entertainment industry; or</txt><note id="sec.6-para1.a-note" guid="_ac18890a-bf08-4660-9cce-cb3cb11703dd" type="example"><heading id="sec.6-para1.a-note-he" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_5ff148bd-2725-458e-a0d6-1edb81a8b8b2">Prohibited working hours</heading><subclause id="sec.7-ssec.1" guid="_caf2450e-0d3d-4367-8238-5da0ae488736" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A school-aged or young child may not work between 10.p.m. and 6.a.m.</txt></block></subclause><subclause id="sec.7-ssec.2" guid="_020c2957-5bd9-40ae-b7d9-380574fd7e8d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">A child who is 11 or 12 years may not do delivery work between 6.p.m. and 6.a.m.</txt></block></subclause></clause><clause id="sec.8" guid="_e9b0de49-2c51-4e76-bd23-f25a3fe6bbe2" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_6ac551e1-733d-42ca-b668-130ba44a9454">Working hours for young children</heading><subclause id="sec.8-ssec" guid="_b5718822-3a67-4289-ac0a-3968339b6bc1" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="1">A young child may not work if— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec-para1.a" guid="_c40aa952-0183-4c01-9a56-0831652a08b4" provision.type="other"><no>(a)</no><block><txt break.before="0">the child has already worked 12 hours during a week; or</txt></block></li><li id="sec.8-ssec-para1.b" guid="_ab379db5-f229-4b55-a065-48925d84dce3" provision.type="other"><no>(b)</no><block><txt break.before="0">the child has already worked 4 hours during a day; or</txt></block></li><li id="sec.8-ssec-para1.c" guid="_25b7c52a-db40-4508-a220-0c3fc76ddb06" provision.type="other"><no>(c)</no><block><txt break.before="0">the child has already worked for the same employer for a period of time that ended within the previous 12 hours.</txt></block></li></list></block></subclause></clause><clause id="sec.9" guid="_4bce139f-59a6-4e45-acfa-fed0998b1187" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_53d76437-5d43-4644-af11-45de8e1b5bfc">Working hours for school-aged children</heading><subclause id="sec.9-ssec.1" guid="_b644ff6c-9830-41e3-8790-28dc267f3792" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A school-aged child may not work if— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.1-para1.a" guid="_ddb54e7b-bc60-468e-8235-58941b9d3c9e" provision.type="other"><no>(a)</no><block><txt break.before="0">it is a school week and the child has already worked 12 hours during the week; or</txt></block></li><li id="sec.9-ssec.1-para1.b" guid="_e087c750-2fca-47ea-889a-5223ca4df0b1" provision.type="other"><no>(b)</no><block><txt break.before="0">it is a week that is not a school week and the child has already worked 38 hours during the week; or</txt></block></li><li id="sec.9-ssec.1-para1.c" guid="_3ebf8b04-1191-4064-b497-ccbf62729b4b" provision.type="other"><no>(c)</no><block><txt break.before="0">it is a school day and the child has already worked 4 hours on the day; or</txt></block></li><li id="sec.9-ssec.1-para1.d" guid="_bedb4661-2371-4ef1-9680-2f70455b4431" provision.type="other"><no>(d)</no><block><txt break.before="0">it is a day that is not a school day and the child has already worked 8 hours on the day; or</txt></block></li><li id="sec.9-ssec.1-para1.e" guid="_fed320e5-f9c4-499f-84d7-9d0c1d5faa9f" provision.type="other"><no>(e)</no><block><txt break.before="0">the child has already worked for the same employer for a period of time that ended within the previous 12 hours.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.2" guid="_c85480ed-38e0-418b-be28-51bfeef3b127" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Unless a relevant industrial instrument provides otherwise, a school-aged child may not continue to work on a particular day if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_3c5e3f38-fd0d-49bc-8733-1d66b2a02d8c" provision.type="other"><no>(a)</no><block><txt break.before="0">the child has worked 4 consecutive hours on the day and not had at least 1 hour rest at the end of the fourth hour; or</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_617f71c1-0905-4e6d-bcd4-e42570b180fb" provision.type="other"><no>(b)</no><block><txt break.before="0">the child has already worked for a period of time on the day.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_904c7e00-24e6-4fb9-b3a0-8e9f2ba31357" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.9-ssec.3-def.schoolday_" guid="_160e0318-d385-4d4f-bcdb-9b102893a41a" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.3-def.schoolday" guid="_175dce17-4543-4ad0-b195-fe65bc416bf4" type="definition">school day</defterm> means a day on which the school-aged child is required to attend school.</txt></definition><definition id="sec.9-ssec.3-def.schoolweek_" guid="_fcbe273f-b276-4aca-848c-263b62eeba3d" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.3-def.schoolweek" guid="_8213fd78-483c-4cac-a1f0-e6aa0758d64e" type="definition">school week</defterm> means a week, starting on a Sunday, during which the school-aged child is required to attend school.</txt></definition></deflist></block></subclause></clause><clause id="sec.10" guid="_22b7733d-5e1a-4059-9400-c8f948f53fed" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_d0f0f89f-3753-4c7b-8edc-2429dfa8559c">Calculating hours worked</heading><subclause id="sec.10-ssec" guid="_78e6067c-c918-4f02-adfa-3e66adacf05b" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="1">For the purpose of calculating the hours worked by a school-aged or young child during a particular period, the hours worked by the child for any employer during the period must be counted.</txt></block></subclause></clause></division><division id="pt.2-div.3" guid="_99e8496d-2f04-426d-96c7-432f75a85622" affected.by.uncommenced="0"><no>Division 3</no><heading id="pt.2-div.3-he" guid="_8f18a24f-68db-405e-a835-54e426d24255">Supervision</heading><note id="pt.2-div.3-note" guid="_b0df6b5e-b9da-4e3c-88ac-44968ecbbf39" type="example"><heading id="pt.2-div.3-note-he" guid="_eeeee428-6028-47d0-bea6-bbdcd494833a">Note—</heading><block><txt industry.</txt></block></note><clause id="sec.11" guid="_c55fdbcf-8554-44ea-b295-84d2a7e7bf74" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_1d4a696c-442b-4650-a442-417b55e71ca5">Supervision</heading><subclause id="sec.11-ssec.1" guid="_f92d3cc6-9535-431d-a52a-58fcda42bc30" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies while a school-aged or young child does—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-ssec.1-para1.a" guid="_c6fc8f40-f41e-4dc9-9902-bdc803da9b55" provision.type="other"><no>(a)</no><block><txt break.before="0">delivery work; or</txt></block></li><li id="sec.11-ssec.1-para1.b" guid="_2d161afc-273a-4d84-a25f-cb9e7be18aa9" provision.type="other"><no>(b)</no><block><txt break.before="0">work that involves the exchange of money.</txt></block></li></list></block></subclause><subclause id="sec.11-ssec.2" guid="_c35dd90d-0d68-473b-b8d9-d8a6bcc2ace1" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">For <legref jurisd="QLD" type="act" refid="sec.9" target.doc.id="act-2006-002" target.version.series="f423a02d-9c6f-4bdf-8eae-0d4c5fc13c4a" target.guid="_5b23005e-704f-4b39-9a70-afb751ce61e1" check="valid">section&#160;9</legref><legref jurisd="QLD" type="act" refid="sec.9-ssec.6" target.doc.id="act-2006-002" target.version.series="f423a02d-9c6f-4bdf-8eae-0d4c5fc13c4a" target.guid="_65332a4b-c1be-4191-a77f-a56385c88bcd" check="valid">(6)</legref> of the <legref jurisd="QLD" type="act" target.doc.id="act-2006-002" target.version.series="f423a02d-9c6f-4bdf-8eae-0d4c5fc13c4a" check="valid">Act</legref>, the prescribed way for the employer to supervise the child for the work is to ensure an adult is near the child and in regular contact with the child.</txt></block></subclause></clause></division><division id="pt.2-div.4" guid="_9fb16ff9-67cb-4850-be30-dda8be9ad3a8" affected.by.uncommenced="0"><no>Division 4</no><heading id="pt.2-div.4-he" guid="_41cd98dc-a14f-401a-ac87-deb8916bbf80">Working conditions related to children’s safety, health and wellbeing </heading><note id="pt.2-div.4-note" guid="_81548eef-d7a4-4773-95f2-3c34bf1afbf2" type="example"><heading id="pt.2-div.4-note-he" guid="_9bd699d1-ab58-4ae2-a867-775fe0eaecee">Note—</heading><block><txt break.before="1">See <intref refid="pt.3" target.guid="_0b8f487a-a115-429a-9032-ce3419b81ded" check="valid">part&#160;3</intref>, <intref refid="pt.3-div.5" target.guid="_4b3d0903-398e-4380-98fc-64757f24c58a" check="valid">division&#160;5</intref> for other working conditions related to the at least 1 hour rest starting before 1p.m. on the day; or</txt></block></li><li id="sec.25-ssec.1-para1.c" guid="_5f2cd4c8-5993-4073-a3fd-ce1c560ad4e6" provision.type="other"><no>(c)</no><block><txt break.before="0">for a child under 13 years who has worked for 50 minutes—the child has not been given at least 10 minutes rest, unless the child is starting a rest period under <intref refid="sec.25-ssec.1-para1.a" target.guid="_6adf49f4-ad2f-4194-a622-d8e36a89ffb5" check="valid">paragraph&#160;(a)</intref> or <intref refid="sec.25-ssec.1-para1.b" target.guid="_8d5b647a-5b12-49b6-bc5f-87729ba4aa0c" check="valid">(b)</intref>; or</txt></block></li><li id="sec.25-ssec.1-para1.d" guid="_a42feabc-98a2-41f6-aa1f-06bd9404b1eb" provision.type="other"><no>(d)</no><block><txt break.before="0">the child has already worked for the same employer for a period of time that ended within the<strike/> previous 12 hours; provision.type="other"><no>(f)</no><block><txt break.before="0">if, in the previous 7 days, the total of the following is more than 40 hours—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-ssec.1-para1.f-para2.i" guid="_34bb4b5c-d0d8-4486-bde6-824209e6dbda" provision.type="other"><no>(i)</no><block><txt break.before="0">the hours the child has worked for any employer; entertainment— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.26-ssec.1-para1.a" guid="_72b1b332-70a1-40a1-8468-0e5d195832e7" provision.type="other"><no>(a)</no><block><txt break.before="0">after 9p.m. on a day if the child is required to attend school before 9a.m. on the next day; or</txt></block></li><li id="sec.26-ssec.1-para1.b" spent.amends="0" provision.type="other"><no>28</no><heading id="sec.28-he" guid="_3b9e49a3-76b4-4165-96ca-18298d62fba0">Calculating hours worked</heading><subclause id="sec.28-ssec" guid="_7340a1f5-0c1a-494e-bbdc-3123039b3120" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="1">For the purpose of calculating the hours worked by a child under this division, the following must be counted—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.28-ssec-para1.a" guid="_7b5d4b9e-bac8-4493-be3a-47fb87f3fa92" provision.type="other"><no>(a)</no><block><txt break.before="0">the time the child is at work, other than a rest period for the child under <intref refid="sec.25" target.guid="_fa040d54-3c68-40f4-b8d6-42d651e27f75" check="valid">section&#160;25</intref><intref refid="sec.25-ssec.1" target.guid="_b2e4b52d-ae55-4fda-8324-3bdb62327fa3" check="valid">(1)</intref><intref refid="sec.25-ssec.1-para1.a" target.guid="_6adf49f4-ad2f-4194-a622-d8e36a89ffb5" check="valid">(a)</intref> and <intref refid="sec.25-ssec.1-para1.b" target.guid="_8d5b647a-5b12-49b6-bc5f-87729ba4aa0c" check="valid">(b)</intref>; and</txt></block></li><li id="sec.28-ssec-para1.b" guid="_ede7484a-2293-41f4-977f-55f3fb602c80" break.before="0">if the child spent more than 45 minutes travelling from the day’s final workplace to home—the time starting 45 minutes after the child left the place and ending when the child arrived home; and</txt></block></li><li id="sec.28-ssec-para1.d" guid="_6cf0fa5a-8c58-464e-9e25-1ea87ab28b9c" provision.type="other"><no>(d)</no><block><txt break.before="0">if the employer brings the child to a workplace—the time starting when the child arrives at the place and ending when the child starts work; and</txt></block></li><li id="sec.28-ssec-para1.e" guid="_1a9f1481-3a90-41c4-8315-52f08c310520" provision.type="other"><no>(e)</no><block><txt break.before="0">if the employer takes the child home from a workplace—the time starting when the child guid="_c69ade9a-76a7-479f-a853-baf10ee3bb9d"><block><txt break.before="1">Maximum penalty—40 penalty units.</txt></block></penalty></subclause><subclause id="sec.32-ssec.2" guid="_07d439c6-ae9b-432c-85e4-d4e94a8e0dcb" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An employer does not commit an offence against <intref refid="sec.32-ssec.1" target.guid="_ad41cdf5-769d-40c1-872a-49125a97330a" check="valid">subsection&#160;(1)</intref> if the employer excludes a parent of a school-aged or young child from an area of the workplace where the child is working, or from contacting the child directly, if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.2-para1.a" guid="_8b461230-4b4f-435f-b0c3-24317595f548" provision.type="other"><no>(a)</no><block><txt break.before="0">the parent is excluded for a limited time; and</txt></block></li><li number.type="manual" unnumbered.indent="0"><li id="sec.32-ssec.2-para1.b-para2.i" guid="_8607aaa5-872f-41de-9b62-69f099cb8f7c" provision.type="other"><no>(i)</no><block><txt break.before="0">to ensure the employer’s production is not disrupted; or</txt></block></li><li id="sec.32-ssec.2-para1.b-para2.ii" guid="_3d22fe96-16fb-4b6e-a998-9f60aae1bd7f" provision.type="other"><no>(ii)</no><block><txt break.before="0">to protect the health and safety of a person in the workplace.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.32-ssec.3" guid="_bed6bf17-37a4-44ae-9247-bfd5596b5089" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0"><intref refid="sec.32-ssec.2" a period of time when the child is to work for an employer.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.33-ssec.2" guid="_3c544ea1-8ff9-48fe-9ab1-d73ea6ce57a6" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The employer of the child must not require or permit the child to work unless—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.33-ssec.2-para1.a" guid="_e86a1b1d-13d1-4516-a6ae-25ed42299de9" provision.type="other"><no>(a)</no><block><txt break.before="0">the employer engages a qualified teacher to provide the program during the program hours; and</txt></block></li><li id="sec.33-ssec.2-para1.b" guid="_4555bf2e-0e70-432c-90ff-af5ef5ab4f24" provision.type="other"><no>(b)</no><block><txt break.before="0">the employer provides an area and facilities that the qualified teacher reasonably considers are needed to provide the type="act" target.doc.id="act-2005-047" target.version.series="3accf6ab-dc22-4eaf-9ff8-18be6d19095b" check="valid"><name emphasis="yes">Education (Queensland College of Teachers) Act 2005</name></legref>.</txt></definition></deflist></block></subclause></clause><clause id="sec.34" guid="_61ef3543-a0d3-4822-a14c-eb0a4359e115" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>34</no><heading id="sec.34-he" guid="_af2e0db9-4a0c-4e00-8844-4d729cc56fec">Exposure of children under 12 weeks to particular harm</heading><subclause id="sec.34-ssec" guid="_082b5930-1b57-4bf1-813d-22a236d41e07" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="1">An employer of a child who is under 12 weeks must ensure the child is not— child to work if the employer knows, or reasonably ought to know, the child is injured or ill, and is not able to work. </txt></block><penalty id="sec.35-ssec.1-pen" guid="_19b0d686-1faf-48c3-a2e3-bd69afb92762" affected.by.uncommenced="0" provision.type="other"><block><txt break.before="1">An employer of a school-aged child who is 13 years or older must take reasonable steps to ensure the child does not leave the child’s workplace unless— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.37-ssec-para1.a" guid="_b404ebb4-ad6b-4e63-8648-46764b442c71" provision.type="other"><no>(a)</no><block><txt break.before="0">the child is in the care of a parent or an authorised person; or</txt></block></li><li id="sec.37-ssec-para1.b" guid="_1230a99f-5b89-42af-9af3-f530883fcc43" provision.type="other"><no>(b)</no><block><txt break.before="0">all of the following apply—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.37-ssec-para1.b-para2.i" guid="_334d7657-d2ed-4964-8d95-70643570b6e3" provision.type="other"><no>(i)</no><block><txt break.before="0">the child’s home is less than 10km from the child’s workplace; </txt></block></li><li id="sec.37-ssec-para1.b-para2.ii" guid="_35d231bf-1e45-4e9a-8d7a-c3fb148589ef" provision.type="other"><no>(ii)</no><block><txt break.before="0">the child’s journey home will ordinarily have the child arriving home before 6p.m.;</txt></block></li><li id="sec.37-ssec-para1.b-para2.iii" guid="_61edc008-7b32-4f8c-97f3-f553ca2b5b1a" provision.type="other"><no>(iii)</no><block><txt break.before="0">the employer has taken reasonable steps to ensure the child starts the journey home within 30 minutes after the child finishes work; or</txt></block></li></list></block></li><li id="sec.37-ssec-para1.c" guid="_e373c091-0a74-4424-9f71-de2c8db53b84" provision.type="other"><no>(c)</no><block><txt break.before="0">all of the following apply— </txt><list number.type="manual" unnumbered.indent="0"><li id="sec.37-ssec-para1.c-para2.i" guid="_6bb7e7a0-22ac-4d87-816e-f9fabd52e9a2" provision.type="other"><no>(i)</no><block><txt break.before="0">a parent of the child has given the employer written consent to allow the child to travel home alone; </txt></block></li><li id="sec.37-ssec-para1.c-para2.ii" guid="_69d1f6b0-5eb2-4dc6-8dac-fa51dcc51e67" provision.type="other"><no>(ii)</no><block><txt break.before="0">the child’s journey guid="_f46d6d15-e8b3-4919-b1f2-0718157b9c2e" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sch.3-def.midwife" guid="_2014cd40-d3ca-4298-a2e3-548253bc964d" type="definition">midwife</defterm> means a person registered under the <legref jurisd="QLD" type="act" target.doc.id="act-2009-hprnlq" target.version.series="406c67ff-adcb-4662-a846-6ab68a354f7c" check="valid"><name emphasis="no">Health Practitioner Regulation National Law</name></legref> to practise in the midwifery profession, other than as a student.</txt><historynote><txt
