target.version.series="a3c48c0e-4146-4fac-a255-fc9cbc0f7af6" check="valid"><name emphasis="yes">Economic Development Regulation part—</txt><deflist><definition id="sec.2A-def.affordablepurchaseprice_" guid="_8f60209c-b636-425d-8fea-881316a37ad2" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.affordablepurchaseprice" guid="_ad4561de-8125-4ddf-8c04-c5b0e6cbc7e1" type="definition">affordable purchase price</defterm>, for a household, means a price that enables the cost of servicing a mortgage for 90% of the purchase price to be not more than 30% of the gross income of the household.</txt></definition><definition id="sec.2A-def.affordablerent_" guid="_c41d2dcd-0cd5-4650-aa63-ec1f85c1fc85" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.affordablerent" guid="_e4c1200c-d42c-4219-b8ad-82d08da365a1" type="definition">affordable rent</defterm>, for a household, means a rent of not more than 30% of the gross income of the household.</txt></definition><definition id="sec.2A-def.firsthomebuyerhousehold_" guid="_76deb2d4-34fe-42aa-b0c5-f56c8b444bf2" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.firsthomebuyerhousehold" guid="_f36b5aa7-8af8-4534-8962-f2aa7ad2056a" type="definition">first home buyer household</defterm> means a household that has a gross household income within the range nominated in a housing needs analysis for identifying a first home buyer household for the priority development area in which the household is situated.</txt></definition><definition id="sec.2A-def.housingneedsanalysis_" guid="_2a31e1eb-91d1-4171-bab5-0e973b6f4541" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.housingneedsanalysis" guid="_fa10a366-b255-4805-b189-4f057d9ca7fd" type="definition">housing needs analysis</defterm> means a document called ‘Housing needs analysis’ that—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2A-def.housingneedsanalysis-para1.a" guid="_f7e9e7e5-33f5-4053-8ddc-2139c43e0343" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">analyses the need for particular types of housing for particular types of households in a particular priority development area; and</txt></block></li><li id="sec.2A-def.housingneedsanalysis-para1.b" guid="_52caf8d9-2d89-41de-b263-5608397c75ea" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">nominates a range of gross household income within which a household may be identified as a first home buyer household or a key worker household for a particular priority development area; and</txt></block></li><li id="sec.2A-def.housingneedsanalysis-para1.c" guid="_4d1f6fe2-72f0-4deb-bbb3-4c89c7338b9f" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">is published on MEDQ’s website.</txt></block></li></list></definition><definition id="sec.2A-def.keyworkerhousehold_" guid="_1eaeae3c-c59e-43bc-96bc-b9a71818523c" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.keyworkerhousehold" guid="_2401df47-e935-49b6-9f02-23fa78ce8e81" type="definition">key worker household</defterm> means a household that has a gross household income within the range nominated in a housing needs analysis for identifying a key worker household for the priority development area in which the household is situated.</txt></definition><definition id="sec.2A-def.lowtomoderateincomehousehold_" guid="_35ff1eff-6c8a-40e0-a7dc-36a1a1e784b4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.lowtomoderateincomehousehold" guid="_77f5ea64-61f0-455e-91a8-f4c542c9ec8b" type="definition">low to moderate income household</defterm> means a household that has a gross household income of more than 50% and less than 120% of the median household income for the local government area in which the household is situated.</txt></definition><definition id="sec.2A-def.marketrent_" guid="_8826b750-224f-40c2-a122-95fdec8716ab" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.marketrent" guid="_775c6555-7487-482e-a588-20b90e8c49b1" type="definition">market rent</defterm>, of housing, means the estimated amount for which an interest in the housing should be leased on the open market between a willing lessor and willing lessee on appropriate terms in an arm’s length transaction, after proper marketing and if the parties had each acted knowledgeably, prudently and without compulsion.</txt></definition><definition id="sec.2A-def.marketvalue_" guid="_b6914c5d-0ebc-4287-9e70-7f6ac38f02a4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.marketvalue" guid="_3ed4ae3a-36eb-47dc-a46c-ec3f6f9a9762" type="definition">market value</defterm>, of housing, means the estimated amount for which the housing should exchange on the open market between a willing buyer and a willing seller in an arm’s length transaction, after proper marketing and if the parties had each acted knowledgeably, prudently and without compulsion.</txt></definition><definition id="sec.2A-def.medianhouseholdincome_" guid="_35c240a5-fd50-41a5-87af-85465d13852f" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.medianhouseholdincome" guid="_b00d36bf-8d5a-4c85-9d86-27b2ed80d5d7" type="definition">median household income</defterm>, for a local government area, means the median household income for the area published by the Australian Bureau of Statistics and indexed by the Queensland wage price index published by the Australian Bureau of Statistics.</txt></definition><definition id="sec.2A-def.verylowincomehousehold_" guid="_8127f235-638c-4eef-8d56-de96a220ed4a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.2A-def.verylowincomehousehold" guid="_c10ca2bb-95cb-431c-bf8d-d1bd6195a2af" type="definition">very low income household</defterm> means a household that has a gross household income of 50% or less than the median household income for the local government area in which the household is situated.</txt></definition></deflist></block><historynote><txt break.before="1"><b>s&#160;2A</b> ins <legref jurisd="QLD" type="subordleg" target.doc.id="sl-2024-0208" target.version.series="f1eabab4-379e-4692-9baf-30747125a1b8" valid.date="as.made" check="valid">2024 SL&#160;No.&#160;208</legref> <legref jurisd="QLD" type="subordleg" refid="sec.3" target.doc.id="sl-2024-0208" target.version.series="f1eabab4-379e-4692-9baf-30747125a1b8" target.guid="_22c3c39d-bf95-4861-b441-0739681dea53" valid.date="as.made" check="valid">s&#160;3</legref></txt></historynote></clause><clause id="sec.2B" guid="_dcd9ec8d-57cb-4298-b974-ae93541c3259" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2B</no><heading id="sec.2B-he" guid="_465a01ae-16f7-4baa-90be-18fb8d0f486b">Affordable housing—<legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref>, <legref jurisd="QLD" type="act" refid="sec.7B" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" target.guid="_a875d603-f929-4be3-a66e-be867797fd47" check="valid">s&#160;7B</legref></heading><subclause id="sec.2B-ssec.1" guid="_94e983d9-9790-4312-bbdd-527b33829084" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section prescribes, for <legref jurisd="QLD" type="act" refid="sec.7B" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" target.guid="_a875d603-f929-4be3-a66e-be867797fd47" check="valid">section&#160;7B</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref>, housing that is affordable to the following types of households—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2B-ssec.1-para1.a" guid="_51913ca6-675a-4c22-82c6-1de22a128dde" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">very low income households;</txt></block></li><li id="sec.2B-ssec.1-para1.b" guid="_a1b16632-f13b-4aba-bfda-39d77cff7698" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">low to moderate income households;</txt></block></li><li id="sec.2B-ssec.1-para1.c" guid="_3c1c5866-7c6f-4b6b-b23f-471593581ebc" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">key worker households;</txt></block></li><li id="sec.2B-ssec.1-para1.d" guid="_10d03e61-e6aa-4b09-b9df-1b746a033559" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">first home buyer households.</txt></block></li></list></block></subclause><subclause id="sec.2B-ssec.2" guid="_84d39c32-1256-4377-989b-3964b8976023" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Housing is affordable to very low income households if the housing satisfies either or both of the following criteria—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2B-ssec.2-para1.a" guid="_e1e3dc0f-1587-46dc-8a5b-6bc689d18a0b" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the housing is provided for rental by a registered provider under the <legref jurisd="QLD" type="act" target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" check="valid"><name emphasis="yes">Housing Act 2003</name></legref>, <legref jurisd="QLD" type="act" refid="sch.4" target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" check="invalid">schedule&#160;4</legref> at an affordable rent for very low income households;</txt></block></li><li id="sec.2B-ssec.2-para1.b" guid="_a56ab694-e93f-4aa6-aa91-74b432f3dedc" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the housing is provided as part of a program, funded by any of the following entities, to support the provision of housing that is affordable to very low income households—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2B-ssec.2-para1.b-para2.i" guid="_620b0590-1ce3-4e17-8292-92cbe223b07e" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a public sector entity under the <legref jurisd="QLD" type="act" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid"><name emphasis="yes">Public Sector Act 2022</name></legref>, <legref jurisd="QLD" type="act" refid="sec.8" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" target.guid="_7bed139d-172e-47e1-aaae-7af5c08382ac" check="valid">section&#160;8</legref>;</txt></block></li><li id="sec.2B-ssec.2-para1.b-para2.ii" guid="_01bd3cb0-b419-42b7-bfe5-a7059c5e854e" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a local government;</txt></block></li><li id="sec.2B-ssec.2-para1.b-para2.iii" guid="_4106902b-e5d2-4f79-9356-34eddb53b6ee" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the State;</txt></block></li><li id="sec.2B-ssec.2-para1.b-para2.iv" guid="_d0170822-b571-4ab7-b4aa-032b5bc746ad" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">the Commonwealth.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.2B-ssec.3" guid="_57d03536-12f3-4478-aafb-3ec83fce78c6" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Housing is affordable to low to moderate income households if the housing satisfies 1 or more of the following criteria—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2B-ssec.3-para1.a" guid="_77f1ef57-b901-42c4-b515-4744d7122476" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the housing is provided for rental by a registered provider under the <legref jurisd="QLD" type="act" target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" check="valid"><name emphasis="yes">Housing Act 2003</name></legref>, <legref jurisd="QLD" type="act" refid="sch.4" target.doc.id="act-2003-052" target.version.series="7c0e0697-0529-4b66-b4af-8b49bec5f945" check="invalid">schedule&#160;4</legref> at an affordable rent for low to moderate income households;</txt></block></li><li id="sec.2B-ssec.3-para1.b" guid="_82d51001-e274-4847-a2a4-318427e39d44" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the housing is provided for rental at a rent of not more than 74.9% of the market rent of the housing;</txt></block></li><li id="sec.2B-ssec.3-para1.c" guid="_6f022946-21b0-4c80-9c7b-d1d7513ca472" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the housing is provided as part of a program, funded by any of the following entities, to support the provision of housing that is affordable to low to moderate income households—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2B-ssec.3-para1.c-para2.i" guid="_d3d8be97-b5f0-4440-96a5-8bfe5faba4e3" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a public sector entity under the <legref jurisd="QLD" type="act" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" check="valid"><name emphasis="yes">Public Sector Act 2022</name></legref>, <legref jurisd="QLD" type="act" refid="sec.8" target.doc.id="act-2022-034" target.version.series="8ae05878-305c-44e8-844a-61550d66e4f4" target.guid="_7bed139d-172e-47e1-aaae-7af5c08382ac" check="valid">section&#160;8</legref>;</txt></block></li><li id="sec.2B-ssec.3-para1.c-para2.ii" guid="_1f94a8b2-7701-4599-8169-416b6a9bd0f9" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">a local government;</txt></block></li><li id="sec.2B-ssec.3-para1.c-para2.iii" guid="_e812293b-9b50-4f33-b8a7-e252efbe2072" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">the State;</txt></block></li><li id="sec.2B-ssec.3-para1.c-para2.iv" guid="_b76f00fc-45e9-48cb-8c66-cfc7660f6731" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">the Commonwealth;</txt></block></li></list></block></li><li id="sec.2B-ssec.3-para1.d" guid="_c5c1043c-8428-4c44-8ccf-6875739440e5" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the housing has a market value that is not more than the affordable purchase price for low to moderate income households in the local government area in which the housing is located;</txt></block></li><li id="sec.2B-ssec.3-para1.e" guid="_f3e32cdd-25fe-42f7-8b50-156b644e9feb" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">the housing has a market value that is not more than 20 times the affordable rent, calculated on a yearly basis, for low to moderate income households in the local government area in which the housing is located;</txt></block></li><li id="sec.2B-ssec.3-para1.f" guid="_8f4eb735-f8af-41f8-a6b6-52ef9d5924d1" provision.type="other" affected.by.uncommenced="0"><no>(f)</no><block><txt break.before="0">the housing has a market rent that is not more than the affordable rent for low to moderate income households in the local government area in which the housing is located.</txt></block></li></list></block></subclause><subclause id="sec.2B-ssec.4" guid="_90f4be85-07c9-4d38-ada5-d94a574618e5" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Housing is affordable to key worker households if the housing satisfies 1 or more of the following criteria—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.2B-ssec.4-para1.a" guid="_925f340e-1913-4362-92d0-ce97f8fb835c" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the housing has a market value that is not more than the affordable purchase price for key worker households in the priority development area in which the housing is located;</txt></block></li><li id="sec.2B-ssec.4-para1.b" guid="_34adfccd-d258-488b-b64a-90a89658e369" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the housing has a market value that is not more than 20 times the affordable rent, calculated on a yearly basis, for key worker households in the priority development area in which the housing is located;</txt></block></li><li id="sec.2B-ssec.4-para1.c" guid="_334a21f7-b709-42db-8f50-5a714101cde2" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the housing has a market rent that is not more than the affordable rent for key worker households in the priority development area in which the housing is located.</txt></block></li></list></block></subclause><subclause id="sec.2B-ssec.5" guid="_dfdb9e80-9143-471d-acc2-c1c1f983923b" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">Housing is affordable to first home buyer households if the housing has a market value that is not more than the affordable purchase price for first home buyer households in the priority development area in which the housing is located.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;2B</b> ins <legref jurisd="QLD" type="subordleg" target.doc.id="sl-2024-0208" target.version.series="f1eabab4-379e-4692-9baf-30747125a1b8" valid.date="as.made" check="valid">2024 SL&#160;No.&#160;208</legref> <legref jurisd="QLD" type="subordleg" refid="sec.3" target.doc.id="sl-2024-0208" target.version.series="f1eabab4-379e-4692-9baf-30747125a1b8" target.guid="_22c3c39d-bf95-4861-b441-0739681dea53" plan of subdivision; and</txt></block></li><li id="sch.3-sec.1-ssec.2-para1.b-para2.ii" guid="_7376497d-446c-4bd8-94e9-c6b8d61d8553" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">evidence allowing the request to be assessed under <intref refid="sch.3-sec.2" target.guid="_7ccf6498-22a9-4b99-bb19-4f8a4251f25f" check="valid">section&#160;2</intref>; and</txt></block></li></list></block></li><li id="sch.3-sec.1-ssec.2-para1.c" guid="_c6bc3089-4d51-4949-af37-4115a87c7d02" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">be made during the relevant period, if any, for the request.</txt></block></li></list></block></subclause><subclause id="sch.3-sec.1-ssec.3" guid="_13a8dbf0-ba9f-44c0-b52b-b64d81fb3247" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For <intref refid="sch.3-sec.1-ssec.2" target.guid="_d45cbc59-38f2-4e61-bdb6-36cd951b7985" check="valid">subsection&#160;(2)</intref><intref refid="sch.3-sec.1-ssec.2-para1.c" target.guid="_c6bc3089-4d51-4949-af37-4115a87c7d02" check="valid">(c)</intref>, the <defterm id="sch.3-sec.1-def.relevantperiod" guid="_d40be9fd-f926-484d-b4d9-e6695ed86da7" type="definition">relevant period</defterm> for the request is—</txt><list break.before="0">if the request relates to a plan of subdivision for reconfiguring a lot that is authorised under a PDA development permit—the period during which the PDA development permit is in effect; or</txt></block></li><li id="sch.3-sec.1-ssec.3-para1.b" guid="_72c119e8-f874-4544-9215-8c79bc1ae3d1" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the request relates to a plan of subdivision for reconfiguring a lot that is required under a PDA development condition of a PDA development permit—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.1-ssec.3-para1.b-para2.i" guid="_db606f4a-cb71-490f-a73f-7bdf2e9ac021" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if the PDA development permit states a currency period under <legref jurisd="QLD" type="act" refid="sch.3-sec.100" target.doc.id="act-2012-043" check="invalid">section&#160;100</legref><legref jurisd="QLD" type="act" refid="sch.3-sec.100-ssec.4" target.doc.id="act-2012-043" check="invalid">(4)</legref> or <legref jurisd="QLD" type="act" refid="sch.3-sec.100-ssec.5" target.doc.id="act-2012-043" check="invalid">(5)</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref>—the stated currency period; or</txt></block></li><li id="sch.3-sec.1-ssec.3-para1.b-para2.ii" guid="_d4872fe9-72a7-465d-8acd-bc7e8c5cad7e" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">otherwise—the period of 4 years after the PDA development permit takes effect; or</txt></block></li></list></block></li><li id="sch.3-sec.1-ssec.3-para1.c" guid="_32ac5c3a-aa58-4754-b711-dcb8d74049d9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">if the request relates to a plan of subdivision for reconfiguring a lot that is required under a PDA exemption certificate—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.1-ssec.3-para1.c-para2.i" guid="_8601f6ad-af24-4c77-be1d-983e651afe60" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if the certificate states a period within which the plan must be given to MEDQ for its approval—the stated period; or</txt></block></li><li id="sch.3-sec.1-ssec.3-para1.c-para2.ii" guid="_f88386ef-2474-435c-b0e3-f86ec418c838" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">otherwise—the period during which the certificate is in effect.</txt></block></li></list></block></li></list></block></subclause></clause><clause id="sch.3-sec.2" guid="_7ccf6498-22a9-4b99-bb19-4f8a4251f25f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sch.3-sec.2-he" guid="_966e96d7-bfd7-45d0-b34a-ef45c093118c">Assessing request</heading><subclause id="sch.3-sec.2-ssec.1" guid="_035a3468-c4d7-4145-bae2-04f310c752c2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The request must be assessed against—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.2-ssec.1-para1.a" guid="_ab67ab4d-8449-4fb3-a1a7-e7ddd408b485" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the criteria that apply in relation to the request under <intref refid="sch.3-sec.2-ssec.2" target.guid="_5bdcc0b6-8d97-4ee6-87e6-8bbcf81d2ea2" check="valid">subsection&#160;(2)</intref>, <intref refid="sch.3-sec.2-ssec.3" target.guid="_70f4d1b4-6734-4937-aeef-e55d08401379" check="valid">(3)</intref> or <intref refid="sch.3-sec.2-ssec.4" target.guid="_69f11190-977d-46de-a4bb-72cfef948d88" check="valid">(4)</intref>; and</txt></block></li><li id="sch.3-sec.2-ssec.1-para1.b" guid="_547e56c5-13ee-4cca-9f49-19a46cdcc24c" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the general criteria under <intref refid="sch.3-sec.2-ssec.5" target.guid="_da286c26-6c30-482a-9de8-6099cca97e73" check="valid">subsection&#160;(5)</intref>.</txt></block></li></list></block></subclause><subclause id="sch.3-sec.2-ssec.2" guid="_5bdcc0b6-8d97-4ee6-87e6-8bbcf81d2ea2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the request relates to a plan of subdivision for reconfiguring a lot that is authorised under a PDA development permit or is required under a PDA development condition of a PDA development permit, the criteria are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.2-ssec.2-para1.a" guid="_28cd3852-99b3-4c29-996f-8c9c229c11f7" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the plan has been prepared in accordance with the requirements of the PDA development permit; and</txt></block></li><li id="sch.3-sec.2-ssec.2-para1.b" guid="_a9cc36ab-2442-44a1-ab91-dfc932fe1c76" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the PDA development permit is subject to PDA development conditions—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.2-ssec.2-para1.b-para2.i" guid="_eff63c9f-dc5c-4746-86ab-ca7fd99f1d21" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the conditions have been complied with; or</txt></block></li><li id="sch.3-sec.2-ssec.2-para1.b-para2.ii" guid="_1e41ad10-0ace-4645-91ae-dbcaef351746" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the applicant has given satisfactory security to MEDQ to ensure compliance with the conditions.</txt></block></li></list></block></li></list></block></subclause><subclause id="sch.3-sec.2-ssec.3" guid="_70f4d1b4-6734-4937-aeef-e55d08401379" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the request relates to a plan of subdivision for reconfiguring a lot that is required under a PDA exemption certificate, the criterion is that the plan has been prepared in accordance with the requirements of the certificate.</txt></block></subclause><subclause id="sch.3-sec.2-ssec.4" guid="_69f11190-977d-46de-a4bb-72cfef948d88" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the request relates to a plan of subdivision for reconfiguring a lot that is not PDA assessable development, the criterion is that the plan is consistent with any PDA development permit relevant to the land.</txt></block></subclause><subclause id="sch.3-sec.2-ssec.5" guid="_da286c26-6c30-482a-9de8-6099cca97e73" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The <defterm id="sch.3-sec.2-def.generalcriteria" guid="_07d4c22b-7ee1-486c-9d01-3624886d94c2" type="definition">general criteria</defterm> are the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.2-ssec.5-para1.a" guid="_19dd0e39-0e78-4f11-a18d-1e71fd3d6975" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">there are no outstanding local government rates or charges or expenses that are a charge over the land under any Act;</txt></block></li><li id="sch.3-sec.2-ssec.5-para1.b" guid="_35d12497-83d4-4ca3-9ac5-7dce9cd8be60" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">there are no outstanding special rates or charges, or infrastructure expenses recoupment charges, in relation to the land;</txt></block></li><li id="sch.3-sec.2-ssec.5-para1.c" guid="_99a40b89-abba-4454-a25c-3ff0512cc154" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the conditions of any water approval under the <legref jurisd="QLD" type="act" target.doc.id="act-2009-046" target.version.series="823a0dc3-6c45-4400-a230-133cee0bae67" check="valid"><name emphasis="yes">South-East Queensland Water (Distribution and Retail Restructuring) Act 2009</name></legref> in relation to the land have been complied with;</txt></block></li><li id="sch.3-sec.2-ssec.5-para1.d" guid="_bf4e652f-97bf-4e97-8f4b-3a0f31b8829f" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">there are no outstanding fees or charges in relation to the land levied by a distributor-retailer under the <legref jurisd="QLD" type="act" target.doc.id="act-2009-046" target.version.series="823a0dc3-6c45-4400-a230-133cee0bae67" check="valid"><name emphasis="yes">South-East Queensland Water (Distribution and Retail Restructuring) Act 2009</name></legref>.</txt></block></li></list></block></subclause><subclause id="sch.3-sec.2-ssec.6" guid="_901dd519-4f5b-4265-b03f-1669c163fa4a" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A reference in this section to the land, in relation to a plan of subdivision, is a reference to the land the subject of the plan of subdivision.</txt></block></subclause><subclause id="sch.3-sec.2-ssec.7" guid="_9b4301b4-4e08-4d49-9426-1b2c9e73393a" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sch.3-sec.2-ssec.7-def.localgovernmentratesorcharges_" guid="_efb7a07c-60a5-4850-9022-acd432b0c0ab" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.3-sec.2-ssec.7-def.localgovernmentratesorcharges" guid="_38cbf924-f5f2-4ffd-90ed-fe72e073d178" type="definition">local government rates or charges</defterm> means rates or charges levied by a local government.</txt></definition><definition id="sch.3-sec.2-ssec.7-def.specialrateorcharge_" guid="_afd8f4fa-1980-44ec-857e-904b84e9e72e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.3-sec.2-ssec.7-def.specialrateorcharge" guid="_91b125ba-c6bc-44c6-b424-d2f4f4172d7a" type="definition">special rate or charge</defterm> means a special rate or charge levied under <legref jurisd="QLD" type="act" refid="sec.115" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" target.guid="_5767b505-0a84-44c1-bd94-de26402b5627" check="valid">section&#160;115</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref>.</txt></definition></deflist></block></subclause></clause><clause id="sch.3-sec.3" guid="_4ae2a133-7a6b-416f-a495-d7cc83098da0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sch.3-sec.3-he" guid="_65f3aae6-a313-4433-a115-fa6d6bccdedd">Deciding request</heading><subclause id="sch.3-sec.3-ssec.1" guid="_af6601dc-db9a-48b0-9b18-3b82e882a228" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the request complies with the criteria against which it must be assessed under <intref refid="sch.3-sec.2" target.guid="_7ccf6498-22a9-4b99-bb19-4f8a4251f25f" check="valid">section&#160;2</intref>, MEDQ must approve the plan of subdivision.</txt></block></subclause><subclause id="sch.3-sec.3-ssec.2" guid="_4f08e143-bb17-43a2-9b04-532dd3095f2a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">MEDQ must give notice of the approval to the applicant within—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.3-ssec.2-para1.a" guid="_274d67d1-5f90-401b-9a29-99fd26425fea" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">20 business days after receiving the request; or</txt></block></li><li id="sch.3-sec.3-ssec.2-para1.b" guid="_4d45c780-f141-4993-8f95-30e2662ce6a2" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">another period agreed between MEDQ and the applicant.</txt></block></li></list></block></subclause><subclause id="sch.3-sec.3-ssec.3" guid="_c4054bea-ad7f-476a-9cd8-a8e3ce939703" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the <legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref> under which the plan of subdivision is to be registered or recorded requires a particular form for the registration or recording, the approval of the plan of subdivision must be in that form.</txt></block></subclause></clause></schedule></schedules></subordleg>
