><block><txt break.before="0">another reasonable cost associated with the surrogacy arrangement or the making of the order transferring parentage.</txt><note id="sec.11-ssec.2-para1.g-note" guid="_896e5ca0-fae1-4596-818c-de04ae35303a" type="example"><heading id="sec.11-ssec.2-para1.g-note-he" guid="_184ec414-c0d2-4c54-9a0a-6b495e6ac153">Examples of other reasonable costs for <intref refid="sec.11-ssec.2-para1.g" target.guid="_129f0185-aa96-450a-8cfa-56200beaeffb" check="valid">paragraph&#160;(g)</intref>—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.2-para1.g-note-para2" guid="_713078f7-160e-40ce-ba86-cfd58dadd860" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">travel and accommodation costs for a birth mother who lives interstate and travels to Queensland to undertake a fertility treatment, to consult with an obstetrician or to give birth</txt></block></li><li id="sec.11-ssec.2-para1.g-note-para2-oc.2" guid="_f73f272c-65b8-40fc-8dc2-7373ffffbf46" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">travel and accommodation costs associated with a birth mother’s attendance at a court hearing about an application for a parentage order if the birth mother does not live near the court</txt></block></li></list></block></note></block></li></list></block></subclause><subclause id="sec.11-ssec.3" guid="_8bf0342f-4ebb-4e92-bcb9-bdb3a8cbe4cc" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.11-ssec.3-def.legalcost_" guid="_b38aa218-49ef-4222-b045-68864c07b1c3" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.3-def.legalcost" guid="_d74360fa-e195-4e7d-a444-d1a9096b7938" type="definition">legal cost</defterm> includes fees for obtaining legal advice and legal representation, court fees, and registry fees associated with registration of a birth and transfer of parentage.</txt></definition><definition id="sec.11-ssec.3-def.medicalcost_" guid="_770f5283-5183-4108-8561-e52548c31d87" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.11-ssec.3-def.medicalcost" guid="_a484564f-b86a-42dc-8fd6-8a9c8b3c027c" type="definition">medical cost</defterm> means a medical cost to the extent that it is not recoverable under Medicare or any health insurance or other number.type="manual" unnumbered.indent="0"><li id="sec.14-ssec.1-para1.a" guid="_4b9a776b-2160-41f0-89f0-af12c067704a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if there is 1 intended parent under the surrogacy arrangement—there is a medical or social need for the surrogacy arrangement if the intended parent is a man or an eligible woman; of which is attributable to the woman; or</txt></block></li><li id="sec.14-ssec.2-para1.b-para2.iii-para3.B" guid="_ce839976-cb71-4e74-923f-6a2b36240893" provision.type="other" affected.by.uncommenced="0"><no>(B)</no><block><txt break.before="0">a child who is unlikely to survive a pregnancy or birth; or</txt></block></li><li id="sec.14-ssec.2-para1.b-para2.iii-para3.C" guid="_c6d2ed77-7a06-4f86-8198-810fac7310e0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_81dc6b03-ffb6-448a-961d-41f30d229306">Enforcement</heading><subclause id="sec.15-ssec.1" guid="_04db4885-7746-4ece-8648-bb810de5bc4e" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A surrogacy arrangement is not enforceable.</txt></block></subclause><subclause id="sec.15-ssec.2" guid="_27b9b26a-d84c-4892-a02e-11f22ad0ab74" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, an obligation under a surrogacy arrangement to pay or reimburse the birth mother’s surrogacy costs is enforceable unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.2-para1.a" guid="_bed81d60-271a-4414-a2b8-94f00f00c976" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a child is born as a result of the surrogacy arrangement; and</txt></block></li><li id="sec.15-ssec.2-para1.b" guid="_925bccd7-5dfe-4713-9920-39313f76038f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the birth mother—</txt><list affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for a medical practitioner swearing an affidavit mentioned in <intref refid="sec.25" id="sec.19-def.consent_" guid="_8b61155a-3478-4f48-8fc0-7804b93ee35b" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.19-def.consent" guid="_18aee213-624a-4d4e-a52c-17562ba492b0" type="definition">consent</defterm> means consent freely and voluntarily given by a person with capacity, within the meaning of the <legref jurisd="QLD" type="act" target.doc.id="act-2000-008" target.version.series="2be00591-d24b-4d27-adb7-2d5071432589" check="valid"><name emphasis="yes">Guardianship and Administration Act 2000</name></legref>, to give the consent.</txt></definition><definition id="sec.19-def.independent_" guid="_9072ae24-0c09-4132-b737-b98eb4c2df68" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.19-def.independent" guid="_c09a05d7-27d8-4210-9ba7-3ddec8adad21" type="definition">independent</defterm>, for a counsellor in relation to an application for a parentage order in relation to a child, means the counsellor—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-def.independent-para1.a" guid="_ca47c006-edf3-43d1-87c7-c94b2ac42b43" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">did not give counselling about the surrogacy arrangement to the birth mother, the birth mother’s spouse (if any) or an intended parent; and</txt></block></li><li id="sec.19-def.independent-para1.b" guid="_beaf5862-9450-42a3-a6d7-33586f3ae704" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">is not, and has not been, directly connected with a medical practitioner who carried out a procedure that resulted in the birth of the child.</txt><note id="sec.19-def.independent-para1.b-note" guid="_ffdf9c98-6c3b-416f-87e9-f2fd7173860c" type="example"><heading id="sec.19-def.independent-para1.b-note-he" guid="_ec77253b-1a3c-4f00-b008-a69737ae8197">Example of direct connection—</heading><block><txt break.before="1">A counsellor is directly connected with a medical practitioner if the counsellor is engaged to give fertility counselling at the fertility clinic where the medical practitioner carried out a procedure that resulted in the birth of the child.</txt></block></note></block></li></list></definition></deflist></block></clause></part><part id="ch.3-pt.2" guid="_1b102550-d7e9-4ec7-8c07-08e58eab6cfb" affected.by.uncommenced="0"><no>Part 2</no><heading id="ch.3-pt.2-he" guid="_f8f2e757-c118-42c9-a3c4-dfce542b1f6c">Making a parentage order</heading><clause id="sec.20" guid="_79fc4223-ad28-4002-a5d1-64280e2db371" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.20-he" guid="_773fddec-f828-42b9-96e4-3fbe54395ccb">Purpose</heading><block><txt break.before="1">This part facilitates the transfer, in particular circumstances, of the parentage of a child born as a result of a surrogacy arrangement that satisfies particular requirements.</txt></block></clause><clause id="sec.21" guid="_5e38b01c-9e26-4292-b675-94fc6b4f392a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>21</no><heading id="sec.21-he" guid="_dea66a6d-a86e-49f2-820e-a2f01917226b">Application for a parentage order</heading><subclause id="sec.21-ssec.1" guid="_5acfb49f-fe4f-42b5-8283-f02a0cdc05b0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An application for a parentage order in relation to a child may be made—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.21-ssec.1-para1.a" guid="_94db30b1-3c21-447b-967a-f697d794ccde" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">not less than 28 days and not more than 6 months after the child’s birth; or</txt></block></li><li id="sec.21-ssec.1-para1.b" guid="_c59bdb11-0a2c-4d8e-9a58-6b7614d5acdf" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">at a later time with the court’s leave.</txt></block></li></list></block></subclause><subclause id="sec.21-ssec.2" guid="_fd8e60ee-52f6-4d4c-ad75-74cce30bca14" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The court may grant leave under <intref refid="sec.21-ssec.1" target.guid="_5acfb49f-fe4f-42b5-8283-f02a0cdc05b0" check="valid">subsection&#160;(1)</intref><intref refid="sec.21-ssec.1-para1.b" target.guid="_c59bdb11-0a2c-4d8e-9a58-6b7614d5acdf" check="valid">(b)</intref> only if it considers the making of the late application is justified because of exceptional circumstances and that it is for the wellbeing, and in the best interests, of the child to grant the leave.</txt></block></subclause><subclause id="sec.21-ssec.3" guid="_7c616b6c-db0b-46d0-89a8-35e429e57c45" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sec.21-ssec.4" target.guid="_fae4a134-fb19-4619-a2f2-28962b0eb49b" check="valid">Subsections&#160;(4)</intref> and <intref refid="sec.21-ssec.5" target.guid="_0a12bcf8-d61b-44af-8202-bf8baa80105a" check="valid">(5)</intref> apply if there are 2 intended parents under the surrogacy arrangement and the 2 intended parents were a couple when the surrogacy arrangement was made.</txt></block></subclause><subclause id="sec.21-ssec.4" guid="_fae4a134-fb19-4619-a2f2-28962b0eb49b" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The application for the parentage order may be made only by the 2 intended parents jointly.</txt></block></subclause><subclause id="sec.21-ssec.5" guid="_0a12bcf8-d61b-44af-8202-bf8baa80105a" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">However, if the 2 intended parents are no longer a couple or 1 of them has died, 1 of the intended parents may apply for a parentage order.</txt></block></subclause><subclause id="sec.21-ssec.6" guid="_34e9a7e6-f08a-4cc7-b281-2e3459d5bb51" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">If there is 1 intended parent under the surrogacy arrangement and the intended parent did not have a spouse when the surrogacy arrangement was made, the intended parent may apply for a parentage order.</txt></block></subclause><subclause id="sec.21-ssec.7" guid="_2a855efc-4107-4b6a-9323-8656b3284e60" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">To the extent practicable, the documents mentioned in <intref refid="sec.25" target.guid="_75fc8eff-b347-438c-89fd-e6fef6e7c686" check="valid">section&#160;25</intref> must be filed with the application.</txt></block></subclause></clause><clause id="sec.22" a parentage order</heading><subclause id="sec.22-ssec.1" guid="_9e507f5f-35aa-4e93-b732-7f6f2c29777b" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">On an application under this part, the court may make a parentage order for the transfer of parentage of a child to the applicant, or joint applicants.</txt></block></subclause><subclause id="sec.22-ssec.2" guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The court may make the parentage order only if it is satisfied affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the proposed order will be for the wellbeing, and in the best interests, of the child;</txt></block></li><li id="sec.22-ssec.2-para1.b" guid="_97f58ef6-7cd4-4c33-a102-a240248686e6" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the child—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.2-para1.b-para2.i" guid="_c54d1dfa-d614-4bef-bf74-01e0eb68051f" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">has resided with the applicant, or joint applicants, for at least 28 consecutive days before the day the application was made; and</txt></block></li><li id="sec.22-ssec.2-para1.b-para2.ii" guid="_34a26ed0-0c4e-4796-9bfa-c71fc5049359" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">was residing with the applicant, or joint applicants, when the application was made; and</txt></block></li><li id="sec.22-ssec.2-para1.b-para2.iii" guid="_585aa308-2e20-4d5d-9c10-17ef44481d8c" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">is residing with the applicant, or joint applicants, at the time of the hearing;</txt></block></li></list></block></li><li id="sec.22-ssec.2-para1.c" guid="_cb9e2283-63f3-40a9-a75b-b4b96f641c8f" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the applicant, or joint applicants, were entitled to apply under <intref refid="sec.21" target.guid="_5e38b01c-9e26-4292-b675-94fc6b4f392a" check="valid">section&#160;21</intref>;</txt></block></li><li id="sec.22-ssec.2-para1.d" guid="_2b40c824-a5c8-42fd-8fa6-a7af66e97cb5" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">there is evidence of a medical or social need for the surrogacy arrangement;</txt></block></li><li id="sec.22-ssec.2-para1.e" guid="_1ef34ccf-20ef-4ea4-84bd-c6ef7c33e9a7" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">the surrogacy arrangement—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.2-para1.e-para2.i" guid="_6e9db0dc-e282-4550-96ee-896ddfa6090c" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">was made after—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.2-para1.e-para2.i-para3.A" guid="_2e23f57b-8384-421a-a739-46f5ad89473a" provision.type="other" affected.by.uncommenced="0"><no>(A)</no><block><txt break.before="0">the birth mother and the birth mother’s spouse (if any), jointly or separately; and</txt></block></li><li id="sec.22-ssec.2-para1.e-para2.i-para3.B" guid="_097b3cc9-c4f9-4e74-ad23-7c5b9fee5e32" provision.type="other" affected.by.uncommenced="0"><no>(B)</no><block><txt break.before="0">the applicant, or joint applicants (jointly or separately);</txt></block></li></list></block><block><txt break.before="1">obtained independent legal advice about the surrogacy arrangement and its implications; and</txt></block></li><li id="sec.22-ssec.2-para1.e-para2.ii" guid="_efabf21b-7440-4654-b1e8-15c79b14a951" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">was made after each of the birth mother, the birth mother’s spouse (if any) and the applicant, or joint applicants, obtained counselling from an appropriately qualified counsellor about the surrogacy arrangement and its social and psychological implications; and</txt></block></li><li id="sec.22-ssec.2-para1.e-para2.iii" guid="_0ddfc60d-b2d9-4ec5-aa57-e3898fbff95c" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">was made with the consent of the birth mother, the birth mother’s spouse (if any) and the applicant, or joint applicants; and</txt></block></li><li id="sec.22-ssec.2-para1.e-para2.iv" guid="_d93f72a1-c56f-4c13-8124-63f2ba2e115f" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">was made before the child was conceived; and</txt></block></li><li id="sec.22-ssec.2-para1.e-para2.v" guid="_8ab2658b-c6f6-47f8-8890-fc913a60da76" provision.type="other" affected.by.uncommenced="0"><no>(v)</no><block><txt break.before="0">is in writing and signed by the birth mother, the birth mother’s spouse (if any) and the applicant, or joint applicants; and</txt></block></li><li id="sec.22-ssec.2-para1.e-para2.vi" guid="_4a76d525-618f-4ccf-a1e5-6ba58aa2e7a5" provision.type="other" affected.by.uncommenced="0"><no>(vi)</no><block><txt break.before="0">is not a commercial surrogacy arrangement;</txt></block></li></list></block></li><li id="sec.22-ssec.2-para1.f" guid="_9e7645e4-eb77-44dd-a644-f041551e017f" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">the birth mother and the birth mother’s spouse (if any) were at least 25 years when the surrogacy arrangement was made;</txt></block></li><li id="sec.22-ssec.2-para1.g" guid="_4a682040-22b9-4ae7-b670-5f8fcefeb0ae" provision.type="other" affected.by.uncommenced="0"><no>(g)</no><block><txt break.before="0">the applicant, or each of the joint applicants—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.22-ssec.2-para1.g-para2.i" guid="_bde75b22-7797-43ba-93c1-05f5f058a7a8" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">was at least 25 years when the surrogacy arrangement was made; and</txt></block></li><li id="sec.22-ssec.2-para1.g-para2.ii" guid="_7a4996c0-5509-4296-a5c7-3493e6e5edc5" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">is resident in Queensland;</txt></block></li></list></block></li><li id="sec.22-ssec.2-para1.h" guid="_78877d26-9310-4255-93b5-fbc97ad7ffc3" provision.type="other" affected.by.uncommenced="0"><no>(h)</no><block><txt break.before="0">the birth mother, the birth mother’s spouse (if any), another birth parent (if any) and the applicant, or joint applicants, consent to the making of the parentage order at the time of surrogacy guidance report under <intref refid="sec.32" target.guid="_f4b60fa5-b821-452b-bfde-0e7e2cafd9c4" check="valid">section&#160;32</intref> supports the making of the proposed order.</txt></block></li></list></block></subclause></clause><clause id="sec.23" guid="_bfc9b0cf-2ab6-471a-b116-51446fda0b10" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>23</no><heading id="sec.23-he" guid="_6f1a91a2-121b-4ee8-867b-de2716ba207d">Dispensing with a requirement</heading><subclause id="sec.23-ssec.1" guid="_48a3419c-8ac3-4226-bbeb-d144e512c3a6" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The court may not dispense with a requirement mentioned in <intref refid="sec.22" target.guid="_a78fbefe-11aa-4d6b-8e0c-4384e9330852" check="valid">section&#160;22</intref><intref refid="sec.22-ssec.2" target.guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" check="valid">(2)</intref><intref refid="sec.22-ssec.2-para1.a" target.guid="_3eaced8e-a4bb-4260-bb7b-9337a3cabe99" check="valid">(a)</intref> or <intref refid="sec.22-ssec.2-para1.e" target.guid="_1ef34ccf-20ef-4ea4-84bd-c6ef7c33e9a7" check="valid">(e)</intref><intref refid="sec.22-ssec.2-para1.e-para2.iii" target.guid="_0ddfc60d-b2d9-4ec5-aa57-e3898fbff95c" target.guid="_efabf21b-7440-4654-b1e8-15c79b14a951" check="valid">(ii)</intref> or <intref refid="sec.22-ssec.2-para1.e-para2.v" target.guid="_8ab2658b-c6f6-47f8-8890-fc913a60da76" check="valid">(v)</intref>, or (f) to (i) only if the court is satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.2-para1.a" guid="_f085726f-db07-41b4-9a38-285b2c3f96d2" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">there are exceptional circumstances for giving the dispensation; and</txt><note id="sec.23-ssec.2-para1.a-note" guid="_a5b0b542-ebad-4a27-806f-5719b3a63e9f" type="example"><heading id="sec.23-ssec.2-para1.a-note-he" guid="_bc6a9c94-27f6-4d3a-90e2-14dddfac68af">Example of exceptional circumstances for dispensing with the requirement under <intref refid="sec.22" target.guid="_a78fbefe-11aa-4d6b-8e0c-4384e9330852" check="valid">section&#160;22</intref><intref refid="sec.22-ssec.2" target.guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" check="valid">(2)</intref><intref refid="sec.22-ssec.2-para1.g" target.guid="_4a682040-22b9-4ae7-b670-5f8fcefeb0ae" check="valid">(g)</intref><intref refid="sec.22-ssec.2-para1.g-para2.ii" target.guid="_7a4996c0-5509-4296-a5c7-3493e6e5edc5" check="valid">(ii)</intref> —</heading><block><txt break.before="1">One of the joint applicants is temporarily residing outside Queensland because of work commitments but is still in a spousal relationship with the other joint applicant who is resident in Queensland.</txt></block></note></block></li><li id="sec.23-ssec.2-para1.b" guid="_59068890-d09c-4b07-a55e-6d105c4fa232" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the dispensation will be for the wellbeing, and in the best interests, of the child.</txt></block></li></list></block></subclause><subclause id="sec.23-ssec.3" guid="_fd527758-53a2-489c-bdd8-6a48de18cfe1" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">However, to dispense with the requirement under <intref refid="sec.22" target.guid="_a78fbefe-11aa-4d6b-8e0c-4384e9330852" check="valid">section&#160;22</intref><intref refid="sec.22-ssec.2" target.guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" check="valid">(2)</intref><intref refid="sec.22-ssec.2-para1.h" target.guid="_78877d26-9310-4255-93b5-fbc97ad7ffc3" check="valid">(h)</intref> for a person to consent to the making of the parentage order, the exceptional circumstances for giving the dispensation must be either that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.23-ssec.3-para1.a" guid="_b7f25f51-d3d6-4130-bc0d-cb1607ee71fb" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the person has died or is not a person with capacity to give the consent; or</txt></block></li><li id="sec.23-ssec.3-para1.b" guid="_5b1df83e-7d2b-4bc8-b805-1ac5d7885a36" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">an applicant can not locate the person after making all reasonable enquiries.</txt></block></li></list></block></subclause></clause><clause id="sec.24" guid="_fc7520ef-77f3-42ce-a277-d6b6d2209231" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>24</no><heading id="sec.24-he" guid="_c1cea4d1-bd3c-472a-a479-33d037674e9b">Additional requirement if multiple births</heading><subclause id="sec.24-ssec.1" guid="_48acf0fa-2001-4381-a215-f580aa34d8c7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a child has a living birth sibling.</txt></block></subclause><subclause id="sec.24-ssec.2" guid="_95ccc0b0-5471-44be-98d3-7362dd1d9770" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Despite any other provision of this Act, the court may make a parentage order about the child in favour of an applicant, or joint applicants, only if it also makes a parentage order about each living birth sibling of the child in favour of the applicant, or joint applicants.</txt></block></subclause><subclause id="sec.24-ssec.3" guid="_b0381538-e2a1-4e47-a6de-bc086befcc0c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.24-ssec.3-def.birthsibling_" guid="_0933263a-77f8-4fe9-b0da-a2abe72f6021" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.24-ssec.3-def.birthsibling" guid="_68e36068-3bf8-41f3-9fb3-b07655c49dac" type="definition">birth sibling</defterm>, of a child, means a brother or sister of the child who is born as a result of the same pregnancy as the child.</txt></definition></deflist></block></subclause></clause><clause id="sec.25" guid="_75fc8eff-b347-438c-89fd-e6fef6e7c686" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>25</no><heading id="sec.25-he" guid="_be293582-e613-491f-87df-800a90502f1a">Documents and information to be produced to court</heading><subclause id="sec.25-ssec.1" guid="_99821e53-e9f5-4e2d-8536-1cc09ed00328" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For an application for a parentage order, the following documents must be produced to the court—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-ssec.1-para1.a" guid="_b5a54f8f-29e0-4607-ba03-612bb2d62fef" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a copy of the child’s birth certificate;</txt></block></li><li id="sec.25-ssec.1-para1.b" guid="_3b684ba9-d21b-4e0f-9ea4-409d25d14641" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a copy of the surrogacy arrangement;</txt></block></li><li id="sec.25-ssec.1-para1.c" guid="_cf37c7d3-cd0c-4310-94c6-e7e3e95fa708" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">an affidavit under <intref refid="sec.26" target.guid="_663d4e1d-4d89-4191-89b3-0195ecaaf8bd" check="valid">section&#160;26</intref> sworn by the applicant, or joint applicants;</txt></block></li><li id="sec.25-ssec.1-para1.d" guid="_077ffe5c-2dfb-462e-b66b-106b69c11ccb" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">an affidavit under <intref refid="sec.27" target.guid="_61c79952-4908-45fd-abf9-ff7e3946de6d" check="valid">section&#160;27</intref> sworn by the birth mother;</txt></block></li><li id="sec.25-ssec.1-para1.e" guid="_f5839ea1-9ca7-4d58-b4af-27143065e340" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">an affidavit under <intref refid="sec.28" target.guid="_20986ace-7a66-462c-85dd-49ba0bff16b2" check="valid">section&#160;28</intref> sworn by the birth mother’s spouse (if any);</txt></block></li><li id="sec.25-ssec.1-para1.f" guid="_b5b12a65-0447-4ba7-86b2-4a03c876702e" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">an affidavit under <intref refid="sec.29" target.guid="_0ac020ac-8295-4193-b219-055d5fd8a817" check="valid">section&#160;29</intref> sworn by another birth parent (if any);</txt></block></li><li id="sec.25-ssec.1-para1.g" guid="_533c6061-de65-4dca-939f-5ce691a1243f" provision.type="other" affected.by.uncommenced="0"><no>(g)</no><block><txt break.before="0">for the applicant, or each joint applicant, the birth mother and the birth mother’s spouse (if any)—an affidavit under <intref refid="sec.30" target.guid="_6eb67edb-90c7-40ef-9d49-ee28683260c8" check="valid">section&#160;30</intref> sworn by the lawyer who gave legal advice to the person before the surrogacy arrangement was made;</txt></block></li><li id="sec.25-ssec.1-para1.h" guid="_03e22e02-0068-4649-8216-38b2014d75dc" provision.type="other" affected.by.uncommenced="0"><no>(h)</no><block><txt break.before="0">an affidavit under <intref refid="sec.31" target.guid="_8803f66c-e6a3-4311-a0fd-9b98fcdee3c1" check="valid">section&#160;31</intref> sworn by the appropriately qualified counsellor who gave counselling to the birth mother, the birth mother’s spouse (if any) and the applicant, or each joint applicant, before the surrogacy arrangement was made;</txt></block></li><li id="sec.25-ssec.1-para1.i" guid="_e6e10949-6f76-4b2f-8021-4fbcb16ee159" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">an affidavit—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-ssec.1-para1.i-para2.i" guid="_ed078a62-3bb9-4f59-8d43-d15280ffd3f6" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">sworn by the independent and appropriately qualified counsellor who, for the purpose of the application, interviewed the birth mother, the birth mother’s spouse (if any), another birth parent (if any) and the applicant, or joint applicants; and</txt></block></li><li id="sec.25-ssec.1-para1.i-para2.ii" guid="_c4f8deba-65a4-4622-b820-7b0494409b27" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">verifying a surrogacy guidance report under <intref refid="sec.32" target.guid="_f4b60fa5-b821-452b-bfde-0e7e2cafd9c4" check="valid">section&#160;32</intref> prepared by the counsellor;</txt></block></li></list></block></li><li id="sec.25-ssec.1-para1.j" guid="_dea680e2-8433-4545-93a4-d7054980295e" provision.type="other" affected.by.uncommenced="0"><no>(j)</no><block><txt break.before="0">for each applicant who is a woman, an affidavit from an appropriately qualified medical practitioner verifying a report prepared by the medical practitioner as to why the applicant is an eligible woman.</txt></block></li></list></block></subclause><subclause id="sec.25-ssec.2" guid="_663ab107-b442-48c2-b7ba-595e21c707bf" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Despite <intref refid="sec.25-ssec.1" target.guid="_99821e53-e9f5-4e2d-8536-1cc09ed00328" check="valid">subsection&#160;(1)</intref><intref refid="sec.25-ssec.1-para1.d" target.guid="_077ffe5c-2dfb-462e-b66b-106b69c11ccb" check="valid">(d)</intref>, <intref refid="sec.25-ssec.1-para1.e" target.guid="_f5839ea1-9ca7-4d58-b4af-27143065e340" check="valid">(e)</intref> and <intref refid="sec.25-ssec.1-para1.f" target.guid="_b5b12a65-0447-4ba7-86b2-4a03c876702e" check="valid">(f)</intref>, a single affidavit satisfying the requirements mentioned in <intref refid="sec.27" target.guid="_61c79952-4908-45fd-abf9-ff7e3946de6d" check="valid">sections&#160;27</intref> to <intref refid="sec.29" target.guid="_0ac020ac-8295-4193-b219-055d5fd8a817" check="valid">29</intref> may be sworn by the birth mother, the birth mother’s spouse (if any) and another birth parent (if any).</txt></block></subclause><subclause id="sec.25-ssec.3" guid="_ca6941ac-26fd-4b80-ae25-4ceead2173c6" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Despite <intref refid="sec.25-ssec.1" target.guid="_99821e53-e9f5-4e2d-8536-1cc09ed00328" check="valid">subsection&#160;(1)</intref><intref refid="sec.25-ssec.1-para1.g" target.guid="_533c6061-de65-4dca-939f-5ce691a1243f" check="valid">(g)</intref>, a single affidavit satisfying the requirements mentioned in <intref refid="sec.30" target.guid="_6eb67edb-90c7-40ef-9d49-ee28683260c8" check="valid">section&#160;30</intref> may be sworn by the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-ssec.3-para1.a" guid="_63f35ce9-343b-482f-b593-b5f352f232a9" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a lawyer who gave legal advice to the birth mother and the birth mother’s spouse jointly;</txt></block></li><li id="sec.25-ssec.3-para1.b" guid="_6b5828ce-63f3-474f-a2d0-b4cfdf053911" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a lawyer who gave legal advice to joint applicants jointly.</txt></block></li></list></block></subclause><subclause id="sec.25-ssec.4" guid="_88b763cd-a9b7-41fc-99c2-5b331f90d095" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Despite <intref refid="sec.25-ssec.1" target.guid="_99821e53-e9f5-4e2d-8536-1cc09ed00328" check="valid">subsection&#160;(1)</intref><intref refid="sec.25-ssec.1-para1.h" target.guid="_03e22e02-0068-4649-8216-38b2014d75dc" check="valid">(h)</intref>, if the same counsellor did not give counselling to the birth mother, the birth mother’s spouse (if any) and the applicant, or joint applicants, affidavits under <intref refid="sec.31" target.guid="_8803f66c-e6a3-4311-a0fd-9b98fcdee3c1" check="valid">section&#160;31</intref> may be sworn by more than 1 counsellor.</txt></block></subclause></clause><clause id="sec.26" guid="_663d4e1d-4d89-4191-89b3-0195ecaaf8bd" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>26</no><heading id="sec.26-he" guid="_0a5a6a6d-f9b4-434c-8075-c7c2fa3cfeca">Applicant’s or joint applicants’ affidavit</heading><block><txt break.before="1">The affidavit sworn by the applicant, or joint applicants, must address the matters mentioned in <intref refid="sec.22" target.guid="_a78fbefe-11aa-4d6b-8e0c-4384e9330852" check="valid">section&#160;22</intref><intref refid="sec.22-ssec.2" target.guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" check="valid">(2)</intref> (to the extent they are not matters regarding the birth mother, the birth mother’s spouse (if any) or another birth parent (if any)), including by stating—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-para1.a" guid="_6bf1f86c-ea8b-4af0-86aa-453ff9dcccd2" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the current and proposed care arrangements for the child; and</txt></block></li><li id="sec.26-para1.b" guid="_a2846767-d12d-4d07-bb2f-f4e0aef9fdc8" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the understanding of the applicant, or joint applicants, of the social, psychological and legal implications of the surrogacy arrangement and the making of a parentage order; and</txt></block></li><li id="sec.26-para1.c" guid="_e12c62a6-1de7-4169-a7fe-4f292e71c9f9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the understanding of the applicant, or joint applicants, in relation to openness and honesty about the child’s birth parentage being for the wellbeing, and in the best interests, of the child; and</txt></block></li><li id="sec.26-para1.d" guid="_b1d9e129-0791-4aec-b4d7-23933db10983" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the proposed name for the child; and</txt></block></li><li id="sec.26-para1.e" guid="_7c8a472f-0ddb-4201-9d28-8fd61fca4e43" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">for each applicant—the applicant’s date of birth and occupation (as at the date of the child’s birth).</txt></block></li></list></block></clause><clause id="sec.27" guid="_61c79952-4908-45fd-abf9-ff7e3946de6d" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>27</no><heading id="sec.27-he" guid="_239c23e8-3dd1-4b08-a5a4-f354f61fff32">Birth mother’s affidavit</heading><block><txt break.before="1">The affidavit sworn by the birth mother must address the matters mentioned in <intref refid="sec.22" target.guid="_a78fbefe-11aa-4d6b-8e0c-4384e9330852" check="valid">section&#160;22</intref><intref refid="sec.22-ssec.2" target.guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" check="valid">(2)</intref><intref refid="sec.22-ssec.2-para1.a" target.guid="_3eaced8e-a4bb-4260-bb7b-9337a3cabe99" check="valid">(a)</intref>, <intref refid="sec.22-ssec.2-para1.e" target.guid="_1ef34ccf-20ef-4ea4-84bd-c6ef7c33e9a7" check="valid">(e)</intref>, <intref refid="sec.22-ssec.2-para1.f" target.guid="_9e7645e4-eb77-44dd-a644-f041551e017f" check="valid">(f)</intref> and <intref refid="sec.22-ssec.2-para1.h" target.guid="_78877d26-9310-4255-93b5-fbc97ad7ffc3" check="valid">(h)</intref> (to the extent they are matters regarding the birth mother), and (2)(e)(iv) and (vi), including by stating—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.27-para1.a" guid="_8789843a-0477-4655-97f5-38d008674aa0" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the understanding of the birth mother of the social, psychological and legal implications of the surrogacy arrangement and the making of a parentage order; and</txt></block></li><li id="sec.27-para1.b" guid="_ac212758-7eec-4c44-8ece-ecb097f3c583" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the understanding of the birth mother in relation to openness and honesty about the child’s birth parentage being for the wellbeing, and in the best interests, of the child; and</txt></block></li><li id="sec.27-para1.c" guid="_90c696bb-3afd-4430-904a-938d9413bf48" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">that the birth mother did not receive any payment, reward or other material benefit or advantage, other than the birth mother’s surrogacy costs, for a matter mentioned in <intref refid="sec.10" target.guid="_00f5ed64-b76c-4dfe-9da1-d73f8f08dbab" check="valid">section&#160;10</intref><intref refid="sec.10-para1.a" target.guid="_5f4ad970-f06b-494f-b4bb-e751a3138209" check="valid">(a)</intref>, <intref refid="sec.10-para1.b" target.guid="_cd0e7c76-aa56-42cd-88b3-eb372015a83b" check="valid">(b)</intref>, or (c); and</txt></block></li><li id="sec.27-para1.d" guid="_cd1a5153-1321-4a5d-a50a-90e30926da74" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the birth mother’s date of birth.</txt></block></li></list></block></clause><clause id="sec.28" guid="_20986ace-7a66-462c-85dd-49ba0bff16b2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>28</no><heading id="sec.28-he" guid="_5aabd4d6-6b4f-4efc-822e-20e60772b9ea">Birth mother’s spouse’s affidavit</heading><block><txt break.before="1">The affidavit sworn by the birth mother’s spouse must address the matters mentioned in <intref refid="sec.22" target.guid="_a78fbefe-11aa-4d6b-8e0c-4384e9330852" check="valid">section&#160;22</intref><intref refid="sec.22-ssec.2" target.guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" check="valid">(2)</intref><intref refid="sec.22-ssec.2-para1.a" target.guid="_3eaced8e-a4bb-4260-bb7b-9337a3cabe99" guid="_e100f31a-ba65-48cb-9c02-56f4cc7e9966" type="definition">relevant persons</defterm>) must verify a report prepared by the counsellor addressing the matter mentioned in <intref refid="sec.22" target.guid="_a78fbefe-11aa-4d6b-8e0c-4384e9330852" check="valid">section&#160;22</intref><intref refid="sec.22-ssec.2" target.guid="_0627a38d-9b85-43bf-8da1-5e9163db698a" id="sec.32-he" guid="_1aa17ab4-70cc-4bf0-9acf-6ea2081c9a75">Surrogacy guidance report</heading><block><txt break.before="1">A surrogacy guidance report must be prepared by an independent and appropriately qualified counsellor and state the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-para1.a" guid="_d938f8a4-e3d3-42d3-9b63-48a2cc24b344" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the reasons the counsellor is an independent and appropriately qualified counsellor;</txt></block></li><li id="sec.32-para1.b" guid="_4b800a33-94f1-403b-be9a-1498d2cc40c6" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">that, for the application, the counsellor interviewed the birth mother, the birth mother’s spouse (if any), another birth parent (if any) and the applicant, or joint applicants, (the <defterm id="sec.32-def.relevantpersons" guid="_0749b456-22d8-45cf-8d4b-de96de8fb492" type="definition">relevant persons</defterm>);</txt></block></li><li id="sec.32-para1.c" guid="_34117745-89e0-4922-b479-32ad83a2e436" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the date or dates of the interviews;</txt></block></li><li id="sec.32-para1.d" parentage order, the court may, for the purpose of deciding whether the proposed order will promote the child’s wellbeing and best interests, require the attendance before it of the birth mother, the birth mother’s spouse (if any), the other birth parent (if any), the applicant, or joint applicants, or another person who has sworn an affidavit for the application to—</txt><list break.before="0">Without limiting <intref refid="sec.36" target.guid="_2e529291-d995-4d97-9138-31cd5764460a" check="valid">section&#160;36</intref>, if the court makes a parentage order transferring parentage of the child to the surviving intended parent, the court may also make an order declaring that the deceased intended parent is taken to have been a parent of the to a request for information made under <intref refid="sec.41-ssec.3" target.guid="_83ee53b9-0583-426a-9986-369cf6fa6731" check="valid">subsection&#160;(3)</intref> to the registrar under that surrogacy costs); or</txt></block></li><li id="sec.46-ssec.1-para1.c" guid="_85823b52-5ab7-4291-8997-832dd87a0160" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">there is an exceptional reason why the parentage order should be discharged.</txt></block></li></list></block></subclause><subclause id="sec.46-ssec.2" guid="_ce5e87ea-7c0c-4ad6-b8fe-f4428435c801" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The applicant must state the ground on which the application is made.</txt></block></subclause><subclause id="sec.46-ssec.3" guid="_d703c892-946f-430c-9ae0-503c51b5301c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">As soon as practicable after filing the application, the applicant must serve a copy of it on each other interested person (other than the Attorney-General).</txt></block></subclause><subclause break.before="0">The court may dispense with the requirement to serve a copy of the application on a person if the court is satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.46-ssec.6-para1.a" guid="_36d43b1d-7332-430f-b701-a27cfdcfda0a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the applicant can not locate the a discharge order</heading><subclause id="sec.47-ssec.1" guid="_bbcf72ad-2702-46ef-8afb-d039ab8e0701" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">On an application under this part, the court may make a discharge order discharging a parentage order in relation to a child.</txt></block></subclause><subclause id="sec.47-ssec.2" guid="_9e5768d9-7178-47e5-b3df-b3aa986a2574" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The court may make the discharge order only if the court is satisfied of all of the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.47-ssec.2-para1.a" guid="_797879ab-984f-493b-ba81-a3a1df2c76ca" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">reasonable efforts have been made to serve the application on—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.47-ssec.2-para1.a-para2.i" guid="_e470a4e8-66d4-4ad3-a149-ceac68e14ba2" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">each other interested person (other than the Attorney-General); and</txt></block></li><li id="sec.47-ssec.2-para1.a-para2.ii" guid="_af5a010e-1689-4e67-a102-3e00f9997ea5" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if the child is under 18 years but the court considers it appropriate having regard to the child’s age—the child;</txt></block></li></list></block></li><li id="sec.47-ssec.2-para1.b" guid="_00bd03dc-85a4-4d77-a242-e987c6024903" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">one of the grounds mentioned in <intref refid="sec.46" target.guid="_4fede872-339f-4b53-8149-0f1cfa2c7fc8" check="valid">section&#160;46</intref><intref refid="sec.46-ssec.1" target.guid="_d50a9b2f-5d97-458b-8a8b-40c6aa6b941c" check="valid">(1)</intref><intref refid="sec.46-ssec.1-para1.a" target.guid="_2bbd3ac0-e3cd-4f95-ad92-4185ca728fc9" check="valid">(a)</intref>, <intref refid="sec.46-ssec.1-para1.b" target.guid="_9f9e328b-17bd-4dfc-9f5d-87756457c50d" check="valid">(b)</intref> or <intref refid="sec.46-ssec.1-para1.c" target.guid="_85823b52-5ab7-4291-8997-832dd87a0160" check="valid">(c)</intref>.</txt></block></li></list></block></subclause><subclause id="sec.47-ssec.3" guid="_b6066b7c-14c2-432b-8653-2fdf8151f87c" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the court makes a discharge order, the court must, in the same order, declare the first name and surname by which the child is to be known after the making of the discharge order.</txt></block></subclause><subclause id="sec.47-ssec.4" guid="_27971c41-bc4e-4e88-83aa-7203f936f119" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In declaring a first name under <intref refid="sec.47-ssec.3" target.guid="_b6066b7c-14c2-432b-8653-2fdf8151f87c" check="valid">subsection&#160;(3)</intref>, the court must have regard to the principle that a child’s first name should be retained except in special circumstances.</txt></block></subclause><subclause id="sec.47-ssec.5" guid="_1a9450f9-0e7f-4ac0-a016-5f684d2904ef" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Also, if the child has been served with a copy of the application, in declaring a name under <intref refid="sec.47-ssec.3" target.guid="_b6066b7c-14c2-432b-8653-2fdf8151f87c" check="valid">subsection&#160;(3)</intref> the court must consider the child’s views about his or her name.</txt></block></subclause><subclause id="sec.47-ssec.6" guid="_a1f42fa2-0ef2-45ae-be06-4990ed307b61" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A declaration of names in a discharge order does not prevent a subsequent change of name under a law of the State or the Commonwealth.</txt></block></subclause><subclause id="sec.47-ssec.7" guid="_823d6eab-9242-4751-a3c2-520f536af9ca" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">If the court makes a discharge order, it may also make any other order it considers appropriate in the interests of justice or to ensure the child’s wellbeing and best interests, including an order relating to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.47-ssec.7-para1.a" guid="_1cfabbb2-2c85-44f2-b831-6d0eaedf3683" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the ownership or possession of property; or</txt></block></li><li id="sec.47-ssec.7-para1.b" guid="_20de8ba2-6875-46b9-83a8-70b40d36f56c" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">any matter affecting the child in relation to the duties, powers, responsibilities and authority which, by law, parents have in relation to children; or</txt></block></li><li id="sec.47-ssec.7-para1.c" guid="_59ded1c1-f7be-4c5b-9bf3-b48d7f18c917" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">where the child is to live.</txt></block></li></list></block></subclause></clause><clause id="sec.48" guid="_3667f7a4-d339-40c0-901c-1b9ab48c5d01" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>48</no><heading id="sec.48-he" guid="_6b95d9cb-4877-415e-944d-4ef24eb26431">Effect of discharge order</heading><subclause id="sec.48-ssec.1" guid="_921451ab-a685-49ba-8a4e-ea2450132de4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">On the making of a discharge order, the rights, privileges, duties, liabilities and relationships of the child and all other persons are the same as if the parentage order being discharged had not been made.</txt></block></subclause><subclause id="sec.48-ssec.2" guid="_b1d5373b-4d75-4b78-9a40-a977a7fed094" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, the making of the discharge order affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">anything lawfully done, or the consequences of anything lawfully done, while the parentage order was in force; offence where a familial relationship is relevant, the child is taken, after the discharge order is made, to have both the familial relationships that resulted from the making of the parentage order guid="_1580ea41-b80c-4196-b28a-f1d84bdec0e3" type="definition">pre-commencement birth mother</defterm>, for a pre-commencement surrogacy arrangement, means a person who, before the commencement, corresponded to a birth mother under a surrogacy arrangement.</txt></definition><definition id="sec.62-def.precommencementintendedparent_" guid="_e9de55b1-cb39-4057-b790-4714149258df" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.62-def.precommencementintendedparent" guid="_14790bc5-2949-4a8a-a776-4ec214035042" type="definition">pre-commencement intended parent</defterm>, for a pre-commencement surrogacy arrangement, means a person who, before the commencement, corresponded to an intended parent under a surrogacy arrangement.</txt></definition><definition id="sec.62-def.precommencementsurrogacyarrangement_" guid="_2261ad38-6bf2-4fbd-be2c-5bff86be99c6" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.62-def.precommencementsurrogacyarrangement" guid="_20312779-805d-4874-9ee1-595321acc0ed" type="definition">pre-commencement surrogacy arrangement</defterm> means an arrangement entered into between a pre-commencement birth mother and a pre-commencement intended parent, or pre-commencement intended parents, before the commencement that corresponded to a surrogacy arrangement.</txt></definition></deflist></block></clause><clause id="sec.63" guid="_372957f7-5bec-4e4a-a40c-6df2949d7811" affected.by.uncommenced="0" spent.amends="0" provision.type="transitional"><no>63</no><heading id="sec.63-he" guid="_cbc561a2-c4e8-42e8-9b28-ea3c08ddfd44">Application for parentage order in relation to pre-commencement surrogacy arrangement</heading><subclause id="sec.63-ssec.1" guid="_c95b4699-a74f-4f43-82a4-25e9fff23136" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.63-ssec.1-para1.a" guid="_62a6c5c8-ae2e-44f6-964d-efb550a4b4c7" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a pre-commencement birth mother and a pre-commencement intended parent, or pre-commencement intended parents, were parties to a pre-commencement surrogacy arrangement; and</txt></block></li><li id="sec.63-ssec.1-para1.b" guid="_215c11b5-2dbe-4561-a572-732dd3237900" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the pre-commencement surrogacy arrangement was not a commercial surrogacy arrangement; and</txt></block></li><li id="sec.63-ssec.1-para1.c" guid="_53b8a9ab-0213-4146-a50d-e66d5204316b" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">a child has been born as a result of the pre-commencement surrogacy arrangement; and</txt></block></li><li id="sec.63-ssec.1-para1.d" guid="_eb89895c-589f-4674-b001-47189db5719a" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the pre-commencement surrogacy arrangement was made before the child was conceived.</txt></block></li></list></block></subclause><subclause id="sec.63-ssec.2" guid="_b002fd68-ae82-4f0a-a1ad-4f4136b02568" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Within 2 years after the commencement, the pre-commencement intended parent, or pre-commencement intended parents, may apply to the court for a parentage order.</txt></block></subclause><subclause id="sec.63-ssec.3" guid="_b21c6779-a095-44f0-a674-c4bc7465a0ed" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Chapter&#160;3 applies in relation to the application and any parentage order made on the application is a parentage order under chapter&#160;3.</txt></block></subclause><subclause id="sec.63-ssec.4" guid="_0572b8af-9678-4eb7-b1c4-3275851b2a79" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In addition to the court’s power under section&#160;23, the court may dispense with a requirement under chapter&#160;3 (other than a requirement mentioned in section&#160;22(2)(e)(iii)) if the court considers it is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.63-ssec.4-para1.a" guid="_8b14a38f-7971-4fa8-90cb-e3a7ac41c143" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for the wellbeing, and in the best interests, of the child born as a result of the pre-commencement surrogacy arrangement to dispense with the requirement; or</txt></block></li><li id="sec.63-ssec.4-para1.b" guid="_978ca6c4-3d16-4021-a516-85e6392a15b9" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">otherwise impractical for the pre-commencement intended parent, or pre-commencement intended parents, to comply with the requirement.</txt><note id="sec.63-ssec.4-para1.b-note" guid="_ee31bbca-a26d-47e1-a4aa-da6eb5f89192" type="example"><heading id="sec.63-ssec.4-para1.b-note-he" guid="_902766f0-e50c-4a19-a339-cb649bbc0d4e">Example for paragraph&#160;(b)—</heading><block><txt break.before="1">It was impracticable to obtain independent legal advice before entering into the pre-commencement surrogacy arrangement.</txt></block></note></block></li></list></block></subclause><subclause id="sec.63-ssec.5" guid="_55e5b9fd-51e6-42ba-802d-4c48187ca032" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">However, to dispense with the requirement under section&#160;22(2)(h) for a person to consent to the making of the parentage order, the circumstances for giving the dispensation must be either that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.63-ssec.5-para1.a" guid="_ce54e8f9-7229-4a9e-94e4-c426e160f4f6" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the person has died or is not a person with capacity to give
