title and purpose</heading><subclause id="sec.1-ssec.1" guid="_6f6d30a9-7ac3-4c8d-a660-805a24e6ed11" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act may be cited as the <legref jurisd="QLD" type="act" target.doc.id="act-2003-078" target.version.series="200dcee6-261a-4d8d-9dd8-07cdbf497d95" check="valid"><name emphasis="yes">Commonwealth Powers (De Facto Relationships) Act 2003</name></legref>.</txt></block></subclause><subclause id="sec.1-ssec.2" guid="_342058be-058d-46b2-aa83-ee12c04d47f4" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The purpose of this Act is to refer certain financial matters arising out of the breakdown of de facto relationships to the Parliament of the Commonwealth for the purposes of <legref jurisd="CTH" check="invalid" type="act">section&#160;51 (xxxvii)</legref> of the <legref jurisd="CTH" check="invalid" type="act"><name emphasis="no">Constitution of the Commonwealth</name></legref>.</txt></block></subclause></clause><clause id="sec.2" guid="_b31f496a-6471-4aef-a088-e3798324081b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sec.2-he" guid="_a27d881c-15e6-4617-8f06-d78082566641">Commencement</heading><subclause id="sec.2-ssec.1" guid="_cab66701-799f-42a3-988d-dc564ee17319" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This Act commences on a day to be fixed by proclamation.</txt></block></subclause><subclause id="sec.2-ssec.2" guid="_e6f841d6-0006-450f-868d-84307aad9d62" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The <legref jurisd="QLD" type="act" target.doc.id="act-1954-003" target.version.series="3cfb010e-ce09-4afd-baf6-bd10d22741a7" check="valid"><name emphasis="yes">Acts Interpretation Act 1954</name></legref>, <legref jurisd="QLD" type="act" refid="sec.15DA" target.doc.id="act-1954-003" target.version.series="3cfb010e-ce09-4afd-baf6-bd10d22741a7" target.guid="_0d629fb7-e3c3-4a59-9aae-256dbf466ea6" check="valid">section&#160;15DA</legref> does not apply to this Act.</txt></block></subclause></clause><clause id="sec.3" guid="_00dd5711-0cfb-4246-acdc-981b6fe1457f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_3061a11d-60ea-4694-b002-6a4fa364546a">Definitions</heading><subclause id="sec.3-ssec.1" guid="_2090f26c-051b-4dad-955b-79b774c00356" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">In this Act—</txt><deflist><definition id="sec.3-ssec.1-def.defactopartner_" guid="_137b6824-f8f2-48fc-9630-340b35c8fd23" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.defactopartner" guid="_055ca0dd-d05b-4f68-a644-c59ac6846b66" type="definition">de facto partner</defterm> means a person who lives or has lived in a de facto relationship.</txt></definition><definition id="sec.3-ssec.1-def.defactorelationship_" guid="_835979be-3d65-4b09-b177-af6b6ea8618e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.defactorelationship" guid="_43a903e4-995f-4d8f-8463-0de1b6adafbd" type="definition">de facto relationship</defterm> means a marriage-like relationship (other than a legal marriage) between 2 persons.</txt></definition><definition id="sec.3-ssec.1-def.financialmatters_" guid="_03fadab5-ba42-4604-92cb-d1f46c213356" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.financialmatters" guid="_e64f4129-6b41-4beb-b32b-ab7e64038772" type="definition">financial matters</defterm>, in relation to de facto partners, means any or all of the following matters—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-def.financialmatters-para1.a" guid="_8c07e31d-e486-4900-ab40-caec1e0260e3" provision.type="other"><no>(a)</no><block><txt break.before="0">the maintenance of de facto partners;</txt></block></li><li id="sec.3-ssec.1-def.financialmatters-para1.b" guid="_20d42019-29f6-4a67-acfe-007d4d6d6f2e" provision.type="other"><no>(b)</no><block><txt break.before="0">the distribution of the property of de facto partners;</txt></block></li><li id="sec.3-ssec.1-def.financialmatters-para1.c" guid="_786304a2-15f1-4bce-8ca3-e389adbd0b57" provision.type="other"><no>(c)</no><block><txt break.before="0">the distribution of any other financial resources of de facto partners, including prospective superannuation entitlements or other valuable benefits of or relating to de facto partners.</txt></block></li></list></definition><definition id="sec.3-ssec.1-def.property_" guid="_1b532c67-cb6e-443d-b815-86ca158c0ca7" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.1-def.property" guid="_4d3f9221-0105-44ab-b914-1b4124176421" type="definition">property</defterm> means any legal or equitable estate or interest (whether present or future and whether vested or contingent) in real or personal property of any description and wherever situated, including money or choses in action.</txt></definition></deflist></block></subclause><subclause id="sec.3-ssec.2" guid="_25b34f78-f56b-42f4-b990-e867d0382702" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For the purposes of this Act, a de facto relationship exists even if a de facto partner is legally married to someone else or is in another de facto relationship.</txt></block></subclause><subclause id="sec.3-ssec.3" guid="_d54874b0-b97f-424a-bf1b-a96c6d8cd620" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A reference in this Act—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.3-para1.a" guid="_c9f28e5a-5e65-4ae6-bcc9-3f14cd1222ac" provision.type="other"><no>(a)</no><block><txt break.before="0">to the property or other financial resources of de facto partners includes a reference to the property or other financial resources of either or both of them; and</txt></block></li><li id="sec.3-ssec.3-para1.b" guid="_34e1d961-5b5e-4378-8038-de51781d6024" provision.type="other"><no>(b)</no><block><txt break.before="0">to the distribution of any property or resources mentioned in <intref refid="sec.3-ssec.3-para1.a" target.guid="_c9f28e5a-5e65-4ae6-bcc9-3f14cd1222ac" check="valid">paragraph&#160;(a)</intref> includes a reference to the conferral of rights or obligations in relation to the property or resources.</txt></block></li></list></block></subclause><subclause id="sec.3-ssec.4" guid="_752a092f-c008-4544-a2d6-09a14d6ba5e3" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">This Act extends to de facto relationships that ended before the commencement of this Act.</txt></block></subclause></clause><clause id="sec.4" guid="_128447d8-0935-4d4b-8a86-79e2d26c87b9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_d39fff0f-9751-4b2d-8e31-a3993a5861aa">References</heading><subclause id="sec.4-ssec.1" guid="_1e727ff7-e836-4a3c-b869-9d5ce4d93bf3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The following matters, to the extent to which they are not otherwise included in the legislative powers of the Parliament of the Commonwealth, are referred to the Parliament of the Commonwealth for a period commencing on the day on which this Act commences and ending on the day fixed, under <intref refid="sec.5" target.guid="_dad960fc-35f9-4324-a52b-f6e9711bf946" check="valid">section&#160;5</intref>, as the day on which the references under this Act are to terminate, but no longer—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.1-para1.a" guid="_69fedfbb-b9dc-4004-9642-69654aabcef3" provision.type="other"><no>(a)</no><block><txt break.before="0">financial matters relating to de facto partners arising out of the breakdown (other than by reason of death) of de facto relationships between persons of different sexes;</txt></block></li><li id="sec.4-ssec.1-para1.b" guid="_3d5f4173-02b9-4a5b-a745-e13380c3a4e8" provision.type="other"><no>(b)</no><block><txt break.before="0">financial matters relating to de facto partners arising out of the breakdown (other than by reason of death) of de facto relationships between persons of the same sex.</txt></block></li></list></block></subclause><subclause id="sec.4-ssec.2" guid="_f6c57e9c-4359-4bb1-8e71-91ce4fe31c3d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The operation of each paragraph of <intref refid="sec.4-ssec.1" target.guid="_1e727ff7-e836-4a3c-b869-9d5ce4d93bf3" check="valid">subsection&#160;(1)</intref> is not affected by the other paragraph.</txt></block></subclause></clause><clause id="sec.5" guid="_dad960fc-35f9-4324-a52b-f6e9711bf946" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_7e7a1dff-0f14-486f-b018-e9faa99c195a">Termination of references</heading><subclause id="sec.5-ssec.1" guid="_8e58f0cd-13af-4ecf-baf5-68e514a18105" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The Governor may, at any time, by proclamation published in the gazette, fix a day as the day on which the references under this Act are to terminate.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_b241e0ee-313d-4c3e-a251-fbb8d88274bb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The day fixed under <intref refid="sec.5-ssec.1" target.guid="_8e58f0cd-13af-4ecf-baf5-68e514a18105" check="valid">subsection&#160;(1)</intref> must be no earlier than the first day after the end of the period of 3 months beginning with the day on which the proclamation is published in the gazette.</txt></block></subclause><subclause id="sec.5-ssec.3" guid="_72a947f2-8038-4f7e-b590-f794c6491dc0" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The Governor may, by proclamation, revoke a proclamation published under <intref refid="sec.5-ssec.1" target.guid="_8e58f0cd-13af-4ecf-baf5-68e514a18105" check="valid">subsection&#160;(1)</intref>, in which case the revoked proclamation is taken, for the purposes of <intref refid="sec.4" target.guid="_128447d8-0935-4d4b-8a86-79e2d26c87b9" check="valid">section&#160;4</intref>, never to have been published.</txt></block></subclause><subclause id="sec.5-ssec.4" guid="_315bcf66-cd7c-4294-811c-0d5660ea288c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A revoking proclamation has effect only if published before the day fixed under <intref refid="sec.5-ssec.1" target.guid="_8e58f0cd-13af-4ecf-baf5-68e514a18105" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.5-ssec.5" guid="_c01f28d7-4886-48da-9c12-1eab4b59231e" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The revocation of a proclamation published under <intref refid="sec.5-ssec.1" target.guid="_8e58f0cd-13af-4ecf-baf5-68e514a18105" check="valid">subsection&#160;(1)</intref> does not prevent publication of a further proclamation under that subsection.</txt></block></subclause><subclause id="sec.5-ssec.6" guid="_6c5e37d0-2ef0-4c74-9c5d-2241ac78ff9b" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A proclamation made under this section is subordinate legislation.</txt></block></subclause></clause></body></wrapper></act>
