affected.by.uncommenced="0"><no>Division 1</no><heading id="pt.2-div.1-he" guid="_b0837518-e87b-4b24-b52b-99abeea0f9cc">General requirements</heading><clause id="sec.3" guid="_7ae5d56f-5444-430a-ae4f-57a15e030ac0" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>3</no><heading id="sec.3-he" guid="_9c6d3ce8-767a-47fe-b90e-57500cfc7045">Format of plans</heading><subclause id="sec.3-ssec.1" guid="_7e43df6b-e95d-44d9-8634-977e676d4481" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A plan (the <defterm id="sec.3-def.subjectplan" guid="_7976f6ab-d41d-4ed7-9f88-e69ba18f5ef8" type="definition">subject plan</defterm>) must be—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.a" guid="_1e9312cc-6f89-42d3-9653-4c24e2d01450" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">in the approved form; and</txt></block></li><li id="sec.3-ssec.1-para1.b" guid="_e4ec4ae0-574a-4e1d-8a3f-4e307b294cf4" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">printed on paper that is—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.1-para1.b-para2.i" guid="_0fb77b25-9a8d-4789-b1e1-efce2365b504" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">A3; and</txt></block></li><li id="sec.3-ssec.1-para1.b-para2.ii" guid="_485799a0-299f-4c79-8c08-9bc148bdbb8d" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">of a density of at least 130gsm; and</txt></block></li></list></block></li><li id="sec.3-ssec.1-para1.c" guid="_a52a99c5-d73f-4cb3-b422-95b369f489d0" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">numbered as required by a plan direction relevant to the subject plan.</txt></block></li></list></block></subclause><subclause id="sec.3-ssec.2" guid="_83852a6c-4c4e-45e8-bfdd-a30554c78ec7" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">An alteration on a plan must be made by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-para1.a" guid="_cc4d6dfd-162b-4d99-a908-3b99bbadd02a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">striking through the printing or writing being altered so the original printing or writing is still legible; and</txt></block></li><li id="sec.3-ssec.2-para1.b" guid="_313fead3-ff9b-438b-a11a-13079d6bc061" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">having each of the following persons initial the alteration—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.3-ssec.2-para1.b-para2.i" guid="_7bfb83fb-6a2c-4187-8aad-d7de8e9c0fde" provision.type="other" affected.by.uncommenced="0"><no>(i)</no><block><txt break.before="0">the surveyor who prepared the plan;</txt></block></li><li id="sec.3-ssec.2-para1.b-para2.ii" guid="_7722747c-05a2-458d-8969-7f93547aa817" provision.type="other" affected.by.uncommenced="0"><no>(ii)</no><block><txt break.before="0">if the alteration affects a boundary of land—the appropriate authority and the registered owner of the land.</txt></block></li></list></block></li></list></block></subclause><subclause id="sec.3-ssec.3" guid="_4ad1a6ed-1568-4c0d-8833-bbd967ba71a7" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.3-ssec.3-def.plandirection_" guid="_1b0a52c3-b8aa-401f-b99f-078e07dd2842" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.3-ssec.3-def.plandirection" guid="_1b83d9ff-c234-4731-a9c2-42656c7c4fe0" type="definition">plan direction</defterm> means a direction of the registrar of titles under the <legref target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="valid" jurisd="QLD" type="act"><name emphasis="yes">Land Title Act 1994</name></legref>, <legref refid="sec.10" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" target.guid="_f35c3d27-53f3-4cd5-a57d-014d8f7cfe21" check="valid" jurisd="QLD" type="act">section&#160;10</legref><legref refid="sec.10-ssec.1" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" check="invalid" jurisd="QLD" type="act">(1)</legref><legref refid="sec.10-ssec.1-para1.b" target.doc.id="act-1994-011" target.version.series="d93aa9d4-b864-42f4-88c5-b51b98fee2e2" given to an appropriate authority for approval must be accompanied by an application for approval in the approved form.</txt></block></clause><clause id="sec.5" guid="_f541fb94-c602-4c04-b4a4-e1c5e8168835" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>5</no><heading id="sec.5-he" guid="_ad324030-f7a2-4c01-8e77-8493c7820699">Defining a stratum lot</heading><subclause id="sec.5-ssec.1" guid="_6d8eb8d1-7163-4366-b3fe-554486822241" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">A stratum lot must be defined by regular planes, that may be horizontal or inclined, fixed by reference to levels in relation to Australian height datum.</txt></block></subclause><subclause id="sec.5-ssec.2" guid="_83938d3f-3863-4427-a34b-6ffcc6fd3a15" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">If a stratum lot is defined by an inclined plane, elevations or sections must be shown, identifying the plane with enough information to enable the level of any point on the plane to be calculated.</txt></block></subclause><subclause id="sec.5-ssec.3" guid="_9059ce89-383d-4321-a309-903e6a4b4a93" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">A stratum lot must be illustrated in orthographic form or isometric form.</txt></block></subclause><subclause id="sec.5-ssec.4" guid="_d900b250-1ee5-42ea-89fa-77559a31fdb6" affected.by.uncommenced="0" provision.type="other"><no>(4)</no><block><txt break.before="0">In this section—</txt><deflist><definition id="sec.5-ssec.4-def.Australianheightdatum_" guid="_3f8c599a-f64b-4f26-b438-c6e23fc31823" affected.by.uncommenced="0"><txt break.before="1"><defterm id="sec.5-ssec.4-def.Australianheightdatum" guid="_00453a26-9414-4a6b-80eb-11e6dc12ab8e" type="definition">Australian height datum</defterm> means the Australian height datum adopted by the National Mapping Council of Australia for referencing a level or height back to a standard base level.</txt></definition></deflist></block></subclause></clause><clause id="sec.6" guid="_c833b3b8-86cb-4db3-b10a-b4b970aa9cff" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>6</no><heading id="sec.6-he" guid="_8e9486dd-5919-43e3-a852-e54e3db10987">What particular plans are to include</heading><subclause id="sec.6-ssec.1" guid="_8fc08fb4-b0f6-4367-bf14-2f366d103d8a" affected.by.uncommenced="0" provision.type="other"><no>(1)</no><block><txt break.before="0">This section applies to a plan other than—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.1-para1.a" guid="_3da5b5c5-e7cc-4750-ad74-41ddab7792ed" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">an easement plan; or</txt></block></li><li id="sec.6-ssec.1-para1.b" guid="_0f1983d6-f094-4971-a32a-b6fea0afff15" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a plan for the subdivision or amalgamation of land as mentioned in <legref type="subordleg" refid="sec.41" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">section&#160;41</legref><legref type="subordleg" refid="sec.41-ssec.4" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">(4)</legref> of the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" jurisd="QLD">Act</legref>.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.2" guid="_9c6e6139-535e-478b-bfa3-4d92a85c200d" affected.by.uncommenced="0" provision.type="other"><no>(2)</no><block><txt break.before="0">The plan must include each of the following—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.6-ssec.2-para1.a" guid="_a2c93e9d-a940-44e2-b95c-501257f78b4a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">a certificate by the surveyor who prepared the plan;</txt></block></li><li id="sec.6-ssec.2-para1.b" guid="_e9357aa4-4230-4c78-8fc9-9e943b03dcbb" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">a certificate by the registered owner of the freehold estate in the land the subject of the plan;</txt></block></li><li id="sec.6-ssec.2-para1.c" guid="_838bf444-6f1d-4c1c-855c-ca06638b8cd0" provision.type="other" affected.by.uncommenced="0"><no>(c)</no><block><txt break.before="0">an approval by the appropriate authority;</txt></block></li><li id="sec.6-ssec.2-para1.d" guid="_71b1fa6b-407c-48df-a028-fb9f8da7a6d6" provision.type="other" affected.by.uncommenced="0"><no>(d)</no><block><txt break.before="0">if the plan is required under <intref refid="pt.2-div.2" target.guid="_bed245b1-fffa-4f33-b32e-7aa33763188b" check="valid">division&#160;2</intref> to include another thing—the other thing.</txt></block></li></list></block></subclause><subclause id="sec.6-ssec.3" guid="_8f13ea16-2f3c-46c6-8fc9-29ad0671b520" affected.by.uncommenced="0" provision.type="other"><no>(3)</no><block><txt break.before="0">The certificates and approval mentioned in <intref refid="sch.2-def.surveyor_" target.guid="_c8ac9e4b-5e77-4868-b702-8e5463c48317" check="valid">subsection&#160;(2)</intref> must be in the approved form.</txt></block></subclause></clause><clause id="sec.7" guid="_2248309e-2419-43ab-9cb1-c96335b7e3a3" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>7</no><heading id="sec.7-he" guid="_047efdb2-94e6-4db4-aa54-1d8ea3b783f6">Signing plans</heading><block><txt break.before="1">A plan required to be signed by an appropriate authority must be signed—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.7-para1.a" guid="_1994a353-21c1-4382-8386-a78ec80f076a" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the appropriate authority is the corporation—by the corporation manager; or</txt></block></li><li id="sec.7-para1.b" guid="_a11d0390-d87d-40ea-9811-3313e803418b" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the appropriate authority is the council—by the council’s chief executive officer.</txt></block></li></list></block></clause><clause id="sec.8" guid="_6d777360-2f22-4a77-9f0c-41cd2d5cc49a" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>8</no><heading id="sec.8-he" guid="_92c0d532-4358-486c-a81c-b713b2c58994">Registrar of titles to record particulars of plans</heading><block><txt break.before="1">The registrar of titles must record, in the freehold land register, particulars of each plan that is required to be registered under the <legref type="subordleg" target.doc.id="UNKNOWN" check="invalid" break.before="1">The registrar of titles must not register a plan unless it is accompanied by a consent, in the approved form, given by—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.10-para1.a" guid="_7297ce0d-22b4-4135-831e-d8934ee4b840" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">if the plan affects common property comprised in a leasehold building units plan—the body corporate of the leasehold building units plan; or</txt></block></li><li id="sec.10-para1.b" guid="_9e5af889-4e43-4d3d-a4d8-9224400c0774" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">if the plan affects any other land—the registered lessee, and any registered mortgagee, of the leasehold estate in the affected land.</txt></block></li></list></block><historynote><txt break.before="1"><b>s&#160;10</b> amd <legref target.doc.id="act-2021-012" affected.by.uncommenced="0" spent.amends="0" provision.type="other"><no>11</no><heading id="sec.11-he" guid="_aa3328cd-7efa-4693-9d6d-125c2eb497bb">Stratum plan</heading><block><txt break.before="1">A stratum plan must include 1 or more sheets showing—</txt><list number.type="manual" unnumbered.indent="0"><li id="sec.11-para1.a" guid="_1ac5b7a8-8b89-4443-a8e2-15ff9a28c8b8" provision.type="other" affected.by.uncommenced="0"><no>(a)</no><block><txt break.before="0">the boundaries of the land intended to be subdivided by the stratum plan; and</txt></block></li><li id="sec.11-para1.b" guid="_f488b119-c3dd-46e2-88f3-2280cc420157" provision.type="other" affected.by.uncommenced="0"><no>(b)</no><block><txt break.before="0">the precise dimensions and location of—</txt><list
