of plan</heading><block><txt break.before="1">The purposes of this plan are to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.a" guid="_6d749727-f4f7-43ea-803d-beba15107388" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">conserve viable populations of estuarine crocodiles in the wild; and</txt></block></li><li id="sec.3-para1.b" guid="_42e953a2-a9e1-4a17-9381-a74e2951b62d" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">protect humans from problem crocodiles; and</txt></block></li><li id="sec.3-para1.c" guid="_02480e59-4f76-4135-b0bb-8931dd3f2bca" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">prevent the loss of aquaculture fisheries resources, stock and working dogs from problem crocodile attacks; and</txt></block></li><li id="sec.3-para1.d" guid="_636b77c8-1918-4a59-a9ee-d69a4f41cc32" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">ensure the commercial use of estuarine crocodiles is affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The dictionary in <intref refid="sch.1" target.guid="_52896f5e-d7f4-41ce-88b5-31cade5113a2" check="valid">schedule&#160;1</intref> defines particular terms used in this plan.</txt></block></subclause><subclause id="sec.4-ssec.2" guid="_5c66273d-b0f6-49b7-84cb-aaacedba57fd" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Subject to <intref refid="sec.4-ssec.1" target.guid="_21989502-7db8-42ee-af05-0853871433c9" check="valid">subsection&#160;(1)</intref>, and unless this plan provides otherwise, terms used in this plan have the same meaning as they have in the <legref jurisd="QLD" type="subordleg" crocodile</defterm></heading><subclause id="sec.5-ssec.1" guid="_b7e6ccb0-df94-48d8-9f2d-995339333adf" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">An estuarine crocodile in the wild is a <defterm id="sec.5-def.problemcrocodile-oc.2" guid="_9c0143b5-44e3-462a-866b-a4e0ac84b0d8" type="definition">problem crocodile</defterm> if the chief executive considers the crocodile is, or is likely to become, a danger to humans.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_6526a80e-8972-4d91-b402-937d61190939" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Also, an estuarine crocodile in the wild is a <defterm id="sec.5-def.problemcrocodile-oc.3" guid="_731402b4-3133-40da-8fdd-5917e04758b2" type="definition">problem crocodile</defterm> if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_fddbee5a-6bee-44a2-b518-ed71bcf1cb12" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the crocodile has passed over, through or under a crocodile prevention barrier on land, other than land in a protected area, on which aquaculture fisheries resources, stock or a working dog normally live; and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_411f5142-8b40-4f90-a747-8cbf613f5c62" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the chief executive considers the crocodile is, or is likely to become, a danger to the aquaculture fisheries resources, stock or working dog.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.3" guid="_ebfecf32-fb83-4ba4-934e-453a967141c5" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Without limiting <intref refid="sec.5-ssec.1" target.guid="_b7e6ccb0-df94-48d8-9f2d-995339333adf" check="valid">subsection&#160;(1)</intref>, the chief executive may consider an estuarine crocodile is, or is likely to become, a danger to humans if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.3-para1.a" guid="_273b7290-0183-463f-b9f1-4975f932f8b0" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the crocodile has attacked, is about to attack, or is behaving aggressively towards, a person; or</txt></block></li><li id="sec.5-ssec.3-para1.b" guid="_f23a264e-8016-4719-9dde-473f3b2dd8c0" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the chief executive reasonably believes the nature of the crocodile’s location or behaviour makes the crocodile a threat, or a potential threat, to the safety or wellbeing of humans.</txt><note id="sec.5-ssec.3-para1.b-note" guid="_e76bd7c0-04fd-41ae-8329-9c4c569c8547" type="example"><heading id="sec.5-ssec.3-para1.b-note-he" guid="_21e09200-72c6-434d-9c5e-e131b3c33dc4">Example for <intref refid="sec.5-ssec.3-para1.b" target.guid="_f23a264e-8016-4719-9dde-473f3b2dd8c0" check="valid">paragraph&#160;(b)</intref>—</heading><block><txt break.before="1">An estuarine crocodile is in an urban area, or a public area commonly used by persons for recreation and in which estuarine crocodiles do not normally live, and has been in the area for an extended period or is frequently in the area.</txt></block></note></block></li></list></block></subclause><subclause id="sec.5-ssec.4" guid="_160449d4-ef4a-4e13-bfd8-beb873739cb9" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Without limiting <intref refid="sec.5-ssec.2" target.guid="_6526a80e-8972-4d91-b402-937d61190939" check="valid">subsection&#160;(2)</intref><intref refid="sec.5-ssec.2-para1.b" target.guid="_411f5142-8b40-4f90-a747-8cbf613f5c62" check="valid">(b)</intref>, the chief executive may consider an estuarine crocodile is, or is likely to become, a danger to aquaculture fisheries resources, stock or a working dog if the crocodile has attacked, is about to attack, or is behaving aggressively towards, the aquaculture fisheries resources, stock or working dog.</txt></block></subclause><subclause id="sec.5-ssec.5" guid="_e0545b20-09cf-45f5-880b-e596c60b2f93" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-ssec.5-def.crocodilepreventionbarrier_" guid="_4c8290c7-9298-4d2c-8d6a-e33ccaea5202" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.5-def.crocodilepreventionbarrier" guid="_ebdfe58f-dcfb-4447-bf40-d305405e9b5b" type="definition">crocodile prevention barrier</defterm> means a barrier that is reasonably likely to prevent crocodiles from passing over, through or under it.</txt></definition></deflist></block></subclause></clause></part><part id="pt.2" guid="_824f24d7-5f40-481c-a546-eed6f7cd8dc0" affected.by.uncommenced="0"><no>Part 2</no><heading id="pt.2-he" guid="_86f5e5cc-a3b7-40a9-819b-4f0ba04bc10d">Problem crocodiles</heading><division id="pt.2-div.1" guid="_863337c2-762c-4f7d-831f-b12ab9dcaef4" affected.by.uncommenced="0"><no>Division 1</no><heading id="pt.2-div.1-he" guid="_e8595365-318b-4682-8081-5d7924d5b482">Scheme for giving problem crocodiles to Queensland crocodile keepers</heading><clause id="sec.6" guid="_02fa50b1-35b6-4e01-bf66-5b6c20057efd" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_cac9a80b-883c-44b0-a995-380b2b3a1e80">Establishing scheme</heading><subclause id="sec.6-ssec.1" guid="_fb976eb5-0fd9-44da-8685-418f0ea4a1f7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The chief executive may establish a scheme for giving problem crocodiles to eligible Queensland crocodile keepers.</txt></block></subclause><subclause id="sec.6-ssec.2" guid="_1569f83f-80f4-418a-9b6c-ad40f6352626" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The chief executive must ensure the scheme—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a" guid="_d540ffaa-01a1-46d0-bc45-6539ad157d4b" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">gives all Queensland crocodile keepers the same opportunity to become eligible to obtain a problem crocodile under the scheme; and</txt></block></li><li id="sec.6-ssec.2-para1.b" guid="_90724191-f600-44a7-b616-d3e4cfcd9974" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">allows a Queensland crocodile keeper to become eligible to obtain a problem crocodile under the scheme only if the keeper—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.b-para2.i" guid="_614c19b2-0f0a-4b7f-8acb-e1280c172977" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">intends to use problem crocodiles under a Queensland crocodile licence mainly for breeding or for displaying the crocodiles to the public; and</txt></block></li><li id="sec.6-ssec.2-para1.b-para2.ii" guid="_91963195-cef7-4753-88c1-0d4355b8447d" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">has appropriate experience in keeping and using estuarine crocodiles in a way that complies with the <legref jurisd="QLD" type="act" target.doc.id="act-1992-020" target.version.series="5a5e324b-388d-450f-843c-b363ee68996c" check="valid">Act</legref>; and</txt></block></li><li id="sec.6-ssec.2-para1.b-para2.iii" guid="_f81b3e03-2512-4959-8708-80609a2f24e8" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">has appropriate facilities for keeping and using estuarine crocodiles; and</txt></block></li><li id="sec.6-ssec.2-para1.b-para2.iv" guid="_8044ec00-14fe-4f69-96f5-d76b7dd26d48" provision.type="other" affected.by.uncommenced="0"><no>(iv)</no><block><txt break.before="0">if the keeper intends to display the crocodile under a Queensland crocodile licence—displays the crocodile for an approved display purpose and has a facility to display the crocodile in a way that complies with the <legref jurisd="QLD" type="act" target.doc.id="act-1992-020" target.version.series="5a5e324b-388d-450f-843c-b363ee68996c" check="valid">Act</legref>; and</txt></block></li></list></block></li><li id="sec.6-ssec.2-para1.c" guid="_96e47426-4d48-4dd4-be03-d394612ab72e" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">allows a Queensland crocodile keeper to become eligible to obtain an icon crocodile under the scheme only if the keeper is prepared to enter into an icon crocodile agreement for the crocodile; and</txt></block></li><li id="sec.6-ssec.2-para1.d" guid="_e9d83bfc-d0cb-4ea0-a6cd-b2d7343b6cae" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">provides for giving problem crocodiles to eligible Queensland crocodile keepers in a way that ensures the keepers have equitable access to problem crocodiles.</txt><note id="sec.6-ssec.2-para1.d-note" guid="_f8dc2299-5da0-4934-b29f-c7998708ff91" type="example"><heading id="sec.6-ssec.2-para1.d-note-he" guid="_a2d2e90b-16e2-4036-b516-1d9f683bfd46">Examples for <intref refid="sec.6-ssec.2-para1.d" target.guid="_e9d83bfc-d0cb-4ea0-a6cd-b2d7343b6cae" check="valid">paragraph&#160;(d)</intref>—</heading><block><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.d-note-para2" guid="_e7be5e15-85cc-48de-bedf-dca8d1d44543" provision.type="other" affected.by.uncommenced="0"><no>•</no><block><txt break.before="0">a system under which each eligible Queensland crocodile keeper guid="_555516f6-54c2-4f58-94d3-db8f27c62929" affected.by.uncommenced="0"><no>Subdivision 1</no><heading id="pt.2-div.2-sdiv.1-he" guid="_eb09b15b-2aab-4e0f-9b8c-35227832c855">Grant of authority</heading><clause id="sec.7" guid="_cb708dd4-1227-40be-9e36-5389afd46440" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_4481e139-713d-49a3-b126-0d8056fd3793">Persons to whom authority may be granted</heading><block><txt break.before="1">The chief executive may grant, with or without conditions, a crocodile management authority to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-para1.a" guid="_03d47068-2038-47ce-8f11-cbbd19858e6f" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">an approved person; or</txt></block></li><li id="sec.7-para1.b" guid="_b5f5aa2b-b992-4f60-86cb-7691f644223f" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a prescribed officer who is not a conservation officer.</txt></block></li></list></block></clause><clause id="sec.8" guid="_9400c97a-cdd4-4bb6-9fa4-473d5a035de5" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_81a602f9-7215-455e-a9d6-e499006c34b8">Authority granted to approved persons authorising employees</heading><subclause id="sec.8-ssec.1" guid="_fb70cefd-03da-4945-b77d-af7f950075d3" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a crocodile management authority granted to an approved person.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_716c099d-ff3f-412e-a168-f39cec17466a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The approved person may, before the authority is granted, ask the chief executive to grant the authority to authorise the approved person and an employee of the approved person to act under the authority.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_cabda291-3194-4eae-8ea7-dde856e3a0cd" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive may grant the authority to the approved person in a way that also authorises the employee to act under the authority if the chief executive is satisfied the employee is an approved person.</txt></block></subclause><subclause id="sec.8-ssec.4" guid="_efef94af-50d4-41c8-96c9-04d08a238bbc" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The chief executive grants the authority in a way that also authorises the employee to act under the authority if the chief executive writes the employee’s name on the authority.</txt></block></subclause></clause><clause id="sec.9" break.before="0">This section applies to a crocodile management authority granted to an approved person.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_9673c8a6-b6e0-4cef-8d02-af99ce065e3b" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The holder of the crocodile management authority may ask the chief executive to amend the authority to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_b8481f30-8f6d-4805-86c6-131539c33599" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">authorise an employee of the holder to act under the authority; or</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_49843a49-683e-40b4-a1c6-0122b903f43e" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">remove the authority of an employee, or former employee, who is authorised to act under the authority.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_f08d2d6c-827a-4df2-9678-0cf68d555a5f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The chief executive may amend the authority in the way requested by the holder.</txt></block></subclause><subclause id="sec.9-ssec.4" guid="_027dce25-6d49-4c66-8d9e-a75388be48ea" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The chief executive amends the authority in a way that authorises the employee to act under the authority if the chief executive writes the employee’s name on the authority.</txt></block></subclause><subclause id="sec.9-ssec.5" guid="_1d34ae4b-597a-41be-ae26-f1fb560befb2" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The chief executive amends the authority in a way that removes the authority of the employee or former employee to act under the authority if the chief executive removes the name of the employee or former employee from the number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a" guid="_e74f1baa-d129-4ffc-8c43-1244438083aa" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">for a crocodile management authority granted to an approved person—2 years; or</txt></block></li><li id="sec.10-para1.b" guid="_1b83abb5-47b8-450b-b071-7fdf2980f0e3" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">for a crocodile management authority granted to a prescribed officer—3 years.</txt></block></li></list></block></clause></subdivision><subdivision id="pt.2-div.2-sdiv.2" guid="_ea3eab4e-c488-4570-92f6-1fed454ef472" affected.by.uncommenced="0"><no>Subdivision affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_d446cc4b-b01d-4fd8-9d31-09265baa749f">Catching problem crocodiles under authority held by approved person</heading><subclause id="sec.11-ssec.1" guid="_c75b8410-d6ec-4208-9620-1ec80ff6fc11" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the holder of a crocodile management authority is an approved person.</txt></block></subclause><subclause id="sec.11-ssec.2" guid="_593fe697-0ea3-4c50-97af-98a2fb6157cf" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The holder, or an employee of the holder authorised to act under the authority, may catch an estuarine crocodile under the authority, in the way stated on the authority, if the chief executive has given the holder a written notice identifying the crocodile as a problem crocodile.</txt></block></subclause></clause><clause id="sec.12" guid="_0af093d3-616f-44da-a05f-17d1ed304b75" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_dab37bf4-e337-4124-8523-42a45cb13c2f">Catching, dealing with and euthanasing problem crocodiles under authority held by prescribed officer</heading><subclause id="sec.12-ssec.1" guid="_3c9f9142-9576-45f0-ac06-00286d9faf90" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the holder of a crocodile management authority is a prescribed officer.</txt></block></subclause><subclause id="sec.12-ssec.2" guid="_be281093-c3b5-492d-a269-eee4db257831" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The holder may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.a" guid="_368475f4-c418-4730-8132-dbfe3c7e3dac" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">catch an estuarine crocodile under the authority, in the way stated on the authority, if the chief executive has given the holder a written notice identifying the crocodile as a problem crocodile; and</txt></block></li><li id="sec.12-ssec.2-para1.b" guid="_f19a2e58-8dbe-4e4a-a470-b49127103fc1" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">after catching the crocodile, deal with the crocodile—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.2-para1.b-para2.i" guid="_075212ae-e05b-49a0-8b3b-4e7e86395b89" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">in the way stated on the authority; or</txt></block></li><li id="sec.12-ssec.2-para1.b-para2.ii" guid="_2a5fe0cd-8a4a-4aa5-b5b0-15ae0d056c18" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if the notice mentioned in <intref refid="sec.12-ssec.2-para1.a" target.guid="_368475f4-c418-4730-8132-dbfe3c7e3dac" check="valid">paragraph&#160;(a)</intref> states a different way for dealing with the crocodile—in the way stated in the notice.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.12-ssec.3" guid="_5392769b-cfb6-4d95-bfa1-ea1bc20db745" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Also, if the notice mentioned in <intref refid="sec.12-ssec.2" target.guid="_be281093-c3b5-492d-a269-eee4db257831" check="valid">subsection&#160;(2)</intref><intref refid="sec.12-ssec.2-para1.a" target.guid="_368475f4-c418-4730-8132-dbfe3c7e3dac" check="valid">(a)</intref> states the holder may euthanase the crocodile identified in the notice in a stated way, the holder may, under the authority, euthanase the crocodile in the stated way.</txt></block></subclause><subclause id="sec.12-ssec.4" guid="_8a5600f2-525a-4202-bd6a-b0b42f3a1546" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The chief executive may give a notice stating the crocodile may be euthanased in a stated way only if the chief executive is satisfied it is necessary to euthanase the crocodile in the circumstances.</txt><note id="sec.12-ssec.4-note" guid="_da327591-1c7b-4a8c-97ce-e0c62d3cb9af" type="example"><heading id="sec.12-ssec.4-note-he" guid="_9dd35936-8638-4055-af77-ee3432f261d0">Example of when chief executive may be satisfied for <intref refid="sec.12-ssec.4" target.guid="_8a5600f2-525a-4202-bd6a-b0b42f3a1546" check="valid">subsection&#160;(4)</intref>—</heading><block><txt break.before="1">the crocodile is in a remote location and has attacked, or is about to attack, a person</txt></block></note></block></subclause></clause></subdivision><subdivision id="pt.2-div.2-sdiv.3" guid="_c36016c2-140b-4a26-80c5-0ca8a21e79c2" affected.by.uncommenced="0"><no>Subdivision 3</no><heading id="pt.2-div.2-sdiv.3-he" guid="_07a65d4f-df5a-4242-8f68-2c0d51352724">Carrying out activities under authority granted to approved person</heading><clause id="sec.13" guid="_f5b5265a-e1e3-4e9d-a2a5-89e3666fc2fd" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>13</no><heading id="sec.13-he" guid="_7be27e72-b6c4-4e11-aad8-cd9ef0dd0da4">Application of subdivision</heading><block><txt break.before="1">This subdivision applies if a crocodile management authority is granted to an approved person.</txt></block></clause><clause id="sec.14" guid="_cb4a762f-4aef-48d1-9cd0-f18bbbc2936b" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>14</no><heading id="sec.14-he" guid="_2e66cbc7-fef4-44fe-b9ad-ad44f23763c7">Compliance with conditions of authority</heading><block><txt break.before="1">A person acting under the crocodile management authority must comply with the conditions of the authority unless the person has a reasonable excuse.</txt></block><penalty id="sec.14-pen" guid="_aa10ccf8-2ef1-4250-b27b-96ebd302047a"><block><txt break.before="1">Maximum penalty—80 penalty units.</txt></block></penalty></clause><clause id="sec.15" guid="_b7077ace-e2e7-49df-8d5f-fb6572f49edb" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>15</no><heading id="sec.15-he" guid="_b307fee6-13bb-4e59-bde8-02a3e2159a6c">Holder must start activities under authority</heading><subclause id="sec.15-ssec.1" guid="_50c466e7-b007-463b-862d-95094925965f" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if the chief executive has given the holder of the crocodile management authority a written notice identifying a problem crocodile that may be caught under the authority.</txt></block></subclause><subclause id="sec.15-ssec.2" guid="_7296c9f1-7e5d-40c2-a0b3-5fa609ec5ac3" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The holder must, within 72 hours after the day the notice is given—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.2-para1.a" guid="_cf9401cc-53c5-40a4-aefb-a6f36822534e" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">put the equipment to be used to catch the crocodile in place; or</txt></block></li><li id="sec.15-ssec.2-para1.b" guid="_96c70d38-378f-4215-93c3-b8e105cd26d6" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the holder intends to catch the crocodile by using a method that does not involve the placement of equipment—take reasonable steps to ensure the crocodile is caught within a reasonable period.</txt></block></li></list></block></subclause><subclause id="sec.15-ssec.3" guid="_36b0c822-6e83-4dfb-a398-6abb10e66272" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the holder does not comply with <intref refid="sec.15-ssec.2" target.guid="_7296c9f1-7e5d-40c2-a0b3-5fa609ec5ac3" check="valid">subsection&#160;(2)</intref>, the chief executive may cancel the authority.</txt></block></subclause><subclause id="sec.15-ssec.4" guid="_6841258f-d166-4d9a-9201-06f0c7f0d416" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Before acting under <intref refid="sec.15-ssec.3" target.guid="_36b0c822-6e83-4dfb-a398-6abb10e66272" check="valid">subsection&#160;(3)</intref>, the chief executive must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.4-para1.a" guid="_44e3145d-9cef-4374-b2e6-653399cd3bec" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">advise the holder that the chief executive proposes to cancel the authority under this section; and</txt></block></li><li id="sec.15-ssec.4-para1.b" guid="_03d3dff1-5af9-466a-8162-0ebad6b84943" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">give the holder a reasonable opportunity to make a written submission to the chief executive about the proposed cancellation; and</txt></block></li><li id="sec.15-ssec.4-para1.c" guid="_091114b3-a888-48cf-9b09-bf13ec1139b9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">have regard to all submissions made by the holder.</txt></block></li></list></block></subclause><subclause id="sec.15-ssec.5" guid="_8d995576-bfa3-4580-a6aa-59ff44993fa8" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">However, <intref refid="sec.15-ssec.4" target.guid="_6841258f-d166-4d9a-9201-06f0c7f0d416" check="valid">subsection&#160;(4)</intref> does not apply if the chief executive reasonably believes—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.5-para1.a" guid="_f7568e92-4cfa-4db7-9626-d1fc9c541f6f" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">complying with the subsection will adversely affect—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-ssec.5-para1.a-para2.i" guid="_6208a0c0-3227-4dd1-b318-e661f467d342" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the likelihood of catching the crocodile; or</txt></block></li><li id="sec.15-ssec.5-para1.a-para2.ii" guid="_8a3a73e0-9700-4024-90cc-cee4f35fa977" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the likelihood of catching the crocodile before it attacks a person, aquaculture fisheries resources, stock or a working dog; and</txt></block></li></list></block></li><li id="sec.15-ssec.5-para1.b" guid="_0164da1d-dcfa-45ee-b3b8-3c43011b6852" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">it is necessary that another person catch the crocodile.</txt></block></li></list></block></subclause></clause><clause id="sec.16" guid="_f1948255-b378-496f-9446-5dc65edb42d4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>16</no><heading id="sec.16-he" guid="_f11318b7-e85e-43a5-a140-33241cbd4f8a">Way problem crocodiles may be caught, kept and moved generally</heading><block><txt break.before="1">A person who catches, keeps or moves a problem crocodile under the crocodile management authority or <intref refid="pt.2-div.2-sdiv.4" target.guid="_05500884-e52d-44a7-827f-e0ae057dac1a" check="valid">subdivision&#160;4</intref> must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.16-para1.a" guid="_5c5cf8f9-a20a-4608-9c22-83d8677de2ea" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">catch, keep and move the crocodile in a way that complies with the Australian Crocodile Code; and</txt></block></li><li id="sec.16-para1.b" guid="_18100559-7f4a-4d26-a54f-eb99206cb8d8" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if required by the chief executive—catch, keep and move the crocodile in the presence of a conservation officer.</txt></block></li></list></block><penalty id="sec.16-pen" guid="_71c016ed-6d2a-46b2-b991-e33199323dc4"><block><txt break.before="1">Maximum penalty—20 penalty units.</txt></block></penalty></clause></subdivision><subdivision id="pt.2-div.2-sdiv.4" provision.type="other"><no>18</no><heading id="sec.18-he" guid="_bed2d2f5-7fbc-4ad4-a73f-9b6936b1c2fd">Dealing with live problem crocodiles if direction given by chief executive</heading><subclause id="sec.18-ssec.1" guid="_4e512227-24e3-491e-8be7-e5f7e56f2d68" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.1-para1.a" guid="_b50ec298-90a7-4622-acb5-c2afd51eaf09" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a person acting under the crocodile management authority catches a problem crocodile; and</txt></block></li><li id="sec.18-ssec.1-para1.b" guid="_17acba34-462a-4d3a-acc7-d77ae0288388" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the crocodile is alive after it is caught; and</txt></block></li><li id="sec.18-ssec.1-para1.c" guid="_9c8b31c6-f482-41ed-b4d1-46c24ca8e397" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the chief executive gives the person a written direction to deal with the crocodile in a particular way.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.2" guid="_b9a08a64-9de3-4268-9d55-d139a370d246" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The person must deal with the crocodile in the way stated in the direction.</txt></block><penalty id="sec.18-ssec.2-pen" guid="_4f2b3af7-89a9-4237-9de7-8ad103148010"><block><txt break.before="1">Maximum penalty—20 penalty units.</txt></block></penalty></subclause><subclause id="sec.18-ssec.3" guid="_157570e2-bbc9-46e7-8dc8-24994cebfece" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A person who deals with a problem crocodile in the way stated in the direction is authorised under the <legref jurisd="QLD" type="act" target.doc.id="act-1992-020" target.version.series="5a5e324b-388d-450f-843c-b363ee68996c" check="valid">Act</legref> to deal with the crocodile in that way.</txt></block></subclause><subclause id="sec.18-ssec.4" guid="_5a85075b-bf7b-469d-84f5-a1f9f45540f3" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Without limiting the directions the chief executive may give for this section, the chief executive may direct a person who catches a problem crocodile under the crocodile management authority to move the crocodile—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.4-para1.a" guid="_d2aa811e-308e-4fe8-ae5f-af453499ce53" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the chief executive has given the crocodile to the person—to the place where the person intends to keep the crocodile under the <legref jurisd="QLD" type="act" target.doc.id="act-1992-020" target.version.series="5a5e324b-388d-450f-843c-b363ee68996c" check="valid">Act</legref>; or</txt></block></li><li id="sec.18-ssec.4-para1.b" guid="_0fe4e1d6-2237-4968-a432-a2c6db68bba9" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the chief executive has given the crocodile to another person—to a place nominated by that person; or</txt></block></li><li id="sec.18-ssec.4-para1.c" guid="_879226f5-9a34-4e1b-b818-011b5edb5517" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">to a place nominated by the chief executive.</txt></block></li></list></block></subclause><subclause id="sec.18-ssec.5" guid="_125969cf-4969-4cbb-9536-bdc2c4fa6a2b" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">However, if the approval of an entity is required before a problem crocodile may be moved into another State, the chief executive may give a direction to move the crocodile into that State only if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.5-para1.a" guid="_59231a4c-46be-4b74-a3c8-3e88e389d2a8" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the approval of the entity has been given; or</txt></block></li><li id="sec.18-ssec.5-para1.b" guid="_ec4a5521-190c-42c4-bf24-92baa7ae5915" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the chief executive is satisfied the approval of the entity will be given.</txt></block></li></list></block></subclause></clause><clause id="sec.19" guid="_0a276e43-58c2-409d-a500-57b9f44ca263" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>19</no><heading id="sec.19-he" guid="_665ed3bf-1ff4-4775-8cea-590fdbadb3de">Keeping live problem crocodiles if no direction by chief executive</heading><subclause id="sec.19-ssec.1" guid="_cb71a7e7-58d5-4540-8c92-0da8a5151c20" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.1-para1.a" guid="_827643fd-183d-45e5-8678-3ef2fbe52d43" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a person acting under the crocodile management authority catches a problem crocodile; and</txt></block></li><li id="sec.19-ssec.1-para1.b" guid="_923642aa-84ae-4ae7-adca-7eb24977c12b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the crocodile is alive after it is caught; and</txt></block></li><li id="sec.19-ssec.1-para1.c" guid="_0fcdd88e-0268-43b6-bb76-626b18384534" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the chief executive has not directed the person to deal with the crocodile in a particular way under <intref refid="sec.18" target.guid="_56733b95-ac3b-4892-afa8-42b680724378" id="sec.19-ssec.2-para1.a" guid="_13a3fdfa-8099-410e-b1e3-f8fcc046f396" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">receives appropriate care; and</txt></block></li><li id="sec.19-ssec.2-para1.b" guid="_1f508140-ce3f-4300-8cec-86c44d87e956" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">is kept in the State and in isolation until the earlier of the following happens—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.2-para1.b-para2.i" target.version.series="5a5e324b-388d-450f-843c-b363ee68996c" check="valid">Act</legref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.19-ssec.4-para1.a" guid="_6b65c970-22de-4692-adda-26eccbeacac7" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">to move the crocodile from the place where it was caught to the place where the crocodile is kept; and</txt></block></li><li id="sec.19-ssec.4-para1.b" guid="_87ad6ca1-2539-47c5-91b9-99eccfecb5a1" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">to keep the crocodile for the period allowed under the subsection.</txt></block></li></list></block></subclause></clause><clause id="sec.20" guid="_fd8401d5-6d04-4121-9a30-9812b1eb1e17" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>20</no><heading id="sec.20-he" guid="_91d5ee76-8099-4a5a-85b4-d2fef2b3f5fb">Dealing with dead problem crocodiles</heading><subclause id="sec.20-ssec.1" guid="_b26132f1-0482-41e6-bd30-e7b268695334" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a problem crocodile dies—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.1-para1.a" guid="_f2205af9-8303-4aeb-a329-7e3e4f3723e5" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">during or immediately after its capture by a person acting under the crocodile management authority; or</txt></block></li><li id="sec.20-ssec.1-para1.b" guid="_b065cbe1-92bb-44ef-b7ad-572363e7b0c2" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">while it is being moved or kept under this subdivision by a person acting under the crocodile management authority.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.2" guid="_273f1612-9853-41bf-990d-3861055b2c61" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The person must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.2-para1.a" guid="_b79946d3-9e38-4611-9096-7b85d9f62c59" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">measure and photograph the crocodile; and</txt></block></li><li id="sec.20-ssec.2-para1.b" guid="_2110870b-10f7-46ab-944f-93059dc2d979" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">deal with the crocodile—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.2-para1.b-para2.i" guid="_de07c8ac-5b22-43e0-842d-254f30292d2e" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if the chief executive gives the person a written direction to deal with the crocodile in a stated way—in the stated way; or</txt></block></li><li id="sec.20-ssec.2-para1.b-para2.ii" guid="_a253a175-b7ab-470a-a44b-65f46a7aa6ca" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">otherwise—by disposing of it in a way that ensures it can be recovered by the chief executive.</txt></block></li></list><note id="sec.20-ssec.2-para1.b-note" guid="_49b5066b-c3ef-4319-92d9-19701f893809" type="example"><heading id="sec.20-ssec.2-para1.b-note-he" guid="_2a271dd3-a63a-4bad-847a-306a94013975">Example of way a problem crocodile can be disposed crocodiles</heading><block><txt break.before="1">A person who deals with a problem crocodile in a way mentioned in <intref refid="sec.20" target.guid="_fd8401d5-6d04-4121-9a30-9812b1eb1e17" check="valid">section&#160;20</intref><intref refid="sec.20-ssec.2" target.guid="_273f1612-9853-41bf-990d-3861055b2c61" check="valid">(2)</intref><intref refid="sec.20-ssec.2-para1.b" target.guid="_2110870b-10f7-46ab-944f-93059dc2d979" check="valid">(b)</intref> must, within 5 business days after the dealing, give the chief executive a written notice stating all of the following under <intref refid="sec.20" target.guid="_fd8401d5-6d04-4121-9a30-9812b1eb1e17" check="valid">section&#160;20</intref><intref refid="sec.20-ssec.2" target.guid="_273f1612-9853-41bf-990d-3861055b2c61" guid="_7032599c-5d05-41f9-880c-15f129e4da30" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a person catches a problem crocodile under a damage mitigation provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">is taken to have accepted the crocodile from the chief executive; and</txt></block></li><li id="sec.28-ssec.5-para1.b" guid="_dfe05c2d-2286-4cd8-af8b-9ce9af9e90da" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec.5-para1.b-para2.i" guid="_91bdd542-4914-4a41-857b-af45601bd821" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if the person is a Queensland crocodile keeper—keep the crocodile under the Queensland crocodile licence; or</txt></block></li><li id="sec.28-ssec.5-para1.b-para2.ii" guid="_2735da2d-19fc-4ec0-8e16-4a771e057da8" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if the person is an interstate crocodile keeper—move the crocodile to the place where the person intends to keep the crocodile under a law of another target.version.series="5a5e324b-388d-450f-843c-b363ee68996c" check="valid">Act</legref> to keep the crocodile for the period allowed under the subsection.</txt></block></subclause></clause><clause id="sec.29" guid="_53874424-96b3-40f2-83d9-5d20850cd1a9" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>29</no><heading id="sec.29-he" guid="_698b7789-ea85-48d9-bcb6-081972ca7d34">Dealing with dead problem crocodiles</heading><subclause id="sec.29-ssec.1" guid="_63b16cb1-1a2e-4cca-b0fe-13b05f83a4f4" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a problem crocodile dies—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.29-ssec.1-para1.a" guid="_7edb6ea5-d4bb-460e-b63e-dbaae5e16b19" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">during or immediately after its capture by the holder of a damage mitigation permit or a relevant person for the holder; or</txt></block></li><li id="sec.29-ssec.1-para1.b" guid="_137e7bb7-b117-4a9f-902e-3f347160e1f6" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">while it is being moved under a damage mitigation permit, or kept under <intref refid="sec.28" target.guid="_2887defa-f82a-447f-a8b2-9498702837b7" check="valid">section&#160;28</intref><intref refid="sec.28-ssec.2" target.guid="_1ccf6285-8a2d-4372-a8e9-beea35151ac2" check="valid">(2)</intref>, by the holder of the permit or a relevant person for the holder.</txt></block></li></list></block></subclause><subclause id="sec.29-ssec.2" guid="_ed7bfb77-a739-4b98-85f0-c3434a8eb861" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The holder or relevant person must—</txt><list number.type="manual" unnumbered.indent="0"><li provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if the chief executive gives the holder or relevant person a written direction to deal with the crocodile in a stated way—in the stated way; or</txt></block></li><li id="sec.29-ssec.2-para1.b-para2.ii" guid="_ba88c173-a773-4166-a1d2-69074cd91223" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if <intref refid="sec.29-ssec.2-para1.b-para2.i" target.guid="_c5c3464a-4fbe-4378-a9e3-5ebf625deece" check="valid">subparagraph&#160;(i)</intref> does not apply and the holder or relevant person is authorised to process the crocodile under the <legref jurisd="QLD" type="act" target.doc.id="act-1992-020" target.version.series="5a5e324b-388d-450f-843c-b363ee68996c" check="valid">Act</legref>—by processing it, or disposing of it in a way that ensures it can be recovered by the chief executive; or</txt></block></li><li id="sec.29-ssec.2-para1.b-para2.iii" guid="_6334e648-d27a-4aa2-8ccd-7084bea67654" provision.type="other" affected.by.uncommenced="0"><no>(iii)</no><block><txt break.before="0">otherwise—by disposing of it in a way that ensures it can be recovered by the chief executive.</txt></block></li></list><note to chief executive about dealing with dead problem crocodiles</heading><block><txt break.before="1">A person who deals with a problem crocodile in a way mentioned in <intref refid="sec.29" target.guid="_53874424-96b3-40f2-83d9-5d20850cd1a9" check="valid">section&#160;29</intref><intref refid="sec.29-ssec.2" target.guid="_ed7bfb77-a739-4b98-85f0-c3434a8eb861" check="valid">(2)</intref><intref refid="sec.29-ssec.2-para1.b" target.guid="_65433b33-03e8-4389-b88c-5fe379f81f40" check="valid">(b)</intref> must, within 5 business days after the dealing, give the under a law of that State; and</txt></block></li><li id="sch.1-def.interstatecrocodilekeeper-para1.b" guid="_5cfb6d15-e330-43af-84a6-0123063ab324" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">does not hold a Queensland crocodile licence.</txt></block></li></list></definition><definition break.before="0">an inspector under the <legref jurisd="QLD" type="act" target.doc.id="act-1994-037" target.version.series="d7ebcb19-f312-46a5-9a6f-59793df30f39" check="valid"><name
