and</txt></block></li><li id="sec.4-ssec.1-para1.b" guid="_8ea1a4c4-54a8-46d5-9e23-6df2eb6d910a" provision.type="other"><no>(b)</no><block><txt break.before="0">the person’s address as shown on the electoral roll is within the jury district; and</txt></block></li><li id="sec.4-ssec.1-para1.c" guid="_c47976ed-a824-429a-8b50-2d232bd0a77d" provision.type="other"><no>(c)</no><block><txt break.before="0">the person is eligible for jury service.</txt></block></li></list></block></subclause><subclause id="sec.4-ssec.2" guid="_a3c918e8-ba1f-483c-a081-def98cb65390" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person who is enrolled as an elector is eligible for jury service unless the person is mentioned in <intref refid="sch.3-def.trial_" target.guid="_19146d1e-19fc-43e4-9d10-a2f04fe46350" check="valid">subsection&#160;(3)</intref>.</txt></block></subclause><subclause id="sec.4-ssec.3" guid="_f7ff0cce-7d4b-4938-8a28-00899218d6e0" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The following persons are not eligible for jury service—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.4-ssec.3-para1.a" guid="_b30d22d6-da85-48bc-9746-a85d3f34126c" provision.type="other"><no>(a)</no><block><txt break.before="0">the Governor;</txt></block></li><li id="sec.4-ssec.3-para1.b" guid="_c5693a7d-9761-462d-ba69-f9627c9f9b92" provision.type="other"><no>(b)</no><block><txt break.before="0">a member of Parliament;</txt></block></li><li id="sec.4-ssec.3-para1.c" guid="_8405bd71-02ed-4e18-881a-5ba1e0e35a99" provision.type="other"><no>(c)</no><block><txt break.before="0">a local government mayor or other councillor;</txt></block></li><li id="sec.4-ssec.3-para1.d" guid="_36d3cb71-ae1e-45ee-9c1e-bfb5acebb4f6" provision.type="other"><no>(d)</no><block><txt break.before="0">a person who is or has been a judge or magistrate (in the State or elsewhere);</txt></block></li><li id="sec.4-ssec.3-para1.e" guid="_f3327800-aaf0-44cf-9c0c-4e048c89cef3" provision.type="other"><no>(e)</no><block><txt break.before="0">a person who is or has been a presiding member of the Land and Resources Tribunal;</txt></block></li><li id="sec.4-ssec.3-para1.f" guid="_25c9386e-86ba-427d-a44a-26e11c2ebe37" provision.type="other"><no>(f)</no><block><txt break.before="0">a lawyer actually engaged in legal work;</txt></block></li><li id="sec.4-ssec.3-para1.g" guid="_32099bf1-8b9c-4928-be09-7bf18f255f7c" provision.type="other"><no>(g)</no><block><txt break.before="0">a person who is or has been a police officer (in the State or elsewhere);</txt></block></li><li id="sec.4-ssec.3-para1.h" guid="_d4762a1f-9762-4112-a2fe-dd55becee21a" provision.type="other"><no>(h)</no><block><txt break.before="0">a detention centre employee;</txt></block></li><li id="sec.4-ssec.3-para1.i" guid="_4886fc83-a0a5-4965-88b3-1aa9524f52ed" provision.type="other"><no>(i)</no><block><txt break.before="0">a corrective services officer;</txt></block></li><li id="sec.4-ssec.3-para1.j" guid="_5a4b3d44-4b17-408d-a510-e515fe1bfde3" provision.type="other"><no>(j)</no><block><txt break.before="0">a person who is 70 years or more, if the person has not elected to be eligible for jury service under <intref refid="sch.3-def.trial_" target.guid="_19146d1e-19fc-43e4-9d10-a2f04fe46350" check="valid">subsection&#160;(4)</intref>;</txt></block></li><li id="sec.4-ssec.3-para1.k" guid="_770e1290-c90f-4fe4-8a1e-c36970928ee5" provision.type="other"><no>(k)</no><block><txt break.before="0">a person who is not able to read or write the English language;</txt></block></li><li id="sec.4-ssec.3-para1.l" guid="_04db4981-33de-40ef-a22a-5e854ce7c8fd" provision.type="other"><no>(l)</no><block><txt break.before="0">a person who has a physical or mental disability that makes the person incapable of effectively performing the functions of a juror;</txt></block></li><li id="sec.4-ssec.3-para1.m" guid="_60413c81-7485-4324-9863-d07978577357" provision.type="other"><no>(m)</no><block><txt break.before="0">a person who has been convicted of an indictable offence, whether on indictment or in a summary proceeding;</txt></block></li><li id="sec.4-ssec.3-para1.n" guid="_8913a392-61d3-459c-a8c9-b939d0191be8" provision.type="other"><no>(n)</no><block><txt break.before="0">a person who has been sentenced (in the State or elsewhere) to imprisonment.</txt></block></li></list></block></subclause><subclause id="sec.4-ssec.4" guid="_fa8a72b8-c6bb-4f97-884a-6044a3659a19" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">A person who is 70 years or more may elect to be eligible for jury service in the way prescribed under a regulation.</txt></block></subclause><historynote><txt break.before="1"><b>s&#160;4</b> amd <legref jurisd="QLD" type="act" target.doc.id="act-1996-080" target.version.series="ae1dbcb2-31da-4022-a88e-c2b1215429b8" valid.date="as.made" check="valid">1996 No.&#160;80</legref> <legref jurisd="QLD" type="act" refid="sec.3" target.doc.id="act-1996-080" valid.date="as.made" check="invalid">s&#160;3</legref>; and</txt></block></li><li id="sec.11-para1.b" guid="_407bb378-55c9-453e-8ce2-9a1b8830ed95" provision.type="other"><no>(b)</no><block><txt break.before="0">allow the sheriff access to any information the commission has relevant to the keeping of jury rolls.</txt></block></li></list></block></clause><clause id="sec.12" guid="_79d6f044-9dfd-4413-b786-875d10164dc4" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>12</no><heading id="sec.12-he" guid="_6bfa3b85-ddbc-40aa-8a1d-52937632a880">Arrangements with commissioner of the police service</heading><subclause id="sec.12-ssec.1" guid="_16855b8b-568a-451e-b368-4f78b14c7b83" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">For keeping a jury roll, the sheriff or the electoral commission may arrange with the commissioner of the police service for the police service to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.12-ssec.1-para1.a" guid="_89912ee6-a199-417f-b62a-20ef8689877a" provision.type="other"><no>(a)</no><block><txt break.before="0">make inquiries reasonably required for keeping a jury roll; guid="_e944022b-17b9-4ffc-aeca-f7f7e03204ec" provision.type="other"><no>(ii)</no><block><txt break.before="0">a form (an <defterm id="sec.18-ssec.3-para1.a-def.applicationform" guid="_7d4d74f5-8fa0-422a-8f70-6e8d169e91d1" type="definition">application form</defterm>) to enable the person to apply to be excused from jury service; and</txt></block></li></list></block></li><li result in substantial inconvenience to the public or a section of the public;</txt></block></li><li id="sec.21-ssec.1-para1.d" guid="_d76c7993-f49b-4b33-a1ed-c3485207ced4" provision.type="other"><no>(d)</no><block><txt break.before="0">whether others are dependent on the person to provide care in circumstances where suitable alternative care is not readily available;</txt></block></li><li id="sec.21-ssec.1-para1.e" guid="_fe3bf384-b3ca-44e8-9b28-c2be3ed63bfc" provision.type="other"><no>(e)</no><block><txt break.before="0">the person’s state of health;</txt></block></li><li id="sec.21-ssec.1-para1.f" guid="_ed93c2e4-add1-46f7-9dde-e7d09bb0c27b" provision.type="other"><no>(f)</no><block><txt break.before="0">anything else stated in a practice direction.</txt></block></li></list></block></subclause><subclause id="sec.21-ssec.2" guid="_ff473605-981c-4e04-b4a2-1954d188dfc5" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A person may be permanently excused from jury service only if the person is eligible to be permanently excused from jury service in the provision.type="other"><no>(b)</no><block><txt break.before="0">identify or provide a means of identifying each person who has been instructed by the sheriff to attend on the day the jury for the provision.type="other"><no>(4)</no><block><txt break.before="0">The request may be made no earlier than 4.00pm on the business day immediately before the day on which the jury for the trial is to be might decide that the questions are to be put to the persons selected to serve as jurors or reserve jurors in each other’s presence in open court, or that the questions are to be put to each person individually.</txt></block></note></block></subclause><subclause id="sec.47-ssec.5" guid="_e201e587-9d96-4e91-96d6-98e3dec615ce" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If, after hearing the answers of a person questioned under this section, the judge considers further inquiry is justified, the judge may give the parties leave to cross-examine the person on oath (under limits fixed by the judge) to find out whether the person is impartial.</txt></block></subclause><subclause id="sec.47-ssec.6" break.before="0">murder;</txt></block></li><li id="sec.59-ssec.1-para1.a-para2.ii" guid="_c5d55ac8-b2a5-47b0-a180-9369469db943" provision.type="other"><no>(ii)</no><block><txt break.before="0">an offence against the <legref jurisd="QLD" type="act" target.doc.id="act-1899-009" target.version.series="19dc3aee-7313-4ba8-a7f6-7abf0c19b425" check="valid"><name emphasis="no">Criminal Code</name></legref>, <legref jurisd="QLD" type="act" refid="sch.1-sec.54A" target.doc.id="act-1899-009" target.version.series="19dc3aee-7313-4ba8-a7f6-7abf0c19b425" offender is liable to imprisonment for life, which can not be mitigated or varied under the <legref jurisd="QLD" type="act" target.doc.id="act-1899-009" target.version.series="19dc3aee-7313-4ba8-a7f6-7abf0c19b425" check="valid"><name emphasis="no">Criminal Code</name></legref> or any other law;</txt></block></li><li id="sec.59-ssec.1-para1.a-para2.iii" guid="_3a248e0c-dcb4-4396-95d1-50c02bc74c64" provision.type="other"><no>(iii)</no><block><txt break.before="0">an offence against a law of the Commonwealth;</txt></block></li></list></block></li><li id="sec.59-ssec.1-para1.b" guid="_92859595-7bf5-4fca-b8c0-bc79798879e7" provision.type="other"><no>(b)</no><block><txt break.before="0">a trial before a jury consisting of only 10 jurors when it gives its verdict.</txt></block></li></list></block></subclause><subclause id="sec.59-ssec.2" guid="_98358c94-5713-4503-ae4a-762745846648" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For <intref refid="sch.3-def.trial_" target.guid="_19146d1e-19fc-43e4-9d10-a2f04fe46350" check="valid">subsection&#160;(1)</intref><intref refid="sch.3-def.trial_" target.guid="_19146d1e-19fc-43e4-9d10-a2f04fe46350" check="valid">(b)</intref>, it does not matter that at any time before its verdict was given the jury consisted of more than 10 jurors.</txt></block></subclause><subclause id="sec.59-ssec.3" guid="_070a44c2-cfda-4283-a097-9fd2db27d05e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The verdict of the jury must be unanimous.</txt></block></subclause><subclause id="sec.59-ssec.4" target.guid="_19146d1e-19fc-43e4-9d10-a2f04fe46350" check="valid">(a)</intref><intref refid="sch.3-def.trial_" target.guid="_19146d1e-19fc-43e4-9d10-a2f04fe46350" check="valid">(i)</intref> or <intref refid="sch.3-def.trial_" target.guid="_19146d1e-19fc-43e4-9d10-a2f04fe46350" check="valid">(ii)</intref>—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.59-ssec.4-para1.a" guid="_974e1373-74c9-415a-a2f6-923e6186458d" provision.type="other"><no>(a)</no><block><txt break.before="0">the jury is unable to reach a unanimous verdict; and</txt></block></li><li refid="sch.3-def.trial_" target.guid="_19146d1e-19fc-43e4-9d10-a2f04fe46350" check="valid">(ii)</intref>;</txt></block></li></list></block><block><txt break.before="1">in relation to the conviction on which at least 11 jurors agree; or</txt></block></li><li id="sec.59A-ssec.6-def.majorityverdict-para1.b" guid="_27aa0742-a274-4fc8-be3e-8600bb367bab" provision.type="other"><no>(b)</no><block><txt break.before="0">if the jury consists of 11 jurors—a verdict on which at least 10 jurors agree.</txt></block></li></list></definition><definition id="sec.59A-ssec.6-def.prescribedperiod_" guid="_a7ad8106-c4e0-48ff-8fb6-048185faa5f4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.59A-ssec.6-def.prescribedperiod" guid="_c2da8b24-a3b1-4cef-82a5-8e269fd334a4" provision.type="other"><no>(i)</no><block><txt break.before="0">a period allowed for meals or refreshments;</txt></block></li><li id="sec.59A-ssec.6-def.prescribedperiod-para1.a-para2.ii" guid="_577c7e7e-5acc-404f-9d9a-fae6a77a9549" provision.type="other"><no>(ii)</no><block><txt break.before="0">a period during which the judge allows the jury to separate, or an individual juror to separate from the jury;</txt></block></li><li id="sec.59A-ssec.6-def.prescribedperiod-para1.a-para2.iii" guid="_286b4965-ed48-44f3-9fc8-393234e74800" provision.type="other"><no>(iii)</no><block><txt type="definition">suspect</defterm>) of bias, fraud or an offence related to the suspect’s membership of the jury or the performance of the suspect’s functions as a member of the jury, the member may disclose the suspicion and the grounds on which it is held to the Attorney-General or the director of public prosecutions.</txt></block></subclause><subclause id="sec.70-ssec.9" type="definition">jury information</defterm> means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.70-ssec.17-def.juryinformation-para1.a" guid="_9d694165-a7ef-4b2f-9c6a-74d37fc80991" provision.type="other"><no>(a)</no><block><txt break.before="0">information about statements made, opinions expressed, arguments advanced, or votes cast, in the course of a jury’s deliberations; or</txt></block></li><li id="sec.70-ssec.17-def.juryinformation-para1.b" guid="_8fa907da-d5c5-4297-b1d2-7da8a709cc11" provision.type="other"><no>(b)</no><block><txt break.before="0">information identifying or likely to identify a person as, or as having been, a juror in a particular
