main purposes of this Act are to ensure—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-para1.a" guid="_ea10fc8f-36a9-4885-9b90-39d0412df55e" provision.type="other"><no>(a)</no><block><txt break.before="0">the public records of Queensland are made, managed, kept and, if appropriate, preserved in a useable form for the benefit of present and future generations; and</txt></block></li><li id="sec.3-para1.b" guid="_55727243-f3b3-4242-b508-5005da9101cd" provision.type="other"><no>(b)</no><block><txt break.before="0">public access to records under this Act is consistent with the principles of the <legref jurisd="QLD" type="act" target.doc.id="act-2009-013" target.version.series="af4229e4-5dfa-4f09-9ecf-292a31d0bb06" check="valid"><name emphasis="yes">Right to Information Act 2009</name></legref> and the <legref jurisd="QLD" type="act" target.doc.id="act-2009-014" target.version.series="b94a9af9-b26d-44e8-af88-037ab58cf01c" <defterm id="sec.6-def.publicrecord-oc.2" guid="_e7b1f88b-e2f4-463d-86a4-70beb1b29a0d" type="definition">public record</defterm> is any of the following records made before or after the commencement of this Act—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_a7f14ba0-466b-4c94-a268-db60f838e944" provision.type="other"><no>(a)</no><block><txt break.before="0">a record made for use by, or a purpose of, a public authority, other than a Minister or Assistant Minister;</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_bd296a8e-78cc-480c-9e57-5f3dff8beffb" provision.type="other"><no>(b)</no><block><txt break.before="0">a record received or kept by a public authority, other than a Minister or Assistant Minister, in the exercise of its statutory, administrative or other public responsibilities or for a related purpose;</txt></block></li><li id="sec.6-ssec.1-para1.c" guid="_61177e9e-4e55-4623-a4ef-0bddae92ac7d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A public authority must—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.1-para1.a" guid="_9faa6fd1-fe85-4219-bacf-11bd0a762c39" provision.type="other"><no>(a)</no><block><txt break.before="0">make and keep full and accurate records of its activities; and</txt></block></li><li id="sec.7-ssec.1-para1.b" guid="_27027f4f-0d20-483a-a3ff-80a80144b8a1" provision.type="other"><no>(b)</no><block><txt break.before="0">have regard to any relevant policy, standards and guidelines made by the archivist about the making and keeping of public records.</txt></block></li></list></block></subclause><subclause id="sec.7-ssec.2" guid="_a0cd693b-67cd-4bf7-9451-656946a45da8" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The executive officer of a public authority must ensure the public authority complies with <intref refid="sec.7-ssec.1" target.guid="_61177e9e-4e55-4623-a4ef-0bddae92ac7d" check="valid">subsection&#160;(1)</intref>.</txt></block></subclause><subclause id="sec.7-ssec.3" guid="_6bdb6c63-c718-4e8d-ae99-87ee2fdf28b8" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.7-ssec.3-def.executiveofficer_" guid="_6212bc9c-b958-4506-abe7-397039c97272" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.7-ssec.3-def.executiveofficer" guid="_10b2dbd9-e3d6-4656-a4d6-58338d92b89e" type="definition">executive officer</defterm>, of a public authority, means—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.3-def.executiveofficer-para1.a" guid="_c2add4d0-8079-4396-8d9f-f2a67e923bf3" provision.type="other"><no>(a)</no><block><txt break.before="0">if the public authority is a department—the chief executive of the department; or</txt></block></li><li id="sec.7-ssec.3-def.executiveofficer-para1.b" guid="_16a68669-ef0e-4ac0-b306-57aeb56b8aee" provision.type="other"><no>(b)</no><block><txt break.before="0">if the public authority is a local government—the chief executive officer of the local government; or</txt></block></li><li id="sec.7-ssec.3-def.executiveofficer-para1.c" guid="_4a7d3d9b-c175-4be2-ab7b-e73daa00e798" provision.type="other"><no>(c)</no><block><txt break.before="0">if the public authority is not an authority mentioned in <intref refid="sec.7-ssec.3-def.executiveofficer-para1.a" target.guid="_c2add4d0-8079-4396-8d9f-f2a67e923bf3" check="valid">paragraphs&#160;(a)</intref> and <intref refid="sec.7-ssec.3-def.executiveofficer-para1.b" target.guid="_16a68669-ef0e-4ac0-b306-57aeb56b8aee" check="valid">(b)</intref>—a person (whatever the person’s position is called) who is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-ssec.3-def.executiveofficer-para1.c-para2.i" guid="_49b6514b-daa8-459d-906f-e9e9810fee22" provision.type="other"><no>(i)</no><block><txt break.before="0">a member of the governing body of the public authority; or</txt></block></li><li id="sec.7-ssec.3-def.executiveofficer-para1.c-para2.ii" guid="_335969ad-90c9-4ab5-85c8-dc7aafc8ed32" provision.type="other"><no>(ii)</no><block><txt break.before="0">concerned with, or takes part in, the public authority’s management.</txt></block></li></list></block></li></list></definition></deflist></block></subclause></clause><clause id="sec.8" guid="_d4aa8de0-5639-4793-8e15-76997fc15f89" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_5e033e06-3b8f-4908-af70-12cd360214f9">Custody and preservation of public records</heading><subclause id="sec.8-ssec.1" guid="_a625b25e-f71f-458c-888a-a6a5a981ed2d" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A public authority is responsible for ensuring the safe custody and preservation of records in its possession.</txt></block></subclause><subclause id="sec.8-ssec.2" guid="_f432cdb8-0069-48d3-8250-39e27f95b770" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Without limiting <intref refid="sec.8-ssec.1" target.guid="_a625b25e-f71f-458c-888a-a6a5a981ed2d" check="valid">subsection&#160;(1)</intref>, an arrangement between a public authority and another person for the person to have custody of a record of the public authority must include arrangements for the safe keeping, proper preservation and return of the record.</txt></block></subclause><subclause id="sec.8-ssec.3" guid="_38c3b8fa-0595-4102-af9e-655128eb287e" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">If a public authority ceases to exist, the records of the public authority must be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.8-ssec.3-para1.a" guid="_97dcc6ac-ea81-411e-85fe-f8d8ac71da8b" provision.type="other"><no>(a)</no><block><txt break.before="0">if the functions of the public authority are to be carried out by another public authority—given to the other public authority; or</txt></block></li><li id="sec.8-ssec.3-para1.b" guid="_47935cf3-3390-4c7c-be91-78eab4f51cb2" provision.type="other"><no>(b)</no><block><txt break.before="0">if the functions of the public authority are not to be carried out by another public authority—given to the public authority that is the relevant public authority under a regulation; or</txt></block></li><li id="sec.8-ssec.3-para1.c" guid="_4407b881-cedf-4664-907f-5bb4d3abc797" provision.type="other"><no>(c)</no><block><txt break.before="0">in any other case—given to the archives or disposed of in accordance with a decision of the archivist.</txt></block></li></list></block></subclause><subclause id="sec.8-ssec.4" guid="_e51a85c9-9116-4c36-b2d2-941100d0f44c" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">If a function or power of a public authority (the <defterm id="sec.8-def.originalpublicauthority" guid="_7db06d7f-82f7-4b3e-bd6a-8fac03e447f8" type="definition">original public authority</defterm>) is transferred to another public authority, the records of the original public authority relating to the function or power must be given to the other public authority.</txt></block></subclause></clause><clause id="sec.9" guid="_16a90407-34a0-482c-bad0-278de292ad5e" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>9</no><heading id="sec.9-he" guid="_9d56bbc7-e229-4c14-8b0b-47285adf603d">Ownership of public records</heading><subclause id="sec.9-ssec.1" guid="_4853749e-75c5-4f2d-a657-c0cd2e0ee8f0" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If a public record is a record of the State or a State instrumentality, ownership of the record vests in the State.</txt></block></subclause><subclause id="sec.9-ssec.2" guid="_242aa8b4-891f-4b8e-b7fa-28a62f5c9620" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Ownership of public records of another public authority vests in—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.9-ssec.2-para1.a" guid="_5091cdf8-b759-46d9-aa37-6588c1038ece" provision.type="other"><no>(a)</no><block><txt break.before="0">if the records are in the authority’s possession—the authority; or</txt></block></li><li id="sec.9-ssec.2-para1.b" guid="_2aa94026-2204-49be-8ff2-212d1f376498" provision.type="other"><no>(b)</no><block><txt break.before="0">in any other case—the State.</txt></block></li></list></block></subclause><subclause id="sec.9-ssec.3" guid="_95f6fb34-36f7-4377-ac67-4731d01de25f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.9-ssec.3-def.Stateinstrumentality_" guid="_5c336891-3352-4d0b-a6da-7c6d34e757a4" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.9-ssec.3-def.Stateinstrumentality" guid="_cfd78154-4564-44c1-bb4e-4e8dc1b6c519" type="definition">State instrumentality</defterm> means a public authority other than a local government.</txt></definition></deflist></block></subclause></clause><clause id="sec.10" guid="_e05948ba-b7e6-49cf-8d32-334a7dad3194" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>10</no><heading id="sec.10-he" guid="_9ac7008b-bb06-4f1e-b105-4e503ccd9f8a">Public records more than 25 years old</heading><subclause id="sec.10-ssec.1" guid="_cd433c43-f923-4572-aa41-a068fe8729d7" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">If a public record in a public authority’s possession is more than 25 years old, the public authority—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.1-para1.a" guid="_2ecb5950-df61-47a6-a3dc-25940eb880ac" provision.type="other"><no>(a)</no><block><txt break.before="0">must give written notice of the record’s existence to the archivist; and</txt></block></li><li id="sec.10-ssec.1-para1.b" guid="_273698e6-5b3d-49d1-9c6e-9a38fc5afad7" provision.type="other"><no>(b)</no><block><txt break.before="0">if the public authority no longer needs the record to be readily available in its own custody, may, if authorised by the archivist, give the record to the archives.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.2" guid="_2b79e6aa-40f3-4154-8281-07b2ecad480e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If the record is not given to the archives under <intref refid="sec.10-ssec.1" target.guid="_cd433c43-f923-4572-aa41-a068fe8729d7" check="valid">subsection&#160;(1)</intref><intref refid="sec.10-ssec.1-para1.b" target.guid="_273698e6-5b3d-49d1-9c6e-9a38fc5afad7" check="valid">(b)</intref>, the archivist may take possession, or a copy, of the record or give directions about the storage of the record.</txt></block></subclause><subclause id="sec.10-ssec.3" guid="_ba4abce2-1d1e-4a74-b4d9-a99c4c72c84f" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A public record in the custody of the archives that is more than 25 years old may be removed from the archives only if the archivist is satisfied—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-ssec.3-para1.a" guid="_7a07a6a1-6239-466e-954d-53ea227f4ad0" provision.type="other"><no>(a)</no><block><txt break.before="0">the record is reasonably needed by the public authority; or</txt></block></li><li id="sec.10-ssec.3-para1.b" guid="_b9222fa7-6847-49bb-b24a-24356133cab0" provision.type="other"><no>(b)</no><block><txt break.before="0">there is another adequate reason for allowing it to be removed.</txt></block></li></list></block></subclause><subclause id="sec.10-ssec.4" guid="_e20fbd8a-242b-4671-9cb7-c3af45443609" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">This section does not prevent the disposal of a public record by, or under an authority given by, the archivist.</txt></block></subclause></clause><clause id="sec.11" guid="_30cf8ebf-d4f7-4a2c-befe-f06a78e4f87a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_55a70edb-cebf-4e19-8469-8fa145476bd0">Transfer of other public records to archives</heading><subclause id="sec.11-ssec.1" guid="_12317a3c-c5e5-450b-990e-6482b848bff5" public record to be readily available in its own custody, it may, if authorised by the archivist, give the record to the archives.</txt></block></subclause><subclause id="sec.11-ssec.3" guid="_88810be1-10e3-42ae-b2e4-2216364dfd68" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The archivist must ensure all public records given to the old</heading><subclause id="sec.12-ssec.1" guid="_72347474-1fae-431f-bdf8-d631d83b6cfa" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A person must not damage a public record more than 30 years old, unless the person has a reasonable excuse.</txt></block><penalty id="sec.12-ssec.1-pen" guid="_af21e128-eb1e-4d81-8815-ed2b5b8802c0"><block><txt break.before="1">Maximum penalty—100 penalty units.</txt></block></penalty></subclause><subclause id="sec.12-ssec.2" guid="_50243b17-e764-4edc-9822-c536c3a16c33" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">This section applies to a public record whether or not it is in the custody of the archives.</txt></block></subclause><subclause id="sec.12-ssec.3" guid="_31ac18be-8418-420a-999c-4d0d4eb55639" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">This section does not apply to a person who is a member of the staff of the archives to the extent the person necessarily damages a public record in carrying out an accepted archival or conservation practice in relation to the record.</txt></block></subclause><subclause id="sec.12-ssec.4" guid="_a0080570-7359-415d-a242-17b75988cb90" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In <intref refid="sec.12-ssec.1" target.guid="_72347474-1fae-431f-bdf8-d631d83b6cfa" check="valid">subsection&#160;(1)</intref>—</txt><deflist><definition id="sec.12-ssec.4-def.damage_" guid="_a3f1bd5e-3643-4497-b98e-ea5aaf331b34" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.12-ssec.4-def.damage" guid="_48bffc48-cf41-4148-9ccb-5fa5442ab629" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies if a public record is an article or material from which information can be produced or made available only with the use of particular equipment or information technology.</txt></block></subclause><subclause id="sec.14-ssec.2" is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.15-para1.a" guid="_89522592-a8c0-4eb6-8a07-6dcb35e9d604" provision.type="other"><no>(a)</no><block><txt break.before="0">the public authority that gave the public record to the archives; or</txt></block></li><li id="sec.15-para1.b" guid="_497a00f3-30eb-4c06-8ff3-13caea8a0af4" provision.type="other"><no>(b)</no><block><txt break.before="0">if the public authority that gave the record to the archives no longer exists, but there is another public authority carrying out the functions of the former authority—the other authority; or</txt></block></li><li id="sec.15-para1.c" guid="_7de1b62d-f555-45e7-ac77-6b50707f9200" provision.type="other"><no>(c)</no><block><txt break.before="0">if the record relates to a function or power of a public authority that has been transferred to another public authority—the other authority; or</txt></block></li><li id="sec.15-para1.d" guid="_bbd2ec81-ceef-4334-889d-88867937c4b1" break.before="0">If a public record mentioned in <intref refid="sec.16-ssec.1" target.guid="_c9b1ff2c-6d12-4b14-baf4-53683b816974" check="valid">subsection&#160;(1)</intref> or <intref refid="sec.16-ssec.1A" target.guid="_cb926a4d-fdb8-4334-b260-ee38ef5c6827" check="valid">(1A)</intref> is also classified by the responsible public authority for the record as containing information about the personal affairs of an individual, whether living or dead, the <defterm id="sec.16-def.restrictedaccessperiod-oc.4" guid="_f37f0af8-515e-4d9f-bf9b-905f3b4de691" type="definition">restricted the archivist must allow the applicant access to the record.</txt></block></subclause><subclause id="sec.18-ssec.2" guid="_be1045b5-ac9a-4857-a796-d4c0c2fb2c1e" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">However, if the restricted access period has not ended, the applicant may have access to the public record only if—</txt><list procedures for being given access to documents and about reviewing decisions about access under those Acts.</txt></block></note></block></li><li id="sec.18-ssec.2-para1.b" guid="_010d39db-3f49-4da7-ae77-fc2a10ec1968" provision.type="other"><no>(b)</no><block><txt break.before="0">the responsible public authority gives the archivist a written notice stating—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.2-para1.b-para2.i" guid="_bc1c88b0-131e-4664-8c49-a6f34d9f6ee4" provision.type="other"><no>(i)</no><block><txt break.before="0">the public authority has classified the record as a record to which unrestricted access is allowed; or</txt></block></li><li id="sec.18-ssec.2-para1.b-para2.ii" guid="_810be5d0-7a43-45ab-bad1-e2b3bc4c4ff4" provision.type="other"><no>(ii)</no><block><txt break.before="0">access to the record may be given on conditions stated in the available for purchase by members of the community under arrangements made by a public authority; or</txt></block></li><li id="sec.18-ssec.3-para1.c" guid="_820fc002-0ada-4e04-a022-303098f04ff2" provision.type="other"><no>(c)</no><block><txt break.before="0">information in the record can be produced or made available only with the use of particular equipment or information technology and the target.doc.id="act-2009-013" target.version.series="af4229e4-5dfa-4f09-9ecf-292a31d0bb06" check="invalid">(1)</legref><legref jurisd="QLD" type="act" refid="sec.10-ssec.1-para1.h" target.doc.id="act-2009-013" target.version.series="af4229e4-5dfa-4f09-9ecf-292a31d0bb06" check="invalid">(h)</legref>, <legref jurisd="QLD" type="act" refid="sec.10-ssec.1-para1.i" target.doc.id="act-2009-013" target.version.series="af4229e4-5dfa-4f09-9ecf-292a31d0bb06" check="invalid">(i)</legref> or <legref jurisd="QLD" type="act" refid="sec.10-ssec.1-para1.j" target.doc.id="act-2009-013" target.version.series="af4229e4-5dfa-4f09-9ecf-292a31d0bb06" check="invalid">(j)</legref> because its disclosure could reasonably be expected to—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.18-ssec.5-para1.a-para2.i" guid="_8b92fc55-8ff0-4299-b2a2-959b604be467" provision.type="other"><no>(i)</no><block><txt break.before="0">endanger the security of a building, structure or vehicle; or</txt></block></li><li id="sec.18-ssec.5-para1.a-para2.ii" guid="_40e9e272-5a98-4018-9c07-9ec55405a27d" provision.type="other"><no>(ii)</no><block><txt break.before="0">prejudice a system or procedure for the protection of persons, property or the environment; or</txt></block></li><li id="sec.18-ssec.5-para1.a-para2.iii" guid="_7dd4d4f3-7a28-483d-8ede-874b0f1f95a1" provision.type="other"><no>(iii)</no><block><txt break.before="0">facilitate a person’s escape from lawful custody; or</txt></block></li><li id="sec.18-ssec.5-para1.a-para2.iv" guid="_3566097b-eac9-4ce4-b75f-32943089b9d9" provision.type="other"><no>(iv)</no><block><txt break.before="0">damage the security of the target.guid="_2a66c52a-8b2e-4003-9804-b6b1aca5d4ff" check="valid">section&#160;16</intref><intref refid="sec.16-ssec.3" target.guid="_f3e72913-660a-4088-9dad-cafe5522c823" provision.type="other"><no>(2)</no><block><txt break.before="0">The responsible public authority for the record may, by written notice given to the archivist, change the restricted access public record may be given to the applicant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.1-para1.a" guid="_b2308543-0d3d-4953-8c9b-0cb648d106e7" provision.type="other"><no>(a)</no><block><txt break.before="0">by allowing the applicant a reasonable opportunity to inspect the record; or</txt></block></li><li id="sec.20-ssec.1-para1.b" guid="_9f2a84fa-370b-45e8-8aac-482caee87f18" provision.type="other"><no>(b)</no><block><txt break.before="0">by giving the applicant a copy of the record; or</txt></block></li><li id="sec.20-ssec.1-para1.c" guid="_5b943680-8bb6-471b-ab34-2a701fd99763" provision.type="other"><no>(c)</no><block><txt break.before="0">if the record is one to which <intref refid="sec.20-ssec.2" target.guid="_982f1674-010f-4216-90ea-e29111dc00dc" check="valid">subsection&#160;(2)</intref>, <intref refid="sec.20-ssec.3" target.guid="_edce794b-59b3-4185-9587-f0dfbd2e8b97" check="valid">(3)</intref> or <intref refid="sec.20-ssec.4" target.guid="_21f2f272-8a6c-4aad-99fc-58ac5ac5316f" check="valid">(4)</intref> applies—by the form of access stated in the subsection.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.2" guid="_982f1674-010f-4216-90ea-e29111dc00dc" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">Access may be given by making arrangements for the applicant to hear the sounds or view the images or writings if the record is something from which sounds or visual images or writings are capable of being reproduced.</txt></block></subclause><subclause id="sec.20-ssec.3" guid="_edce794b-59b3-4185-9587-f0dfbd2e8b97" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">Access may be given by giving the applicant a written transcript of the words recorded or contained in the record if the record is one—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.3-para1.a" guid="_e213d547-0808-4f06-a245-f56232538182" provision.type="other"><no>(a)</no><block><txt break.before="0">by which words are recorded in a way in which they are capable of being reproduced in the form of sound; or</txt></block></li><li id="sec.20-ssec.3-para1.b" guid="_a0d6f647-d64d-4b68-80e8-fadf8576e5be" provision.type="other"><no>(b)</no><block><txt break.before="0">in which words are contained in the form of shorthand writing or in a codified form.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.4" guid="_21f2f272-8a6c-4aad-99fc-58ac5ac5316f" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">Access may be given by giving the applicant a written document containing the information if—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.4-para1.a" guid="_bd0cc6bf-b0b1-42d5-8d79-084181489de6" provision.type="other"><no>(a)</no><block><txt break.before="0">the record is not a written record; and</txt></block></li><li id="sec.20-ssec.4-para1.b" guid="_5000e758-c216-4059-b294-7e563642e038" provision.type="other"><no>(b)</no><block><txt break.before="0">the archivist or the responsible public authority could create a written document containing the information in the record using equipment that is usually available to it for retrieving or collating electronically stored information.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.5" guid="_d386ca45-2afc-4239-abfd-b9233ad27d88" affected.by.uncommenced="0" provision.type="other"><no>(5)</no><block><txt break.before="0">If the applicant asks for access in a particular and reasonably practical way, access must be given in that way.</txt></block></subclause><subclause id="sec.20-ssec.6" guid="_0ce8b6ec-0313-4b08-a075-c5946bd6be32" affected.by.uncommenced="0" provision.type="other"><no>(6)</no><block><txt break.before="0">However, access may be given in another way decided by the archivist if giving access to the record in the way requested by the applicant—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.6-para1.a" guid="_a62f8fe4-fbd4-408f-8022-3a08ada83040" provision.type="other"><no>(a)</no><block><txt break.before="0">would interfere unreasonably with the operations of the archives or the responsible public authority; or</txt></block></li><li id="sec.20-ssec.6-para1.b" guid="_51f87d99-9f38-4a97-ae51-b52809647358" provision.type="other"><no>(b)</no><block><txt break.before="0">would be detrimental to the preservation of the record; or</txt></block></li><li id="sec.20-ssec.6-para1.c" guid="_d00b9848-a806-450e-8466-7cfc3f6f7a74" provision.type="other"><no>(c)</no><block><txt break.before="0">would be inappropriate, having regard to the physical nature of the record; or</txt></block></li><li id="sec.20-ssec.6-para1.d" guid="_74dc9883-a9e5-4dfd-846a-33d1a303153e" provision.type="other"><no>(d)</no><block><txt break.before="0">would involve an infringement of copyright of a person other than the State.</txt></block></li></list></block></subclause><subclause id="sec.20-ssec.7" guid="_12f48f78-e4ce-4c9b-8054-aee33e7ceb82" affected.by.uncommenced="0" provision.type="other"><no>(7)</no><block><txt break.before="0">The archivist may—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.20-ssec.7-para1.a" guid="_b2800879-7489-4876-9ba1-a4110284dc68" provision.type="other"><no>(a)</no><block><txt break.before="0">impose reasonable conditions on access to a public record; and</txt></block></li><li guid="_2da61500-4c5b-4a89-b2a3-c8a919324f66" provision.type="other"><no>(b)</no><block><txt break.before="0">to identify public records of enduring value and require that they be retained in a useable form, whether or not the records are in the custody of the archives;</txt></block></li><li id="sec.24-para1.c" guid="_49eee0b1-1247-458d-8c1a-50c0b9c10c55" provision.type="other"><no>(c)</no><block><txt break.before="0">to make decisions about the disposal of public records;</txt></block></li><li id="sec.24-para1.d" guid="_314c2426-2f83-4389-a56b-44b816042043" provision.type="other"><no>(d)</no><block><txt break.before="0">to manage, keep and preserve records for public authorities and other entities;</txt></block></li><li id="sec.24-para1.e" guid="_62ee6041-6944-40d7-a0bb-c206106b7245" provision.type="other"><no>(e)</no><block><txt break.before="0">to provide public access to public id="sec.25-ssec.1" guid="_ff5a4f05-0778-4498-87af-c35cf4031188" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The powers of the archivist include the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.25-ssec.1-para1.a" guid="_46eee975-cbf1-4fda-814a-4bb55dc16035" provision.type="other"><no>(a)</no><block><txt break.before="0">to establish and manage repositories and other facilities to store, preserve, exhibit and make available for use public records and other materials;</txt></block></li><li id="sec.25-ssec.1-para1.b" guid="_d2f08a6c-edd7-4926-b81c-aa18fe81a57c" provision.type="other"><no>(b)</no><block><txt break.before="0">to copy public records and other materials;</txt></block></li><li id="sec.25-ssec.1-para1.c" guid="_fd54239e-ea93-46ce-8b9b-88ec3b1a6e4f" provision.type="other"><no>(c)</no><block><txt break.before="0">to publish public records and other materials;</txt></block></li><li id="sec.25-ssec.1-para1.d" guid="_69ba0e21-6a21-44be-817c-1f316511ab1e" provision.type="other"><no>(d)</no><block><txt break.before="0">to acquire records by purchase, gift, bequest or loan;</txt></block></li><li id="sec.25-ssec.1-para1.e" guid="_bbf5af0f-ace9-45fa-8c95-5689a2088723" provision.type="other"><no>(e)</no><block><txt break.before="0">to authorise the disposal of particular public records or classes of public records;</txt></block></li><li id="sec.25-ssec.1-para1.f" guid="_5aa5eddc-e6ef-4533-8d23-0f85e702e06f" provision.type="other"><no>(f)</no><block><txt break.before="0">to make policy, standards and guidelines about the making, keeping, preserving, managing and disposing of public affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">The archivist may authorise the disposal of particular public records or classes of public records if the public authority that has control of the records has applied for, or consented to, the disposal of the records.</txt></block></subclause><subclause id="sec.26-ssec.2" break.before="0">the purposes of this Act.</txt></block></li></list></block></subclause><subclause id="sec.26-ssec.3" guid="_a360d357-208c-4636-9159-b166b3db2a48" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">To remove any doubt, it is declared that the registrar or other officer of a court with responsibility for official records of the court break.before="0">The archivist may make an arrangement with a public authority that the authority will store its electronic records at its premises rather than the archives.</txt></block></li><li id="sec.28-note-para1.2" guid="_c659ecd6-4b9d-4178-b1ce-ed5c6f910b94" provision.type="other"><no>2</no><block><txt break.before="0">The archivist may make an arrangement with a public authority that creates its own permanent archives that the authority may store its public records in the authority’s archives rather than the
