jurisd="QLD" type="act" refid="sec.37" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" target.guid="_b2815609-eb81-4449-9550-98098aa59ff7" notice about PDA development application on land—<legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref>, <legref jurisd="QLD" type="act" refid="sec.84" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" target.guid="_0ad51714-c0c3-46ab-b59e-cf61e746d6ae" check="valid">s&#160;84</legref></heading><subclause id="sec.5-ssec.1" guid="_15c2515e-4347-4d0f-b8e9-b21773c2ffa2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref>, this section prescribes the way a notice about a PDA development application must be placed on the relevant land.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_e38acec2-5931-4749-a7c1-21551797416a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The notice must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.a" guid="_4ebc64e1-d9da-451d-80af-17ab0f29df2e" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">be placed on, or within 1.5m of, the road frontage for the relevant land; and</txt></block></li><li id="sec.5-ssec.2-para1.b" guid="_1c6c225e-a7fd-4d8a-9341-3f5f24347a05" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">be mounted at least 300mm above ground level; and</txt></block></li><li id="sec.5-ssec.2-para1.c" guid="_f4d3038e-67ff-425e-8574-04f752dc9117" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">be positioned so it is visible from—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.2-para1.c-para2.i" guid="_d82690f5-4d7b-463d-a95d-031e0778a596" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">any road adjoining the relevant land; or</txt></block></li><li id="sec.5-ssec.2-para1.c-para2.ii" guid="_5b01ee69-3b95-42d8-908d-57f4e1108544" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if the only access to the relevant land is across other land—any road adjoining the other land at the point of access; and</txt></block></li></list></block></li><li id="sec.5-ssec.2-para1.d" guid="_350208e7-2562-47cf-8c0c-2b03d025702e" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">be made of weatherproof material; and</txt></block></li><li id="sec.5-ssec.2-para1.e" guid="_a320237f-6f70-4d64-bbb9-838aa235ce17" provision.type="other" affected.by.uncommenced="0"><no>(e)</no><block><txt break.before="0">be not less than 1,200mm x 900mm in size.</txt></block></li></list></block></subclause><subclause id="sec.5-ssec.3" guid="_76a89788-f5ee-40fa-bbf1-460327a71b9a" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the relevant land has more than 1 road frontage, a notice must be placed on each road frontage for the land.</txt></block></subclause><subclause id="sec.5-ssec.4" guid="_36b91073-d82b-43c2-9f82-f9153b447c70" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">The applicant must maintain the notice from the day it is placed on the relevant land until the end of the submission period for the application.</txt></block></subclause><subclause id="sec.5-ssec.5" guid="_969fcf11-7677-4bc4-9375-38972e995115" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-ssec.5-def.roadfrontage_" guid="_d39e1a27-0c53-47d3-8d26-d088ef882534" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.5-def.roadfrontage" guid="_4229b7b3-219a-4c7c-914a-7fc42432ee20" type="definition">road frontage</defterm>, for relevant land, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.5-ssec.5-def.roadfrontage-para1.a" guid="_cc70e9b5-384b-46f5-a924-31380923cb21" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">generally—the boundary between the relevant land and any road adjoining the land; or</txt></block></li><li id="sec.5-ssec.5-def.roadfrontage-para1.b" guid="_ded90749-6b20-42c0-9a99-e1cba2dccccb" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the only access to the relevant land is across other land—the boundary between the other land and any road adjoining the other provision.type="other"><no>1</no><heading id="sch.3-sec.1-he" guid="_9fd206b2-5a8f-4e7f-8896-8613a79f01ff">Request for approval of plan of subdivision</heading><subclause id="sch.3-sec.1-ssec.1" guid="_8ace44e8-8bf7-448c-a45b-072d2e2e49af" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person may, under this section, ask MEDQ to approve a plan of subdivision.</txt></block></subclause><subclause id="sch.3-sec.1-ssec.2" guid="_d45cbc59-38f2-4e61-bdb6-36cd951b7985" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The request must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.1-ssec.2-para1.a" guid="_0b39514a-8f54-4b84-aeec-01dafcd4fd2a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">be in writing; and</txt></block></li><li id="sch.3-sec.1-ssec.2-para1.b" guid="_c3bf5748-c92d-40e4-aa24-d72c647751a5" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">be accompanied by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.1-ssec.2-para1.b-para2.i" guid="_3f3bbc38-935c-4d81-9812-d3daba3ba544" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">a copy of the proposed plan of subdivision; and</txt></block></li><li id="sch.3-sec.1-ssec.2-para1.b-para2.ii" guid="_7376497d-446c-4bd8-94e9-c6b8d61d8553" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">evidence allowing the request to be assessed under <intref refid="sch.3-sec.2" target.guid="_7ccf6498-22a9-4b99-bb19-4f8a4251f25f" check="valid">section&#160;2</intref>; and</txt></block></li></list></block></li><li id="sch.3-sec.1-ssec.2-para1.c" guid="_c6bc3089-4d51-4949-af37-4115a87c7d02" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">be made during the relevant period, if any, for the request.</txt></block></li></list></block></subclause><subclause id="sch.3-sec.1-ssec.3" guid="_13a8dbf0-ba9f-44c0-b52b-b64d81fb3247" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">For <intref refid="sch.3-sec.1-ssec.2" target.guid="_d45cbc59-38f2-4e61-bdb6-36cd951b7985" check="valid">subsection&#160;(2)</intref><intref refid="sch.3-sec.1-ssec.2-para1.c" target.guid="_c6bc3089-4d51-4949-af37-4115a87c7d02" check="valid">(c)</intref>, the <defterm id="sch.3-sec.1-def.relevantperiod" guid="_d40be9fd-f926-484d-b4d9-e6695ed86da7" type="definition">relevant period</defterm> for the request is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.1-ssec.3-para1.a" guid="_afa99375-76d0-4de1-a765-ab9f47f10a03" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the request relates to a plan of subdivision for reconfiguring a lot that is authorised under a PDA development permit—the period during which the PDA development permit is in effect; or</txt></block></li><li id="sch.3-sec.1-ssec.3-para1.b" guid="_72c119e8-f874-4544-9215-8c79bc1ae3d1" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the request relates to a plan of subdivision for reconfiguring a lot that is required under a PDA development condition of a PDA development permit—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.1-ssec.3-para1.b-para2.i" guid="_db606f4a-cb71-490f-a73f-7bdf2e9ac021" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if the PDA development permit states a currency period under <legref jurisd="QLD" type="act" refid="sch.3-sec.100" target.doc.id="act-2012-043" check="invalid">section&#160;100</legref><legref jurisd="QLD" type="act" refid="sch.3-sec.100-ssec.4" target.doc.id="act-2012-043" check="invalid">(4)</legref> or <legref jurisd="QLD" type="act" refid="sch.3-sec.100-ssec.5" target.doc.id="act-2012-043" check="invalid">(5)</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref>—the stated currency period; or</txt></block></li><li id="sch.3-sec.1-ssec.3-para1.b-para2.ii" guid="_d4872fe9-72a7-465d-8acd-bc7e8c5cad7e" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">otherwise—the period of 4 years after the PDA development permit takes effect; or</txt></block></li></list></block></li><li id="sch.3-sec.1-ssec.3-para1.c" guid="_32ac5c3a-aa58-4754-b711-dcb8d74049d9" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">if the request relates to a plan of subdivision for reconfiguring a lot that is required under a PDA exemption certificate—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.1-ssec.3-para1.c-para2.i" guid="_8601f6ad-af24-4c77-be1d-983e651afe60" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">if the certificate states a period within which the plan must be given to MEDQ for its approval—the stated period; or</txt></block></li><li id="sch.3-sec.1-ssec.3-para1.c-para2.ii" guid="_f88386ef-2474-435c-b0e3-f86ec418c838" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">otherwise—the period during which the certificate is in effect.</txt></block></li></list></block></li></list></block></subclause></clause><clause id="sch.3-sec.2" guid="_7ccf6498-22a9-4b99-bb19-4f8a4251f25f" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>2</no><heading id="sch.3-sec.2-he" guid="_966e96d7-bfd7-45d0-b34a-ef45c093118c">Assessing request</heading><subclause id="sch.3-sec.2-ssec.1" guid="_035a3468-c4d7-4145-bae2-04f310c752c2" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The request must be assessed against—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.2-ssec.1-para1.a" guid="_ab67ab4d-8449-4fb3-a1a7-e7ddd408b485" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the criteria that apply in relation to the request under <intref refid="sch.3-sec.2-ssec.2" target.guid="_5bdcc0b6-8d97-4ee6-87e6-8bbcf81d2ea2" check="valid">subsection&#160;(2)</intref>, <intref refid="sch.3-sec.2-ssec.3" target.guid="_70f4d1b4-6734-4937-aeef-e55d08401379" check="valid">(3)</intref> or <intref refid="sch.3-sec.2-ssec.4" target.guid="_69f11190-977d-46de-a4bb-72cfef948d88" check="valid">(4)</intref>; and</txt></block></li><li id="sch.3-sec.2-ssec.1-para1.b" guid="_547e56c5-13ee-4cca-9f49-19a46cdcc24c" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the general criteria under <intref refid="sch.3-sec.2-ssec.5" target.guid="_da286c26-6c30-482a-9de8-6099cca97e73" check="valid">subsection&#160;(5)</intref>.</txt></block></li></list></block></subclause><subclause id="sch.3-sec.2-ssec.2" guid="_5bdcc0b6-8d97-4ee6-87e6-8bbcf81d2ea2" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the request relates to a plan of subdivision for reconfiguring a lot that is authorised under a PDA development permit or is required under a PDA development condition of a PDA development permit, the criteria are—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.2-ssec.2-para1.a" guid="_28cd3852-99b3-4c29-996f-8c9c229c11f7" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the plan has been prepared in accordance with the requirements of the PDA development permit; and</txt></block></li><li id="sch.3-sec.2-ssec.2-para1.b" guid="_a9cc36ab-2442-44a1-ab91-dfc932fe1c76" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the PDA development permit is subject to PDA development conditions—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.2-ssec.2-para1.b-para2.i" guid="_eff63c9f-dc5c-4746-86ab-ca7fd99f1d21" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the conditions have been complied with; or</txt></block></li><li id="sch.3-sec.2-ssec.2-para1.b-para2.ii" guid="_1e41ad10-0ace-4645-91ae-dbcaef351746" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">the applicant has given satisfactory security to MEDQ to ensure compliance with the conditions.</txt></block></li></list></block></li></list></block></subclause><subclause id="sch.3-sec.2-ssec.3" guid="_70f4d1b4-6734-4937-aeef-e55d08401379" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the request relates to a plan of subdivision for reconfiguring a lot that is required under a PDA exemption certificate, the criterion is that the plan has been prepared in accordance with the requirements of the certificate.</txt></block></subclause><subclause id="sch.3-sec.2-ssec.4" guid="_69f11190-977d-46de-a4bb-72cfef948d88" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If the request relates to a plan of subdivision for reconfiguring a lot that is not PDA assessable development, the criterion is that the plan is consistent with any PDA development permit relevant to the land.</txt></block></subclause><subclause id="sch.3-sec.2-ssec.5" guid="_da286c26-6c30-482a-9de8-6099cca97e73" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">The <defterm id="sch.3-sec.2-def.generalcriteria" guid="_07d4c22b-7ee1-486c-9d01-3624886d94c2" type="definition">general criteria</defterm> are the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.2-ssec.5-para1.a" guid="_19dd0e39-0e78-4f11-a18d-1e71fd3d6975" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">there are no outstanding local government rates or charges or expenses that are a charge over the land under any Act;</txt></block></li><li id="sch.3-sec.2-ssec.5-para1.b" guid="_35d12497-83d4-4ca3-9ac5-7dce9cd8be60" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">there are no outstanding special rates or charges, or infrastructure expenses recoupment charges, in relation to the land;</txt></block></li><li id="sch.3-sec.2-ssec.5-para1.c" guid="_99a40b89-abba-4454-a25c-3ff0512cc154" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">the conditions of any water approval under the <legref jurisd="QLD" type="act" target.doc.id="act-2009-046" target.version.series="823a0dc3-6c45-4400-a230-133cee0bae67" check="valid"><name emphasis="yes">South-East Queensland Water (Distribution and Retail Restructuring) Act 2009</name></legref> in relation to the land have been complied with;</txt></block></li><li id="sch.3-sec.2-ssec.5-para1.d" guid="_bf4e652f-97bf-4e97-8f4b-3a0f31b8829f" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">there are no outstanding fees or charges in relation to the land levied by a distributor-retailer under the <legref jurisd="QLD" type="act" target.doc.id="act-2009-046" target.version.series="823a0dc3-6c45-4400-a230-133cee0bae67" check="valid"><name emphasis="yes">South-East Queensland Water (Distribution and Retail Restructuring) Act 2009</name></legref>.</txt></block></li></list></block></subclause><subclause id="sch.3-sec.2-ssec.6" guid="_901dd519-4f5b-4265-b03f-1669c163fa4a" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">A reference in this section to the land, in relation to a plan of subdivision, is a reference to the land the subject of the plan of subdivision.</txt></block></subclause><subclause id="sch.3-sec.2-ssec.7" guid="_9b4301b4-4e08-4d49-9426-1b2c9e73393a" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sch.3-sec.2-ssec.7-def.localgovernmentratesorcharges_" guid="_efb7a07c-60a5-4850-9022-acd432b0c0ab" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.3-sec.2-ssec.7-def.localgovernmentratesorcharges" guid="_38cbf924-f5f2-4ffd-90ed-fe72e073d178" type="definition">local government rates or charges</defterm> means rates or charges levied by a local government.</txt></definition><definition id="sch.3-sec.2-ssec.7-def.specialrateorcharge_" guid="_afd8f4fa-1980-44ec-857e-904b84e9e72e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.3-sec.2-ssec.7-def.specialrateorcharge" guid="_91b125ba-c6bc-44c6-b424-d2f4f4172d7a" type="definition">special rate or charge</defterm> means a special rate or charge levied under <legref jurisd="QLD" type="act" refid="sec.115" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" target.guid="_5767b505-0a84-44c1-bd94-de26402b5627" check="valid">section&#160;115</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref>.</txt></definition></deflist></block></subclause></clause><clause id="sch.3-sec.3" guid="_4ae2a133-7a6b-416f-a495-d7cc83098da0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sch.3-sec.3-he" guid="_65f3aae6-a313-4433-a115-fa6d6bccdedd">Deciding request</heading><subclause id="sch.3-sec.3-ssec.1" guid="_af6601dc-db9a-48b0-9b18-3b82e882a228" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If the request complies with the criteria against which it must be assessed under <intref refid="sch.3-sec.2" target.guid="_7ccf6498-22a9-4b99-bb19-4f8a4251f25f" check="valid">section&#160;2</intref>, MEDQ must approve the plan of subdivision.</txt></block></subclause><subclause id="sch.3-sec.3-ssec.2" guid="_4f08e143-bb17-43a2-9b04-532dd3095f2a" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">MEDQ must give notice of the approval to the applicant within—</txt><list number.type="manual" unnumbered.indent="0"><li id="sch.3-sec.3-ssec.2-para1.a" guid="_274d67d1-5f90-401b-9a29-99fd26425fea" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">20 business days after receiving the request; or</txt></block></li><li id="sch.3-sec.3-ssec.2-para1.b" guid="_4d45c780-f141-4993-8f95-30e2662ce6a2" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">another period agreed between MEDQ and the applicant.</txt></block></li></list></block></subclause><subclause id="sch.3-sec.3-ssec.3" guid="_c4054bea-ad7f-476a-9cd8-a8e3ce939703" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If the <legref jurisd="QLD" type="act" target.doc.id="act-2012-043" target.version.series="6f56f180-a792-4ea9-adb8-88878b2aaf9d" check="valid">Act</legref> under which the plan of subdivision is to be registered or recorded requires a particular form for the registration or recording, the approval of the plan of subdivision must be in that form.</txt></block></subclause></clause></schedule></schedules></subordleg>
