target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" check="valid" jurisd="QLD" type="act">Act</legref>, a declaration of an apprenticeship or traineeship under <legref refid="sec.8" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" target.guid="_174caca3-291e-4d6c-97ba-5545510a767d" check="valid" jurisd="QLD" type="act">section&#160;8</legref><legref refid="sec.8-ssec.2" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" target.guid="_cbe18bde-416d-47fd-9e5d-c386570b978b" check="valid" jurisd="QLD" type="act">(2)</legref> of the <legref target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" check="valid" jurisd="QLD" type="act">Act</legref> may include the following prescribed requirements for the apprenticeship or traineeship—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.a" guid="_1bef07da-df08-4c78-8c92-23948e5e8c91" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the level of education a person must have reached before starting the apprenticeship or traineeship;</txt></block></li><li id="sec.3-ssec.1-para1.b" guid="_57fee021-6def-4b2b-9653-435c3b2c80b4" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">that a person can not start the apprenticeship or traineeship without prior written approval of a nominated entity for the apprenticeship or traineeship;</txt></block></li><li id="sec.3-ssec.1-para1.c" guid="_6dc258c9-6dfb-4b06-9a2c-f3188f666555" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">that a person completing the apprenticeship or traineeship (the <defterm id="sec.3-ssec.1-def.relevantapprenticeortrainee" guid="_83883970-44f5-427c-aac5-5674f2ed8dc4" type="definition">relevant apprentice or trainee</defterm>) must be supervised;</txt></block></li><li id="sec.3-ssec.1-para1.d" guid="_7611e992-c5c6-419f-835a-6bc187ad2888" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">if the relevant apprentice or trainee must be supervised—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.d-para2.i" guid="_488463b5-96a0-49c5-8d60-9020a0dcecfa" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the qualifications and experience the supervisor must have; and</txt></block></li><li id="sec.3-ssec.1-para1.d-para2.ii" guid="_5dae484c-1399-4950-b7ae-d289e8a6e0d6" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">that the supervisor—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.d-para2.ii-para3.A" guid="_83bdc106-c96e-45f2-807d-7e40b73bbcd0" provision.type="other" affected.by.uncommenced="0"><no>(A)</no><block><txt break.before="0">may also, at a place the apprenticeship or traineeship is being completed, supervise other apprentices or trainees; or</txt></block></li><li id="sec.3-ssec.1-para1.d-para2.ii-para3.B" guid="_d54ffe7c-980b-47b0-9f49-1f24e0e22e29" provision.type="other" affected.by.uncommenced="0"><no>(B)</no><block><txt break.before="0">must not, at a place the apprenticeship or traineeship is being completed, supervise other apprentices or trainees; and</txt></block></li></list></block></li><li id="sec.3-ssec.1-para1.d-para2.iii" guid="_7248bd26-f8f7-4ead-a063-74a95b9afe3b" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">for a supervisor who may supervise other apprentices or trainees under <intref refid="sec.3-ssec.1-para1.d-para2.ii" target.guid="_5dae484c-1399-4950-b7ae-d289e8a6e0d6" check="valid">subparagraph&#160;(ii)</intref><intref refid="sec.3-ssec.1-para1.d-para2.ii-para3.A" target.guid="_83bdc106-c96e-45f2-807d-7e40b73bbcd0" check="valid">(A)</intref>—the number of other apprentices or trainees the supervisor may supervise;</txt></block></li></list></block></li><li id="sec.3-ssec.1-para1.e" guid="_ba732fea-abe7-4078-ac65-56a18ad4289c" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">other requirements relating to the nature and quality of the supervision of the apprenticeship or traineeship that the chief executive considers relevant.</txt></block></li></list></block></subclause><subclause id="sec.3-ssec.2" guid="_b72a204e-bdf0-4a5c-9ae1-ab0d07de4656" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-ssec.2-def.nominatedentity_" guid="_6cb71e40-81cb-41d3-8bfa-4cb32b362506" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.2-def.nominatedentity" guid="_b20d4b7b-d989-43c1-ac70-37ab394e5b07" type="definition">nominated entity</defterm>, for an apprenticeship or traineeship, means an employer group, industry body or regulatory authority nominated in the declaration of the apprenticeship or traineeship under <legref refid="sec.8" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" target.guid="_174caca3-291e-4d6c-97ba-5545510a767d" check="valid" jurisd="QLD" type="act">section&#160;8</legref><legref refid="sec.8-ssec.2" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" target.guid="_cbe18bde-416d-47fd-9e5d-c386570b978b" check="valid" jurisd="QLD" type="act">(2)</legref> of the <legref target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" check="valid" jurisd="QLD" type="act">Act</legref>.</txt></definition></deflist></block></subclause></clause></part><part id="pt.3" guid="_d82854c5-b2e1-4a40-8cad-365a666a8767" affected.by.uncommenced="0"><no>Part 3</no><heading id="pt.3-he" guid="_0ee0ff2d-c97d-4594-a780-655ce3e4829a">Training records</heading><clause id="sec.4" guid="_62129032-ac39-4206-8360-928bc2e049c4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>4</no><heading id="sec.4-he" guid="_2d15cd88-df47-40f6-92c9-c14591c33e27">Prescribed training records</heading><block><txt break.before="0">For <legref jurisd="QLD" type="act" refid="sec.41" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" target.guid="_caf7f841-6be1-4e27-8c48-66e2029096bd" check="valid">section&#160;41</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" check="valid">Act</legref>, definition <defterm guid="_531660a5-a5ce-45f2-b232-48945ef6fa4e" type="mention">misconduct</defterm>, <intref refid="sec.4-para1.b" check="invalid">paragraph&#160;(b)</intref><intref refid="sec.4-para1.b-para2.i" check="invalid">(i)</intref>, a record of the apprentice’s or trainee’s progress towards, and achievement of, the competencies outlined in the apprentice’s or trainee’s training plan, is prescribed as a training record.</txt></block></clause><clause id="sec.5" guid="_e5b57f22-7155-45dd-b1fd-1d56db30f2c0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_ce56b4fc-a922-4550-bf0a-87d4a6834a61">Requirement to give training records</heading><subclause id="sec.5-ssec.1" guid="_67a3c6da-3866-46b9-bf42-df306645b1e8" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The supervising registered training organisation for the apprentice or trainee must give a training record mentioned in <intref refid="sec.4" target.guid="_62129032-ac39-4206-8360-928bc2e049c4" check="valid">section&#160;4</intref> to the apprentice or trainee within 14 days after all parties sign a training plan for the apprentice or trainee.</txt><penalty id="sec.5-ssec.1-pen" guid="_f4c71381-e767-415d-8d7f-dcfdd709576f"><block><txt break.before="1">Maximum penalty—20 penalty units.</txt></block></penalty></block></subclause><subclause id="sec.5-ssec.2" guid="_1628fe70-8351-4d42-a36c-3671b477ab76" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">This section does not apply if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_e7ff5c24-87a5-4312-9490-a917b97c5b66" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a training plan for the apprentice or trainee is signed because of the permanent, temporary or statutory transfer of the registered training contract; and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_da9498d7-799a-4506-bc2a-d0e7bf34271d" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the apprentice or trainee has a training record for the apprenticeship or traineeship that was provided by the supervising registered training organisation under <intref refid="sec.5-ssec.1" target.guid="_67a3c6da-3866-46b9-bf42-df306645b1e8" check="valid">subsection&#160;(1)</intref>.</txt></block></li></list></block></subclause></clause><clause id="sec.6" guid="_71590dce-9f09-43ec-941d-dd1e4d379bbb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_96683bf2-df71-4127-9f95-031c9bd09bde">Keeping training records</heading><subclause id="sec.6-ssec.1" guid="_423ca057-6310-41f8-b2f9-f6d56e1ba1cb" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For <legref jurisd="QLD" type="act" refid="sec.41" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" target.guid="_caf7f841-6be1-4e27-8c48-66e2029096bd" check="valid">section&#160;41</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" check="valid">Act</legref>, definition <defterm guid="_77b2132e-970b-41f3-8090-cee79bdb66f5" type="mention">misconduct</defterm>, <intref refid="sec.6-ssec.1-para1.b" target.guid="_3ec3ba29-d621-4efe-a5d6-c6312365d1ea" check="valid">paragraph&#160;(b)</intref><intref refid="sec.6-ssec.1-para1.b-para2.i" check="invalid">(i)</intref>, the prescribed way to keep a training record is as follows—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_3ae19afb-7464-4d73-87b9-e090689e47f5" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the record must be in the form decided by the supervising registered training organisation for the apprentice or trainee;</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_3ec3ba29-d621-4efe-a5d6-c6312365d1ea" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the record must be complete and accurate with the particulars of training completed by the apprentice or trainee;</txt></block></li><li id="sec.6-ssec.1-para1.c" guid="_dd89527c-99f8-42fa-933b-b0f7f1c2bbc3" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the record must be in the possession of the apprentice or trainee unless the apprentice or trainee has produced it to a person under the <legref jurisd="QLD" type="act" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" check="valid">Act</legref>;</txt></block></li><li id="sec.6-ssec.1-para1.d" guid="_7d5d4af2-965e-4283-85a0-99bd836f374f" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">the record must be kept by the apprentice or trainee for the duration of the apprenticeship or traineeship.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_7b921d71-77da-4774-bf09-dc06bc117c3a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If training is required to be delivered by the employer, for <intref refid="sec.6-ssec.1" target.guid="_423ca057-6310-41f8-b2f9-f6d56e1ba1cb" check="valid">subsection&#160;(1)</intref><intref refid="sec.6-ssec.1-para1.b" target.guid="_3ec3ba29-d621-4efe-a5d6-c6312365d1ea" check="valid">(b)</intref>, the employer must, at reasonable intervals of not more than 3 months, require the apprentice or trainee to produce the training record to the employer to be updated.</txt></block></subclause><subclause id="sec.6-ssec.3" guid="_b0407f52-2f77-4c26-8dc1-76b1ad7c4a24" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive may, by reasonable notice, require the apprentice or trainee to produce the training record to the chief executive for inspection.</txt><note id="sec.6-ssec.3-note" guid="_7db4d3c7-3215-4f0b-ad87-5bce04c4b28e" type="example"><heading id="sec.6-ssec.3-note-he" guid="_fe5a62d9-6469-4127-bf48-5db761308f71">Note—</heading><block><txt break.before="1">See also <legref jurisd="QLD" type="act" refid="sec.41" target.doc.id="act-2014-025" target.version.series="34e97469-5af1-4946-a954-6c90f8ca4a53" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_4802e4d9-e3ca-429b-b98a-6f60688ecd43">Recording training delivered by supervising registered training organisation</heading><block><txt break.before="0">If training is required to be delivered by the supervising registered training organisation for an apprenticeship or traineeship, the supervising registered training organisation must, at reasonable intervals of not more than 3 months—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-para1.a" guid="_051c6619-fdf0-4081-99f0-ddd6a80d2176" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">require the apprentice or trainee to produce a training record mentioned in <intref refid="sec.4" target.guid="_62129032-ac39-4206-8360-928bc2e049c4" check="valid">section&#160;4</intref>; and</txt></block></li><li id="sec.7-para1.b" guid="_4b9a7546-a1f4-454c-bb1b-0acfda70bac3" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the training record is produced—update and keep the record complete and accurate with the particulars of
